T17R-V-11026/98/2016-3rrg;a- (wr-l)] MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 19th May, 2017 S.O. 1636 (E).—In exercise of the powers conferred by sub-section (I) of Section 43 of the Arms Act, 1959 (54 of 1959), the Central Government hereby directs that the powers and functions exercisable and performed by it under sub-section (1) of section (5), clauses (b) and (c) of section 7 and Chapter III of the Arms Act, 1959, shall also be exercised and performed by the Secretary to the Government of India in the Ministry of Commerce and Industry, Department of Industrial Policy and Promotion, in respect of the category of arms and ammunition and defence items as specified under columns (2) and (3) of the Schedule below, subject to the following conditions, namely:—

(a) that the Secretary, Department of Industrial Policy and Promotion shall, in the exercise and performance of powers and functions under the said sections, be subject to the supervision and control of the Central Government in the Ministry of Home Affairs:

(b) that the Secretary, Department of Industrial Policy and Promotion shall observe the policies and instructions laid down by the Central Government in the Ministry of Home Affairs and shall not enunciate any new policy or issue instructions in relation thereto without the prior consent of the Central Government in the Ministry of Home Affairs; and

(c) that the Central Government may revoke such delegation of powers and functions or may itself exercise or perform the powers or functions under the said sections, if in its opinion such a course of action is necessary in the public interest.

(i) Ground vehicles, as follows:—

(a) ground vehicles, namely, tanks and other military armoured or armed vehicles and military vehicles fitted with mountings for arms or equipment for mine laying or the launching of munitions includes all tracked and wheeled self propelled armoured and non-armoured weapon systems and trailers for towed and static weapon systems;

(b) other ground vehicles, namely, all-wheel drive vehicles capable of off road use which have been manufactured or fitted with materials or components to provide Ballistic protection to level III (NIJ 0108.01.

(c) September 1985, or comparable national standard or above) with mountings for arms or equipment for mine laying specially designed for military use;

amphibious, hovercrafts and deep water fording vehicles for military use;

(ii) Cryogenic and superconductive equipment especially designed or configured to be installed in military vehicle.

(ii) Defence aircraft, space craft and parts thereof.

Aircraft including helicopters, lighter-than-air vehicle, Unmanned Aerial Vehicles, Remotely Piloted Vehicles, autonomous programmable vehicles, unmanned lighter than air vehicle (including all variety of manned and unmanned airborne vehicles, target systems, loitering missiles, drones, balloons, blimps, aerostat, parachutes, paragliders, ground effect machines, air cushion vehicles or hovercraft, Unmanned Aerial Vehicles and launchers, designed for military application).

(iii) Warships of all kinds. (i) Vessels of war (surface or underwater), other surface vessels (Fitted with automatic weapons having a caliber of

12.7 mm or higher. Chemical Biological Radiological and Nuclear protection, active weapon countermeasure systems), special naval equipment, anti-submarine or torpedo nets, hull penetrators and connectors specially designed for military use;

(ii) Air Independent Propulsion systems (nuclear or conventional) for marine applications.

(iv) Arms and ammunition and allied items of defence equipment; parts and accessories thereof, oilier than small arm of caliber upto 12.7 mm as defined under clause (51) of sub-rule (I) of rule 2 of the Arms Rules, 2016 and parts, components and ammunition for such small arm.

(i) All rifle and smooth-bore weapons and other arms, automatic or semi-automatic or pump action type weapons, weapons using case less ammunition, silencers, special gun-mountings, weapons sights, signature reduction devices and flash suppressors to include rifles, carbines, revolvers, pistols, machine pistols, multi barrel rocket, machine guns, guns, rocket, cannon and missile systems - used on land, ships and shore based and airborne, howitzers, mortars, anti-tank weapons, projectile launchers, military flame throwers, rifles, recoilless rifles;

(ii) ammunition and fuze setting devices, including the following:—

(a) safing and arming devices, fuzes, sensors and initiation devices;

(b) power supplies with high one-time operational output;

(c) combustible cases for charges;

(d) submunitions including bomblets, terminally guided projectiles.

(iii) bombs, torpedoes, grenades, smoke canisters, rockets, mines, missiles, depth charges, demolition-charges, demolition-devices, demolition kits, aircraft missile protection systems, pyrotechnic devices, cartridges and simulators (i.e. equipment simulating the characteristics of any of these items), specially designed for military

(iv) energetic materials and related substances includes all explosives like primers, boosters, initiators, igniters, detonators, smoke bomb, colour signals, propellants and THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(H)] pyrotechnics, oxidizers, binders, plasticisers, mobomers, additive scuopling agents, precursors and other related ammunition;

(v) high velocity kinetic energy weapon systems and related equipment—

(a) kinetic energy weapon systems specially designed for destruction or effecting mission-abort of target;

(b) specially designed test and evaluation facilities and test models, including diagnostic instrumentation and targets, for dynamic testing of kinetic energy projectiles and systems;

(vi) Directed Energy Weapon systems, related or countermeasure equipment and test models as follows:—

(a) laser systems specially designed for, destruction or effecting mission, abort of a target;

(b) particle beam systems capable of destruction or effecting mission-abort of a target;

(c) high power Radio-Frequency systems capable of destruction or effecting mission-abort of target;

(d) equipment specially designed for the detection or identification of; or defence against, system at (a) and

(c) above;

(e) physical test models for the systems, equipment and components, specified under this head;

(f) Laser protection equipments (e.g. eye and sensor protection).
