2. प्राजधकरण के अध्र्क्ष और सिस्ट्र् रािपत्र में इस अजधसूचना के प्रकािन की तारीख तीन वषा की अवजध के जलए पि धारण करेंग े।
3. प्राजधकरण, ऐसी िजिर्ों का प्रर्ोग करेगा और ऐसी प्रदिर्ा का अनुसरण करेगा िो उि अजधसूचना में र्र्ा जवजनर्िाष् ि हैं ।
4. प्राजधकरण, झारखंड राज्र् के जलए पैरा 6 के अधीन गरित राज्र्स्ट्तरीर् जविेषज्ञ मलू्र्ांकन सजमजत की जसफाररिों पर अपना जवजनश्चर् करेगा ।
5. प्राजधकरण के सभी जवजनश्चर् बैिक में दकए िाएगंे और सामान्द्र् रूप से सवासम्मत होंग े:
परन्द्तु र्दि कोई जवजनश्चर् बहुमत द्वारा दकर्ा िाता ह ैतो इसके पक्ष और उसके जवपक्ष में, जवचारों के ब्र्ौरे कार्ावृत्त में स्ट्पष्ट रूप से लेखबद्ध दकए िाएंग ेऔर उनकी एक प्रजत पर्ाावरण और वन मंत्रालर् को भेिी िाएगी ।
6. केन्द्रीर् सरकार, झारखंड राज्र् सरकार से परामिा करके, प्राजधकरण की सहार्ता करने के प्रर्ोिन के जलए, राज्र्स्ट्तरीर् जविेषज्ञ मलु्र्ांकन सजमजत, झारखंड (जिसे इसमें इसके पश्चात ्सजमजत कहा गर्ा ह)ै का गिन करती ह,ै िो जनम्नजलजखत व्यजिर्ों से जमलकर बनगेी, अर्ाात् :- (क) श्री अिोक कुमार वसंह, भारतीर् वन सेवा (सेवाजनवृत्त) - अध्र्क्ष;

7. सजमजत के अध्र्क्ष और सिस्ट्र् रािपत्र में इस अजधसूचना के प्रकािन की तारीख तीन वषा की अवजध के जलए पि धारण करेंग े। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3
8. जहत के दकसी जवरोध से बचन ेके जलए,--
(i) प्राजधकरण और सजमजत के अध्र्क्ष र्ा सभापजत और सिस्ट्र्,-- (क) र्ह घोजषत करेंगे दक वे दकस परामिा सगंिन और पररर्ोिना के प्रस्ट्तावक से िुड ेहैं;
(ख) ऐसी पररर्ोिना के जलए पर्ाावरण समाघात जनधाारण और पर्ाावरण प्रबंध र्ोिना को तैर्ार करन ेके संबंध में कोई परामिा नहीं करेंग ेर्ा सहर्ोग नहीं करेंग े जिसका प्राजधकरण द्वारा जवजनश्चर् दकर्ा िाना ह ैर्ा सजमजत द्वारा अपने कार्ाकाल के िौरान मूल्र्ांकन दकर्ा िाना ह ै; और
(ii) र्दि सजमजत के अध्र्क्ष र्ा दकसी सिस्ट्र् न े पूवावती पांच वषों के िौरान दकसी पररर्ोिना प्रस्ट्तावक के जलए परामिा सेवाएं प्रिान की हैं र्ा पर्ाावरण समाघात जनधाारण अध्र्र्न संचाजलत दकर्ा ह ैतो वे अपन ेआपको ऐसे प्रस्ट्तावकों द्वारा प्रस्ट्ताजवत दकसी पररर्ोिना के मलू्र्ांकन की प्रदिर्ा से सजमजत के बैिकों से िरू रखेंगे ।
9. सजमजत, ऐसी िजिर्ों का प्रर्ोग करेगी और ऐसी प्रदिर्ाओं का पालन करेगी िो उि अजधसूचना में जवजनर्िाष्ट की िाएं ।
10. सजमजत, सामूजहक उत्तरिाजर्त्व के जसद्धांत पर कार्ा करेगी और अध्र्क्ष प्रत्र्ेक मामल ेमें सवासमजत्त पर पहुचंन े का प्रर्ास करेगा और र्दि वे सवासमजत्त पर पहुचंन ेमें असफल रहते हैं तो बहुमत का मत अजभभावी होगा ।
11. राज्र् सरकार, प्राजधकरण और सजमजत के सजचवालर् के रूप में कार्ा करने के जलए अजभकरण को जवजनर्िाष्ट करेगी ; और सजचवालर्, जवत्तीर् और संभार-तंत्र संबंधी सहार्ता, जिसके अंतगात आवास, पररवहन भी ह ै और उि अजधसूचना के अधीन उनके कृत्र्ों के संबंध में ऐसी अन्द्र् सुजवधाएं उपलब्ध कराएगा ।
12. प्राजधकरण और सजमजत के अध्र्क्ष और सिस्ट्र्ों को बैिक के जलए फीस, र्ात्रा भत्ता, और महगंाई भत्ता राज्र् सरकार के सुसंगत जनर्मों के उपबंधों के अनुसार संित्त दकर्ा िाएगा । [ िे-11013-75/2008-आईए-II(I)(पीिी.)] डॉ. सुिीत कुमार बािपेर्ी, संर्ुि सजचव MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 8th April, 2024 S.O. 1641(E).— In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India, in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14 th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Jharkhand (hereinafter referred to as the Authority) comprising of the following persons, namely:—
(a) Shri Kamlesh Pandey, IFS (Retd.)
Aarya Enclave, Govindnagar, Tilta, Ratu, Ranchi, Jharkhand-835222 - Chairman;
(b) Dr. Kirti Avishek.
Associate Professor, Department of Civil And Environmental Engineering, Birla Institute of Technology, Mesra, Ranchi 835215 - Member;
(c) Chief Conservator of Forest, Vigilance, Forest, Environment and Climate Change, Department, Jharkhand - Member- Secretary.

2. The Chairman and Members of the Authority shall hold office for a period of three years from the date of publication of this notification in the Official Gazette.
3. The Authority shall exercise such powers and follow such procedures as specified in the said notification.
4. The Authority shall take its decision on the recommendations of the State Level Expert Appraisal Committee constituted under paragraph 6 for the State of Jharkhand.
5. All decisions of the Authority shall be taken in a meeting and shall ordinarily be unanimous:
Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to MoEF.
6. The Central Government, in consultation with the State Government of Jharkhand, for the purpose of assisting the Authority, hereby constitutes the State Level Expert Appraisal Committee, Jharkhand (hereinafter referred to as the Committee), comprising of the following persons, namely:—
(a) Shri Ashok Kumar Singh, IFS (Retd.)

7. The Chairperson and Members of the Committee, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette.
8. In order to avoid any conflict of interest,-
(i) the Chairman or Chairperson and Members of the Authority, and the Committee shall,-
(a) declare to which consulting organisation they have been associated with and also the project proponents;
(b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority or to be appraised by the Committee during their tenure; and
(ii) if the Chairperson or any Member of the Committee has provided consultancy services or conducted Environment Impact Assessment studies for any project proponent during the preceding five years, they shall recuse themselves from the meetings of the Committee from the process of appraisal of any project proposed by such proponents.
9. The Committee shall exercise such powers and follow such procedures as specified in the said notification.
10. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach consensus in each case, and if they fail to reach consensus, the view of the majority shall prevail.

11. The State Government shall specify an agency to act as Secretariat of the Authority and the Committee and the Secretariat shall provide financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification.
12. The sitting fee, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Committee, shall be paid in accordance with the provisions of relevant rules of the State Government.
