.— —— —गुजरात के शूलपाने�र व�यजीव अभयार�य के चार� ओर के �े� को पा�रि�थितक संवेदी जोन के $प म& घोिषत करते )ए, एक ,ा$प अिधसूचना को भारत सरकार के पया-वरण, वन और जलवायु प�रवत-न मं�ालय क0 अिधसूचना सं. का. आ.
2079(अ), तारीख 30 जुलाई, 2015 को भारत के राजप� असाधारण म& ,कािशत �कया गया था, िजसके 9ारा ऐसे सभी ;ि<य� से, िजनके उससे ,भािवत होने क0 संभावना थी, उस तारीख से, िजसको उ< अिधसूचना को अंत@वA करने वाली राजप� क0 ,ितयां जनता को उपलBध करा दी जाती हC, 60 �दन क0 अविध के भीतर आ�ेप और सुझाव आमंि�त �कए गए थे;
और उ< अिधसूचना को अंत@वA करने वाली राजप� क0 ,ितयां 30 जुलाई, 2015 को जनता को उपलBध करा दी गई थI;
और उ< ,ा$प अिधसूचना के ,JयुKर म& सभी ;ि<य� और पणधा�रय� से ,ाL आ�ेप� और सुझाव� पर के�Mीय सरकार 9ारा सNयक् $प से िवचार कर िलया गया ह;ै और, के�Mीय सरकार समझती ह ै�क गुजरात के नम-दा िजले म& ि�थत शूलपाने�र व�यजीव अभयार�य 607.708 वग- �कलोमीटर �े� म& फैला )आ है ;
और जहाँ, शूलपाने�र व�यजीव अभयार�य म& वर�टTेट क0 267 ,जाित िजसम& मछली समूह (17 ,जाित), एिNफिबयस (19 ,जाित), रेपटाईल (16 ,जाित), प�ी (194 ,जाित) और मैNलस (21 ,जाित) तथा एनबर�टTेड ,जाित म& सिNमिलत क0ट ,जाित (212 ,जाित), अ@चड समूह (57 ,जाित) , कु�टेकािनस (3 ,जाित), मड-�रपाड (3 ,जाित), मोलोस^स (9 ,जाित) और अनािलड (4 ,जाित), तथा रेपटर क0 24 ,जाितय� �क उपलBधता एक महJवपूण- पहलू है ;
और जहाँ, ते�दआु (पै�थरा पार_स) एक `ेa िशकारी है और जंगली िब�ली (फेिलस चैउस), र�टी �पवbड कैट (फेिलस cिबिगनोसा), कामन जैकाल (कैिनस औरोइस), इिडयन eे मैगूस, cिड मैगूस, पालम सीिबट, पैथन, रस�स वाइपर, कोबरा इJया�द अ�य मुfय िशकारी ह ैऔर बाgकग िडयर और फोर हा@नड एं�टलोप ब)ल शाकाहारी �तनपायी के साथ संNभर भी �दखाई पड़ते हC;
और जहाँ, �लोथ िबयर, वाइ�ड िबयर और �रिसयूस माकाऊ मुfय सवा-हारी ह ैऔर अभयार�य क0 दलु-भ ,जाित म& जइंट �कैरल तथा फालइंग �कैरल सिNमिलत हC तथा दलु-भ एवं िवलुL,ाय जैव िविवधता है ;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और जहाँ, शूलपाने�र वन म& लगभग 600 वृ� ,जाितयाँ िजसम& फ�जी समूह (18 ,जाित) , Tायोफेट समूह (6 ,जाित) पेlीडोफेbस (5 ,जाित) और एि�जयो�Tम (571 ,जाित) �क दलु-भ ,जाित और मालोटस �फलीपयेनिमस, �कराबेरा सूइटीनोइ_स इस तरह से नम-दा के जल �तर को दबुारा भरने म& मदद करते हC ;
और, शूलपाने�र व� यजीव अभयार�य के चार� ओर के �े� को, िजसका िव�तार और सीमाएं इस अिधसूचना के पैरा 1 म& िविनgदA हC, पया-वरण क0 दिृA से पा�रि�थितक पा�रि�थितकपा�रि�थितक पा�रि�थितक संवेदी संवेदीसंवेदी संवेदी जोन जोनजोन जोन के $प म& सुरि�त और संरि�त करना तथा उ< पा�रि�थितक पा�रि�थितकपा�रि�थितक पा�रि�थितक संवेदी संवेदीसंवेदी संवेदी जोन जोनजोन जोन म& उmोग� या उmोग� के वगn के ,चालन तथा ,सं�करण करने को ,ितिषo करना आवpयक है अतः, अब, के�Mीय सरकार, पया-वरण (संर�ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प�ठत पया-वरण (संर�ण) अिधिनयम, 1986 (1986 का 29) क0 धारा 3 क0 उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप धारा (3) 9ारा ,दK शि<य� का ,योग करते )ए, गुजरात राrय के शूलपाने�र व�यजीव अभयार�य क0 सीमा के चार� ओर 7 �कलोमीटर तक के �े� को शूलपाने�र व�यजीव अभयार�य पा�रि� थितक0य संवेदी जोन (िजसे इसम& इसके पp चात् पा�रि�थितक संवेदी जोन कहा गया ह)ै के $प म& अिधसूिचत करती ह,ै िजसका िववरण िनsानुसार ह,ै अथा-त् :--
1. पा�रि�थितक पा�रि�थितकपा�रि�थितक पा�रि�थितक संवेदी संवेदीसंवेदी संवेदी जोन जोनजोन जोन का काका का िव�तार िव�तारिव�तार िव�तार और औरऔर और उसक� उसक�उसक� उसक� सीमाएं सीमाएंसीमाएं सीमाएं--(1) पा�रि�थितक संवेदी जोन 545.20 वग- �कलोमीटर �े� म& फैला )आ ह ै। व�यजीव अभयार�य क0 सीमा से पा�रि�थितक संवेदी जोन 7 �कलोमीटर के साथ िव�तृत ह ै। शूलपाने�र व�यजीव अभयार�य क0 उKरी और उKर-पूवu सीमा के साथ नम-दा नदी ,वािहत होती ह ैऔर यह ,ाकृितक सीमा बनाती ह ै । उKर और उKर-पूवu अंितम के पा�रि�थितक संवेदी जोन क0 सीमा गोरा eाम क0 उKरी सीमा के नम-दा नदी तट का अभयार�य भाग बनाती ह ै। महाराv राrय क0 सीमा अभयार�य के पूवu भाग का िह�सा ह ै।
(2) पा�रि�थितक संवेदी जोन का मानिच� इसके सीमा िववरण के साथ जीपीएस िनदwशांक� के संदभ- म& उपाबंध उपाबंध उपाबंध उपाबंध I II I पर उपाबo ह ै।
(3) पा�रि�थितक संवेदी जोन म& आने वाले 121 eाम� क0 सूची इसके अ�ांश और देशा�तर के साथ उपाबंध उपाबंध उपाबंध उपाबंध II IIII II पर उपाबo ह ै। 2 22

पा�रि�थितक पा�रि�थितकपा�रि�थितक पा�रि�थितक संवेदी संवेदीसंवेदी संवेदी जोन जोनजोन जोन के केके के िलए िलएिलए िलए आंचिलक आंचिलकआंचिलक आंचिलक महायोजना महायोजनामहायोजना महायोजना – –– –
(1) राrय सरकार, पा�रि� थितक संवेदी जोन के ,योजन� के िलए राजप� म& इस अिधसूचना के अंितम ,काशन क0 तारीख से दो वष- क0 अविध के भीतर, �थानीय ;ि<य� के परामश- से, और इस अिधसूचना म& �दए गए अनुबंध� का पालन करते )ए आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना का अनुमोदन राrय सरकार म& स�म ,ािधकारी 9ारा �कया जाएगा ।
(3) पा�रि�थितक संवेदी जोन के िलए आंचिलक महायोजना राrय सरकार 9ारा ऐसी रीित जैसा इस अिधसूचना म& िविनgदA है और सुसंगत के�Mीय और राrय िविधय� तथा के�Mीय सरकार 9ारा जारी माग-दश-क िसoांत�, य�द कोई हो, के अनु$प भी तैयार क0 जाएगी ।
(4) आंचिलक महायोजना सभी संबo राrय िव भाग� के साथ परामश- से पया-वरणीय और पा�रि�थितक िवचारण� को उसम& एक0कृत करने के िलए तैयार क0 जाएगी, अथा-त्:--
(i) पया-वरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पय-टन ;
(v) नगरपािलक ;
(vi) राज� व ;
(vii) कृिष ;
(viii) गुजरात ,देश राr य ,दषूण िनयं�ण बोड-;
(ix) yसचाई
(x) लोक िनमा-ण िवभाग ; और

(5) आंचिलक महायोजना अनुमो�दत िवmमान भू-उपयोग, अवसंरचना और �zयाकलाप� पर कोई िनब{धन अिधरोिपत नहI करेगी जब तक �क इस अिधसूचना म& िविनgद| ट न हो और आचंिलक महायोजना सभी अवसंरचना और �zयाकलाप� म& और अिधक द�ता और पा�रि�थितक अनुकूलता का संवध-न करेगी ।
(6) आंचिलक महायोजना म& अना}छा�दत �े�� के जीण~oार, िवmमान जल िनकाय� के संर�ण, आवाह �े�� के ,बंधन, जल- संभर� के ,बंधन, भूतल जल के ,बंधन, मृदा और नमी संर�ण, �थानीय समुदाय� क0 आवpयकता� तथा पा�रि�थितक0 और पया-वरण से संबंिधत ऐसे अ�य पहलू�, िजन पर �यान दनेा आवpयक ह,ै के िलए उपबंध ह�गे ।
(7) आंचिलक महायोजना सभी िवmमान पूजा � थल�, eाम� और नगरीय बंदोब�त�, वन� के ,कार और �क� म�, कृिष �े��, ऊपजाऊ भूिम, ह�रत �े� जैसे उmान और उसी ,कार के � थान, उmान कृिष �े�, आgकड�, झील� और अ�य जल िनकाय� का अ�यकंन करेगी ।
(8) आंचिलक महायोजना पा�रि�थितक संवेदी जोन म& िवकास को िविनयिमत करेगी िजससे �क � थानीय समुदाय� के पा�रि�थितकज�य िवकास और जीिवका को सुिनिp चत �कया जा सके ।
(9) गुजरात राrय सरकार अपनी अिधका�रता वाले �े� क0 आंचिलक महायोजना तैयार करेगी ।
3. रा�य रा�यरा�य रा�य सरकार सरकारसरकार सरकार �ारा �ारा�ारा �ारा �कए �कए�कए �कए जाने जानेजाने जाने वाले वालेवाले वाले उपाय उपायउपाय उपाय-- ---- -- राrय सरकार इस अिधसूचना के उपबंध� को ,भावी करने के िलए िनsिलिखत उपाय करेगी, अथा-त् :-
(1) भू भभूू भू- -- -उपयोग उपयोग उपयोग उपयोग - -- - पा�रि� थितक संवेदी जोन म& आमोद-,मोद के ,योजन के िलए िचि�हत �कए गए हC वन�, उmान-कृिष �े��, कृिष �े��, पाकn और खुले �थान� का वािणिrयक और औmोिगक संबo िवकास �zयाकलाप� के िलए उपयोग या संप�रवत-न नहI होगा:
परंतु पा�रि�थितक संवेदी जोन के भीतर कृिष भूिम का संप�रवत-न के अधीन मानीटरी सिमित क0 िसफा�रश पर और राrय सरकार के पूव- अनुमोदन से, �थानीय िनवािसय� क0 आवासीय ज$रत� को पूरा करने के िलए और पैरा 4 क0 सारणी के �तंभ (2) के अधीन मद सं.
11, 21, 27, 31 और 32 के सामने सूचीबo �zयाकलाप� को पूरा करने के िलए अनु�ात ह�गे, अथा-त् :-
(i) पा�रि�थितक अनुकूल पय-टन �zयाकलाप� के िलए पय-टक� के अ� थायी आवासन के िलए पा�रि�थितक अनुकूल आरामगाह जैसे ट&ट, लकड़ी के मकान आ�द ;
(ii) िवmमान सड़क� को चौड़ा करना;
(iii) ,दषूण उJप� न करने वाले लघु उmोग;
(iv) वषा- जल संचय; और
(v) कुटीर उmोग, िजसके अंतग-त eामीण द�तकार, सुिवधा �टोर और �थानीय सुिवधाएं हC | परंतु यह और �क जनजातीय भूिम का उपयोग राrय सरकार के पूव- अनुमोदन और संिवधान के अनु} छेद 244 या तJसमय ,वृK िविध के उपबंध� के अनुपालन के िबना, िजसके अंतग-त अनुसूिचत जनजाित और अ�य परंपरागत वन िनवासी (वन अिधकार� क0 मा�यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिrयक या उmोग िवकास �zयाकलाप� के िलए अनु�ात नहI होगा :
परंतु यह और भी �क पा�रि� थितक संवेदी जोन के भीतर भू-अिभलेख� म& उपसंजात कोई �ु�ट, मानीटरी सिमित के िवचार ,ाL करने के प�ात ्राrय सरकार 9ारा ,Jयेक मामले म& एक बार संशोिधत होगी और उ< �ु�ट के संशोधन क0 सूचना क& Mीय सरकार के पया-वरण, वन और जलवायु प�रवत-न मं�ालय को दनेी होगी । परंतु यह और भी �क उपयु-< �ु�ट का संशोधन म& इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म& भू-उपयोग का प�रवत-न सिNमिलत नहI होगा । परंतु यह और भी �क िजससे ह�रत �े� म& जैसे वन �े�, कृिष �े� आ�द म& कोई पा�रणािमक कटौती नहI होगी और अन,यु^ त या अनुJ पादक कृिष �े�� म& पुन: वनीकरण करने के ,यास �कए जाएंगे ।
(2) �ाकृितक जल �ोत �ाकृितक जल �ोत �ाकृितक जल �ोत �ाकृितक जल �ोत -- आचंिलक महायोजना म& सभी ,ाकृितक जल �ोत� क0 पहचान क0 जाएगी और उनके संर�ण और पुनc�भूतकरण के िलए योजना सिN मिलत होगी और राr य सरकार 9ारा ऐसे �े�� पर या उनके िनकट िवकास �zयाकलाप ,ितिषo करने के िलए ऐसी रीित से माग-िनदwश तैयार �कए जाएंगे । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(3) पय�टन पय�टन पय�टन पय�टन – –– – (क) पा�रि�थितक संवेदी जोन के भीतर पय-टन संबंधी �zयाकलाप पय-टन महायोजना के अनुसार ह�गे जो �क आंचिलक महायोजना के भाग $प म& होगी । (ख) पय-टन महायोजना पय-टन िवभाग, राrय सरकार 9ारा राज� व और वन िवभाग, के परामश- से तैयार होगी । (ग) पय-टन संबंधी �zयाकलाप िनN निलिखत के अधीन िविनयिमत ह�गे, अथा-त् :-
(i) पा�रि�थितक संवेदी जोन के भीतर सभी नए पय-टन �zयाकलाप� या िवmमान पय-टन �zयाकलाप� का िव�तार के�M सरकार के पया-वरण, वन और जलवायु प�रवत-न मं�ालय 9ारा जारी (समय-समय पर यथा संशोिधत) माग-िनदशे� के अनुसार होगा िजसम& पा�रि�थितक पय-टन, पा�रि�थितक िश�ा और पा�रि�थितक िवकास को महJव �दया जाएगा और पा�रि�थितक संवेदी जोन क0 वहन �मता के अ�ययन पर आधा�रत होगा;
(ii) पा�रि�थितक अनुकूल पय-टन �zयाकलाप से संबंिधत पय-टक� के अ�थायी अिधभोग के िलए वास सुिवधा के िसवाय संरि�त �े� क0 सीमा से एक �कलोमीटर तक या पा�रि�थितक संवेदी जोन क0 सीमा तक इनम& जो भी िनकट ह,ै नये वािणिrयक होटल और �रसोट- अनु�ात नहI ह�गे। परंतु, जहाँ पा�रि�थितक संवेदी जोन का िव�तार एक �कलोमीटर से rयादा ह ैवहाँ, एक �कलोमीटर से परे और पा�रि�थितक संवेदी जोन क0 सीमा तक सभी नए पय-टक �zयाकलाप या िवmमान �zयाकलाप का िव�तार पय-टन महायोजना और रा| lीय � या� संर�ण ,ािधकरण के अनुसार होगा।
(iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक, पय-टन के िलए िवकास और िवmमान पय-टन �zयाकलाप� के िव�तार को वा�तिवक �थल िविनgदA संवी�ा तथा मानीटरी सिमित क0 िसफा�रश पर आधा�रत संबंिधत िविनयामक ,ािधका�रय� 9ारा अनु�ात �कया होगा ।
(4) नैस#गक नैस#गकनैस#गक नैस#गक िवरासत िवरासतिवरासत िवरासत -- ---- -- पा�रि�थितक संवेदी जोन म& महJवपूण- नैस@गक िवरासत के सभी �थल� जैसे सभी जीन कोश आरि�त �े�, शैल िवरचनाएं, जल ,पात�, झरन�, घाटी मागn, उपवन�, गुफाएं, �थल�, �मण, अ�रोहण, ,पात� आ�द क0 पहचान क0 जाएगी और उ�ह& संरि�त �कया जाएगा तथा उनक0 सुर�ा और संर�ा के िलए इस अिधसूचना के ,काशन क0 तारीख से छह मास के भीतर, उपयु< योजना बनाएगी और ऐसी योजना जोनल मा�टर �लान का भाग होगा ।
(5) मानव िन#मत िवरा मानव िन#मत िवरामानव िन#मत िवरा मानव िन#मत िवरासत � थ सत � थसत � थ सत � थल ल ल ल - -- - पा�रि� थितक संवेदी जोन म& भवन�, संरचना�, िश�प-त�य, ऐितहािसक, कलाJमक और सां�कृितक महJव के �े�� क0 पहचान करनी होगी और इस अिधसूचना के ,काशन क0 तारीख से छह माह के भीतर उनके संर�ण क0 योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म& सिNमिलत क0 जाएगी ।
(6) % व % व% व % विन �दषूण िन �दषूणिन �दषूण िन �दषूण -- पा�रि�थितक संवेदी जोन म& � विन ,दषूण के िनयं�ण के िलए गुजरात राr य सरकार का पया-वरण िवभाग वायु (,दषूण िनवारण और िनयं�ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम� के उपबंध� के अनुसरण म& माग-दश-क िसoांत और िविनयम तैयार करेगा ।
(7) वायु वायुवायु वायु �दषूण �दषूण�दषूण �दषूण -- पा�रि�थितक संवेदी जोन म&, वायु ,दषूण के िनयं�ण के िलए राrय सरकार का पया-वरण िवभाग वायु (,दषूण िनवारण और िनयं�ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम� के उपबंध� के अनुसरण म& माग-दश-क िसoांत और िविनयम तैयार करेगा ।
(8) बिह�ाव बिह�ावबिह�ाव बिह�ाव का काका का िन�सारण िन�सारणिन�सारण िन�सारण -- पा�रि�थितक संवेदी जोन म& उपचा�रत बिह�ाव का िन�सारण जल (,दषूण िनवारण तथा िनयं�ण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयम� के उपबंध� के अनुसार होगा ।
(9) ठोस ठोसठोस ठोस अपिश- अपिश-अपिश- अपिश- -- ---- -- ठोस अपिशA� का िनपटान िनsिलिखत $प म& होगा -
(i) पा�रि�थितक संवेदी जोन म& ठोस अपिशA� का िनपटान भारत सरकार के तJकालीन पया-वरण और वन मं�ालय क0 समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख 25 िसतंबर, 2000 नगरपािलक ठोस अपिशA (,बंध और हथालन) िनयम, 2000 के उपबंध� के अनुसार �कया जाएगा ;
(ii) �थानीय ,ािधकरण जैव िनsीकरणीय और अजैव िनsीकरणीय संघटक� म& ठोस अपिशA� के संपृथ�न के िलए योजनाएं तैयार कर&गे ;
(iii) जैव िनsीकरणीय सामeी को अिधमानतः खाद बनाकर या कृिम खेती के मा�यम से पुनःच�zत �कया जाएगा ;

(iv) अकाब-िनक सामeी का िनपटान पा�रि�थितक संवेदी जोन के बाहर पहचान �कए गए � थल पर �कसी पया-वरणीय �वीकृत रीित म& होगा और पा�रि�थितक संवेदी जोन म& ठोस अपिश| ट� को जलाना या भ| मीकरण अनु�ात नहI होगा ।
(10) जवै जवैजवै जवै िच�क/ सी िच�क/ सीिच�क/ सी िच�क/ सीय अपिश1 ट य अपिश1 टय अपिश1 ट य अपिश1 ट- पा�रि�थितक संवेदी जोन म& जैव िच�कJसीय अपिशA� का िनपटान भारत सरकार के तJकालीन 9ारा पया-वरण और वन मं�ालय क0 समय-समय पर यथासंशोिधत अिधसूचना सं.का.आ. 630(अ) तारीख 20 जुलाई, 1998 9ारा ,कािशत जैव िच�कJसीय अपिशA (,बंध और हथालन) िनयम, 1998 के उपबंध� के अनुसार �कया जाएगा।
(11) यानीय यानीययानीय यानीय प�रवहन प�रवहनप�रवहन प�रवहन - प�रवहन क0 यानीय गितिविध ,ाणीय� के अनुकूल रीित से िविनयिमत क0 जाएगी और इस संबंध म& आंचिलक महायोजना म& िवशेष उपबंध सिNमिलत �कए जाएंगे और जब तक ऐसी आंचिलक महायोजना राrय सरकार के स�म ,ािधकारी 9ारा तैयार और अनुमो�दत नहI �कया जाता ह,ै मानीटरी सिमित संुसगत अिधिनयम� और उसके अधीन बनाए गए िनयम� और िविनयम� के अधीन यानीय गितिविधय� के अनुपालन को मानीटर करेगी ।

सि�मा-ण �zयाकलाप । (क) संरि�त �े� क0 सीमा से एक �कलोमीटर तक या पा�रि�थितक संवेदी जोन क0 सीमा तक इनम& जो भी िनकट ह,ै के भीतर �कसी भी ,कार का नया वािणिr यक संिनमा-ण अनु�ात नहI होगा :
परंतु � थानीय � यि^ तय� को अपने आवासीय उपयोग, िजसके अंतग-त पैरा 3 के उपपैरा (1) म& सूचीबo �zयाकलाप भी हC, के िलए अपनी भूिम पर संिनमा-ण करने क0 अनुमित होगी । (ख) ,दषूण उJ प� न न करने वाले लघु उmोग� से संबंिधत संिनमा-ण �zयाकलाप िनयम या िविनयम, य�द कोई लागू ह�, के अनुसार स�म ,ािधकारी से पूव- अनुमित ,ा� त करने के पp चात् अनु�ात ह�गे । (ग) पर�तु, जहाँ पा�रि�थितक संवेदी जोन का िव�तार एक �कलोमीटर से rयादा है तो वहाँ, एक �कलोमीटर के पp चात् और पा�रि�थितक संवेदी जोन क0 सीमा तक � थानीय � यि^ तय� क0 स�ावी आवp यकता के िलए संिनमा-ण अनु�ात होगा तथा अ� य वािणिr यक संिनमा-ण �zयाकलाप आंचिलक महायोजना के अनु$प ह�गे।

खाई का मैदान । नए खाई खोदने के मैदान का �थािपत �कया जाना ,ितिषo ह ै। पुराने खाई के मैदान लागू िविधय� के अधीन िविनयिमत �कए जाएं ।

िवmमान सड़क� को चौड़ा करना और उ�ह& सुदढृ करना तथा नई सड़क� का संिनमा-ण । उिचत पया-वरण समाघात िनधा-रण और � यूिनकरण उपाय यथा लागू अनुसार ह�गे ।

होटल� और लॉज के िवmमान प�रसर� म& बाड लगाना । लागू िविधय� के अधीन िविनयिमत ह�गे ।

साइनबोड- और हो�डग । लागू िविधय� के अधीन िविनयिमत ह�गे ।
24.
राि� म& यािनक यातायात का संचलन । लागू िविधय� के अधीन तथा आंचिलक महायोजना के अनुसार वािणिrयक वाहन� के िविनयिमत �कया जाएगा ।

8. महJ ता का कोई अ� य िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 5th May, 2016 S.O.1653(E).—Whereas, a draft notification, declaring Eco-sensitive Zone around Shoolpaneshwar Wildlife Sanctuary in Gujarat, was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 2079 (E), dated the 30th July 2015, inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, copies of the Gazette containing the said notification were made available to the public on the 30 th July, 2015;
And whereas, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
And whereas, the Central Government considers that the Shoolpaneshwar Wildlife Sanctuary situated in Narmada District, Gujarat is spread over an area of 607.708 squarer kilometers;
And whereas, Shoolpaneshwar Wildlife Sanctuary has 267 vertebrate species belonging to Fishes group (17 spp.), Amphibians (19 spp.), Reptile (16 spp.), Birds (194 spp.) and Mammals (21 spp.) and the invertebrate species include Insect group (212 spp.) Arachnid group (57 spp.) Crustaceans (3 spp.), Myriapod (3 spp.), Molluscs (9 spp.) and Annalid (4 spp.) and the significant aspect is presence of 24 species of raptor;
And whereas, Leopard (Panthera pardus) is the top predator and Jungle cat (Felis chaus), Rusty spotted cat (Felis rubiginosa), Common Jackal (Canis aureus), Indian Fox (Vulpes bengalensis), Honey badger (Mellivora Capensis), Indian grey mongoose, Ruddy mongoose, Palm Civet, Python, Russell’s viper, Cobra, etc. are other important predator and the barking deer and four horned antelope are abundant mammalian herbivore, with sightings of Sambar;
And whreas, Sloth bear, Wild Boar and Rhesus Macaque are important omnivores and the rare species of the sanctuary includes the giant squirrel and the flying squirrel and the rare and endangered biological diversity;
And whereas, Shoolpaneshwar forest has about 600 plant species which contain Fungi group (18 spp.), bryophyte group (6 spp.), pteridophytes (5 spp.) and angiosperms (571 spp.) including rare varieties and Mallotus phillippensis, Schrebera swietenioides thus plays an important role in recharging the water table of Narmada;
16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] And whereas, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Shoolpaneshwar Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries, or class of industries, and their operations or processes in the said Eco-sensitive zone;
Now therefore, in exercise of the powers conferred by sub- section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule
(3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent of upto 7 kms around the boundary of the Shoolpaneshwar Wildlife Sanctuary in the State of Gujarat as the Shoolpaneshwar Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone. - (1) The Eco-sensitive Zone is spread over an area of 545.20 square kilometers The extent of Eco-sensitive Zone varies up to 7 kilometers from the boundary of the Wildlife Sanctuary. River Narmada flows along the northern and north-eastern boundary of the Shoolpaneshwar Wildlife Sanctuary and forms its natural boundary. The sanctuary-side river bank of the Narmada river upto the northern boundary of Gora village forms the boundary of the Eco-sensitive Zone on the north and north-eastern end. On the eastern side the sanctuary shares boundary with the State of Maharashtra.
(1) The map of the Eco-sensitive Zone along with boundary details in terms of GPS coordinates is appended as Annexure-I.
(2) The list of 121 villages falling in the Eco-sensitive Zone along with latitudes and longitudes is appended as Annexure-II.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The said Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The said Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Gujarat State Pollution Control Board;
(ix) Irrigation;
(x) Public Works Department; and
(xi) Tribal Development Department for integrating environmental and ecological considerations into it.
(5) The said Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The said Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.
(7) The said Master Plan shall demarcate all the existing places of worship, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.

(8) The said Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities.
(9) The State Government of Gujarat shall prepare Zonal Master Plans for area under their jurisdiction.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 11, 21, 27, 31 and 32 in column
(2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly Friendly tourism activities;
(ii) widening and strengthening of existing roads and construction of new roads;
(iii) small scale industries not causing pollution;
(iv) rainwater harvesting; and
(v) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, in consultation with the Department of Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) No new commercial hotels and resorts shall be permitted, within one kilometer of the boundary of the Protected Area or the boundary of Eco-sensitive Zone whichever is nearer, except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities.
18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] However, where Eco-sensitive Zone extends beyond one kilometer, then beyond one kilometer and up to the boundary of the Eco-sensitive Zone, all new tourism activities or expansions of existing activities would be conformity with Tourism Master Plan and National Tiger Conservation Authority guidelines.
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Gujarat State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made there under.
(7) Air pollution.- The Environment Department of the State Government or Gujarat State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.
(8) Discharge of effluents.- No discharge of untreated effluent is permitted and the discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made there under.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and nonbiodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20 th July, 1998 as amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial Units. -
(a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based Industries set up as per the Law.
(b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Ecosensitive zone shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Remarks

(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units are prohibited except for the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption.
(b) The mining operations shall strictly be in accordance with the orders of the Hon’ble Supreme Court dated
04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and order of the Hon’ble Supreme Court dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
4. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.
5. Establishment of major thermal and hydro-electric projects Prohibited (except as otherwise provided) as per applicable laws.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
7. Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons.
Prohibited (except as otherwise provided) as per applicable laws.
8. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
Regulated Activities
9. Protection of hill slopes and river banks and coastal areas.

10. Introduction of exotic species. Regulated under applicable laws.
11. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted, within one kilometer of the boundary of the Protected Area or the boundary of Eco-sensitive Zone whichever is nearer, except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities.
However, where Eco-sensitive Zone extends beyond one kilometer, then beyond one kilometer and up to the boundary of the Eco-sensitive Zone, all new tourism activities or expansions of existing activities would be conformity with Tourism Master Plan and National Tiger Conservation Authority guidelines
12. Construction activities.
(a) No new commercial construction of any kind shall be permitted, within one kilometer of the boundary of the Protected Area or the boundary of Eco-sensitive Zone whichever is nearer:
Provided that local people shall be permitted to 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] undertake construction in their land for residential use including the activities listed in sub- paragraph (1) of paragraph 3.
(b) The construction activity related to small scale industries not causing pollution shall be permitted as per applicable rules and regulations, if any, with the prior permission from the competent authority.
(c) However, where Eco-sensitive Zone extends beyond one kilometer, then beyond one kilometer and upto the boundary of Eco- sensitive Zone, construction for bona fide local needs shall be permitted and other commercial construction activities shall be in conformity with the Zonal Master Plan.
14. Use of plastic bags. Regulated under applicable laws.
15. Air and Vehicular Pollution. Regulated under applicable laws.
16. Noise pollution. Regulated under applicable laws.
17. Extraction of ground. water Regulated under applicable laws.
18. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government;
(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder;
(c) in case of Project Forests and Protected Forests the Working Plan prescriptions shall be followed.
19. Discharge of treated effluents and solid waste in natural water bodies or land area.
Regulated under applicable laws.
20. Insulation of electric lines. Promote underground cabling. All existing electric lines passing through the Eco-sensitive Zone shall be adequately insulated in the time frame prescribed under the Zonal Master Plan.
21. Widening and strengthening of existing roads and construction of new roads.
Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
22. Fencing of existing premises of hotels and lodges.
Regulated under applicable laws.
23. Sign Boards and Hoardings. Regulated under applicable laws.
24. Movement of Vehicular Traffic. Regulated for commercial vehicles as per the Zonal Master Plan and the applicable laws.
25. Drastic Change of Agriculture systems or land use pattern.
Regulated under applicable laws.
26. Commercial water resources including ground water harvesting.
(a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land;
(b) extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority;
(c) no sale of surface water or ground water shall be permitted;
(d) steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
27. Small scale industries not causing pollution.
Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.

5. Monitoring Committee:-
(1)The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone falling in the State of Gujarat, which shall comprise of the following namely:-
(i) Collector, Narmada District – Chairman
(ii) Member of Parliament of the area* – Member
(iii) President of Concerned Zilla Panchayat – Member
(iv) Representative of Tribal Development Department, Government of Gujarat – Member
(v) Senior Town Planner of the area – Member
(vi) Regional Officer, Gujarat State Pollution Control Board, Narmada District – Member
(vii) A representative of Non-governmental Organisations working in the field of environment to be nominated by the State Government for a term of one year in each case -Member
(viii) An expert in the area of ecology and environment to be nominated by the State Government for a term of one year in each case -Member
(ix) A representative of the Department of Forest and Environment, Government of Gujarat – Member
(x) Deputy Conservator of Forests (in charge of the Shoolpaneshwar Wildlife Sanctuary), Narmada District -Member- Secretary *Subject to the State Government of Gujarat obtaining relevant approvals inter alia including permission from the Speaker of Lok Sabha Terms of Reference:
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Promoted Activities
28. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Shall be actively promoted.
29. Organic farming. Shall be actively promoted.
30. Adoption of green technology for all activities.
Shall be actively promoted.
31. Cottage industries including village artisans.
Shall be actively promoted.
32. Rain water harvesting.
Shall be actively promoted.
33. Use of renewable energy sources Shall be actively promoted.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure- III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
