PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 1465] ubZ fnYyh] 'kqØokj] ebZ 19] 2017@ oS'kk[k 29] 1939 No. 1465] NEW DELHI, FRIDAY, MAY 19, 2017/VAISAKHA 29, 1939 पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢ ालय अिधसूचना नई िदल्ली, 19 मई, 2017 का.आ. 1654(अ).–ᮧारूप अिधसूचना भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसचूना सं. का.आ. 3123 तारीख 20 नवम्बर, 2015 ᳇ारा भारत के राजपᮢ असाधारण मᱶ ᮧकािशत की गई थी िजसमᱶ उन सभी ᳞िᲦयᲂ से, िजनको उसस ेᮧभािवत होन ेकी संभावना थी, उस तारीख स,े िजसको उᲦ अिधसचूना की राजपᮢ की ᮧितया ंजनता को उपलब्ध करा दी गई थी, साठ िदन की अविध के भीतर, आक्षपे और सुझाव आमंिᮢत िकए गए थे;
और, उᲦ ᮧारूप अिधसचूना के ᮧत्युᱫर मᱶ ᳞िᲦयᲂ और पणधािरयᲂ से कोई टीका िटप्पिणया/ंआके्षप और सुक्षाव ᮧा᳙ नहᱭ हुए थ;े बालुखांडा-कोनाकर् वन् यजीव अभयारण्य संवेदी जोन तटीय पािरिस् थितक ᮧणाली और जीव िविवधता के संरक्षण के िलए वन् य जीव संरक्षण अिधिनयम, 1972 की धारा 18 के अधीन अिधसूचना सखं् यांक 9013/एफएपफएएच तारीख 23 अᮧलै, 1984 और उक् त अिधसूचना संख् यांक 15261/एफएपफएएच तारीख 1 िसतम् बर, 1987 ᳇ारा उपांतिरत की गई थी िजसका एक भाग 70.40 एकड़ सरकारी भूिम ह ैजो अभयारण्य के िसवाय ह ैअिधसूिचत क्षेᮢ ह ै । बालुखांडा-कोनाकर् वन् यजीव अभयारण्य वन् य जीव के स् वस् थाने और बाहस् थाने िसंचाई के िलए उड़ीसा मᱶ भुवनेश् वर स ेलगभग 60 िकलोमीटर एक महत् वपूणर् स् थल ह;ै यह अभयारण्य पुरी िजल ेमᱶ िस्थत ह ैऔर 87 वगर् िकलोमीटर से अिधक ᮰ेᮢ मᱶ फैला हुआ ह ᱹ। इस अभयारण्य के दिक्षणी भाग की ओर बंगाल की खाड़ी ह।ै कैजुआिरन, काज ू (एनाकािडर्यम फैिसडᱶडलेी), यूकेिलप्टस और ईयर िलफ अकेिसया (अकेिसया औिरिसयुिलफॉिमर्स) मुख्य वृक्ष ᮧजाितया ंह।ै ᮧाकृितक वनस्पितयᲂ मᱶ नीम (अजािदराछा इंिडका), घांटा (अबुिटलॉन एसपी), गुआकोली, िखरकोली (मोनीलᮓा हके्सन्ᮤ) आिद शािमल ह;ै और, ᮧाची नदी के मुहाने पर िस्थत इस अभयारण्य के गोलारा ᮧस्तािवत आरिक्षत वन ᮧखण्ड का एक भाग मनकडकᱶ डु, बाराकोली, जामनु (सज़ीिगयम कुमिमनी), झूमपुरी, बᱶत और बांस जैसे सहयोिगयᲂ सिहत केरूअन, राजु, गआुन, जसैी कच्छ वनस्पितयᲂ का पोषण करता ह ैऔर इस अभयारण्य मᱶ इनके सहचर वन्यजीव जसैे िक काला िहरण (एिनलेटोप सिवर्ᮧा), िचᱫीदार िहरण (रिशया अल्ᮨेिड), लकड़बग्घा (िहना एसपी), जंगली िबल्ली (फेिलस चौस), िसयार (कैिनस ऑिरयस), लोमड़ी (वल्प्स वल्प्स), बंदर (माकाका एसपी), खरगोश (िलपस एसपी), मानीटर िलजाडर् (वाराणस एसपी) आिद पाए जात ेह;ै और, उक् त पािरिस्थितक और पयार्वरणीय दिृष् ट स ेपािरिस् थितक सवंेदी जोन के रूप मᱶ बालुखांडा-कोनाकर् वन् यजीव अभयारण्य के संरिक्षत क्षेᮢ के चारो ओर के क्षेᮢ को, जो इस अिधसूचना के परैा 1 मᱶ िविन᳸दर्ष् ट िवस् तार और सीमाᲐ के क्षेᮢ को संरिक्षत और सुरिक्षत 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] करना आवश् यक ह ैतथा उᲦ पािरिस्थितक संवेदी जोन मᱶ उ᳒ोगᲂ के ᮧचालन या ᮧसंस्करण या उ᳒ोगᲂ के वगᲄ का ᮧचालन और ᮧसंस्करण करन ेको ᮧितिष करना आवश्यक ह ै;
अतः, अब, केन्ᮤीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv) के साथ पिठत और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेहुए, उड़ीसा राज् य मᱶ बालुखांडा-कोनाकर् वन् यजीव अभयारण्य की सीमा 0 मीटर से 500 मीटर तक के िवस् तािरत क्षेᮢ को बालुखांडा-कोनाकर् वन् यजीव अभयारण्य पािरिस् थितक संवेदी जोन (िजसे इसमᱶ इसके पश् चात् पािरिस् थितक संवेदी जोन कहा गया ह)ै के रूप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथार्त ्:--
1. पािरिस्थितक सवंदेी जोन का िवस्तार और उसकी सीमाएं--(1) पािरिस्थितक संवेदी बालुखांडा-कोनाकर् वन् यजीव अभयारण्य की सीमा से भूिमरक्षा िदशा पर 0 मीटर से 500 मीटर ह ैऔर पािरिस् थितक सवंदेी जोन 21.50 वगर् िकलोमीटर के क्षेᮢ मᱶ ह ै।
(2) पािरिस्थितक संवेदी जोन पवूर् की ओर 190 54'03.5''उᱫर अक्षांश और 860 13'34.2''पवूर् दशेान्तर ; पि᳟म दिक्षण की ओर 190 48'14.4'' उत् तर अक्षांश तथा 850 51'35.0'' पवूर् दशेान्तर; उᱫर की ओर 190 52'45.0''उᱫर अक्षांश और 860 01'01.8''पवूर् देशान्तर और दिक्षण की ओर 190 51' 15.3'' उᱫर अक्षांश तथा 860 04'33.9'' पवूर् दशेान्तर स ेिघरा हुआ ह।ै
(3) बालुखांडा-कोनाकर् वन् यजीव अभयारण्य, भ-ूसमन्वयक के साथ पािरिस्थितक सवंेदी जोन की सीमा का मानिचᮢ उपाबधं I के रूप मᱶ उपाब ह ै।
(4) पािरिस्थितक संवेदी जोन के भीतर आन ेवाल ेतीस ᮕामᲂ की सचूी उनके भ-ूसमन्वयक के साथ उपाबधं II के रूप मᱶ उपाब ह ै।
2. पािरिस्थितक सवंदेी जोन के िलए आचंिलक महायोजना –(1) राज्य सरकार, पािरिस् थितक संवदेी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन की तारीख से दो वषर् की अविध के भीतर, स्थानीय ᳞िᲦयᲂ के परामशर् स,े इस अिधसूचना मᱶ संलग् न अनुबंधᲂ के सामंजस् य से आचंिलक महायोजना तैयार करेगी ।
(2) इस ᮧकार तैयार िकए गए आचंिलक महायोजना अिधसूचना मᱶ िविन᳸दर᳥् शतर् के अनुरूप हᲂग ेऔर पयार्वरणीय ᮧभाव शािमल हᲂगे।
(3) आंचिलक महायोजना राज् य सरकार मᱶ सक्षम ᮧािधकारी ᳇ारा अनुमोिदत होगी ।
(4) पािरिस् थितक सवंेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ िविन᳸दर्ष् ट रूप मᱶ ऐसी रीित मᱶ राज् य सरकार तथा सुसंगत कᱶ ᮤीय सरकार और राज् य सरकार िविधयᲂ के सामंजस् य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागर्िनदᱷश, यिद कोई हᲂ, ᳇ारा तैयार होगी ।
(5) आंचिलक महायोजना सभी संबंिधत राज् य सरकार के िवभागᲂ के परामशर् से तैयार होगी, अथार्त्:--
(i) पयार्वरण ;
(ii) वन ;
(iii) शहरी िवकास ;
(iv) पयर्टन ;
(v) नगरपािलका ;
(vi) राजस् व ;
(vii) कृिष ; और
(viii) उड़ीसा राज् य ᮧदषूण िनयंᮢण बोडर्।
(6) आंचिलक महायोजना अनुमोिदत िव᳒मान भ-ूउपयोग, अवसंरचनात् मक और िᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक िक इस अिधसूचना मᱶ और आचंिलक महायोजना मᱶ सभी अवसंरचना और अिधक ᮧभावी और पािरिस् थितक अनकूुल िᮓयाकलाप कारक इस ᮧकार िविन᳸दर्ष् ट न हो ।
(7) आंचिलक महायोजना मᱶ अनाच्छािदत क्षेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरक्षण, आवाह क्षेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरक्षण, स्थानीय समुदायᲂ की आवश्यकताᲐ तथा पािरिस्थितक और पयार्वरण से संबंिधत ऐसे अन्य पहलᲐू, िजन पर ध्यान दनेा आवश्यक ह,ै के िलए उपबंध हᲂगे ।
(8) आंचिलक महायोजना सभी िव᳒मान पूजा स् थलᲂ, ᮕामᲂ और नगरीय बंदोबस्तᲂ, वनᲂ के ᮧकार और िकस् मᲂ, कृिष क्षेᮢᲂ, ऊपजाऊ भूिम, हिरत क्षेᮢ जैस ेउ᳒ान और उसी ᮧकार के स् थान, उ᳒ान कृिष क्षेᮢ, फलोउ᳒ान, झीलᲂ और अन्य जल िनकायᲂ का अभ्यकंन करेगी और समथर्नकारी मानिचᮢ और िव᳒मान और ᮧस्तािवत भूिम के उपयोग की िवशषेताᲐ के ब्यौरे दतेे हुए मानिचᮢᲂ ᳇ारा समिथर्त होगी । ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(9) आंचिलक महायोजना पािरिस् थितक संवेदी जोन मᱶ िवकास को पािरिस् थितक अनुकूल िवकास और स् थानीय समुदायᲂ की जीवकोपाजर्न को सुिनिश् चत करत ेहुए िविनयिमत और अिधसचूना मᱶ िविन᳸दर᳥् संविधर्त िᮓयाकलाप होगी ।
(10) इस ᮧकार अनुमोिदत आचंिलक महायोजना इस अिधसूचना के उपबंधᲂ के अनुसार िनगरानी के अपने कायᲄ को करन े के िलए िनगरानी सिमित के िलए एक संदभर् दस्तावजे तैयार करेगी ।
3. राज्य सरकार ᳇ारा िकए जान ेवाल ेउपाय-- राज्य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन ेके िलए िन᳜िलिखत उपाय करेगी, अथार्त ्:--
(1) भ-ूउपयोग - पािरिस् थितक संवेदी जोन मᱶ आमोद-ᮧमोद के ᮧयोजन के िलए िचिन्हत िकए गए ह ᱹवनᲂ, उ᳒ान-कृिष क्षेᮢᲂ, कृिष क्षेᮢᲂ, पाकᲄ और खुल ेस्थानᲂ का वािणिज्यक और औ᳒ोिगक संब िवकास िᮓयाकलापᲂ के िलए उपयोग या संपिरवतर्न नहᱭ होगा :
परंत ुपािरिस्थितक संवेदी जोन के भीतर कृिष भूिम का संपिरवतर्न, पैरा 5 के अधीन िनगरानी सिमित की िसफािरश पर और राज्य सरकार के पवूर् अनुमोदन से, स्थानीय िनवािसयᲂ की आवासीय जरूरतᲂ को परूा करन ेके िलए और पैरा 4 की सारणी के स्तंभ (2) के सूचीब िᮓयाकलापᲂ को पूरा करने के िलए अनुज्ञात हᲂगे, अथार्त ्:-
(i) ᮧदषूण उत्प᳖ न करन ेवाल ेलघु उ᳒ोग,
(ii) पािरिस् थितक अनुकूल पयर्टन िᮓयाकलापᲂ के िलए पयर्टकᲂ के अस् थायी आवासन के िलए पािरिस् थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आिद ;
(iii) वषार् जल संचय, और
(iv) कुटीर उ᳒ोग, िजसके अंतगर्त ᮕामीण उ᳒ोग, सुिवधाजनक भंडार और स् थानीय सुिवधाएं भी ह ᱹ:
परंत ुयह और िक राज्य सरकार के पवूर् अनुमोदन और संिवधान के अनचु् छेद 244 के उपबंधᲂ और तत्समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अिधकारᲂ की मान्यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिज्यक या उ᳒ोग िवकास िᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनुज्ञात नहᱭ होगा :
परंत ुयह और भी िक पािरिस् थितक संवेदी जोन के भीतर भू-अिभलखेᲂ मᱶ उपसंजात कोई ᮢुिट िनगरानी सिमित के िवचार ᮧा᳙ करन े के प᳟ात ् राज्य सरकार ᳇ारा ᮧत्येक मामल ेमᱶ केवल एक बार संशोिधत होगी और उᲦ ᮢुिट के संशोधन की कᱶ ᮤीय सरकार के पयार्वरण वन और जलवाय ु पिरवतर्न मंᮢालय को सूचना दनेी होगी । परंत ुयह और भी िक उपयुर्Ღ ᮢुिट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय िकसी भी दशा मᱶ भू-उपयोग का पिरवतर्न सिम्मिलत नहᱭ होगा । परंत ुयह और भी िक िजससे हिरत क्षेᮢ मᱶ जसेै वन क्षेᮢ, कृिष क्षेᮢ आिद मᱶ कोई पािरणािमक कटौती नहᱭ होगी और अनᮧयुक् त या अनुत् पादक कृिष क्षेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास िकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोतᲂ -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ की पहचान की जाएगी और उनके संरक्षण और पुनरुद्भूतकरण के िलए योजना सिम् मिलत होगी और राज् य सरकार ᳇ारा ऐस ेक्षेᮢᲂ पर या उनके िनकट िवकास िᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागर्िनदᱷश तैयार िकए जाएगें ।
(3) पािरिस्थितक पयर्टन – (क) पािरिस्थितक संवेदी जोन के भीतर पयर्टन संबंधी िᮓयाकलाप, जो आंचिलक महायोजना का भाग रूप मᱶ िन᳜िलिखत रूप मᱶ हᲂगे । (ख) पािरिस्थितक पयर्टन महायोजना पयर्टन िवभाग, उड़ीसा सरकार ᳇ारा राजस् व और वन िवभाग, उड़ीसा सरकार के परामशर् स ेतैयार होगी । (ग) पयर्टन महायोजना आंचिलक महायोजना के एक घटक के रूप मᱶ होगी । (घ) पयर्टन संबंधी िᮓयाकलाप िनम् निलिखत के अधीन िविनयिमत हᲂग,े अथार्त् :-
(i) पािरिस्थितक अनकूुल पयर्टन िᮓयाकलाप स ेसंबंिधत पयर्टकᲂ के अस्थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिक्षत क्षेᮢ बालुखांडा-कोनाकर् वन् यजीव अभयारण्य की सीमा स ेएक िकलोमीटर तक या पािरिस्थितक सवेंदी जोन के िवस्तार तक इनमᱶ जो भी िनकट ह,ै नये वािणिज्यक होटल और िरसोटर् अनुज्ञात नहᱭ हᲂगे। परंत,ु जहा ँपािरिस्थितक सवंेदी जोन का िवस्तार एक िकलोमीटर स ेज्यादा ह ैवहा,ँ एक िकलोमीटर स ेपरे और पािरिस्थितक सवंेदी जोन के िवस्तार तक सभी नए पयर्टक िᮓयाकलाप या िव᳒मान िᮓयाकलाप का िवस्तार पयर्टन महायोजना के अनुसार होगा;
(ii) पािरिस्थितक संवेदी जोन के भीतर सभी नए पयर्टन िᮓयाकलापᲂ या िव᳒मान पयर्टन िᮓयाकलापᲂ का िवस्तार कᱶ ᮤीय 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सरकार के पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢालय के मागर्दशर्क िसांतᲂ के ᳇ारा तथा राष् ᮝीय व् याᮖ संरक्षण ᮧािधकरण, ᳇ारा जारी पािरिस्थितक पयर्टन (समय-समय पर यथा संशोिधत) मागर्दशर्क िसांतᲂ के अनसुार, पािरिस्थितक पयर्टन, पािरिस्थितक िशक्षा और पािरिस्थितक िवकास को महत्व दते े हुए पािरिस्थितक संवेदी जोन की वहन क्षमता के अध्ययन पर आधािरत होगा;
(iii) आंचिलक महायोजना का अनुमोदन िकए जाने तक, पयर्टन के िलए िवकास और िव᳒मान पयर्टन िᮓयाकलापᲂ के िवस्तार को वास्तिवक स्थल िविन᳸दर᳥् संवीक्षा तथा िनगरानी सिमित की िसफािरश पर आधािरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनुज्ञात िकया होगा ।
(4) नसैिगर्क िवरासत -- पािरिस्थितक संवेदी जोन मᱶ महत्वपूणर् नसैिगर्क िवरासत के सभी स्थलᲂ जसेै सभी जीन कोश आरिक्षत क्षेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, स्थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आिद की पहचान की जाएगी और उन्हᱶ संरिक्षत िकया जाएगा तथा उनकी संरक्षा और संरक्षा के िलए इस अिधसूचना के ᮧकाशन की तारीख से छह मास की अविध के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनिमर्त िवरासत स् थलᲂ - पािरिस् थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िशल्प-तथ्य, ऐितहािसक, कलात्मक और सांस्कृितक महत्व के क्षेᮢᲂ की पहचान करनी होगी और इस अिधसूचना के ᮧकाशन की तारीख से छह मास की अविध के भीतर उनके संरक्षण की योजनाए ंतैयार करनी होगी तथा आंचिलक महायोजना मᱶ सिम्मिलत की जाएगी ।
(6) ध् विन ᮧदषूण – पािरिस्थितक संवेदी जोन मᱶ राज्य सरकार का पयार्वरण िवभाग या उड़ीसा राज्य सरकार िनवारण और ध्विन ᮧदषूण िनयंᮢण पयार्वरण (संरक्षण) अिधिनयम, 1986 के अधीन ध्विन (िविनयमन और िनयंᮢण) िनयम 2000 के अनुसार सकंिलत िकया जाएगा ।
(7) वाय ुᮧदषूण -- पािरिस्थितक संवेदी जोन मᱶ वायु ᮧदषूण के िनयंᮢण के िलए वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम 1981 (1981 का 14) और इसके अधीन िकए गए िविनयमᲂ के अनसुार सकंिलत िकया जाएगा ।
(8) बिह᮲ाव का िनस्सारण -- पािरिस्थितक संवेदी जोन मᱶ उपचािरत बिह᮲ाव का िनस्सारण साधारण मानकᲂ के िलए पयार्वरणीय ᮧदिूषत आच्छािदत के िनस्सारण के अतंगर्त पयार्वरणीय (संरक्षण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा।
(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत रूप मᱶ होगा -
(i) पािरिस्थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िᮓयािन्वत िकया जाएगा ;
(ii) अकाबर्िनक सामᮕी पािरिस्थितक संवेदी जोन बा᳭ पहचान की गई स्थल पर स्वीकायर् रीित मᱶ ᳞यत िकया जाएगा ;
(iii) ठोस अपिश᳥ᲂ के ज्वलन या भस्मीकरण और भराई का स्थापना पािरिस्थितक सवंेदी जोन मᱶ अनुज्ञा नहᱭ की जाएगी ;
(10) जवै िचिकत् सीय अपिशष् ट- (i) जैव िचिकत् सीय अपिशष् ट ᮧबंधन िन᳜िलिखत रूप मᱶ होगा— पािरिस्थितक सवंेदी जोन मᱶ जैव िचिकत्सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢालय की अिधसूचना सं.का.िन 343 (अ) तारीख 28 माचर् 2016 ᳇ारा ᮧकािशत जैव िचिकत्सीय अपिश᳥ ᮧबधं िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा ।
(ii) पािरिस्थितक संवेदी जोन मᱶ कोई साधारण उपचार सुिवधा या भस्मीकरण अनुज्ञात नहᱭ िकया जाएगा ।
(iii) पािरिस्थितक संवेदी जोन मᱶ मौजूद ᳞िᲦगत अस्पतालᲂ या िनजी स्वास्थ्य कᱶ ᮤᲂ के संरिक्षत क्षेᮢ पर ᮧितकूल असर से बचने के िलए पयार्᳙ अपिश᳥ उपचार ᮧणाली ᮧदान करनी चािहए।
(11) प्लािस्टक अपिश᳥ ᮧबधंन: - पािरिस्थितक संवेदी जोन मᱶ प्लािस्टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं.का.िन 340(अ), तारीख 18 माचर्, 2016 ᳇ारा ᮧकािशत प्लािस्टक अपिश᳥ ᮧबधं िनयम 2016 के उपबंधᲂ के अनुसार िकया जाएगा।
(12) िनमार्ण और िवध्वसं अपिश᳥ ᮧबधंन: - पािरिस्थितक संवेदी जोन मᱶ संिनमार्ण और िवध्वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢालय की अिधसूचना सं.का.िन 317(अ), तारीख 29 माचर्, 2016 ᳇ारा ᮧकािशत संिनमार्ण और िवध्वंस ᮧबधं िनयम, 2016 के उपबधंᲂ के अनुसार िकया जाएगा।
(13) ई–अपिश᳥:- पािरिस्थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय ᳇ारा ᮧकािशत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा। ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(14) यानीय पिरवहन: - पिरवहन की यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आचंिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत िकए जाएंगे और आंचिलक महायोजना के तैयार होने और राज्य सरकार के सक्षम ᮧािधकारी ᳇ारा के अनुमोिदत होने तक, िनगरानी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनपुालन को िनगरानी करेगी ।
(15) यिद यह आवश्यक समझता ह,ै इस अिधसूचना के उपबंधᲂ को ᮧभावी करने मᱶ केन्ᮤीय सरकार और राज्य सरकार, अन्य उपायᲂ िन᳸दर᳥् करेगा।
4. पािरिस्थितक सवंदेी जोन मᱶ ᮧितिष और िविनयिमत िᮓयाकलापᲂ की सचूी - पािरिस्थितक संवेदी जोन मᱶ सभी िᮓयाकलाप पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीच ेदी गई सारणी मᱶ िविन᳸दर᳥् रीित मᱶ िविनयिमत हᲂगे, अथार्त ्:-- सारणी ᮓम स.ं िᮓयाकलाप िटप्पिणयां
(1) (2) (3) ᮧितिष िᮓयाकलाप
1. वािणिज्यक खनन, पत्थर की खदान और उनको तोड़न ेकी इकाइया ं। (क) सभी ᮧकार के नए और िव᳒मान खनन (लघु और वृहत खिनज), पत्थर की खानᱶ और उनको तोड़न ेकी इकाइयां वास्तिवक स्थानीय िनवािसयᲂ की घरेलू आवश्यकताᲐ िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संिनमार्ण या मरम्मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइल्स या ईंटᲂ का िनमार्ण करना भी सिम्मिलत ह,ै के िसवाय नहᱭ हᲂगी ;
(ख) खनन संिᮓयाएं, माननीय उᲬतम न्यायालय की िरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमर्न िथरुमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अगस्त, 2006 और िरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतिरम आदशे के अनुसरण मᱶ सवर्दा ᮧचालन होगा ।
2. आरा मीलᲂ की स्थापना । पािरिस्थितक सवंेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िवस् तार अनुज्ञात नहᱭ होगा ।
3. ᮧदषूण (जल या वायु या मृदा या ध् विन) कािरत करन ेवाले उ᳒ोगᲂ की स् थापना । पािरिस्थितक सवंेदी जोन मᱶ नए उ᳒ोग और उ᳒ोगᲂ मᱶ िव᳒मान ᮧदषूण का िवस्तार अनुज्ञा नहᱭ होगी। फरवरी, 2016 मᱶ जब तक िक इस ᮧकार अिधसूचना मᱶ िविन᳸दर᳥् न हो, कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा जारी िदशािनदᱷशᲂ मᱶ उ᳒ोगᲂ के वगᱮकरण के अनुसार पािरिस्थितक संवेदी जोन के भीतर केवल गैर- ᮧदषूण कुटीर उ᳒ोगᲂ की अनुज्ञा दी जाएगी। इसके अितिरᲦ गैर- ᮧदषूण कुटीर उ᳒ोगᲂ को संविधर्त िकया जाएगा।
4. जलावन लकड़ी का वािणिज्यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
5. पᱫनᲂ, बंदरगाह और जेटी की स्थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
6. िकसी पिरसकंटमय पदाथᲄ का उपयोग या उत्पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
7. पयर्टन से संबंिधत िᮓयाकलाप जसैे गमर् वाय ु गुब्बारᲂ आिद ᳇ारा अभयारण्य क्षेᮢ के ऊपर से उड़ना जैसे िᮓयाकलाप करना। लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
8. ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢ मᱶ अनुपचािरत बिह᮲ार्व और ठोस अपिश᳥ᲂ का िनस्सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
9. होटल और िरसोटर् का वािणिज्यक स्थापन । नए वािणिज् यक स् थापन जैसे होटल और िरसोटर् पािरिस् थितक संवदेी जोन के भीतर स ेअनुज्ञा नहᱭ होगी ।
10. संिनमार्ण िᮓयाकलाप । पैरा 3 के उपपरैा (1) के सूचीब िᮓयाकलापᲂ सिहत स्थानीय घरेल ू आवश्यकताᲐ के िसवाए पािरिस्थितक सवंेदी जन के भीतर नए ᮧकार का संिनमार्ण अनुज्ञा नहᱭ दी जाएगी। ᮧदषूणता करने वाले लघु उ᳒ोगᲂ से 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] संबंिधत संिनमार्ण िᮓयाकलाप के मामले मᱶ िविनयिमत िकया जाएगा और न्यूनतम रखा जाएगा।
11. ठोस अपिश᳥ िनपटान स्थल और ठोस और जैव िचिकत्सा अपिश᳥ के िलए सामान्य जलाए जान ेकी सुिवधा की स्थापना। पािरिस्थितक सवंेदी जोन मᱶ ठोस अपिश᳥ िनपटान की कोई नई ठोस अपिश᳥ िनपटान स्थल और अपिश᳥ उपचार/ᮧसंस्करण सुिवधा की अनमुित नहᱭ ह।ै इसके अितिरᲦ औ᳒ोिगक ᮧिᮓया और स्वास्थ्य ᮧित᳧ान / अस्पतालᲂ आिद से उत्प᳖ िकसी भी ठोस अपिश᳥ के उपचार के िलए सामान्य या ᳞िᲦगत जलावतरण की सुिवधा का अिधकतर ᮧितिष ह।ै
12. फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमान े पर वािणिज्यक पशुधन संपदा और कुक्कुट फामᲄ की स्थापना । स्थानीय जरूरतᲂ को पूरा करने के िसवाय लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे।
13. ईंट भᲵᲂ की स्थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) । िविनयिमत िᮓयाकलाप
14. वृक्षᲂ की कटाई । (क) राज्य सरकार मᱶ सक्षम ᮧािधकारी की पवूर् अनमुित के िबना वन, सरकारी या राजस्व या िनजी भूिम पर या वनᲂ मᱶ ᳴कंही वृक्षᲂ की कटाई नहᱭ होगी । (ख) वृक्षᲂ की कटाई संबंिधत कᱶ ᮤीय या राज्य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
15. कृिष ᮧणािलयᲂ मᱶ आमूल पिरवतर्न । लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
16. वािणिज्यक जल संसाधन िजसके अंतगर्त भू- जल संचयन भी ह ै। (क) भूिम के अिधभोगी के वास्तिवक कृिष और घरेलू खपत के िलए जल का िनष्कषर्ण (सतही और भूिमगत जल) अनुज्ञात होगा । (ख) औ᳒ोिगक, वािणिज्यक उपयोग के िलए सतही और भूिमगत जल का िनष्कषर्ण के िलए संबंिधत िविनयामक ᮧािधकरण पवूर् िलिखत अनुज्ञा अपेिक्षत होगी िजसके अंतगर्त िकतने पिरणाम मᱶ वह िनष्कषर्ण करेगा, भी ह ै। (ग) सतही या भूजल का िवᮓय अनुज्ञात नहᱭ होगा । (घ) जल के संदषूण या ᮧदषूण, िजसके अंतगर्त कृिष भी ह,ै को रोकने के िलए सभी उपाय िकए जाएंगे ।
17. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पिरिनमार्ण और केबल िबछाना और अन्य बुिनयादी ढांच े। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । भूिमगत केबल को बढ़ावा िदया जाएगा।
18. होटलᲂ और लॉज के िव᳒मान पिरसरᲂ मᱶ बाड लगाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
19. प् लािस् टक के थैलᲂ का उपयोग लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
20. िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमार्ण । उिचत पयार्वरण समाघात िनधार्रण और न् यूनीकरण उपाय यथा लागू अनुसार हᲂगे ।
21. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणिज्यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
22. िवदशेी ᮧजाितयᲂ की पहचान। लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
23. पहाड़ी ढालᲂ और नदी तटᲂ का संरक्षण । लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
24. वायु और यािनक ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
25. वािणिज् यक साइनबोडर् और होिडᲈग। लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
26. ᮧाकृितक जल िनकायᲂ सतही क्षेᮢ मᱶ उपचािरत बिह᮲ार्व का िनस्सारण । उपचािरत/ बिह᮲ार्व के पुनचर्ᮓण को ᮧोत्सािहत करन ेऔर अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनपुालन िकया जाएगा । अन्यथा लाग ू िविधयᲂ के अधीन उपचािरत बिह᮲ार्व के पुनचर्ᮓण/ᮧवाह के िनवर्हन को िविनयिमत िकया जाएगा।
27. वन उत्पादᲂ या गैर काष् ठ वन उत्पादᲂ एन टी एफ टी का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।

29. नए काष् ठ आधािरत उ᳒ोग। पािरिस् थितक सवंेदी जोन की सीमा के भीतर नए काष् ठ आधािर त उ᳒ोगᲂ की स् थापना को अनजु्ञात नहᱭ िक या जाएगा:
परंतु नए का᳧ आधािरत उ᳒ोग 100% आयाितत का᳧ स्टाक को ᮧयोग मᱶ लात ेहुए पािरिस्थितक सवंेदी जोन मᱶ स्थािपत िकए जा सकᱶ गे ।
30. पािरिस् थितक अनुकूल पयर्टक िᮓयाकलापᲂ के िलए, पयर्टकᲂ के अस्थायी आवासन के िलए पािरिस् थितक अनुकूल कुटीर, जैसे तंब,ू लकड़ी के घर आिद। लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
31. नागिरक सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ के अनुसार न्यनूीकरण की उपायᲂ के साथ, िनयम और िविनयमन और उपलब्ध िदशािनदᱷश िविनयिमत हᲂगे।
32. खुल ेकुआ, बोर कुआ, आिद के िलए कृिष और अन्य उपयोग । िविनयिमत और उपयुᲦ ᮧािधकारी ᳇ारा िᮓयाकलापᲂ की सख्ती से िनगरानी की जाएगी।
33. ठोस अपिशष् ट ᮧबंधन। लागू िविधयᲂ के अधीन िविनयिमत हᲂग े। सवंिधर्त िᮓयाकलाप
34. स्थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी पित के साथ पशपुालन, पशुपालन कृिष, जल कृिष और मछली पालन। लागू िविधयᲂ के अधीन अनुज्ञात हᲂगे ।
35. ᮧदषूण उत्प᳖ न करन ेवाल ेलघु उ᳒ोग । पािरिस्थितक सवंेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा जारी िदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफर् गैर- ᮧदिूषत उ᳒ोगᲂ की स्थापना के वगᱮकरण की अनुमित दी जाएगी, पािरिस्थितक संवेदी जोन से गैर –ᮧदषूण, गैर पिरसकंटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधािरत औ᳒ोिगक उत्पादᲂ का उत्पादन उ᳒ोग को सक्षम ᮧािधकारी ᳇ारा अनुज्ञात िकए जाएंगे।
36. वषार् जल संचयन। सिᮓय रूप से बढावा िदया जाए ।
37. जैिवक खेती। सिᮓय रूप से बढावा िदया जाए ।
38. नवीकरणीय ऊजार् ᮲ोत का उपयोग। लागू िविधयᲂ के अधीन अनुज्ञात हᲂगे ।
39. सभी िᮓयाकलापᲂ के िलए हिरत ᮧौ᳒ोिगकी को ᮕहण करना । सिᮓय रूप से बढावा िदया जाए ।
40. वानस् पितक बाड। लागू िविधयᲂ के अधीन अनुज्ञात हᲂगे ।
41. कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण कारीगर आिद भी ह।ᱹ सिᮓय रूप से बढावा िदया जाए ।
42. नवीकरणीय ऊजार् ᮲ोत का उपयोग। सिᮓय रुप स ेबायो गैस, सौर ᮧकाश आिद को बढ़ावा िदया जाएगा ।
43. कृिष वािनकी । सिᮓ य रूप से बढ़ावा िदया जाएगा ।
44. पािरिस्थितक-अनुकूल पिरवहन का उपयोग । सिᮓय रूप से बढ़ावा िदया जाएगा ।
45. कौशल िवकास । सिᮓ य रूप से बढ़ावा िदया जाएगा ।
46. िन᳜ीकृत भूिम/ वन/ आवास की बहाली । सिᮓ य रूप से बढ़ावा िदया जाएगा ।
47. पयार्वरणीय जागरुकता । सिᮓय रूप से बढ़ावा िदया जाएगा । ऊपर िविन᳸दर᳥् िᮓयाकलाप के अनुसार ᮧितिष िᮓयाकलाप ᮧारूप अिधसूचना जारी करने की तारीख स ेᮧस्त हᲂगी। पािरिस्थितक सवंदेी जोन िनगरानी सिमित- (1) कᱶ ᮤीय सरकार, पािरिस्थितक संवेदी जोन के ᮧभावी िनगरानी के िलए एक िनगरानी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथार्त् :- i. िजला कलक् टर पुरी, उड़ीसा सरकार - अध्यक्ष ;
ii. पुिलस अधीक्षक, पुरी – सदस् य ;

iv. पािरिस् थितक और पयार्वरण के क्षेᮢ मᱶ उड़ीसा सरकार ᳇ारा नामिन᳸दर्ष् ट ᮧत्यके मामले मᱶ तीन वषर् की अविध के िलए एक िवशेषज्ञ - सदस्य ;
v. उड़ीसा राज्य जवै-िविवधता बोडर् का सदस्य सिचव/सदस्य - सदस्य;
vi. तहसीलदार,गोप – सदस् य ;
vii. कायर्पालक अिधकारी, पुरी नगरपािलका, परुी - सदस्य ;
viii. कायर्पालक अिधकारी, कोणाकर् एनएसी, कोणाकर् - सदस्य ;
ix. ᮧादिेशक अिधकारी, उड़ीसा राज् य ᮧदषूण िनयंᮢण बोडर् - सदस्य ; और x. ᮧखडं वन अिधकारी, पुरी वन् यजीव ᮧखंड – सदस्य-सिचव ।
6. िनदᱷश िनबधंन
(1) िनगरानी सिमित का कायर्काल अिधसूचना जारी करन ेकी तारीख स ेतीन वषर् की अविध के िलए होगा।
(2) पािरिस्थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनपुालन को मानीटर करेगी ।
(3) पािरिस्थितक संवेदी जोन मᱶ भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अनुसचूी मᱶ के अधीन सिम्मिलत िᮓयाकलापᲂ और इस अिधसचूना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आन े वाल े ऐस े िᮓयाकलापᲂ की दशा मᱶ वास्तिवक िविन᳸दर᳥् स्थलीय दशाᲐ पर आधािरत राज्य स्तरीय पािरिस्थितक संवेदी जोन िनगरानी सिमित ᳇ारा संवीक्षा की जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पवूर् पयार्वरण िनकासी के िलए केन्ᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को िन᳸दर᳥् की जाएगी ।
(4) इस अिधसचूना के पैरा 4 के अधीन यथा िविन᳸दर᳥् ᮧितिष िᮓयाकलापᲂ के िसवाय, भारत सरकार के पयार्वरण और वन मंᮢालय की अिधसूचना संख्यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अिधसूचना के अनसुूची के अधीन ऐस ेिᮓयाकलापᲂ, िजन्हᱶ सिम्मिलत नहᱭ िकया गया ह,ै परंत ुपािरिस्थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐस ेिᮓयाकलापᲂ की वास्तिवक िविन᳸दर᳥् स्थलीय दशाᲐ पर आधािरत िनगरानी सिमित ᳇ारा संवीक्षा की जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸दर᳥् िकया जाएगा ।
(5) िनगरानी सिमित का सदस्य-सिचव या संब उपायुक् त (उपायुक् तᲂ) संरिक्षत क्षेᮢ ऐस े᳞िᲦ के िवरू, जो इस अिधसूचना के िकसी उपबंध का उल्लंघन करता ह,ै पयार्वरण (संरक्षण) अिधिनयम, 1986 की धारा 19 के अधीन पिरवाद फाइल करन ेके िलए सक्षम होगा ।
(6) िनगरानी सिमित मुᲂ के आधार पर अपेक्षाᲐ पर िनभर्र रहते हुए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेषज्ञᲂ, औ᳒ोिगक संगमᲂ या संब पणधािरयᲂ के ᮧितिनिधयᲂ को अपन ेिवचार-िवमशर् मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

8. कोई अन् य महत् वपणूर् िवषय । 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 19th May, 2017 S.O.1654(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.
3123(E) dated the 20th November, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, comments, objections and suggestions received from persons and stakeholders in response to the draft notification were duly considered;
AND WHEREAS, the Balukhanda-Konark Wildlife Sanctuary has been notified under section 18 of Wildlife Protection Act, 1972 for conservation of the sensitive coastal ecosystem and biodiversity vide Government notification No.9013/FFAH dated 23rd April, 1984 and the notification was amended vide Government notification No.15261/FFAH dated the 1st September, 1987, in which 70.40 Acres of the Government land in one patch was excluded from the Sanctuary and the Balukhanda-Konark Wildlife Sanctuary is at a distance about 60 kilometres from Bhubaneswar in the State of Odisha and is an important site for integration of in-situ and ex-situ Conservation of Wildlife;
AND WHEREAS, the Balukhanda-Konark Wildlife Sanctuary situated in Puri District in the State of Odisha extending over 87 square kilometres and the Bay of Bengal is on the Southern side of the Sanctuary. The primary tree species are casuarinas, cashew (Anacardium occidentale), Eucalypatus and Ear leaf Acacia (Acacia auriciuliformis). The natural vegetation consists of Neem (Azadirachta indica), Ghanta (Abutilon sp.), Guakoli, Khirkoli (Monilkra hexandra) etc.;
AND WHEREAS, a portion of Golara proposed reserved Forest Block of this Sanctuary situated on the mouth of Prachi river supports Mangrove vegetation like Keruan (Hollarhena antidysenterika), Raj, Guan along with associates like Mankadkendu, Barakoli, Jamun (Syzgium cummini), Jhumpuri, Canes and Bamboos. Wild animals like Black Buck (Antilope cervicapra), Spotted deer (Rusa alfredi), Hyena (Hyaena sp.), Jungle Cat (Felis chaus), Jackal (Canis aureus), Fox (Vulpes vulpes), Monkey (Macaca sp.), Hare (Lepus sp.), Monitor Lizard (Varanus sp.), etc. are found in the Sanctuary;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of the Balukhanda-Konark Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with subrule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an extent of 0 metres to 500 metres on the landward side of the Balukhanda-Konark Wildlife Sanctuary in the State of Odisha as the Balukhanda-Konark Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1)The extent of Eco-sensitive Zone varies from 0 metres to 500 metres on the landward side of boundary of the Balukhanda-Konark Wildlife Sanctuary. 21. 50 square kilometres.
(2) The Eco-sensitive Zone is bounded by 19º54’03.5"N latitude and 86º13’34.2”E longitude towards east; 19º48’14.4"N latitude and 85º51’35.0"E longitude towards west-south; 19º52’45.0"N latitude and 86º01’01.8”E longitude towards north and 19º51’15.3"N latitude and 86º04’33.9"E longitude towards south.
(3) The map of Balukhanda-Konark Wildlife Sanctuary demarcating the Eco-sensitive Zone boundary along with the geo co-ordinates are appended as Annexure I.
(4) The list of thirty villages falling within the Eco-sensitive Zone along with their geo co-ordinates is appended as Annexure II.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan so prepared shall commensurate with the stipulation specified in the Notification and include the environmental implications.
(3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.

(4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture; and
(viii) Odisha State Pollution Control Board.
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas such as parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.
(9) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and shall follow prohibited, regulated and promoted activities specified in the Notification so as to ensure Eco-friendly development for livelihood security of local communities.
(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions with respect to the provisions given in this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:-
(i) Small scale industries not causing pollution;
(ii) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism activities;
(iii) Rainwater harvesting; and
(iv) Cottage industries including village artisans:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or and restrict development activities within the catchment areas.
(3) Eco-Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-tourism Master Plan shall be prepared by the Department of Tourism, Government of Odisha in consultation with Department of Revenue and Forests, Government of Odisha.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities relating to tourism shall be regulated as under, namely.-
(i) No new construction of hotels and resorts shall be allowed within 1 km. from the boundary of the Balukhanda-Konark Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km.
from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by The National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism.
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Odisha State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 framed under the Environment (Protection) Act, 1986.
(7) Air pollution.- Regulations for the control of air pollution in the Eco-Sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with.
(8) Discharge of effluents.- The discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made therein.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) The solid waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 .
(ii) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone.
(iii) No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- (i) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016.
(ii) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.

(iii) Individual hospitals or private health centres already existing within the Eco Sensitive Zone should provide adequate waste treatment system to avoid adverse impact on the Protected Area.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317(E), dated the 29th March, 2016.
(13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change .
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:- Sl. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs.
UOI in W.P.(C) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
5. Establishment of ports, harbours and jetty. Prohibited (except as otherwise provided) as per applicable laws.
6. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
7. Undertaking activities related to tourism like over-flying the sanctuary area by hot-air balloons, etc.

8. Discharge of untreated effluents and solid waste in natural water bodies or land area.

9. Commercial establishment of hotels and resorts.
No new or expansion of existing commercial establishments such as hotels and resorts shall be permitted within the Eco-sensitive Zone.
10. Construction activities. No new construction of any kind shall be permitted within the Eco-sensitive Zone, except for the domestic needs of local residents including the activities listed in sub-paragraph (1) of paragraph 3. In case of the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum.
11. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste .
No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within Eco sensitive zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is Prohibited.
12. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
13. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
Regulated Activities
14. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
15. Drastic change of agriculture system. Regulated under applicable laws.
16. Commercial water resources including ground water harvesting.
(a)The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.
(b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority.
(c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
17. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law. Underground cabling may be promoted.
18. Fencing of existing premises of hotels, lodges and resorts.
Regulated under applicable laws.
19. Use of plastic carry bags. Regulated under applicable laws.
20. Widening and strengthening of existing roads and construction of new roads.
Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
21. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
22. Introduction of exotic species. Regulated under applicable laws.
23. Protection of hill slopes and river banks. Regulated under applicable laws.
24. Air, noise and vehicular pollution. Regulated under applicable laws.
25. Commercial Sign boards and hoardings. Regulated under applicable laws.

26. Discharge of treated effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water.
Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
27. Collection of Forest produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
28. Security Forces Camp. Regulated under applicable laws.
29. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone:
Provided that new wood based industry may be set up in the Eco-sensitive Zone using 100% imported wood stock.
30. Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, etc.
for Eco-friendly tourism activities.
Regulated under applicable laws.
31. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
32. Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
33. Solid Waste Management. Regulated under applicable laws.
Promoted Activities
34. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming and fisheries.
Permitted under applicable laws.
35. Small scale industries not causing pollution. Non polluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
36. Rain water harvesting. Shall be actively promoted.
37. Organic farming. Shall be actively promoted.
38. Use of renewable energy sources. Permitted under applicable laws.
39. Adoption of green technology for all activities. Shall be actively promoted.
40. Vegetative fencing. Permitted under applicable laws.
41. Cottage industries including village artisans, etc., Shall be actively promoted.
42. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted .
43. Agro-Forestry. Shall be actively promoted.
44. Use of eco-friendly transport. Shall be actively promoted.
45. Skill Development. Shall be actively promoted.
46. Restoration of Degraded Land/ Forests/ Habitat.
Shall be actively promoted.
47. Environmental Awareness . Shall be actively promoted.
Prohibited Activities as specified above shall come into effect from the date of issue of Draft Notification.
5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) The District Collector Puri, Government of Odisha – Chairman;
(ii) Superintendent of Police, Puri - Member;

(iii) Representative of Non-governmental Organisations working in the field of environment to be nominated by the State Government of Odisha for a term of three years in each case – Member;
(iv) One expert in the area of ecology and environment to be nominated by the State Government of Odisha for a term of three years in each case - Member;
(v) Member-Secretary or Member, Odisha State Biodiversity Board - Member;
(vi) Tahasildar, Gop - Member;
(vii) Executive Officer, Puri Municipality, Puri -Member;
(viii) Executive Officer, Konark NAC, Konark - Member;
(ix) Regional Officer, Odisha State Pollution Control Board -Member; and
(x) Divisional Forest Officer, Puri Wildlife Division – Member-Secretary.
6.Terms of Reference:-
(1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of Notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment, 2006 vide S.O. 1533 (E), dated the 14th September, 2006, and the Coastal Regulation Zone, Notification 2011 vide S.O. No. 19(E) dated 6th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof.
Only white categories of industries shall be considered as specified in the guidelines issued by the Central Pollution Control Board for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and S.O. 19 (E) dated 6th January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State under intimation to this Ministry as per proforma appended at Annexure III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
