PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 1503] ubZ fnYyh] 'kqØokj] ebZ 26] 2017@T;s"B 5] 1939 No. 1503] NEW DELHI, FRIDAY, MAY 26, 2017/JYAISTHA 5, 1939 पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢालय अिधसचूना नई िदल्ली, 26 मई, 2017 का.आ. 1698(अ).—ᮧारुप अिधसूचना भारत के राजपᮢ असाधारण मᱶ भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं. का.आ. 3229 (अ), तारीख 1 िदसम्बर, 2015 ᳇ारा ᮧकािशत की गई थी िजसमᱶ अन्य सभी ᳞िᲦयᲂ से, िजनकी उससे ᮧभािवत होन ेकी संभावना थी, उस तारीख स,े िजसको अिधसूचना को अन्तिवर᳥् करने वाल ेराजपᮢ की ᮧितयां जनता को उपलब्ध करा दी गई थᱭ, साठ िदन की अविध के भीतर सझुाव और आक्षेप आमंिᮢत िकए गए थ;े और, उᲦ ᮧारूप अिधसूचना के ᮧत्युᱫर मᱶ ᳞िᲦयᲂ और पणधािरयᲂ स ेकोई आक्षेप और सुक्षाव ᮧा᳙ नहᱭ हुए थ;े और, महावीर हरीना वनस्थली रा᳦ीय उ᳒ान हदैराबाद शहर के समीप तलेंगाना के रंगरेी िजले मᱶ घनी आबादी और आवासीय सह वािणिज्यक क्षेᮢ मᱶ अविस्थत ह ैऔर 1459 हके्टेयर के क्षेᮢफल तक िवस्तािरत ह;ै और, रा᳦ीय उ᳒ान तजेी से िवकिसत हो रह ेहदैराबाद शहर के िलए एक बृहत काबर्न िसंक का कायर् करता ह,ै दिक्षणी पठार के अत्यंत जैव िविवधता का ᮧितिनिधत्व करने वाले वनस्पित, जंत ुऔर अितीय शैल िनमार्ण िजसमᱶ 600 से अिधक पौधᲂ की ᮧजाित, 110 पिक्षयᲂ की ᮧजाित, 20 स्तनपािययᲂ की ᮧजाित, 20 सरीसृप और अभेचरᲂ की ᮧजाित, कीड़ᲂ और अन्य अकशेरुकीय की ᮧजाित सिम्मिलत ह,ै का अिंतम अवशेष ह ै;
और, रा᳦ीय उ᳒ान भारतीय काल े िहरण, चार सᱭग वाले िहरण, िचᱫदेार िहरण, भारतीय साही, जंगली िबल्ली, सामान्य नेवला, भारतीय ऊदिबलाव, काला जंगली खरगोश, बनैला सूअर का समुिचत आवास ह;ै और, इस क्षेᮢ ᮧारुिपक दिक्षणी पठार वनस्पित को दशार्या हिरत क्षेᮢ ह ैजहां, रेन्डे डयूमाटोिरयम, िजिजफस मांिरिटयाना, बाउिहिनया रेसमोसा, केिशया िफस्टयूला, अकेिशया ल्यूकोप्ले और अनोना स्कामोसा जैस ेपौधᲂ की ᮧजाितयां ह;ै और, महावीर हरीना वनस्थली रा᳦ीय उ᳒ान के चारᲂ ओर के संरिक्षत क्षेᮢ को, पयार्वरण की दिृ᳥ से पािरिस्थितक संवेदी जोन के रूप मᱶ सुरिक्षत और संरिक्षत करना और वन्यजीव के सुधार और िवकास करना आवश्यक ह;ै अतः, अब, केन्ᮤीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv) के साथ पिठत और उपधारा (1) ᳇ारा ᮧदᱫ 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] शिᲦयᲂ का ᮧयोग करत ेहुए, तलेंगाना राज् य मᱶ महावीर हरीना वनस्थली रा᳦ीय उ᳒ान की सीमा से एक िकलोमीटर तक के िवस्तािरत क्षेᮢ को महावीर हरीना वनस्थली रा᳦ीय उ᳒ान पािरिस्थितक संवेदी जोन (िजसे इसमᱶ इसके प᳟ात पािरिस्थितक सवंेदी जन कहा गया है) के रूप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथार्त् :—
1. पािरिस्थितक सवंदेी जोन का िवस्तार और उसकी सीमाएं.—(1) पािरिस्थितक सवंेदी जोन मᱶ महावीर हरीना वनस्थली रा᳦ीय उ᳒ान की चारᲂ तरफ से 1 िकलोमीटर तक के क्षेᮢ मᱶ फैला हुआ ह ैऔर इसमᱶ तेलगंाना के रंगरेी िजला के 17 ᮕाम सिम्मिलत ह ैऔर पािरिस्थितक सवंेदी जोन का क्षेᮢ 40.56 वगर् िकलोमीटर ह ै।
(2) अक्षांश और दशेान्तर के साथ पािरिस्थितक सवंेदी जोन की सीमा का मानिचᮢ उपाबधं I के रूप मᱶ उपाब ह।ै
(3) पािरिस्थितक संवेदी जोन के अंतगर्त आन ेवाल ेᮕामᲂ की सचूी उपाबधं II मᱶ िदया गया ह।ै
2. पािरिस्थितक सवंदेी जोन के िलए आचंिलक महायोजना.—(1) राज्य सरकार, पािरिस्थितक संवेदी जोन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन की तारीख से दो वषर् की अविध के भीतर, स्थानीय ᳞िᲦयᲂ के परामशर् से और इस अिधसूचना मᱶ िदए गए राज्य सरकार मᱶ सक्षम ᮧािधकारी के अनुमोदन के िलए इस अिधसूचना मᱶ अनुबंधᲂ का पालन करत ेहुए आचंिलक महायोजना तैयार करेगी ।
(2) राज्य सरकार ᳇ारा पािरिस् थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ यथा िविन᳸दर्ष् ट ऐसी रीित मᱶ तथा सुसंगत कᱶ ᮤीय और राज् य िविधयᲂ के अनरुुप और कᱶ ᮤीय सरकार ᳇ारा जारी मागर्िनदᱷशᲂ, यिद कोई हᲂ, ᳇ारा तयैार होगी ।
(3) आंचिलक महायोजना, पािरिस्थितक और पयार्वरणीय संबंधी बातᲂ को उᲦ योजना मᱶ समाकिलत करन ेके िलए राज् य सरकार के सभी संब िवभागᲂ के परामशर् स ेतैयार होगी, अथार्त्:—
(i) पयार्वरण;
(ii) वन और वन्यजीव;
(iii) कृिष और बागबानी ;
(iv) राजस् व;
(v) नगर िवकास;
(vi) पािरिस्थितक-पयर्टन सिहत पयर्टन;
(vii) ᮕामीण िवकास;
(viii) िसंचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका और नगर िवकास;
(x) पंचायती राज;
(xi) लोक िन मार्ण िव भाग।
(4) आंचिलक महायोजना अनुमोिदत िव᳒मान भू-उपयोग, अवसंरचना और िᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक िक इस अिधसूचना मᱶ िविन᳸दर्ष् ट न हो और आचिंलक महायोजना सभी अवसंरचना और िᮓयाकलापᲂ मᱶ और अिधक दक्षता और पािरिस्थितक अनुकूलता का सवंधर्न करेगी ।
(5) आंचिलक महायोजना मᱶ अनाच्छािदत क्षेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरक्षण, आवाह क्षेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरक्षण, स्थानीय समुदायᲂ की आवश्यकताᲐ तथा पािरिस्थितक और पयार्वरण से संबंिधत ऐसे अन्य पहलᲐू, िजन पर ध्यान दनेा आवश्यक ह,ै के िलए उपबंध हᲂगे ।
(6) आंचिलक महायोजना सभी िव᳒मान पजूा स् थलᲂ, ᮕामᲂ और नगरीय बंदोबस्तᲂ, वनᲂ के ᮧकार और िकस् मᲂ, कृिष क्षेᮢᲂ, ऊपजाऊ भूिम, हिरत क्षेᮢ जैस ेउ᳒ान और उसी ᮧकार के स् थान, उ᳒ान कृिष क्षेᮢ, फलोउ᳒ान, झीलᲂ और अन्य जल िनकायᲂ का अभ्यकंन करेगी और समथर्नकारी मानिचᮢ और िव᳒मान और ᮧस्तािवत भूिम के उपयोग की िवशषेताᲐ के ब्यौरे दतेे हुए मानिचᮢᲂ ᳇ारा समिथर्त होगी ।
(7) आंचिलक महायोजना पािरिस्थितक सवंेदी जोन मᱶ िवकास को सारणी मᱶ सूचीब ᮧितिष, िविनयिमत िᮓयाकलापᲂ का पालन करेगी तथा िविनयिमत करेगी स् थानीय समुदायᲂ की जीवकोपाजर्न सुरक्षा के िलए, पािरिस्थितक अनुकूल िवकास सुिनिश् चत करेगी तथा संविधर्त करेगी। ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(8) आचंिलक महायोजना क्षेᮢीय िवकास योजना के साथ सह-िवस्तारी होगी ।
(9) इस ᮧकार अनुमोिदत आचंिलक महायोजना इस अिधसूचना के उपबंधᲂ के अनुसार िनगरानी के अपने कायᲄ को करन ेके िलए िनगरानी सिमित के िलए एक संदभर् दस्तावेज तैयार करेगी ।
3. राज्य सरकार ᳇ारा िकए जान ेवाल ेउपाय.—राज्य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन ेके िलए िन᳜िलिखत उपाय करेगी, अथार्त:्—
(1) भ-ूउपयोग – (क) पािरिस् थितक संवेदी जोन मᱶ आमोद-ᮧमोद के ᮧयोजन के िलए िचिन्हत िकए गए वनᲂ, उ᳒ान-कृिष क्षेᮢᲂ, कृिष क्षेᮢᲂ, पाकᲄ और खुले स्थानᲂ का वािणिज्यक और औ᳒ोिगक संब िवकास िᮓयाकलापᲂ के िलए उपयोग या संपिरवतर्न नहᱭ होगा:
परंत ुपािरिस्थितक संवेदी जोन के भीतर िविन᳸दर᳥् कृिष और अन्य भूिम से िभ᳖ कृिष और अन्य भूिम का संपिरवतर्न िनगरानी सिमित की िसफािरश पर और यथा लागू सुसगंत राज्य िविधयᲂ और केन्ᮤीय/राज्य सरकार के अन्य िनयमᲂ तथा िविनयमᲂ के अधीन सक्षम ᮧािधकारी के पवूर् अनुमोदन स,े तथा इस अिधसूचना के उपबधंᲂ ᳇ारा स्थानीय िनवािसयᲂ की िन᳜िलिखत आवासीय जरूरतᲂ को पूरा करन ेके िलए अनुज्ञात िकया जाएगा, जैस:े-
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमार्ण;
(ii) अवसंरचना और नागिरक सुिवधाᲐ का संिनमार्ण और नवीकरण;
(iii) ᮧदषूण उत्प᳖ न करन ेवाल ेलघु उ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण उ᳒ोग भी ह;ᱹ सुिवधाजनक भण्डार और पािरिस्थितक पयर्टन मᱶ सहायक स्थानीय सुिवधाएं िजसमᱶ गृह वास भी ह;ै और
(v) संविधर्त िᮓयाकलाप और िजन्ह ेपैरा 4 के अधीन िदया गया ह:ै परन्त ुयह और िक जनजातीय भूिम का कोई उपयोग राज्य सरकार की सुसंगत राज्य िविधयᲂ तथा इसके अधीन बनाए िनयमᲂ और उपिनयमᲂ के अधीन सक्षम ᮧािधकारी के पवूर् अनमुोदन के िबना तथा संिवधान के अनचु्छेद 244 और तत्समय ᮧवᱫृ िविध िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अिधकारᲂ की मान्यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै के उपबंधᲂ के अनपुालन के िबना, वािणिज्यक या उ᳒ोग िवकास िᮓयाकलापᲂ के िलए अनुज्ञात नहᱭ होगा:
परंत ुयह भी िक पािरिस् थितक संवेदी जोन के भीतर भ-ूअिभलखेᲂ मᱶ उपसंजात कोई ᮢुिट, िनगरानी सिमित के िवचार ᮧा᳙ करन ेके प᳟ात ्राज्य सरकार ᳇ारा ᮧत्येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुिट के संशोधन की सचूना कᱶ ᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को दनेी होगी । परंत ुयह और भी िक ऊपर िन᳸दर᳥् ᮢुिट के संशोधन मᱶ इस उप पैरा के अधीन यथा उपबिंधत के िसवाय िकसी भी दशा मᱶ भू-उपयोग का पिरवतर्न सिम्मिलत नहᱭ होगा । (ख) वनरोपण और वास जीणᲃार िᮓयाकलापᲂ वाले अनᮧयुक् त या अनुत् पादक कृिष क्षेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास िकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ/निदयᲂ/चैनलᲂ की पहचान की जाएगी और उनके संरक्षण और नवीकरण के िलए योजना समािव᳥ होगी ।
(3) पयर्टन/पािरिस्थितक पयर्टन – (क) पािरिस्थितक संवेदी जोन के भीतर िव᳒मान सभी नए पािरिस्थितक िᮓयाकलाप या पयर्टन संबंधी िᮓयाकलाप पािरिस्थितक सवंेदी जोन के िलए पयर्टन महायोजना के अनसुार हᲂग ेजो िक आंचिलक महायोजना के भाग रूप मᱶ होगी । (ख) पािरिस्थितक पयर्टन महायोजना पयर्टन िवभाग, ᳇ारा राज्य के पयार्वरण और वन िवभाग के परामशर् से तैयार होगी । (ग) पयर्टन महायोजना आंचिलक महायोजना के एक घटक का रूप होगी । (घ) पािरिस्थितक पयर्टन संबंधी िᮓयाकलाप िन᳜ानुसार िविनयिमत हᲂगे, अथार्त् :-
(i) महावीर हरीना वनस्थली रा᳦ीय उ᳒ान की सीमा स े1 िक. मी. के भीतर या पािरिस्थितक सवंेदी जोन के िवस्तार तक जो भी िनकट हो और वन्यजीव अभयारण्य की सीमा स ेएक िक.मी. की दरूी स ेपरे पािरिस्थितक संवदेी जोन के िवस्तार तक नए होटलᲂ तथा िरसोटर् का संिनमार्ण अनुज्ञात िकया जाएगा और नए होटलᲂ तथा िरसाटर् की स्थापना केवल पयर्टन महायोजना के अनुसार पािरिस्थितक पयर्टन सुिवधाᲐ के िलए अभ्यंिकत और नामो᳸दर᳥् क्षेᮢᲂ मᱶ ही अनुज्ञात की जाएगी;

(ii) पािरिस्थितक संवेदी जोन के भीतर सभी नए पयर्टन िᮓयाकलापᲂ या िव᳒मान पयर्टन िᮓयाकलापᲂ का िवस्तार कᱶ ᮤीय सरकार के पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢालय के मागर्दशर्क िसांतᲂ के ᳇ारा तथा राष् ᮝीय व् याᮖ संरक्षण ᮧािधकरण, ᳇ारा जारी पािरिस्थितक पयर्टन (समय-समय पर यथा संशोिधत) मागर्दशर्क िसांतᲂ के अनुसार, पािरिस्थितक पयर्टन, पर आधािरत होगा;
(iii) आंचिलक महायोजना का अनुमोदन िकए जाने तक, पयर्टन के िलए िवकास और िव᳒मान पयर्टन िᮓयाकलापᲂ के िवस्तार को वास्तिवक स्थल िविन᳸दर᳥् संवीक्षा तथा िनगरानी सिमित की िसफािरश पर आधािरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनुज्ञात िकया जाएगा और पािरिस्थितक संवदेी जोन के भीतर नये होटल/ िरसोटर् या वािणिज्यक स्थापनᲂ का िविनमार्ण अनुज्ञात नहᱭ िकया जाएगा ।
(4) नसैिगर्क िवरासत -- पािरिस्थितक संवेदी जोन मᱶ महत्वपूणर् नैसिगर्क िवरासत के सभी स्थलᲂ जैसे सभी जीन कोश आरिक्षत क्षेᮢ, शैल िवरचनाए,ं जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं स्थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आिद की पहचान की जाएगी और उन्हᱶ संरिक्षत िकया जाएगा तथा उनकी सुरक्षा और संरक्षा के िलए उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनिमर्त िवरासत स् थल - पािरिस् थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िशल्प-तथ्य, ऐितहािसक, कलात्मक और सांस्कृितक महत्व के क्षेᮢᲂ की पहचान करनी होगी और उनके संरक्षण की योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ भाग होगी ।
(6) ध् विन ᮧदषूण – पािरिस्थितक संवदेी जोन मᱶ िनवारण और ध्विन ᮧदषूण िनयंᮢण पयार्वरण (संरक्षण) अिधिनयम, 1986 के अधीन ध्विन (िविनयमन और िनयंᮢण) िनयम 2000 के अनुसार संकिलत िकया जाएगा ।
(7) वाय ुᮧदषूण -- पािरिस्थितक संवेदी जोन मᱶ िनवारण और िनयंᮢण, वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम 1981 (1981 का 14) और इसके अधीन िकए गए िनयमᲂ के अनसुार सकंिलत िकया जाएगा ।
(8) बिह᮲ाव का िनस्सारण - पािरिस्थितक संवेदी जोन मᱶ उपचािरत बिह᮲ाव का िनस्सारण पयार्वरणीय (संरक्षण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ या राज्य सरकार ᳇ारा िनयत मानकᲂ के अन्तगर्त आन ेवाल ेपयार्वरणीय ᮧदषूक तत्वᲂ के िनस्सारण के साधारण मानकᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान और ᮧबंधन िन᳜िलिखत रूप मᱶ होगा-- (क) पािरिस्थितक संवेदी जोन मᱶ ठोस अपिशष् ट िनपटान तथा ᮧबधंन, ठोस अपिश᳥ ᮧबधं िनयम, 2016, जो भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसचूना सं. का.आ. 1357(अ), तारीख 8 अᮧलै, 2016 ᳇ारा ᮧकािशत िकए गए थे, के उपबंधᲂ के अनसुार िकया जाएगा ; और जैिवक सामᮕी का िनपटान पािरिस्थितक संवेदी जोन के बाहर पहचान िकए गए स्थल पर स्वीकायर् रीित मᱶ िकया जाएगा। (ख) पािरिस्थितक संवेदी जोन मᱶ ठोस अपिशष् टᲂ को जलाना या भस्मीकरण और भिूम भराव के स्थापनᲂ को अनुज्ञात नहᱭ िकया जाएगा ।
(10) जवै िचिकत् सीय अपिशष् ट - जैव िचिकत् सीय अपिशष् ट ᮧबंधन िन᳜िलिखत रूप मᱶ होगा— (क) पािरिस्थितक संवेदी जोन मᱶ जैव िचिकत्सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं.का.िन 343(अ), तारीख 28 माचर्, 2016 ᳇ारा ᮧकािशत जैव िचिकत्सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा । (ख) पािरिस्थितक संवेदी जोन मᱶ कोई साधारण उपचार सुिवधा या जलाया जाना अनुज्ञात नहᱭ िकया जाएगा ।
(11) प्लािस्टक अपिश᳥ ᮧबधंन - पािरिस्थितक संवेदी जोन मᱶ प्लािस्टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं.का.िन 340(अ), तारीख 18 माचर्, 2016 ᳇ारा ᮧकािशत प्लािस्टक अपिश᳥ ᮧबधं िनयम 2016 के उपबंधᲂ के अनुसार िकया जाएगा।
(12) सिंनमार्ण और िवध्वसं अपिश᳥ ᮧबधंन - पािरिस्थितक संवदेी जोन मᱶ संिनमार्ण और िवध्वसं अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना स.ंका.िन 317(अ), तारीख 29 माचर्, 2016 ᳇ारा ᮧकािशत संिनमार्ण और िवध्वंस ᮧबंध िनयम, 2016 के उपबधंᲂ के अनसुार िकया जाएगा । ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(13) ई–अपिश᳥- पािरिस्थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबधं का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय ᳇ारा ᮧकािशत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा।
(14) यानीय पिरवहन - पिरवहन की यानीय गित आवास के अनकूुलन रीित ᳇ारा िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध समािव᳥ िकए जाएंगे और आंचिलक महायोजना के तैयार होने तक और राज्य सरकार के सक्षम ᮧािधकारी ᳇ारा के अनुमोिदत होने तक, िनगरानी सिमित ससंुगत अिधिनयम तथा तदधीन बनाए गए िनयमᲂ और िविनयमᲂ के अधीन यानीय गित के अनुपालन को मानीटर करेगी ।
(15) यानीय ᮧदषूण - लागू िविधयᲂ के अनसुार यानीय ᮧदषूण की िनवारण और िनयंᮢण का अनपुालन िकया जाएगा और स्वच्छ ईंधन उदाहरण के िलए सीएनजी, एलपीजी, आिद के उपयोग के िलए ᮧयास िकए जानᱶ ह ᱹ।
(16) औ᳒ोिगक इकाइया ं- (i) राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन को या उसके प᳟ात पािरिस्थितक संवेदी जोन के भीतर िकसी नए ᮧदिूषत उ᳒ोगᲂ की स्थापना की अनुज्ञा नहᱭ दी जाएगी।
(ii) फरवरी, 2016 मᱶ कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा जारी िदशािनदᱷशᲂ मᱶ केवल गैर- उ᳒ोगᲂ के वगᱮकरण के अनुसार, पािरिस्थितक सवंेदी जोन के भीतर केवल गैर ᮧदषूणकारी उ᳒ोगᲂ को तब तक अनजु्ञात िकया जाएगा जब तक िक इस अिधसूचना मᱶ इस ᮧकार िविन᳸दर᳥् न हो और इसके अलावा, गैर-ᮧदषूणकारी कुटीर उ᳒ोगᲂ को बढ़ावा िदया जाएगा।
(17) पहाड़ी ढलानᲂ का सरंक्षण - पहाड़ी ढलानᲂ का संरक्षण िन᳜ानसुार होगा:
(क) आंचिलक महायोजना उन पहाड़ी ढलानᲂ पर क्षेᮢᲂ को उपदिशर्त करेगी जहा ंिकसी भी संिनमार्ण की अनुज्ञा नहᱭ दी जाएगी । (ख) कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर िकसी भी संिनमार्ण की अनुज्ञा नहᱭ दी जाएगी ।
(18) केन्ᮤीय सरकार और राज्य सरकार, यिद यह आवश्यक समझती ह,ै इस अिधसूचना के उपबंधᲂ को ᮧभावी करन ेमᱶ अन्य अितिरᲦ उपाय िविन᳸दर᳥् करेगी।
4. पािरिस्थितक सवंेदी जोन मᱶ ᮧितिष और िविनयिमत िकए जान ेवाल ेिᮓयाकलापᲂ की सचूी.—पािरिस्थितक संवेदी जोन मᱶ सभी िᮓयाकलाप पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और तटीय िविनयमन जोन, 2011 और पयार्वरणीय ᮧभाव िनधार्रण (ईआईए) अिधसचूना, 2006 और वन (संरक्षण) अिधिनयम, 1980 (1980 के 69), भारतीय वन अिधिनयम, 1927 (1927 के 16), वन्यजीव (संरक्षण) अिधिनयम, 1972 (1972 के 53) तथा इनमᱶ िकए गए संशोधनᲂ सिहत अन्य लाग ू िविधयᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई सारणी मᱶ िविन᳸दर᳥् रीित मᱶ िविनयिमत हᲂग,े अथार्त ्:— सारणी ᮓम स.ं िᮓयाकलाप िटप्पिणयां

1. वािणिज्यक खनन । (क) सभी ᮧकार के नए और िव᳒मान खनन (लघु और वृहत खिनज), पत्थर की खानᱶ और उनको तोड़न ेकी इकाइयां वास्तिवक स्थानीय िनवािसयᲂ की घरेलू आवश्यकताᲐ िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संिनमार्ण या मरम्मत के िलए भूिम को खोदना और मकान बनान े के िलए दशेी टाइल्स या ईंटᲂ का िनमार्ण करना भी सिम्मिलत ह,ै के िसवाय नहᱭ हᲂगी;
(ख) खनन संिᮓयाएं, माननीय उᲬतम न्यायालय की िरट यािचका (िसिवल) सं.
1995 का 202 टी.एन. गौडाबमर्न िथरुमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अगस्त, 2006 और िरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧलै, 2014 के अंतिरम आदेश के अनुसार की जाएगी ।
2. ᮧदषूण (जल या वायु या मदृा या ध् विन) कािरत करन ेवाले उ᳒ोगᲂ की स् थापना । कोई नई या पािरिस्थितक सवंेदी जोन मᱶ ᮧदषूण फैलान ेवाल ेउ᳒ोगᲂ के िवस्तार की अनुज्ञा नहᱭ दी जाएगी। पािरिस्थितक सवंेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा जारी 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] िदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफर् गरै- ᮧदिूषत उ᳒ोगᲂ की स्थापना के वगᱮकरण की अनुज्ञा दी जाएगी, जब तक िक इस अिधसूचना मᱶ िविन᳸दर᳥् न हो।
3. बृहत जल िव᳒ुत पिरयोजना की स् थापना। लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂग े।
4. िकसी पिरसंकटमय पदाथᲄ का उपयोग या उत्पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂग े।
5. ᮧाकृितक जल िनकायᲂ या भूिम क्षेᮢ मᱶ अनपुचािरत बिह᮲ावᲂ का िनस्सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂग े।
6. ठोस अपिश᳥ िनपटान स्थल की स्थापना और सामान्य जलाए जाने की सिुवधा के िलए ठोस और जवै िचिकत्सा अपिश᳥। पािरिस्थितक सवंेदी जोन मᱶ ठोस अपिश᳥ िनपटान की कोई नई ठोस अपिश᳥ िनपटान स्थल और अपिश᳥ उपचािरत/ᮧसंस्करण सुिवधा की अनुज्ञा नहᱭ ह।ै औ᳒ोिगक ᮧिᮓया और स्वास्थ्य ᮧित᳧ान/अस्पतालᲂ आिद स े उत्प᳖ िकसी भी ठोस अपिश᳥ के उपचािरत के िलए सामान्य या ᳞िᲦगत जलावतरण की सुिवधा का अिधकतर ᮧितिष ह ै।
7. फमᲄ, कॉरपोरेट कंपिनयᲂ, कंपिनयᲂ ᳇ारा बड़ े पैमाने पर वािणिज्यक पशुधन और कुक्कुट फामᲄ की स्थापना । स्थानीय आवश्यकताᲐ को पूरा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष (यथा अन् यथा उपबंिधत के िसवाय) हᲂगे अन्यथा नहᱭ।
8. नई आरा िमलᲂ की स्थापना। पािरिस्थितक सवंेदी जोन के भीतर नई या िव᳒मान आरा िमलᲂ का िवस् तार अनुज्ञात नहᱭ होगा ।
9. ईंट भᲵᲂ की स्थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂग े।
10. प् लािस् टक के थैलᲂ का उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂग े।
11. जलावन लकड़ी का वािणिज्यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂग े। ख. िविनयिमत िᮓयाकलाप
12. होटलᲂ और िरसोटᲄ की स्थापना । पािरिस्थितक पयर्टन िᮓयाकलापᲂ संबधंी पयर्टकᲂ की लघु संरचनाᲐ के िलए संरिक्षत क्षेᮢ की सीमा से एक िकलोमीटर तक या पािरिस्थितक सवंेदी जोन के िवस्तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणिज्यक होटल और िरसोटर् अनुज्ञात हᲂग,े अन्यथा नहᱭ । परंतु, जहाँ पािरिस्थितक संवदेी जोन का सीमा एक िकलोमीटर से ज्यादा ह ै वहाँ, एक िकलोमीटर से परे और पािरिस्थितक सवंेदी जोन के िवस्तार तक सभी नए पयर्टक िᮓयाकलाप या िव᳒मान िᮓयाकलाप का िवस्तार पयर्टन महायोजना और यथा लाग ूमागर्दशर्क िसांतᲂ के अनुरुप होगा।
13. नए का᳥ आधािरत उ᳒ोग। लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
14. संिनमार्ण िᮓयाकलाप । (क) संरिक्षत क्षेᮢ या पािरिस्थितक संवेदी जोन जो भी िनकट हो, की सीमा स े एक िकलोमीटर के भीतर िकसी भी ᮧकार का वािणिज्यक संिनमार्ण अनुज्ञात नहᱭ िकया जाएगा:
परंत ु स् थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब िᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकी भूिम मᱶ संिनमार्ण करन े की अनुमित भवन उपिविधयᲂ के अनसुार दी जाएगी ।
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमार्ण;
(ii) अवसंरचना ढांचᲂ और नागिरक सुिवधाᲐ का संिनमार्ण और नवीकरण;
(iii) कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा जारी िदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफर् गैर- ᮧदिूषत उ᳒ोगᲂ की स्थापना के वगᱮकरण;

(iv) कुटीर उ᳒ोगᲂ िजसके अतंगर्त ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भण्डार और स्थानीय सुख सुिवधाᲐ जो पािरिस्थितक पयर्टन िजस मᱶ सहायक हो गृह वास; और
(v) इस अिधसूचना मᱶ सूचीब िᮓयाकलापᲂ की सचूी :
परन्तु ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उत् पन् न नहᱭ करते ह,ᱹ से सबंंिधत संिनमार्ण िᮓयाकलाप िविनयिमत िकए जाएंगे और लाग ूिनयमᲂ और िविनयमᲂ, यिद कोई हᲂ, के अनसुार सक्षम ᮧािधकारी की पूवर् अनुज्ञा से ही न् यूनतम पर रखे जाएंगे । (ख) एक िकलोमीटर स ेपरे आंचिलक महायोजना की अनुसार िविनयिमत हᲂगे ।
15. ᮧदषूण उत्प᳖ न करन ेवाल ेलघु उ᳒ोग । पािरिस्थितक सवंेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा जारी िदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफर् गरै- ᮧदिूषत उ᳒ोगᲂ की स्थापना के वगᱮकरण की अनुमित दी जाएगी, जब तक िक इस अिधसूचना मᱶ िविन᳸दर᳥् न हो । इसके अितिरᲦ, गैर-ᮧदिूषत कुटीर उ᳒ोगᲂ को ᮧितिष िकया जाएगा।
16. वृक्षᲂ की कटाई । (क) राज्य सरकार मᱶ सक्षम ᮧािधकारी की पूवर् अनुज्ञा के िबना वन, सरकारी या राजस्व या िनजी भूिम पर या वनᲂ मᱶ ᳴कंही वृक्षᲂ की कटाई नहᱭ होगी । (ख) वृक्षᲂ की कटाई संबंिधत कᱶ ᮤीय या राज्य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
17. वन उत्पादᲂ और गैर काष् ठ वन उत्पाद (एन.टी.एफ.पी.) का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
18. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पिरिनमार्ण और केबल िबछाना और अन्य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂग े । भूिमगत केबल को बढ़ावा िदया जाएगा।
19. नागिरक सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ के अनुसार न्यूनीकरण की उपायᲂ के साथ, िनयम और िविनयमन और उपलब्ध िदशािनदᱷश िविनयिमत हᲂगे।
20. िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना और नई सड़कᲂ का संिनमार्ण । लागू िविधयᲂ के अनुसार न्यनूीकरण की उपायᲂ के साथ, िनयम और िविनयमन और उपलब्ध िदशािनदᱷश िविनयिमत हᲂगे।
21. पयर्टन से संबंिधत िᮓयाकलाप जैसे गमर् वायु गबु्बारᱶ, हलेीकाप्टर, ᮟोन, माइᮓोलाइटस और अन्य पयर्टन िᮓयाकलाप आिद ᳇ारा पािरिस्थितक संवेदी जोन क्षेᮢ के ऊपर स े उड़ना जैस े िᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
22. पहाड़ी ढालᲂ और नदी िकनारᲂ का संरक्षण । लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
23. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणिज्यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
24. स्थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष और मछली पालन । स्थानीय लोगᲂ के उपयोग के िलए लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
25. ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢ मᱶ उपचािरत बिह᮲ार्व का िनस्सारण । उपचािरत बिह᮲ार्व के पनुचर्ᮓण को ᮧोत्सािहत करन े और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन िकया जाएगा । अन्यथा लाग ू िविधयᲂ के अधीन उपचािरत बिह᮲ार्व के पुनचर्ᮓण/ᮧवाह के िनवर्हन को िविनयिमत िकया जाएगा।
26. सतह और भूजल के वािणिज्यक िनष्कषर्ण । लागू िविधयᲂ के अधीन िविनयिमत हᲂग े।
27. खुले कुआ, बोर कुआ, आिद के िलए कृिष और अन्य उपयोग । िविनयिमत और उपयुᲦ ᮧािधकारी ᳇ारा िᮓयाकलापᲂ की सख्ती स े िनगरानी की जाएगी। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

35. कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण कारीगर भी ह ᱹ। सिᮓय रूप से बढ़ावा िदया जाएगा ।
36. नवीकरणीय ऊजार् ᮲ोत का उपयोग । बायोगैस, सौर ᮧकाश आिद को बढ़ावा िदया जाना ह ै।
37. कृिष वािनकी । सिᮓय रूप से बढ़ावा िदया जाएगा ।
38. पािरिस्थितक अनकूुल पिरवहन का उपयोग । सिᮓय रूप से बढ़ावा िदया जाएगा ।
39. कौशल िवकास । सिᮓय रूप से बढ़ावा िदया जाएगा ।
40. िन᳜ीकृत भूिम या वन या आवास ᮧत्यावतर्न । सिᮓय रूप से बढ़ावा िदया जाएगा ।
41. पयार्वरणीय जागरुकता । सिᮓय रूप से बढ़ावा िदया जाएगा ।
5. िनगरानी सिमित.—कᱶ ᮤीय सरकार, पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते हुए तीन वषर् की अविध के िलए िनगरीनी सिमित गिठत करती ह,ै पािरिस्थितक सवंेदी जोन की िनगरानी ᮧभावी के िलए िजसमᱶ िन᳜िलिखत स ेिमलकर बनगेी:— (क) िजला कलक्टर, रंगरेी िजला - अध्यक्ष;
(ख) पयार्वरण के क्षेᮢ मᱶ कायर् करने वाल ेगैर सरकारी संगठनᲂ का तेलंगाना राज्य सरकार ᳇ारा ᮧत्यके मामले मᱶ तीन वषर् के िलए नामिन᳸दर᳥् एक ᮧितिनिध – सदस् य ;
(ग) पािरिस्थितक और पयार्वरण के क्षेᮢ मᱶ तेलगंाना राज्य सरकार ᳇ारा ᮧत्येक मामले मᱶ तीन वषर् के िलए नामिन᳸दर्ष् ट एक िवशेषज्ञ - सदस् य;
(घ) ᮧादिेशक अिधकारी, राज्य ᮧदषूण िनयंᮢण बोडर् -सदस् य;
(ङ) क्षेᮢ का विर᳧ नगर योजना अिधकारी - सदस्य ;
(च) राज्य जवै-िविवधता बोडर् का सदस्य -सदस्य ;

6. िनदᱷश का िनबधंन:-
(1) िनगरानी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(2) ऐसे िᮓयाकलाप जो भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अनुसूची के अंतगर्त आते हᱹ और इस अिधसचूना के पैरा 4 के अधीन सारणी मᱶ यथािविन᳸दर᳥् ᮧितिष िᮓयाकलापᲂ के िसवाय पािरिस्थितक संवेदी जोन मᱶ आते ह ᱹवास्तिवक िविन᳸दर᳥् स्थलीय दशाᲐ पर आधािरत िनगरानी सिमित ᳇ारा संवीक्षा की जाएगी और उᲦ अिधसचूना के उपबंधᲂ के अधीन पवूर् पयार्वरण अनापिᱫ के िलए केन्ᮤीय सरकार के पयार्वरण, वन और जलवाय ु पिरवतर्न मंᮢालय को िन᳸दर᳥् की जाएगी ।
(3) ऐस ेिᮓयाकलापᲂ, िजन्ह ेभारत सरकार के तत्कालीन पयार्वरण और वन मंᮢालय की अिधसूचना संख्यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अिधसूचना के अनुसचूी के अधीन सिम्मिलत नहᱭ िकया गया ह,ै उसके परैा के अधीन सारणी मᱶ यथा िविन᳸दर᳥् ᮧितिष िᮓयाकलापᲂ के िसवाय, पािरिस्थितक संवेदी जोन मᱶ आत े ह,ᱹ वास्तिवक िविन᳸दर᳥् स्थलीय दशाᲐ पर आधािरत िनगरानी सिमित ᳇ारा संवीक्षा की जाएगी और उस ेसंब िविनयामक ᮧािधकरणᲂ को िन᳸दर᳥् िकया जाएगा ।
(4) िनगरानी सिमित का सदस्य-सिचव या संब कलक्टर या संब पाकर् का उप वन संरक्षक ऐसे ᳞िᲦ के िवरू, जो इस अिधसूचना के िकसी उपबंध का उल्लंघन करता ह,ै पयार्वरण (संरक्षण) अिधिनयम, 1986 की धारा 19 के अधीन पिरवाद फाइल करन ेके िलए सक्षम होगा ।
(5) िनगरानी सिमित मुा दर मुा के आधार पर अपेक्षाᲐ पर िनभर्र रहते हुए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेषज्ञᲂ, औ᳒ोिगक संगमᲂ या संब पणधािरयᲂ के ᮧितिनिधयᲂ को अपन ेिवचार-िवमशर् मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(6) िनगरानी सिमित ᮧत्यके वषर् की 31 माचर् तक की अपनी वािषर्क कारर्वाई िरपोटर् राज्य के मुख्य वन्य जीव वाडर्न को उपाबधं III मᱶ उपबिंधत रूप िवधान के अनुसार उक् त वषर् के 30 जनू तक ᮧस्तुत करेगी ।
(7) केन्ᮤीय सरकार का पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय िनगरानी सिमित को अपन ेकृत्यᲂ के ᮧभावी िनवर्हन के िलए समय- समय पर ऐस ेिनदशे द ेसकेगा, जो वह ठीक समझे ।

8. कोई अन् य महत् वपणूर् िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 26th May, 2017 S.O. 1698(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3229 (E), dated 1st December, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, no objections and suggestions received from persons and stakeholders in response to the draft notification;
AND WHEREAS, Mahavir Harina Vanasthali National Park is located in Ranga Reddy District of Telangana in a densely populated and residential cum commercial area in close vicinity to the city of Hyderabad and is spread over an area of 1459 hectare;
AND WHEREAS, the National Park acts as a vast carbon sink for the rapidly developing city of Hyderabad, stands as the last vestige of the flora, fauna and unique rock formations representing the rich bio-diversity of Deccan Plateau, which includes more than 600 plant species, 110 bird species, 20 Mammal species, 20 species of Reptiles & Amphibians, hundreds of species of insects, and other invertebrates;
AND WHEREAS, the National Park provides perfect habitat for Indian black buck, Four horned antelope, spotted deer, Indian porcupine, civet cat, common mongoose, Indian Pangolin, black napped hare, wild boar;
AND WHEREAS, the area supports vegetation which represents typical typical Deccan flora and has plant species such as Randea deumatorium, Ziziphus mauritiana, Bauhinia racemosa, Cassia fistula, Acacia leucoploea, and Anona squamosa;
AND WHEREAS, it is necessary to conserve and protect the area around the Mahavir Harina Vanasthali National Park and to propagate improvement and development of the wildlife therein and its environment;
AND WHEREAS, it become necessary to specify certain areas are around the Mahavir Harina Vanasthali National Park as Eco-sensitive Zone and to prohibit industries, operations or processes or class of industries, operations or processes in the said Eco-sensitive Zone.
¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 NOW THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub–section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of up to one kilometer all around the boundary of the Mahavir Harina Vanasthali National Park in the State of Telangana, as the Mahavir Harina Vanasthali National Park Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundary of Eco-sensitive Zone.-
(1) The Eco-sensitive Zone has an extent of up to one kilo meters all around the boundary of the Mahavir Harina Vanasthali National Park and includes 17 villages in Rangareddy District of Telangana State and the area of Eco-sensitive Zone is 40.56 square kilo meters.
(2) The map of Eco-sensitive Zone boundary together with latitudes –longitudes and boundary description is appended as Annexure I.
(3) The list of villages falling within the Eco-sensitive Zone is given at Annexure-II.
2. Zonal Master Plan for the Eco-sensitive Zone.-
(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture & Horticulture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism including Eco-tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal & urban development;
(x) Panchayati Raj;
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant State laws and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given under para 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant State laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities.
(2) Natural water bodies.- The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/ Eco-tourism.-
(a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Eco-tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km. from the boundary of the Mahavir Harina Vanasthali National Park or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17 Change and the Eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism.
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within the Ecosensitive Zone area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act,
1986.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; and the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.
(b) No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016.
(b) No common treatment facility or incineration shall be permitted within the Eco-sensitive Zone.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016.
(13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.
(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and the efforts to be made for use of cleaner fuel for example CNG, LPG, etc.

(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of Industries in the Guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.- The protection of hill slopes shall be as under:-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.— All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone Notification 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:— TABLE S No Activity Description

1. Commercial Mining.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new industries and expansion of existing polluting industries in the Eco-sensitive Zone shall be permitted.
Only non-polluting industries shall be allowed within the Ecosensitive Zone as per classification of Industries in the Guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within the Eco-sensitive Zone.
Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is prohibited.

7. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
10. Use of polythene bags. Prohibited (except as otherwise provided) as per applicable laws.
11. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
12. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
13. New wood based industry. Regulated under applicable laws.
14. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the protected area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution termed as per Classification done by the Central Pollution Control Board in February 2016;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and
(v) promoted activities listed in this Notification:
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
15. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
16. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

5. Monitoring Committee.- (1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:—
(a) District Magistrate and Collector, Ranga Reddy District — Chairman
17. Collection of Forest produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws.
18. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law. Underground cabling may be promoted.
19. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
20. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
21. Under taking other activities related to tourism like over flying the Ecosensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.
Regulated under applicable law.
22. Protection of Hill Slopes and river banks.
Regulated under applicable laws.
23. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
24. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
25. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
26. Commercial extraction of surface and ground water.
Regulated under applicable law.
27. Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
28. Solid Waste Management. Regulated under applicable laws
29. Introduction of Exotic species. Regulated under applicable laws.
30. Eco-tourism. Regulated under applicable laws.
31. Commercial Sign boards and hoardings.
Regulated under applicable laws.
C. Promoted Activities
32. Rain water harvesting. Shall be actively promoted.
33. Organic farming. Shall be actively promoted.
34. Adoption of green technology for all activities.
Shall be actively promoted.
35. Cottage industries including village artisans, etc.
Shall be actively promoted.
36. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted.
37. Agro-Forestry. Shall be actively promoted.
38. Use of eco-friendly transport. Shall be actively promoted.
39. Skill Development. Shall be actively promoted.
40. Restoration of Degraded Land/ Forests/ Habitat.
Shall be actively promoted.
41. Environmental Awareness. Shall be actively promoted.

(b) One representative of Non Governmental Organization working in the field of environment to be nominated by the Government of Telangana for a term of three years in each case — Member
(c) one expert in the area of ecology and environment to be nominated by the Government of Telangana for a term of three years in each case — Member
(d) Regional Officer, State Pollution Control Board — Member.
(e) Senior Town Planner of the area — Member.
(f) Member, State Biodiversity Board, — Member;
(g) District Wildlife Warden, Rangareddy/Divisional Forest officer (T), Rangareddy District — Member Secretary.
6. Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(4) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure III.
(7) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
