PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 1506] No. 1506] NEW DELHI, FRIDAY, MAY 26, 2017/JYAISTHA 5, 1939 पययावरण, वन और जलवयय ुपररवतान मतं्रयलय ऄधधसचूनय नइ ददल्ली, 26 मइ, 2017 कय.अ. 1701(ऄ).—प्रयरुप ऄधधसूचनय भयरत के रयजपत्र ऄसयधयरण में सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय सं. कय.अ. 3226(ऄ), तयरीख 1 ददसम्बर, 2015 द्वयरय प्रकयधित की गइ थी धजसमें ऐसे सभी व्यधियों से, धजनकी ईससे प्रभयधवत होने की संभयवनय थी, ईस तयरीख से, धजसको ऄधधसूचनय को ऄन्तर्ववष्ट करने वयल े रयजपत्र की प्रधतययं जनतय को ईपलब्ध करय दी गइ थीं, सयठ ददन की ऄवधध के भीतर अक्षेप और सुझयव अमंधत्रत दकए गए थ;े और, ईि रयजपत्र, की प्रधतययं जनतय को 1 ददसम्बर, 2015 को ईपलब्ध करय दी गइ थीं;
और, प्रयरुप ऄधधसूचनय के ईत्तर में सभी व्यधियों और पणधयररयों से प्रयप्त अक्षेपों और सुक्षयवों पर केन्रीय सरकयर द्वयरय धवचयर कर धलयय गयय ह;ै और, ब्रह्मधगरर वन्यजीव ऄभययरण्य कय गठन वर्ा 1974 में ब्रह्मधगरी घयट और ईटी अरधक्षत वनों के सम्पूणा वन के्षत्र को ियधमल करके दकयय गयय थय । ब्रह्मधगरी वन्यजीव ऄभययरण्य को रयज्य सरकयर ने ऄपनी ऄधधसूचनय सं. एएफएड 50 एफडब्ल्यूएल, 74 तयरीख 05-06-1974 को वन्यजीव (संरक्षण) ऄधधधनयम, 1972 की धयरय 18 के ईप-धयरय (1) के ईपबंधों के ऄधीन 181.29 वगा दकलोमीटर के क्षेत्र के रूप में ऄधधसूधचत दकयय थय। और, ब्रह्मधगरी वन् यजीव ऄभययरण्य कनयाटक रयज् य में कोदगु धजले की दधक्षणी ददिय में धथ थत ह ैऔर 11055’ से 120 19’ ईत् तरी ऄक्षयंि तथय 75044’ से 760 04’ पूवी देियंतर के बीच धथ थत ह ै । और, बह्मधगरी वन् यजीव ऄभययरण्य पध चमी घयट के बीचों बीच धथ थत ह ैऔर 1 प्रधतित से 35 प्रधतित से ऄधधक ढयल के ऄंतर वयले उबड़ खयबड़ भू–भयग ईसकी धविेर्तय ह ैऔर यह प्रधतवर्ा 2500 धम.धम. से 6000 धम.धम. के बीच ईच् च वर्या वयलय क्षेत्र ह ै । और, ऄभययरण्य प्रचुर जैव धवधवधतय को संभयलतय ह ै धजसमें थथयधनकतय की ईच्च दर ह ै और गंभीर रूप से संकटयपन्न प्रजयधतयों के धलए भी वयस ह।ै ऄभययरण्य में पयए जयन े वयले महत्वपूणा जंतओुं में बयघ (पैंथेरय टयआगररस), तेंदअु (पैंथरेय 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पयडास), जंगली कुत् तय (कुओन ऄल्पयआंस), एधिययइ हयथी (एधलफस मैक्सीमूस), गौर और भयरतीय भैंसय (बोस गौरस), सयंभर (रूसय यूनीकोलार), मुंजक (मुनटीक्स मुनतजक), ससह पचु्छ वयनर (मेकक्यूआ सीलनेस), नीलधगरी लंगरू (तेरयचयपीथेक्स जोहन्नी), नीलधगरी धचरयलय (मयरटेस गवयंटीनसन्नी), भूरय मसंुग (परयडूक्यूऄस जेरदोनी), तेंदअु धबल् ली (परीओनयलीलरूस बेनदयलेन्सीस), तवयंग (लोररस लयदेके्कआरीऄनऄस), ट्रयवनकोर ईड़न धगलहरी (पेटीनयमयस फूसकोक्पीलऄस), ककग कोबरय (ओपहीओफगस हन्नह), आंधडयन रयक पययथन (पययथन मूलयरूस मलूयरूस), और मयलयबयर धचतकबरी धनिे (ऄनथरयकोकेरूस कोरोनटस), मयलयबयर शे्वत धनेि (ओकयसेरूस धगरीसेऄस), मयलयबयर ट्रययगन (हरपयकटेस फेसकीऄटस), मयलयबयर धचलधबल (मयओफोनस होरसदफआडआ), वयययनद धचलधबल (गररूलक्स डेलथेसेरटी), सफेद तुंदय वृक्ष घयलमले (डेनडरोकीट्टय लेकोहसटरय), धहल मनैय (गरयकूलय रेलीगीओसय) अदद सधम्मधलत हैं। ऄभययरण्य कयवेरी नदी के धलए अवयह के्षत्र ह ैजो कनयाटक की एक महत्वपूणा नदी और लक्ष्मीधन्थथ और रयमधथथा नदी कयवेरी नदी की सहययक नदी ह ैधजनकय ईदगम ब्रह्मधगरी वन्यजीव ऄभययरण्य ह ैऔर कइ बयरहमयसी सररतयओं कय भी ईदगम ऄभययरण्य ह;ै यह ऄभययरण्य कनयाटक में नयगरयहोल रयष्ट ट्रीय पयका तथय तयलय कयवेरी वन् यजीव ऄभययरण्य और केरल रयज् य में वयययनद तथय ऄरयलम वन् य जीव ऄभययरण्य के बीच धवचरण करन ेके धलए एधिययइ हयथी (एलेफस मैक्सीमस) तथय बयघ (पैंथरेय टयआगररस), जैसे धवियल थ तनधयररयों के धलए एक महत् वपूणा गधलययरे कय धनमयाण करतय ह ैऔर हयथी पररयोजनय के ऄधीन घोधर्त मैसूर हयथी ररजवा कय भी भयग ह ै। ऄभययरण्य में ऄत्यधधक पुष्टप एवं पयधणसमूह धवधवधतय ह,ै ऄभययरण्य में िोलय चयरयगयहों से धमलकर बने सदयबहयर और ऄधा-सदयबहयर वन होते हैं और वनथपधत में बहुत महत्वपूणा प्रजयधतययं जैसे डीप्टरोकयपास आंडसस, एंटररस टॉक्सीधसययररयय, ककग्वयआंडरैन पनीतम, डययथप्योरस एबेनम, धबिोद़ियय जयवयनीकय, कैलोधललयम एपेटलुम, धसनयमोमयम जेलेनयआकम, डयल्बर्वगयय लेरटफोधलयय, पटरोकयपास मयसूाधपयम, एलयओकयपास एसपी, मययधथट्रकय थपरै, गयर्वसधनयय एसपी, मयधचलस मैकेरन्थय, मेधसयय फेररअ, हॉधपयय परवीललोरय, डययोएधक्सधलयम मैलेबरीकम, कैनेररयम कंड्रम, गेंटम आलय अदद, ियधमल हैं। और, ब्रह्मधगरी वन् यजीव ऄभययरण्य, के चयरों ओर के क्षेत्र को, धजसकय धवथतयर और सीमयएं आस ऄधधसूचनय के परैय 1 में धवधनर्ददष्ट हैं, पयररधथथधतक तथय पययावरण की दधृष्ट से पयररधथथधतक संवेदी जोन के रूप में सुरधक्षत और संरधक्षत करनय तथय ईि पयररधथथधतक संवेदी जोन में ईद्योगों यय ईद्योगों के वगो कय प्रचयलन तथय प्रसंथकरण करन ेको प्रधतधर्द्ध करनय अवयक ह ै;
ऄतः, ऄब, केन्रीय सरकयर, पययावरण (संरक्षण) धनयम, 1986 के धनयम 5 के ईपधनयम (3) के सयथ परठत पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) की धयरय 3 की ईपधयरय (1) और ईपधयरय (2) के खंड (v) और खंड (xiv) और ईपधयरय (3) द्वयरय प्रदत्त िधियों कय प्रयोग करत ेहुए, कनयाटकय रयज्य में ब्रह्मधगरी वन् यजीव ऄभययरण्य, की सीमय के क्षेत्र को ब्रह्मधगरी वन् यजीव ऄभययरण्य, पयररधथ थधतक संवेदी जोन (धजसे आसमें आसके प चयत ्पयररधथ थधतक संवेदी जोन कहय गयय ह)ै के रूप में ऄधधसूधचत करती ह,ै धजसके ब्यौरे धनम्नयनुसयर ह,ै ऄथयात् :--
1. पयररधथथधतक संवदेी जोन कय धवथतयर और ईसकी सीमयए.ं—(1) पयररधथथधतक संवेदी जोन ब्रह्मधगरी वन् यजीव ऄभययरण्य कय कुल भौगोधलक क्षेत्रफल 136.60 वगा दकलोमीटर (बयड़ों को छोड़कर) ह ैधजसकय धवथतयर 1 से 15 दकलोमीटर तक ह ै। पयररधथथधतक संवेदी जोन सीमयओं कय वणान ईपयबधं I में ददयय गयय ह ै।
(2) ऄक्षयंि और देियन्तर के सयथ पयररधथथधतक संवेदी जोन कय मयनधचत्र ईपयबधं II के रुप में ईपयबद्ध ह ै।
(3) ब्रह्मधगरी वन् य जीव ऄभययरण्य की सीमयओं के प्रमुख धबदओुं के भू- धनदेियंक और पयररधथथधतक संवेदी जोन की सीमयए ं ईपयबधं III के रूप में ईपयबद्ध ह ै।
(4) पयररधथ थधतक संवेदी जोन के ऄन्तगात अने वयले गयंवों की सूची तथय अरधक्षत वन क्षेत्रो कय धववरण ईपयबधं IV के रूप में ईपयबद्ध ह ै। II (ii) 3
2. पयररधथथधतक संवदेी जोन के धलए अचंधलक महययोजनय.—(1) रयज्य सरकयर, पयररधथथधतक संवेदी जोन के प्रयोजन के धलए रयजपत्र में ऄंधतम ऄधधसूचनय के प्रकयिन की तयरीख से दो वर्ा की ऄवधध के भीतर, थथयनीय व्यधियों के परयमिा से और आस ऄधधसूचनय में ददए गए ऄनबंुधों कय पयलन करते हुए अंचधलक महययोजनय तैययर करेगी।
(2) रयज्य सरकयर द्वयरय पयररधथ थधतक संवेदी जोन के धलए अचंधलक महययोजनय ऐसी रीधत जो आस ऄधधसूचनय में धवधनर्ददष्ट ट ह ैतथय सुसंगत कें रीय और रयज् य धवधधयों के ऄनरुुप और कें रीय सरकयर द्वयरय जयरी मयगाधनदेिों, यदद कोइ हों, द्वयरय तैययर होगी ।
(3) अंचधलक महययोजनय, पययावरणीय और पयररधथथधतक संबंधी बयतों को समयकधलत करने के धलए रयज् य सरकयर के सभी संबद्ध धवभयगों के परयमिा से तैययर होगी, ऄथयात:्—
(i) पययावरण;
(ii) वन और वन्यजीव;
(iii) कृधर् ;
(iv) रयजथ व;
(v) नगर धवकयस;
(vi) पयाटन;
(vii) ग्रयमीण धवकयस;
(viii) ससचयइ और बयढ़ धनयंत्रण;
(ix) नगरपयधलकय;
(x) पंचययती रयज;
(xi) लोक धन मयाण धव भयग।
(4) अंचधलक महययोजनय ऄनुमोददत धवद्यमयन भू-ईपयोग, ऄवसंरचनय और दिययकलयपों पर कोइ धनबंधन ऄधधरोधपत नहीं करेगी जब तक दक आस ऄधधसूचनय में आस प्रकयर धवधनर्ददष्ट ट न हो और अचंधलक महययोजनय सभी ऄवसंरचनय और दिययकलयपों में जो ऄधधक दक्षतय और पयररधथथधतक ऄनुकूल हों कय संवधान करेगी ।
(5) अंचधलक महययोजनय में ऄनयच्छयददत क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकययों के संरक्षण, अवयह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदय और नमी संरक्षण, थथयनीय समुदययों की अवयकतयओं तथय पयररधथथधतक और पययावरण से संबंधधत ऐसे ऄन्य पहलओुं, धजन पर ध्ययन देनय अवयक ह,ै के धलए ईपबंध होंगे ।
(6) अचंधलक महययोजनय सभी धवद्यमयन पूजय थ थलों, ग्रयमों और नगरीय बंदोबथतों, वनों के प्रकयर और दकथ मों, कृधर् क्षेत्रों, उपजयउ भूधम, हररत क्षते्र जैसे ईद्ययन और ईसी प्रकयर के थ थयन, ईद्ययन कृधर् के्षत्र, फलोईद्ययन, झीलों और ऄन्य जल धनकययों कय ऄभ्यकंन करेगी और आस योजनय के मयनधचत्र के सयथ धवद्यमयन और प्रथतयधवत भूधम ईपयोग धविेर्तयओं कय धववरण संलग्न होगय ।
(7) अंचधलक महययोजनय पयररधथथधतक संवेदी जोन में धवकयस को धवधनयधमत करेगी और सयरणी में सूचीबद्ध प्रधतधर्द्ध, धवधनयधमत दिययकलयपों कय पयलन करेगी तथय थ थयनीय समुदययों की अजीधवकय सुरक्षय के धलए, पयररधथथधतक ऄनुकूल धवकयस सुधनध चत करेगी तथय संवर्वधत करेगी।
(8) अंचधलक महययोजनय क्षेत्रीय धवकयस योजनय की सह धवथतयरी होगी ।
(9) आस प्रकयर ऄनुमोददत अंचधलक महययोजनय आस ऄधधसूचनय के ईपबंधों के ऄनुसयर मयनीटरी के ऄपने कृत्यों को करन ेके धलए मयनीटरी सधमधत के धलए एक संदभा दथतयवेज होगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
3. रयज्य सरकयर द्वयरय दकए जयन े वयल े ईपयय.—रयज्य सरकयर आस ऄधधसूचनय के ईपबंधों को प्रभयवी करन े के धलए धनम्नधलधखत ईपयय करेगी, ऄथयात्:—
(1) भू-ईपयोग – (क) पयररधथ थधतक संवेदी जोन में वनों, ईद्ययन-कृधर् क्षेत्रों, कृधर् क्षेत्रों, अमोद-प्रमोद के प्रयोजन के धलए धचधन्हत दकए गए पयकों और खुल ेथथयनों कय वृहद वयधणधज्यक यय वृहद अवयसीय कयम्पलैक्स औद्योधगक दिययकलयपों के धलए ईपयोग यय संपररवतान नहीं होगय:
परंत ुपयररधथथधतक संवेदी जोन के भीतर भयग (क) में धवधनर्ददष्ट प्रयोजन से धभन्न प्रयोजन के धलए कृधर् और ऄन्य भूधम कय संपररवतान मयनीटरी सधमधत की धसफयररि पर और यथय लयगू और क्षेत्रीय नगर योजनय ऄधधधनयम तथय केन्रीय/रयज्य सरकयर के ऄन्य धनयमों तथय धवधनयमों के ऄधीन सक्षम प्रयधधकयरी के पूवा ऄनुमोदन से, तथय आस ऄधधसूचनय के ईपबंधों द्वयरय थथयनीय धनवयधसयों की धनम्नधलधखत अवयसीय जरूरतों को पूरय करन ेके धलए ऄनुज्ञयत दकयय जयएगय, जैसे:—
(i) धवद्यमयन सड़कों को चौड़य करनय और ईन्हें सुदढृ करनय तथय नइ सड़कों कय संधनमयाण;
(ii) बुधनययदी ढयंचों और नयगररक सुधवधयओं कय संधनमयाण और नवीकरण;
(iii) प्रदरू्ण ईत्पन्न न करने वयल ेलघ ुईद्योग;
(iv) कुटीर ईद्योगों धजसके ऄंतगात ग्रयमीण ईद्योग हैं; सुधवधयजनक भण्डयर और थथयनीय सुख-सुधवधयओं जो पयररधथथधतक पयाटन में सहययक हैं धजसमें ग्रह वयस सधम्मधलत ह;ैऔर
(v) संवर्वधत दिययकलयप और परैय 4 के ऄधीन ददयय गयय ह:ै परंत ुयह और भी दक क्षेत्रीय नगर योजनय ऄधधधनयम और ऄन्य धनयमों और धवधनयमों के ऄधीन रयज्य सरकयर के पूवा ऄनुमोदन तथय संधवधयन के ऄनचु्छेद 244 और तत्समय प्रवृत्त धवधध के ईपबंधों के ऄनुपयलन के धबनय, धजसके ऄंतगात ऄनुसूधचत जनजयधत और ऄन्य परंपरयगत वन धनवयसी (वन ऄधधकयरों की मयन्यतय) ऄधधधनयम, 2006 (2007 कय 2) भी ह,ै वयधणधज्यक यय ईद्योग धवकयस दिययकलयपों के धलए जनजयतीय भूधम कय ईपयोग ऄनुज्ञयत नहीं होगय:
परंत ु यह और भी दक पयररधथ थधतक संवेदी जोन के भीतर भू-ऄधभलेखों में प्रकट होने वयली कोइ तु्ररट, मयनीटरी सधमधत के धवचयर प्रयप्त करन ेके पश्चयत ्रयज्य सरकयर द्वयरय प्रत्येक मयमले में एक बयर संिोधधत होगी और ईि तु्ररट के संिोधन की सूचनय कें रीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को देनी होगी । परंत ुयह और भी दक ईपयुाि तु्ररट के संिोधन में आस ईप पैरय के ऄधीन यथय ईपबंधधत के धसवयय दकसी भी दिय में भू-ईपयोग कय पररवतान सधम्मधलत नहीं होगय । (ख) वनरोपण और वयस जीणोद्धयर दिययकलयपों वयल ेऄनप्रयकु् त यय ऄनुत् पयदक कृधर् क्षेत्रों में पुन: वनीकरण करन ेके प्रययस दकए जयएंगे ।
(2) प्रयकृधतक जल स्रोत.—अचंधलक महययोजनय में सभी प्रयकृधतक जल स्रोतों यय नददयों यय जलसरणी की पहचयन की जयएगी और ईसमें ईनके संरक्षण और पनुरुद्भूतकरण के धलए योजनय सधम् मधलत होगी ।
(3) पयाटन/पयररधथथधतक पयाटन.—(क) पयररधथथधतक संवेदी जोन के भीतर सभी नए पयररधथथधतक पयाटन दिययकलयप यय धवद्यमयन पयाटन संबंधी दिययकलयप पयररधथथधतक संवेदी जोन के धलए पयाटन महययोजनय के ऄनुसयर होंगे । (ख) पयररधथथधतक पयाटन महययोजनय पयाटन धवभयग, द्वयरय रयज्य सरकयर के पययावरण और वन धवभयग के परयमिा से तैययर होगी । (ग) पयाटन महययोजनय अंचधलक महययोजनय के एक घटक के रूप में होगी । II (ii) 5 (घ) पयररधथथधतक पयाटन संबंधी दिययकलयप धनम् नधलधखत के ऄधीन धवधनयधमत होंगे, ऄथयात ्:—
(i) वन्यजीव ऄभयरयण्य की सीमय से एक दकलोमीटर के भीतर यय पयररधथथधतक संवेदी जोन के धवथतयर तक, जो भी धनकट हो, दकसी होटल यय ररसोटा कय नयय संधन्नमयाण ऄनुज्ञयत नहीं दकयय जयएगय । तथयधप, वन्यजीव ऄभययरण्य की सीमय से एक दकलोमीटर की दरूी से परे पयररधथथधतक संवेदी जोन के धवथतयर तक नए होटलों और ररसोटों की थथयपनय पयाटन महययोजनय के ऄनुसयर पयररधथथधतक पयाटन सुधवधयओं के धलए पूवा सीमयंदकत और पदयधभधहत क्षेत्रों में ही ऄनुज्ञयत की जयएगी।
(ii) पयररधथथधतक संवेदी जोन के ऄन्दर सभी नए पयाटन दियय-कलयप यय धवद्यमयन पयाटन दिययकलयपों के धवथतयर केन्रीय सरकयर, पययावरण, वन और जलवययु पररवतान मंत्रयलय द्वयरय जयरी मयगादिी धसद्धयंतों तथय पयररधथथधतक पयाटन पर बल दतेे हुए रयष्ट्रीय बयघ संरक्षण प्रयधधकरण द्वयरय जयरी पयररधथथधतक पयाटन मयगादिी धसद्धयंतों (समय- समय पर यथय संिोधधत) के ऄनुसयर होगय ।
(iii) जब तक अंचधलक महययोजनय कय ऄनुमोदन नहीं कर ददयय जयतय ह ै जब तक पयाटन संबंधी धवकयस तथय धवद्यमयन पयाटन दिययकलयपों कय धवथतयर मयनीटरी सधमधत के वयथतधवक थथल धवधनर्ददष्ट संवीक्षय तथय धसफयररि के अधयर पर सम्बंधधत धवधनययमक प्रयधधकयरी द्वयरय ऄनजु्ञयत दकयय जयएगय और पयररधथथधतक संवेदी जोन क्षेत्र के भीतर कोइ नयय होटल/ररसयटा यय वयधणधज्यक थथयपन कय संधन्नमयाण ऄनुज्ञयत नहीं दकयय जयतय ह ै।
(4) नसैर्वगक धवरयसत.—पयररधथथधतक संवेदी जोन में महत्वपूणा नैसर्वगक धवरयसत के सभी थथलों जैसे सभी जीन कोि अरधक्षत के्षत्र, िैल धवरचनयएं, जल प्रपयतों, झरनों, घयटी मयगों, ईपवनों, गुफयए,ं थथलों, भ्रमण, ऄश्वरोहण, प्रपयतों अदद की पहचयन की जयएगी और धवरयसत संरक्षण योजनय अंचधलक महययोजनय के भयग के रुप में परररक्षण और संरक्षण के धलए तैययर की जयएगी ।
(5) मयनव धनर्वमत धवरयसत थ थल.—पयररधथ थधतक संवेदी जोन में भवनों, संरचनयओं, धिल्प-तथ्य, ऐधतहयधसक, कलयत्मक और सयंथकृधतक महत्व के के्षत्रों की पहचयन और ईनके संरक्षण के धलए धवरयसत योजनय अंचधलक महययोजनय के भयग के रुप में तैययर की जयएगी ।
(6) ध् वधन प्रदरू्ण.—पयररधथथधतक संवेदी जोन में ध् वधन प्रदरू्ण की रोकथयम और धनयंत्रण कय ध्वधन पययावरणीय (संरक्षण) ऄधधधनयम, 1986, औ ईसमें दकए गए संिोधनों के ऄधीन प्रदरू्ण (धवधनयमन और धनयंत्रण) धनयमों 2000 के ऄनुसयर ऄनुपयलन दकयय जयएगय ।
(7) वयय ुप्रदरू्ण.—पयररधथथधतक संवेदी जोन में, वयय ुप्रदरू्ण की रोकथयम और धनयंत्रण वययु (प्रदरू्ण धनवयरण और धनयंत्रण) ऄधधधनयम, 1981 (1981 कय 14) के ईपबंधों और ईसके ऄधीन बनयए गए धनयमों और ईनमें दकए गए संिोधनों के ऄनुसयर ऄनुपयलन दकयय जयएगय ।
(8) बधहस्रयव कय धनथसयरण.—पयररधथथधतक संवेदी जोन में ईपचयररत बधहस्रयव कय धनथसयरण, सयधयरणों मयनकों के ऄन्तगात पययावरणीय (संरक्षण) ऄधधधनयम, 1986 और ईसके ऄधीन बनयए गए धनयमों के ऄधीन अने वयले पययावरणीय प्रदरू्ण के धनथसयरण के धलए सयधयरण मयनकों यय रयज्य सरकयर द्वयरय धनयत मयनकों, जो भी ऄधधक कठोर हो, के ईपबंधों के ऄनुसयर होगय।
(9) ठोस ऄपधिष्ट.—ठोस ऄपधिष्टों कय धनपटयन और प्रबंधन धनम्नधलधखत रूप में होगय— (क) पयररधथथधतक संवेदी जोन में ठोस ऄपधिष्ट धनपटयन और प्रबंधन समय-समय पर संिोधधत ठोस ऄपधिष्ट ट प्रबंधन धनयम, 2016, जो भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय सं. कय.अ.
1357(ऄ) तयरीख 8 ऄप्रलै, 2016 द्वयरय प्रकयधित दकए गए थ,े के ईपबंधों के ऄनुसयर दकयय जयएगय ;
ऄकयबाधनक सयमग्री कय धनपटयन पयररधथथधतक संवेदी जोन के बयहर पहचयन दकए गए थ थल पर दकसी पययावरणीय थवीकृत रीधत में होगय;

(10) जैव धचदकत् सीय ऄपधिष्ट ट.—जैव धचदकत् सीय ऄपधिष्ट ट प्रबंधन धनम्नधलधखत रूप में होगय— (क) पयररधथथधतक संवेदी जोन में जैव धचदकत्सीय ऄपधिष्टों कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवयय ु पररवतान मंत्रयलय की समय-समय पर यथय संिोधधत ऄधधसूचनय सं.कय.धन 343 (ऄ) तयरीख 28 मयचा 2016 द्वयरय प्रकयधित जैव धचदकत्सीय ऄपधिष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय । (ख) पयररधथथधतक संवेदी जोन में कोइ सयमयन्य ईपचयर सुधवधय यय भष्टमीकरण ऄनुज्ञयत नहीं दकयय जयएगय ।
(11) प्लयधथटक ऄपधिष्ट प्रबधंन.—पयररधथथधतक संवेदी जोन में प्लयधथटक ऄपधिष्ट प्रबंध कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की समय-समय पर यथयसंिोधधत ऄधधसूचनय सय.कय.धन 340(ऄ), तयरीख 18 मयचा, 2016 द्वयरय प्रकयधित प्लयधथटक ऄपधिष्ट प्रबंध धनयम 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय।
(12) सधंनमयाण और धवध्वसं ऄपधिष्ट प्रबधंन.—पयररधथथधतक संवेदी जोन में संधनमयाण और धवध्वंस ऄपधिष्ट प्रबंध भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की समय-समय पर यथयसंिोधधत ऄधधसूचनय सय.कय.धन 317(ऄ), तयरीख 29 मयचा, 2016 द्वयरय प्रकयधित संधनमयाण और धवध्वंस प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय ।
(13) इ–ऄपधिष्ट.—पयररधथथधतक संवेदी जोन में इ–ऄपधिष्ट प्रबंध कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय द्वयरय समय-समय पर यथयसंिोधधत इ–ऄपधिष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय।
(14) ययनीय पररवहन.—पररवहन की ययनीय संचयलन अवयस के ऄनुकूल रीधत में धवधनयधमत होंगी और आस संबंध में अंचधलक महययोजनय में धवधनर्ददष्ट ईपबंध समयधवष्ट दकए जयएंग ेऔर अंचधलक महययोजनय के तैययर होने और रयज्य सरकयर के सक्षम प्रयधधकयरी द्वयरय के ऄनुमोददत होने तक, मयनीटरी सधमधत सुसंगत ऄधधधनयमों तथय तदधीन बनयए गए धनयमों और धवधनयमों के ऄधीन ययनीय संचलन के ऄनुपयलन को मयनीटर करेगी ।
(15) ययनीय प्रदरू्ण.—लयगू धवधधयों के ऄनुसयर वयहन प्रदरू्ण की रोकथयम और धनयंत्रण कय ऄनुपयलन दकयय जयएगय। थवच्छक ईंधन ईदयहरण के धलए सीएनजी, एलपीजी, अदद के ईपयोग के धलए प्रययस दकए जयंएगे ।
(16) औद्योधगक इकयआयय.ं—(i) सरकयरी रयजपत्र में आस ऄधधसूचनय के प्रकयिन पर यय ईसके बयद पयररधथथधतक संवेदी जोन के भीतर दकन्ही नए प्रदरू्णकयरी ईद्योगों की थथयपनय की ऄनुमधत नहीं दी जयएगी।
(ii) पयररधथथधतक संवेदी जोन में कें रीय प्रदरू्ण धनयंत्रण बोडा द्वयरय फरवरी, 2016 में जयरी ददियधनदेिों में धसफा गैर- केवल ऄप्रदरू्णकयरी ईद्योगों की थथयपनय को वगीकरण के ऄनुसयर ऄनुमधत दी जयएगी, जब तक दक आस ऄधधसूचनय में आस प्रकयर धवधनर्ददष्ट न हो। आसके ऄलयवय, गैर-प्रदरू्णकयरी कुटीर ईद्योगों को प्रधतधर्द्ध दकयय जयएगय।
(17) पहयड़ी ढलयनों को सरंक्षण.—पहयड़ी ढलयनों कय संरक्षण धनम्नयनुसयर:
(क) अंचधलक महययोजनय में पहयड़ी ढलयनों पर क्षेत्रों को ईपदर्वित दकयय जयएगय जहयं दकसी भी संधनमयाण की ऄनुमधत नहीं दी जयएगी । (ख)कटयव के एक ईच्च धडग्री के सयथ धवद्यमयन खड़ी पहयड़ी ढलयनों यय ढलयनों पर दकसी भी संधनमयाण की ऄनुमधत नहीं दी जयएगी ।
(18) केन्रीय सरकयर और रयज्य सरकयर, यदद यह अवयक समझती ह,ै आस ऄधधसूचनय के ईपबंधों को प्रभयवी करन ेमें ऄन्य ईपयय धवधनर्ददष्ट करेगय।
4. पयररधथथधतक सवंदेी जोन में प्रधतधर्द्ध यय धवधनयधमत दकए जयन ेवयल ेदिययकलयपों की सचूी.—पयररधथथधतक संवेदी जोन में सभी दिययकलयप पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) के ईपबंधों और तटीय धवधनयमन जोन (सीअरजेड), 2011 और पययावरणीय प्रभयव अकलन (इअइए ) ऄधधसूचनय, 2006 और वन (संरक्षण) ऄधधधनयम, 1980 (1980 के 69), भयरतीय वन ऄधधधनयम, 1927 (1927 के 16), वन्यजीव (संरक्षण) ऄधधधनयम, 1972 (1972 के 53) के ईपबंधों तथय ईनमें दकए गए संिोधनों द्वयरय ियधसत होंगे और नीचे दी गइ सयरणी में धवधनर्ददष्ट रीधत में धवधनयधमत होंग,े ऄथयात ्:— II (ii) 7 सयरणी िम स.ं दिययकलयप टीकय-रटप्पणी

2. प्रदरू्ण जल यय वययु यय मृदय यय ध् वधन कयररत करन ेवयले ईद्योगों की थ थयपनय । कोइ नयय ईद्योग यय पयररधथथधतक संवेदी जोन में प्रदरू्ण फैलयने वयल े ईद्योगों के धवथतयर की ऄनुमधत नहीं दी जयएगी। पयररधथथधतक संवेदी जोन के भीतर कें रीय प्रदरू्ण धनयंत्रण बोडा द्वयरय फरवरी, 2016 में जयरी ददियधनदेिों में धसफा गैर- प्रदधूर्त ईद्योगों को थथयपनय के ऄनुसयर ऄनुज्ञयत दकयय जयएगय, जब तक दक आस ऄधधसूचनय में आस प्रकयर धवधनर्ददष्ट न हो।
3. बृहत जल धवदु्यत पररयोजनय की थ थयपनय । लयग ूधवधधयों के ऄनुसयर प्रधतधर्द्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे ।
4. दकसी पररसंकटमय पदयथों कय ईपयोग यय ईत्पयदन यय प्रथसंकरण । लयग ूधवधधयों के ऄनुसयर प्रधतधर्द्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे ।
5. प्रयकृधतक जल धनकययों यय सतही के्षत्र में ऄनुपचयररत बधहस्रयाव और ठोस ऄपधिष्टों कय धनथसयरण । लयग ूधवधधयों के ऄनुसयर प्रधतधर्द्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे ।
6. ठोस ऄपधिष्ट धनपटयन थथल और ठोस और जैव धचदकत्सय ऄपधिष्ट के धलए सयमयन्य भष्टमीकरण की सुधवधय की थथयपनय। पयररधथथधतक संवेदी जोन के भीतर कोइ नइ ठोस ऄपधिष्ट धनपटयन थथल तथय ठोस ऄपधिष्ट और ऄपधिष्ट ईपचयर/प्रसंथकरण सुधवधय की ऄनुमधत नहीं ह।ै आसके ऄधतररि औद्योधगक प्रदियय और थवयथथ्य प्रधतष्ठयन/ऄथपतयलों अदद से ईत्पन्न दकसी भी ठोस ऄपधिष्ट के ईपचयर के धलए सयमयन्य यय व्यधिगत भष्टमीकरण की सुधवधय कय संथथयपन प्रधतधर्द्ध ह।ै
7. फमों, कॉपोरेट, कंपधनयों द्वयरय बडे़ पैमयने पर वयधणधज्यक पिुधन संपदय और कुक्कुट फयमों की थथयपनय । थथयनीय जरूरतों को परूय करने के धसवयय लयग ू धवधधयों के ऄनुसयर प्रधतधर्द्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे।
8. नइ अरय धमलों की थथयपनय। पयररधथथधतक संवेदी जोन के भीतर नइ यय धवद्यमयन अरय धमलों कय धवथ तयर ऄनुज्ञयत नहीं होगय ।
9. ईंट भट्टों की थथयपनय करनय। लयग ूधवधधयों के ऄनुसयर प्रधतधर्द्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे ।

11. होटलों और ररसोटों कय वयधणधज्यक थथयपन । पयररधथथधतक ऄनुकूल पयाटन दिययकलयपों के धलए लघु ऄथथययी संरचनयओं के धलए संरधक्षत क्षते्र सीमय के एक दकलोमीटर के भीतर यय पयररधथथधतक संवेदी जोन के धवथतयर तक ही जो भी धनकट हो कोइ नयय वयधणधज्यक होटल और ररसोटा ऄनुज्ञयत होंगे ऄन्यथय नहीं । परन्त ु संरधक्षत क्षेत्र की सीमय से एक दकलोमीटर परे यय पयररधथथधतक संवेदी जोन के धवथतयर तक, जो भी धनकट हो सभी नए पयाटन दिययकलयपों यय धवद्यमयन दिययकलयपों कय धवथतयर यथयलयग ू पयाटन महययोजनय के ऄनरुूप होगय ।
12. संधनमयाण दिययकलयप । (क) संरधक्षत क्षेत्र की सीमय से एक दकलोमीटर के भीतर यय पयररधथथधतक संवेदी जोन के धवथतयर तक जो भी धनकट हो, दकसी भी प्रकयर कय वयधणधज्यक संधनमयाण ऄनजु्ञयत नहीं दकयय जयएगय:
परंतु थ थयनीय लोगों को पैरय 3 के ईप परैय (1) में सूचीबद्ध दिययकलयपों सधहत ईनके ईपयोग के धलए ईनकी भूधम में थथयनीय धनवयथयों की अवयसीय अवयकतयओं को पूरय करने धलए संधनमयाण करने की ऄनुमधत भवन ईपधवधधयों के ऄनुसयर दी जयएगी ।
(i) धवद्यमयन सड़कों को चौड़य करनय और ईन्हें सुदढृ करनय तथय नइ सड़कों कय संधनमयाण;
(ii) बुधनययदी ढयंचों और नयगररक सुख-सुधवधयओं कय संधनमयाण और नवीकरण;
(iii) फरवरी, 2016 में कें रीय प्रदरू्ण धनयंत्रण बोडा द्वयरय दकए गए वगीकरण के ऄनुसयर पररभयधर्त गैर-प्रदरू्णकयरी लघु ईद्योग;
(iv) कुटीर ईद्योगों धजनके ऄंतगात ग्रयमीण ईद्योग हैं; सुधवधय भण्डयर और थथयनीय सुख सुधवधयओं जो पयररधथथधतक पयाटन में धजस में ग्रह वयस भी ह ैसहययक हो; और
(v) आस ऄधधसूचनय में सूचीबद्ध संवर्वधत दिययकलयपों की सूची :
परन्तु ऐसे लघु ईद्योगों जो प्रदरू्ण ईत् पन् न नहीं करते हैं, से संबंधधत संधनमयाण दिययकलयप धवधनयधमत दकए जयएंगे और लयग ू धनयमों और धवधनयमों, यदद कोइ हों, के ऄनुसयर सक्षम प्रयधधकयरी की पूवा ऄनुमधत से ही न् यनूतम पर रखे जयएंग े। (ख) एक दकलोमीटर से अगे अंचधलक महययोजनय की ऄनुसयर धवधनयधमत होंगे ।
13. प्रदरू्ण ईत्पन्न न करन ेवयले लघु ईद्योग । फरवरी, 2016 में केन्रीय प्रदरू्ण धनयंत्रण बोडा द्वयरय जयरी ईद्योगों में वगीकरण के ऄनुसयर गैर-प्रदरू्णकयरी ईद्योग और ऄपररसंकट में, लघ ु और सेवय ईद्योग, कृधर्, पुष्टप कृधर्, ईद्ययन कृधर् यय पयररधथथधतक संवेदी जोन से देिी सयमग्री से ईत्पयदों को ईत्पन्न करने वयले कृधर् अधयररत ईद्योग सक्षम प्रयधधकयरी द्वयरय ऄनुज्ञयत होंगे।
14. वृक्षों की कटयइ । (क) रयज्य सरकयर में सक्षम प्रयधधकयरी की पूवा ऄनुमधत के धबनय वन, सरकयरी यय रयजथव यय धनजी भूधम पर वृक्षों की कोइ कटयइ नहीं होगी । II (ii) 9 (ख) वृक्षों की कटयइ संबंधधत कें रीय यय रयज्य ऄधधधनयम यय ईसके ऄधीन बनयए गए धनयमों के ईपबंध के ऄनुसयर धवधनयधमत होगी ।
15. वन ईत्पयदों और गरै कयष्ट ठ वन ईत्पयदों कय संग्रहण (एनटीएफपी) । लयग ूधवधधयों के ऄधीन धवधनयधमत होंग े।
16. धवदु्यत और दरूसंचयर टयवरों कय पररधनमयाण और केबल धबछयनय और ऄन्य बुधनययदी ढयंचे । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । भूधमगत केबल धबछयए जयन े को बढ़यवय ददयय जयएगय।
17. नयगररक सुख सुधवधयओं सधहत बुधनययदी ढयंचे। लयगू धवधधयों धनयमों और धवधनयमों मयगी धसद्धयंतों के ऄनुसयर न्यूनीकरण की ईपययों के सयथ, और ईपलब्ध दकए जयएंग े।
18. धवद्यमयन सड़कों को चौड़य करनय और ईन्हें सुदढृ करनय तथय नइ सड़कों कय संधन्नमयाण । लयगू धवधधयों धनयमों और धवधनयमों मयगी धसद्धयंतों के ऄनुसयर न्यूनीकरण की ईपययों के सयथ, और ईपलब्ध दकए जयएंग े।
19. पयाटन से संबंधधत दिययकलयप करनय जैसे गमा वययु गुब्बयरें, हलेीकयप्टर, ड्रोन, मयआिोलयआटस अदद द्वयरय पयररधथथधतक संवेदी जोन क्षेत्र के उपर से ईड़नय लयग ूधवधधयों के ऄधीन धवधनयधमत होंगे ।
20. पहयड़ी ढयलों और नदी तटों कय संरक्षण । लयग ूधवधधयों के ऄधीन धवधनयधमत होंगे ।
21. रयधत्र में ययनीय ययतयययत कय संचलन । लयगू धवधधयों के ऄधीन वयधणधज्यक प्रयोजन के धलए धवधनयधमत होंगे ।
22. थथयनीय समुदययों द्वयरय चलयइ जय रही कृधर् और बयगवयनी प्रथयओं के सयथ पिुपयलन, पिुपयलन कृधर्, जलकृधर् और मछली पयलन । थथयनीय लोगों के ईपयोग के धलए लयग ूधवधधयों के ऄधीन धवधनयधमत होंगे ।
23. प्रयकृधतक जल धनकययों यय सतही के्षत्र में ईपचयररत ऄपधिष्ट जल/बधहस्रयाव कय धनथसयरण । ईपचयररत ऄपधिष्ट जल/बधहस्रयाव कय धनथसयरण को जल धनकययों में प्रवेि नहीं करन े ददयय जयएगय। ऄन्यथय लयग ू धवधधयों के ऄनुसयर ईपचयररत जल बधहस्रयाव कय धनथसयरण धवधनयधमत दकयय जयएगय।
24. सतह और भूजल कय वयधणधज्यक धनष्टकर्ाण । लयग ूधवधधयों के ऄधीन धवधनयधमत होंगे ।
25. खुल ेकुअ, बोर कुअ, अदद के धलए कृधर् और ऄन्य ईपयोग । धवधनयधमत और समुधचत प्रयधधकयरी द्वयरय दिययकलयपों की सख्ती से मयनीटरी की जयएगी।
26. ठोस ऄपधिष्ट ट प्रबंधन। लयग ूधवधधयों के ऄधीन धवधनयधमत होंगे ।
27. धवदेिी प्रजयधतयों को लयनय । लयग ूधवधधयों के ऄधीन धवधनयधमत होंगे ।
28. पयररधथथधतक-पयाटन। लयग ूधवधधयों के ऄधीन धवधनयधमत होंगे ।
29. पोधलथीन बैगों कय ईपयोग । लयग ूधवधधयों के ऄधीन धवधनयधमत होंगे ।

(ii) मयननीय धवधयन सभय सदथ य, धवरयजपेट धनवयाचन क्षेत्र, कोदयगु धजलय – सदथ य;
(कनयाटक सरकयर द्वयरय, ऄन् य बयतों के सयथ, सुसंगत ऄनुमोदन ऄधभप्रयप् त करते हुए, धजसके ऄतंगात ऄध् यक्ष, कनयाटक धवधयन सभय, से ऄनुज्ञय, यदद ऄपेधक्षत हो भी ह ैप्रयप्त करन ेके ऄध् यधीन)
(iii) पययावरण धवभयग, कनयाटक सरकयर कय प्रधतधनधध- सदथ य;
(iv) िहरी धवकयस धवभयग कनयाटक सरकयर कय प्रधतधनधध -सदथ य;

(vi) क्षेत्रीय ऄधधकयरी, कनयाटक रयज्य प्रदरु्ण धनयंत्रण बोडा, मसूैर-सदथ य;
(vii) कनयाटक रयज्य द्वयरय तीन वर्ा की ऄवधध के धलए नयमधनर्ददष्ट ट दकए जयन ेवयलय पयररधथ थधतक और पययावरण क्षेत्र कय एक धविेर्ज्ञ - सदथय ;
(viii) रयज्य जैव-धवधवधतय बोडा कय सदथय सधचव/सदथय- सदथय ;
(ix) ईपययुक् त यय ईसकय प्रधतधनधध कोडयग ुधजलय, मेधडकेरी- सदथय ;
(x) ईप वन संरक्षक, मेधडकेरी वन् य जीव ऄभययरण्य, मेधडकेरी- सदथ य सधचव।
6. धनदेि - धनबधंन
(1) पयररधथथधतक संवेदी जोन सधमधत आस ऄधधसूचनय के ईपबंधों के ऄनुपयलन को मयनीटर करेगी। II (ii) 11
(2) पयररधथथधतक संवेदी जोन में भयरत सरकयर के तत् कयलीन पययावरण और वन मंत्रयलय की ऄधधसूचनय सं. कय.अ.
1533(ऄ) तयरीख 14 धसतंबर, 2006 की ऄनुसूची में के ऄधीन सधम्मधलत दिययकलयपों और आस ऄधधसूचनय के पैरय 4 के ऄधीन सयरणी में यथय धवधनर्ददष्ट प्रधतधर्द्ध गधतधवधधयों के धसवयय अन ेवयले ऐसे दिययकलयपों की दिय में वयथतधवक धवधनर्ददष्ट थथलीय दियओं पर अधयररत मयनीटरी सधमधत द्वयरय संवीक्षय की जयएगी और ईि ऄधधसूचनय के ईपबंधों के ऄधीन पूवा पययावरण ऄनयपधत्त के धलए केन्रीय सरकयर के पययावरण, वन और जलवयय ुपररवतान मंत्रयलय को धनर्ददष्ट की जयएगी ।
(3) आस ऄधधसूचनय के पैरय 4 के ऄधीन सयरणी में यथय धवधनर्ददष्ट प्रधतधर्द्ध दिययकलयपों के धसवयय, भयरत सरकयर के तत् कयलीन पययावरण और वन मंत्रयलय की ऄधधसूचनय संख्ययंक कय.अ. 1533(ऄ) तयरीख 14 धसतंबर, 2006 की ऄधधसूचनय के ऄनुसूची के ऄधीन ऐसे दिययकलयपों, धजन्हें सधम्मधलत नहीं दकयय गयय ह,ै परंत ुपयररधथथधतक संवेदी जोन में अते हैं, ऐसे दिययकलयपों की वयथतधवक धवधनर्ददष्ट थथलीय दियओं पर अधयररत मयनीटरी सधमधत द्वयरय संवीक्षय की जयएगी और ईसे संबद्ध धवधनययमक प्रयधधकरणों को धनर्ददष्ट दकयय जयएगय ।
(4) मयनीटरी सधमधत कय सदथय-सधचव यय संबद्ध ईपययुक् त यय संबद्ध ईद्ययन ईप वन संरक्षक ऐसे व्यधि के धवरूद्ध, जो आस ऄधधसूचनय के दकसी ईपबंध कय ईल्लघंन करतय ह,ै पययावरण (संरक्षण) ऄधधधनयम, 1986 की धयरय 19 के ऄधीन पररवयद फयआल करन ेके धलए सक्षम होगय ।
(5) मयनीटरी सधमधत मुद्दय दर मुद्दय के अधयर पर ऄपेक्षयओं पर धनभार रहत े हुए संबद्ध धवभयगों के प्रधतधनधधयों यय धविेर्ज्ञों, औद्योधगक संगमों यय संबद्ध पणधयररयों के प्रधतधनधधयों को ऄपन ेधवचयर-धवमिा में सहययतय के धलए अमंधत्रत कर सकेगी ।
(6) मयनीटरी सधमधत प्रत्येक वर्ा की 31 मयचा तक की ऄपनी वयर्वर्क कयरावयइ ररपोटा रयज्य के मुख्य वन्य जीव वयडान को ईपयबधं V में ईपबंधधत रूप धवधयन के ऄनुसयर ईक् त वर्ा के 30 जून तक प्रथतुत करेगी ।
(7) केन्रीय सरकयर कय पययावरण, वन और जलवययु पररवतान मंत्रयलय मयनीटरी सधमधत को ऄपन े कृत्यों के प्रभयवी धनवाहन के धलए ऐसे धनदेि दे सकेगय, जो वह ठीक समझे ।
7. आस ऄधधसूचनय के ईपबंधों को प्रभयव देने के धलए कें रीय सरकयर और रयज् य सरकयर ऄधतररक् त ईपयय, यदद कोइ हों, धवधनर्ददष्ट ट कर सकें ग े।

8. कोइ ऄन् य महत् वपूणा धवर्य । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 26th May, 2017 S.O. 1701(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3226(E), dated the 1 st December, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And Whereas, copies of the Gazette were made available to the public on the dated the 1 st December, 2015;
And Whereas, objections and suggestions received from persons and stakeholders in response to the draft notification duly considered by the Central government.;
And Whereas, the Brahmagiri Wildlife Sanctuary was formed by including the entire forest areas of Brahmagiri Ghat and Urti reserve forests in the year 1974. The State Government vide its Notification No. AFD.50 FWL;74 Dated 05-06-1974 notified an area of 181.29 square kilometres as Brahmagiri Wildlife Sanctuary under the provisions of the Sub-Section (1) of Section 18 of the Wildlife (Protection) Act, 1972.
And Whereas, Brahmagiri Wildlife Sanctuary is situated in Southern side of Kodagu district in the State of Karnataka and lies between North latitude 11 55 to 12 19 and East longitude 75 44 to 76 04 ;
And Whereas, the Brahmagiri Wildlife Sanctuary lies in the core of Western Ghats and is characterized by rugged terrain with slopes varying from 1% to more than 35% slope and it is a high rain fall ranging between 2500 mm to 6000 mm per year;
And Whereas, the Sanctuary supports rich biodiversity with high rate of endemism and is also home for critically endangered species. The important animals found in the sanctuary include Tiger (Panthera tigris), Leopard (Leopard Panthera pardus), Wild Dog (Cuon alpines), Asiatic Elephant (Elephas maximus), Gaur or Indian Bison (Bos II (ii) 17 gaurus), Sambar (Rusa unicolor), Barking deer (Muntiacus muntjak), Lion Tailed Macaque (Macaque silenus), Nilgiri Langur (Trachypithecus johnii), Nilgiri Marten (Martes gwatkinsii), Brown Palm Civet (Paradoxurus jerdoni), Leopard Cat (Prionailurus bengalensis), Slender Loris (Loris lydekkerianus), Travancore Flying Squirrel (Petinomys fuscocapillus), King Cobra (Ophiophagus Hannah), Indian Rock Python (Python molurus molurus), and Malabar Pied Hornbill (Anthracoceros coronatus), Malabar Grey Hornbill (Ocyceros griseus), Malabar Trogon (Harpactes fasciatus), Malabar Whistling Thrush (Myophonus horsfieldii), Wayanad Laughing Thrush (Garrulax delesserti), White-bellied Tree-pie (Dendrocitta leucogastra), Hill Myna (Gracula religiosa), etc. The Sanctuary is catchment for River Cauvery which is an important River of Karnataka and Lakshmanthirtha and Ramathirtha are the tributaries of River Cauvery that originates from Brahmagiri Wildlife Sanctuary and many perennial streams also originate from the Sanctuary;
And Whereas, the Sanctuary forms an important corridor for large mammals like Asiatic Elephant (Elephas maximus) and Tiger (Panthera tigris) to move between Nagarahole National Park and Talacauvery Wildlife Sanctuary in Karnataka and Wynad and Aralam Wildlife Sanctuaries in KeralaState and also forms part of the Mysore Elephant Reserve declared under the Project Elephant;
And Whereas, the sanctuary has a very high Floral and Faunal diversity, the sanctuary consists of evergreen and semi-evergreen forests interspersed with shola grasslands and the vegetation comprises of very important species like Dipterocarpus indicus, Antiaris toxicaria, Kingiodendron pinnatum, Diospyrous ebenum, Bischofia javanica, Calophyllum apetalum, Cinnamomum zeylanicum, Dalbergia latifolia, Pterocarpus marsupium, Elaeocarpus sp., Myrstica sp., Garcinia sp., Machilus macarantha, Mesua ferrea, Hopea parviflora, Dysoxylum malabaricum, Cannarium strictum, Gnetum ula, etc.
And Whereas, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Brahmagiri Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
Now Therefore, in exercise of the powers conferred by sub section (1) and clauses (v) and (xiv) of sub-section
(2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of Brahmagiri Wildlife Sanctuary in the State of Karnataka as the Brahmagiri Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.— (1) The total geographical area of Eco-sensitive Zone is 136.60 square kilometers (excluding enclosures) with an extentvarying from 1 to 15 kilometres around the boundary of Brahmagiri Wildlife Sanctuary. The boundary description of the Eco-sensitive Zone is given in Annexure– I.
(2) The map of Eco-sensitive Zone boundary together with latitudes longitudes is appended as Annexure II;
(3) The Geo Coordinates of major points on the boundary of Brahmagiri Wildlife Sanctuary and on the boundary of Ecosensitive Zone boundary is appended as Annexure-III.
(4) The list of villages and the details of reserved forest areas falling within the Eco-sensitive Zone is given at Annexure- IV.
2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan; namely:- i. Environment;
ii. Forest and Wildlife;

iv. Revenue;
v. Urban Development;
vi. Tourism;
vii. Rural Development;
viii. Irrigation and Flood Control;

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.—(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) Promoted activities and given under para 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.—The catchment areas of all natural springs or rivers or channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/ Eco-tourism.—(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:—
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.
(4) Natural Heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.—Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.
(7) Air pollution.—Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto.
(8) Discharge of effluents.—Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes.—Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357(E), dated 8th April, 2016 as amended from time to time;
the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.—Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.
(b) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Plastic Waste Management.—The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.—The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution.—Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial Units.—(i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.—The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian II (ii) 21 Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:— TABLE Sl. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within Eco sensitive zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is Prohibited.
7. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
10. Commercial use of fire wood. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
11. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

12. Construction activities (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and
(v) Promoted activities listed in this Notification.
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
13. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
14. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
15. Collection of Forest produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws.
16. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law. Underground cabling may be promoted.
17. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
19. Under taking other activities related to tourism like over flying the ESZ area by hot air balloon, helicopter, drones, Microlites, etc.

5. Monitoring Committee.—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:-
(i) Regional Commissioner, Mysore – Chairman
(ii) Hon’ble Member of Legislative Assembly, Virajpet Constituency, Kodagu District – Member (Subject to the State Government of Karnataka obtaining relevant approvals inter alia including permission from the Speaker of Legislative Assembly, Karnataka, if required)
(iii) Representative of the Department of Environment, Government of Karnataka – Member;
(iv) Representative of the Department of Urban Development, Government of Karnataka –Member;
(v) Representative of Non-governmental Organizations working in the field of nature conservation (including heritage conservation) to be nominated by the Govt. of Karnataka for three years– Member;
(vi) The Regional Officer, Karnataka State Pollution Control Board, Mysore – Member;
(vii) One expert in Ecology from reputed Institution or University of the State of Karnataka to be nominated by the Govt. of Karnataka for three years – Member.
23. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
24. Commercial extraction of surface and ground water.
Regulated under applicable law.
25. Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
26. Solid Waste Management. Regulated under applicable laws.
27. Introduction of Exotic species. Regulated under applicable laws.

6. Terms of Reference.—(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-V.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
[F. No. 25/168/2015-ESZ] LALIT KAPUR, Scientist ’G’ ANNEXURE - I Boundary description of the Eco-sensitive Zone around Brahmagiri Wildlife Sanctuary.
North: Theboundary lineof Eco-sensitive Zone starts at Soma Male on the ―D‖ line of Kerti reserve forest boundary and runs in South-Eastern direction and all along the northern boundary of Kerti reserve forest till it reaches a point where the ―D‖-line of Urti reserve forest and Kerti reserve forest meets i.e. common point at Perambadi tank.
II (ii) 25 The Eco-sensitive Zone boundary line then runs at a width of 1 Kilometer parallel to the D-Line of Brahmagiri Wildlife Sanctuary passing through the villages of Arji, Nangala, Rudraguppe, Badaga & Forest, Kuttandi, Begur, Hysodlur, Badagarakeri, Parakatakeri, Theralu & Forest, West Nemmale, Kurchi, Manchalli & Forest and Kutta villages.
East – South – West : Then the line runs in South-Western direction and runs all along the common boundary of Brahmagiri Wildlife Sanctuary and interstate boundary till it reaches the common point of Urti reserve forest of Brahmagiri Wildlife Range and Kerti reserve forest of Makutta Range at Kutupuzha Bridge. Then the line traverses all along the boundary of Kerti reserve forest and reaches the starting point at Soma Male. The concurrence to include the Private lands, Reserved Forests and Protected Areas of the Kerala State as shown in the map within the Eco-sensitive Zone has been obtained.
