PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 1550] T;s"B No. 1550] NEW DELHI, WEDNESDAY, MAY 31, 2017/JYAISTHA 10, 1939 पर्यावरण, वन और जलवयर् ुपररवर्ान मतं्रयलर् अधिसचूनय नई दिल्ली, 31 मई, 2017 कय.आ. 1751(अ).—भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. 3227 (अ), र्यरीख 1 दिसम्बर, 2015 द्वयरय भयरर् के रयजपत्र, असयियरण में, उन सभी व्यधिर्ों से, धजनके उससे प्रभयधवर् होने की संभयवनय थी, उस र्यरीख से, धजसको उस रयजपत्र की प्रधर्र्यं, धजसमें र्ह अधिसूचनय अंर्र्वाष्ट ह,ै जनर्य को उपलब्ि करय िी गई थीं, सयठ दिन की अवधि के भीर्र आक्षेप और सुझयव आमंधत्रर् करर्े हुए एक प्रयरुप अधिसूचनय प्रकयधिर् की गई थी;
और, जबदक रयजपत्र की प्रधर्र्यं जनर्य को र्यरीख 1 दिसम्बर, 2015 को उपलब्ि करय िी गई थीं;
और, उि प्रयरुप अधिसूचनय के प्रत्र्ुत्तर में व्यधिर्ों और पणियररर्ों से कोई टीकय रटप्पधणर्यं/आक्षेप और सुझयव प्रयप्त नहीं हुए थे;
और, र्ेििी रयमललंग घयट वन्यजीव अभर्यरण्र्, महाराष्ट्र के उस्मयनयबयि धजले में धस्थर् ह ैऔर 22.37 वगा ककलोमीटर क्षेत्र में फैला ह ै;
और, अभर्यरण्र् कयले धहरण (ऐनटीलोपे सर्वाकयपरय), सयही (हयइस्रीक्स इंधिकय), लकड़बग्घय (हनैय हनैय), जंगली सूअर (सूस स्रोफय), मुंसग गन्िधबलयव (पैरयिोक्रूस हेरमाफरोडीटेस), भेधड़र्य (कैनिस लुपुस पाल्लीपस), जंगली धबल्ली (फेनिस चाउस), लोमड़ी (वुलपेस बेिगालेिसीस), भयरर्ीर् सयही (हयइस्रीक्स इंधिकय), खरगोि, मोर (पयवो दरस्ट्रेटस) आदि को आश्रर् िरे्य ह।ै अभर्यरण्र् कय मुख्र् आकर्ाण बन्िरों की अधिक जनसंख्र्य ह ै;
और, क्षेत्र की वनस्पधर् में झयधड़र्ों के जंगल, बयग-बगीचों के खण्ि और चरयगयह अन्र्र्वाष्ट हैं और मुख्र् वृक्षों की प्रजयधर्र्ों में र्यमयररंि (टेमेररण्िस इंधिकय), पीपल वृक्ष (कफकस ररधलधजओसय), भयरर्ीर् अंजीर वृक्ष (दफकस ग्लोमेरयटय), पूवी भयरर्ीर् आबनूस (ियर्ोस्पयईरोस मेलयनोजयइलोन), िुगर सेब (ऐनोनय स्कोबयमोसय), नीम (अजयिीरेकय इंधिकय), दिक धस्टक (ग्लयइरीधसधिर्य धसधपर्म) और सैंिलवुि (सिटलुम अलबुम) अन्र्र्वाष्ट हैं ;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, र्ेििी रयमललंग घयट वन्यजीव अभर्यरण्र् के चयरों ओर के संरधक्षर् क्षेत्र को, धजसकय धवस्र्यर और सीमयएं इस अधिसूचनय के पैरय 1 में धवधनर्िाष्ट हैं, पयररधस्थधर्क और पर्यावरण की िधृष्ट से पयररधस्थधर्क संवेिी जोन के रूप में सुरधक्षर् और संरधक्षर् करनय र्थय उि पयररधस्थधर्क संवेिी जोन में उद्योगों और उद्योगों के वगों के र्य और उनके प्रचयलन र्थय प्रसंस्करण करने को प्रधर्धर्द्ध करनय आवश्र्क ह;ै अर्ः, अब, केन्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के सयथ परठर् पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (1) और उपियरय (2) के खंि (v) और खंि (xiv) और उपियरय (3) द्वयरय प्रित्त िधिर्ों कय प्रर्ोग करर्े हुए, महाराष्ट्र रयज् र् में र्ेििी रयमललंग घयट वन् र्जीव अभर्यरण्र् की सीमय से 0.1 ककलोमीटर से 3.240 ककलोमीटर र्क के धवस् र्यर र्क के क्षेत्र को र्ेििी रयमललंग घयट वन् र्जीव अभर्यरण्र् पयररधस्थधर्क संवेिी जोन (धजसे इसमें इसके पश् चयर्् पयररधस्थधर्क संवेिी जोन कहय गर्य ह)ै के रूप में अधिसूधचर् करर्ी ह,ै धजसके ब्र्ौरे धनम्नयनुसयर हैं, अथयार्् :—
1. पयररधस्थधर्क सवंिेी जोन कय धवस्र्यर और उसकी सीमयएं.—(1) पयररधस्थधर्क संवेिी जोन कय धवस्र्यर र्ेििी रयमललंग घयट वन् र्जीव अभर्यरण्र् की सीमा 0.1 ककलोमीटर से 3.240 ककलोमीटर र्क की दरूी के बीच ह।ै पाररनस्ट्िनिक संवदेी जोि का क्षेत्रफल
3.589 वगग ककलोमीटर ह ै।
(2) पयररधस्थधर्क संवेिी जोन का मयनधचत्र र्ेििी रयमललंग घयट वन् र्जीव अभर्यरण्र् के सीमा के भू-निदशेांक उपयबंि I के रूप में उपयबद्ध ह ै।
(3) पयररधस्थधर्क संवेिी जोन के भीर्र आने वयले (10) ग्रयमों की सूची और भू- निदशेांक उपयबंि II के रुप में उपयबद्ध ह ै।
2. पयररधस्थधर्क सवंेिी जोन के धलए आचंधलक महयर्ोजनय.—(1) रयज्र् सरकयर, पयररधस् थधर्क संवेिी जोन के प्रर्ोजन के धलए रयजपत्र में इस अधिसूचनय के प्रकयिन की र्यरीख से िो वर्ा की अवधि के भीर्र, स्थयनीर् लोगों के परयमिा से और इस अधिसूचनय में दिए गए अनुबंिों के कय पयलन करर्े हुए आंचधलक महयर्ोजनय र्ैर्यर करेगी।
(2) इस प्रकयर र्ैर्यर आंचधलक महयर्ोजनय अधिसूचनय में धवधनर्िाष्ट िर्ा के अनुरूप होगय और उसमें पर्यावरणीर् धववक्षयएं होंगी।
(3) आचंधलक महयर्ोजनय रयज् र् सरकयर में सक्षम प्रयधिकयरी द्वयरय अनुमोदिर् होगी ।
(4) रयज्र् सरकयर द्वयरय पयररधस् थधर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय ऐसी रीधर् में र्ैर्यर की जयएगी जो इस अधिसूचनय में धवधनर्िाष् ट ह ैर्थय सुसंगर् कें रीर् और रयज् र् धवधिर्ों और कें रीर् सरकयर द्वयरय जयरी मयगाधनिदेशिों, र्दि कोई हों, के अनुरूप होगी।
(5) आंचधलक महयर्ोजनय, सभी संबद्ध धवभयगों के परयमिा से र्ैर्यर की जयएगी, अथयार््:—
(i) पर्यावरण;
(ii) वन;
(iii) नगर धवकयस;
(iv) पर्ाटन;
(v) नगरपयधलकय;
(vi) रयजस् व;
(vii) कृधर् ;
(viii) लसंचयई;
(ix) लोक धन मयाण धव भयग; और
(x) महयरयष्ट्र रयज्र् प्रिरू्ण धनर्ंत्रण बोिा ।
(6) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन भू-उपर्ोग, अवसंरचनय और दरर्यकलयपों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय में इस प्रकयर धवधनर्िाष् ट न हो और आचंधलक महयर्ोजनय सभी अवसंरचनय और दरर्यकलयपों, जो और अधिक िक्ष और पयररधस्थधर्क अनुकूल हों, कय संविान करेगी । II (ii) 3
(7) आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबंिन, भूर्ल जल के प्रबंिन, मृिय और नमी संरक्षण, स्थयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधस्थधर्क और पर्यावरण से संबंधिर् ऐसे अन्र् पहलूओं, धजन पर ध्र्यन िनेय आवश्र्क ह,ै के धलए उपबंि होंगे ।
(8) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय स् थलों, ग्रयमों और नगरीर् बंिोबस्र्ों, वनों के प्रकयर और दकस् मों, कृधर् क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षेत्र जैसे उद्ययन और उसी प्रकयर के स् थयन, उद्ययन कृधर् क्षेत्र, फलोउद्ययन, झीलों और अन्र् जल धनकयर्ों कय अभ्र्कंन करेगी और इसके सयथ मयनधचत्र भी लगे होंगे र्ह र्ोजनय के मयनधचत्र द्वयरय धवद्यमयन और प्रस्र्यधवर् भूधम के उपर्ोग को धविेर्र्यओं कय ब्र्ौरे िनेे वयले मयनधचत्रों द्वयरय समर्थार् होगी ।
(9) आंचधलक महयर्ोजनय पयररधस् थधर्क संवेिी जोन में धवकयस को धवधनर्धमर् करेगी और अधिसूचनय में प्रधर्धर्द्ध, धवधनर्धमर् और संवर्िार् दरर्यकलयपों कय पयलन करेगी धजसमें पयररधस् थधर्क अनुकूल धवकयस को स् थयनीर् समुियर्ों की आजीधवकय की सुरक्षय के धलए भी सुधनधिर् दकर्य जय सके ।
(10) आंचधलक महयर्ोजनय इस अधिसूचनय में दिए गए उपबंिों के संबंि में अपने कृत्र्ों के करने के धलए धनगरयनी सधमधर् के धलए एक संिभा िस्र्यवेज र्ैर्यर करेगी ।
3. रयज्र् सरकयर द्वयरय दकए जयन ेवयल ेउपयर्.— रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करने के धलए धनम्नधलधखर् उपयर् करेगी, अथयार्् :—
(1) भ-ूउपर्ोग - पयररधस् थधर्क संवेिी जोन में वनों, उद्ययन-कृधर् क्षेत्रों, कृधर् क्षेत्रों, आमोि-प्रमोि के प्रर्ोजन के धलए धचधन्हर् दकए गए पयकों और खुले स्थयनों कय वयधणधज्र्क र्य औद्योधगक संबद्ध धवकयस दरर्यकलयपों के धलए क्षेत्रों में उपर्ोग नहीं दकर्य जयएगय र्य संपररवर्ान नहीं होगय:
परंर्ु पयररधस्थधर्क संवेिी जोन के भीर्र कृधर् भूधम को संपररवर्ान मयनीटरी सधमधर् की धसफयररि पर और रयज्र् सरकयर के पूवा अनुमोिन से, स्थयनीर् धनवयधसर्ों की आवयसीर् जरूरर्ों को पूरय करने के धलए और पैरय 4 की सयरणी के स्र्ंभ (2) में सूचीबद्ध दरर्यकलयपों के धलए अनुज्ञयर् दकर्य जय सकेगय, अथयार् ्:—
(i) पयररधस् थधर्क अनुकूल पर्ाटन दरर्यकलयपों के धलए पर्ाटकों के अस् थयर्ी अधिभोग के धलए पयररधस् थधर्क अनुकूल कुटीर जैसे टेंट, लकड़ी के मकयन आदि ;
(ii) धवद्यमयन सड़कों को चौड़य और सुिढृ़ बनयनय और नई सड़कों कय संधिमयाण;
(iii) प्रिरू्ण उत्पि न करने वयले लघु उद्योग;
(iv) कुटीर उद्योग, धजसके अंर्गार् ग्रयमीण कयरीगर भी हैं। परंर्ु र्ह और दक रयज्र् सरकयर के पूवा अनुमोिन और संधवियन के अनुच् छेि 244 र्य र्त्समर् प्रवृत्त धवधि के उपबंिों के अनुपयलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी है, वयधणधज्र्क र्य उद्योग धवकयस दरर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय :
परंर्ु र्ह भी दक पयररधस् थधर्क सवंेिी जोन के भीर्र भू-अधभलेखों में प्रकयर होने वयली कोई त्रुरट, मयनीटरी सधमधर् के धवचयर प्रयप्त करने के पियर्् रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमले में एक बयर संिोधिर् होगी और उि त्रुरट के संिोिन की कें रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को सूचनय िनेी होगी । परंर्ु र्ह भी दक उपर्ुाि त्रुरट के संिोिन में इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी ििय में भू-उपर्ोग कय पररवर्ान सधम्मधलर् नहीं होगय । परंर्ु र्ह भी दक हररर् क्षेत्र में जैसे वन क्षेत्र, कृधर् क्षेत्र आदि में कोई पयररणयधमक कटौर्ी नहीं होगी और अनप्रर्ुक् र् र्य अनुत् पयिक कृधर् क्षेत्रों में पुन: वनीकरण करने के प्रर्यस दकए जयएंगे ।
(2) प्रयकृधर्क जल स्रोर्.— आचंधलक महयर्ोजनय में सभी प्रयकृधर्क जल स्रोर्ों के आवयह क्षेत्रों की पहचयन की जयएगी और उनके संरक्षण और पुनरुद्भूर्करण के धलए र्ोजनयएं सधम् मधलर् हो और रयज् र् सरकयर द्वयरय आवयह प्रबंि र्ोजनय ऐसी रीधर् में र्ैर्यर की जयएगी धजससे आवयह क्षेत्रों के भीर्र धवकयस दरर्यकलयप प्रधर्धर्द्ध दकर्य जय सके और र्य धनबंधिर् दकर्य जय सके । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(3) पयररधस्थधर्क-पर्ाटन.—(क) पयररधस्थधर्क संवेिी जोन के भीर्र पर्ाटन संबंिी दरर्यकलयप पर्ाटन महयर्ोजनय के अनुसयर होंगे जो दक आंचधलक महयर्ोजनय के भयग रूप में होगी । (ख) पयररधस्थधर्क-पर्ाटन महयर्ोजनय पर्ाटन धवभयग, महाराष्ट्र सरकार द्वारा महयरयष्ट्र सरकयर के रयजस्व धवभयग और वन धवभयग, के परयमिा से र्ैर्यर की जाएगी । (ग) पर्ाटन महयर्ोजनय आंचधलक महयर्ोजनय के एक घटक के रूप में होगय । (घ) पर्ाटन संबंिी दरर्यकलयप धनम् नधलधखर् के अिीन धवधनर्धमर् होंगे, अथयार््:—
(i) र्ेििी रयमललंग घयट वन् र्जीव अभर्यरण्र् संरधक्षर् क्षेत्र की सीमय से एक दकलोमीटर र्क र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क इनमें जो भी धनकट है, नर्े वयधणधज्र्क होटलों और ररसोटों अनुज्ञयर् नहीं होंगे। र्थयधप वन्र्जीव अभर्यरण्र् की सीमय पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क एक दकलोमीटर से परे नए होटलों र्थय ररसोटों की स्थयपनय के धलए पूवा अभ्र्यंदकर् और नयमधनर्िाष्ट क्षेत्रों में अनुज्ञयर् दकर्य जयएगय;
(ii) पयररधस्थधर्क संवेिी जोन के भीर्र सभी नए पर्ाटन दरर्यकलयपों र्य धवद्यमयन पर्ाटन दरर्यकलयपों कय धवस्र्यर कें रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् द्वयरय मयगाििाक धसद्धयंर्ों के र्थय रयष् रीर् ा र्यघ्र स संरक्षण प्रयधिकरण, द्वयरय जयरी पयररधस्थधर्क पर्ाटन (समर्-समर् पर र्थय संिोधिर्) मयगाििाक धसद्धयंर्ों के अनुसयर, पयररधस्थधर्क पर्ाटन पर बल िरे्े हुए होगय;
(iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयने र्क, पर्ाटन के धलए धवकयस और धवद्यमयन पर्ाटन दरर्यकलयपों के धवस्र्यर को वयस्र्धवक स्थल धवधनर्िाष्ट संवीक्षय र्थय मयनीटरी सधमधर् की धसफयररि पर आियररर् संबधंिर् धवधनर्यमक प्रयधिकरणों द्वयरय अनुज्ञयर् दकर्य होगय ।
(4) नसैर्गाक धवरयसर्.— पयररधस्थधर्क संवेिी जोन में महत्वपूणा नैसर्गाक धवरयसर् के सभी स्थलों जैसे सभी जीन कोि आरधक्षर् क्षेत्र, िैल धवरचनयएं, जल प्रपयर्ों, झरनों, घयटी मयगों, उपवनों, गुफयएं, स्थलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और उन्हें संरधक्षर् दकर्य जयएगय र्थय उनकी सुरक्षय और संरक्षय के धलए उपर्ुि र्ोजनय बनयएगी और ऐसी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगय ।
(5) मयनव धनर्मार् धवरयसर् स् थल.—पयररधस् थधर्क संवेिी जोन में भवनों, संरचनयओं, धिल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंस्कृधर्क महत्व के क्षेत्रों की पहचयन करनी होगी और उनके संरक्षण की र्ोजनयएं इस अधिसूचनय के प्रकयिन की र्यरीि से छह मयस के भीर्र र्ैर्यर की जयएगी र्थय आंचधलक महयर्ोजनय में सधम्मधलर् की जयएगी ।
(6) ध् वधन प्रिरू्ण.— पयररधस्थधर्क संवेिी जोन में ध् वधन प्रिरू्ण के धनर्ंत्रण के धलए धनर्मों को महाराष्ट्र रयज् र् सरकयर कय पर्यावरण धवभयग र्य रयज् र् प्रिरू्ण धनर्ंत्रण बोिा पर्यावरणीर् (संरक्षण) अधिधनर्म, 1866, ध्वधन प्रिरू्ण (धवधनर्मन और धनर्ंत्रण) धनर्म, 2000 के अनुसयर कयर्याधन्वर् करेगय ।
(7) वयर् ुप्रिरू्ण.— पयररधस्थधर्क संवेिी जोन में, वयर्ु प्रिरू्ण के धनर्ंत्रण के धलए धवधनर्मों रयज्र् सरकयर कय पर्यावरण धवभयग र्य रयज् र् प्रिरू्ण धनर्ंत्रण बोिा वयर्ु (प्रिरू्ण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर अनुपयलन दकर्य जयएगय ।
(6) बधहस्रयव कय धनस्सयरण.— पयररधस्थधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनस्सयरण सयमयन्र् मयनकों के धलए पर्यावरणीर् प्रिधूर्र् आच्छयदिर् के धनस्सयरण के अंर्गार् पर्यावरणीर् (संरक्षण) अधिधनर्म, 1866 और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर होगय ।
(8) ठोस अपधिष्ट.—ठोस अपधिष्टों कय धनपटयन धनम्नधलधखर् रूप में होगय—
(i) पयररधस्थधर्क संवेिी जोन में ठोस अपधिष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थय संिोधिर् अधिसूचनय सं. कय.आ. 1357(आ), र्यरीख 8 अप्रैल, 2016 द्वयरय प्रकयधिर् ठोस अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ;
(ii) अकयबाधनक सयमग्री कय धनपटयन पयररधस्थधर्क संवेिी जोन के बयहर पहचयन दकए गए स् थल पर दकसी पर्यावरणीर् स्वीकृर् रीधर् में होगय;

(iii) पयररधस्थधर्क संवेिी जोन में ठोस अपधिष् टों को जलयनय र्य भस्मीकरण और भूधम भरयव के स्थयपनों को अनुज्ञयर् नहीं दकर्य जयएगय ।
(10) जवै धचदकत् सीर् अपधिष् ट.—पयररधस्थधर्क संवेिी जोन में जैव धचदकत् सीर् अपधिष् ट धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थय संिोधिर् अधिसूचनय सं.कय.धन. 343(अ), र्यरीख 28 मयचा, 2016 द्वयरय प्रकयधिर् जैव धचदकत्सीर् अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ।
(i) पयररधस्थधर्क संवेिी जोन में कोई सयमयन्र् उपचयर सुधविय र्य भधष्मकरण अनुज्ञयर् नहीं दकर्य जयएगय ।
(ii) पयररधस्थधर्क संवेिी जोन के भीर्र पहले से ही धवद्यमयन व्यधिगर् अस्पर्यलों र्य प्रयइवेट स्वयस्थ्र् केन्रों को संरधक्षर् क्षेत्र पर प्रधर्कूल प्रभयव से बचने के धलए पर्ाटन अपधिष्ट उपचयर प्रणयली उपलब्ि करयए ।
(11) प्लयधस्टक अपधिष्ट प्रबिंन.—पयररधस्थधर्क संवेिी जोन में प्लयधस्टक अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सय.कय.धन. 340(अ), र्यरीख 16 मयचा, 2016 द्वयरय प्रकयधिर् प्लयधस्टक अपधिष्ट प्रबंि धनर्म 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(12) धनमयाण और धवध्वसं अपधिष्ट प्रबिंन.—पयररधस्थधर्क संवेिी जोन में संधनमयाण और धवध्वंस अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थय संिोधिर् अधिसचूनय सय.कय.धन 317(अ), र्यरीख 28 मयचा, 2016 द्वयरय प्रकयधिर् संधनमयाण और धवध्वंस प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(13) ई–अपधिष्ट.—पयररधस्थधर्क संवेिी जोन में ई–अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् द्वयरय प्रकयधिर् समर्-समर् पर र्थय संिोधिर् और ई–अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(14) र्यनीर् पररवहन: - पररवहन की र्यनीर् गधर्धवधिर्य ंआवयस के अनुकूल रीधर् में धवधनर्धमर् होंगी और इस संबंि में आंचधलक महयर्ोजनय में धवधनर्िाष्ट उपबंि समयधवष्ट दकए जयएंगे और ऐसे समर् र्क जब र्क आंचधलक महयर्ोजनय के र्ैर्यर होर्ी ह ैऔर रयज्र् सरकयर के सक्षम प्रयधिकयरी द्वयरय अनुमोदिर् होन ेर्क, मयनीटरी सधमधर् सुसंगर् अधिधनर्मों र्थय उनके अिीन बनयए गए धनर्मों और धवधनर्मों के अनुसयर र्यनीर् गधर्धवधिर्ों के अनुपयलन को मयनीटर करेगी ।
(15) औद्योधगक इकयइर्य:ं - (क) प्रस्र्यधव पयररधस्थधर्क संवेिी जोन के भीर्र दकसी नए कयष्ठ आियररर् उद्योगों की धवद्यमयन स्थयपनय की अनुमधर् नहीं िी जयएगी। (ख) प्रस्र्यधवर् पयररधस्थधर्क संवेिी जोन के भीर्र जल, वयर्ु, ध्वधन प्रिरू्णकयररर् करने वयले दकसी नए उद्योग की स्थयपनय की अनुमधर् नहीं िी जयएगी ।
(16) इस अधिसूचनय के उपबंिों को प्रभयवी करने के धलए केन्रीर् सरकयर और रयज्र् सरकयर, अन्र् उपयर्ों र्दि वह आवश्र्क समझर्ी ह,ै धवधनर्िाष्ट करेगय।
4. पयररधस्थधर्क संविेी जोन में प्रधर्धर्द्ध और धवधनर्धमर् दकए जयन ेवयल े दरर्यकलयपों की सचूी - पयररधस्थधर्क संवेिी जोन में सभी दरर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1866 कय 28) और र्ियिीन बनयए गए धनर्मों के उपबंिों द्वयरय ियधसर् होंग े और नीचे िी गई सयरणी में धवधनर्िाष्ट रीधर् में धवधनर्धमर् होंगे, अथयार्् :— सयरणी रम स.ं दरर्यकलयप टीकय-रटप्पणी

1. वयधणधज्र्क खनन, पत्थर की खियन और उनको र्ोड़ने की इकयइर्यं । (क) सभी प्रकयर के नए और धवद्यमयन खनन (लघु और वृहर् खधनज), पत्थर की खयनें और उनको र्ोड़ने की इकयइर्यं वयस्र्धवक स्थयनीर् धनवयधसर्ों की घरेलू आवश्र्कर्यओं, धजसमें धनजी उपर्ोग के धलए मकयनों के संधनमयाण र्य मरम्मर् के धलए िरर्ी को खोिनय और आवयसन के धलए ििेी टयइल्स र्य ईंटों कय संधनमयाण करनय भी सधम्मधलर् हैं, को पूरय करने के धसवयर् और अन्र् दरर्यकलयपों के धलए र्ुरंर् प्रभयव से प्रधर्धर्द्ध की जयर्ी है ;

2. आरय धमलों की स्थयपनय । पयररधस्थधर्क संवेिी जोन के भीर्र नई और धवद्यमयन आरय धमलों कय धवस् र्यर अनुज्ञयर् नहीं होगय ।
3. प्रिरू्ण(जल र्य वयर्ु र्य मृिय र्य ध् वधन) कयररर् करने वयले उद्योगों की स् थयपनय । पयररधस्थधर्क संवेिी जोन में प्रिरू्ण फैलयने वयले उद्योगों के धवस्र्यर की अनुमधर् िी जयएगी। पयररधस्थधर्क संवेिी जोन के कें रीर् प्रिरू्ण धनर्ंत्रण बोिा द्वयरय जयरी दिियधनिदेशिों में फरवरी, 2016 के भीर्र धसफा गैर- प्रिधूर्र् उद्योगों की स्थयपनय के वगीकरण की अनुमधर् िी जयएगी, जब र्क दक इस अधिसूचनय में धवधनर्िाष्ट न हो।
4. जलयवन लकड़ी कय वयधणधज्र्क उपर्ोग । लयगू धवधिर्ों के अनुसयर प्रधर्धर्द्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
5. नई बृहर् जल धवद्युर् पररर्ोजनय और लसंचयई पररर्ोजनय की स्थयपनय । लयगू धवधिर्ों के अनुसयर प्रधर्धर्द्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
6. दकसी पररसंकटमर् पियथों कय उपर्ोग र्य उत्पयिन र्य प्रसंस्करण । लयगू धवधिर्ों के अनुसयर प्रधर्धर्द्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
7. प्रयकृधर्क जल धनकयर्ों र्य भूधम क्षेत्र में अनुपचयररर् बधहस्त्रयवों कय धनस्सयरण । लयगू धवधिर्ों के अनुसयर प्रधर्धर्द्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
8. पर्ाटन से संबंधिर् दरर्यकलयप जैसे गमा वयर्ुर्यन गमावयर्ु गुबयरों आदि द्वयरय रयष्ट्रीर् पयका क्षेत्र के ऊपर से उड़नय जैसे दरर्यकलयप करनय। लयगू धवधिर्ों के अनुसयर प्रधर्धर्द्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
9. ईंट भट्टों की स्थयपनय करनय। लयगू धवधिर्ों के अनुसयर प्रधर्धर्द्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
10. फमों, कॉपोरेट, कंपधनर्ों द्वयरय बडे़ पैमयने पर वयधणधज्र्क पिुिन संपिय और कुक्कुट फयमों की स्थयपनय । स्थयनीर् जरूरर्ों को पूरय करने के धसवयए लयगू धवधिर्ों के अनुसयर प्रधर्धर्द्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे।
11. ठोस अपधिष्ट धनपटयन स्थल की स्थयपनय और ठोस और सयमयन्र् जैव धचदकत्सय अपधिष्ट के धलए सयमयन्र् भधष्मकरण सुधविय के धलए ठोस और जैव धचदकत्सय अपधिष्ट। पयररधस्थधर्क संवेिी जोन में ठोस अपधिष्ट धनपटयन की कोई नई ठोस अपधिष्ट स्थल और अपधिष्ट उपचयर/प्रसंस्करण सुधविय की अनुमधर् नहीं ह ै । इसके अधर्ररि औद्योधगक प्रदरर्य और स्वयस्थ्र् स्थयपन/अस्पर्यलों आदि से उत्पि दकसी भी प्रकयर के ठोस अपधिष्ट के उपचयर के धलए सयमयन्र् र्य व्यधिगर् भधष्मकरण की सुधविय कय प्रधर्धर्द्ध ह ै। ख. धवधनर्धमर् दरर्यकलयप
12. नए कयष् ठ आियररर् उद्योग। पयररधस् थधर्क संवेिी जोन के भीर्र नए कयष् ठ आियररर् उद्योग की स् थयपनय अनुज्ञयर् नहीं होगी :
परंर्ु पयररधस्थधर्क संवेिी जोन में 100% आर्यधर्र् कयष् ठ स् टयक उपभोग करने वयले नए कयष् ठ आियररर् उद्योग की स् थयपनय की जय सकेगी ।
13. होटलों और ररसोटों की स्थयपनय । पयररधस्थधर्क पर्ाटन दरर्यकलयपों संबंिी पर्ाटकों की लघु अस्थयर्ी संरचनयओं के धलए संरधक्षर् क्षेत्र की सीमय स े एक दकलोमीटर र्क र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क, इनमें जो भी धनकट ह,ै नए वयधणधज्र्क होटल और ररसोटा अनुज्ञयर् होंगे, अन्र्थय नहीं । परंर्ु, संरधक्षर् क्षेत्र की सीमय से एक दकलोमीटर से ज्र्यिय ह ै र्य एक पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क ह ै जो भी धनकट हो सभी नए पर्ाटक दरर्यकलयप र्य धवद्यमयन दरर्यकलयप कय धवस्र्यर पर्ाटन महयर्ोजनय और र्थय लयगू मयगाििी धसद्धयंर्ों के अनुरूप होगय।
14. संधनमयाण दरर्यकलयप । संरधक्षर् क्षेत्र र्य पयररधस्थधर्क सवंेिी जोन जो भी धनकट हो, की सीमय स े एक दकलोमीटर के भीर्र दकसी भी प्रकयर कय वयधणधज्र्क संधनमयाण अनुज्ञयर् नहीं दकर्य जयएगय:
II (ii) 7 परंर्ु स् थयनीर् धनवयधसर्ों की आवयसीर् आवश्र्कर्यओं की पूर्र्ा के धलए पैरय 6 के उप पैरय (1) में सूचीबद्ध दरर्यकलयपों सधहर् उनके भूधम उपर्ोग के धलए उनकी भूधम में संधनमयाण करने की अनुज्ञय भवन उपधवधिर्ों के अनुसयर िी जयएगी जैसे :
(i) धवद्यमयन सड़कों को चौड़य करनय और उन्हें सुिढृ करनय र्थय नई सड़कों कय संधनमयाण;
(ii) बुधनर्यिी ढयंचों और नयगररक सुधवियओं कय संधनमयाण और नवीकरण;
(iii) कुटीर उद्योगों धजसके अंर्गार् ग्रयमीण उद्योग हैं; सुधवियजनक भण्ियर और स्थयनीर् सुख सुधवियओं जो पयररधस्थधर्क पर्ाटन धजस गृह वयस में सहयर्क हो; और
(iv) इस अधिसूचनय में सूचीबद्ध संवर्िार् दरर्यकलयप :
15. वृक्षों की कटयई । (क) रयज्र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनुमधर् के धबनय वन, सरकयरी र्य रयजस्व र्य धनजी भूधम पर र्य वनों में ककंही वृक्षों की कटयई नहीं होगी । (ख) वृक्षों की कटयई संबंधिर् कें रीर् र्य रयज्र् अधिधनर्म और उसके अिीन बनयए गए धनर्मों के उपबंि के अनुसयर धवधनर्धमर् होगी ।
16. वयधणधज्र्क जल संसयिन धजसके अंर्गार् भू- जल संचर्न भी है । (क) भूधम के अधिभोगी के वयस्र्धवक कृधर् उपर्ोग और घरेलू खपर् के धलए सर्ही और भूधमगर् जल कय धनष्कर्ाण अनुज्ञयर् होगय । (ख) औद्योधगक, वयधणधज्र्क उपर्ोग के धलए सर्ही और भूधमगर् जल कय धनष्कर्ाण धजसके अंर्गार् वह मयत्रय भी ह ैधजसकय धनष्कर्ाण दकर्य जय सकर्य हैं के धलए संबंधिर् धवधनर्यमक प्रयधिकरण पूवा धलधखर् अनुज्ञय अपेधक्षर् होगी । (ग) सर्ही र्य भूजल कय धवरर् अनुज्ञयर् नहीं होगय । (घ) दकसी स्रोर् से जल, धजसके अंर्गार् कृधर् भी है, के संिरू्ण र्य प्रिरू्ण को रोकने के धलए सभी उपयर् दकए जयएंग े।
17. धवद्युर् केबलों और िरूसंचयर टयवरों कय पररधनमयाण और केबल धबछयनय और अन्र् बुधनर्यिी ढयंचे । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । भूधमगर् केबल के धबछयए जयने को बढ़यवय दिर्य जयएगय।
18. होटलों और लॉज के धवद्यमयन पररसरों में बयि लगयनय । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
19. धवद्यमयन सड़कों को चौड़य करनय और उन्हें सुिढृ करनय र्थय नई सड़कों कय संधनमयाण । लयग ू धवधिर्ों के अनुसयर न्र्ूनीकरण की उपयर्ों के सयथ, धनर्म और धवधनर्मन और उपलब्ि दिियधनिदेशि धवधनर्धमर् होंगे।
20. रयधत्र में र्यधनक र्यर्यर्यर् कय संचलन । लयगू धवधिर्ों के अिीन वयधणधज्र्क प्रर्ोजन के धलए धवधनर्धमर् होंगे ।
21. धवििेी प्रजयधर्र्ों को लयनय । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
22. पहयड़ी ढयलों और निी र्टों कय संरक्षण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
23. प्रयकृधर्क जल धनकयर्ों र्य सर्ही क्षेत्र में उपचयररर् बधहस्रयावों अपधिष्ट जल/ कय धनस्सयरण । उपचयररर् बधहस्रयाव के पुनचारण को प्रोत्सयधहर् करने और अवमल र्य ठोस अपधिष्टों के धनपटयन के धलए धवद्यमयन धवधनर्मों कय अनुपयलन दकर्य जयएगय । अन्र्थय लयगू धवधिर्ों के अिीन उपचयररर् बधहस्रयाव के पुनचारण/प्रवयह के धनवाहन को धवधनर्धमर् दकर्य जयएगय।
24. वयधणधज् र्क सयइनबोिा और होर्िंग । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
25. वन उत्पयिों और गैर कयष् ठ वन उत्पयिों कय संग्रहण । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंगे ।
26. वयर्ु और र्यधनक प्रिरू्ण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
27. पोधलथीन बैगों कय उपर्ोग । पयररधस्थधर्क संवेिी जोन के भीर्र पॉधलथीन बैग के उपर्ोग की अनुमधर् ह।ै र्थयधप धवधनर्िाष्ट आवश्र्कर्य के आियर पर, र्ह लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
28. कृधर् प्रणयधलर्ों में आमूल पररवर्ान । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
29. अवसंरचनय धजसमें नयगररक सुख सुधवियएं भी ह।ै लयग ू धवधिर्ों के अनुसयर न्र्ूनीकरण की उपयर्ों के सयथ, धनर्म और धवधनर्मन और उपलब्ि दिियधनिदेशि धवधनर्धमर् होंगे।
30. खुले कुआ, बोर कुआ, आदि के धलए कृधर् और अन्र् उपर्ोग । धवधनर्धमर् और समुधचर् प्रयधिकयरी द्वयरय दरर्यकलयपों की सख्र्ी से मयनीटरी की जयएगी।
31. ठोस अपधिष् ट प्रबंिन। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
32. पयररधस्थधर्क पर्ाटन। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । ग. सवंर्िार् दरर्यकलयप
33. स्थयनीर् समुियर्ों द्वयरय की जय रही कृधर् और बयगवयनी प्रथयओं के सयथ पिुपयलन, पिुपयलन कृधर्, जल कृधर् और मछली पयलन । स्थयनीर् लोगों के उपर्ोग के धलए लयग ू धवधिर्ों के अिीन अिुज्ञाि होगें।र्थयधप, इनमें से कुछ दरर्यकलयपों के अत्र्धिक धवस्र्यर महयर्ोजनय के अनसुयर होनय चयधहए ।
34. प्रिरू्ण उत्पि न करने वयले लघु उद्योग । फरवरी, 2016 में केन्रीर् प्रिरू्ण धनर्ंत्रण बोिा द्वयरय जयरी उद्योगों में वगीकरण के अनुसयर गैर-प्रिरू्णकयरी उद्योग और अपररसंकट में, लघु और सेवय उद्योग, कृधर्, पुष्प कृधर्, उद्ययन कृधर् र्य पयररधस्थधर्क संवेिी जोन से ििेी सयमग्री से उत्पयिों को उत्पि करने वयले कृधर् आियररर् उद्योग सक्षम प्रयधिकयरी द्वयरय अनुज्ञयर् होंगे।
35. वर्या जल संचर्न । सदर र् रूप से बढ़यवय दिर्य जयएगय ।
36. जैधवक खेर्ी। सदर र् रूप से बढ़यवय दिर्य जयएगय ।
37. सभी गधर्धवधिर्ों के धलए हररर् प्रौद्योधगकी को ग्रहण करनय । सदर र् रूप से बढ़यवय दिर्य जयएगय ।
38. कुटीर उद्योगों धजसके अंर्गार् ग्रयमीण कयरीगर भी हैं । सदर र् रूप से बढ़यवय दिर्य जयएगय ।
39. नवीकरणीर् ऊजया स्रोर् कय उपर्ोग । बयर्ोगैस, सौर प्रकयि इत् र्यदि को बढ़यवय दिर्य जयनय ह ै।

5. मयनीटरी सधमधर्.—(1) कें रीर् सरकयर, पयररधस्थधर्क संवेिी जोन के प्रभयवी मयनीटरी के धलए एक मयनीटरी सधमधर् कय गठन करेगी जो धनम्नधलधखर् से धमलकर बनेगी, अथयार्् :— (क) नजला कलक्टर, उस्मयनयबयि —अध्यक्ष;
(ख) धजलय पररर्ि प्रनिनिनि, उस्मयनयबयि —सदस्ट्य;
(ग) पर्यावरण के क्षेत्र में कयर्ा करने वयले गैर सरकयरी संगठनों (धजसके अंर्गार् धवरयसर् संरक्षण भी ह)ै कय प्रत्र्ेक मयमले में र्ीन वर्ा की अवधि के धलए महाराष्ट्र रयज्र् सरकयर द्वयरय नयमधनर्िाष्ट एक प्रधर्धनधि —सदस्ट्य;
(घ) महाराष्ट्र सरकयर द्वयरय नयमधनर्िाष् ट प्रत्र्ेक मयमले में र्ीन वर्ा की अवधि के धलए पयररधस् थधर्क और पर्यावरण क्षेत्र कय एक धविेर्ज्ञ —सदस्ट्य;
(ि.) क्षेत्रीर् अधिकयरी, महाराष्ट्र राज्य प्रदषूण नियंत्रण बोडग —सदस्ट्य;
(च) सदस्ट्य-सनचव र्य सदस्ट्य, महाराष्ट्र रयज्र् जैव-धवधविर्य बोिा —सदस्ट्य;
II (ii) 9 (छ) वररष्ठ नगर र्ोजनय अधिकयरी —सदस्ट्य;
(ज) महाराष्ट्र सरकयर के वन और पर्यावरण धवभयग कय प्रधर्धनधि —सिस्र्;
(झ) प्रभयगीर् वन अधिकयरी, उस्मयनयबयि —सदस्ट्य-सनचव।
6. धनिदेशि धनबिंन.— (1) मयनीटरी सधमधर् कय कयर्ाकयल इस अधिसूचनय के जयरी करने की र्यरीख से र्ीन वर्ा कय होगय और मयनीटरी सधमधर् उपबंिों के अनुपयलन को मयनीटर करेगी ।
(2) पयररधस्थधर्क संवेिी जोन सधमधर् इस अधिसूचनय के उपबंिों के अनुपयलन को मयनीटर करेगी ।
(3) पयररधस्थधर्क संवेिी जोन में भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसचूनय सं. कय.आ. 1533(अ), र्यरीख 14 धसर्ंबर, 2006 की अनुसूची के अिीन सधम्मधलर् दरर्यकलयपों और इस अधिसूचनय के पैरय 4 के अिीन प्रधर्धर्द्ध गधर्धवधिर्ों के धसवयर् आन ेवयले ऐसे दरर्यकलयपों की ििय में वयस्र्धवक धवधनर्िाष्ट स्थलीर् िियओं पर आियररर् मयनीटरी सधमधर् द्वयरय संवीक्षय की जयएगी और उि अधिसूचनय के उपबंिों के अिीन पूवा पर्यावरण धनकयसी के धलए केन्रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को धनर्िाष्ट की जयएगी । उद्योगों की केवल श्वेर् श्रेधणर्ों को "उद्योगों, 2016 कय वगीकरण" के धलए सीपीसीबी द्वयरय जयरी दिियधनिदेशिों में धनर्िाष्ट के रूप में मयनय जयएगय।

(5) धनगरयनी सधमधर् कय सिस्र्-सधचव र्य संबद्ध आर्ुि र्य संरधक्षर् क्षेत्र कय प्रभयरी ऐस ेव्यधि के धवरूद्ध, जो इस अधिसूचनय के दकसी उपबंि कय उल्लंघन करर्य ह,ै पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1866 कय 28) की ियरय 19 के अिीन पररवयि फयइल करने के धलए सक्षम होगय ।

8. कोई अन् र् महत् वपूणा धवर्र् । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 31st May, 2017 S.O. 1751(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.
3227(E) dated the 1 st December, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette were made available to the public on the 1 st December, 2015;
AND WHEREAS, no comments/objections and suggestions were received from persons and stakeholders in response to the draft notification;
AND WHEREAS, the Yedshi Ramling Ghat Wildlife Sanctuary is situated in Osmanabad District of Maharashtra and extends over an area of 22.37 square kilometers;
AND WHEREAS, the Wildlife Sanctuary harbours Black Buck (Antilope cervicapra), Porcupine (Hystrix indica), Hyena (Hyaena hyaena), Wild Pig (Sus scrofa), Palm Civet (Paradoxurus hermaphrodites), Wolf (Canis lupus pallipes), Jungle Cat (Felis chaus), Fox (Vulpes bengalensis), Indian Porcupine (Hystrix indica), Rabbit, Peacock (Pavo cristatus), etc. The main attraction of the Sanctuary is large population of monkeys;
AND WHEREAS, the vegetation of area include shrub forests, plantation blocks and grasslands and the major tree species include Tamarind (Tamarindus indica), Peepal tree (Ficus religiosa), Indian Fig tree (Ficus glomerata), East Indian Ebony (Diospyros melanoxylon), Sugar apple (Anona squamosa), Neem (Azadirachta indica), Quick Stick (Glyrisidia Sepium) and Sandalwood (Santalum album);
AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Yedshi Ramling Ghat Wildlife Sanctuary as Eco-Sensitive Zone from ecological and environmental point of view class of industry and to prohibit industries or and their operations and processes in the said Eco-Sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
0.1 kilometres to 3.240 kilometres from the boundary of Yedshi Ramling Ghat Wildlife Sanctuary in the State of Maharashtra as the Yedshi Ramling Ghat Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Ecosensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.—(1) The extent of Eco-sensitive Zone varies from 0.1 kilometre to 3.240 kilometres from the boundary of the Yedshi Ramling Ghat Wildlife Sanctuary. The area of the Eco Sensitive Zone is 3.589 square kilometres.
(2) The map of Yedshi Ramling Ghat Wildlife Sanctuary demarcating the Eco-sensitive Zone boundary along with the Geo co-ordinates are appended as Annexure I.
(3) The list of ten (10) villages falling within the Eco-sensitive Zone along with their geo co-ordinates is appended as Annexure II.
2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan so prepared shall commensurate with the stipulation specified in the Notification and include the environmental implications.
(3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Irrigation;
(ix) Public Works Department; and
(x) Maharashtra State Pollution Control Board.
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas such as parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited, regulated and promoted activities specified in the Notification so as to ensure Eco-friendly development for livelihood security of local communities.
(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions with respect to the provisions given in this notification.

3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.— Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism activities;
(ii) widening and strengthening of existing roads and construction of new roads;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village artisans.
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or and restrict development activities within the catchment areas.
(3) Eco-Tourism.—(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism, Government of Maharashtra in consultation with Department of Revenue and Forests, Government of Maharashtra.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities relating to tourism shall be regulated as under, namely.—
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Yedshi Ramling Ghat Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural Heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.—The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.—Regulations for the control of air pollution in the Eco-Sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with.
(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein.
(9) Solid wastes.—Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8 th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343(E), dated the 28 th March, 2016, as amended from time to time.
(i) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone;
(ii) Individual hospitals or private health centres already existing within the Eco Sensitive Zone should provide adequate waste treatment system to avoid adverse impact on the Protected Area.
(11) Plastic Waste Management.—The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.—The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Industrial units.—
(a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Ecosensitive Zone shall be permitted.
(16) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.—All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:- TABLE Sl. (a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 04 th August, 2006 in the matter of T.N.
Godavarman Thirumulpad Vs. UOI in W.P.(C) No. 202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No. 435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
5. Establishment of new major hydroelectric projects and irrigation projects.

9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
10. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
11. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within Eco sensitive zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is Prohibited.
Regulated Activities
12. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone:
Provided that new wood-based industry may be set up in the Eco-sensitive Zone using 100 % imported wood stock.
13. Commercial Establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Ecotourism activities:
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
14. Construction activities No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the II (ii) 19 local residents such as:
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) cottage industries including village industries;
convenience stores & local amenities supporting ecotourism including home stays; and
(iv) promoted activities listed in this Notification.
15. Felling of Trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
16. Commercial water resources including ground water harvesting.
(a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land;
(b) extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority;
(c) no sale of surface water or ground water shall be permitted;
(d) steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
17. Erection of electrical and communication towers and laying of cables and other infrastructures Regulated under applicable law. Underground cabling may be promoted.
18. Fencing of existing premises of hotels and lodges.
Regulated under applicable laws.
19. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
20. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
21. Introduction of exotic species. Regulated under applicable laws.

23. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
24. Commercial Sign boards and hoardings. Regulated under applicable laws.
25. Collection of Forest produce or non- Timber Forest Produce (NTFP).
Regulated under applicable laws.
26. Air and vehicular pollution Regulated under applicable laws.
27. Use of polythene bags. Use of polythene bags are permitted within the Eco Sensitive Zone. However, based on specific requirement, it shall be regulated under applicable laws.
28. Drastic Change of Agriculture systems Regulated under applicable laws.
29. Infrastructure including civic amenities Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
30. Open Well, Bore Well etc. for agriculture or other usage Regulated and the activity should be strictly monitored by the appropriate authority.
31. Solid Waste Management. Regulated under applicable laws
32. Eco-tourism Regulated under applicable laws Promoted Activities
33. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
However, excessive expansion of some of these activities should be regulated as per, master plan.
34. Small scale non polluting industries. Non polluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, smallscale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
35. Rain water harvesting. Shall be actively promoted.
36. Organic farming. Shall be actively promoted.
37. Adoption of green technology for all activities.
Shall be actively promoted.
II (ii) 21 Prohibited Activities as specified above shall come into effect from the date of issue of Draft Notification.
5. Monitoring Committee.— (1) The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:- a) District Collector, Osmanabad - Chairman;
b) Representative of Zilla Parishad, Osmanabad – Member;
c) A representative of Non-governmental Organization working in the field of environment (including heritage conservation) to be nominated by the Government of Maharashtra for a term of three years in each case – Member;
d) One expert in the area of ecology and environment to be nominated by the Government of Maharashtra for a term of one year in each case - Member;
e) Regional Officer, Maharashtra State Pollution Control Board, - Member;
f) Member-Secretary or Member, Maharashtra State Biodiversity Board - Member;
g) Senior Town Planning Officer - Member;
h) A representative of Department of Forest and Environment, Government of Maharashtra – Member;
i) Divisional Forest Officer, Osmanabad – Member Secretary
(6) Terms of Reference: (1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of Notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment, 2006 vide S.O. 1533 (E), dated the 14th September, 2006, and Coastal Regulation Zone, 2011 vide S.O. No. 19(E) dated
38. Cottage industries including village artisans, etc.
Shall be actively promoted.
39. Use of renewable energy and fuels. Bio gas, solar light etc to be promoted
40. Agro-Forestry Shall be actively promoted.
41. Use of eco-friendly transport Shall be actively promoted.
42. Skill Development Shall be actively promoted.
43. Restoration of Degraded Land/ Forests/ Habitat Shall be actively promoted.
44. Environmental Awareness Shall be actively promoted.
22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] the 6 th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14 th September, 2006 and S.O. 19 (E) dated 6 th January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wild Life Warden of the State under intimation to this Ministry as per proforma appended at Annexure III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
