(i) पया�वरण ;
(ii) वन और वIयजीव ;
(iii) कृिष;
(iv) राजO व;
(v) शहरी िवकास;
(vi) पय�टन;
(vii) Jामीण िवकास;
(viii) fसचाई और बाढ़ िनयं�ण;
(ix) नगरपािलका;
(x) महाराo राiय 1दषूण िनयं�ण बोड�; और
(xi) लोक िनमा�ण िवभाग । (5) उk त योजना अनुमो�दत िव[मान भू-उपयोग, अवसंरचना और �pयाकलाप0 पर कोई िनबqधन अिधरोिपत नह< करेगी जब तक �क इस अिधसूचना म, िविनYदM ट न हो और उk त महायोजना म, सभी अवसंरचना और �pयाकलाप0 म, द?ता तथा पा�रिO थितक�य अनुकूलता का संवध�न करेगी । (6) उk त महायोजना म, अनाrछा�दत ?े�0 के जीण\^ार, िव[मान जल िनकाय0 के संर?ण, आवाह ?े�0 के 1बंधन, जल-संभर0 के 1बंधन, भूतल जल के 1बंधन, मृदा और नमी संर?ण, Oथानीय समदुाय0 क� आव_यकताg तथा पा�रिOथितक� और पया�वरण से संबंिधत ऐसे अIय पहलुg, िजन पर sयान दनेा आव_यक ह,ै के िलए उपबंध ह0गे । (7) उk त महायोजना सभी िव[मान पूजा O थल0, Jाम0 और नगरीय बंदोबOत0, वन0 के 1कार और �कO म0, जनजातीय ?े�, कृिष ?े�0, ऊपजाऊ भूिम, ह�रत ?े� जैसे उ[ान और उसी 1कार के O थान, उ[ान कृिष ?े�, आYकड0, झील0 और अIय जल िनकाय0 का मानिच�0 के साथ अuयकंन करेगी और योजना को मानिच�0 म, �दए गए िव[मान तथा 1Oतािवत भूिम उपयोग सुिवधाg के िववरण +ारा सम6थत �कया जाएगा। (8) उk त महायोजना पा�रिO थितक संवेदी जोन म, िवकास के पा�रिO थितक अनुकूल िवकास और O थानीय समुदाय0 क� आजीिवका को सुिनि_ चत करते Aए िविनयिमत होगी । (9) उk त महायोजना इस अिधसचूना म, �दए गए उपबंध0 के संबंध म, अपने कायv के बाहर ले जाने के िलए मानीटरी सिमित के िलए एक संदभ� दOतावेज तैयार करेगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ा�ा�ा�ारारारारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय....———— राiय सरकार अंितम अिधसूचना के उपबंध0 को 1भावी करने के िलए िनdिलिखत उपाय करेगी, अथा�त् :———— (1) भूभभूूभू----उपयोगउपयोगउपयोगउपयोग....————पा�रिOथितक संवेदी जोन म, वन0, उ[ान-कृिष ?े�0, कृिष ?े�0, आमोद-1मोद के 1योजन के िलए िचिIहत �कए गए पाकv और खुले Oथान0 का वािणिiयक और औ[ोिगक संब^ िवकास �pयाकलाप0 के िलए उपयोग या संप�रवत�न नह< होगा । मानिच� के साथ आंचिलक महायोजना म, कुछ ?े�0 को पूरी तरह प�रभािषत �कया जाएगा । परंतु पा�रिOथितक संवेदी जोन के भीतर कृिष और अIय भूिम का संप�रवत�न मानीटरी सिमित क� िसफा�रश पर और ?े�ीय नगर योजना अिधिनयम के तहत स?म 1ािधकारी के पूव� अनुमोदन के से और यथा लागू केIaीय/राiय सरकार के अIय िनयम0 और िविनयम0, जो Oथानीय िनवािसय0 क� आवासीय जTरत0 को पूरा करने के िलए और पैरा 4 क� सारणी के Oतंभ (2) के अधीन सूचीब^ �pयाकलाप0 को पूरा करने के िलए आव_यक हG, अनुUात �कया जा सकेगा, जैसे:- (i) पा�रिO थितक अनुकूल पय�टन �pयाकलाप0 के िलए पय�टक0 के अO थायी आवासन के िलए पा�रिO थितक अनुकूल आरामगाह जैसे ट,ट, लकड़ी के मकान आ�द; (ii) िव [मान सड़क0 को चौड़ा करना और सुदढ़ृ करना तथा नई सड़क0 का संिx माण�; (iii) कुटीर उ[ोग, िजसके अंतग�त Jामीण उ[ोग, सुिव धाजनक O टोर और O थानीय सुिव धाएं भी हG; (iv) वषा� जल संचय; और (v) 1दषूण उyपx न करने वाले लघु उ[ोग; परंतु यह और भी �क राiय सरकार के पूव� अनुमोदन और संिवधान के अनुr छेद 244 या तyसमय 1वृE िविध के उपबंध0 के अनुपालन के िबना, िजसके अंतग�त अनुसूिचत जनजाित और अIय परंपरागत वन िनवासी (वन अिधकार0 क� माIयता) अिधिनयम, 2006 (2007 का 2) भी है, वािणिiयक या उ[ोग िवकास �pयाकलाप0 के िलए जनजातीय भूिम का उपयोग अनुUात नह< होगा : परंतु यह और भी �क पा�रिO थितक संवेदी जोन के भीतर भू-अिभलेख0 म, पाई जाने वाली कोई �ु�ट मानीटरी सिमित के िवचार 1ाF करने के पzात ् राiय सरकार +ारा 1yयेक मामले म, एक बार संशोिधत होगी और उ/ �ु�ट के संशोधन क� भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय को सूचना दनेी होगी : परंतु यह और भी �क उपयु�/ �ु�ट के संशोधन म, इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म, भू-उपयोग का प�रवत�न सि'मिलत नह< होगा : अ1युk त या अनyु पादक कृिष ?े�0 म, पुन: वनीकरण करने के 1यास �कए जाएंग।े (2) �ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत.———— सभी 1ाकृितक जल {ोत0/न�दय0/1णाल0 क� पहचान क� जाएगी और उनके संर?ण और पुनC}भूतकरण के िलए आचंिलक महायोजना म, सि' मिलत होगी। (3) पय�टनपय�टनपय�टनपय�टन/पा/पा/पा/पा�रि�थितक पय�टन�रि�थितक पय�टन�रि�थितक पय�टन�रि�थितक पय�टन....———— (क) पा�रिOथितक संवेदी जोन के भीतर पय�टन संबंधी �pयाकलाप पय�टन महायोजना के अनुसार ह0गे जो �क आंचिलक महायोजना के भाग Tप म, होगी । (ख) पय�टन महायोजना पय�टन िवभाग, +ारा पया�वरण और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के Tप म, जाना जायेगा । (घ) पय�टन संबंधी �pयाकलाप िन' निलिखत के अधीन िविनयिमत ह0गे, अथा�त् :- (i) पा�रिOथितक अनुकूल पय�टन �pयाकलाप से संबंिधत पय�टक0 के अOथायी अिधभोग के िलए वास सुिवधा के िसवाय संरि?त ?े� क� सीमा से एक �कलोमीटर तक या पा�रिOथितक संवेदी जोन के िवOतार तक इनम, जो भी िनकट ह,ै नये वािणिiयक होटल और �रसोट� अनुUात नह< ह0गे। तथािप, जहाँ पा�रिOथितक संवेदी जोन का िवOतार एक �कलोमीटर से iयादा ह ै वहाँ, एक �कलोमीटर से परे और पा�रिOथितक संवेदी जोन के िवOतार तक सभी नए पय�टक �pयाकलाप या िव[मान �pयाकलाप का िवOतार पय�टन महायोजना के अनुसार होगा; (ii) पा�रिOथितक संवेदी जोन के भीतर सभी नए पय�टन �pयाकलाप0 या िव[मान पय�टन �pयाकलाप0 का िवOतार क, aीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय के माग�दश�क िस^ांत0 के +ारा तथा राM Nीय � या� संर?ण 1ािधकरण, +ारा जारी पा�रिOथितक पय�टन (समय-समय पर यथा संशोिधत) माग�दश�क िस^ांत0 के अनुसार, पा�रिOथितक पय�टन, पा�रिOथितक िश?ा और पा�रिOथितक िवकास को महyव दतेे Aए पा�रिOथितक संवेदी जोन क� वहन ?मता के अsययन पर आधा�रत होगा;

(iii) आंचिलक महायोजना का अनुमोदन �कए जान ेतक, पय�टन के िलए िवकास और िव[मान पय�टन �pयाकलाप0 के िवOतार को वाOतिवक Oथल िविनYद7 संवी?ा तथा मानीटरी सिमित क� िसफा�रश पर आधा�रत संबंिधत िविनयामक 1ािधकरण0 +ारा अनुUात �कया होगा । (4) नसै"गकनसै"गकनसै"गकनसै"गक िवरासतिवरासतिवरासतिवरासत....———— पा�रिOथितक संवेदी जोन म, महyवपूण� नैस6गक िवरासत के सभी Oथल0 जैसे सभी जीन कोश आरि?त ?े�, शैल िवरचनाएं, जल 1पात0, झरन0, घाटी मागv, उपवन0, गुफाएं, Oथल0, �मण, अ�रोहण, 1पात0 आ�द क� पहचान क� जाएगी और उIह, संरि?त �कया जाएगा तथा उनक� सरु?ा और संर?ा के िलए ऐसी योजना आंचिलक महायोजना का भाग होगी । (5) मानव िन"मत िवरासत � थमानव िन"मत िवरासत � थमानव िन"मत िवरासत � थमानव िन"मत िवरासत � थलललल....---- पा�रिO थितक संवेदी जोन म, भवन0, संरचनाg, िश�प-त�य, ऐितहािसक, कलाyमक और सांOकृितक महyव के ?े�0 क� पहचान करनी होगी और उनके संर?ण क� योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म, सि'मिलत क� जाएगी । (6) $ व$ व$ व$ विन �दषूणिन �दषूणिन �दषूणिन �दषूण.———— पया�वरण (संर?ण) अिधिनयम 1986 के अधीन sविन 1दषूण (िविनयमन और िनयं�ण) िनयम, 2000 म, िनयत उपबंध0 के अनुसार म, पा�रिOथितक संवेदी जोन म, sविन 1दषूण के िनयं�ण के िलए िविनयम0 को काया�िIवत करेगा । (7) वायुवायुवायुवायु �दषूण�दषूण�दषूण�दषूण.———— पा�रिOथितक संवेदी जोन म,, राiय सरकार के पया�वरण िवभाग वायु (1दषूण िनवारण एवं िनयं�ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के उपबंध0 के अनुसार वायु 1दषूण के िनयं�ण के िलए मानक और िविनयम काया�िIवत करेगा । (8) बिह�ावबिह�ावबिह�ावबिह�ाव काकाकाका िन�सारणिन�सारणिन�सारणिन�सारण.———— पा�रिOथितक संवेदी जोन म, उपचा�रत बिह{ाव का िनOसारण पया�वरणीय (संर?ण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयम0 के अIतग�त आने वाले पया�वरणीय 1दषूण के िनOसारण संबंधी साधारण मानक0 के उपबंध0 के अनुसार होगा तथा पया�वरण क� सरं?ण के िलए मानक ओर अिधक कठोर बनाये जा सकते हG। (9) ठोसठोसठोसठोस अपिश, अपिश, अपिश, अपिश, ....---- ठोस अपिश70 का िनपटान और 1बंधन िनdिलिखत Tप म, होगा: ———— (क) पा�रिOथितक संवेदी जोन म, ठोस अपिश7 िनपटान और 1बंधन, समय-समय पर संशोिधत ठोस अपिशM ट 1बंधन िनयम, 2016, जो भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय क� अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अ1ैल, 2016 +ारा 1कािशत �कए गए थे, के अनुसार �कया जाएगा ; (ख) अकाब�िनक सामJी का िनपटान पा�रिOथितक संवेदी जोन के बाहर पहचान �कए गए O थल पर �कसी पया�वरणीय Oवीकृत रीित म, होगा; (ग) पा�रिOथितक संवेदी जोन म, ठोस अपिशM ट0 को जलाना या भM मीकरण और भूिम भराव के Oथापन0 को अनुUात नह< �कया जाएगा । (10) जैव िच�क. सीजैव िच�क. सीजैव िच�क. सीजैव िच�क. सीय अपिश0 टय अपिश0 टय अपिश0 टय अपिश0 ट.———— जैव िच�कy सीय अपिशM ट 1बंधन िनdिलिखत Tप म, होगा— (क) पा�रिOथितक संवेदी जोन म, जैव िच�कyसीय अपिश70 का िनपटान भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय क� समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन 343 (अ), तारीख 28 माच�, 2016 +ारा 1कािशत जैव िच�कyसीय अपिश7 1बंध िनयम, 2016 के उपबंध0 के अनुसार �कया जाएगा । (ख) पा�रिOथितक संवेदी जोन म, कोई सामाIय उपचार सुिवधा या जलाया जाना अनुUात नह< �कया जाएगा । (11) 1लाि�टक1लाि�टक1लाि�टक1लाि�टक अपिश,अपिश,अपिश,अपिश, �बंधन�बंधन�बंधन�बंधन....———— पा�रिOथितक संवेदी जोन म, �लािOटक अपिश7 1बंध का िनपटान भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय क� समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन. 340(अ), तारीख 18 माच�, 2016 +ारा 1कािशत �लािOटक अपिश7 1बंध िनयम 2016 के उपबंध0 के अनुसार �कया जाएगा। (12) िनमा�णिनमा�णिनमा�णिनमा�ण औरऔरऔरऔर िव$वसंिव$वसंिव$वसंिव$वसं अपिश,अपिश,अपिश,अपिश, �बधंन�बधंन�बधंन�बधंन....———— पा�रिOथितक संवेदी जोन म, संिनमा�ण और िवsवंस अपिश7 1बंध का िनपटान भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय क� समय-समय पर यथासंशोिधत अिधसचूना सं.का.िन 317(अ), तारीख 29 माच�, 2016 +ारा 1कािशत संिनमा�ण और िवsवंस 1बंध िनयम, 2016 के उपबंध0 के अनुसार �कया जाएगा । (13) इले56ोिनकइले56ोिनकइले56ोिनकइले56ोिनक––––अपिश,अपिश,अपिश,अपिश,....———— पा�रिOथितक संवेदी जोन म, ई–अपिश7 1बंध का िनपटान भारत सरकार के पया�वरण, वन और जलवाय ुप�रवत�न मं�ालय क� समय-समय पर यथासंशोिधत +ारा 1कािशत ई–अपिश7 1बंध िनयम, 2016 के उपबंध0 के अनुसार �कया जाएगा। (14) यानीययानीययानीययानीय प�रवहनप�रवहनप�रवहनप�रवहन....———— प�रवहन क� यानीय गितिविधया ंआवास के अनुकूल िविनयिमत ह0गी और इस संबंध म, आंचिलक महायोजना म, िवशेष उपबंध अिधकिथत �कए जाएंगे और आंचिलक महायोजना के तैयार होने और राiय सरकार के स?म 1ािधकारी +ारा के अनुमो�दत होने तक, मानीटरी सिमित 1वृE िनयम0 और िविनयम0 के अनुसार यानीय गितिविधय0 के अनुपालन को मानीटर करेगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5

AND WHEREAS, copies of the Gazette were made available to the public on the 5 th November, 2015;
AND WHEREAS, no objections and suggestions were received from any person in response to the draft notification;
AND WHEREAS the Gangewadi New Great Indian Bustard Wild Life Sanctuary is situated in Solapur and Osmanabad Districts of Maharashtra and is spread over an area of 1.98 square kilometer The Sanctuary is known for its wild life specially the Great Indian Bustard and Black buck apart from some other mammalian species like fox, jackal and wolf.
AND WHEREAS, certain reptiles, amphibians, butterflies, spiders and invertebrates inhabit this wild life sanctuary;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Gangewadi New Great India Bustard Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the powers conferred by sub section (1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent from 40 metres to 675 metres around the boundary of Gangewadi New Great India Bustard Wildlife Sanctuary in Maharashtra as the Gangewadi New Great India Bustard Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:—
1. Extent and Boundaries of Eco-sensitive Zone.— (1) The Eco-Sensitive Zone is spread over an area of 7.14 square kilometer with an extent from 40 metres to 675 metres around the boundary of Gangewadi New Great India Bustard Wildlife Sanctuary.
(2) The map of the Sanctuary along with the Eco-sensitive Zone showing salient features along the boundary is appended as Annexure-I. The list of Geo Co-ordinates of the sanctuary and the Eco Sensitive Zone is annexed as Annexure-I (A).
(3) The boundary description of the Eco Sensitive Zone is given in Annexure-II.
(4) The list of four villages namely Gangewadi falling in Solapur district and Dhotri, Devkurli and Pimpla Bk., in Osmanabad district within the Eco-sensitive Zone along with geo co-ordinates is appended as Annexure-III.

2. Zonal Master Plan for Eco-Sensitive Zone.— 1. The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for consideration and approval of the Competent Authority in the State Government.
2. The said Plan shall be approved by the Competent Authority in the State Government.
3. The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
4. The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Maharashtra State Pollution Control Board; and
(xi) Public Works Department.
(5) The said Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The said Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The said Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(8) The said Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities.
(9) The said Plan shall be a reference document for the Monitoring Committee for carrying out its functions of monitoring vide the provisions of this notification.
3. Measures to be taken by State Government.— The State Government shall take the following measures for giving effect to the provisions of the final notification, namely:— 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(1) Land use.— Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or industrial activities. Such areas shall be clearly defined in the Zonal Master Plan along with maps;
Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable, to meet the residential needs of the local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:—
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities;
(ii) Widening and strengthening of existing roads and construction of new roads;
(iii) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay;
(iv) Rain water harvesting, and
(v) Small scale industries not causing pollution;
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.—The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/Eco-Tourism.—(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:—
(i) No new construction of hotels and resorts shall be allowed within 1 kilometre from the boundary of the Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone (beyond 1 kilometre) shall be in accordance with the guidelines issued by the Central Government in the Ministry of ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.
(4) Natural Heritage.— All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man- made Heritage Sites.— Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise Pollution.— Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.
(7) Air Pollution.— Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto.
(8) Discharge of Effluents.— Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid Wastes.— Disposal and Management of solid wastes shall be as under:—
(a) The solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357(E), dated 8th April, 2016 as amended from time to time;
(b) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(c) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Ecosensitive Zone.
(10) Bio Medical Wastes.— Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number G.S.R. 343(E), dated the 28th March, 2016 as amended from time to time.
(b) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Plastic Waste Management.— The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.

(12) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) Electronic Waste.— The Electronic Waste (E-Waste) Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular Traffic.— The vehicular traffic movement shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution.— Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial Units.— (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.— All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:— TABLE Sl. (a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
4. Setting up of industries causing water or air or soil or noise pollution.
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17 polluting cottage industries shall be promoted.
5. Establishment of major thermal and hydro-electric projects.
Prohibited (except as otherwise provided) as per applicable laws.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
7. Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons.
Prohibited (except as otherwise provided) as per applicable laws.
8. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
9. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within Eco sensitive zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is Prohibited.
10. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
11. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
12. Use of plastic bags. Prohibited (except as otherwise provided) as per applicable laws.
Regulated Activities
13. Commercial Establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Ecotourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
14. Introduction of exotic species. Regulated under applicable laws.
15. Construction activities.
No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
(a) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Cottage industries including village industries;
convenience stores & local amenities supporting ecotourism including home stays; and
(iv) Promoted activities listed in this Notification.
16. Trenching ground. Establishing of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws.
17. Vehicular emissions. Regulated under applicable laws.
18. Noise pollution. Regulated under applicable laws.
19. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
20. Discharge of treated effluents and solid waste in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
21. Insulation of electric lines, erection of electrical and communication towers and laying of cables and other infrastructures.
Promote underground cabling. All existing electric lines passing through the Eco-sensitive Zone shall be adequately insulated in the time frame prescribed under the Zonal Master Plan.
22. Widening and strengthening of existing roads.
Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
23. Fencing of existing premises of hotels and lodges.
Regulated under applicable laws.
24. Sign Boards and Hoardings. Regulated under applicable laws.
25. Movement of Vehicular Traffic at night. Regulated for commercial vehicles as per the Zonal Master Plan and the applicable laws.
26. Drastic Change of Agriculture systems or land use pattern.
Regulated under applicable laws.
27. Commercial use of water resources including ground water.
(a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.
(b) Extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority.
(c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
28. Small scale non polluting industries. Non polluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, smallscale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
29. Solid Waste Management. Regulated under applicable laws.
30. Eco-tourism. Regulated under applicable laws Promoted Activities
31. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
32. Organic farming. Shall be actively promoted.
33. Adoption of green technology for all activities.
Shall be actively promoted.
34. Cottage industries including village artisans.
Shall be actively promoted.
35. Rain water harvesting. Shall be actively promoted.
36. Use of renewable energy and clean fuels. Bio gas, solar light, CNG, LPG etc. to be actively promoted.
37. Agro-Forestry. Shall be actively promoted.
38. Skill Development. Shall be actively promoted.
39. Restoration of Degraded Land/ Forests/ Habitat.
Shall be actively promoted.
40. Environmental Awareness. Shall be actively promoted.

5. Monitoring Committee.- The Central Government hereby constitutes a committee to be called the Monitoring Committee, to monitor the compliance with the provisions of this notification, which shall comprise of the following namely:—
(1) District Collector, Osmanabad. Chairman;
(2) Representative of District Collector, Solapur. Member;
(3) A representative of Zilla Parishad, Osmanabad. Member;
(4) A representative of Zilla Parishad, Solapur. Member;
(5) One representative of Non-Governmental Organisation (working in the field of environment and heritage conservation) to be nominated by the State Government for a period of one year.
Member;
(6) One expert in the area of ecology and environment to be nominated by the State Government for a period of one year.
Member;
(7) Regional Officer, Maharashtra State Pollution Control Board, Osmanabad.
Member;
(8) Town Planning Officer, Osmanabad. Member;
(9) Town Planning Officer, Solapur. Member;
(10) Member of State Biodiversity Board. Member;
(11) Representative of Conservator of Forest, Solapur Forest Division.
Member; and
12. Divisional Forest Officer, Osamabad. Member-Secretary .
6. Terms of Reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of Notification
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-IV.
(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
