PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 1605] ubZ fnYyh] cq/okj] twu 7] 2017@᭔ ये᭔ ये᭔ ये᭔ ये᭬ ठ᭬ ठ᭬ ठ᭬ ठ 17] 1939 No. 1605] NEW DELHI, WEDNESDAY, JUNE 7, 2017/JYAISTHA 17, 1939 पयाᭅवरणपयाᭅवरणपयाᭅवरणपयाᭅवरण, , , , वनवनवनवन औरऔरऔरऔर जलवाय ुपᳯरवतᭅन मंᮢ ालयजलवाय ुपᳯरवतᭅन मंᮢ ालयजलवाय ुपᳯरवतᭅन मंᮢ ालयजलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूनाअिधसचूनाअिधसचूनाअिधसचूना नई ᳰद᭨ली, 7 जून, 2017 का.आ.का.आ.का.आ.का.आ. 1812181218121812((((अअअअ))))....————ᮧाᱧप अिधसूचना भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 3341, तारीख 7 ᳰदस᭥बर, 2015 ᳇ारा भारत के राजपᮢ असाधारण मᱶ ᮧकािशत कᳱ गई थी िजसमᱶ उन सभी ᳞िᲦयᲂ से, िजनको उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उᲦ अिधसूचना कᳱ राजपᮢ कᳱ ᮧितयां जनता को उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर, आᭃपे और सुझाव आमंिᮢत ᳰकए गए थ;े और, उᲦ ᮧाᱧप अिधसूचना के ᮧ᭜युᱫर मᱶ ᳞िᲦयᲂ और पणधाᳯरयᲂ से कोई टीका ᳯट᭡पिणयां/आᭃेप और सुᭃाव ᮧा᳙ नहᱭ ᱟए थ;े और, नालसरोवर पᭃी अभयार᭛य गुजरात के अहमदाबाद और सुरे᭠ ᮤ नगर िजल े मᱶ ि᭭ थत ह ै और 120.82 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ फैला ᱟआ ह;ै और, यह अभयार᭛य देश के सबसे बड़े ᮧाकृितक नमभूिमयᲂ मᱶ से एक ह,ै िजसका िव᭭तार वषाᭅ पर िनभᭅर करता है और िजसकᳱ अिधकतम गहराई बाढ़ के समय लगभग 1.5.—2.0 मीटर होती ह;ै और, इस अभयार᭛य मᱶ पानी मुयत: अथाᭅत् दो नᳰदयᲂ ᮩािᳬिण और भोगावᲂ से ᮧा᳙ होता ह ैऔर साथ ही इसमᱶ पानी 3000 वगᭅ ᳰकलोमीटर मᱶ फैल ेआवाह ᭃेᮢ से भी आता ह ैिजसमᱶ गांधीनगर िजले का कालोल तालुका, मेहसाणा िजल ेका कादी तालुका और अहमदाबाद िजले का सआंनद, वᱭरमगम और बवला तालुका और सुरे᭠ᮤनगर िजल ेका लाखतर एवं िलमडी तालुका शािमल ह;ै और, नालसरोवर अभयार᭛य मᱶ िविवध ᮧकार के पयाᭅवास ह ᱹअथाᭅत ्खुले जल ᭃेᮢ, दलदल, नरकट-तल और ᳇ीप समूह.—इस अभयार᭛य मᱶ 300 से भी अिधक ᳇ीप ह ᱹजो पानी के ᭭तर के नीचे जाने पर ᳰदखाई पड़त ेह◌ंै; 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, नालसरोवर अभयारणय् मᱶ िविवध ᮧकार के पयाᭅवास होने के कारण यहां पिᭃयᲂ कᳱ 226 ᮧजाितयां, मछली कᳱ 20 ᮧजाितयां और ᭭तनधाᳯरयᲂ कᳱ 13 ᮧजाितयां जैसे पिᭃयᲂ तथा ᭭तनधाᳯरयᲂ सारस ᮓेन, इंिडयन ि᭭कमर, एिशयाइ जंगली गध ेऔर भेिडये कᳱ वैि᳡क ᱨप से संकटᮕ᭭त ᮧजाितयᲂ सिहत िव᳒मान ह;ै और, इस अभयार᭛य मᱶ शैवाल कᳱ लगभग 50 ᮧजाितयां तथा फूलदार पौधᲂ के 72 से भी अिधक ᮧकारᲂ सिहत ᮧचुर संया मᱶ जलीय वन᭭पित िव᳒मान ह;ै और, नालसरोवर पᭃी अभयार᭛य के आसपास पाए जान ेवाले वन᭭पित मᱶ िपली ितलवन, िपली तनवानी (लेम िव᭭कोस), अिछल अिजओपॉस भूᳯरᮧस (तामरीस डाइआइका), जलगंबावो गधंारो ओखड़ (बᳶगया ओडोरटा), बोरचुच कागागीसोदा (कोटᭅरस ओिलटोᳯरयस), चुनच ᭓ढारी (कोटᭅरस ए᭭तुआन), बेथु गोखᱨ िमथुन गोखᱨ अकैती (ᮝायिबलस टेरेि᭭ᮝस), लागो से᭧वᲃव (एलीिसआपᭅस रगोसस), जवािशयो (अलहागी सरंडलहगी), पैरागोडोडी (एिशनोमेने इंिडका), अ᭣दामेथी रानीमेित (ᮓोटोलᳯरया मेिडकािगिन), फाᲷाकᳱ भोनीगल (इंिडगोफेरा एननेफ़ा᭨ला), सेवरी, जयंती (सेसबािनया एयजी᭡पᳯटका), गंधो बोवाल (ᮧोसोिपस िलिल᭢लोरा), चीजोडो (ᮧोसोिपस िसनेᳯरया), अंगगुती, जलािगयो (अ᭥मािनया बासीफेरा), पनलावंग (लुडिविगया पेरेननीस), सतोडो (ᮝांथाहमेा पोटुᭅलाका᭭ᮝम), भांᮕो (एि᭨ल᭢ट अ᭨बा), ममेजेवो (एिनको᭭टेमा िलटोरेल) ह;ᱹ और, अभयार᭛य मᱶ मुय ᮧाणी जैसे काला िहरण (एिनलेटोप सᳶवकापरा), ᭣लूबुल (बोसेलफस ᮝागोकैमेलस), िसयार (कैिनस ऑᳯरयस), भारतीय जंगली गधे (एसस हीिमयोनस खूर), जंगली िब᭨ली (फेिलस चॉउस), पांच धारीदार िगलहरी (फ़ानमबुलस पᱶनैनी) सामा᭠य नेवला (हपᱷि᭭टस एडवसᱮ), ᱧफस टेल खरगोश (लपेिसिनगᳯरकोिलस ᱨᳰफकायुडाटस), डेजटᭅ गेरिबल (मेᳯरयनस ᮳ᳰककाई), भारतीय बनलैा सूअर (᭭स ᭭ᮓोफा), ᮕ े क᭭तरूी (सनकस मरीनस), भारतीय गेरिबल (टेटेरा इंिडका), भारतीय लोमड़ी (वु᭨᭡स बᱶगलᱶिसस ) आᳰद ह;ै और, इस अभयार᭛य मᱶ ᮕी᭣स, पेिलकन, बतख एवं कलहसं, रेल, कूट ᮓेक, जकाना, जलकौवा, बगुला, एᮕेट िबटनᭅ, ᭭टॉक, बुᲯा, ᭭पूनिबल, ᭢लेᳲमगᲂ, ᮓेन, वाडर, शोरबडᭅ, गल, टनᭅ, ᳴कगᳰफशर, वैगटेल, िपिपट, गᱨड, हᳯैरयर जैसी ᮧवासी और ᭭थानीय पᭃी ᮧजाितयᲂ सिहत अनेक जल पिᭃयᲂ का संभरण होता ह;ै और, अपन े बड़े आकार और उ᭨लेखनीय ᮧजाित ᮧचुरता के साथ साथ जलीय पिᭃयᲂ कᳱ बᱟतायत के कारण नालसरोवर पᭃी अभयार᭛य को रामसर क᭠वᱶशन के अतगᭅत अ᭠तराᭅरा᳦ीय मह᭜व कᳱ नमभूिम के ᱨप मᱶ मा᭠यता देकर इसे रामसर ᭭थल के ᱨप मᱶ अिभिहत ᳰकया गया ह;ै और, पाᳯरि᭭थितक और पयाᭅवरणीय दिृ᭬ ट से पाᳯरि᭭ थितक संवेदी जोन के ᱨप मᱶ नालसरोवर पᭃी अभयार᭛य के संरिᭃत ᭃेᮢ, िजसका िव᭭ तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᭬ ट ह,ᱹ को संरिᭃत और सुरिᭃत करना आव᭫ यक ह ैतथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ के ᮧचालन या ᮧसं᭭करण या उ᳒ोगᲂ के वगᲄ का ᮧचालन और ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह ै; अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, गुजरात मᱶ नालसरोवर पᭃी अभयार᭛य कᳱ सीमा 2.35 ᳰकलोमीटर से 13 ᳰकलोमीटर तक के िव᭭ ताᳯरत ᭃेᮢ को नालसरोवर पᭃी अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका ᭣यौरा िन᳜ानुसार ह,ै अथाᭅत ्:—
1. पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन काकाकाका िव᭭तारिव᭭तारिव᭭तारिव᭭तार औरऔरऔरऔर उसकᳱउसकᳱउसकᳱउसकᳱ सीमाएंसीमाएंसीमाएंसीमाएं....————(1) पाᳯरि᭭ थितक संवेदी जोन अहमदाबाद और सुरे᭠ ᮤ नगर िजलᲂ मᱶ ि᭭ थत ह ै।
(2) अभयार᭛य कᳱ सीमा से पाᳯरि᭭ थितक संवेदी जोन का िव᭭ तार 2.35 ᳰकलोमीटर से 4.84 ᳰकलोमीटर तक ह ै। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(3) नालसरोवर पᭃी अभयार᭛य के पाᳯरि᭭ थितक संवेदी जोन कᳱ सीमा का िववरण उपाबधंउपाबधंउपाबधंउपाबधं----IIII के ᱨप मᱶ उपाब ह ै।
(4) पाᳯरि᭭ थितक संवेदी जोन के साथ नालसरोवर पᭃी अभयार᭛य का मानिचᮢ उपाबधंउपाबधंउपाबधंउपाबधं----IIIIIIII के ᱨप मᱶ उपाब ह ै और अभयार᭛य और पाᳯरि᭭ थितक संवेदी जोन के भू-िनदᱷशांक उपाबधंउपाबधंउपाबधंउपाबधं----IIIIIIIIIIII के ᱨप मᱶ उपाब ह ै।
(4) पाᳯरि᭭ थितक संवेदी जोन के अंतगᭅत आने वाल ेᮕामᲂ कᳱ सूची उपाबधंउपाबधंउपाबधंउपाबधं----IIIIVVVV के ᱨप मᱶ उपाब ह ै।
2222.... पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महायोजनामहायोजनामहायोजनामहायोजना.————((((1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ ᳰदए गए अनुबंधᲂ का पालन करके आंचिलक महायोजना तैयार करेगी।
(2) आंचिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) पाᳯरि᭭ थितक संवेदी जोन के िलए आंचिलक महायोजना, रा᭔ य सरकार ᳇ारा इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित मᱶ तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के अनुᱧप भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना, उᲦ योजना मᱶ पयाᭅवरणीय और पाᳯरि᭭ थितक बातᲂ को समाकिलत करने के िलए रा᭔ य के िन᳜िलिखत िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत:्—
(i) पयाᭅवरण;
(ii) वन और व᭠यजीव;
(iii) कृिष ;
(iv) राज᭭ व;
(v) नगर िवकास;
(vi) पयᭅटन;
(vii) ᮕामीण िवकास;
(viii) ᳲसचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका;
(x) पंचायती राज; और
(xi) लोक िन माᭅण िव भाग।
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ जो अिधक दᭃता और पाᳯरि᭭थितक अनुकूल हᲂ, का संवधᭅन करेगी ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलᲐु, िजन पर ᭟यान देना आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(8) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगी िजसके पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ आजीिवका सुरᭃा को सुिनि᭫ चत ᳰकया जा सके ।
(9) आंचिलक महायोजना इस अिधसूचना मᱶ ᳰदए गए उपबंधᲂ के अनुसार मᱶ अपन ेकृ᭜यᲂ का पालन करने के िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
3. रा᭔यरा᭔यरा᭔यरा᭔य सरकारसरकारसरकारसरकार ᳇ा᳇ा᳇ा᳇ारारारारा ᳰकएᳰकएᳰकएᳰकए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय----....————रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन े के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :—
(1) भूभभूूभू----उपयोगउपयोगउपयोगउपयोग....————पाᳯरि᭭थितक संवेदी जोन मᱶ आमोद-ᮧमोद के ᮧयोजनो के िलए वनᲂ, उ᳒ान कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, पाकᲄ और मनोरंजना᭜मक ᮧयोजनᲂ के िलए अिभिनि᳟त खुल े᭭थानᲂ को मुय वािणि᭔यक या मुय आवासीय पᳯरसर या औ᳒ोिगक ᳰᮓयाकलापᲂ के िलए उपयोग नहᱭ ᳰकया जाएगा या उनके िनए ᭃेᮢᲂ मᱶ संपᳯरवᳶतत नहᱭ ᳰकया जाएगा। परंत ुपाᳯरि᭭थितक संवेदी जोन के भीतर भाग (क) मᱶ िविन᳸द᳥ ᮧयोजन से िभ᳖, ᮧयोजन के िलए कृिष और अ᭠य भूिम का संपᳯरवतᭅन िनगरानी सिमित कᳱ िसफाᳯरश पर और सुसंगत रा᭔य िविध के अधीन सᭃम ᮧािधकारी के पूवᭅ अनुमोदन से अनु᭄ात ᳰकया जा सकेगा और यथा लागू के᭠ᮤीय सरकार/रा᭔य सरकार के अ᭠य िनयम जैसे िविनयम तथा ᭭थानीय आव᭫यकताᲐ को परूा करन ेके िलए इस अिधसूचना के उपबंधᲂ के ᳇ारा िन᳜िलिखत ᳰकया जा सकेगा जैसे:-
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;
(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजनके अंतगᭅत ᮕामीण कारीगर भी ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुिवधाᲐ सहायक पाᳯरि᭭थितक पयᭅटन मᱶ सि᭥मिलत गृह वास; और
(iv) संवᳶधत ᳰᮓयाकलाप और परैा 7 के अधीन ᳰदया गया ह:ै परंत ुयह और भी ᳰक सुसंगत रा᭔य िविधयᲂ और रा᭔य सरकार अ᭠य िनयमᲂ और िविनयमᲂ के अंतगᭅत रा᭔य सरकार के पूवᭅ अनुमोदन तथा संिवधान के अनु᭒छेद 244 और त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा: परंत ुयह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात ्रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को देनी होगी । परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट के संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । (ख) वनीकरण तथा वास जीणᲃार ᳰᮓयाकलापᲂ सिहत अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन े के ᮧयास ᳰकए जाएंग े।
(2) ᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोत.—आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ के ᭃेᮢᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजनाएं सि᭥ मिलत हो और रा᭔ य सरकार ᳇ारा आवाह ᮧबंध योजना ऐसी रीित मᱶ तैयार कᳱ जाएगी िजससे ᭃेᮢᲂ के भीतर िवकास ᳰᮓयाकलाप ᮧितिष ᳰकया जा सके और या िनबᲈिधत ᳰकया जा सके ।
(3) पयᭅपयᭅपयᭅपयᭅटनटनटनटन////पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक----पयᭅटनपयᭅटनपयᭅटनपयᭅटन....————(क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी । (ख) पाᳯरि᭭थितक-पयᭅटन महायोजना पयाᭅवरण और वन के रा᭔य िवभागᲂ के परामशᭅ से पयᭅटन िवभाग ᳇ारा तैयार कᳱ जाएगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ होगा । (घ) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂग,े अथाᭅत:्— ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(i) अभयार᭛य संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट ह,ै नये वािणि᭔यक होटलᲂ और ᳯरसोटᲄ अन᭄ुात नहᱭ हᲂगे। तथािप व᭠यजीव अभयार᭛य कᳱ सीमा पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक एक ᳰकलोमीटर से परे नए होटलᲂ तथा ᳯरसोटᲄ कᳱ ᭭थापना के िलए पूवᭅ अ᭤यांᳰकत और नामिन᳸द᳥ ᭃेᮢᲂ मᱶ ही अनु᭄ात ᳰकया जाएगा;
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा मागᭅदशᭅक िसांतᲂ के तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार पाᳯरि᭭थितक पयᭅटन पर बल देत ेᱟए होगा;
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा िनगरानी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगकनसैᳶगकनसैᳶगकनसैᳶगक िवरासतिवरासतिवरासतिवरासत....————पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थलललल....————पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और उनके संरᭃण कᳱ योजनाएं इस अिधसूचना के ᮧकाशन कᳱ तारीश से छह मास के भीतर तैयार कᳱ जाएगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ व᭟ व᭟ व᭟ विन ᮧदषूणिन ᮧदषूणिन ᮧदषूणिन ᮧदषूण.—पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण िनवारण और िनयंᮢण पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 के अनुसार कायाᭅि᭠वत करेगा ।
(7) वायुवायुवायुवायु ᮧदषूणᮧदषूणᮧदषूणᮧदषूण.—पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनवारण के िलए वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार अनुपा᭨य ᳰकया जाएगा ।
(8) बिह᮲ावबिह᮲ावबिह᮲ावबिह᮲ाव काकाकाका िन᭭सारणिन᭭सारणिन᭭सारणिन᭭सारण.—पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोसठोसठोसठोस अपिश᳥अपिश᳥अपिश᳥अपिश᳥....————ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकायᭅ रीित मᱶ होगा;
(iii) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭭मीकरण और भूिम भराव के ᭭थापनᲂ को अनु᭄ात नहᱭ ᳰकया जाएगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(10) जैव िचᳰक᭜ सीजैव िचᳰक᭜ सीजैव िचᳰक᭜ सीजैव िचᳰक᭜ सीय अपिश᭬ टय अपिश᭬ टय अपिश᭬ टय अपिश᭬ ट.—जैव िच ᳰक ᭜ सीय अपिश ᳥ ᮧबंध िन᳜िलिखत के अनुसार होगा-
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜ सीय अपिश᭬ ट िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं.का.िन 343 (अ) तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(ii) पाᳯरि᭭थितक संवेदी जोन मᱶ कोई साधारण उपचार सुिवधा या भ᭭मीकरण अनु᭄ात नहᱭ ᳰकया जाएगा ।
(11) यानीययानीययानीययानीय पᳯरवहनपᳯरवहनपᳯरवहनपᳯरवहन.....—पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल रीित मᱶ िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िविन᳸द᳥ उपबंध समािव᳥ ᳰकए जाएंग ेऔर ऐसे समय तक जब तक आंचिलक महायोजना के तैयार होती ह ैऔर रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होने तक, िनगरानी सिमित सुसंगत अिधिनयमᲂ तथा उनके अधीन बनाए गए िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को िनगरानी करेगी ।
(12) यानीययानीययानीययानीय ᮧदषूणᮧदषूणᮧदषूणᮧदषूण....————लागू िविधयᲂ के अनुसार वाहन ᮧदषूण कᳱ रोकथाम और िनयंᮢण का अनुपालन ᳰकया जाएगा। ᭭व᭒छक धन उदाहरण के िलए सीएनजी, एलपीजी, आᳰद के उपयोग के िलए ᮧयास ᳰकए जाएगे ।
(13) ᭡लाि᭭टक᭡लाि᭭टक᭡लाि᭭टक᭡लाि᭭टक अपिश᳥अपिश᳥अपिश᳥अपिश᳥ ᮧबंᮧबंᮧबंᮧबंधनधनधनधन....————पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(14) सिंनमाᭅणसिंनमाᭅणसिंनमाᭅणसिंनमाᭅण औरऔरऔरऔर िव᭟वसंिव᭟वसंिव᭟वसंिव᭟वसं अपिश᳥अपिश᳥अपिश᳥अपिश᳥ ᮧबधंनᮧबधंनᮧबधंनᮧबधंन....————पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(15) ईईईई––––अपिश᳥अपिश᳥अपिश᳥अपिश᳥....————पाᳯरि᭭थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा समय-समय पर यथासंशोिधत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(16) औ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयां....————(i) राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन को या उसके प᳟ात पाᳯरि᭭थितक संवेदी जोन के भीतर ᳰक᭠ही नए ᮧदषूणकारी उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा नहᱭ दी जाएगी।
(ii) पाᳯरि᭭थितक संवेदी जोन मᱶ कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा फरवरी, 2016 मᱶ जारी ᳰदशािनदᱷशᲂ मᱶ केवल गैर.—केवल अᮧदषूणकारी उ᳒ोगᲂ कᳱ ᭭थापना को वगᱮकरण के अनुसार अनु᭄ा दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᳥ न हो। इसके अलावा, गैर-ᮧदषूणकारी कुटीर उ᳒ोगᲂ को ᮧितिष ᳰकया जाएगा।
(17) पहाड़ीपहाड़ीपहाड़ीपहाड़ी ढलानᲂढलानᲂढलानᲂढलानᲂ कोकोकोको सरंᭃणसरंᭃणसरंᭃणसरंᭃण....————पहाड़ी ढलानᲂ का संरᭃण िन᳜ानुसार होगा : (क) आंचिलक महायोजना मᱶ पहाड़ी ढलानᲂ पर ᭃेᮢᲂ को उपदᳶशत ᳰकया जाएगा जहां ᳰकसी भी संिनमाᭅण कᳱ अन᭄ुा नहᱭ दी जाएगी । (ख)कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर ᳰकसी भी संिनमाᭅण कᳱ अनु᭄ा नहᱭ दी जाएगी ।

(2) ᮧदषूण (जल, वायु, मृदा, ᭟ विन आᳰद) काᳯरत करन ेवाले उ᳒ोगᲂ कᳱ ᭭ थापना । कोई नया उ᳒ोग या पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧदषूण फैलान े वाले उ᳒ोगᲂ के िव᭭तार कᳱ अनु᭄ा नहᱭ दी जाएगी। पाᳯरि᭭थितक संवेदी जोन के भीतर कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा फरवरी, 2016 मᱶ जारी ᳰदशािनदᱷशᲂ मᱶ केवल गैर.—ᮧदिूषत उ᳒ोगᲂ को ᭭थापना के अनसुार अनु᭄ात ᳰकया जाएगा, जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᳥ न हो इसके अितᳯरᲦ, गैर ᮧदषूण कूटी उ᳒ोग का बढ़ावा ᳰदया जाएगा।
(3) बृहत जल िव᳒ुत पᳯरयोजना कᳱ ᭭ थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
(4) ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन या ᮧ᭭संकरण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
(5) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
(6) ठोस अपिश᳥ िनपटान ᭭थल और ठोस और जैव िचᳰक᭜सा अपिश᳥ के िलए साधारण भ᭭मीकरण कᳱ सुिवधा कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नई ठोस अपिश᳥ िनपटान ᭭थल तथा ठोस अपिश᳥ और अपिश᳥ उपचार एवं ᮧसं᭭करण सुिवधा कᳱ अनु᭄ा नहᱭ ह।ै इसके अितᳯरᲦ औ᳒ोिगक ᮧᳰᮓया और ᭭वा᭭᭝य ᮧित᳧ान एवं अ᭭पतालᲂ आᳰद स े उ᭜प᳖ ᳰकसी भी ठोस अपिश᳥ के उपचार के िलए साधारण या ᳞िᲦगत भ᭭मीकरण कᳱ सुिवधा का सं᭭थापन ᮧितिष ह।ै 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(7) फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़ े पैमाने पर वािणि᭔यक पशुधन संपदा और कुकुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को पूरा करने के िसवाय लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
(8) नई आरा िमलᲂ कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर नई या िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(9) ट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
(10) पयᭅटन से संबंिधत ᳰᮓयाकलाप करना जैस े गमᭅ वायु गु᭣बारᱶ, हलेीका᭡टर, ᮟोन, माइᮓोलाइटस आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना। लागू िविधयᲂ के अधीन िविनयिमत ᳰकया जाएगा। ख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलाप
(11) होटलᲂ और ᳯरसोटᲄ का वािणि᭔यक ᭭थापन । पाᳯरि᭭थितक अनकूुल पयᭅटन ᳰᮓयाकलापᲂ के िलए लघु अ᭭थायी संरचनाᲐ के िलए संरिᭃत ᭃेᮢ सीमा के एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक ही जो भी िनकट हो कोई नया वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात हᲂगे अ᭠यथा नहᱭ। पर᭠तु संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर परे या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, जो भी िनकट हो सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार यथालागू पयᭅटन महायोजना के अनुᱨप होगा ।
(12) संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक जो भी िनकट हो, ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा: परंतु ᭭ थानीय लोगᲂ को पैरा 6 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके उपयोग के िलए उनकᳱ भूिम मᱶ ᭭थानीय िनवा᭭यᲂ कᳱ आवासीय आव᭫यकताᲐ को पूरा करन ेिलए संिनमाᭅण करने कᳱ अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी जैस:े—
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना और नई सड़कᲂ का संिनमाᭅण;
(ii) बुिनयादी ढांचᲂ और नागᳯरक सुख-सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) कुटीर उ᳒ोगᲂ िजनके अंतगᭅत ᮕामीण उ᳒ोग ह;ᱹ सुिवधा भ᭛डार और ᭭थानीय सुख सुिवधाᲐ जो पाᳯरि᭭थितक पयᭅटन मᱶ िजस मᱶ गृह वास भी ह ैसहायक हो; और

(13) ᮧदषूण उ᭜प᳖ न करन ेवाल ेलघ ु उ᳒ोग । फरवरी, 2016 मᱶ के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी उ᳒ोगᲂ मᱶ वगᱮकरण के अनुसार गैर-ᮧदषूणकारी उ᳒ोग और अपᳯरसंकट मᱶ, लघु और सेवा उ᳒ोग, कृिष, पु᭬प कृिष, उ᳒ान कृिष या पाᳯरि᭭थितक संवेदी जोन से दशेी सामᮕी से उ᭜पादᲂ को उ᭜प᳖ करन े वाले कृिष आधाᳯरत उ᳒ोग सᭃम ᮧािधकारी ᳇ारा अनु᭄ात हᲂगे।
(14) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर वृᭃᲂ कᳱ कोई कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
(15) वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का सᮕंहण (एनटीएफपी) । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(16) नागᳯरक सुख सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ िनयमᲂ और िविनयमᲂ मागᱮ मागᭅदशᭅको के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, और उपल᭣ध ᳰकए जाएगें ।
(17) िव᳒ुत और दरूसंचार टावरᲂ का पᳯरिनमाᭅण और केबल िबछाना और अ᭠य बुिनयादी ढांचे । भूिमगत केबल िबछाए जान ेको बढ़ावा ᳰदया जाएगा।
(18) होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(19) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅवᲂ अपिश᳥ जल एवं का िन᭭सारण । जल िनकायᲂ मᱶ ᮧवेश करने के िलए अपिश᳥ जल/ बिह᮲ाव उपचाᳯरत उ᭜सजᭅन रोकेगा। पुन:चᮓण और अपिश᳥ जल उपचाᳯरत पुन: उपयोग के िलए ᮧयास ᳰकए जाएगे अ᭠यथा अपिश᳥ जल/ बिह᮲ाव उ᭜सजᭅन लागू िविध के अनुसार िविनयिमत ᳰकया जाएगा।
(20) सतह और भूजल का वािणि᭔यक िन᭬कषᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(21) खुले कुआ, बोर कुआ, आᳰद के िलए कृिष और अ᭠य उपयोग । िविनयिमत और समुिचत ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ कᳱ सती स े िनगरानी कᳱ जाएगी।
(22) वािणि᭔ यक साइनबोडᭅ और होᳺडगᱶ । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(23) वायु, ᭟विन और यािनक ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(24) िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(25) पाᳯरि᭭थितक-पयᭅटन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(26) सुरᭃा बल िशिवर। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(27) नए का᭬ ठ आधाᳯरत उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना अनु᭄ात नहᱭ होगी : परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ 100% आयाितत का᭬ ठ ᭭ टाक उपभोग करने वाल ेनए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना कᳱ जा सकेगी । 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(28) पाᳯरि᭭थितक अनकूुल पयᭅटन ᳰᮓयाकलापᲂ हतेु पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए पाᳯरि᭭थितक अनुकूल कुटीर जैस े त᭥बु, लकड़ी के आवास। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(31) जैिवक खेती। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(32) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को अंगीकृत करना । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(33) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर भी ह ᱹ। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।

(35) कृिष वािनकᳱ । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(36) पाᳯरि᭭थितक अनुकूल पᳯरवहन का उपयोग । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(37) कौशल िवकास । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(38) िन᳜ीकृत भिूम या वन या का जीणᲃार । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
(39) पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।

(1) िनगरानी सिमित इस अिधसूचना के उपाबंध का अनुपालन िनगरानी सिमित करेगी।
(2) िनगरानी सिमित कᳱ अविध इस अिधसूचना के ᮧकाशन कᳱ तारीख से तीन वषᭅ का होगा ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 7th June, 2017 S.O. 1812(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3341, dated 7th December, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND whereas, no comments or objections and suggestions received from persons and stakeholders in response to the draft notification; WHEREAS, Nalsarovar Bird Sanctuary is located in Ahmedabad and Surendranagar districts of Gujarat and is spread over an area of 120.82 square kilometer; AND WHEREAS, the sanctuary is one of the largest natural wetlands in the country the extent of which varies depending upon the rainfall and which has maximum depth of about 1.5.—2.0 meters when flooded; AND WHEREAS, the sanctuary receives water mainly from two rivers viz. Brahmini and Bhogavo and also receives rain water from a catchment area spread over 3000 square kilometers comprising of Kalol Taluka of Gandhinagar district, Kadi Taluka of Mehsana district and Sanand, Viramgam and BavlaTaluka of Ahmedabad district and Lakhtar and Limdi Taluka of Surendranagar district; AND WHEREAS, the Nalsarovar sanctuary has varied habitat types viz. open water areas, marshes, reedbeds and islands.—there are more than 300 islands in the sanctuary which get exposed when water level recedes; AND WHEREAS, due to wide variety of habitats the Nalsarovar Sanctuary harbours 226 bird species, 20 species of fish and 13 species of mammals including globally threatened species of birds and mammals such as Sarus crane, Indian Skimmer, Asiatic Wild Ass and Wolf; AND WHEREAS, the sanctuary has rich aquatic flora with nearly 50 species of algae and over 72 types of flowering plants; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 AND WHEREAS, The vegetation found around Nalsaroval Bird Sanctuary includes Pili Tilvan, Pili Tanvani (Cleome viscose), Achhil Aijopras Bhuripras (Tamarix dioica), Jaljambvo Gandharo Okhrad (Bergia Odorata), Borchhuchh Kagagisoda (Corchorus Olitorius), Chunch Chhadhari (Corchorus aestuans), Bethu Gokhru Mithu Gokhru Akanti (Tribulus terrestris), Lago Samorvo (Alysicarpus rugosus), Jawasiyo (Alhagi Psendulhagi), Paragdodi (Aeschynomene indica), Abdaumethi Ranmethi (Crotolaria medicaginea), Fatakiya Bhonygal (Indigofera enneaphylla), Sevri, Jayanti (Sesbania aegypltiaca), Gando Boval (Prosopis liliflora), Khijdo (Prosopis cineraria), Aganbuti, Jalagio (Ammannia baccifera), Panlavang (Ludwigia perennis), Satodo (Trianthema portulacastrum), Bhangro (Eclipta alba), Mamejevo (Enicostema Littorale); AND WHEREAS, the sanctuary has main fauna such as Blackbuck (Antilope cervicapra), Bluebull (Boselaphus tragocamelus), Jackal (Canis aureus), Indian wild ass (Equas hemionous khur), Jungle cat (Felis chaus), Five sriped palm squirrel (Funambulus pennanae), Common mongoose (Herpestes edwardsi), Rufous tailed hare(Lepusnigricollis ruficaudatus), Desert gerbille(Meriones hurricanae), Indian wild boar (Sas scrofa), Grey musk shrew (Suncus murinus), Indian gerbille (Tetera indica), Indian fox (Vulpes bengalensis); AND WHEREAS, the sanctuary supports many water birds including migratory and local bird species like Grebes, Pelicans, Ducks & Geese, Rails, Coots, Crakes, Jacanas, Cormorants, Herons, Egrets, Bittern, Storks, Ibises, Spoonbill, Flamingos, Cranes, Waders,shorebirds, Gulls, Terns, Kingfishers, Wagtails, Pipits, Eagles, Harriers; AND WHEREAS, owing to its large size and remarkable species richness as well as abundance of aquatic birds, Nalsarovar Bird Sanctuary has been designated as a Ramasar site recognizing it as a Wetland of International Importance under the Ramsar Convention; AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which specified in paragraph 1 of this notification, around the Nalsarovar Bird Sanctuary as Eco sensitive zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause
(xiv) of sub.—section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying up to 13 kilometers from the boundary of the Nalsarovar Bird Sanctuary in the State of Gujarat, as Nalsarovar Bird Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone..—(1) The Eco-sensitive Zone is located in the districts of Ahmedabad and Surendranagar.
(2) The extent of Eco-sensitive Zone ranges from 2.35 kilometer to 4.84 kilometers from the boundary of the Sanctuary.
(3) The description of boundary of Eco-sensitive Zone of Nalsarovar Bird Sanctuary is annexed as Annexure I.
(4) The map of Nalsarovar Bird Sanctuary together with Eco-sensitive Zone is appended as Annexure II and the Geo-coordinates of Sanctuary and ESZ are appended as Annexure III. 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(4) The list of villages falling within the Eco-sensitive Zone is annexed as Annexure IV.
2. Zonal Master Plan for the Eco-sensitive Zone..—(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue,
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal ;
(x) Panchayati Raj ; and
(xi) Public Works Department.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21
(1) Landuse..—
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/ Government and State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) Promoted activities and given under para 7:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism/Eco-tourism.—(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests. 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely.—
(i) new construction of hotels and resorts shall not be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel or resort or commercial establishment construction is permitted within Eco-sensitive Zone area.
(4) Natural Heritage..—Natural Heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites..—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution..—Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.
(7) Air pollution..— Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto.
(8) Discharge of effluents..—Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes..— Disposal and Management of solid wastes shall be as under.—
(i) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Ecosensitive Zone.
(10) Bio-medical waste..—Bio medical waste management shall be as under:-
(i) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.
(ii) no common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Vehicular traffic ..—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Vehicular Pollution-Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(13) Plastic Waste Management.—The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(14) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(15) E-waste.—The E.—Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(16) Industrial Units.—(i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes..—The protection of hill slopes shall be as under.-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone..—All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S.No. Activity Remarks

1. Commercial Mining.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 04 August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). No new industries and expansion of existing polluting industries in the Ecosensitive zone shall be permitted. Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste. No new solid waste disposal site and waste treatment or processing facility of solid waste is permitted within Eco sensitive zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment or hospitals etc. is Prohibited.
7. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies. Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Ecosensitive Zone.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
10. Under taking other activities related to tourism like over flying the ESZ area by hot air balloon, helicopter, drones, Microlites, etc. Regulated under applicable law. B. Regulated activities
11. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
12. Construction activities. No new commercial construction of any kind shall be permitted within one ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 25 Kilometre from the boundary of the Protected Area or upto extent of the Ecosensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as.-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and
(iv) promoted activities listed in this Notification.
13. Small scale non polluting industries. Non polluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
14. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
15. Collection of Forest produce or Non-Timber Forest Produce (NTFP). Regulated under applicable laws.
16. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
17. Erection of electrical & telecommunication towers related infrastructure. Promote underground cabling.
18. Fencing of existing premises of hotels and lodges. Regulated under applicable laws.
19. Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water or effluent shall be regulated as per applicable laws.
20. Commercial extraction of surface and ground water. Regulated under applicable law.
21. Open Well, Bore Well etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority.
22. Commercial Sign boards and hoardings. Regulated under applicable laws.
23. Air, Noise and vehicular pollution. Regulated under applicable laws.
24. Introduction of Exotic species. Regulated under applicable laws.
25. Eco-tourism. Regulated under applicable laws
26. Security Forces Camp. Regulated under applicable laws.
27. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone. Provided that new wood based industry may be set up in the Eco-sensitive using 100 percent imported wood stock.

5. Monitoring Committee.— The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:-
(i) Collector, Surendranagar. -Chairman;
(ii) Representative of Collector, Ahmadabad –Member;
(iii) Regional Officer, State Pollution Control Board. -Member;
(iv) One representative of Non-governmental Organisations working in the field of nature conservation to be nominated by the Government of Gujarat (for a term of three year in each case).—Member;
(v) One expert in Ecology/wildlife/birds from reputed Institution or University of the State of Gujarat to be nominated by the Government of Gujarat (for a term of three year in each case). -Member;
(vi) Member State Biodiversity Board -Member;
(vi) One expert in Hydrology -Member;
(viii) One expert in Ground water -Member;
(ix) Deputy Conservator of Forests, (Incharge of the Nalsarovar Bird Sanctuary -Member-Secretary.
6. Terms of Reference:
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The tenure of the monitoring committee shall be for three years from date of publication of this Notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual sitetourism activities.
29. Solid Waste Management. Regulated under applicable laws. C. Promoted Activities:
30. Rain water harvesting. Shall be actively promoted.
31. Organic farming. Shall be actively promoted.
32. Adoption of green technology for all activities. Shall be actively promoted.
33. Cottage industries including village artisans, etc. Shall be actively promoted.
34. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted
35. Agro-Forestry. Shall be actively promoted.
36. Use of eco-friendly transport. Shall be actively promoted.
37. Skill Development. Shall be actively promoted.
38. Restoration of Degraded Land/ Forests/ Habitat. Shall be actively promoted.
39. Environmental Awareness. Shall be actively promoted. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 27 specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual sitespecific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro.—forma appended at Annexure-V.
(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F.
