और उᲦ राजपᮢ, कᳱ ᮧितयां जनता को तारीख 9 ᳰदस᭥बर, 2015 को उपल᭣ध करा दी गई थᱭ ;
और, उᲦ ᮧाᱧप अिधसूचना के ᮧ᭜युᱫर मᱶ ᳞िᲦयᲂ और पणधाᳯरयᲂ से कोई टीका ᳯट᭡पिणयां/आᭃेप और सुᭃाव ᮧा᳙ नहᱭ ᱟए थ;े और, िहमाचल ᮧदेश के सोलन िजले मᱶ ि᭭थत मज़थाल व᭠यजीव अभयार᭛य जो 31° 15’ उ. से 31° 18’ उ. के बीच अᭃांश तथा 76°57’ पू. से 77°02’ प.ू देशा᭠तर के बीच 37.71 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ फैला ᱟआ ह ै। और, इस अभयार᭛ य का अिभᮧाय ᮧचुर जैिवक जीवजंतु और वन᭭ पितयᲂ का वणᭅन करना ह ै । चीर (कैटᳯरयस वािलिसची), तᱶदआु (पᱶथरेा पाडᭅस), साँभर (ᱧसा यूनीलोर), घोरल (नामोरेडस एसपी), मंुजक (नामोरेडस एसपी), काला भालू (उसᭅस अमेᳯरकन) कᳱ मुय ᮧजाितयाँ ह ᱹ। और, देवदार ᮧमुख पौधे ᮧजाितयां ह ᱹऔर अ᭠य ᮧजाितयᲂ मᱶ बान-ओक (Ფैरसस ᭨यूकोᮝीकोफोरा), कैल (िपनास एसपी), चीर (िपनस रॉसबरी), केनथ (पायरस पिशया), कच वृᭃ (बबड़ी केटचु), क᭓नर (बूनीया वेᳯरएगेट) दमू (बेरबेरीस अᳯर᭭ताटा), पाजा (ᮧुनास कैसरोए᭙स), िशशम (डा᭨बᳶगया सीसू), सानान, जामुन (साइज़ीिगयम किमनी), फेगरा (ᳰफकस पा᭨माट), अमलतास (कैिसया ᳰफ़᭗टुला), आम (मंिगफेरा इंिडका), िबᱟल (ᮕूया ऑᳯटवा) आᳰद ह।ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, मज़थाल व᭠यजीव अभयार᭛य सोलन मᱶ आंिशक हासमान सतलुज नदी के दिᭃण तट मᱶ और िहमाचल ᮧदशे के िशमला िजला मᱶ पि᳟मी िहमालयी ᭃेᮢ के अंतगᭅत 575 मी से 1985 मी, के ऊपर सीमांᳰकत ह ै । यह उपो᭬णीय मानसून जलवायु ᭃेᮢ ह ै। िहमालयी चीर पाइन (पीनस रोसबरगही), बेन औक, (यूरस िलयूकोᳯᮝकोफोरा)वन और उपो᭬णीय भूहर झाड़ी मुय वन᭭पित के ᮧकार ह।ै अभयार᭛य मᱶ मुय ᮧाकृितकवास का बड़ा खंड लंबी घास के साथ ि᭭टप दिᭃण पूवᱮ ढाल आवᱫ िवकᳱणᭅ वनारोिपत के साथ ᮧकᳱणᭅ िचल, बेन-ओक और तगंघाटी मᱶ िमि᮰त चौड़ीपᱫी वन और िनचला ᭃेᮢ समािव᳥ ह ै। और, मज़थाल व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करन ेको ᮧितिष करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप धारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत े ᱟए, िहमाचल ᮧदेश रा᭔य मᱶ मज़थाल व᭠यजीव अभयार᭛य कᳱ सीमा के 0 मीटर से 2 ᳰकलोमीटर चारᲂ ओर तक के िव᭭ताᳯरत ᭃेᮢ को मज़थाल व᭠यजीव अभयार᭛य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात ्पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:--
1. पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक संवदेीसंवदेीसंवदेीसंवदेी जोनजोनजोनजोन काकाकाका िव᭭तारिव᭭तारिव᭭तारिव᭭तार औरऔरऔरऔर उसकᳱउसकᳱउसकᳱउसकᳱ सीमाएंसीमाएंसीमाएंसीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन मज़थाल व᭠यजीव अभयार᭛य कᳱ सीमा के चारᲂ शू᭠य से 2.252 ᳰकलोमीटर तक िव᭭ताᳯरत ह।ै पाᳯरि᭭थितक संवेदी जोन कᳱ ओर से व᭠यजीव अभयार᭛य के उᱫर-पूवᱮ भाग पर सतलुज नदी पर उपनदी ढलानᲂ कᳱ उपि᭭थित और उᱫर-पि᳟मी भाग कᳱ ओर से सतलजु बेिसन नदी पर केओएल बांध के संिनमाᭅण से ह।ै पाᳯरि᭭थितक संवेदी जोन का ᭃेᮢ 12.68 वगᭅ ᳰकलोमीटर ह।ै
(2) भू-िनदᱷशांकᲂ के साथ पाᳯरि᭭थितक संवेदी जोन मᱶ िवभािजत मज़थाल व᭠यजीव अभयार᭛य का मानिचᮢ उपाबधंउपाबधंउपाबधंउपाबधं I I I I के ᱧप मᱶ उपाब ह ै।
(3) पाᳯरि᭭ थितक संवेदी जोन के अतंगᭅत आन ेवाले ᮕामᲂ कᳱ सूची के साथ मुय िब᭠दᲐु के भू-िनदᱷशांक उपाबधंउपाबधंउपाबधंउपाबधं IIIIIIII के ᱧप मᱶ उपाब ह ै।
2222.... पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक संवदेीसंवदेीसंवदेीसंवदेी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महायोजनामहायोजनामहायोजनामहायोजना ––––(1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) आंचिलक महायोजना के ᳇ारा तैयार ᳰकए गए अिधसूचना मᱶ उ᭨लेिखत शतᭅ के अनुᱨप हᲂगे और पयाᭅवरणीय ᮧभाव भी शािमल हᲂगे।
(3) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(4) पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित से रा᭔ य सरकार तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश का िसांत, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(5) आंचिलक महायोजना, रा᭔ य सरकार के सभी संब िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत:्--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पयᭅटन ;
(v) नगरपािलका ;
(vi) राज᭭ व ;

(vii) कृिष ;
(viii) ᳲसचाई;
(ix) लोक िनमाᭅण िवभाग; और
(x) िहमाचल ᮧदेश रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ।
(6) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(7) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(8) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, जनजाित ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी और मानिचᮢ ᳇ारा समᳶथत होगा। इस योजना के मानिचᮢ ᳇ारा िव᳒मान और ᮧ᭭तािवत भूिम के उपयोग का िववरण ᳰकया जाएगा ।
(9) आंचिलक महायोजना, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगी और ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन के िलए पाᳯरि᭭थितक अनुकूल को सुिनि᭫ चत करने के िलए, उस अिधसूचना मᱶ िविन᳸द᳥ ᳰᮓयाकलापᲂ को ᮧितिष, िविनयिमत या ᮧो᳖त करेगी ।
(10) आंचिलक महायोजना इस अिधसूचना मᱶ ᳰदए गए उपबंधᲂ के संबंध मᱶ अपन ेकायᲄ के बाहर ल ेजाने के िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी ।
3. रा᭔यरा᭔यरा᭔यरा᭔य सरकारसरकारसरकारसरकार ᳇ारा᳇ारा᳇ारा᳇ारा ᳰकएᳰकएᳰकएᳰकए जानेजानेजानेजाने वालेवालेवालेवाले उपाउपाउपाउपायययय-------- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :-
(1)(1)(1)(1) भूभभूूभू----उपयोग उपयोग उपयोग उपयोग ---- पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंत ु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन ेके िलए और पैरा 4 कᳱ सारणी के ᭭तंभ
(2) के अधीन सूचीब ᳰᮓयाकलापᲂ को पूरा करन ेके िलए अनु᭄ात हᲂगे, अथाᭅत ्:-
(i) पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद ;
(ii) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;
(iii) ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग;
(iv) वषाᭅ जल संचय; और;
(ii) ᮕामीण उ᳒ोग, सुिवधा भंडार और ᭭थानीय सुिवधाᲐ सिहत कुटीर उ᳒ोग:
परंत ुयह और भी ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन तथा संिवधान के अनु᭒छेद 244 और त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा:
परंत ुयह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात ्रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को देनी होगी । परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंत ुयह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएंगे । ((((2222)))) ᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोत - आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करन ेके िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे । ((((3333)))) पयᭅटन पयᭅटन पयᭅटन पयᭅटन –––– (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂग ेजो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी । (ख) पयᭅटन महायोजना पयᭅटन िवभाग िहमाचल ᮧदेश सरकार ᳇ारा रा᭔य और वन िवभाग िहमाचल ᮧदेश सरकार के परामशᭅ से तैयार होगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ जाना जायेगा । (घ) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂग,े अथाᭅत ्:-
(i) पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय मज़थाल व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर के भीतर पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट ह,ै होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ होगा। परंतु, उᲦ अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितक पयᭅटन सुिवधाᲐ के िलए पूवᭅ अ᭤यांᳰकत तथा पदािभिहत ᭃेᮢᲂ मᱶ ही अन᭄ुात ᳰकए जाएंगे;
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤ सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;

(7) वायुवायुवायुवायु ᮧदषूणᮧदषूणᮧदषूणᮧदषूण - पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए िविनयम वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुपालन मᱶ हᲂग े।
(8) बिह᮲ावबिह᮲ावबिह᮲ावबिह᮲ाव काकाकाका िन᭭सारणिन᭭सारणिन᭭सारणिन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण साधारण मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा । ((((9999)))) ठोसठोसठोसठोस अपिश᳥ अपिश᳥ अपिश᳥ अपिश᳥ -------- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा--
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ का िन᭭सारण, समय-समय पर संशोिधत ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ.
1357(अ) तारीख 8 अᮧलै, 2016 ᳇ारा ᮧकािशत ᳰकए गए थ,े के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा ;
(iii) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण और भूिम भराव अनु᭄ात नहᱭ होगा।

(16) अगर यह आव᭫यक समझता ह,ै इस अिधसूचना के उपाबंध को ᮧभावी करन ेमᱶ के᭠ᮤीय सरकार और रा᭔य सरकार, अ᭠य उपायᲂ िन᳸द᳥ करेगा।

(ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4.8.2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामल े मᱶ तारीख 21.04.2014 के अतंᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
2. आरा मीलᲂ कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
3. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन या ᮧसं᭭करण। लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠यथा उपबंिधत के िसवाय) ।
4. जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करन ेवाले उ᳒ोगᲂ कᳱ ᭭ थापना । कोई नई या पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧदषूण फैलान ेवाल ेउ᳒ोगᲂ के िव᭭तार कᳱ अनुमित दी जाएगी। कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा फरवरी, 2016 मᱶ जारी ᳰदशािनदᱷशᲂ के अनुसार पाᳯरि᭭थितक संवेदी जोन के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ अनुमित दी जाएगी, इसके अितᳯरᲦ, गैर ᮧदषूणकारी लघ ुउ᳒ोगᲂ को बढ़ावा ᳰदया जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
5. नए वृहत तापीय और जल-िव᳒ुतीय पᳯरयोजना । लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠यथा उपबंिधत के िसवाय) ।
6. जलावन लकड़ी का वािणि᭔यक उपयोग। लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
7. ᭡लाि᭭टक बैग का उपयोग । लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
8. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ, हलेीका᭡टर, ᮟोन, माइᮓोलाइट आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
9. मछली पकड़ना । लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
10. ᮧाकृितक जल िनकायᲂ या भू-ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण। लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
11. कूड़ा-करकट ᳞यन । लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
12. ठोस अपिश᳥ िनपटान ᭭थल कᳱ ᭭थापना और िलए ठोस और जैव िचᳰक᭜सा अपिश᳥ के िलए सामा᭠य जलाए जान े कᳱ सुिवधा । पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ कᳱ कोई नई ठोस अपिश᳥ िनपटान ᭭थल और अपिश᳥ उपचाᳯरत/ᮧसं᭭करण सुिवधा कᳱ अनुमित नहᱭ ह ै । औ᳒ोिगक ᮧᳰᮓया और ᭭वा᭭᭝य ᮧित᳧ान और अ᭭पतालᲂ आᳰद से उ᭜प᳖ ᳰकसी भी ठोस अपिश᳥ के उपचार के िलए सामा᭠य या ᳞िᲦगत भ᭬मीकरण कᳱ सुिवधा के और सं᭭थापन को ᮧितिष ᳰकया जाएगा ।
13. फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणि᭔यक पशुधन संपदा और कुकुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को परूा करने के िलए लाग ू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
14. ट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । िविनयिमत ᳰᮓयाकलापिविनयिमत ᳰᮓयाकलापिविनयिमत ᳰᮓयाकलापिविनयिमत ᳰᮓयाकलाप
15. होटल और िव᮰ाम ᭭थलᲂ का वािणि᭔यक ᭭थापन। पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलापᲂ संबंधी कᳱ लघु अ᭭थायी संरचनाᲐ के िलए संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात हᲂग,े अ᭠यथा नहᱭ । परंत,ु संरिᭃत ᭃेᮢ से एक ᳰकलोमीटर से परे या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक जो भी नजदीक हो सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना और यथा लाग ूमागᭅदशᱮ िसांतᲂ के अनᱧुप होगा।
16. सि᳖माᭅण ᳰᮓयाकलाप। संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, जो भी िनकट हो, ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:
परंत ु ᭭ थानीय लोगᲂ को परैा 6 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करन ेकᳱ अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी ।
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;

(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) कुटीर उ᳒ोगᲂ िजसके अतंगᭅत ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुख सुिवधाᲐ जो पाᳯरि᭭थितक पयᭅटन िजस मᱶ सहायक हो ᮕह वास; और
(iv) इस अिधसूचना मᱶ संवᳶधत ᳰᮓयाकलापᲂ कᳱ सूची :
17. खाई का मैदान। नए खाई खोदने के मैदान का ᭭थािपत ᳰकया जाना ᮧितिष ह ै| पुरान े खाई के मैदान लाग ूिविधयᲂ के अधीन िविनयिमत ᳰकए जाएं |
18. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत अपिश᳥ जल/बिह᮲ाᭅवᲂ का िन᭭सारण जल िनकायᲂ मᱶ ᮧवेश नहᱭ ᳰदया जाएगा और उपचाᳯरत जल के पुन:चᮓᭅण और पुन:उपयोग के िलए ᮧयास ᳰकए जाएंग े और उपचाᳯरत अपिश᳥ जल/बिह᮲ाᭅवᲂ को िन᭭सारण लागु िविधयᲂ के अनुसार िविनयिमत ᳰकया जाएगा।
19. वायु और यानीय ᮧदषूण। लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
20. ᭟विन ᮧदषूण। लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
21. भू-जल कᳱ िनकासी । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
22. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
23. ᮧवासी चरवाह।े लाग ूिविधयᲂ और आंचिलक महायोजना के अनुसार िविनयिमत हᲂग े।
24. मौजूदा ᮧित᳧ान। लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।

26. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना । लाग ूिविधयᲂ िनयमᲂ तथा िविनयम और उपल᭣ध मागᭅदशᭅक िसांतᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ ᳰकया जाएगा।
27. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना। लाग ूिविधयᲂ के अधीन िविनयिमत होगा । व᭠ यजीव के मु त संचलन को अनु᭄ात करन े के िलए पाᳯरि᭭थितक संवेदी जोन के भीतर होटलᲂ या अ᭠ य वािणि᭔ यक ᭭ थापन अपनी पᳯरसंपि᭜ तयᲂ मᱶ काटेदार से बाड नहᱭ लगाएंग ेऔर कोई भी बाड़ एक मीटर से ऊंची नहᱭ होगी । कोई िव᳒मान बाड़, जो इस अनुबंध का अनुपालन नहᱭ करती ह,ै को आंचिलक महायोजना मᱶ वᳶणत समय- सीमा के अनुसार उपांतᳯरत ᳰकया जाएगा ।

45. ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग । फरवरी, 2016 मᱶ के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी उ᳒ोगᲂ के वगᱮकरण के अनुसार सफेद वगᭅ के ᱧप मᱶ करार ᳰदये गए गरै ᮧदषूणकारी उ᳒ोग और गरै पᳯरसंकटमय, लघ ु और सेवा उ᳒ोग, कृिष, उ᳒ान कृिष, पु᭬प कृिष या पाᳯरि᭭थितक संवेदी जोन से देशीय सामᮕी से उ᭜पादᲂ का उ᭜पादन करने वाला कृिष आधाᳯरत सᭃम ᮧािधकारी ᳇ारा अनु᭄ात ᳰकया जाएगा।
46. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।

(i) िजला उपायुᲦ, सोलन -अ᭟यᭃ;
(ii) िहमाचल ᮧदेश सरकार ᳇ारा नामिन᳸द᭬ ट ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ का एक िवशेष᭄ - -सद᭭य;
(iii) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करन ेवाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै का ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए भारत सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध - -सद᭭य;
(iv) सद᭭य सिचव एवं सद᭭य, िहमाचल ᮧदेश रा᭔य जैव िविवधता बोडᭅ -सद᭭य;
(v) कायᭅकारी अिभय᭠ता, िहमाचल ᮧदेश रा᭔य ᮧदषूण िनयंᮢण बोडᭅ, -सद᭭य;
(vi) वᳯर᳧ नगर योजनाकार -सद᭭य;
(vii) वन उप संरᭃक (व᭠यजीव), िशमला -सद᭭य;
(viii) ᮧभागीय वन अिधकारी (रा᭔य ᭃेᮢीय), कुिनहर -सद᭭य-सिचव

(1) मानीटरी सिमित का कायᭅकाल अिधसूचना जारी करने कᳱ तारीख से तीन वषᭅ कᳱ अविध के िलए होगा।
(2) मािन टरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ.
1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आन ेवाल ेऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी । उ᳒ोगᲂ कᳱ केवल ᳡ेत ᮰ेिणयᲂ को "उ᳒ोगᲂ, 2016 का वगᱮकरण" के िलए सीपीसीबी ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ िन᳸द᳥ के ᱨप मᱶ माना जाएगा।
(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंत ु पाᳯरि᭭थितक संवेदी जोन मᱶ आत े ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(5) मानीटरी सिमित का सद᭭य-सिचव या संब आयुᲦ ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लघंन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 (1986 का 29) के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा।
(6) मानीटरी सिमित मा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहत े ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपन ेिवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय व᭠य जीव वाडᭅन को उपाबधंउपाबधंउपाबधंउपाबधं III मᱶ उपबंिधत ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭ततु करेगी ।

AND WHEREAS, the flora and fauna represent rich biological significance of this Sanctuary. The key species are Cheer (Catreus wallichii), Leopard (Panthera pardus), Sambar (Rusa unicolor), Ghoral (Naemorhedus sp.), barking deer (Muntiacus sp.), Black Bear (Ursus americanus);
AND WHEREAS, Deodar is the dominant plant species and other species includes Ban-oak (Quercus leucotrichophora), Kail (Pinus sp.), Chir (Pinus roxburghii), Kainth (Pyrus pashia), Cutch tree (Acacia catechu), Kachnar (Bauhinia variegate), Daroo (Berberis aristata), Paja (Prunus cerasoides), Shisham (Dalbergia sissoo), Sanan, Jamun (Syzygium cumini), Fegra (Ficus palmate), Amaltas (Cassia fistula), Mango (Mangifera indica), Bihul (Grewia optiva), etc.
AND WHEREAS, the Majathal Wildlife Sanctuary is bordering the southern bank of river Satluj partly falling in Solan and partly in Shimla District of Himachal Pradesh in Western Himalayan region within an altitude of 575m to 1985m above msl. The area has subtropical Monsoon climate. Himalayan Chir pine (Pinus Roxburghii), Ban Oak (Quercus leucotrichophora), forest and sub tropical Euphorbia scrub are the major vegetation types. Major habitat in the sanctuary comprises steep south eastern slopes covered with large patches of tall grass sparsely forested with Chir, Ban Oak and mixed broadleaved forests in ravines and low lying areas.
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the boundary of the protected area of Majathal Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries or and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE , in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule
(3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent ranging from 0 metres to 2 kilometres around the boundary of Majathal Wildlife Sanctuary in the State of Himachal Pradesh as the Majathal Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:—
1. Extent and boundaries of Eco-sensitive Zone.—(1)The extent of Eco-sensitive Zone varies from zero to 2.252 kilometres from the boundary of the Majathal Wildlife Sanctuary. zero ESZ towards the North-eastern side of the wildlife sanctuary is due to the presence of precipitous slopes on the river Satluj and towards the North-western side is due to the construction of KOL dam on the river Satluj basin. The area of the Eco- sensitive Zone is 12.68 sq. km.
(2) The map of Majathal Wildlife Sanctuary demarcating the Eco-sensitive Zone along with the geo co-ordinates are appended as Annexure I.
(3) The list of villages falling within Eco-sensitive Zone along with geo coordinates of the prominent points is appended as Annexure II.
2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan so prepared shall commensurate with the stipulation specified in the Notification and include the environmental implications.
(3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Irrigation;
(ix) Public Works Department; and
(x) Himachal Pradesh State Pollution Control Board.
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas such as parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.

(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited, regulated and promoted activities specified in the Notification so as to ensure Eco-friendly development for livelihood security of local communities.
(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions with respect to the provisions given in this notification.
3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:—
(1) Landuse.—Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:—
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism activities;
(ii) Widening and strengthening of existing roads and construction of new roads;
(iii) Small scale industries not causing pollution;
(iv) Rainwater harvesting; and
(v) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.— The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or and restrict development activities within the catchment areas.
(3) Eco-Tourism.—(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism, Government of Himachal Pradesh in consultation with Department of Revenue and Forests, Government of Himachal Pradesh.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities relating to tourism shall be regulated as under, namely.—
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Majathal Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan:
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural Heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.—The Environment Department of the State Government or Bihar State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.— Regulations for the control of air pollution in the Eco-Sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with.
(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein.–
(9) Solid wastes.—Disposal of solid wastes shall be as under:—
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343(E), dated the 28th March, 2016, as amended from time to time.
(i) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone;
(ii) Individual hospitals or private health centres already existing within the Eco Sensitive Zone should provide adequate waste treatment system to avoid adverse impact on the Protected Area.
(11) Plastic Waste Management.—The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.—The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic .—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Industrial units.— (a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.
(15) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.

4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.—All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:— Sl. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No. 202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No. 435 of 2012.
2. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
4. Setting up of industries causing water or air or soil or noise pollution.
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
5. Establishment of new major hydroelectric projects Prohibited (except as otherwise provided) as per applicable laws.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
7. Use of plastic bags Prohibited (except as otherwise provided) as per applicable laws.
8. Undertaking other activities related to tourism like over flying the ESZ area by hot air balloon, helicopter, drones, Microlites, etc.

13. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.

Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
16. Construction activities No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as:
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) cottage industries including village industries; convenience stores & local amenities supporting eco-tourism including home stays; and
(iv) Promoted activities listed in this Notification.
17. Trenching ground Establishing of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws.
18. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
19. Air and Vehicular Pollution Regulated under applicable laws.
20. Noise pollution Regulated under applicable laws.
21. Extraction of ground water Regulated under applicable laws.
22. Felling of Trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
23. Migratory graziers Regulated under applicable laws and as per Zonal Master Plan.
24. Existing establishments Regulated under applicable laws.
25. Erection of electrical, insulation of electric lines and communication towers and laying of cables and other infrastructures Regulated under applicable laws. Underground cabling may be promoted.

In order to allow free movement of wildlife, hotels or other commercial establishments within the ESZ shall not fence their properties with barbed wire and no fence shall be higher than 1 meter. Any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan.

5. Monitoring Committee.—The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) Deputy Commissioner, Solan -Chairman;
(ii) An expert in the area of ecology and environment to be nominated by the Government of Himachal Pradesh for three years in each case -Member;
(iii) One representative of Non-governmental Organization (working in the field of environment including heritage conservation) to be nominated by the Government of India for a term of three years in each case -Member;
(iv) Member Secretary or Member, Himachal Pradesh State Biodiversity Board -Member;
(v) Executive Engineer, Himachal Pradesh Pollution Control Board -Member;
(vi) Senior Town Planner -Member;
(vii) Deputy Conservator of Forest (Wildlife), Shimla -Member;
(viii) Divisional Forest Officer (Territorial), Kunihar -Member-Secretary.

6. Terms of Reference.—(1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of Notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State under intimation to this Ministry as per proforma appended at Annexure III .
8. The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
