PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 1607] No. 1607] NEW DELHI, WEDNESDAY, JUNE 7, 2017/JYAISTHA 17, 1939 पर्यावरण, वन और जलवयर् ुपररवर्ान मतं्रयलर् अधिसचूनय नई दिल्ली, 7 जून, 2017 कय.आ. 1814(अ).—प्रयरुप अधिसूचनय भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय.आ. 3333 (अ), र्यरीख 10 दिसम्बर, 2015 द्वयरय भयरर् के रयजपत्र असयियरण में प्रकयधिर् की गई थी धजसमें उन सभी व्यधिर्ों से, धजनको उससे प्रभयधवर् होने की संभयवनय थी, उस र्यरीख से, धजसको उि अधिसूचनय की रयजपत्र की प्रधर्र्यं जनर्य को उपलब्ि करय िी गई थी, सयठ दिन की अवधि के भीर्र, आक्षेप और सुझयव आमंधत्रर् दकए गए थे;
और, उि प्रयरुप अधिसूचनय अंर्र्ववष्ट रयजपत्र की प्रधर्र्यं 10 दिसम्बर, 2015 को जनर्य को उपलब्ि करय दिर्य गर्य थय;
और, व्यधिर्ों से प्रयप्त आक्षेप और सुझयव सम्र्क रूप से धवचयर दकर्य गर्य थय;
और, डेधिगढ़ वन्र्जीव अभर्यरण्र्, उडीसय के बरगढ़ धजले में धथथर् है, वन्र्जीव के अपने मूल थथयन संरक्षण के धलए एक महत्वपूणा थथल ह।ै अभर्यरण्र् कय क्षेत्र 353.81 वगा दकलोमीटर ह ैऔर उत्तर अक्षयंि 21.28’ 30’’ और 21.43’ 30’’ और पूवा ििेयंर्र
83.30’ और 83.46’30’’ के बीच धथथर् है;
और, डेधिगढ़ वन्र्जीव अभर्यरण्र् र्थयथथयन संरक्षण के धलए महत्वपूणा थथल ह ैजो की अत्र्धिक जैव-धवधविर्य से भरय है धजसमें थर्नियररर्ों की 40 प्रजयधर् 234 प्रजयधर् की धचधडर्याँ, सरीसृप 41 प्रजयधर्, उभर्चरों की 12 प्रजयधर्, मछधलर्ों की 42 प्रजयधर्, उडोनयट्स, की 39 प्रजयधर् धर्धर्धलर्ों की 85 प्रजयधर्, मकडी की 38 प्रजयधर् र्थय रयष्ट्रीर् पररपेक्ष्र् में, जनसंख्र्य के कयरण-1 की प्रजयधर्र्याँ जैसे- र्ेिआु (पेंथेरय पयडास), भयरर्ीर् गौर (बोस गौरस), और चौससगय मृग (टेटरयसेरस क्वयडररकोरधनस) ह;ै और, अभर्यरण्र् पूवा और उत्तर में मयनव धनर्वमर् धहरयकुण्ड जलयिर्ों से सीमयंदकर् ह ैअर्: रयज्र् के कुछ चर्धनर् जलयिर्ों में से एक जलयिर् कय धनमयाण करनय ह ैजो िोनों थथलीर् एवं जलीर् जैव-धवधविर्य की मिि करर्य ह ैजो दक िीर्कयल में पयनी के पररवयसी पधक्षर्ों की महत्वपूणा संख्र्य को आकृष्ट करर्य ह ैऔर र्ह वन्र्जीव अभर्यरण्र् 250 से भी अधिक की वनथपधर्र् प्रजयधर्र्ों कय गृह ह ैधजसमें बहुर् सी इथनो-बोरटधनकल और औषिीर् मूल्र् की है;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, डेधिगढ़ वन्र्जीव अभर्यरण्र् के चयरों ओर के क्षेत्र को, धजसकय धवथर्यर और सीमयएं इस अधिसचूनय के पैरय 1 में धवधनर्दिष्ट हैं, पर्यावरण की िधृष्ट से पयररधथथधर्क संवेिी जोन के रूप में सुरधक्षर् और संरधक्षर् करनय र्थय उि पयररधथथधर्क संविेी जोन में उद्योगों र्य उद्योगों के वगो के प्रचयलन र्थय प्रसंथकरण करने को प्रधर्धषद्ध करनय आवश्र्क ह ै;
अर्ः, अब, केन्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) और पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (2) के खंड (v) और खंड (xiv) के सयथ परठर् और उपियरय (3) द्वयरय प्रित्त िधिर्ों कय प्रर्ोग करर्े हुए, उडीसय रयज्र् में डेधिगढ़ वन्र्जीव अभर्यरण्र् की सीमय के चयरों ओर से 5 दकलोमीटर र्क के धवथ र्यररर् क्षेत्र को डेधिगढ़ वन्र्जीव अभर्यरण्र् पयररधथथधर्क संवेिी जोन (धजसे इसमें इसके पश् चयर्प पयररधथ थधर्क संवेिी जोन कहय गर्य ह)ै के रूप में अधिसूधचर् करर्ी ह,ै धजसकय धववरण धनम्नयनसुयर है, अथयार्प :--
1. पयररधथथधर्क संविेी जोन कय धवथर्यर और उसकी सीमयएं--(1) पयररधथथधर्क संवेिी जोन कय धवथर्यर डेधिगढ़ वन्र्जीव अभर्यरण्र् की सीमय से 2 दकलोमीटर से 5 दकलोमीटर र्क क्षेत्र कय है | पयररधथथधर्क संवेिी जोन कय क्षेत्र 519.67 वगा दकलोमीटर ह ै।
(2) भ-ूधनििेयंकों के सयथ डेधिगढ़ वन्र्जीव अभर्यरण्र् को धवभयधजर् कर पयररधथथधर्क संवेिी जोन की सीमय कय मयनधचत्र उपयबिं I और Iक के रुप में उपयबद्ध ह।ै
(3) पयररधथथधर्क संवेिी जोन के अंर्गार् आने वयले ग्रयमों की सूची के सयथ प्रमुख धबन्िओुं के भू-धनििेयंक उपयबंि II के रूप में उपयबद्ध हैं ।
2. पयररधथथधर्क सवंिेी जोन के धलए आचंधलक महयर्ोजनय –(1) रयज्र् सरकयर, पयररधथ थधर्क संवेिी जोन के प्रर्ोजन के धलए रयजपत्र में इस अधिसूचनय के प्रकयिन की र्यरीख से िो वषा की अवधि के भीर्र, थथयनीर् व्यधिर्ों के परयमिा से, इस अधिसूचनय में संलग् न अनुबंिों के सयमंजथ र् से आंचधलक महयर्ोजनय र्ैर्यर करेगी ।
(2) आंचधलक महयर्ोजनय रयज् र् सरकयर में सक्षम प्रयधिकयरी द्वयरय अनुमोदिर् होगी ।
(3) पयररधथ थधर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय इस अधिसचूनय में धवधनर्दिष् ट रूप में ससी रीधर् में रयज् र् सरकयर र्थय सुसंगर् कें रीर् सरकयर और रयज् र् सरकयर धवधिर्ों के सयमंजथ र् में भी र्थय कें रीर् सरकयर द्वयरय जयरी मयगाधनििे, र्दि कोई हों, द्वयरय र्रै्यर होगी ।
(4) आंचधलक महयर्ोजनय सभी संबंधिर् रयज् र् सरकयर के धवभयगों के परयमिा से र्ैर्यर होगी, अथयार्प --
(i) पर्यावरण ;
(ii) वन ;
(iii) िहरी धवकयस ;
(iv) पर्ाटन ;
(v) नगरपयधलकय ;
(vi) रयजथ व ;
(vii) कृधष ; और
(viii) उडीसय रयज् र् प्रिषूण धनर्ंत्रण बोडा।
(5) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन भू-उपर्ोग, अवसंरचनयत् मक और दरियर्यकलयपों पर कोई धनबबंधिन अधिरोधपर् नह करेगी जब र्क दक इस अधिसूचनय में और आचंधलक महयर्ोजनय में सभी अवसंरचनय और अधिक प्रभयवी और पयररधथ थधर्क अनुकूल दरियर्यकलयप कयरक इस प्रकयर धवधनर्दिष् ट न हो ।
(6) आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षते्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबंिन, भूर्ल जल के प्रबंिन, मृिय और नमी संरक्षण, थथयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधथथधर्क और पर्यावरण स ेसंबंधिर् ससे अन्र् पहलूओं, धजन पर ध्र्यन िनेय आवश्र्क ह,ै के धलए उपबंि होंगे ।
(7) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय थ थलों, ग्रयमों और नगरीर् बंिोबथर्ों, वनों के प्रकयर और दकथ मों, कृधष क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षेत्र जैसे उद्ययन और उसी प्रकयर के थ थयन, उद्ययन कृधष क्षेत्र, फलोउद्ययन, झीलों और अन्र् जल धनकयर्ों कय अभ्र्कंन करेगी और धवद्यमयन और प्रथर्यधवर् भूधम के उपर्ोग की धविेषर्यओं के ब्र्ौरे िरे्े हुए मयनधचत्रों द्वयरय समर्वथर् होगी । II (ii) 3
(8) आंचधलक महयर्ोजनय पयररधथ थधर्क संवेिी जोन में धवकयस को पयररधथ थधर्क अनुकूल धवकयस और थ थयनीर् समुियर्ों की जीवकोपयजान को सुधनधश् चर् करर्े हुए धवधनर्धमर् और अधिसूचनय में धवधनर्दिष्ट संवर्विर् दरियर्यकलयप होगी ।
(9) इस प्रकयर अनुमोदिर् आंचधलक महयर्ोजनय इस अधिसूचनय के उपबंिों के अनुसयर धनगरयनीके अपने कयर्ों को करने के धलए धनगरयनी सधमधर् के धलए एक संिभा िथर्यवेज र्ैर्यर करेगी ।
3. रयज्र् सरकयर द्वयरय दकए जयन ेवयल ेउपयर्-- रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करने के धलए धनम्नधलधखर् उपयर् करेगी, अथयार्प :--
(1) भ-ूउपर्ोग - पयररधथ थधर्क संवेिी जोन में वनों, उद्ययन-कृधष क्षेत्रों, कृधष क्षेत्रों, आमोि-प्रमोि के प्रर्ोजन के धलए धचधन्हर् दकए गए पयकों और खुले थथयनों कय वयधणधज्र्क और औद्योधगक संबद्ध धवकयस दरियर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नह होगय :
परंर्ु पयररधथथधर्क संवेिी जोन के भीर्र कृधष भूधम कय संपररवर्ान, धनगरयनी सधमधर् की धसफयररि पर और रयज्र् सरकयर के पूवा अनुमोिन से, थथयनीर् धनवयधसर्ों की आवयसीर् जरूरर्ों को पूरय करने के धलए और पैरय 4 की सयरणी के थर्ंभ (2) के सूचीबद्ध दरियर्यकलयपों को पूरय करने के धलए अनुज्ञयर् होंगे, अथयार्प :-
(i) प्रिषूण उत्पन्न न करने वयले लघु उद्योग,
(ii) पयररधथ थधर्क अनुकूल पर्ाटन दरियर्यकलयपों के धलए पर्ाटकों के अथ थयर्ी आवयसन के धलए पयररधथ थधर्क अनुकूल आरयमगयह जैसे टेंट, लकडी के मकयन आदि ;
(iii) वषया जल संचर्, और
(iv) कुटीर उद्योग, धजसके अंर्गार् ग्रयमीण कयरीगर भी हैं परंर्ु र्ह और दक रयज्र् सरकयर के पूवा अनुमोिन और संधवियन के अनुच् छेि 244 के उपबंिों और र्त्समर् प्रवृत्त धवधि के उपबंिों के अनुपयलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै वयधणधज्र्क र्य उद्योग धवकयस दरियर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नह होगय :
परंर्ु र्ह और भी दक पयररधथ थधर्क संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई त्रुरट धनगरयनी सधमधर् के धवचयर प्रयप्त करने के पश्चयर्प रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमले में केवल एक बयर संिोधिर् होगी और उि त्रुरट के संिोिन की कें रीर् सरकयर के पर्यावरण वन और जलवयर्ु पररवर्ान मंत्रयलर् को सूचनय िनेी होगी । परंर्ु र्ह और भी दक उपर्ुाि त्रुरट कय संिोिन में इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी ििय में भू-उपर्ोग कय पररवर्ान सधम्मधलर् नह होगय । परंर्ु र्ह और भी दक धजससे हररर् क्षेत्र में जैसे वन क्षेत्र, कृधष क्षेत्र आदि में कोई पयररणयधमक कटौर्ी नह होगी और अनप्रर्ुक् र् र्य अनुत् पयिक कृधष क्षेत्रों में पुन वनीकरण करने के प्रर्यस दकए जयएंगे ।
(2) प्रयकृधर्क जल स्रोर्ों -- आचंधलक महयर्ोजनय में सभी प्रयकृधर्क जल स्रोर्ों की पहचयन की जयएगी और उनके संरक्षण और पुनरुद्भूर्करण के धलए र्ोजनय सधम् मधलर् होगी और रयज् र् सरकयर द्वयरय ससे क्षेत्रों पर र्य उनके धनकट धवकयस दरियर्यकलयप प्रधर्धषद्ध करने के धलए ससी रीधर् से मयगाधनििे र्ैर्यर दकए जयएंगे ।
(3) पर्ाटन – (क) पयररधथथधर्क संवेिी जोन के भीर्र पर्ाटन संबंिी दरियर्यकलयप, जो आंचधलक महयर्ोजनय कय भयग रूप में धनम्नधलधखर् रूप में होंगे । (ख) पर्ाटन महयर्ोजनय पर्ाटन धवभयग, उडीसय सरकयर द्वयरय रयजथ व और वन धवभयग, उडीसय सरकयर के परयमिा से र्ैर्यर होगी । (ग) पर्ाटन महयर्ोजनय आंचधलक महयर्ोजनय के एक घटक के रूप में होगी । (घ) पर्ाटन संबंिी दरियर्यकलयप धनम् नधलधखर् के अिीन धवधनर्धमर् होंगे, अथयार्प -
(i) पयररधथथधर्क अनुकूल पर्ाटन दरियर्यकलयप से संबंधिर् पर्ाटकों के अथथयर्ी अधिभोग के धलए वयस सुधविय के धसवयर् संरधक्षर् क्षेत्र डेधिगढ़ वन् र्जीव अभर्यरण्र् की सीमय से एक दकलोमीटर र्क र्य पयररधथथधर्क संवेिी जोन के धवथर्यर र्क इनमें जो भी धनकट ह,ै नर्े वयधणधज्र्क होटल और ररसोटा अनुज्ञयर् नह होंगे। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंर्ु, जहयाँ पयररधथथधर्क संवेिी जोन कय धवथर्यर एक दकलोमीटर से ज्र्यिय ह ैवहयाँ, एक दकलोमीटर से परे और पयररधथथधर्क संवेिी जोन के धवथर्यर र्क सभी नए पर्ाटक दरियर्यकलयप र्य धवद्यमयन दरियर्यकलयप कय धवथर्यर पर्ाटन महयर्ोजनय के अनुसयर होगय;
(ii) पयररधथथधर्क संवेिी जोन के भीर्र सभी नए पर्ाटन दरियर्यकलयपों र्य धवद्यमयन पर्ाटन दरियर्यकलयपों कय धवथर्यर कें रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् के मयगाििाक धसद्धयंर्ों के द्वयरय र्थय रयष् रीर् व् र्यघ्र स संरक्षण प्रयधिकरण, द्वयरय जयरी पयररधथथधर्क पर्ाटन (समर्-समर् पर र्थय संिोधिर्) मयगाििाक धसद्धयंर्ों के अनुसयर होगय;
(iii) आंचधलक महयर्ोजनय कय अनमुोिन दकए जयन ेर्क, पर्ाटन के धलए धवकयस और धवद्यमयन पर्ाटन दरियर्यकलयपों के धवथर्यर को वयथर्धवक थथल धवधनर्दिष्ट संवीक्षय र्थय धनगरयनी सधमधर् की धसफयररि पर आियररर् संबंधिर् धवधनर्यमक प्रयधिकरणों द्वयरय अनुज्ञयर् दकर्य होगय ।
(4) नसैर्वगक धवरयसर् – पयररधथथधर्क संवेिी जोन में महत्वपूणा नैसर्वगक धवरयसर् के सभी थथलों जैसे सभी जीन कोि आरधक्षर् क्षेत्र, िैल धवरचनयएं, जल प्रपयर्ों, झरनों, घयटी मयगों, उपवनों, गुफयओं, थथलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और उन्हें परररधक्षर् दकर्य जयएगय र्थय उनकी सुरक्षय और संरक्षय के धलए इस अधिसूचनय के प्रकयिन की र्यरीख से छह मयस के भीर्र, उपर्ुि र्ोजनय बनयई जयएगी और ससी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगी ।
(5) मयनव धनर्वमर् धवरयसर् थ थल – पयररधथ थधर्क संवेिी जोन में भवनों, संरचनयओं, धिल्प-र्थ्र्, सधर्हयधसक, कलयत्मक और सयंथकृधर्क महत्व के क्षेत्रों की पहचयन की जयएगी और इस अधिसूचनय के प्रकयिन की र्यरीख से छह मयस के भीर्र उनके संरक्षण की र्ोजनयएं र्ैर्यर की जयएंगी र्थय आंचधलक महयर्ोजनय में सधम्मधलर् की जयएंगी ।
(6) ध् वधन प्रिषूण – पयररधथथधर्क संवेिी जोन में रयज्र् सरकयर कय पर्यावरण धवभयग र्य उडीसय रयज्र् सरकयर धनवयरण और ध्वधन प्रिषूण धनर्ंत्रण पर्यावरण (संरक्षण) अधिधनर्म, 1986 के अिीन ध्वधन (धवधनर्मन और धनर्ंत्रण) धनर्म 2000 के अनुसयर संकधलर् दकर्य जयएगय ।
(7) वयर् ुप्रिषूण -- पयररधथथधर्क संवेिी जोन में वयर्ु प्रिषूण के धनर्ंत्रण के धलए वयर्ु (प्रिषूण धनवयरण और धनर्ंत्रण) अधिधनर्म 1981 (1981 कय 14) और इसके अिीन दकए गए धवधनर्मों के अनुसयर संकधलर् दकर्य जयएगय ।
(8) बधहस्रयव कय धनथसयरण -- पयररधथथधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनथसयरण सयियरण मयनकों के धलए पर्यावरणीर् प्रिधूषर् आच्छयदिर् के धनथसयरण के अंर्गार् पर्यावरणीर् (संरक्षण) अधिधनर्म, 1986 और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर होगय।
(9) ठोस अपधिष्ट -- ठोस अपधिष्टों कय धनपटयन धनम्नधलधखर् रूप में होगय -
(i) पयररधथथधर्क संवेिी जोन में ठोस अपधिष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय.आ. 1357(आ), र्यरीख 8 अप्रैल, 2016 ठोस अपधिष्ट प्रबंि धनर्म, 2016 के उपबिंों के अनुसयर दरियर्यधन्वर् दकर्य जयएगय ;
(ii) अकयबाधनक सयमग्री पयररधथथधर्क संवेिी जोन बयह्य पहचयन की गई थथल पर थवीकयर्ा रीधर् में व्यर् दकर्य जयएगय ;
(iii) ठोस अपधिष्टों के ज्वलन र्य भथमीकरण और भरयई कय थथयपनय पयररधथथधर्क संवेिी जोन में अनुज्ञय नह की जयएगी ;
(10) जैव धचदकत् सीर् अपधिष् ट- पयररधथथधर्क संवेिी जोन में समर्-समर् पर र्थय संिोधिर् जैव धचदकत्सीर् अपधिष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 343 (अ), र्यरीख 28 मयचा 2016 द्वयरय प्रकयधिर् जैव धचदकत्सीर् अपधिष्ट प्रबिं धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ।
(i) पयररधथथधर्क संवेिी जोन में कोई सयियरण उपचयर सुधविय र्य भथमीकरण अनुज्ञयर् नह दकर्य जयएगय ।
(ii) पयररधथथधर्क संवेिी जोन के भीर्र धवद्यमयन व्यधथटक अथपर्यलों र्य धनजी थवयथथ्र् कें रों के संरधक्षर् क्षेत्र पर प्रधर्कूल समयघयर् से बचने के धलए पर्याप्त अपधिष्ट उपचयर प्रणयली प्रियन करेगय।
(11) प्लयधथटक अपधिष्ट प्रबिंन - पयररधथथधर्क संवेिी जोन में प्लयधथटक अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 340(अ), र्यरीख 18 मयचा, 2016 द्वयरय प्रकयधिर् प्लयधथटक अपधिष्ट प्रबंि धनर्म 2016 के उपबंिों के अनुसयर दकर्य जयएगय। II (ii) 5
(12) धनमयाण और धवध्वसं अपधिष्ट प्रबिंन - पयररधथथधर्क संवेिी जोन में संधनमयाण और धवध्वंस अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 317(अ), र्यरीख 29 मयचा, 2016 द्वयरय प्रकयधिर् संधनमयाण और धवध्वंस प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(13) ई–अपधिष्ट:- पयररधथथधर्क संवेिी जोन में ई–अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् द्वयरय प्रकयधिर् ई–अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(14) र्यनीर् पररवहन - पररवहन की र्यनीर् गधर्धवधिर्यं आवयस के अनुकूल धवधनर्धमर् होंगी और इस संबंि में आंचधलक महयर्ोजनय में धविेष उपबंि अधिकधथर् दकए जयएंग ेऔर आंचधलक महयर्ोजनय के र्ैर्यर होने और रयज्र् सरकयर के सक्षम प्रयधिकयरी द्वयरय के अनुमोदिर् होने र्क, धनगरयनी सधमधर् प्रवृत्त धनर्मों और धवधनर्मों के अनुसयर र्यनीर् गधर्धवधिर्ों के अनुपयलन को धनगरयनी करेगी ।
(15) र्दि र्ह आवश्र्क समझर्य ह,ै इस अधिसूचनय के उपबंिों को प्रभयवी करने में केन्रीर् सरकयर और रयज्र् सरकयर, अन्र् उपयर्ों धनर्दिष्ट करेगय।
4. पयररधथथधर्क सवंिेी जोन में प्रधर्धषद्ध और धवधनर्धमर् दरियर्यकलयपों की सचूी - पयररधथथधर्क संवेिी जोन में सभी दरियर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) के उपबंिों द्वयरय ियधसर् होंगे और नीच ेिी गई सयरणी में धवधनर्दिष्ट रीधर् में धवधनर्धमर् होंग,े अथयार्प :-- सयरणी रियम स.ं दरियर्यकलयप टीकय-रटप्पणी

1. वयधणधज्र्क खनन, पत्थर की खियन और उनको र्ोडने की इकयइर्यं । (क) सभी प्रकयर के नए और धवद्यमयन खनन (लघु और वृहर् खधनज), पत्थर की खयनें और उनको र्ोडने की इकयइर्यं वयथर्धवक थथयनीर् धनवयधसर्ों की ििेी आवश्र्कर्यओं धजसमें धनजी उपर्ोग के धलए मकयनों के संधनमयाण र्य मरम्मर् के धलए िरर्ी को खोिनय और मकयन बनयने के धलए ििेी ईंटों कय धनमयाण करनय भी सधम्मधलर् ह,ै के धसवयर् नह होंगी ;
(ख) खनन संदरियर्यएं, मयननीर् उच्चर्म न्र्यर्यलर् की ररट र्यधचकय (धसधवल) सं. 1995 कय 202 टी.एन. गौडयबमान धथरुमूलपयि बनयम भयरर् सरकयर के मयमले में आििे र्यरीख 4 अगथर्, 2006 और ररट र्यधचकय (सी) सं. 2012 कय 435 गोवय फयउंडेिन बनयम भयरर् सरकयर के मयमले में र्यरीख 21 अप्रैल, 2014 के अंर्ररम आििे के अनुसरण में सवािय प्रचयलन होगय ।
2. आरय धमलों की थथयपनय । पयररधथथधर्क संवेिी जोन के भीर्र नई और धवद्यमयन आरय धमलों कय धवथ र्यर अनुज्ञयर् नह होगय ।
3. प्रिषूण (जल र्य वयर्ु र्य मृिय र्य ध् वधन) कयररर् करने वयले उद्योगों की थ थयपनय । (क) पयररधथथधर्क संवेिी जोन में नए उद्योग और उद्योगों में धवद्यमयन प्रिषूण कय धवथर्यर अनुज्ञय नह होगी। (ख)फरवरी, 2016 में जब र्क दक इस प्रकयर अधिसूचनय में धवधनर्दिष्ट न हो, कें रीर् प्रिषूण धनर्ंत्रण बोडा द्वयरय जयरी दिियधनििेों में उद्योगों के वगीकरण के अनुसयर पयररधथथधर्क संवेिी जोन के भीर्र केवल गैर- प्रिषूण कुटीर उद्योगों की अनुज्ञय िी जयएगी।
4. जलयवन लकडी कय वयधणधज्र्क उपर्ोग । लयग ूधवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्) ।
5. नई बृहर् जल धवद्युर् पररर्ोजनयओं की थथयपनय । लयगू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्) ।
6. दकसी पररसंकटमर् पियथों कय उपर्ोग र्य उत्पयिन र्य प्रसंथकरण। लयगू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्) ।

8. प्रयकृधर्क जल धनकयर्ों र्य सर्ही क्षेत्र में अनुपचयररर् बधहस्रयाव कय धनथसयरण । लयग ूधवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्) ।
9. ठोस अपधिष्ट धनपटयन थथल और ठोस और जैव धचदकत्सय अपधिष्ट के धलए सयियरण जलयए जयने की सुधविय की थथयपनय। पयररधथथधर्क संवेिी जोन में ठोस अपधिष्ट धनपटयन की कोई नई ठोस अपधिष्ट धनपटयन थथल और अपधिष्ट उपचयर/प्रसंथकरण सुधविय की अनुमधर् नह ह।ै इसके अधर्ररि औद्योधगक प्रदरियर्य और थवयथथ्र् प्रधर्ष्ठयन / अथपर्यलों आदि स े उत्पन्न दकसी भी ठोस अपधिष्ट के उपचयर के धलए सयमयन्र् र्य व्यधिगर् जलयवर्रण की सुधविय कय अधिकर्र प्रधर्धषद्ध ह।ै
10. फमों, कॉपोरेट, कंपधनर्ों द्वयरय बडे पैमयने पर वयधणधज्र्क पिुिन संपिय और कुक्कुट फयमों की थथयपनय । थथयनीर् जरूरर्ों को पूरय करने के धसवयर् लयगू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे।
11. ईंट भट्टों की थथयपनय करनय। लयगू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे । ख. धवधनर्धमर् दरियर्यकलयप
12. वृक्षों की कटयई । (क) रयज्र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनुमधर् के धबनय वन र्य सरकयरी र्य रयजथव र्य धनजी भूधम पर र्य वनों में ककही वृक्षों की कटयई नह होगी । (ख) वृक्षों की कटयई संबंधिर् कें रीर् र्य रयज्र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंि के अनुसयर धवधनर्धमर् होगी ।
13. होटलों और ररसोटों की वयधणधज्र्क थथयपनय । पयररधथथधर्क पर्ाटन दरियर्यकलयपों संबंिी पर्ाटकों की लघु संरचनयओं के धलए संरधक्षर् क्षेत्र की सीमय से एक दकलोमीटर र्क र्य पयररधथथधर्क संवेिी जोन के धवथर्यर र्क, इनमें जो भी धनकट ह,ै नए वयधणधज्र्क होटल और ररसोटा अनुज्ञयर् होंगे, अन्र्थय नह । परंर्ु, जहयाँ पयररधथथधर्क संवेिी जोन कय धवथर्यर एक दकलोमीटर से ज्र्यिय ह ै वहयाँ, एक दकलोमीटर से परे और पयररधथथधर्क संवेिी जोन के धवथर्यर र्क सभी नए पर्ाटक दरियर्यकलयप र्य धवद्यमयन दरियर्यकलयप कय धवथर्यर पर्ाटन महयर्ोजनय और र्थय लयगू मयगाििी धसद्धयंर्ों के अनुरुप होगय।
14. कृधष प्रणयली में प्रबल पररवर्ान । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
15. वयधणधज्र्क जल संसयिन धजसके अंर्गार् भू- जल संचर्न भी ह ै। (क) भूधम के अधिभोगी के वयथर्धवक कृधष और ििेी खपर् के धलए ही जल कय सर्ही और भूधमगर् जल धनष्कषाण अनुज्ञयर् होगय । (ख) औद्योधगक र्य वयधणधज्र्क उपर्ोग के धलए सर्ही और भूधमगर् जल के धनष्कषाण के धलए संबंधिर् धवधनर्यमक प्रयधिकयरी से पूवा धलधखर् अनुज्ञय अपेधक्षर् होगी धजसके अंर्गार् दकर्ने पररमयण में वह धनष्कषाण करेगय, भी है । (ग) सर्ही र्य भूजल कय धवरियर् अनुज्ञयर् नह होगय । (घ) दकसी भी स्रोर् से, धजसके अंर्गार् कृधष भी ह,ै जल के संिषूण र्य प्रिषूण को रोकने के धलए सभी उपयर् दकए जयएंग े।
16. धवद्युर् केबलों और िरूसंचयर टयवरों कय पररधनमयाण और केबल धबछयनय और अन्र् बुधनर्यिी ढयंचे । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । भूधमगर् केबल को बढ़यवय दिर्य जयएगय।
17. धवद्यमयन होटलों, लॉजों और ररसटो में बयड लगयनय । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
18. पोधलथीन बैगों कय उपर्ोग । पयररधथथधर्क संवेिी जोन के भीर्र पोधलथीन बैग के उपर्ोग की अनजु्ञय ह।ै र्थयधप, धवधिष्ट आवश्र्कर्य के आियर पर, लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
19. धवद्यमयन सडकों को चौडय करनय और सुिढृ करनय र्थय नई सडकों कय संधनमयाण । लयग ू धवधिर्ों के अनुसयर न्र्ूनीकरण की उपयर्ों के सयथ, धनर्म और धवधनर्मन और उपलब्ि दिियधनििे धवधनर्धमर् होंगे।
20. रयधत्र में र्यधनक र्यर्यर्यर् कय संचलन । धवधिर्ों के अिीन वयधणधज्र्क प्रर्ोजन के धलए धवधनर्धमर् होंगे ।
21. धवििेी प्रजयधर्र्ों को लयनय । धवधिर्ों के अिीन धवधनर्धमर् होंग े।
22. पहयडी ढयलों और निी र्टों कय संरक्षण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
23. वयर्ु (ध् वधन सधहर्) और र्यधनक प्रिषूण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । II (ii) 7
24. वयधणधज् र्क सयइनबोडा और होर्डडग । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
25. प्रयकृधर्क जल धनकयर्ों भू क्षेत्र में उपचयररर् अपधिष्ट/ बधहस्रयावों कय धनथसयरण । उपचयररर् अपधिष्ट जल/ बधहस्रयावों के धनथसयरण को जल धनकयर्ों में प्रवेि नह करने दिर्य जयएगय। उपचयररर् अपधिष्ट जल के पुनचरियण और पुन:
उपर्ोग के धलए दकए जयने वयले प्रर्यस अन्र्थय लयगू धवधिर्ों के अनुसयर उपचयररर् अपधिष्ट जल/ बधहस्रयाव कय धनथसयरण धवधनर्धमर् दकर्य जयएगय।
26. वन उत्पयिों र्य गैर कयष् ठ वन उत्पयिों कय संग्रहण (एनटीएफपी) । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
27. सुरक्षय बल कैं प । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
28. नए कयष्ठ आियररर् उद्योग। पयररधथ थधर्क संवेिी जोन की सीमय के भीर्र नए कयष् ठ आियरर र् उद्योगों की थ थयपनय को अनुज्ञयर् नह दक र्य जयएगय परंर्ु नए कयष्ठ आियररर् उद्योग 100% आर्यधर्र् कयष्ठ थटयक को प्रर्ोग में लयर्े हुए पयररधथथधर्क संवेिी जोन में थथयधपर् दकए जय सकें गे ।
29. पयररधथ थधर्क अनुकूल पर्ाटक दरियर्यकलयपों के धलए, पर्ाटकों के अथथयर्ी आवयसन के धलए पयररधथ थधर्क अनुकूल कुटीर, जैसे र्ंबू, लकडी के घर आदि। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
30. संधनमयाण दरियर्यकलयप । संरधक्षर् क्षेत्र र्य पयररधथथधर्क संवेिी जोन जो भी धनकट हो, की सीमय से एक दकलोमीटर के भीर्र दकसी भी प्रकयर कय नर्य वयधणधज्र्क संधनमयाण अनुज्ञयर् नह दकर्य जयएगय (क) परंर्ु थथयनीर् धनवयधसर्ों की आवयसीर् आवश्र्कर्यओं को पूरय करने के धलए थ थयनीर् लोगों को उप पैरय (1) में सूचीबद्ध दरियर्यकलयपों सधहर् उनके उपर्ोग के धलए उनकी भूधम में संधनमयाण करने की अनुमधर् भवन उपधवधिर्ों के अनुसयर िी जयएगी जैसे:-
(i) धवद्यमयन सडकों को चौडय करनय और उन्हें सुिढृ़ करनय र्थय नई सडकों कय संधनमयाण;
(ii) बुधनर्यिी ढयंचों और नयगररक सुख सुधवियओं कय संधनमयाण और नवीकरण;
(iii) कुटीर उद्योगों धजसके अंर्गार् ग्रयमीण उद्योग भी हैं; सुधवियजनक भण्डयर और थथयनीर् सुख सुधवियएं जो पयररधथथधर्क पर्ाटन धजसमें गृह वयस भी ह ैसहयर्क हो; और
(iv) इस अधिसूचनय में संवर्विर् दरियर्यकलयपों की सूची।
31. नयगररक सुधवियओं सधहर् बुधनर्यिी ढयंचे। लयग ू धवधिर्ों के अनुसयर न्र्ूनीकरण की उपयर्ों के सयथ, धनर्म और धवधनर्मन और उपलब्ि दिियधनििे धवधनर्धमर् होंगे।
32. खलेु कुआ, बोर कुआ, आदि के धलए कृधष और अन्र् उपर्ोग । धवधनर्धमर् और उपर्ुि प्रयधिकयरी द्वयरय दरियर्यकलयपों की सख्र्ी से धनगरयनी की जयएगी।
33. ठोस अपधिष् ट प्रबंिन। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
34. पयररधथथधर्क पर्ाटन। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । ग. सवंर्विर् दरियर्यकलयप
35. थथयनीर् समुियर्ों द्वयरय चल रही कृधष और बयगवयनी पद्धधर् के सयथ पिुपयलन, पिुपयलन कृधष, जल कृधष और मत्थर् पयलन। धवधिर्ों के अिीन अनुज्ञयर् होंग।े
36. प्रिषूण उत्पन्न न करने वयले लघु उद्योग । फरवरी, 2016 में केन्रीर् प्रिषूण धनर्ंत्रण बोडा द्वयरय जयरी उद्योगों में वगीकरण के अनुसयर गैर-प्रिषूणकयरी उद्योग और अपररसंकट में, लघु और सेवय उद्योग, कृधष, पुष्प कृधष, उद्ययन कृधष र्य पयररधथथधर्क संवेिी जोन स े ििेी सयमग्री स े उत्पयिों को उत्पन्न करने वयले कृधष आियररर् उद्योग सक्षम प्रयधिकयरी द्वयरय अनुज्ञयर् होंगे।

5. धनगरयनी सधमधर्- (1) कें रीर् सरकयर, पयररधथथधर्क संवेिी जोन के प्रभयवी धनगरयनी सधमधर् कय गरठर् करर्ी ह ैजो धनम्नधलधखर् से धमलकर बनेगी, अथयार्प :- (क) धजलय कलक्टर, बरगढ़, उडीसय सरकयर - अध्र्क्ष;
(ख) पुधलस अिीक्षक धजलय बरगढ़ – सिथर्;
(ग) पर्यावरण के क्षेत्र में कयर्ा करने वयले गैर सरकयरी संगठनों कय उडीसय सरकयर द्वयरय नयमधनर्दिष्ट एक प्रधर्धनधि – सिथ र् ;
(घ) पयरर धथ थ धर् क और पर्यावरण के क्षेत्र में उडीसय सरकयर द्वयरय नयमधनर्दिष्ट दकए जयने वयलय एक धविेषज्ञ- सिथर् ;
(ङ) उडीसय रयज्र् जैव-धवधविर्य बोडा कय सधचव-सिथर् र्य सिथर् - सिथर् ;
(च) प्रभयगीर् वन अधिकयरी, बरगढ़ प्रभयग -सिथ र्;
(छ) क्षेत्रीर् अधिकयरी, उडीसय प्रिषूण धनर्ंत्रण बोडा - सिथर् ;
(ज) प्रभयगीर् वन अधिकयरी, हीरयकंुड वन्र्जीव प्रभयग - सिथ र्-सधचव । धनििे धनबंिन
(1) धनगरयनी सधमधर् कय कयर्ाकयल अधिसूचनय जयरी करने की र्यरीख से र्ीन वषा की अवधि के धलए होगय।
(2) धनगरयनी सधमधर् इस अधिसूचनय के उपबंिों के अनुपयलन को धनगरयनी करेगी ।
(3) पयररधथथधर्क संवेिी जोन में भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अनुसूची के अिीन सधम्मधलर् दरियर्यकलयपों और इस अधिसूचनय के पैरय 4 के अिीन प्रधर्धषद्ध गधर्धवधिर्ों के धसवयर् आन े वयले ससे दरियर्यकलयपों की ििय में वयथर्धवक धवधनर्दिष्ट थथलीर् िियओं पर आियररर् धनगरयनी सधमधर् द्वयरय संवीक्षय की जयएगी और उि अधिसूचनय के उपबंिों के अिीन पूवा पर्यावरण धनकयसी के धलए केन्रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को धनर्दिष्ट की जयएगी । उद्योगों की केवल श्वेर् श्रेधणर्ों को "उद्योगों, 2016 कय वगीकरण" के धलए सीपीसीबी द्वयरय जयरी दिियधनििेों में धनर्दिष्ट के रूप में मयनय जयएगय।
(4) इस अधिसूचनय के पैरय 4 के अिीन र्थय-धवधनर्दिष्ट प्रधर्धषद्ध दरियर्यकलयपों के धसवयर्, भयरर् सरकयर के र्त्कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय संख्र्यंक कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 और कय.आ. 19(अ), र्यररख 6 जनवरी, 2011 और अधिसूचनय के अनुसूची के अिीन ससे दरियर्यकलयपों, धजन्हें सधम्मधलर् नह दकर्य गर्य ह,ै परंर्ु पयररधथथधर्क संवेिी जोन में आर् ेहैं, सस े दरियर्यकलयपों की वयथर्धवक धवधनर्दिष्ट थथलीर् िियओं पर आियररर् धनगरयनी सधमधर् द्वयरय संवीक्षय की जयएगी और उसे संबद्ध धवधनर्यमक प्रयधिकरणों को धनर्दिष्ट दकर्य जयएगय ।
(5) धनगरयनी सधमधर् कय सिथर्-सधचव र्य संबद्ध कलक्टर र्य संबंधिर् मुख्र् वन संरक्षक ससे व्यधि के धवरूद्ध, जो इस अधिसूचनय के दकसी उपबंि कय उल्लंघन करर्य ह,ै पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 19 के अिीन पररवयि फयइल करने के धलए सक्षम होगय । II (ii) 9
(6) धनगरयनी सधमधर् मुद्दों के आियर पर अपेक्षयओं पर धनभार रहर्े हुए संबद्ध धवभयगों के प्रधर्धनधिर्ों र्य धविेषज्ञों, औद्योधगक संगमों र्य संबद्ध पणियररर्ों के प्रधर्धनधिर्ों को अपने धवचयर-धवमिा में सहयर्र्य के धलए आमंधत्रर् कर सकेगी ।
(7) धनगरयनीसधमधर् प्रत्र्ेक वषा की 31 मयचा र्क रयज् र् के मुख् र् वन् र्जीव वयडान को अपनी वयर्वषक कयरावयई ररपोटा उपयबिं III में उपबंधिर् रूप में उक् र् वषा के 30 जून र्क प्रथर्ुर् करेगी ।
(8) केन्रीर् सरकयर कय पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् धनगरयनीसधमधर् को अपन ेकृत्र्ों के प्रभयवी धनवाहन के धलए समर्-समर् पर ससे धनििे ि ेसकेगय, जो वह ठीक समझ े।

8. कोई अन् र् महत् वपूणा धवषर् । II (ii) 19 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 7th June, 2017 S.O. 1814(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3333 (E), dated the 10 th December, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, the copies of the Gazette containing the draft notification were made available to the public on the 10 th December, 2015;
AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the draft notification were duly considered;
AND WHEREAS, the Debrigarh Wildlife Sanctuary, located in the Bargarh district of Odisha, forms an important site for in-situ conservation of wildlife and the said Sanctuary covers an area of 353.81 square kilometres and is located between 21.28’ 30’’ and 21.43’ 30’’ North latitudes and between 83.30’ and
83.46’30’’ East longitudes;
AND WHEREAS, the aforesaid Sanctuary is home to an immense array of biodiversity, over 40 species of mammals, 234 species of birds, 41 species of reptiles, 12 species of amphibians, 42 species of fishes, 39 species of odonates, 85 species of butterflies and 38 species of spiders and the said Wildlife Sanctuary is extremely important in the national context because of significant population of Schedule-I species like Leopard (Panthera pardus), Indian Gaur (Bos gaurus), and Four-horned Antelope (Tetracerus quadricornis);
AND WHEREAS, the said sanctuary is fringed on the east and north by the huge man-made water body of Hirakud reservoir, thus forming one of the selected few sanctuaries in the state supporting both terrestrial and aquatic biodiversity and this further attracts a significant number of migratory waterfowls during the winter season; the said Wildlife Sanctuary is home to over 250 plant species, many of which possess ethnobotanical and medicinal values;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of the Debrigarh Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1), clause (v) and clause
(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 2 to 5 kilometres from the Debrigarh Wildlife Sanctuary in the State of Odisha as the Debrigarh Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Ecosensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1)The extent of Eco-sensitive Zone varies from 2 kilometres to 5 kilometres from the boundary of the Debrigarh Wildlife Sanctuary and the area of the Eco- Sensitive Zone is 519.67 square kilometres.
(2) The map of Debrigarh Wildlife Sanctuary demarcating the Eco-sensitive Zone boundary along with the geo co-ordinates are appended as Annexure I and I(A).
(3) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure II.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, for integrating environmental and ecological considerations into it, namely:- i. Environment;
ii. Forest;
iii. Urban Development;
iv. Tourism;
v. Municipal;
vi. Revenue;
vii. Agriculture; and viii. Odisha State Pollution Control Board.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas such as parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited, regulated and promoted activities specified in this notification so as to ensure Eco-friendly development for livelihood security of local communities.
(9) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions with respect to the provisions given in this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:-
(i) small scale industries not causing pollution;
(ii) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism activities;
(iii) rainwater harvesting; and
(iv) cottage industries including village artisans:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or restrict development activities within the catchment areas.
(3) Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Odisha in consultation with Department of Revenue and Forests, Government of Odisha.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities relating to tourism shall be regulated as under, namely.-
(i) no new construction of hotels and resorts shall be allowed within one kilometre from the boundary of the Debrigarh Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that, beyond the distance of one kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts may be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or Odisha State Pollution Control Board shall implement the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- Regulation for the control of air pollution in the Eco-Sensitive Zone shall be in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and the rules made there under.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Ecosensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28 th March, 2016, as amended from time to time.
(i) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(ii) Individual hospitals or private health centres already existing within the Eco Sensitive Zone shall provide adequate waste treatment system to avoid adverse impact on the Protected Area.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.- The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:- Table Sl. 1. Commercial mining, stone quarrying and crushing units.
(a) New (minor and major minerals), stone quarrying and crushing units shall be prohibited except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for personal consumption.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04 th August, 2006 in the matter of T.N.
Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting of industries causing pollution (water, air, soil, noise, etc.).
(a) No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
(b) Only non-polluting industries may be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
5. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
6. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
7. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.
Prohibited (except as otherwise provided) as per applicable laws.
8. Discharge of untreated effluents in natural water bodies or land area.

9. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste No new solid waste disposal site and waste treatment/processing facility of solid waste shall be permitted within Eco sensitive zone and Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc.

10. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc..

12. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.
13. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for ecotourism activities:
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
14. Drastic change of agriculture system. Regulated under applicable laws.
15. Commercial water resources including ground water harvesting.
(a)The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.
(b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned regulatory authority.
(c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
16. Erection of electrical and communication towers and laying of cables and other infrastructures Regulated under applicable laws. (underground cabling may be promoted).
17. Fencing of existing premises of hotels, lodges and resorts.
Regulated under applicable laws.
18. Use of polythene bags. Use of polythene bags may be permitted within the Eco Sensitive Zone, however, based on specific requirement, it shall be regulated under applicable laws.
19. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulations and available guidelines.
20. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
21. Introduction of exotic species. Regulated under applicable laws.
22. Protection of hill slopes and river banks. Regulated under applicable laws.
23. Air (including noise) and vehicular pollution. Regulated under applicable laws.
24. Commercial sign boards and hoardings. Regulated under applicable laws.
25. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water, and the discharge of treated waste water/effluent shall be regulated as per applicable laws.
26. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
27. Security Forces Camp. Regulated under applicable laws.
28. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone:
Provided that new wood based industry may be set up in the Eco-sensitive Zone using 100% imported wood stock.

29. Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, etc. for eco-friendly tourism activities.
Regulated under applicable laws.
30. Construction activities. No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents.
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) cottage industries including village industries;
convenience stores & local amenities supporting ecotourism including home stays; and
(iv) promoted activities listed in this Notification.
31. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulations and available guidelines.
32. Open well, bore well, etc. for agriculture or other usage.
Regulated under applicable laws and the activity shall be monitored by the cocerned authority.
33. Solid waste management. Regulated under applicable laws.
34. Eco-tourism. Regulated under applicable laws.
C. Promoted Activities:
35. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming and fisheries.
Permitted under applicable laws.
36. Small scale non polluting industries. Non polluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
37. Rain water harvesting. Shall be actively promoted.
38. Organic farming. Shall be actively promoted.
39. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted .
40. Adoption of green technology for all activities. Shall be actively promoted.
41. Vegetative fencing. Permitted under applicable laws.
42. Cottage industries including village artisans, etc. Shall be actively promoted.
43. Agro-forestry. Shall be actively promoted.
44. Use of eco-friendly transport. Shall be actively promoted.
45. Skill Development. Shall be actively promoted.
46. Restoration of degraded land/ forests/ habitat. Shall be actively promoted.
47. Environmental awareness. Shall be actively promoted.
5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(a) District Collector,Bargarh, Government of Odisha – Chairman;
(b) Superintendent of Police of Bargarh District – Member;
(c) Representative of Non-Governmental Organisations working in the field of environment to be nominated by the Government of Odisha – Member;

(d) One expert in the area of ecology and environment to be nominated by the Government of Odisha – Member;
(e) Member-Secretary or Member, Odisha State Biodiversity Board –Member;
(f) Divisional Forest Officer, Bargarh Division –Member;
(g) Regional Officer, Odisha State Pollution Control Board -Member; and
(h) Divisional Forest Officer, Hirakud Wildlife Division -Member Secretary.
Terms of reference:
(1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of publication of this notification Official Gazette.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment, 2006 vide S.O. 1533 (E), dated the 14th September, 2006, and Coastal Regulation Zone, 2011 vide S.O. No. 19(E) dated 6 th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14 th September, 2006 and S.O. 19 (E) dated 6 th January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wild Life Warden of the State as per proforma appended at Annexure III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
