PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 1608] ubZ fnYyh] cq/okj] twu 7] 2017@T;s"B 17] 1939 No. 1608] NEW DELHI, WEDNESDAY, JUNE 7, 2017/JYAISTHA 17, 1939 पयाᭅवरणपयाᭅवरणपयाᭅवरणपयाᭅवरण, , , , वनवनवनवन औरऔरऔरऔर जलवायुजलवायुजलवायुजलवायु पᳯरवतᭅनपᳯरवतᭅनपᳯरवतᭅनपᳯरवतᭅन मंᮢालयमंᮢालयमंᮢालयमंᮢालय अिधसचूनाअिधसचूनाअिधसचूनाअिधसचूना नई ᳰद᭨ली, 6 जून, 2017 काकाकाका....आआआआ.... 1815181518151815 ((((अअअअ)))).—ᮧाᱧप अिधसूचना भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 3340(अ), तारीख 10 ᳰदस᭥बर, 2015, ᳇ारा भारत के राजपᮢ असाधारण मᱶ ᮧकािशत कᳱ गई थी िजसमᱶ उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह उᲦ ᮧाᱧप अिधसूचना अंतᳶव᳥ ह,ै जनता को उपल᭣ध करा दी गई थᱭ, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमंिᮢत ᳰकए गए थ;े और, राजपᮢ, िजसमᱶ उᲦ अिधसूचना अंतᳶव᳥ ह,ै कᳱ ᮧितयां जनता को तारीख 10 ᳰदस᭥बर, 2015, को उपल᭣ध करा दी गई थᱭ;
और, पूवᲃᲦ ᮧाᱧप अिधसूचना के ᮧ᭜युᱫर मᱶ ᳞िᲦयᲂ और पणधाᳯरयᲂ से कोई आᭃेप और सुझाव ᮧा᳙ नहᱭ ᱟए थ;े और, कनाᭅटक सरकार कᳱ अिधसूचना सं एफईई 140 एफड᭣᭨यू एल 93, तारीख 3 अᲦूबर, 2000 के अनुसार अिधसूिचत अᱫीवेरी पᭃी अ᭤यार᭛य कनाᭅटक रा᭔य के उᱫर क᳖ड़ और धारवाड़ िजलᲂ के मुडगोह तथा कलघाटकᳱ कᳱ तालुक कᳱ सीमाᲐ मᱶ अवि᭭थत ह ैऔर 2.226 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ ह;ै और, ᭭थानीय कृषकᲂ कᳱ ᳲसचाई संबंधी आव᭫यकताᲐ कᳱ पूᳶत करने के िलए अᱫीवेरी ᮕाम मᱶ ᭝याबंहाला पर 1992 मᱶ एक ᳲसचाई जला᭫य बनाया गया था िजसके पᳯरणामᱨवᱨप िविभ᳖ ᳰक᭭मᲂ के पᭃी ᭭थानीय और ᮧवासी पिᭃयᲂ दोनᲂ आकᳶषत ᱟए। पहले वषᭅ 20 पिᭃयᲂ कᳱ ᮧजाितयᲂ, उसके बाद अगले वषᭅ 35 ᮧजाितयᲂ को दखेा गया था।चूंᳰक जलाशय आस पड़ोस मᱶ िवपुल पोषणकारी भूभागᲂ वाले शांत तथा अिवᭃु᭣ ध पᳯरᭃेᮢ मᱶ आᮤᭅ 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पतझड़ी वन के म᭟ य मᱶ अवि᭭ थत ह,ै यह अपने ᮧजनन ᳰᮓयाकलापᲂ के िलए यहा ंआ᮰य पाने वाले पिᭃयᲂ के िलए ᭭ वगᭅ बन गया ह ै। और, इस मानव िनᳶमत ᮧाकृितक वास मᱶ 1200 से अिधक पिᭃयᲂ के जोड़ ेᮧजनन करते ᱟए पाए जाते ह ᱹ िजनमᱶ सफेद बु᭔ जा, बगुला, छोटा जलकौआ, चमचा चᲂच, रंगीन चमरखᱶच, जसैी कुछ ᮧजाितयां ह ᱹजो यहां ᮧजनन करती ह ᱹऔर ᳯटटहरी जलमुगᱮ पनलुआ, बांकर, भारतीय झबरा आᳰद जैसे पᭃी सालᲂ साल यहां पाए जाते ह ᱹ । सीखपरऔर, गागᱷनी, ितदारी, बटान आᳰद नवंबर मास से फरवरी मास के बीच ᮧजनन के िलए यहां ᮧवास करते ह ᱹ। मंुडागोड, हिलयल और येलापुर ता᭨ लुकᲂ के सिं᳖कट ᭃेᮢᲂ मᱶ बᱟत से छोटे और बड़ ेजलाशय भी पिᭃयᲂ के घᲂसला, उनको पोषण तथा ᮧजनन करन ेमᱶ भी सहायता करत ेह ᱹजो इस ᮧकार इस अ᭤यार᭛य को एक आदशᭅ जलीय ᮧाकृितक वास का िनमाᭅण करते ह ᱹ। और, अᱫीवेरी पᭃी अ᭤यार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाए ंइस अिधसचूना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण और पाᳯरि᭭थितक कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सरुिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ और उ᳒ोगᲂ के वगᲃ और उनके ᮧचालन तथा ᮧसं᭭करण करन ेको ᮧितिष करना आव᭫यक ह ै;
अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए, कनाᭅटक रा᭔ य मᱶ अᱫीवेरी पᭃी अ᭤यार᭛य कᳱ सीमा स े1 ᳰकलोमीटर से 1.90 ᳰकलोमीटर तक के पᳯरवतᱮ ᭃेᮢ को अᱫीवेरी पᭃी अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसके ᭣यौरे िन᳜ानुसार ह,ᱹ अथाᭅत् :—
1. पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंेदीसवंेदीसवंेदीसवंेदी जोनजोनजोनजोन काकाकाका िव᭭तारिव᭭तारिव᭭तारिव᭭तार औरऔरऔरऔर उसकᳱउसकᳱउसकᳱउसकᳱ सीमाएंसीमाएंसीमाएंसीमाए—ं(1) अ᭜ तीवेरी पᭃी अभयार᭛य कᳱ सीमा के इदᭅ िगदᭅ पाᳯरि᭭थितक संवेदी जोन का कुल ᭃेᮢ 1.0 ᳰकलोमीटर से 1.90 ᳰकलोमीटर तक कᳱ सीमा के साथ 10.70 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ ह ैऔर ऐसे जोन कᳱ सीमा का वणᭅन उपाबधंउपाबधंउपाबधंउपाबधं I के ᱧप मᱶ उपाब ह ै।
(2) पाᳯरि᭭थितक संवेदी जोन के मानिचᮢ तथा इसकᳱ सीमा के ᭣यौरᲂ के साथ अᭃांश और दशेा᭠तर उपाबधंउपाबधंउपाबधंउपाबधं II के ᱧप मᱶ उपाब ह ै।
(3) अᱫीवेरी पᭃी अभयार᭛य कᳱ सीमा पर तथा पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा पर ᮧमुख ᳲबदओु के भू- िनदᱷशांक उपाबंधउपाबंधउपाबंधउपाबंध III III III III के ᱧप मᱶ उपाब ह ै।
(4) अᱫीवेरी पᭃी अभयार᭛य के आस पास पाᳯरि᭭थितक संवेदी जोन मᱶ आने वाले ᮕामᲂ और ᳯरजवᭅ वन ᭃेᮢ का वणᭅन उपाबधंउपाबधंउपाबधंउपाबधं IV IV IV IV के ᱧप मᱶ उपाब ह ै।
2222.... पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महायोजनामहायोजनामहायोजनामहायोजना———— (1) रा᭔य सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ ᳰदए गए अनुबंधᲂ का पालन करते ᱟए आंचिलक महायोजना तैयार करेगी।
(2) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित इस अिधसूचना मᱶ िविन᳸द᭬ ट ᳰकए गए अनुसार तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के अनुᱧप और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(3) आंचिलक महायोजना, पाᳯरि᭭थितक और पयाᭅवरणीय बातᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत:्--
(i) पयाᭅवरण;
(ii) वन और व᭠यजीव;
(iii) कृिष ;
(iv) राज᭭ व;
(v) नगर िवकास;
(vi) पयᭅटन;
(vii) ᮕामीण िवकास;
(viii) ᳲसचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िन माᭅण िव भाग।
(4) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भ-ूउपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनकूुलता का संवधᭅन करेगी ।
(5) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण स ेसंबंिधत ऐसे अ᭠य पहलुᲐ, िजन पर ᭟यान दनेे कᳱ आव᭫यकता ह,ै के िलए उपबंध हᲂगे ।
(6) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी और इस योजना के साथ मानिचᮢ लगे हᲂगे िजनमᱶ िव᳒मान और ᮧ᭭तािवत भूिम के उपयोग कᳱ िवशेषताᲐ के ᭣यौरᱶ हᲂगे ।
(7) आंचिलक महायोजना पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगी और पैरा 4 मᱶ कᳱ सारणी मᱶ सूचीब ᮧितिष, िविनयिमत ᳰᮓयाकलापᲂ का अनवुतᭅन करेगी और ᭭थानीय समुदायᲂ कᳱ आजीिनका सुरᭃा के िलए पाᳯरि᭭थितक अनुकूल िवकास को सुिनि᳟त करेगी और उसका संवधᭅन करेगी ।
(8) इस ᮧकार अनुमोᳰदत आंचिलक महायोजना इस अिधसूचना मᱶ ᳰदए गए उपबंधᲂ के अनुसार मᱶ अपने मानीटरी के कायᲄ को करने के िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी ।
3. रा᭔यरा᭔यरा᭔यरा᭔य सरकासरकासरकासरकारररर ᳇ारा᳇ारा᳇ारा᳇ारा ᳰकएᳰकएᳰकएᳰकए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय----———— रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन ेके िलए िन᳜िलिखत उपाय करेगी, अथाᭅत:्—
(1) भूभभूूभू----उपयोग उपयोग उपयोग उपयोग ———— (क) पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजनᲂ के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक या आवासीय पᳯरसर या औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए ᭃेᮢᲂ मᱶ उपयोग या संपᳯरवतᭅन नहᱭ होगा:
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम और अ᭠य भूिमयᲂ का संपᳯरवतᭅन मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन स,े जो ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन े के िलए ह ैतथा ᳰᮓयाकलापᲂ के िलए जैस:े—
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;
(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण उ᳒ोग भी ह;ᱹ सुिवधाजनक भ᭛डारᲂ और ᭭थानीय सुिवधाए ं जो पाᳯरि᭭थितक पयᭅटन का समथᭅन करती ह ैᮕह वास सिहत; और
(v) संवᳶधत ᳰᮓयाकलाप जो पैरा 4 के अंतगᭅत ᳰदए गए ह:ै परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन तथा संिवधान के अन᭒ुछेद 244 और त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक और उ᳒ोिगक िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा:
परंतु यह भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ ᮧकट होने वाली कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करन ेके प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट के संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक हᳯरत ᭃेᮢ मᱶ जैस े वन ᭃेᮢ, कृिष ᭃेᮢ मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ िजसमᱶ पुन: वनीकरण और वास जीणᲃार ᳰᮓयाकलाप ह,ै करने के ᮧयास ᳰकए जाएगें ।
(2) ᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोत—आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ के आवाह ᭃेᮢᲂ, नᳰदयᲂ और जलमागᲄ कᳱ पहचान कᳱ जाएगी और उसमᱶ उनके सरंᭃण और पुनᱧ᭞भूतकरण के िलए योजना समािव᳥ होगी और रा᭔ य सरकार ᳇ारा ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएगें िजससे ऐस ेᭃेᮢᲂ मᱶ या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष ᳰकए जाएगें ।
(3) पयᭅटनपयᭅटनपयᭅटनपयᭅटन———— (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी । (ख) पयᭅटन महायोजना रा᭔य पयᭅटन िवभाग, ᳇ारा पयाᭅवरण और वन िवभाग के परामशᭅ से तैयार होगी । (ग) पयᭅटन के ᳰᮓयाकलाप िन᳜ानुसार िविनयिमत ᳰकए जाएगें, अथाᭅत् :—
(i) पाᳯरि᭭थितक अनकूुल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय अᱫीवेरी पᭃी अभयार᭛य कᳱ सीमा स ेएक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट ह,ै होटल और ᳯरसोटᭅ का नया सिंनमाᭅण अनु᭄ात नहᱭ होगा। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 परंतु, उᲦ अ᭤यार᭛य कᳱ सीमा स े एक ᳰकलोमीटर कᳱ दरूी से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, नए होटलᲂ और ᳯरसोटᲄ कᳱ पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितक पयᭅटन सुिवधाᲐ के िलए पूवᭅ अ᭤यांᳰकत तथा पदािभिहत ᭃेᮢᲂ मᱶ ही अनु᭄ात ᳰकए जाएगें;
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤ सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन मागᭅदशᭅक िसातंᲂ (समय-समय पर संशोिधत) के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दते े ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगकनसैᳶगकनसैᳶगकनसैᳶगक िवरासतिवरासतिवरासतिवरासत....———— पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाए,ं जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और िवरासत संरᭃण योजना उनकᳱ सरुᭃा और संरᭃा के िलए तैयार कᳱ जाएगी जो ऐसी आंचिलक महायोजना का भाग होगी ।
(5) मानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थलललल....———— पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक, सᲅदयᭅपरक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ और पᳯरवेश कᳱ पहचान कᳱ जाएगी और उनके संरᭃण के िलए िवरासत संरᭃण योजना आंचिलक महायोजना के ᱧप मᱶ तैयार कᳱ जाएगी ।
(6) ᭟ व᭟ व᭟ व᭟ विन ᮧदूिन ᮧदूिन ᮧदूिन ᮧदषूणषणषणषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण का िनवारण और िनयंᮢण के िलए ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ 2000 के अनुसार ᳰकया जाएगा। पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 के अधीन बनाए गए ।
(7) वायुवायुवायुवायु ᮧदषूणᮧदषूणᮧदषूणᮧदषूण — पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या कनाᭅटक रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ वाय ु(ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ावबिह᮲ावबिह᮲ावबिह᮲ाव काकाकाका िन᭭सारणिन᭭सारणिन᭭सारणिन᭭सारण.— पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण जल (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोसठोसठोसठोस अपिश᳥अपिश᳥अपिश᳥अपिश᳥ ....———— ठोस अपिश᳥ᲂ का िनपटान और ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा— (क) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान और ᮧबंधन भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ख) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाए ंतैयार करᱶगे ;
6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ग) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम स ेपुनःचᳰᮓत ᳰकया जाएगा ;
(घ) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकायᭅ रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।
(10) जवै िचᳰक᭜ सीजवै िचᳰक᭜ सीजवै िचᳰक᭜ सीजवै िचᳰक᭜ सीय अपिश᭬ टय अपिश᭬ टय अपिश᭬ टय अपिश᭬ ट.— जैव िचᳰक᭜ सीय अपिश᭬ ट ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा— (क) पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा-संशोिधत अिधसूचना सं. का.िन 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा । (ख) पाᳯरि᭭थितक संवेदी जोन मᱶ कोई सामा᭠य उपचार सुिवधा या जलाया जाना अनु᭄ात नहᱭ ᳰकया जाएगा ।
(11) ᭡लाि᭭टक᭡लाि᭭टक᭡लाि᭭टक᭡लाि᭭टक अपिश᳥अपिश᳥अपिश᳥अपिश᳥ ᮧबधंनᮧबधंनᮧबधंनᮧबधंन....———— पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं.का.िन 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(12) िनमाᭅणिनमाᭅणिनमाᭅणिनमाᭅण औरऔरऔरऔर िव᭟वंिव᭟वंिव᭟वंिव᭟वंसससस अपिश᳥अपिश᳥अपिश᳥अपिश᳥ ᮧबधंनᮧबधंनᮧबधंनᮧबधंन....———— पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं.का.िन 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(13) ईईईई––––अपिश᳥अपिश᳥अपिश᳥अपिश᳥....———— पाᳯरि᭭थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा ᮧकािशत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(14)यानीययानीययानीययानीय पᳯरवहनपᳯरवहनपᳯरवहनपᳯरवहन....———— पᳯरवहन कᳱ यानीय संचलन आवास के अनुकूल रीित मᱶ िविनयिमत होगा और इस संबंध मᱶ आंचिलक महायोजना मᱶ िविन᳸द᳥ उपबंध समािव᳥ ᳰकए जाएगें और आंचिलक महायोजना के तैयार होन ेऔर रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित सुसंगत अिधिनयमᲂ और उसके अधीन बनाए गए िनयमᲂ और िविनयमᲂ के अनुसार यानीय संचलन के अनुपालन को मानीटर करेगी ।
(15)यानीययानीययानीययानीय ᮧदषूणᮧदषूणᮧदषूणᮧदषूण....———— यान ᮧदषूण कᳱ रोकथाम और िनयंᮢण लागू िविधयᲂ के अनसुार कᳱ जाएगी और ᭭व᭒छक धन उदाहरण के िलए सीएनजी, एलपीजी, आᳰद के उपयोग के िलए ᮧयास ᳰकए जाएगें ।
(16)औ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयां....———— (i) राजपᮢ मᱶ इस अिधसचूना के ᮧकाशन पर या उसके प᳟ात पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए ᮧदषूणकारी उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनुमित नहᱭ दी जाएगी।
(ii) फरवरी, 2016 मᱶ पाᳯरि᭭थितक संवेदी जोन के भीतर कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ उ᳒ोगᲂ के वगᱮकरण के अनुसार गैर-ᮧदषूणकारी उ᳒ोगᲂ को ही अनमुित दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ अ᭠यथा िविन᳸द᳥ न हो।
(17) पहाड़ीपहाड़ीपहाड़ीपहाड़ी ढलानᲂढलानᲂढलानᲂढलानᲂ कोकोकोको सरंᭃणसरंᭃणसरंᭃणसरंᭃण....———— पहाड़ी ढलानᲂ का सरंᭃण िन᳜ानसुार होगा:

(1) वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइयां । (क) नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइया ं वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइ᭨स या टᲂ का िविनमाᭅण करना भी सि᭥मिलत ह,ै के िसवाय नहᱭ हᲂगी ;
(ख) खनन संᳰᮓयाए,ं ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ उᲬतम ᭠यायालय के आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के आदशे के अनुसार कᳱ जाएगी ।
(2) ᮧदषूण(जल या वाय ुया मृदा या ᭟ विन आᳰद) काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । कोई नई या पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧदषूण फैलाने वाले उ᳒ोगᲂ के िव᭭तार कᳱ अनुमित नही दी जाएगी और पाᳯरि᭭थितक संवेदी जोन के भीतर कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा फरवरी, 2016 मᱶ जारी ᳰदशािनदᱷशᲂ के वगᱮकरण के अनुसार िसफᭅ गैर- ᮧदषूणकारी उ᳒ोगᲂ को अनुमित तब तक दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हो ।
(3) बृहत जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂग े।
(4) ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन या ᮧसं᭭करण। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂग े।
(5) ᮧाकृितक जल िनकायᲂ या भूिम ᭃेᮢ मᱶ अनुपचाᳯरत बिहᳫावᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂग े।
(6) ठोस अपिश᳥ िनपटान ᭭थल कᳱ ᭭थापना और ठोस और जैव िचᳰक᭜सा अपिश᳥ सामा᭠य जलाए जाने कᳱ सुिवधा के िलए । पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ कᳱ कोई नई ठोस अपिश᳥ िनपटान ᭭थल और अपिश᳥ उपचाᳯरत/ᮧसं᭭करण सुिवधा कᳱ अनुमित नहᱭ ह ैऔर औ᳒ोिगक ᮧᳰᮓया और ᭭थापन ᮧित᳧ान, अ᭭पतालᲂ आᳰद से उ᭜प᳖ ᳰकसी भी ठोस अपिश᳥ के उपचार के िलए सामा᭠य या ᳞िᲦगत भ᭬मीकरण कᳱ सुिवधा को और सं᭭थापन को ᮧितिष ᳰकया जाएगा । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(7) फमᲄ, कॉपᲃरेट, कंपिनयᲂ आᳰद ᳇ारा बड़ े पैमाने पर वािणि᭔यक पशुधन संपदा और कुकुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को पूरा करने के िसवाय लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
(8) नई आरा िमलᲂ कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(9) ट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
(10) जलावन लकिड़यᲂ का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
(11) पवन िमलᲂ का पᳯरिनमाᭅण । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
(12) मछली पकड़ना। लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । ख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलाप
(13) होटलᲂ और ᳯरसोटᲄ कᳱ वािणि᭔यक ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलापᲂ संबंधी लघु अ᭭थायी संरचनाᲐ के िलए संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात हᲂगे, अ᭠यथा नहᱭ । परंतु, संरिᭃत ᭃेᮢ कᳱ सीमा से 1 ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, जो भी िनकट हो, ᳰकसी भी नए वािणि᭔यक होटल एवं ᳯरसोटᲄ को ही अन᭄ुात ᳰकया जाएगा अ᭠यथा नहᱭ ।
(14) संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, जो भी िनकट हो, ᳰकसी भी ᮧकार का नया वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय लोगᲂ कᳱ आवासीय आव᭫यकताᲐ कᳱ पूᳶत करन ेके िलए पैरा 3 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी । पर᭠तु यह और ᳰक ऐसे लघ ुउ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते ह,ᱹ से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएगें और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएगें । (ख) एक ᳰकलोमीटर से आगे यह आंचिलक महायोजना कᳱ अनुसार िविनयिमत हᲂगे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9
(15) ᮧदषूण उ᭜प᳖ न करन े वाल े लघ ु उ᳒ोग । फरवरी, 2016 मᱶ के᭠ᮤीय ᮧदषूण बोडᭅ ᳇ारा जारी उ᳒ोगᲂ के वगᱮकरण के अनुसार गैर-ᮧदषूणकारी उ᳒ोग और अपᳯरसंकट मᱶ, लघु और सेवा उ᳒ोग, कृिष, पु᭬प कृिष उ᳒ान, जो पाᳯरि᭭थितक संवेदी जोन स े दशेी सामिᮕयᲂ से बने उ᭜पादᲂ का उ᭜पादन करते ह,ᱹ सᭃम ᮧािधकारी ᳇ारा अनु᭄ात हᲂगे।
(16) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनसुार िविनयिमत होगी ।
(17) वन उ᭜पादᲂ और गैर-का᭬ ठ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(18) िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण और केबलᲂ के िबछाए जाने और अ᭠य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । भिूमगत केबल के िबछाए जाने को बढ़ावा ᳰदया जाएगा।
(19) नागᳯरक सुख-सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ िनयमᲂ और िविनयमᲂ और उपल᭣ध ᳰदशािनदᱷशᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ िविनयिमत ᳰकए जाएगें।
(20) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण । लागू िविधयᲂ िनयमᲂ और िविनयमᲂ और उपल᭣ध ᳰदशािनदᱷशᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ िविनयिमत ᳰकए जाएगें।
(21) पयᭅटन से संबंिधत ᳰᮓयाकलाप जैस े गमᭅ वायु गु᭣बारᱶ, हलेीका᭡टर, ᮟोन, माइᮓोलाइटस और अ᭠य पयᭅटन ᳰᮓयाकलाप आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(22) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(23) रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
(24) ᭭थानीय समुदायᲂ ᳇ारा चलाई जा रही कृिष और बागवानी पितयᲂ के साथ पशुपालन, पशुपालन कृिष जल कृिष और मछली पालन । ᭭थानीय लोगᲂ के उपयोग के िलए लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(25) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत अपिश᳥ जल/बिह᮲ाᭅव का िन᭭सारण जल िनकायᲂ मᱶ ᮧवेश नहᱭ करने ᳰदया जाएगा और उपचाᳯरत अपिश᳥ जल के पुनचᭅᮓण और पुन:उपयोग के िलए ᮧयास ᳰकए जाएगें और 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] उपचाᳯरत अपिश᳥ जल/बिह᮲ाᭅवᲂ का िन᭭सारण लागू िविधयᲂ के अनुसार िविनयिमत ᳰकया जाएगा ।
(26) सतह और भूजल के वािणि᭔यक िन᭬कषᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(27) कृिष या अ᭠य उपयोग के िलए खुले कुआ, बोर कुआ, आᳰद । िविनयिमत और स᭥ब ᮧािधकारी ᳇ारा ᳰᮓयाकलाप कᳱ मानीटरी कᳱ जाएगी।
(28) ठोस अपिश᭬ ट ᮧबंधन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(29) िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(30) पाᳯरि᭭थितक पयᭅटन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(31) पोिलथीन बैगᲂ का उपयोग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(iv) ᳰकसी िवयात सं᭭था या िव᳡िव᳒ालय से पाᳯरि᭭ थित के ᭃेᮢ मᱶ तीन वषᭅ कᳱ अविध के िलए कनाᭅटक सरकार ᳇ारा नाम िन᳸द᭬ ट ᳰकए जाने वाला एक िवशेष᭄ — सद᭭य ;

(5) मानीटरी सिमित का सद᭭य-सिचव या संब कलटर संब पाकᭅ उपवन संरᭃक का ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा ।
(6) मानीटरी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहत ेᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय व᭠यजीव वाडᭅन को उपाबधंउपाबधंउपाबधंउपाबधं VVVV मᱶ उपबंिधत ᱨप िवधान के अनुसार उ त वषᭅ के 30 जनू तक ᮧ᭭तुत करेगी ।
(8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय िनगरानी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदशे द ेसकेगा, जो वह ठीक समझे ।

8. कोई अ᭠ य महत् वपूणᭅ िवषय । 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 6th June, 2017 S.O. 1815(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, dated the 10th December, 2015 vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3340 (E), dated the 10th December 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said draft notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 10th December 2015;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification;
AND WHEREAS, the Attiveri Bird Sanctuary notified as per Government of Karnataka Notification no. FEE 140 FWL93, dated the 3rd October, 2000 and located in the borders of Mundgod and Kalghatgi Taluka of Uttar Kannada and DharwadDistricts of Karnataka State is spread over an area of 2.226 square kilometer;
AND WHEREAS, in 1992, an irrigation tank was built across Thayavvanahalla at Attiveri village to cater the irrigation needs of the local farmers, which also resulted in attracting varieties of birds, both local and migratory; the first year witnessed about 20 species of birds, followed by 35 species in the next year, and as the reservoir is located in the midst of a moist deciduous forest in a calm and serene locality with abundant feeding grounds in the surroundings, it became a heaven for the birds to seek refuge here for their breeding activities;
AND WHEREAS, more than 1200 pairs of birds are found breeding in this man made habitats White Ibis, Herons, Little Cormorants, Spoonbills, Painted storks are some of the species, which breed here, birds like Lapwings, Water hen, Stilt, Darter, Indian shag, etc. are found throughout the year; Pintails, Gargany, Shoveller, Plovers, etc.
Migrate here forbreeding between November to February and many small and big tanks in the adjacent areas of Mundagod, Haliyal and Yellapur taluks also help the birds to nest, feed and breed, thus making up this Sanctuary an ideal aquatic habitat;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Attiveri Bird Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the powers conferred by sub section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area varying from 1 kilometer to 1.90 kilometers from the boundary of Attiveri Bird Sanctuary in the State of Karnataka as the Attiveri Bird Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.— (1) The total geographical area of the Eco-Sensitive Zone is spread over an area of 10.70 square kilometers with an extent varying from 1.0 kilometre to 1.90 kilometres around the boundary of Attiveri Bird Sanctuary and the boundary description of the said Zone is appended as Annexure-I.
(2) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-II .
(3) The Geo-coordinates of major points on the boundary of Attiveri Bird Sanctuary and on the boundary of Ecosensitive Zone the is appended as Annexure-III.
(4) The details of villages and Reserve Forest area falling within the Eco-sensitive Zone around Attiveri Bird Sanctuary are appended as Annexure- IV.
2. Zonal Master Plan for the Eco-sensitive Zone.— (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said Plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in the table in paragraph 4 and ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.-—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse:— Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the State Government to meet the residential needs of the local residents , and for activities such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agriculture area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.— The catchment areas of all natural springs, rivers and channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] up by the State Government in such a manner as to prohibit development activities of or near these area which are detrimental to such area.
(3) Tourism.— (a)The activity relating to tourism within the Eco-Sensitive Zone shall be as per the Tourism Master Plan which shall form fact of the Zonal Master Plan.
(b)The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The activities of tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within one kilometre from the boundary of the Attiveri Bird Sanctuary or upto the extent of the eco-sensitive Zone whichever is nearer:
Provided that, beyond the distance of one kilometre from the boundary of the said Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development based on the carrying capacity study of the Ecosensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.— All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation part of the Zonal Master Plan.
(5) Man-made heritage sites.— Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.— Prevention and Control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 made under the Environment (Protection) Act, 1986.
(7) Air pollution.— The Environment Department of the State Government or Karnataka State Pollution Control Board shall draw of guidelines and regulation for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.— Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (prevention and control of pollution) Act, 1974 (6 of 1974) and rules made thereunder.
(9) Solid wastes.- Disposal and management of solid wastes shall be as under:-
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357(E), dated 8th April, 2016 as amended from time to time;
(b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(c) the biodegradable material shall be recycled preferably through composting or vermiculture;
(d) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone and no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Ecosensitive Zone.
(10) Bio-medical waste.— Bio medical waste management shall be as under:-
(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time;
(b)no common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.

(11) Plastic waste management.—The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.—The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.—The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic.— The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example CNG etc.
(16) Industrial units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under, and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) New and existing (minor and major minerals), stone quarrying and crushing units shall be prohibited except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for personal consumption.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 04th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new or expansion of existing polluting industries in the Ecosensitive zone shall be permitted and only non-polluting industries may be permitted within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.

4. Use or production or processing of any hazardous substances.

Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste No new solid waste disposal site and waste treatment/processing facility of solid waste shall be permitted within Eco sensitive Zone and further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment, hospitals, etc. shall be and prohibited.
7. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
10. Commercial use of fire wood Prohibited (except as otherwise provided) as per applicable laws.
11. Erection of wind mills Prohibited (except as otherwise provided) as per applicable laws.
12. Fishing Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
13. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
14. Construction activities (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone, whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents:
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
15. Small scale non polluting industries.
Non polluting industries as per the classification of industries issued by the Central Pollution Control Board in February, 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority.
16. Felling of trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
17. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.

18. Erection of electrical and communication towers and laying of cables and other infrastructures Regulated under applicable law (underground cabling may be promoted).

5. Monitoring Committee.-The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) Deputy Commissioner, Uttar Kannada - Chairman;
(ii) Representative of the Department of Environment, Government of Karnataka - Member;
(iii) Representative of the Department of Urban Development, Government of Karnataka - Member;
(iv) One expert in ecology from reputed institution or university of the State to be nominated by the Government of Karnataka for a term of three years in each case - Member;
(v) A representative of Non-Government Organisation working in the field of environment to be nominated by the Government of Karnataka for a term of three years - Member;
(vi) Representative of Karnataka State Pollution Control Board. - Member;
(vii) Member, State Biodiversity Board - Member;
(viii) The Conservator of Forests & Director -Member Secretary.
6. Terms of reference:-
(1) The tenure of the Monitoring Committee shall be three years.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended as Annexure-V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification .
8. The provisions of this notification shall be subject to the orders, if any passed or to be passed, by the Hon,ble Supreme Court of India or the High Court or the National Green Trubunal.

NORTH: The line starts at a junction point on the common inter village boundary of Garudhonihalli village Sy No.
297 and Asthakatti village Sy Nos. 114 near a small tank, then the line runs in east direction along the reserve forest boundary and borders of SY No 114, 113, 110, 111, 102, 101, 100, 97 & 96 of Villages Asthakatti. Then it runs North along the same reserve forest boundary and reaches the corner of Sy No 67 of the same village.
EAST: From the above point the boundary runs eastwards in the reserve forest boundary till the co-ordinate N 150 5'
35.68” E 750 3' 11.36”, then the boundary passes along outer line of reserved forest boundary of Bendlagatti village & forest Sy. No 85 till the co-ordinate N 150 4' 52.78” E 7503' 51.07”. Then the line runs in south-west direction along the stream till the co-ordinate N 150 4' 43.0” E 750 3' 4.53”, then the line continuous southwards to reach the point with coordinate N 1504' 28.28” E 750 3' 45.48”, then line passes in south direction till the co-ordinate N 150 4' 16.05” E 750 3'
43.71” on the inter village boundary of Bendlagatti and Vadaghatta villages. Then line passes in south-west direction till the co-ordinate N 150 3' 51.69” E 750 3' 26.78”.
SOUTH: From the above point line proceeds in south-west direction till the co-ordinate N 150 3' 38.83” E 7503' 8.08”, then the line runs westwards till the co-ordinate N 150 3' 34.18” E 7502' 42.4”. Further the line continuous till it reaches the co-ordinate N 150 3' 38.21” E 750 2' 23.69”. Then the boundary runs in north-west direction along the reserve forest boundary of Hunugunda of Uttarakannada district till it reaches a stream.
WEST: From the above point the line runs in west direction along the Kalaghatagitaluk boundary as well as reserve forest boundary. Then it runs North along the reserve forest boundary and turns North-East direction through the borders of Garudhonihalli Village Sy. Nos. 318, 319, 311, 302, 301 & 297 till it reaches the point where the line begins.
