(क) 4692, तारीख 23 जुलाई,1909, (ख) 2016 तारीख 12 मई 1913, (ग) 2017 आर, तारीख 12 मई, 1913, (घ) 3463 आर, तारीख 14 जुलाई 1913, (ड.) 3412 आर, तारीख 14 नवंबर 1933 (च) 864 जी.जे. तारीख 14 फरवरी, 1939 ᮧᮓमᲂ मᱶ ᳰकया गया था, वषᭅ 1981 मᱶ 29 वगᭅ ᳰकलोमीटर ᭃेᮢ के नांगखाइलम आरिᭃत के पूवᱮ भाग को व᭠यजीव को अभयार᭛य मᱶ संपᳯरवᳶतत ᳰकया गया और आरिᭃत वन का शषे भाग गहन संरᭃण और रᭃण उपायᲂ के अधीन था और इस कारण ये वन अपने ᮧाचीन मू᭨य ᮧितधाᳯरत ᳰकए ᱟए ह।ᱹ इस ᭃेᮢ मᱶ पहािड़यᲂ और घाᳯटयᲂ कᳱ बᱟतायत ह ैिजनमᱶ से कई जलधाराएं बहती ह ᱹजो उमᮝयू, उमतसोर और उमसा नᳰदयᲂ मᱶ िमलती ह ᱹजो इस ᭃेᮢ के चारᲂ और हᱹ। इस ᭃेᮢ कᳱ ऊंचाई 200 मीटर से 800 मीटर के बीच ह ैमाकᳵदाह सबसे ऊंचा ᳲबद ुह ैिजसकᳱ ऊंचाई 965 मीटर ह।ैखड़ी ढाल वाले पहाड़ी ढाल ᮧचुर माᮢा मᱶ नहᱭ ह ᱹऔर उमᮝयू एवं उमतसोर नᳰदयᲂ के ᳰकनारे कुछ भागᲂ मᱶ ही ᳰदखाई पड़त ेह;ᱹ 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, अभयार᭛य तथा आरिᭃत वन पूवᱮ िहमालयी ᭭थािनक पᭃी ᭃेᮢ (कॉलर और अ᭠य आᳰद) के अंतगᭅत वैि᳡क जैव-िविवधता मुय ᭭थल के ᱨप मᱶ वगᱮकृत (पूवᲃᱫर भारत) ᭃेᮢ मᱶ आत ेह ᱹऔर यह ᭃेᮢ वन᭭पितजात और ᮧािण-जात संपदा से समृ ह ै। नांगखाइलम व᭠यजीव अभयार᭛य, नांगखाइलम के उᱫरी भाग मᱶ एक उ᭬ण कᳯटबंधीय िमि᮰त सदाबहार वन ह ै यहां कᳱ वन᭭पित अिधकांशत: आᮤᭅ पणᭅपाती वन है दिᭃणी भाग कᳱ ओर पणᭅपाती घटक कुछ उप-उ᭬ण कᳯटबंधीय और कुछ शीतो᭬ण सिहत सदाबहार ᮧजाितयᲂ के अिधक ᮧितशत के साथ धीरे-धीरे कम होते जाते ह,ᱹ कुल िमलाकर, सामा᭠य जंगली वन᭭पित बांस वनᲂ और घास वाले ढालᲂ के साथ िमलकर सदशृ ᱨप मᱶ ᳰदखाई पड़त ेह ᱹऔर ऊंचाई के साथ बदलती वन᭭पित तीन मंिजला आकार मᱶ ᳰदखाई देती ह ैजहां फैल ेᱟए शीषᲄ तथा लंबे ठंूठᲂ वाल ेिवशाल वृᭃ शीषᭅ छतरी के ᱨप मᱶ ᳰदखाई देते ह ᱹजो अिधपादपᲂ कᳱ उप-जाितयᲂ के िलए आ᮰य-᭭थल के ᱨप मᱶ कायᭅ करते ह;ᱹ पर᭠त,ु साल इस ᭃेᮢ कᳱ ᮧमुख वृᭃ ᮧजाित ह।ै और, इस ᭃेᮢ मᱶ ᭭तनधाᳯरयᲂ कᳱ 50 से अिधक ᮧजाितयᲂ तथा सरीसृपᲂ कᳱ 25 ᮧजाितयᲂ को आ᮰य िमलता ह,ै व᭠यजीव (संरᭃण) अिधिनयम, 1972 (1972 का 53) कᳱ अनुसूची-I मᱶ सूचीब ᭭तनधाᳯरयᲂ कᳱ 140 ᮧजाितयᲂ मᱶ से लगभग 30 ᮧजाितयां यहां पाई जाती ह,ᱹ लमिच᭜ ता, तᱶदआु, ᱟलांक उतक, हाथी, गौर, ᳲबटुरांग और ᮕेट इंिडयन धनेश िविश᳥ ᮧजाितयां ह:ᱹ इस ᭃेᮢ मᱶ और इसके आस-पास कई जलाशयᲂ और नᳰदयां, िहल महसीर, चॉकलेट महसीर जैसी संकटाप᳖ म᭜᭭य ᮧजाितयᲂ और खासी िह᭨स वाटर मᱶढक और वाटर मॉनीटर िछपकली जैसे सरीसृप जो अब बᱟत दलुᭅभ हो गए ह,ᱹ हतेु अ᭒छे ᮧजनन ᭭थल हᱹ; और, 200 वगᭅ ᳰकलोमीटर से कम ᭃेᮢ मᱶ 400 से अिधक पᭃी ᮧजाितयᲂ सिहत नांगखाइलम व᭠यजीव अभयार᭛य तथा नांगखाइलम आरिᭃत वन और उिमयम जलाशय सिहत उसके िनकटवतᱮ ᭃेᮢ संरᭃण और जैव-िविवधता कᳱ दिृ᳥ से िन:संदेह मह᭜वपूणᭅ ᭃेᮢ ह ᱹ और पयाᭅवास कᳱ कमी तथा अवैध िशकार के कारण ᱨफाउस नेड हॉनᭅिबल जैसी संकटाप᳖ ᮧजाितयां अ᭜यिधक दलुᭅभ हो गई ह;ै और, मेघालय मᱶ कुछ ᮧजाितयां पहली बार अिभलेिखत कᳱ गई ह ᱹये ᮧजाितयां ह ᱹ- ᮕेट ᮓ᭭टेड ᮕेब, ᭣लैक नेड ᮕेब, रेड नेड ᮕेब, इंिडयन शाग, छोटा हरा बगुला, टाइगर आँफ मलय िबटनᭅ, ᮕेटर एंडजुटᱶट ᭭टॉकᭅ और ᭣लैक हडेेड गल। सवᱷᭃण एवं अभी हाल ही मᱶ गुजरे समय मᱶ डाटᭅर, डाडᱷ᭠स या ि᭣ल᭝स बाजा, पᱶटेड ᭭टॉकᭅ , ले᭭सर या िहमालयन ᮕ-ेहडेेड ᳰफश ईगल, ᭣लैक अथवा ᳴कग िग, लांग-िब᭨ड िग, सफेद गदᭅन वाला िग, सफेद टांग वाला फा᭨कोनेट, सफेद गालᲂ वाला पहाड़ी तीतर, वुड ᳩाइप, टॉनी ᳰफश आउल, ि᭣᭨᭝स ᳴कगᳰफशर, रफस नेड धनेश, ᭭पᱹलडे ᮟांगो, िचᱫीदार पंखᲂ वाला ᭭टेयर और ᮕ-ेिसिबया जैसी संकटᮕ᭭त और संकट कᳱ आशंका वाली ᮧजाितयᲂ को भी अिभिलिखत ᳰकया गया ह;ै और, इससे संब अ᭠य वृᭃ ᮧजाितयां ह ᱹ मेसुआफेरी, लेगर᭭ᮝोिमयापरवीफोरा, चीमावािलची, एᮓोकॉपᭅसᮨैसीनीफोिलयस, ए᭨᭭टोिनया᭭कॉलᳯरस, बॉ᭥बेससीबा, आटᲄकॉपᭅसचैपलाशा, िबसकोᳰफयाजावािनका, के᭭टोनोिपिससिह᭭ᮝीस, सी.इंिडका सी.ᳯᮝबुलोयडस, िसनामो᭥मतमाला, एिलयोकॉपᭅस᭢लोᳯरबंडस, लैिनयाकोरोमंडेिलका, गᱨगािप᳖ाटा, एंथोसीफेलसकडांबा, टेᮝामेलसनुडी᭢लोरा, तूनािसिलयाटा, िसजीिजयम एसपीपी., क᭨लीकपाᭅअरबोᳯरया, केरेयाअरबोᳯरया, एंबिलकाआᳰँफिसनािलस, जमेिलनाअरबोᳯरया, िजनोकाᳶडयाओडोराटा, मलोटसᳰफलीपेिनस, सेिपयम एसपीपी., एिलिपिनयामलाकसेि᭠सस, हो᭨लारहनेाएंटीडीसᱶᳯᮝका, अमोममएसपीपी, कोलोकेिसयाइ᭭कुलᱶटा, को᭭टस᭭पेिशयोसस, लो᭣बाम᭨टी᭢लोरा, ओसेिलसकोनᱮकुलाटा, ᮨेगमाइ᭗सककाᭅ, ᳲजिजबरजेᱨबेट, जेड.केपीटाटम, जेड.कासुनुनेन, साइᮧसएसपीपी. इ᭜याᳰद; और, नांगखाइलम व᭠ यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पाᳯरि᭭थितक और पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह;ै और, यह रेखाएं आव᭫यक हो जाती ह ᱹ ᳰक नांगखाइलम व᭠ यजीव अभयार᭛य के चारᲂ ओर कुछ ᭃेᮢᲂ को पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ देखा जाए और उ᳒ोगᲂ, संचालन या ᮧᳰᮓयाᲐ या उ᳒ोगᲂ के वगᲄ, पᳯरचालन या ᮧᳰᮓयाᲐ को पाᳯरि᭭थितक संवेदी जोन मᱶ रोक ᳰदया जाएगा। अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत े ᱟए, मेघालय रा᭔ य मᱶ नांगखाइलम व᭠ यजीव अभयार᭛य कᳱ सीमा से
335.07 मीटर से 8.43 ᳰकलोमीटर तक के िव᭭ तार तक के ᭃेᮢ को नांगखाइलम व᭠ यजीव अभयार᭛य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती है, िजसका ᭣यौरा िन᳜ानुसार ह,ै अथाᭅत ्:--
1. पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक संवदेीसंवदेीसंवदेीसंवदेी जोनजोनजोनजोन काकाकाका िव᭭तारिव᭭तारिव᭭तारिव᭭तार औरऔरऔरऔर उसकᳱउसकᳱउसकᳱउसकᳱ सीमाएंसीमाएंसीमाएंसीमाएं-(1) पाᳯरि᭭थितक संवेदी जोन का िव᭭तार नांगखाइलम व᭠ यजीव अभयार᭛य कᳱ सीमा से 335.07 मीटर से 8.43 ᳰकलोमीटर तक िभ᳖-िभ᳖ ह ैऔर पाᳯरि᭭थितक संवेदी जोन का कुल ᭃेᮢ 202.87 वगᭅ ᳰकलोमीटर ह ै।
(2) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का वणᭅन उपाबधंउपाबधंउपाबधंउपाबधं----I के ᱨप मᱶ उपाब ह ै।
(3) पाᳯरि᭭थितक संवेदी जोन का मानिच ᮢ के साथ पाᳯरि᭭थितक संवेदी जोन के भू- िनदᱷशांक और व᭠यजीव अभयार᭛य उपाबधं उपाबधं उपाबधं उपाबधं II के ᱨप मᱶ उपाब ह ै।
(4) ᮧमुख िब᭠दᲐु के िनदᱷशांकᲂ के साथ-साथ पाᳯरि᭭थितक संवेदी जोने के भीतर आन ेवाल ेᮕामᲂ कᳱ सूची उपाबधं उपाबधं उपाबधं उपाबधं III के ᱨप मᱶ उपाब ह ै।
2222.... पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महायोजनामहायोजनामहायोजनामहायोजना –––– (1) रा᭔य सरकार, पाᳯरि᭭थितक संवेदी जोन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) रा᭔य सरकार ᳇ारा पाᳯरि᭭थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(3) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत:्-- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) पयाᭅवरण;
(ii) वन और व᭠यजीव;
(iii) कृिष और बागवानी;
(iv) राज᭭ व;
(v) नगर िवकास;
(vi) पयᭅटन सिहत पाᳯरि᭭थितक पयᭅटन;
(vii) ᮕामीण िवकास;
(viii) ᳲसचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका और शहरी िवकास;
(x) पंचायती राज;
(xi) लोक िन माᭅण िव भाग।
(4) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ, पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᳥ न ᳰकया जाए और उᲦ आंचिलक महायोजना सभी अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ मᱶ दᭃता और पाᳯरि᭭थितक अनुकूलता का सुधार करेगी ।
(5) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलᲐू, िजन पर ᭟यान देना आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(6) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी और इस योजना के मानिचᮢ ᳇ारा िव᳒मान और ᮧ᭭तािवत भूिम के उपयोग का िववरण ᳰकया जाएगा ।
(7) आंचिलक महायोजना पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगी और सारणी मᱶ सूचीब ᮧितिष, िविनयिमत ᳰᮓयाकलापᲂ का पालन करेगी तथा ᭭ थानीय समुदायᲂ कᳱ आजीिवका सुरᭃा के िलए, पाᳯरि᭭थितक अनुकूल िवकास सुिनि᭫ चत करेगी तथा संवᳶधत करेगी।
(8) आंचिलक महायोजना ᭃेᮢ ीय िवकास योजना के साथ सह-अंतक होगी ।
(9) आंचिलक महायोजना इस अिधसूचना मᱶ ᳰदए गए उपबंधᲂ के संबंध मᱶ अपने कायᲄ के बाहर ले जाने के िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी ।
3. रा᭔यरा᭔यरा᭔यरा᭔य सरकारसरकारसरकारसरकार ᳇ारा᳇ारा᳇ारा᳇ारा ᳰकएᳰकएᳰकएᳰकए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय-------- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत्:--
(1) भूभभूूभू----उपयोग.उपयोग.उपयोग.उपयोग.---- (क) पाᳯरि᭭थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुल े᭭थानᲂ का मुय वािण᭔यक या मुय आवािसक का᭥पे᭨कस या औ᳒ोिगक ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा: परंत ुपाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम और अ᭠य भूिम का संपᳯरवतᭅन, इसमᱶ िविन᳸द᳥ ᮧयोजन से िभ᳖ ᮧयोजन के िलए िनगरानी सिमित कᳱ िसफाᳯरश पर और सुसंगत रा᭔य िविधयᲂ और केᮤीय सरकार या रा᭔य सरकारᲂ के ऐसी अ᭠य िनयमᲂ और िविनयमᲂ के अधीन जो लाग ूहो, सᭃम ᮧािधकारी के पूवᭅ अनमुोदन से, और इस अिधसूचना के ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 उपबंधो ᳇ारा ᭭थानीय िनवािसयᲂ कᳱ िन᳜िलिखत आवासीय आव᭫यकताᲐ को पूरा करने के िलए अनु᭄ात ᳰकया जा सकेगा ह,ै जैसे:-
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;
(ii) बुिनयादी ढांचᲂ और नागᳯरक सुख सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) ᮧदषूण उ᭜प᳖ न करने वाल ेलघ ुउ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजसके अतंगᭅत ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुख सुिवधाᲐ जो पाᳯरि᭭थितक पयᭅटन िजस मᱶ सहायक हो गृह वास; और
(v) संवᳶधत ᳰᮓयाकलाप और अनु᭒छेद 4 के अधीन ᳰदया गया ह:ै परंत ु यह और ᳰक संुसगत रा᭔य िविधयᲂ और रा᭔य सरकार के अ᭠य िनयमᲂ और िविनयमᲂ के अधीन सᭃम ᮧािधकारी रा᭔य सरकार के पूवᭅ अनुमोदन तथा संिवधान के अनु᭒छेद 244 और त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा: परंत ुयह भी ᳰक पाᳯरि᭭थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपदᳶशत, िनगरानी सिमित के िवचार ᮧा᳙ करन े के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को देनी होगी । परंत ुयह भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू- उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । (ख) वनीकरण और ᮧाकृितक वास स᭥बधी ᳰᮓयाकलापᲂ को पुन:᭭थािपत करन ेके िलए और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ/नᳰदयᲂ/जलांतरालो कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी ।
(3) पयᭅटनपयᭅटनपयᭅटनपयᭅटन /पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक----पयᭅटन पयᭅटन पयᭅटन पयᭅटन –––– (क) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन संबंधी ᳰᮓयाकलाप या िव᳒मान पयᭅटन स᭥बधी ᳰᮓयाकलापो का िव᭭तार पयᭅटन महायोजना के अनुसार हᲂगे । (ख) पाᳯरि᭭थितक पयᭅटन महायोजना पयᭅटन िवभाग, ᳇ारा पयाᭅवरण और वन िवभाग के परामशᭅ से तैयार कᳱ जाएगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ होगा । (घ) पाᳯरि᭭थितक पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत:्-
(i) व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट ह,ै ᳰकसी नये वािणि᭔यक होटल और ᳯरसोटᭅ, का संि᳖माणᭅ अन᭄ुात नहᱭ होगा और व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए होटलो और ᳯरसोटᭅ कᳱ ᭭थापना पयᭅटन महायोजना के अनुसार केवल पाᳯरि᭭थितक पयᭅटन सुिवधाᲐ के िलए पूवᭅ पᳯरभािषत और अिभिचि᭠हत ᭃेᮢो मᱶ ही अन᭄ुात होगी;
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा िनगरानी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा और पाᳯरि᭭थितक संवेदी जोन के भीतर ᳰकसी नए होटल या ᳯरसोटᭅ या वािणि᭔यक ᭭थापना का सि᳖माᭅण अन᭄ुात नहᱭ होगा ।
(4) नसैᳶगकनसैᳶगकनसैᳶगकनसैᳶगक िवरासतिवरासतिवरासतिवरासत -------- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उनकᳱ सुरᭃा और संरᭃा के िलए योजना आंचिलक महायोजना के भाग ᱨप िवरासत संरᭃण योजना बनाई जाएगी ।
(5) मानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थल ल ल ल ---- पाᳯरि᭭थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ और कᳱ पहचान कᳱ जाएगी और उनके संरᭃण कᳱ िवरासत संरᭃण योजना तैयार कᳱ जाएगी आंचिलक महायोजना का भाग ᱨप होगी ।
(6) ᭟ व᭟ व᭟ व᭟ विन ᮧदषूणिन ᮧदषूणिन ᮧदषूणिन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण कᳱ िनवारण और िनयंᮢण का ᭟विन पयाᭅवरण (संरᭃण) अिधिनयम, 1986, ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ 2000 के अनुसार अनुपालन ᳰकया जाएगा ।
(7) वायुवायुवायुवायु ᮧदषूणᮧदषूणᮧदषूणᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण कᳱ िनवारण और िनयंᮢण वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) के उपबंधᲂ और उसके अधीन बनाए गए िनयमᲂ के अनुसार अनपुालन ᳰकया जाएगा ।
(8) बिह᮲ावबिह᮲ावबिह᮲ावबिह᮲ाव काकाकाका िन᭭सारणिन᭭सारणिन᭭सारणिन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, साधारणᲂ मानकᲂ के अ᭠तगᭅत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के अधीन आन े वाल े पयाᭅवरणीय ᮧदषूण के िन᭭सारण के िलए साधारण मानकᲂ या रा᭔य सरकार ᳇ारा िनयत साधारण मानकᲂ के उपबंधᲂ के अनुसार होगा।
(9) ठोसठोसठोसठोस अपिश᳥ अपिश᳥ अपिश᳥ अपिश᳥ -------- ठोस अपिश᳥ᲂ का िनपटान और ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा-- (क) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ िनपटान और ᮧबंधन, समय-समय पर संशोिधत ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अᮧलै, 2016 ᳇ारा ᮧकािशत ᳰकए गए थ,े के अनुसार ᳰकया जाएगा ; अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा; (ख) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस िविधयᲂ के सुरिᭃत और पयाᭅवरणीय ᭟विन ᮧबंधन (ईएसएम), िव᳒मान िनयमᲂ और िविनयमᲂ के अनुᱨप पहचान ᮧौ᳒ोिगᳰकयᲂ को उपयोग करन ेकᳱ अनुमित दी जाएगी ।
(10) जैव िचᳰक᭜ सीजैव िचᳰक᭜ सीजैव िचᳰक᭜ सीजैव िचᳰक᭜ सीय अपिश᭬ टय अपिश᭬ टय अपिश᭬ टय अपिश᭬ ट- जैव िचᳰक᭜ सीय अपिश᭬ ट ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा— (क) पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं.का.िन. 343(अ), तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा । (ख) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस िविधयᲂ के सुरिᭃत और पयाᭅवरणीय ᭟विन ᮧबंधन (ईएसएम), िव᳒मान िनयमᲂ और िविनयमᲂ के अनुᱨप पहचान ᮧौ᳒ोिगᳰकयᲂ को उपयोग करन ेकᳱ अनुमित दी जाएगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
(11) ᭡लाि᭭टक᭡लाि᭭टक᭡लाि᭭टक᭡लाि᭭टक अपिश᳥अपिश᳥अपिश᳥अपिश᳥ ᮧबधंनᮧबधंनᮧबधंनᮧबधंन: : : : ---- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सा.का.िन 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(12) िनमाᭅणिनमाᭅणिनमाᭅणिनमाᭅण औरऔरऔरऔर िव᭟वसंिव᭟वसंिव᭟वसंिव᭟वसं अपिश᳥अपिश᳥अपिश᳥अपिश᳥ ᮧबधंनᮧबधंनᮧबधंनᮧबधंन: : : : ---- पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं.का.िन 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(13) ईईईई––––अपिश᳥अपिश᳥अपिश᳥अपिश᳥::::---- पाᳯरि᭭थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा ᮧकािशत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(14) यानीययानीययानीययानीय पᳯरवहन: पᳯरवहन: पᳯरवहन: पᳯरवहन: ---- पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा के अनुमोᳰदत होने तक, िनगरानी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को िनगरानी करेगी ।
(15) यानीययानीययानीययानीय ᮧदषूणᮧदषूणᮧदषूणᮧदषूण::::---- लागू िविधयᲂ के अनुसार वाहन ᮧदषूण कᳱ िनवारण और िनयंᮢण का अनुपालन ᳰकया जाएगा। ᭭व᭒छक धन के उपयोग के िलए ᳰकए गए ᮧयास उदाहरण के िलए सीएनजी, एलपीजी, आᳰद ह ᱹ।
(16) औ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयां: : : : ---- (क) राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन के बाद या ᮧकाशन मᱶ, पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा नहᱭ दी जाएगी। (ख) पाᳯरि᭭थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफᭅ गरै- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना के वगᱮकरण कᳱ अनु᭄ा दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हो। इसके अितᳯरᲦ गैर-ᮧदिूषत कुटीर उ᳒ोगᲂ को ᮧितिष ᳰकया जाएगा।
(17) पहाड़ीपहाड़ीपहाड़ीपहाड़ी ढलानᲂढलानᲂढलानᲂढलानᲂ कोकोकोको सरंᭃणसरंᭃणसरंᭃणसरंᭃण: : : : ---- पहाड़ी ढलानᲂ के संरᭃण के अंतगᭅत: (क) आंचिलक महायोजना पहाड़ी ढलानᲂ पर ᭃेᮢᲂ का संकेत होगा जहां ᳰकसी भी संिनमाᭅण कᳱ अनु᭄ा नहᱭ दी जाएगी। (ख) कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर ᳰकसी भी संिनमाᭅण कᳱ अन᭄ुा नहᱭ दी जाएगी ।
(18)(18)(18)(18) अगर यह आव᭫यक समझता ह,ै इस अिधसूचना के उपाबंधᲂ को ᮧभावी करन ेमᱶ के᭠ᮤीय सरकार और रा᭔य सरकार, अ᭠य उपायᲂ िविन᳸द᳥ करेगी।

1. वािणि᭔यक खनन । (क) सभी ᮧकार के खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ दशेी आव᭫यकताᲐ के िसवाय नहᱭ हᲂगी िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संि᳖माᭅण या 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] मर᭥मत के िलए भूिम को खोदना और मकान बनाने के िलए दशेी टाइलᲂ का िनमाᭅण भी सि᭥मिलत ह;ै (ख) माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गोᳲवदरामन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के कठोर अनुसरण का ᮧचालन होगा ।
2. (जल, वायु, मृदा, ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । कोई नई या पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧदषूण फैलाने वाले उ᳒ोगᲂ के िव᭭तार कᳱ अनु᭄ा नहᱭ दी जाएगी। पाᳯरि᭭थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना के वगᱮकरण कᳱ अनु᭄ा दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हो।
3. नए बृहत जल िव᳒ुत पᳯरयोजना और ᳲसचाई पᳯरयोजना कᳱ ᭭ थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
4. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
5. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
6. फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणि᭔यक पशुधन संपदा और कुकुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को पूरा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
7. नई आरा िमलᲂ कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
8. ट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
9. ᭡ लाि᭭ टक के थैलᲂ का उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
10. जलावन लकिड़यᲂ का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
11. नए का᭬ ठ आधाᳯरत उ᳒ोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । खखखख. . . . िविनयिमत ᳰᮓयाकलापिविनयिमत ᳰᮓयाकलापिविनयिमत ᳰᮓयाकलापिविनयिमत ᳰᮓयाकलाप
12. होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलापᲂ संबंधी पयᭅटकᲂ कᳱ लघु संरचनाᲐ के िलए संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे: परंतु, जहाँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा है वहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना और यथा लागू मागᭅदशᱮ िसांतᲂ के अनुᱧप होगा।
13. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो, कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा: परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;
(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना के वगᱮकरण;
(iv) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुख सुिवधाᲐ जो पाᳯरि᭭थितक पयᭅटन िजस मᱶ सहायक हो गृह वास; और
(v) इस अिधसूचना मᱶ संवᳶधत ᳰᮓयाकलापᲂ कᳱ सूची : पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते ह,ᱹ स े संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंगे । (ख) एक ᳰकलोमीटर से आगे आंचिलक महायोजना कᳱ अनुसार िविनयिमत हᲂगे ।
14. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । फरवरी, 2016 मᱶ के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी उ᳒ोगᲂ मᱶ वगᱮकरण के अनुसार गैर-ᮧदषूणकारी उ᳒ोग और अपᳯरसंकट मᱶ, लघु और सेवा उ᳒ोग, कृिष, पु᭬प कृिष, उ᳒ान कृिष या पाᳯरि᭭थितक संवेदी जोन से दशेी सामᮕी से उ᭜पादᲂ को उ᭜प᳖ करने वाले कृिष आधाᳯरत उ᳒ोग सᭃम ᮧािधकारी ᳇ारा अनु᭄ात हᲂगे।
15. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनु᭄ा के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
16. वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण (एनटीएफपी) । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
17. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण और केबल िबछाना और अ᭠य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । भूिमगत केबल को बढ़ावा ᳰदया जाएगा।
18. नागᳯरक सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
19. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना । लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
20. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वाय ु गु᭣बारᱶ, हलेीका᭡टर, ᮟोन, माइᮓोलाइटस और अ᭠य पयᭅटन ᳰᮓयाकलाप आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
21. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
22. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
23. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष और मछली पालन । ᭭थानीय लोगᲂ के उपयोग के िलए लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
24. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । जल िनकायᲂ मᱶ ᮧवेश करने के िलए अपिश᳥ जल/बिह᮲ाᭅव उपचाᳯरत उ᭜सजᭅन रोकेगा पुन:चᮓण और अपिश᳥ जल उपचाᳯरत पुन: उपयोग के िलए ᮧयास ᳰकए जाएंगे अ᭠यथा अपिश᳥ जल/ बिह᮲ाᭅव उ᭜सजᭅन लागू िविध के अनुसार िविनयिमत ᳰकया जाएगा ।
25. सतह और भूजल के वािणि᭔यक िन᭬कषᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
26. खुले कुआ, बोर कुआ, आᳰद के िलए कृिष और अ᭠य उपयोग । िविनयिमत और समुिचत ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ कᳱ सती से िनगरानी कᳱ जाएगी।
27. ठोस अपिश᭬ ट ᮧबंधन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
29. पाᳯरि᭭थितक पयᭅटन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(2) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸द᳥ ᮧितिष गितिविधयᲂ के िसवाय आन ेवाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत िनगरानी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण अनापिᱫ के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(3) इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंत ुपाᳯरि᭭थितक संवेदी जोन मᱶ आते ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत िनगरानी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(4) िनगरानी सिमित का सद᭭य-सिचव या संब उपायु त या संब उ᳒ान उप वन संरᭃक ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लघंन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा ।
(5) िनगरानी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहत ेᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपन ेिवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(6) िनगरानी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय व᭠य जीव वाडᭅन को उपाबधंउपाबधंउपाबधंउपाबधं IIIIVVVV मᱶ उपबंिधत ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।
(7) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय िनगरानी सिमित को अपन े कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए ऐसे िनदेश दे सकेगा, जो वह ठीक समझे ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 7th May, 2017 S.O. 1816(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3497 (E), dated 22nd December, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; And Whereas, copies of the Gazette were made available to the public on the 22nd December, 2015; And Whereas, no objections and suggestions received from persons and stakeholders in response to the draft notification; And Whereas, the Nongkhyllem Reserved Forest was constituted in stages during the regime of the erstwhile British Government vide Government of Assam Gazette Notification Nos.- (a)4692,dated23rd July, 1909 (b)2016,datedthe 12th May,1913 (c)2017R,dated the 12th May, 1913 (d)3463R,dated the 14th July, 1913, (e)3412R,dated the 14th November, 1933 and (f)864-GJ,dated the 14th February, 1939;due to abundance of wildlife and good habitat qualities, the eastern part of Nongkhyllem Reserve of 29 square kilometer area was converted to a Wildlife Sanctuary in 1981 and the remaining part of the Reserve Forests was subjected to intensive protection and conservation measures and it is due to this, that these forests have retained their pristine value. The area comprises fully of hills and valleys, along which, flow numerous streams that join the rivers such as Umtrew, Umtasor and Umsaw which surround the area. The altitude of the area ranges from 200 meters to 800 meters and the highest point is Mawkyndah with an altitude of 965 meters. Steep hill slopes are not common and occur only along certain portions of the banks of Umtrew and Umtasor rivers. And Whereas, the Sanctuary and the Reserve Forests fall in the (North Eastern India) region classified as a global bio-diversity hot spot under the Eastern Himalayan Endemic Bird Area and this area is rich in floral and faunal biodiversity. The Nongkhyllem Wildlife Sanctuary is tropical mixed evergreen forests, in the northern portion of Nongkhyllem, the vegetation is mostly moist deciduous type of Forest, towards the southern portion the deciduous components decrease gradually with more percentage of evergreen species including some sub-tropical and some temperate; as a whole, the general woody vegetation presents a homogenous appearance mixed with bamboo forests and grassy slopes and the vegetation changes with altitude presenting a three-storey appearance where large trees with spreading crowns and tall boles forming the top canopy which act as shelter for varieties of epiphytes. Sal is the dominant tree species in the area; however a large number of tree species are found. 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] And Whereas, the area harbours over 50 species of mammals and 25 species of reptiles; of 140 species of mammals listed in Schedule-I to the Wildlife (Protection) Act, 1972, (53 of 1972) about 30 species are found here, notable species being the Clouded Leopard, Leopard, Hoolock gibbon, Elephant, Gaur, Binturong and Great Indian Hornbill; many water bodies and streams in and around the area are good breeding sites for endangered species of fish such as the Hill Mahseer, Chocolate Mahseer and reptiles such as the Khasi Hills Water Tortoise and the Water monitor lizard, which have become very rare. And Whereas, With more than 400 species of birds in less than 200 square kilometre area, Nongkhyllem Wildlife Sanctuary and adjacent areas including the Nongkhyllem Reserved Forest and Umiam reservoir and undoubtedly important areas from conservation and bio-diversity point of view and the endangered species such as the Rufous necked hornbill have become extremely rare due to habitat shrinkage and poaching. And Whereas, Some species have been recorded for the first time in Meghalaya, these include Great Crested Grebe, Black necked Grebe, Red necked Grebe, Indian Shag, Little green heron, Tiger of Malay Bittern, Greater adjutant stork and Black headed gull. Threatened and near-threatened species include the Darter, Darden’s or Blyth’s Baza, Painted Stork, lesser or Himalayan Grey-headed fish eagle, Black or king Vulture, Long-Billed vulture, white necked vulture, white legged Falconet, white cheeked Hill Partridge, Wood Snipe, Tawny Fish Owl, Blyth’s Kingfisher, Rufous necked Hornbill, Spangled Drongo, Spotted winged Stare and Grey Sibia have also been recorded during the survey and some in the recent past. And Whereas, other tree species which are its associates are Mesuaferea, Lagerstroemiaparvifora, Schimawallichii, Acrocarpusfraxinifolius, Alstoniascholaris, Bombaxceiba, Artocarpuschaplasha, Bischofiajavanica, Castanopsishistrix, C.indicaC.tribuloides, Cinnamommumtamala, Elaeocarpusfloribundus, Lanneacoromandelica, Garugapinnata, Anthocephaluscadamba, Tetramelesnudiflora, Toonaciliata, Syzygiumspp. Callicarpaarborea, Careyaarborea, Emblicaofficinalis, Gmelinaarborea, Gynocardiaodorata, Mallotusphilippensis, Sapiumspp, Alpiniamalaccensis, Hollarhenaantidisentrica, Amomumspp., Colocasiaesculenta, Costusspeciosus, Globbamultiflora, Oxaliscorniculata, Phragmiteskarka, Zinggiberzerumbet, Z.capitatum, Z.cassununen, Cyperusspp.etc.; the common large woody shrub sare Abromaaugusta, Allophylluscobbe, Antidesmaacuminatum, Aporosaboxburghii, Bochmeriaplatyphvlla, Caseariavareca, Clerodendrumbracteatum, Crotoncaudatus, Euryaacuminata, Glycosmismauritiana, Holmskoldiasanguinea, Iteamacrophvlla, Ixoraacuminata, Leeaasperaworthii, Maoutiapuya, Mussaendamacrephvlla, M.rexburghii, Pavettaindicaetc.;the common herbsareAchyranthesaspera, Amaranthusspinosus, Celossiaargentica, Cyathulaprostrata, Echinochloahirta, Comphostemmaparviflorum, Orthosiphenincurvus, Phyllanthusdebilis, Houttyniacordataetc.;the gregarious grasses are Arundineriabengalensis, A.nepalensis, Centeheccalappacea, Digitariascendens, Echinecleacruspavenis, Ichnanthusvicinus, Lapthatherumgracile, Oplismenuscompositus, Panicumbrevifelium.P.paludesum,P.flavidunand Lianas andclimbersare Buteaparviflora, Derriseliptica, Entadapurseatha, Millettiacinerea, M.pachycarpa; andthecommonshrub by twiners are Mucunamacrocarpa, As pidepteriselliptica, Bvttneriagrandifolia, Combretumpunctatum, Dalhduseabracteata, Iodeshaokeriana, Natsiatumherpeticumand Roydsiasuaveglens, and Uncariapilosa and U.sessilifructus are two weak climbers on large shrubs in the dense Forest; And Whereas, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification, around the protected area of the Nongkhyllem Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; And Whereas, it lines become necessary to specify certain areas are around the Nongkhyllem Wildlife Sanctuary as Eco-sensitive Zone and to prohibit industries, operations or processes or class of industries, operations or processes in the said Eco-sensitive Zone. Now, Therefore, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule
(3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 335.07 metres to 8.43 kilometres from the boundary of the Nongkhyllem Wildlife Sanctuary in the State of Meghalaya as the Nongkhyllem Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and boundary of Eco-sensitive Zone.—(1)The extent of Eco-sensitive Zone varies from 335.07 metres to
8.43 kilometres from the boundary of the Nongkhyllem Wildlife Sanctuary and the total area of the Eco- sensitive Zone is
202.87 square kilometre.
(2) The boundary description of the Eco-sensitive Zone is appended as Annexure I.
(3) The map of Eco-sensitive Zone, co-ordinates of Eco-sensitive Zone and Wildlife Sanctuary is appended as Annexure II .
(4) The list of the villages falling within Eco-sensitive Zone along with coordinates of the prominent points is appended as Annexure III. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture and Horticulture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism including eco-tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal and urban development;
(x) Panchayati Raj; and
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.—(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the other purpose within the Eco-sensitive Zone, may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant State laws and other rules and regulations of Central or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as.—
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities; 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given under para 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant State laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities.
(2) Natural water bodies.—The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/ Eco-tourism.—(a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Eco-tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism.
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Ecosensitive Zone area.
(4) Natural Heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.—Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.— Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19
(8) Discharge of effluents.—Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government.
(9) Solid wastes.—Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste.—Bio medical waste management shall be as under:
(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016;
(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11) Plastic Waste Management.—The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016,.
(12) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016,.
(13) E-waste.—The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.
(14) Vehicular traffic.— The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution.—Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and the efforts to be made for use of cleaner fuel such as CNG, LPG.
(16) Industrial Units.—(a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.—The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.— All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE Sl. 1. Commercial Mining.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted. Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies. Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
7. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
8. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
9. Use of polythene bags. Prohibited (except as otherwise provided) as per applicable laws.
10. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
11. New wood based industry. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities
12. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
13. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as: ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and
(v) Promoted activities listed in this Notification:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any:
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
14. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
15. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
16. Collection of Forest produce or Non- Timber Forest Produce (NTFP). Regulated under applicable laws.
17. Erection of electrical and communication towers and laying of cables and other infrastructures . Regulated under applicable law. Underground cabling may be promoted.
18. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
19. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
20. Under taking other activities related to tourism like over flying the Ecosensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated under applicable law.
21. Protection of Hill Slopes and river banks. Regulated under applicable laws.
22. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
23. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals.
24. Discharge of treated waste water/effluents in natural water bodies or land area. The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws. 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
5. Monitoring Committee.—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:-
(a) The Conservator of Forests (Territorialand Wild Life), Government of Meghalaya – Chairman;
(b) Chief Forest Officer, Khasi Hills Autonomous District Council - Member;
(c) A representative from the Revenue Department, Ri-Bhoi District Nongpoh -Member;
(d) A representative of Non-governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Meghalaya for a term of three years – Member;
(e) One expert in the area of ecology and environment to be nominated by the Government of Meghalaya for three years - Member; and
(f) Member, State Biodiversity Board-Member;
(g) Divisional Forest Officer, Khasi Hills Wildlife Division, Shillong - Member Secretary.
6. Terms of Reference.—(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(4) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
25. Commercial extraction of surface and ground water. Regulated under applicable law.
26. Open Well, Bore Well etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority.
27. Solid Waste Management. Regulated under applicable laws.
28. Introduction of Exotic species. Regulated under applicable laws.
29. Eco-tourism. Regulated under applicable laws.
30. Commercial Sign boards and hoardings. Regulated under applicable laws. C. Promoted Activities
31. Rain water harvesting. Shall be actively promoted.
32. Organic farming. Shall be actively promoted.
33. Adoption of green technology for all activities. Shall be actively promoted.
34. Cottage industries including village artisans, etc. Shall be actively promoted.
35. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted.
36. Agro-Forestry. Shall be actively promoted.
37. Use of eco-friendly transport. Shall be actively promoted.
38. Skill Development. Shall be actively promoted.
39. Restoration of Degraded Land/ Forests/ Habitat. Shall be actively promoted.

(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV.
(7) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F. It goes along the community forest of Raid Nongpoh upto Umtas or community Forests (point-3 in a map at 25.811974 latitudes and 91.823244 longitudes) at about 19 kilometres.
