PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 172] ubZ fnYyh] cg̀Lifrokj] tuojh 19] 2017@ikS"k 29] 1938 No. 172] NEW DELHI, THURSDAY, JANUARY 19, 2017/PAUSA 29, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 18 जनवरी, 2017 का.आ. 185(अ).—भारत सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢ ालय कᳱ अिधसूचना सं. का. आ. 2541(अ), तारीख 2 िसत᭥बर, 2015, उन सभी ᳞िᲦयᲂ स,े िजनके उससे ᮧभािवत होने कᳱ सभंावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसचूना अंतᳶव᳥ ह,ै उपल᭣ध करा दी गई थᱭ, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सझुाव आमिंᮢत करत ेᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;
और, के᭠ᮤीय सरकार उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सझुावᲂ पर ᳇ारा स᭥यक ᱨप िवचार ᳰकया गया;
और, च᭛ डीगढ़ संघ रा᭔ यᭃेᮢ के सुखना व᭠ यजीव अभयार᭛य कᳱ सीमा दो अ᭠ य रा᭔ यᲂ अथाᭅत् पजंाब और हᳯरयाणा के साथ िमली ᱟई ह ै और सुखना व᭠ यजीव अभयार᭛य िशवािलक पहािड़यᲂ के अंतगᭅत आती ह ै जो पाᳯरि᭭ थितक ᱨप से संवेदनशील और भ-ूवै᭄ािनक ᱨप स ेअ᭭ थायी ह ैऔर इसिलए वषाᭅ के दौरान िमᲵी के कटाव के िलए उ᭒ च ᱨप स ेᮧवण ह।ै सुखना व᭠ यजीव अभयार᭛य का कुल ᭃेᮢफल 25.9849 वगᭅ ᳰकलोमीटर (6420.99 एकड़) ह ै;
और, इसके पाᳯरि᭭ थितक, ᮧािणजातीय, वन᭭ पतीय, आकृितिव᭄ानी, ᮧाकृितक और भ-ूवै᭄ािनक मह᭜ व के कारण इस ᭃेᮢ को च᭛ डीगढ़ ᮧशासन अिधसूचना सं. 694-एचआईआई(4)-98/4519 तारीख 6 माचᭅ, 1998 ᳇ारा व᭠ यजीव और इसके पयाᭅवरण के सरंᭃण, ᮧजनन और िवकास के ᮧयोजन के िलए व᭠ यजीव अभयार᭛य के ᱨप मᱶ घोिषत ᳰकया गया था । और, भारत के व᭠यजीव सं᭭थान के िनदᱷशन मᱶ, व᭠यजीव अभयार᭛य जनगणना, 2010 के दौरान, अनसुूची I और II कᳱ दो ᮧजाित और अनसुूची III कᳱ तीन ᮧजाित और अनुसूची IV कᳱ बᱟत सी ᮧजाित को सुखना वन् यजीव अभयार᭛य मᱶ ᳯरपोटᭅ ᳰकया गया था । उनमᱶ ᮧमुख ᮧजाितया ँजो ᳰक सुखना व᭠ यजीव अभयार᭛य मᱶ उपि᭭थत ह-ै तᱶदआु (पे᭠थेरा ᭭पा), सांभर (ᱨस ᭭पा), भारतीय साल (मािनस ᭭पा), गो᭨डन िसयार (कैनीस ᭭पा), ᮕे लंगूर (समेनोिपथेकस ᭭पा), जंगली सूअर (सूस ᭭पा), लाल जंगली मूगᱮ (गैलस ᭭पा), भारतीय मोर (पावो ᭭पा), चीतल (एिसस ᭭पा), गो᭨डन ओरीवली (ओᳯरओ᭨स ᭭पा), कोबरा 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ओᳰफयोफागुस ᭭पा), रसलै वाइपर (दबोइया ᭭पा), भारतीय अजगर (पाइथन ᭭पा), इ᭜याᳰद तथा इनके अितᳯरᲦ िविवध ᮧकार कᳱ ितितिलया ँ(70 स ेअिधक ᮧजाित) और अ᭠य कᳱड़ ेभी बᱟलता मᱶ पाये जात ेह ᱹ;
और, सुखना व᭠ यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसचूना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सरुिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭ करण करन ेको ᮧितिष करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (सरंᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए, च᭛ डीगढ़, संघ रा᭔ यᭃेᮢ मᱶ 1050 हेटेयर सुखना व᭠ यजीव अभयार᭛य कᳱ सीमा स े2.0 ᳰकलोमीटर स े2.75 ᳰकलोमीटर तक के िव᭭ ताᳯरत ᭃेᮢ को सुखना व᭠ यजीव अभयार᭛य पाᳯरि᭭ थितक सवेंदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार है, अथाᭅत ्:--
1. पाᳯरि᭭थितक सवंदेी जोन का िव᭭तार और उसकᳱ सीमाए.ं—(1) पाᳯरि᭭ थितक संवेदी जोन, चंडीगढ़ सघं रा᭔ यᭃेᮢ मᱶ सुखना व᭠ यजीव अभयार᭛य कᳱ सीमा से 2.0 ᳰकलोमीटर से 2.75 ᳰकलोमीटर के ᭃेᮢ तक िव᭭ ताᳯरत ह;ै संघ रा᭔ यᭃेᮢ चंडीगढ़ ᮧशासन न े पाᳯरि᭭ थितक संवेदी जोन को दो जोनᲂ मᱶ िवभािजत ᳰकया ह ैअथाᭅत ् जोन-I और जोन-II और सखुना व᭠यजीव अभयार᭛य कᳱ सीमा स ेजोन- I का िव᭭तार 0.5 ᳰकलोमीटर तक ह ैऔर सतंुलन ᭃेᮢ जोन-II मᱶ रखा जाएगा और यह व᭠यजीव िनवास ᭭थान के सरंᭃण के िलए जोन-I मᱶ सत मानदंडᲂ के उे᭫य स ेᳰकया गया ह;ै पाᳯरि᭭ थितक संवेदी जोन का ᭃेᮢ 1050.0 हे टेयर (चंडीगढ़ संघ रा᭔ यᭃेᮢ के भाग पर) ह ै।
(2) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का मानिचᮢ, इसके अᭃाशं और देशा᭠तर के साथ उपाबधं I के ᱨप मᱶ उपाब ह ै।
(3) पाᳯरि᭭थितक संवेदी जोन और सुखना व᭠यजीव अभयार᭛य के िनदᱷशाकं कᳱ सीमा का िववरण उपाबंध II और उपाबधं II क के ᱨप मᱶ उपाब ह ै।
(4) पाᳯरि᭭थितक संवेदी जोन के िनदᱷशांक इसके अᭃांश और दशेा᭠ तर के साथ उपाबंध III के ᱨप मᱶ उपाब ह ै।
(5) पाᳯरि᭭ थितक संवेदी जोन के अंतगᭅत आने वाले तीन ᮕाम, अथाᭅत् खुदा, अलीशेर, ᳰकशनगढ़ और काय᭥ बवाला ह ᱹ।
2. पाᳯरि᭭थितक सवंदेी जोन के िलए आचंिलक महायोजनाण.—(1) चंडीगढ़ सघं रा᭔ यᭃेᮢ पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अिंतम ᮧकाशन कᳱ तारीख स ेदो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल न अनबंुधᲂ के सामंज᭭ य स,े एक आंचिलक महायोजना तैयार करेगा ।
(2) आंचिलक महायोजना संघ रा᭔ यᭃेᮢ कᳱ सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) पाᳯरि᭭ थितक संवेदी जोन के िलए आंचिलक महायोजना, संघ रा᭔ यᭃेᮢ सरकार ᳇ारा इस अिधसचूना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित मᱶ तथा ससुगंत कᱶ ᮤीय और संघ रा᭔ यᭃेᮢ कᳱ िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना, इसमᱶ पयाᭅवरणीय और पाᳯरि᭭ थितक िवचारᲂ को समाकिलत करने के िलए िन᭥ निलिखत सभी संब संघ रा᭔ यᭃेᮢ कᳱ सरकार के िवभागᲂ के परामशᭅ स ेतैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पयᭅटन ;
(v) नगरपािलका ;

(vi) राज᭭ व ;
(vii) कृिष ;
(viii) चंडीगढ़ ᮧदषूण िनयंᮢण सिमित ;
(ix) ᳲसचाई; और
(x) लोक िनमाᭅण िवभाग।
(5) आंचिलक महायोजना अनमुोᳰदत िव᳒मान भ-ूउपयोग, अवसरंचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ और आंचिलक महायोजना मᱶ सभी अवसरंचना और अिधक ᮧभावी और पाᳯरि᭭ थितक अनकूुल ᳰᮓयाकलाप कारक इस ᮧकार िविन᳸द᭬ ट न हᲂ ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-सभंरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मदृा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐस ेअ᭠य पहलᲐू, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भिूम, हᳯरत ᭃेᮢ जैस ेउ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यंकन करेगी ।
(8) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास के पाᳯरि᭭ थितक अनकूुल िवकास और ᭭ थानीय समदुायᲂ कᳱ आजीिवका को सिुनि᭫ चत करते ᱟए िविनयिमत होगी ।
3. सघं रा᭔ यᭃेᮢ कᳱ सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय.— संघ रा᭔ यᭃेᮢ कᳱ सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत ्:--
(1) भ-ूउपयोग.—पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए ह ᱹपाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंत ुपाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, पैरा 5 के अधीन मानीटरी सिमित कᳱ िसफाᳯरश पर और संघ रा᭔ यᭃेᮢ कᳱ सरकार के पूवᭅ अनमुोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन ेके िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन ᮓम स.ं 21, 23, 29 और 34 के सामन ेसूचीब ᳰᮓयाकलापᲂ को पूरा करन ेके िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭ थितक अनकूुल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭थायी आवासन के िलए पाᳯरि᭭ थितक अनकूुल आरामगाह जैस ेटᱶट, लकड़ी के मकान आᳰद ;

(ii) ᮧदषूण काᳯरत न करने वाल ेलघु उ᳒ोग;
(iii) वषाᭅ जल संचयन; और
(iv) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण िश᭨पी भी ह ᱹ:
परंत ुयह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और सिंवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसिूचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंत ुयह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भ-ूअिभलेखᲂ मᱶ पाई जान ेवाली कोई ᮢुᳯट मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜यके मामल ेमᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ के᭠ᮤीय सरकार, पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय को सूचना दनेी होगी :
परंत ुयह भी ᳰक उपयुᭅᲦ ᮢुᳯट के संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भ-ूउपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा :
परंत ुयह भी ᳰक हᳯरत ᭃेᮢ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अᮧयु त या अन᭜ु पादक कृिष ᭃेᮢᲂ मᱶ पनु: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल-᮲ोत.— आचंिलक महायोजना मᱶ सभी ᮧाकृितक ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुननᭅवीकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट ऐसे िवकास ᳰᮓयाकलापᲂ को जो ऐस ेᭃेᮢᲂ के िलए हािनकारक हᲂ, ᮧितिष करने के िलए मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन.—(क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, पयᭅटन महायोजना के अनुसार हᲂगे, जो आंचिलक महायोजना का भाग ᱨप हᲂगे । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, संघ रा᭔ यᭃेᮢ, च᭛डीगढ़ सरकार के पयᭅटन िवभाग ᳇ारा राज᭭ व और वन िवभाग, सघं रा᭔ यᭃेᮢ च᭛डीगढ़ सरकार के परामशᭅ से तैयार होगी । (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा जारी (समय-समय पर यथा संशोिधत) मागᭅिनदशेᲂ के अनुसार होगा िजसमᱶ पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व ᳰदया जाएगा और पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा ;
(ii ) पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और ᳯरसोटᭅ के नए संिनमाᭅण अनु᭄ात नहᱭ हᲂगे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (iii ) आंचिलक महायोजना का अनमुोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगक िवरासत.—(पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाᲐ, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ पᳯररिᭃत ᳰकया जाएगा तथा उनकᳱ सरुᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगी ।
(5) मानव िनᳶमत िवरासत ᭭ थल.—पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, सरंचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ और अहातᲂ कᳱ पहचान कᳱ जाएगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर उनके सरंᭃण कᳱ योजनाएं तैयार कᳱ जाएंगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएंगी ।
(6) ᭟ विन ᮧदषूण.—(च᭛डीगढ़ संघ रा᭔य ᭃेᮢ, पयाᭅवरण (सरंᭃण) अिधिनयम 1986 के अधीन ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 मᱶ िनयत उपबंधᲂ के अनुसरण मᱶ पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟विन ᮧदषूण के िनयंᮢण के िलए िविनयमᲂ को कायाᭅि᭠वत करेगा ।
(7) वाय ुᮧदषूण.—(पाᳯरि᭭थितक संवेदी जोन मᱶ, वाय ुᮧदषूण के िनयंᮢण के िलए चंडीगढ़ संघ रा᭔ यᭃेᮢ ᮧदषूण िनयंᮢण सिमित वाय ु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण.—(पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (सरंᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥.—(ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसचूना सं. का.आ. 1357(अ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनसुार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय सघंटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम स े पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(10) जैव िचᳰक᭜ सीय अपिश᭬ ट.—पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसचूना सं.का.िन.343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय पᳯरवहन.—पᳯरवहन कᳱ यानीय गितिविधया ंआवास के अनकूुल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होन ेऔर रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनमुोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनसुार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
4. पाᳯरि᭭थितक सवंदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰकए जान ेवाल ेᳰᮓयाकलापᲂ कᳱ सचूी.—पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत ्:-- सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
(1) वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़न े कᳱ इकाइयां । (क) सभी ᮧकार के खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइया ं वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेल ू आव᭫यकताᲐ के िसवाय नहᱭ हᲂगी ;
(ख) माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गोᳲवदरामन िथᱧमलूपाद बनाम भारत सरकार के मामल ेमᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामल े मᱶ तारीख 21 अᮧैल, 2014 के अतंᳯरम आदशे के कठोर अनुसरण का ᮧचालन होगा ।
(2) आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(3) जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर ᳰकसी नए और ᮧदषूण काᳯरत करने वाल ेिव᳒मान उ᳒ोगᲂ का िव᭭ तार अन᭄ुात नहᱭ होगा ।
(4) ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(5) जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(6) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(7) भ-ूजल सचंयन सिहत वािणि᭔ यक जल ᮲ोत । पाᳯरि᭭ थितक संवेदी जोन मᱶ भ-ूजल सिहत ᮧाकृितक जल ᮲ोतᲂ के वािणि᭔ यक उपयोग को ᮧितिष ᳰकया जाएगा । जल के संदषूण या ᮧदषूण के िनवारण के िलए सभी कायᭅवािहयां कᳱ जाएंगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
(8) ᮧमुख थमᭅल और हाइᮟो िव᳒ुत पᳯरयोजनाᲐ कᳱ ᭭थापना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(9) नए का᭬ ठ आधाᳯरत उ᳒ोग। पाᳯरि᭭ थितक संवेदी जोन के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना अनु᭄ात नहᱭ होगी:
परंत ुिव᳒मान का᭬ ठ आधाᳯरत उ᳒ोग िविध के अनसुार बना रहगेा :
परंत ु यह और ᳰक िव᳒मान आरा िमलᲂ कᳱ अनु᭄ि᭡ तयᲂ का नवीकरण उनकᳱ पयᭅवसान अविध पर नहᱭ ᳰकया जाएगा ।
(10) कॉपᲃरेट फमᲄ और कंपिनयᲂ ᳇ारा बड़ ेपैमान ेपर वािणि᭔यक पशुᲐ और पो᭨ᮝी फामᲄ कᳱ ᭭थापना। लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय)। हालाᳰंक, ᭭थानीय ᳰकसानᲂ के ᳇ारा एक छोटे पैमान ेपर पहल कᳱ अनमुित दी ह।ै िविनयिमत ᳰᮓयाकलाप
(11) होटलᲂ और ᳯरसोटᲄ कᳱ वािणि᭔यक ᭭थापना । पाᳯरि᭭थितक अनकूुल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सिुवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा स ेएक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक इनमᱶ जो भी िनकट ह,ै नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे। पर᭠त ु व᭠यजीव अभयार᭛य कᳱ सीमा स े एक ᳰकलोमीटर स े परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनᱧुप होगा । वािणि᭔यक पाᳯरि᭭थितक पयᭅटन के साथ "व᭠यजीव िनवास मᱶ गैर वािनकᳱ ᳰᮓयाकलापᲂ के िलए ᳰदशा-िनदᱷशᲂ" के अनसुार जारी एफ. स.ं 610/2011 व᭠यजीव ᳰदनाकं 15-03.2011 ᳇ारा पयाᭅवरण और वन मंᮢालय (व᭠यजीव ᮧभाग), नई ᳰद᭨ली और रा᳦ीय बाघ सरंᭃण ᮧािधकरण के ᳰदशा िनदᱷशᲂ (यᳰद लागू हो) के साथ िविनयिमत ᳰकया जाएगा ।
(12) सि᳖माᭅण ᳰᮓयाकलाप। संरिᭃत ᭃेᮢ कᳱ सीमा या पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक जो भी िनकट हो, से 0.5 ᳰकलोमीटर (जोन-1) के भीतर ᳰकसी भी ᮧकार के नये वािणि᭔यक सिंनमाᭅण अनु᭄ात नहᱭ होगᱶ:
परंतु ᭭ थानीय लोगᲂ को परैा 3 के उपपैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भिूम मᱶ सिंनमाᭅण करने कᳱ अनु᭄ात होगᱶ । (क) सभी ᮧकार के नए भवनᲂ और घरᲂ का संिनमाᭅण जोन-1 मᱶ 0.5 ᳰकलोमीटर कᳱ दरूी पर ᮧितिष होगा; सुखना व᭠ यजीव अभयार᭛य कᳱ सीमा स े0.5 ᳰकलोमीटर से 1.25 ᳰकलोमीटर तक, कम घन᭜व के सिंनमाᭅण (भूखंड के आधे से कम भाग को आ᭒छाᳰदत ᳰकया जायेगा) और कम ऊचाईँ वाल ेभवन (15 फᳱट ऊचाँई तक) अनु᭄ात करेगᱶ यᳰद ᭃेᮢ के भिूम उपयोग योजना के अधीन अनु᭄ेय ह;ै ᭃेᮢ के ᳰकसी भी संिनमाᭅण िवकास िविनयमन के िलए लागू करना होगा और पाᳯरि᭭थितक संवेदी जोन कᳱ ᮧबंधन योजना के अनुसार िविनयिमत ᳰकया जाएगा; परंतु 1.25 ᳰकलोमीटर से परे संघ रा᭔य शािसत ᮧदशे ᮧशासन चंडीगढ़ ᮧशासन भवन के उपिनयम और वा᭭तिुवद िनयंᮢण/सघं रा᭔य ᭃेᮢ के ᮧशासन के जोᳲनग के िविनयमन के अनुसार नए भवनᲂ और िव᳒मान घरᲂ के सिंनमाᭅण िविनयिमत करेगा। पाᳯरि᭭थितक संवेदी जोन के जोन-1 मᱶ तहखानᲂ के सिंनमाᭅण अनु᭄ात नहᱭ होगᱶ, तथािप, जोन-1 मᱶ भवन के पुनᳶनमाᭅण/मर᭥मत उपयᲦु के अधीन रहत े ᱟए, अनु᭄ात होगा जैसे कम घन᭜व के सिंनमाᭅण (भूखंड के आधे स े कम भाग को आ᭒छाᳰदत ᳰकया जायेगा) और कम ऊचाँई वाल ेभवन (15 फᳱट ऊचाँई तक) होगᱶ। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनमुित स,े ᮧदषूण न काᳯरत करने वाले लघु उ᳒ोग स े संबंिधत सिंनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएगें और ᭠ यूनतम पर रखे जाएंगे । (ग) इसके अितᳯरᲦ, आंचिलक महायोजना के अनसुार संिनमाᭅण और नागᳯरक सिुवधाᲐ कᳱ वृि िविनयिमत होगी।
(13) िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण । संघ रा᭔य ᭃेᮢ के चंडीगढ़ ᮧशासन ᳇ारा िविनयिमत ᳰकया जाएगा;
भिूमगत केबलᲂ को ᮧो᭜ साहन दनेा ।
(14) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनमुित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई, संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनसुार िविनयिमत होगी ।
(15) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण । पाᳯर᭭थितक संवेदी जोन मᱶ िव᳒मान सड़को, नई सड़कᲂ का संिनमाᭅण और िव᳒मान सड़कᲂ को चौड़ा करना या मर᭥मत करना िविनयिमत होगा तथा ᭠यूनतम समाधान के साथ ᳰकया जाएगा ।
(16) उᲬ टᱶशन पारेषण लाइनᲂ का पᳯरिनमाᭅण । यथा लागू िविनयिमत के अनसुार हᲂगे; भिूमगत केबलᲂ को ᮧो᭜ साहन ᳰदया जाएगा ।
(17) िवदेशी ᮧजाितयᲂ को लाना। पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ मᱶ िवदशेी ᮧजाितयᲂ कᳱ शुᱨआत िविनयिमत ᳰकया जाएगा।
(18) होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । होटल और लॉज के पᳯरसर कᳱ बाड़ लगान े के पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ मᱶ िविनयिमत ᳰकया जाएगा।
(19) वायु (िजसके अतंगᭅत ᭟विन ᮧदषूण भी ह)ै और यािनक ᮧदषूण। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(20) वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(21) पाᳯरि᭭ थितक अनकूुल पयᭅटक ᳰᮓयाकलापᲂ के िलए, पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक अनकूुल कुटीर, जैसे तंबू, लकड़ी के घर आᳰद । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(22) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अबमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
(23) ᮧदषूण उ᭜प᳖ न करन ेवाल ेलघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन मᱶ देशीय माल से उ᭜पादᲂ का उ᭜पादन करने वाल े गैर ᮧदषूण, गैर पᳯरसंकटमय, लघ ुऔर सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत दशेीय माल स ेऔ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात ᳰकए जाएगें ।
(24) पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वाय ुगु᭣बारᲂ आᳰद ᳇ारा रा᳦ीय उ᳒ान ᭃेᮢ के ऊपर से उड़ाना और अ᭠य पयᭅटन ᳰᮓयाकलाप । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे (सघं शािसत ᮧदशे चंडीगढ़ के मुय व᭠यजीव वाडᭅन कᳱ पूवᭅ अनुमित के साथ) ।

(26) ᭡ लाि᭭ टक के थैलᲂ का उपयोग। लागू िविधयᲂ (अ᭠ यथा उपबंिधत के िसवाय) के अधीन िविनयिमत हᲂगे ।
(27) पाᳯरि᭭थितक-पयᭅटन ᳰᮓया- कलाप । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । सवंᳶधत ᳰᮓयाकलाप
(28) ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(29) वषाᭅ जल संचयन । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।
(30) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(31) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।
(32) जैिवक खेती । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।
(33) वान᭭ पितक बाड़ । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(34) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह।ᱹ सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।
(35) कृिष वािनकᳱ। सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।
(36) पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।
(37) कौशल िवकास । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।
5. पाᳯरि᭭थितक सवेंदी जोन मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत स ेिमलकर बनेगी, अथाᭅत ्:-
(i) मुय वन सरंᭃक/सह मुय व᭠ यजीव वाडᭅन, चंडीगढ़ संघ रा᭔ यᭃेᮢ कᳱ सरकार–अ᭟यᭃ;
(ii) मु य वा᭭ तकुार, चंडीगढ़ सघं रा᭔ यᭃेᮢ–सद᭭ य ;
(iii) मु य इंजीिनयर, चंडीगढ़ सघं रा᭔ यᭃेᮢ–सद᭭ य ;
(iv) मु य इंजीिनयर, नगर िनगम, चंडीगढ़ संघ रा᭔ यᭃेᮢ–सद᭭य;
(v) िनदशेक, ᮕामीण िवकास और पंचायत, संघ रा᭔ यᭃेᮢ, चंडीगढ़–सद᭭य ;
(vi) सद᭭ य-सिचव, चंडीगढ़ ᮧदषूण िनयंᮢ ण सिमित–सद᭭ य ;
(vii) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाल ेगैर सरकारी संगठनᲂ से चंडीगढ़ संघ रा᭔ यᭃेᮢ कᳱ सरकार ᳇ारा तीन वषᭅ के िलए नामिन᳸द᳥ ᮧितिनिध–सद᭭य
(viii) पाᳯरि᭭ थितक और पयाᭅवरण के ᭃेᮢ मᱶ एक िवशेष᭄ िजस े चंडीगढ़ संघ रा᭔ यᭃेᮢ कᳱ सरकार ᳇ारा नामिन᳸द᭬ ट ᳰकया जाएगा– सद᭭ य ;

(ix) रा᭔य जैव-िविवधता बोडᭅ का सद᭭य –सद᭭य;
(x) उप वन सरंᭃक (व᭠ यजीव), चंडीगढ़ संघ रा᭔ यᭃेᮢ–सद᭭य-सिचव ।
6. िनदᱷश िनबंधन
(1) मानीटरी सिमित का कायᭅकाल तीन वषᭅ का होगा।
(2) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ.

(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐस ेᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंत ुपाᳯरि᭭थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐस ेᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(5) मानीटरी सिमित का सद᭭य-सिचव या संब उपायु त, ऐस े᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन े के िलए सᭃम होगा ।
(6) मानीटरी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहत े ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमिंᮢत कर सकेगी ।
(7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय जीव वाडᭅन उपाबधं IV मᱶ उपबंिधत ᱨप िवधान के अनसुार उ त वषᭅ के 30 जनू तक ᮧ᭭तुत करेगी ।

8. कोई अ᭠ य मह᭜ वपणूᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 18th January, 2017 S.O. 185(E).—whereas, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number fS.O. 2541 (E), dated the 2nd September, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, objections and suggestions were received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
And whereas, the Sukhna Wildlife Sanctuary in the Union territory of Chandigarh shares the boundary with two other States viz Punjab and Haryana and Sukhna Wildlife Sanctuary falls in the Shivalik Hills which are ecologically sensitive and geologically unstable and thus are highly prone to soil erosion during rains and the total area of Sukhna Wildlife Sanctuary is 25.9849 square kilometres (6420.99 acres).
And whereas, due to its ecological, faunal, floral, geo-morphological, natural and geological significance for the purpose of protecting, propagating and developing wildlife and its environment, this area was declared as Wildlife Sanctuary vide Chandigarh Administration notification No. 694-HII(4)-98/4519, dated the 6th March, 1998.
And whereas, as per Wildlife Census, carried out under the guidance of Wildlife Institute of India, during 2010, two species of Schedules I and II and three species of Schedule III and many species of Schedule IV of Wildlife (Protection) Act, 1972 (53 of 1972), were reported in Sukhna Wildlife Sanctuary; among prominent species present in the Sukhna Wildlife Sanctuary are-Leopar (Panthera sp.), Sambar (Rusa sp.), Indian Pangolin (Manis sp.), Golden Jackal (Canis), Grey Langur (Semnopithecus sp.), Wild Boar (Sus sp.), Red Jungle Fowl (Gallus sp.), Indian Peafowl (Pavo sp.), Chital (Axis sp.), Golden Oriole (Oriolus sp.), Cobra (Ophiophagus sp.), Russell’s Viper (Daboia sp.), Indian Python (Python sp.), etc. apart from this a wide variety of butterflies (more than 70 species) and other insects are found in abundance.
And whereas, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of the Sukhna Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
Now, therefore, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub-section
(2) and sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of 1050 hectares, to an extent varying from 2.0 kilometres to 2.75 kilometres from the boundary of the Sukhna Wildlife Sanctuary in the Union territory of Chandigarh on the side of Chandigarh as the Sukhna Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.— (1) The extent of Eco-sensitive Zone varies from 2.0 kilometres to 2.75 kilometres from the boundary of the Sukhna Wildlife Sanctuary in the Union territory of Chandigarh;
the Union territory Administration of Chandigarh has divided the Eco-sensitive Zone in two zones i. e., Zone-I and Zone- II and The extent of Zone-I is upto 0.5 km of from the boundary of the Sukhna Wildlife Sanctuary and the balance area shall be in Zone-II and this has been done with the purpose of having stricter norms in Zone-I for protection of wildlife habitat; the area of Eco-sensitive Zone is 1050.0 hectares (on the side of Union territory of Chandigarh).
(2) The map of Eco-sensitive Zone boundary together with its latitudes and longitudes is appended as Annexure I.
(3) The boundary description of the Eco-sensitive Zone and co-ordinates of Sukhna Wildlife Sanctuary are appended as-Annexure II and Annexure IIA .
(4) The coordinates of Eco-sensitive Zone with its latitudes and longitudes is appended as Annexure III .
(5) There are three villages falling within the Eco-sensitive Zone namely, Khuda Alisher, Kishangarh and Kaimbwala.

2. Zonal Master Plan for Eco-sensitive Zone.— (1) The Union territory of Chandigarh shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the Union territory Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the Union territory Government in such manner as is specified in this notification and also in consonance with the Central and Union territory laws and the guidelines issued by the Central Government, if any.
(4) The said Plan shall be prepared in consultation with all Union territory Government Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Chandigarh Pollution Control Committee;
(ix) Irrigation; and
(x) Public Works Department, for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide the details for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities.
3. Measures to be taken by Union territory Government.— The Union territory Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.— Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the Union territory Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 21, 23, 29 and 34 in column (2) of the Table in paragraph 4, namely:-
(i) eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, for eco-friendly tourism activities;
(ii) small scale industries not causing pollution;
(iii) rainwater harvesting; and
(iv) cottage industries including village artisans:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the Union territory Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the Union territory Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area etc. and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.— The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union territory Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.— (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall be part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Union territory Government of Chandigarh in consultation with Department of Revenue and Forests, Government of Union territory of Chandigarh.
(c) The activity of tourism shall be regulated as under, namely.—
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in based on carrying capacity study of the Eco-sensitive Zone and in accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of Environment, Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;
(ii) new construction of hotels and resorts shall not be permitted within Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.— All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.— Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.— Chandigarh Pollution Control Committee shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986
(7) Air pollution.— Chandigarh Pollution Control Committee shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.
(8) Discharge of effluents.— The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.— The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343(E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the Union territory Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.— All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:- TABLE Sl.No. Activity Remarks

1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units are prohibited except for the domestic needs of bona fide local residents.
(b) The mining operations shall strictly be in accordance to the orders of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T. N. Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No. 202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No. 435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of existing polluting industries shall be permitted within the Eco-sensitive Zone.
4. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per law.
5. Commercial use of firewood. Prohibited (except as otherwise provided) as per law.
6. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per law.
7. Commercial water resources including ground water harvesting.
Commercial use of natural water resources including ground water shall be prohibited in the Eco-sensitive Zone and all steps shall be taken to prevent contamination or pollution of water.
8. Establishment of new thermal and major hydroelectric projects.
Prohibited (except as otherwise provided) as per applicable laws.
9. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone:
Provided the existing wood-based industry may continue as per law:
Provided further that renewal of licenses of existing saw mills shall not be done on their expiry.
10. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies.
Prohibited (except as otherwise provided) as per applicable laws, however, initiatives on a small-scale by the local farmers are permitted.
B. RegulatedActivities:

11. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre. of the boundary of the protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond one kilometre or up to the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Eco- Tourism Master Plan.
Commercial eco-tourism establishments shall be regulated strictly in accordance with the guidelines for taking non-forestry activities in Wild life habitats" issued vide F.No.610/2011 WL, dated 15-03.2011 by the Ministry of Environment and Forest (WL Division), New Delhi and National Tiger Conservation Authority Guidelines (if applicable).
12. Construction activities. No new commercial construction of any kind shall be permitted within 0.5 kilometre (Zone-I) from the boundary of protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3.
(a) Construction of all types of new buildings and houses up to a distance of 0.5 km i.e. in the zone-I shall be prohibited;
from 0.5 kilometre to 1.25 kilometre from the boundary of Sukhna Wildlife Sanctuary, construction of low density (ground coverage less than half of the plot size ) and low rise building (height upto 15 feet) can be allowed if permissible under the prescribed land use plan of the area.; any construction will have to adhere to the Development Regulation applicable to the area and shall be regulated as per the Eco-sensitive Zone management plan; beyond 1.25 kilometre construction of new buildings and houses shall be regulated as per existing Chandigarh Administration Building Bylaws and Architectural Control/Zoning regulation of Union territory Administration. Construction of basement in Zone-I of Eco-sensitive Zone shall not be allowed, however, reconstruction/repair of building in Zone-I shall be allowed subject to the restriction as above i. e. construction of low density (ground coverage less than half of the plot size) and low rise building (height upto 15 feet).
(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any.
(c) The further, construction and augmentation of civic amenities shall be regulated as per the Zonal Master Plan.
13. Erection of electrical and telecommunication towers.
Shall be regulated by Union territory of Chandigarh Administration; underground cabling shall be promoted.
14. Felling of trees. (a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the Union territory Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the Central or the Union territory laws and the rules made thereunder.

15. Widening and strengthening of existing roads and construction of new roads.
Construction of new roads and widening or repair of existing roads in the Eco-sensitive Zone shall be regulated and done with minimal impacts.
16. Erection of high tension transmission lines.
As per regulations, as applicable; underground cabling shall be promoted.
17. Introduction of exotic species. Introduction of exotic species shall be regulated in the Ecosensitive Zone.
18. Fencing of premises of hotels and lodges.
Fencing of premises of hotels and lodges shall be regulated in the Eco-sensitive Zone.
19. Air (including noise) and vehicular pollution.
As Regulated under applicable laws.
20. Commercial sign boards and hoardings.
As Regulated under applicable laws.
21. Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, etc.
for eco-friendly tourism activities.
As Regulated under applicable laws.
22. Discharge of treated effluents in natural water bodies or land area.
Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
23. Small scale industries not causing pollution.
Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Ecosensitive Zone which do not cause any adverse impact on environment shall be permitted.
24. Undertaking activities related to tourism like over-flying the national park area by aircraft, hotair balloons.
Regulated under applicable laws (with prior approval of Chief Wildlife Warden of the Union territory of Chandigarh).
25. Solid Waste Management Regulated under applicable laws.
26. Uses of plastic carry bags. Regulated (except as otherwise provided) as per law.
27. Eco-Tourism Activity Regulated under applicable laws.
C. Promoted Activities:
28. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming and fisheries.
Permitted under the law.
29. Rain water harvesting. Shall be actively promoted.
30. Use of renewable energy sources. Permitted under the law.
31. Adoption of green technology for all activities.
Shall be actively promoted.
32. Organic farming. Shall be actively promoted.
33. Vegetative fencing. Permitted under the law.
34. Cottage industries including village artisans, etc.
Shall be actively promoted.
35. Agro forestry. Shall be actively promoted.
36. Environnemental awareness Shall be actively promoted.
37. Skill development Shall be actively promoted.
5. Monitoring Committee.—The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:- 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) Chief Conservator of Forest cum Chief Wildlife Warden, Government of Union territory (UT) Chandigarh –Chairman;
(ii) Chief Architect, UT, Chandigarh –Member;
(iii) Chief Engineer, UT, Chandigarh –Member;
(iv) Chief Engineer, Municipal Corporation UT, Chandigarh –Member;
(v) Director Rural Development and Panchayat, UT, Chandigarh –Member;
(vi) Member Secretary, Chandigarh Pollution Control Committee –Member;
(vii) A representative of Non-governmental Organisations’ working in the field of environment to be nominated by the Government of Union territory of Chandigarh for a term of three years –Member;
(viii) One expert in the area of ecology and environment to be nominated by the Government of UT, Chandigarh –Member;
(ix) Member of State Biodiversity Board –Member;
(x) Deputy Conservator of Forest (WL), UT Chandigarh –Member -Secretary.
6. Terms of reference.—
(1) The tenure of the Monitoring Committee shall be three years.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the concerned Regulatory Authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Conservator Forest (WL) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the Union territory per proforma appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
(9) The Central Government and the Union territory Government may specify additional measures, if any, for giving effect to provisions of this notification.
(10) The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
