कय.आ. 67 र्यरीख 10 दिसम्बर, 2015 द्वयरय भयरर् के रयजपत्र असयियरण में प्रकयधिर् की गई थी धजसमें उन सभी व्यधिर्ों से, धजनको उससे प्रभयधवर् होने की संभयवनय थी, उस र्यरीख से, धजसको उि अधिसूचनय की रयजपत्र की प्रधर्र्यं जनर्य को उपलब्ि करय िी गई थीं, सयठ दिन की अवधि के भीर्र, आक्षेप और सुझयव आमंधत्रर् दकए गए थे;
और, प्रयरूप अधिसूचनय अंर्र्वाष्ट करर्े हुए रयजपत्र की प्रधर्र्यं 10 दिसम्बर, 2015 को उपलब्ि करय िी गई थी;
और, सयठ दिन की अवधि धवधनर्िाष्ट के भीर्र प्रयरूप अधिसूचनय के प्रत्र्ुत्तर में व्यधिर्ों और पणाियररर्ों से प्रयप्त कोई आक्षेप और सुझयव प्रयप्त नहीं हुए हैं;
और, गयगय अभर्यरण्र् गुजरयर् रयज्र् के जयमनगर धजले के कल्र्यणपुर र्यलुक में ग्रयम गयगय के पयस 2232’ उ, 70 08’ पू में धथथर् एक अनोखी आर्द्ाभूधम पर्यावरण-व्यवथथय है। र्ह प्रमुख धर्मयही भयरिर्य से 11 दकलोमीिर और 22 दकलोमीिर िरू ह।ै जयमनगर द्वयररकय रयज्र् रयजमयगा पर एक धवभयजन से िरू ह ै। अभर्यरण्र् क्षेत्र में 332.87 हेक्िेर्र क्षेत्रफल है। परंर्ु अभर्यरण्र् िो भयगों में धथथर् है और बीच में जल अपधिष्ट के धवियल धहथसों में धथथर् ह।ै गयगय भयग-1 कय क्षेत्र, जो ग्रयम के िधक्षण पूवा दििय में पड़र्य है, एक फ्लैि है धजसमें कोमल ढयल ह ैजो उत्कृष्ट घयस भूधम पयररधथथधर्क र्ंत्र कय समथान करर्य ह।ै इससे पहले इस क्षेत्र को "धविी" के रूप में प्रबंधिर् दकर्य गर्य थय, लेदकन क्षेत्र के पयररधथथधर्क, भौगोधलक, भौधर्की, पुष्प और गौण महत्व को अभर्यरण्र् के व्ययपक सरकयरी अधिसूचनय संख्र्य जीवीएन/57/88/डब्ल्र्ूएलपी-1087/जी-49/वी-2 दिनयंक 24-11-88 क्षेत्र 332.87 हेक्िेर्र में घोधिर् दकर्य गर्य थय;
और, वन्र्जीव अभर्यरण्र् कय क्षेत्र 3.33 वगा दकलोमीिर में फैलय ह ैऔर गुजरयर् रयज्र् में िवेभूधम द्वयरकय धजले के कल्र्यणपुर र्यलुक में गयगय धथथर् है;
और, र्ह क्षेत्र "ओखयरी रेधगथर्यन क्षेत्र" के भीर्र धथथर् ह ैऔर पधिमी भयग में ियिय नमक कयम ह ैऔर कच्छ की खयड़ी है जो कई पक्षी प्रजयधर्र्ों को आकर्िार् करर्ी ह।ै वयथर्व में सर्िार्ों के बयि के धहथसों में निी और झीलों में पयनी नमकीन होर्य ह ैऔर इस प्रकयर इस 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] क्षेत्र में कई जलीर् और समुर्द्ी पक्षी और वयडसा आकर्िार् होर्े हैं। प्रवयसी के्रन िोनों डेमोइसल और कॉमन के्रन सर्िार्ों में रहर्ी है, खुले मैियन और नमक डयलनय उनके धलए अच्छय भुनयर्े हुए मैियन हैं। गयगय अभर्यरण्र् क्षेत्र के महत्व के नीचे दिए गए हैं-:
र्ह जैव-धवधविर्य में बहुर् समृद्ध ह ैके सयथ 300 एसपीपी. से अधिक कुछ लुप्तप्रयर् एसपीपी. सधहर्। र्ह लुप्तप्रयर् एसपीपी. में धनवयस करर्े ह ैजैसे, हुबयरय बथिडा और भेधड़र्य। इस क्षेत्र में कई पक्षी, सरीसृप और थर्नियरी पयए जयर्े हैं। पौिों और चरयगयह के धलए आििा थथल जहयं कुछ अन्र् एसपीपी. थथयनयंर्ररर् दकए जयर्े ह।ै पयररधथथधर्क और अन्र् िोि के धलए र्ह आििा अवसर प्रियन करर्य ह।ै और, अभर्यरण्र् क्षेत्र में जैसे प्रॉपॉपीज जुलीफ्लोरय, सयइपरस और थकेरपस प्रजयधर्र्यं, ियईफय हयथीधर्र्य, धथपनफेक्स थिोलोधनफेरय सल्वयडोरो, कैलोट्रोधपस आदि प्रजयधर्र्यं पयए गए हैं। और, इस क्षेत्र में पयए गए के्रन, एग्रेट्स, पेधलकन, एवोकेिल, हरेोन, हरैरर्र इत्र्यदि जैसे पधक्षर्ों की धवधविर्यएं ह।ै मॉधनिर धछपकली, चूह ेसयंप, रसेल वयइपर, सथकंक इत्र्यदि जैसे सरीसृपों की धवधविर्य र्हयं धमली। लकड़बग्घय, भेधड़र्य, ब्लू बुल, धसर्यर, सयही, सयमयन्र् नेवलय जैसे धवधभन्न थर्नियररर् र्हयं पयर्े गए। अर्ः अब केन्र्द्ीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के सयथ परठर् पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (2) के खंड (v) और खंड (xiv) और उपियरय (1) द्वयरय प्रित्त िधिर्ों कय प्रर्ोग करर्े हुए, गुजरयर् रयज्र् में गयगय वन्र्जीव अभर्यरण्र् एकसयथ गरठर् हैं, की सीमय से 1.0 दकलोमीिर र्क के धवथर्यररर् क्षेत्र को गयगय वन्र्जीव अभर्यरण्र् पयररधथथधर्क संवेिी जोन (धजसे इसमें इसके पियर्् पयररधथथधर्क सवंेिी जोन कहय गर्य ह)ै के रूप में अधिसूधचर् करर्ी ह ैधजसकय धववरण धनम्नयनुसयर है, अथयार् ्:-
1. पयररधथथधर्क संविेी जोन कय धवथर्यर और उसकी सीमयएं--(1) पयररधथथधर्क संवेिी जोन की पररिीर् क्षेत्र 19.43 वगा दकलोमीिर चौरस के सयथ गयगय अभर्यरण्र् की सीमय के आसपयस एक दकलोमीिर र्क फैलय हुआ है।
(2) गयगय अभर्यरण्र् के पयररधथथधर्क संवेिी जोन की सीमय कय वणान उपयबंि Iक, और Iख के रूप में दिर्य गर्य ह ै।
(3) अक्षयंि और ििेयंर्र के सयथ पयररधथथधर्क संवेिी जोन की सीमय के सयथ इसके मयनधचत्र कय ब्र्ौरय उपयबंि II के रूप में उपयबद्ध ह ै।
(4) पयररधथथधर्क संवेिी जोन के अंर्गार् आने वयले पयंच ग्रयमों की सूची उपयबंि III के रूप में संलग्न ह ै।
2. पयररधथथधर्क सवंिेी जोन के धलए आचंधलक महयर्ोजनय – (1) रयज्र् सरकयर, पयररधथ थधर्क संवेिी जोन के प्रर्ोजन के धलए रयजपत्र में अधिसूचनय के अंधर्म प्रकयिन की र्यरीख से िो विा की अवधि के भीर्र, थथयनीर् व्यधिर्ों के परयमिा से, इस अधिसूचनय में संलग् न अनुबंिों के सयमंजथ र् से आंचधलक महयर्ोजनय र्ैर्यर करेगी ।
(2) उि र्ोजनय रयज्र् सरकयर में सक्षम प्रयधिकयरी द्वयरय अनुमोदिर् होगी ।
(3) पयररधथ थधर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय इस अधिसूचनय में धवधनर्िाष् ि रूप में ससी रीधर् में रयज् र् सरकयर र्थय सुसंगर् कें र्द्ीर् और रयज् र् धवधिर्ों के सयमंजथ र् में भी र्थय कें र्द्ीर् सरकयर द्वयरय जयरी मयगाधनिदेशि, र्दि कोई हों, द्वयरय र्ैर्यर होगी ।
(4) आंचधलक महयर्ोजनय, उि र्ोजनय में पर्यावरणीर् और पयररधथ थधर्क बयर्ों को समयकधलर् करने के धलए रयज् र् के धनम्नधलधखर् धवभयगों के परयमिा से र्ैर्यर होगी, अथयार््:--
(i) पर्यावरण ;
(ii) वन और वन्र्जीव;
(iii) कृधि;
(iv) रयजथ व;
(v) िहरी धवकयस ;
(vi) पर्ािन;
(vii) ग्रयमीण धवकयस;

(viii) ससंचयई और बयढ़ धनर्ंत्रण;
(ix) नगरपयधलकय;
(x) पंचयर्र्ी रयज; और
(xi) लोक धनमयाण धवभयग।
(5) महयर्ोजनय अनुमोदिर् धवद्यमयन भू-उपर्ोग, अवसंरचनयत् मक और दक्रर्यकलयपों पर कोई धनबबंधिन अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय में धवधनर्िाष्ट न हों और आचंधलक महयर्ोजनय में सभी अवसंरचनय दक्रर्यकलयपों में िक्षर्य और पयररधथथधर्क अनुकूलर्य कय संविान करेगी ।
(6) आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षते्रों के प्रबंिन, जल-संभरों के प्रबंिन, भू-जल के प्रबंिन, मृिय और नमी संरक्षण, थथयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधथथधर्क और पर्यावरण से संबंधिर् ससे अन्र् पहलूओं, धजन पर ध्र्यन िनेय आवश्र्क ह,ै के धलए उपबंि होंगे ।
(7) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय थ थलों, ग्रयमों और नगरीर् बंिोबथर्ों, वनों के प्रकयर और दकथ मों, कृधि क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षेत्र जैसे उद्ययन और उसी प्रकयर के थ थयन, उद्ययन कृधि क्षेत्र, आर्का डों, झीलों और अन्र् जल धनकयर्ों कय अभ्र्कंन करेगी ।
(8) आंचधलक महयर्ोजनय पयररधथ थधर्क संवेिी जोन में धवकयस को पयररधथ थधर्क अनुकूल धवकयस और थ थयनीर् समुियर्ों की जीवकोपयजान को सुधनधश् चर् करर्े हुए धवधनर्धमर् होगी ।
(9) आंचधलक महयर्ोजनय इस अधिसूचनय में दिए गए उपबंिों के अनुसयर में अपने कृत्र्ों कय पयलन करने के धलए धनगरयनी सधमधर् के धलए एक संिभा िथर्यवेज र्ैर्यर करेगी ।
3. रयज्र् सरकयर द्वयरय दकए जयन ेवयल ेउपयर्-- रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करने के धलए धनम्नधलधखर् उपयर् करेगी, अथयार््:--
(1) भ-ूउपर्ोग –(क) पयररधथथधर्क संवेिी जोन में आमोि-प्रमोि के धलए वनों, उद्ययन कृधि क्षेत्रों, कृधि क्षेत्रों, पयकों और मनोरंजनयत्मक प्रर्ोजनों के धलए अधभधनधिर् खुले थथयनों को मुख्र् वयधणधज्र्क र्य मुख्र् आवयसीर् पररसर र्य औद्योधगक गधर्धवधिर्ों के धलए उपर्ोग नहीं दकर्य जयएगय र्य उनके धनए क्षेत्रों में संपररवर्र्ार् नहीं दकर्य जयएगय:
परंर्ु पयररधथथधर्क संवेिी जोन के कृधि और अन्र् भूधम संपररवर्ान आवयसीर् आवश्र्कर्य धनगरयनी सधमधर् थथयनीर् धनवयधसर्ों की आवश्र्कर्यओं के पूवा अनुमोिन से दकर्य जयर्ेगय और ससे दक्रर्यकलयपों के धलए होंगे जैसे:-
(i) धवद्यमयन सड़कों को चौड़य करनय और उन्हें सुिढृ करनय र्थय नई सड़कों कय संधनमयाण;
(ii) बुधनर्यिी ढयंचों और नयगररक सुधवियओं कय संधनमयाण और नवीकरण;
(iii) प्रििूण उत्पन्न न करने वयले लघु उद्योग;
(iv) कुिीर उद्योगों धजनके अंर्गार् ग्रयमीण कयरीगर भी हैं; सुधवियजनक भण्डयर और थथयनीर् सुधवियओं सहयर्क पयररधथथधर्क पर्ािन में सधम्मधलर् गृह वयस; और
(v) संवर्िार् दक्रर्यकलयप और पैरय 4 के अिीन दिर्य गर्य है:
परंर्ु र्ह और भी दक सुसंगर् रयज्र् धवधिर्ों और रयज्र् सरकयर अन्र् धनर्मों और धवधनर्मों के अंर्गार् रयज्र् सरकयर के पूवा अनुमोिन र्थय संधवियन के अनुच्छेि 244 और र्त्समर् प्रवृत्त धवधि के उपबंिों के अनुपयलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै वयधणधज्र्क र्य उद्योग धवकयस दक्रर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय:
परंर्ु र्ह और भी दक पयररधथ थधर्क संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई त्रुरि, धनगरयनी सधमधर् के धवचयर अधभप्रयप्त करने के पियर् ्रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमले में एक बयर संिोधिर् होगी और उि त्रुरि के संिोिन की सूचनय कें र्द्ीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को िनेी होगी :
परंर्ु र्ह और भी दक उपर्ुाि त्रुरि के संिोिन में इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी ििय में भू-उपर्ोग कय पररवर्ान सधम्मधलर् नहीं होगय । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) परंर्ु र्ह और भी दक वन जैसे हररर् क्षते्र में पयररणयधमक कभी नहीं होगी
(2) प्रयकृधर्क जल स्रोर् -- आचंधलक महयर्ोजनय में सभी प्रयकृधर्क जल स्रोर्ों की पहचयन की जयएगी और उनके संरक्षण और पुनरुद्भूर्करण के धलए र्ोजनय सधम् मधलर् होगी रयज्र् सरकयर द्वयरय इन क्षेत्रों में र्य उनके धनकि धवकयस दक्रर्यकलयपों जो औसे क्षेत्रों के धलए हयधनकयरक ह,ै को प्रधर्धिद्ध करने के धलए ससी रीधर् से मयगाधनिदेशि र्ैर्यर करेगय।
(3) पर्ािन– (क) पयररधथथधर्क संवेिी जोन के भीर्र सभी नए पयररधथथधर्क पर्ािन दक्रर्यकलयप र्य धवद्यमयन पर्ािन दक्रर्यकलयपों कय धवथर्यर पर्ािन महयर्ोजनय के अनुसयर आंचधलक महयर्ोजनय के धलए होगय । (ख) पर्ािन महयर्ोजनय पर्ािन धवभयग, द्वयरय रयज्र् पर्यावरण और वन धवभयग के परयमिा से र्ैर्यर होगी । (ग) पर्ािन महयर्ोजनय आंचधलक महयर्ोजनय के एक घिक के रूप में होगी । (घ) पयररधथथधर्क पर्ािन संबंिी दक्रर्यकलयप धनम्नयनुसयर धवधनर्धमर् होंगे, अथयार्् :-
(i) वन्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीिर के भीर्र र्य पयररधथथधर्क संवेिी जोन के धवथर्यर र्क, इनमें जो भी धनकि ह,ै नर्े वयधणधज्र्क होिल और ररसोिा अनुज्ञयर् नहीं होंगे :
परंर्ु वन्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीिर की िरूी से परे पयररधथथधर्क संवेिी जोन के धवथर्यर र्क होिलों और सैरगयहों कय थथयपन केवल पूवा पररधनधिर् क्षेत्रों में पर्ािन महयर्ोजनय के अनुसयर पयररधथथधर्क पर्ािन सुधवियओं के धलए ही अनुज्ञयर् होगय;
(ii) पयररधथथधर्क संवेिी जोन के भीर्र नए पर्ािन दक्रर्यकलयपों र्य धवद्यमयन पर्ािन दक्रर्यकलयपों कय धवथर्यर कें र्द्ीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् के मयगाििाक धसद्धयंर्ों के द्वयरय र्थय रयष् ट्रीर् ा र्यघ्र स संरक्षण प्रयधिकरण, द्वयरय जयरी पयररधथथधर्क पर्ािन (समर्-समर् पर र्थय-संिोधिर्) मयगाििाक धसद्धयंर्ों के अनुसयर, पयररधथथधर्क पर्ािन, पर बल के अध्र्र्न पर आियररर् होगय;
(iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयन ेर्क, पर्ािन के धलए धवकयस और धवद्यमयन पर्ािन दक्रर्यकलयपों के धवथर्यर को वयथर्धवक थथल धवधनर्िाष्ट संवीक्षय र्थय धनगरयनी सधमधर् की धसफयररि पर आियररर् संबंधिर् धवधनर्यमक प्रयधिकरणों द्वयरय अनुज्ञयर् दकर्य होगय ।
(4) नसैर्गाक धवरयसर् -- पयररधथथधर्क संवेिी जोन में महत्वपूणा नैसर्गाक धवरयसर् के सभी थथलों जैसे सभी जीन कोि आरधक्षर् क्षेत्र, िैल धवरचनयएं, जल प्रपयर्ों, झरनों, घयिी मयगों, उपवनों, गुफयएं, थथलों, भ्रमण, अश्वरोहण, प्रपयर्ो आदि की पहचयन की जयएगी और उन्हें संरधक्षर् दकर्य जयएगय र्थय उनकी सुरक्षय और संरक्षय के धलए इस अधिसूचनय के प्रकयिन की र्यरीख स ेछह मयस के भीर्र, उपर्ुि र्ोजनय बनयएगी और ससी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगय ।
(5) मयनव धनर्मार् धवरयसर् थ थल - पयररधथ थधर्क संवेिी जोन में भवनों, संरचनयओं, धिल्प-र्थ्र्, सधर्हयधसक, कलयत्मक और सयंथकृधर्क महत्व के क्षेत्रों की पहचयन करनी होगी और इस अधिसूचनय के प्रकयिन की र्यरीख स ेछह मयह के भीर्र उनके संरक्षण की र्ोजनयएं र्ैर्यर करेगी र्थय आंचधलक महयर्ोजनय कय भयग होगय ।
(6) ध् वधन प्रििूण -- पर्यावरण (संरक्षण) अधिधनर्म 1986 के अिीन ध्वधन प्रििूण (धवधनर्म और धनर्ंत्रण) धनर्म, 2000 उपबंिों के अनुसयर कयर्याधन्वर् करेगय ।
(7) वयर् ु प्रििूण -- पयररधथथधर्क संवेिी जोन में, वयर्ु प्रििूण के धनवयरण और धनर्ंत्रण कय वयर्ु (प्रििूण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर अनुपयलन दकर्य जयएगय ।
(8) बधहस्रयव कय धनथसयरण -- पयररधथथधर्क संवेिी जोन में उपचयररर् बधहस्रयव (प्रििूण र्थय धनर्त्रण)अधिधनर्म, 1974 के उपयबंिों के अनुसयर होगय पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय) और इसके अिीन दकए गए उपयबंिों द्वयरय ियधसर् दकर्य जयएगय और सयरणी में धवधनर्िाष्ट रीधर् में धवधनर्धमर् दकर्य जयएगय अथयर्ा -:
(9) ठोस अपधिष्ट -- ठोस अपधिष्टों कय धनपियन और प्रबंिन धनम्नधलधखर् रूप में होगय-- II (ii) 5
(i) पयररधथथधर्क संवेिी जोन में ठोस अपधिष्ट धनपियन र्थय प्रबंिन ठोस अपधिष् ि प्रबंिन धनर्म, 2016, जो भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय.आ. 1357(अ) र्यरीख 8 अप्रैल, 2016 द्वयरय प्रकयधिर् दकए गए थे, के उपबंिों के अनुसयर दकर्य जयएगय ;
(ii) अकयबाधनक सयमग्री कय धनपियन पयररधथथधर्क संवेिी जोन के बयहर पहचयन दकए गए थ थल पर दकसी पर्यावरणीर् थवीकृर् रीधर् में होगय;
(iii) पयररधथथधर्क संवेिी जोन में ठोस अपधिष् िों को जलयनय र्य भथमीकरण और भूधम भरयव के थथयपनों को अनुज्ञयर् नहीं दकर्य जयएगय ।
(10) जैव धचदकत् सीर् अपधिष् ि.- जैव धचदकत् सीर् अपधिष् ि प्रबंिन धनम्नधलधखर् रूप में होगय—
(i) पयररधथथधर्क संवेिी जोन में जैव धचदकत्सीर् अपधिष्टों कय धनपियन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 343 (अ) र्यरीख 28 मयचा 2016 द्वयरय प्रकयधिर् जैव धचदकत्सीर् अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ।
(ii) पयररधथथधर्क संवेिी जोन में कोई सयियरण उपचयर सुधविय र्य जलयर्य जयनय अनुज्ञयर् नहीं दकर्य जयएगय ।
(11) र्यनीर् पररवहन.- पररवहन की र्यनीर् गधर्धवधिर्यं आवयस के अनुकूल रीधर् में धवधनर्धमर् होंगी और इस संबंि में आंचधलक महयर्ोजनय में धवधनर्िाष्ट उपबंि समयधवष्ट दकए जयएंगे और ससे समर् र्क जब र्क आंचधलक महयर्ोजनय के र्ैर्यर होर्ी ह ैऔर रयज्र् सरकयर के सक्षम प्रयधिकयरी द्वयरय अनुमोदिर् होने र्क, धनगरयनी सधमधर् सुसंगर् अधिधनर्मों र्थय उनके अिीन बनयए गए धनर्मों और धवधनर्मों के अनुसयर र्यनीर् गधर्धवधिर्ों के अनुपयलन को मयनीिर करेगी ।
(12) र्यनीर् प्रििूण:- लयग ू धवधिर्ों के अनुसयर वयहन प्रििूण की धनवयरण और धनर्ंत्रण कय अनुपयलन दकर्य जयएगय। थवच्छक ईंिन उियहरण के धलए सीएनजी, एलपीजी, आदि के उपर्ोग के धलए प्रर्यस दकए जयएंगे ।
(13) प्लयधथिक अपधिष्ट प्रबिंन: - पयररधथथधर्क संवेिी जोन में प्लयधथिक अपधिष्ट प्रबंि कय धनपियन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंिोधिर् अधिसूचनय सय.कय.धन 340(अ), र्यरीख 18 मयचा, 2016 द्वयरय प्रकयधिर् प्लयधथिक अपधिष्ट प्रबंि धनर्म 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(14) सधंनमयाण और धवध्वसं अपधिष्ट प्रबिंन: - पयररधथथधर्क संवेिी जोन में संधनमयाण और धवध्वंस अपधिष्ट प्रबंि भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंिोधिर् अधिसूचनय सय.कय.धन 317(अ), र्यरीख 29 मयचा, 2016 द्वयरय प्रकयधिर् संधनमयाण और धवध्वंस प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ।
(15) ई–अपधिष्ट:- पयररधथथधर्क संवेिी जोन में ई–अपधिष्ट प्रबंि कय धनपियन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् द्वयरय समर्-समर् पर र्थयसंिोधिर् ई–अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(16) औद्योधगक ईकयइर्य:ं - (i) पयररधथथधर्क संवेिी जोन के भीर्र दकन्ही नए प्रििूणकयरी उद्योगों की थथयपनय की अनुज्ञय नहीं िी जयएगी।
(ii) पयररधथथधर्क संवेिी जोन में कें र्द्ीर् प्रििूण धनर्ंत्रण बोडा द्वयरय फरवरी, 2016 में जयरी दिियधनिदेशिों में केवल गैर- केवल अप्रििूणकयरी उद्योगों वगीकरण के अनुसयर अनुज्ञय िी जयएगी, जब र्क दक इस अधिसूचनय में इस प्रकयर धवधनर्िाष्ट न हो।
(17) पहयड़ी ढलयनों को संरक्षण: - पहयड़ी ढलयनों कय संरक्षण धनम्नयनुसयर होगय:
(क) आंचधलक महयर्ोजनय में पहयड़ी ढलयनों पर क्षेत्रों को उपिर्िार् दकर्य जयएगय जहयं दकसी भी संधनमयाण की अनुज्ञय नहीं िी जयएगी । (ख) कियव के एक उच्च धडग्री के सयथ धवद्यमयन खड़ी पहयड़ी ढलयनों र्य ढलयनों पर दकसी भी संधनमयाण की अनुज्ञय नहीं िी जयएगी ।

4. पयररधथथधर्क सवंेिी जोन में प्रधर्धिद्ध और धवधनर्धमर् दक्रर्यकलयपों की सूची - पयररधथथधर्क संवेिी जोन में सभी दक्रर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) के उपबंिों द्वयरय ियधसर् होंगे और नीचे िी गई सयरणी में धवधनर्िाष्ट रीधर् में धवधनर्धमर् होंगे, अथयार् ्:-- सयरणी क्रम स.ं दक्रर्यकलयप वणान 1 2 3 क. प्रधर्धिद्ध दक्रर्यकलयप
1. वयधणधज्र्क खनन, पत्थर की खियन, उनको र्ोड़ने की इकयइर्यं । (क) सभी प्रकयर के खनन (लघु और वृहर् खधनज), पत्थर की खयनें और उनको र्ोड़ने की इकयइर्यं वयथर्धवक थथयनीर् धनवयधसर्ों की घरेलू आवश्र्कर्यओं के धसवयर् नहीं होंगी धजसमें धनजी उपर्ोग के धलए मकयनों के संधन्नमयाण र्य मरम्मर् के धलए भूधम को खोिनय और मकयन बनयने के धलए ििेी ियइलों कय धनमयाण भी सधम्मधलर् है;
(ख) मयननीर् उच्चर्म न्र्यर्यलर् की ररि र्यधचकय (धसधवल) सं. 1995 कय 202 िी.एन. गोसवंिरयमन धथरुमलूपयि बनयम भयरर् सरकयर के मयमले में आििे र्यरीख 4 अगथर्, 2006 और ररि र्यधचकय (सी) सं. 2012 कय 435 गोवय फयउंडेिन बनयम भयरर् सरकयर के मयमले में र्यरीख 21 अप्रैल, 2014 के आििे के अनुसरण कय प्रचयलन होगय ।
2. प्रििूण (जल र्य वयर्ु र्य मृिय र्य ध् वधन) कयररर् करने वयले उद्योगों की थ थयपनय । (क) कोई नर्य उद्योग र्य पयररधथथधर्क संवेिी जोन में प्रििूण फैलयने वयले उद्योगों के धवथर्यर की अनुज्ञय नहीं िी जयएगी। (ख) पयररधथथधर्क संवेिी जोन के भीर्र कें र्द्ीर् प्रििूण धनर्ंत्रण बोडा द्वयरय फरवरी, 2016 में जयरी दिियधनिदेशिों में केवल गैर- प्रिधूिर् उद्योगों को थथयपनय के अनुसयर अनुज्ञयर् दकर्य जयएगय, जब र्क दक इस अधिसूचनय में इस प्रकयर धवधनर्िाष्ट न हो।
3. बृहर् जल धवद्युर् पररर्ोजनय पररर्ोजनय की थथयपनय । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
4. दकसी पररसंकिमर् पियथों कय उपर्ोग र्य उत्पयिन र्य प्रसंथकरण। लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
5. प्रयकृधर्क जल धनकयर्ों र्य क्षेत्र सर्ही में अनुपचयररर् बधहस्रयाव कय धनथसयरण । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
6. ठोस अपधिष्ट धनपियन थथल की थथयपनय और ठोस और जैव धचदकत्सय अपधिष्ट के धलए सयमयन्र् जलयए जयने की सुधविय । पयररधथथधर्क संवेिी जोन में ठोस अपधिष्ट धनपियन की कोई नई ठोस अपधिष्ट धनपियन थथल और अपधिष्ट उपचयररर्/प्रसंथकरण सुधविय की अनुमधर् नहीं ह ै । औद्योधगक प्रदक्रर्य और थवयथथ्र् थथयपनों/अथपर्यलों आदि से उत्पन्न दकसी भी प्रकयर के ठोस अपधिष्ट के उपचयर के धलए सयमयन्र् र्य व्यधिगर् भथमीकरण की सुधविय कय अधर्ररि संथथयपन प्रधर्धिद्ध ह ै।
7. फमों, कॉपोरेि, कंपधनर्ों द्वयरय बडे़ पैमयने पर वयधणधज्र्क पिुिन संपिय और कुक्कुि फयमों की थथयपनय । थथयनीर् जरूरर्ों को पूरय करने के धलए लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे।
8. नई आरय धमलों की थथयपनय। पयररधथथधर्क संवेिी जोन के भीर्र नई और धवद्यमयन आरय धमलों कय धवथ र्यर अनुज्ञयर् नहीं होगय ।
9. ईंि भट्टों की थथयपनय करनय। लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
10. पर्ािन से संबंधिर् दक्रर्यकलयप करनय जैसे गमा वयर्ु गुब्बयरें, हेलीकयप्िर, ड्रोन, मयइक्रोलयइिस आदि द्वयरय पयररधथथधर्क संवेिी जोन क्षेत्र के ऊपर से उड़नय। लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे । II (ii) 7 ख. धवधनर्धमर् दक्रर्यकलयप
11. होिलों और ररसोिों कय वयधणधज्र्क थथयपन । पयररधथथधर्क अनुकूल पर्ािन दक्रर्यकलयपों के धलए लघु अथथयर्ी संरचनयओं के धलए संरधक्षर् क्षेत्र सीमय के एक दकलोमीिर के भीर्र र्य पयररधथथधर्क संवेिी जोन के धवथर्यर र्क ही जो भी धनकि हो कोई नर्य वयधणधज्र्क होिल और ररसोिा अनुज्ञयर् होंगे अन्र्थय नहीं :
परन्र्ु संरधक्षर् क्षेत्र की सीमय से एक दकलोमीिर परे र्य पयररधथथधर्क संवेिी जोन के धवथर्यर र्क, जो भी धनकि हो सभी नए पर्ािन दक्रर्यकलयपों र्य धवद्यमयन दक्रर्यकलयपों कय धवथर्यर र्थयलयगू पर्ािन महयर्ोजनय के अनुरुप होगय ।
12. संधनमयाण दक्रर्यकलयप । (क) संरधक्षर् क्षेत्र की सीमय से एक दकलोमीिर के भीर्र र्य पयररधथथधर्क संवेिी जोन के धवथर्यर र्क जो भी धनकि हो, दकसी भी प्रकयर कय वयधणधज्र्क संधनमयाण अनुज्ञयर् नहीं दकर्य जयएगय:
(ख) परंर्ु थ थयनीर् लोगों को पैरय 3 के उप पैरय (1) में सूचीबद्ध दक्रर्यकलयपों सधहर् उनके उपर्ोग के धलए उनकी भूधम में थथयनीर् धनवयथर्ों की आवयसीर् आवश्र्कर्यओं को पूरय करने धलए संधनमयाण करने की अनुमधर् भवन उपधवधिर्ों के अनुसयर िी जयएगी । (ग) और दक ससे लघु उद्योगों जो प्रििूण उत् पन् न नहीं करर्े हैं, से संबंधिर् संधनमयाण दक्रर्यकलयप धवधनर्धमर् दकए जयएंगे और लयगू धनर्मों और धवधनर्मों, र्दि कोई हों, के अनुसयर सक्षम प्रयधिकयरी की पूवा अनुज्ञय से ही न् र्ूनर्म पर रखे जयएंगे । (घ) एक दकलोमीिर से आगे आंचधलक महयर्ोजनय की अनुसयर धवधनर्धमर् होंगे ।
13. प्रििूण उत्पन्न न करने वयले लघु उद्योग । फरवरी 2016 में, केन्र्द्ीर् प्रििूण धनर्ंत्रण बोडा द्वयरय जयरी उद्योगों के वगीकरण के अनुसयर श्वेर् प्रवगा के रुप में मयने गए गैर प्रििूणकयरी उद्योग और अपररसंकि में, लघु और सेवय उद्योग, कृधि उद्ययन, कृधि र्य कृधि आियररर् उद्योग जो पयररधथथधर्क संवेिी जोन से ििेी सयमग्री कय उत्पयिन करर्य ह ैसक्षम प्रयधिकयरी द्वयरय अनुज्ञयर् होंगे ।
14. वृक्षों की कियई । (क) रयज्र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनजु्ञय के धबनय वन, सरकयरी र्य रयजथव र्य धनजी भूधम पर र्य वनों में ककंही वृक्षों की कियई नहीं होगी । (ख) वृक्षों की कियई संबंधिर् कें र्द्ीर् र्य रयज्र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर धवधनर्धमर् होगी ।
15. वन उत्पयिों और गैर कयष् ठ वन उत्पयिों कय संग्रहण (एनिीएफपी) । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
16. धवद्युर् और िरूसंचयर ियवरों कय पररधनमयाण और केबल धबछयनय और अन्र् बुधनर्यिी ढयंचे । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । भूधमगर् केबल धबछयए जयने को बढ़यवय दिर्य जयएगय।
17. नयगररक सुख सुधवियओं सधहर् बुधनर्यिी ढयंचे। लयग ू धवधिर्ों के अनुसयर न्र्ूनीकरण उपयर्ों धनर्म और धवधनर्मन और उपलब्ि दिियधनिदेशिों के सयथ दकए जयएंगे।
18. धवद्यमयन सड़कों को चौड़य करनय और उन्हें सुिढृ करनय र्थय नई सड़कों कय संधनमयाण। उधचर् पर्यावरण समयघयर् धनियारण और न् र्ूनीकरण उपयर् र्थय लयगू अनुसयर होंगे ।
19. पहयड़ी ढयलों और निी र्िों कय संरक्षण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
20. रयधत्र में र्यधनक र्यर्यर्यर् कय संचलन । लयगू धवधिर्ों के अिीन वयधणधज्र्क प्रर्ोजन के धलए धवधनर्धमर् होंगे ।
21. थथयनीर् समुियर्ों द्वयरय चल रही कृधि और बयगवयनी पद्धधर् के सयथ पिुपयलन, पिुपयलन कृधि, जल कृधि और मछली पयलन। थथयनीर् लोगों के उपर्ोग के धलए लयगू धवधिर्ों के अिीन अनुज्ञयर् होंगे । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
22. प्रयकृधर्क जल धनकयर्ों सर्ही क्षेत्र में उपचयररर् बधहस्रयाव कय धनथसयरण । उपचयररर्/ बधहस्रयाव के पुनचाक्रण को प्रोत्सयधहर् करने और अवमल र्य ठोस अपधिष्टों के धनपियन के धलए धवद्यमयन धवधनर्मों कय अनुपयलन दकर्य जयएगय । अन्र्थय लयगू धवधिर्ों के अिीन उपचयररर् बधहस्रयाव के पुनचाक्रण/प्रवयह के धनवाहन को धवधनर्धमर् दकर्य जयएगय।
23. सर्ह और भूजल कय वयधणधज्र्क धनष्किाण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
24. खुले कुआ, बोर कुआ, आदि के धलए कृधि और अन्र् उपर्ोग । धवधनर्धमर् और समुधचर् प्रयधिकयरी द्वयरय दक्रर्यकलयपों की सख्र्ी से धनगरयनी की जयएगी।
25. ठोस अपधिष् ि प्रबंिन। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
26. धवििेी प्रजयधर्र्ों को लयनय । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
27. पयररधथथधर्क-पर्ािन। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
28. पॉधलथीन बैग कय उपर्ोग । पयररधथथधर्क संवेिी जोन के भीर्र पॉधलथीन बैग के उपर्ोग की अनुज्ञय ह।ै र्थयधप, धवधिष्ट अपेक्षय के आियर पर, इसे लयग ू धवधिर्ों के अिीन धवधनर्धमर् दकर्य जयएगय।
29. वयधणधज् र्क सयइनबोडा और होर्डबंधग । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । ग. सवंर्िार् दक्रर्यकलयप
30. विया जल संचर्न । सदक्र र् रूप से बढ़यवय दिर्य जयएगय ।
31. जैधवक खेर्ी । सदक्र र् रूप से बढ़यवय दिर्य जयएगय ।
32. सभी गधर्धवधिर्ों के धलए हररर् प्रौद्योधगकी को अंगीकृर् करनय । सदक्र र् रूप से बढ़यवय दिर्य जयएगय ।
33. कुिीर उद्योगों धजसके अंर्गार् ग्रयमीण कयरीगर आदि भी हैं। सदक्र र् रूप से बढ़यवय दिर्य जयएगय ।
34. नवीकरणीर् ऊजया और ईंिन स्रोर् कय उपर्ोग । बयर्ोगैस, सौर रोिनी आदि को बढ़यवय दिर्य जयए।
35. बयर्ोगैस, सौर प्रकयि आदि। सदक्र र् रूप से बढ़यवय दिर्य जयएगय ।
36. कृधि वयधनकी ।
37. पयररधथथधर्क अनुकूल पररवहन कय उपर्ोग । सदक्र र् रूप से बढ़यवय दिर्य जयएगय ।
38. कौिल धवकयस । सदक्र र् रूप से बढ़यवय दिर्य जयएगय ।

5. धनगरयनी सधमधर् - कें र्द्ीर् सरकयर, पयररधथथधर्क संवेिी जोन प्रभयव धनगरयनी के धलए गठन दकर्य ह,ै धनम्नधलधखर् से धमलकर बनेगी, अथयार्:्--
(1) कलक्िर, धजलय िेवभूधम द्वयरकय – अध्र्क्ष ;
(2) गुजरयर् सरकयर के पर्यावरण और वन धवभयग कय प्रधर्धनधि – सिथर् ;
(3) क्षेत्रीर् अधिकयरी, रयज्र् प्रििूण धनर्ंत्रण बोडा - सिथर् ;
(4) गैर सरकयरी संगठन कय एक प्रधर्धनधि जो प्रयकृधर्क संरक्षण के क्षेत्र में कयर्ा कर रहय ह ैउसे गुजरयर् सरकयर द्वयरय (प्रत्र्ेक मयमले में एक विा की अवधि के धलए) नयमधनर्िाष्ट दकर्य जयएगय - सिथर् ;
(5) गुजरयर् रयज्र् के प्रधर्धिर् संथथयन र्य धवश्वधवद्ययलर् से पयररधथथधर्क/ वन्र्जीव/पक्षी के क्षेत्र में प्रत्र्ेक मयमले में एक विा की अवधि के धलए एक धविेिज्ञ – सिथर्;
(6) क्षेत्र कय वररि नगर र्ोजनयकयर – सिथर्;
(7) रयज्र् जैव -धवधविर्य बोडा कय सिथर् – सिथर्;
(8) उप वन संरक्षक, जयमनगर/िवेभूधम द्वयरकय – सिथर्-सधचव । II (ii) 9
6.धनिदेशि धनबिंन:-
(1) धनगरयनी सधमधर् इस अधिसूचनय के उपबंिों के अनुपयलन को मयनीिर करेगी ।
(2) धनगरयनी सधमधर् कय कयर्ाकयल र्ीन विा कय होगय ।
(3) पयररधथथधर्क संवेिी जोन में भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अनुसूची में सधम्मधलर् दक्रर्यकलयपों और इस अधिसूचनय के पैरय 7 सयरणी में धवधनर्िाष्ट प्रधर्धिद्ध गधर्धवधिर्ों के धसवयर् आन ेवयले ससे दक्रर्यकलयपों की ििय में वयथर्धवक धवधनर्िाष्ट थथलीर् िियओं पर आियररर् धनगरयनी सधमधर् द्वयरय संवीक्षय की जयएगी और उि अधिसूचनय के उपबंिों के अिीन पूवा पर्यावरण धनकयसी के धलए केन्र्द्ीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को धनर्िाष्ट की जयएगी।
(4) इस अधिसूचनय के पैरय 7 के अिीन सयरणी में र्थय धवधनर्िाष्ट प्रधर्धिद्ध दक्रर्यकलयपों के धसवयर्, भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय संख्र्यंक कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अधिसूचनय के अनुसूची के अिीन ससे दक्रर्यकलयपों, धजन्हें सधम्मधलर् नहीं दकर्य गर्य है, परंर्ु पयररधथथधर्क संवेिी जोन में आर् ेहैं, ससे दक्रर्यकलयपों की वयथर्धवक धवधनर्िाष्ट थथलीर् िियओं पर आियररर् धनगरयनी सधमधर् द्वयरय संवीक्षय की जयएगी और उसे संबद्ध धवधनर्यमक प्रयधिकरणों को धनर्िाष्ट दकर्य जयएगय ।
(5) धनगरयनी सधमधर् कय सिथर्-सधचव र्य संबंधिर् कोई व्यधि जो इस अधिसूचनय के दकसी उपबंि कय उल्लंघन करर्य है, उसके धवरुद्ध पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 19 के अिीन पररवयि फयइल करने के धलए सक्षम होगय ।
(6) धनगरयनी सधमधर् मुद्दों के आियर पर अपेक्षयओं पर धनभार रहर्े हुए संबद्ध धवभयगों के प्रधर्धनधिर्ों र्य धविेिज्ञों, औद्योधगक संगमों र्य संबद्ध पणियररर्ों के प्रधर्धनधि प्रधर् मुद्दे की अपेक्षयओं के अनुसयर धवचयर-धवमिा में सहयर्र्य के धलए आमंधत्रर् कर सकेगी ।
(7) धनगरयनी सधमधर् प्रत्र्ेक विा की 31 मयचा र्क की अपनी वयर्िाक कयरावयई ररपोिा रयज्र् के मुख्र् वन्र् जीव वयडान को उपयबंि IV पर उपयबद्ध प्रयरूप में 30 जून र्क प्रथर्ुर् करेगी ।

8. कोई अन् र् महत् वपूणा धविर् । MINISTRY OF ENVIRONMENT, FORESTS AND CLIMATE CHANGE NOTIFICATION New Delhi, the 7th June, 2017 S.O. 1865(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, Past II, Section 3, Sub-Section (ii), dated the 10 th December, 2015, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3338 (E), dated the 7 th December, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the draft notification were made available to the public on the 10 th December, 2015;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification within the specified period of sixty of days;
AND WHEREAS, Gaga Sanctuary, a unique wetland eco-system located in 2232’ N, 70 08’ E, is situated near village Gaga in Kalyanpur taluka of Jamnagar district, of the State of Gujarat and it is 22 kilometers away from the range head quarter Bhatiya and 11 kilometers away from a bifurcation on Jamnagar Dwarika State highway; the said Sanctuary is having an area of 332.87 hector, however, the Sanctuary is located in two parts and in between and by the side vast stretches of waste lands are situated; the area of Gaga part -1 which falls in south east direction of village is flat having gentle slope which support excellent grass land ecosystem; earlier the area was managed as “vidi” but realising the ecological, geo-morphological, floral and faunal importance of the area it was declared as a Sanctuary, wide Government notification number GVN/57/88/WLP-1087/G-49/V-2 dated the 24 th November, 488 and area 332.87 hector;
AND WHEREAS, the afore said Sanctuary is spread over an area of 3.33.square kilometres and situated at Gaga located in Kalyanpur Talukal of Devbhumi DwarkaDistrict) in the State of Gujarat;
14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, the area is situated within the “Okhari desert area” and on the western side lies the Tata salt works and Gulf of Kutch which attracts many birds species, in fact the water in the river and lakes turns salty during later parts of winter and thus many aquatic and marine birds and waders are attracted in this area; The migratory crane both demoiselle and common cranes passes their winter here and open ground and salt pans are good roosting ground for them; the said sanctuary area has high significances indicated below:- o it is very rich in bio-diversity with more than 300 spp. Including some endangered specied;
o it inhabits endangered spp. like, Houbara bustard and wolf;
o a variety of birds, reptiles and mammals are found in this area;
o ideal site for plants and grassland where some other spp. can be re-located;
o it provides ideal opportunity for ecological and other research;
AND WHEREAS, species like Prosopis juliflora, Cyperus and Scirpus species, Typha elephantia, Spinifex stolonifera Salvadora, Calotropis, etc. are found in the said Sanctuary area.
AND WHEREAS, Varity of birds like Cranes, Egrets, Pelican, Avocet, Heron, Harrier, etc. are found in this area; variety of reptiles like Monitor lizard, Rat Snake, Russell wiper, Skink, etc are found here; variety of mammals like Hyaena, Wolf, Bluebull, Jackal, Porcupine, and Common mongoose are also found here:
NOW, THEREFORE, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of 1.0 kilometer around the boundary of Gaga Sanctuary in the State of Gujarat as the Gaga Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone shall be with a peripheral area of 19.43 square kilometers with an extent upto one kilometer around the boundary of the Gaga Sanctuary.
(2) The boundary description of Gaga Sanctuary and its Eco-sensitive Zone is given in Annexure-I,- A and I-B.
(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-II.
(4) The list of five villages falling within the Eco-sensitive Zone is appended as Annexure-III.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;

(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal ;
(x) Panchayati Raj ; and
(xi) Public Works Department.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.-
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities:
Provided that the conversion of agricultural and other lands. within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the to meet the residential needs of the local residents and for activities such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and
(v) promoted activities in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such an forest and agriculture area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Tourism Master Plan shall be prepared by State Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within one kilometer from the boundary of the Gaga Sanctuary or upto the extent of the Eco-Sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometer from the boundary of the said Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts may be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) til the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation within six months from the date of publication of their note speciation in the official Gazette and such place shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared within six months from the date of publication of their note speciation in the official Gazette and such place shall form part the Zonal Master Plan.

(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act,
1986.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the water (prevention and control of pollution) Act, 1974 and the rules made thereunder.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:-
(i) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- Bio medical waste management shall be as under:-
(i) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time;
(ii) no common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the Competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Vehicular pollution-Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example CNG, etc.
(13) Plastic waste management:- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(14) Construction and demolition waste management- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(15) E-waste- The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change as amended from time to time.
(16) Industrial units.- (i) No new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries may be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. Prohibited, regulated and promoted activities:- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under, and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, store quarrying and cashing units
(a) New (minor and major minerals), stone quarrying and crushing units prohibited except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for personal construction.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs.
UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
(a). No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
(b). Only non-polluting industries may be permitted within Eco-Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste shall permitted within Eco Sensitive Zone and installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment, hospitals, etc. shall be prohibited.
7. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
10. Under taking other activities related to tourism like over flying the Eco-Sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.
Prohibited (except as otherwise provided) as per applicable laws.
II (ii) 19 B. Regulated Activities
11. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Ecosensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
12. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
(b) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents:
(c) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(c) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
13. Small scale non-polluting industries.
Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority.
14. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.
15. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
16. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law and underground cabling may be promoted.
17. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18. Widening and strengthening of existing roads and construction of new roads.

21. Ongoing agriculture and horticul-ture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
22. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies and efforts shall to be made for recycle and reuse of treated waste water, and the discharge of treated waste water/effluent shall be regulated as per applicable laws.
23. Commercial extraction of surface and ground water.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-Sensitive Zone, comprising of the following, namely:- SI. No. Constituent of Monitoring Committee Designation 1 Collector Devbhuni Dwarka district Chairman;
2 Representative of the Department of Environment and Forests Government of Gujarat Member;
3 Regional officer State Pollution Control Board Member;
4 One representative of Non-Governmental Organisations working in the field of nature conservation to be nominated by the Govt. of Gujarat ( fora term of one year in each case) Member;
5 One expert in Ecology/Wildlife/birds from reputed institution of University of the State of Gujarat to be nominated by the Government of Gujarat ( fora term of one year in each case) Member;
6 Senior Town Planer of area Member;
7 Member of State Bio-Diversity Board Member;
8 Deputy Conservator of Forest Jamagar / Devbhumi Dwarka Member Secretary.
24. Open well, bore well, etc. for agriculture or other usage.
Regulated under applicable laws and the activity shall be monitored by the concerned authority.
25. Solid waste management. Regulated under applicable laws.
26. Introduction of exotic species. Regulated under applicable laws.
27. Eco-tourism. Regulated under applicable laws
28. Use of polythene bags. Use of polythene bags is permitted within the Eco Sensitive Zone, however, based on specific requirement; it shall be regulated under applicable laws.

32. Adoption of green technology for all activities.

6. Terms of reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring Committee shall be for three years.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 7 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 7 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis..
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma given in (Annexure IV).
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
