PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 1728] No. 1728] NEW DELHI, TUESDAY, JUNE 20, 2017/JYAISTHA 30, 1939 पर्यावरण, वन और जलवयर् ुपररवर्ान मतं्रयलर् अधिसचूनय नई दिल्ली, 20 जून, 2017 कय.आ. 1942(अ).—भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. 3495 (अ), र्यरीख 22 दिसम्बर, 2015 द्वयरय भयरर् के रयजपत्र, असयियरण में, उन सभी व्यधिर्ों से, धजनके उससे प्रभयधवर् होने की संभयवनय थी, उस र्यरीख से, धजसको उस रयजपत्र की प्रधर्र्यं, धजसमें र्ह अधिसूचनय अरं्र्वाष्ट ह,ै जनर्य को उपलब्ि करय िी गई थी, सयठ दिन की अवधि के भीर्र आक्षेप और सुझयव आमंधत्रर् करर्े हुए एक प्रयरुप अधिसूचनय प्रकयधिर् की गई थी;
और, उि रयजपत्र, धजसमें उि अधिसूचनय अरं्र्वाष्ट ह,ै की प्रधर्र्यं जनर्य को र्यरीख 22 दिसम्बर, 2015, को उपलब्ि करय िी गई थी;
और, उि प्रयरुप अधिसूचनय के प्रत्र्ुत्तर में व्यधिर्ों और पणियररर्ों से कोई आक्षेप और सुक्षयव प्रयप्त नही हुए ह;ै और, हहगंोलगढ़ अभर्यरण्र् गजुरयर् के रयजकोट धजले में 220 7’ उ. और 220 10’ उ. अक्षयंि र्थय 700 18’ प.ू और 710 21’ प.ू के बीच धथथर् ह ैऔर 6.54 वगा दकलोमीटर के क्षेत्र में फैलय हुआ ह ैऔर अभर्यरण्र् अहमियबयि से अहमियबयि- रयजकोट रयज्र् रयजमयगा (रयज्र् रयजमयगा. 8) से 180 दकलोमीटर की िरूी पर रयजकोट में धथथर् ह;ै धजलय मुख्र्यलर् अभर्यरण्र् से लगभग 77 दकलोमीटर िरू पर ह;ै और, हहगंोलगढ़ वन्र्जीव अभर्यरण्र् को वन्र्जीव संरधक्षर् अधिधनर्म, 1972 की ियरय 18 के र्हर्, धजसमें सरकयरी अधिसूचनय सं. जीकेएच-168/80-डब्ल्र्ूएलपी-1080-91082-पी.2, दिनयंक 29 अगथर्, 1980 को घोधिर् दकर्य गर्य; 1984 में अभर्यरण्र् की घोिणय और धनपटयन के बयि, र्ह गुजरयर् पयररधथथधर्की धिक्षय और अनुसंियन (जीईईआर) फयउंडेिन के प्रबंिन के र्हर् रखय गर्य; जीईईआर एक थवयर्त्त संगठन और सयवाजधनक ट्रथट ह ैइसकय मुख्र्यलर् गयंिीनगर में ह ैऔर गुजरयर् सरकयर न े विा 2020 र्क पटे्ट की अवधि कय नवीकरण कर दिर्य ह;ै प्रयरंधभक विों में, अभर्यरण्र्, मुख्र् संरक्षक वन (वन्र्जीव) द्वयरय अनुमोदिर् वयर्िाक र्ोजनयओं के मयध्र्म से प्रबंधिर् दकर्य गर्य थय और अभर्यरण्र् कय प्रबंिन सरकयर द्वयरय थवीकृर् दिर्यकलयपों के अनुसयर दकर्य गर्य थय; हहगंोलगढ़ वन्र्जीव अभर्यरण्र् की वर्ामयन प्रबंिन र्ोजनय को 2014-24 की अवधि के धलए थवीकृर् दकर्य गर्य थय और इसके अनुसयर कयम और दिर्यकलयपों को पूरय दकर्य जयर्य ह ैऔर मुख्र् संरक्षण उदे्दश्र्ों के अलयवय, र्ह अभर्यरण्र् प्रकृधर्, वन्र्जीव और पर्यावरण धिक्षय और जयगरूकर्य के कें द्र के रूप में उपर्ोगी ह।ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, उि अभर्यरण्र् में 51 प्रजयधर्र्ों के पेड़, 155 प्रजयधर्र्ों की जड़ी बूटी और 38 झयधड़र्ों की और पवार्यरोधहर्ों की 42 प्रजयधर्र्यं, 31 घयस की प्रजयधर्र्यं, 11 थर्नपयर्ी प्रजयधर्र्यं, सरीसृप की 33 प्रजयधर्र्यं, पधक्षर्ों की 232 से अधिक प्रजयधर्र्यं और कुछ िलुाभ सवयनय घयस पैच के सयथ-सयथ अच्छी गुणवत्तय के कयंटेियर वन ह,ै जो इस समृद्ध जैव-धवधविर्य में ियधमल ह ै। और, हहगंोलगढ़ वन्र्जीव अभ्र्यरण्र् में मखु्र् जीव: ब्ल ू बुल (बोसेलफस ट्रयगोकैमेलस), हचंकयरय (गजेलय बेनेटटी), सयमयन्र् नेवलय (हपेथटेस एडवर्ड्सी), रेधगथर्यनी धबल्ली (फेधलस कोन्सटेन्टीनय ओनयाटय), पयंच-ियरीियर पयम धगलहरी (फ़नमबसस पेंनयटी), फ्लयइंग लोमड़ी (पेटोपस धगगयनेटेनस), ग्र े छछूूँिर (सनकस मैररनस), भयरर्ीर् लोमड़ी (वल्पस बेनगयलेंधसस), भयरर्ीर् भेधड़र्य (कैधनस ल्र्ूपस), इंधडर्न गेरधबल्स (र्रे्रय इंधडकय), भयरर्ीर् खरगोि (धलपस धनग्रीकोधलस), भयरर्ीर् सयही (हयइथट्रीक्स इंधडकय), भयरर्ीर् बनैलय सूअर (सस थिोफय), धसर्यर (कैधनस ऑररर्स), जंगली धबल्ली (फेधलस चौस), र्ेंिआु (पेंथेरय पयडास), पैले हजेहोग (पैरयकीनस मयइिोप्रस), भयरर्ीर् गंि धबलयव (वीवर्राकुलय इंधडकय), ियरीियर लकड़बग्घय (हनैय हनैय) ह;ै और, हहगंोलगढ़ वन्र्जीव अभ्र्यरण्र् में मखु्र् वनथपधर् गोरि (अकयदकर्य सेनेगल), छर्रों-बयवल (अकयदकर्य प्लयनफ्रॉन्स), हमोबयवल (अकयदकर्य ल्र्ूकोफ्लोआ), िेिीबयवल (अकयदकर्य धनलोरटकय), ध़िजयडो (प्रोसोधपस धसनेररर्य), गिंो बयवल (प्रोसोधपस जुलीफ्लोरय), सुबयवल (ल्र्ूकेनय ल्र्ूकोसेफलय), बयररि के पडे़ (समयने सयमन), गोरस अमली (धपथेसोलोधबर्म डुलसी), धसरयस (अधल्बधजर्य लीब्बेक), इगोररएओ (बयलनइट्स इधजधप्चआ), अधसर्यरो (बूनीधडर्य ररसेमोसय), अम्ली (र्यमयर इंडस इंधडकय), सैंडसेरो (डेलोधनक्स इलयर्य), गलु महोर (डेलोधनक्स रीजेररर्य), सन महोर (पेलोपिेोरम पटरोकयरपूम), कयधसि (कैधसर्य धसर्यमय), गोमालो (कयधसर्य. दफ़थटुलय), नीम (अजयधडरयचर्य इंधडकय), बकयन धलडोडो (मेधलर्य अजेियर) ह;ै और, हहगंोलगढ़ वन्र्जीव अभर्यरण्र् के चयरों ओर के क्षते्र को, धजसकय धवथर्यर और सीमयएं इस अधिसूचनय के पैरय 1 में धवधनर्िाष्ट हैं, पर्यावरण की िधृष्ट से पयररधथथधर्क संवेिी जोन के रूप में सुरधक्षर् और संरधक्षर् करनय र्थय उि पयररधथथधर्क संवेिी जोन में उद्योगों र्य उद्योगों के वगो के प्रचयलन र्थय प्रसंथकरण करन ेको प्रधर्धिद्ध करनय आवश्र्क ह ै;
अर्ः, अब, केन्द्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के सयथ परठर् पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (1), उपियरय (2) के खंड (v) और खंड (xiv) और उप ियरय (3) द्वयरय प्रित्त िधिर्ों कय प्रर्ोग करर्े हुए, गुजरयर् रयज्र् में हहगंोलगढ़ वन्र्जीव अभर्यरण्र् की सीमय के 1.0 दकलोमीटर से 4.1 दकलोमीटर र्क के धवथ र्यररर् क्षेत्र को हहंगोलगढ़ वन्र्जीव अभर्यरण्र् पयररधथ थधर्क संवेिी जोन (धजसे इसमें इसके पश् चयर्प पयररधथथधर्क संवेिी जोन कहय गर्य ह)ै के रूप में अधिसूधचर् करर्ी ह,ै धजसकय धववरण धनम्नयनुसयर ह,ै अथयार्प :--
1. पयररधथथधर्क सवंिेी जोन कय धवथर्यर और उसकी सीमयए-ं-(1) पयररधथथधर्क संवेिी जोन कय धवथर्यर हहगंोलगढ़ वन्र्जीव अभर्यरण्र् की सीमय के 1.0 दकलोमीटर से 4.1 दकलोमीटर र्क ह ै|
(2) पयररधथथधर्क संवेिी जोन कय धवथर्यर 31.66 वगा दकलोमीटर र्क ह ै|
(3) अक्षयंिों और ििेयन्र्र के सयथ पयररधथथधर्क संवेिी जोन कय मयनधच त्र इसके सीमय धववरण के सयथ उपयबिं I पर उपयबद्ध ह ै।
(4) पयररधथथधर्क संवेिी जोन गुजरयर् रयज्र् में रयजकोट धजल ेके 6 ग्रयमों में फैलय हुआ ह ै| पयररधथथधर्क संवेिी जोन में आने वयले ग्रयमों की सूची उपयबिं II पर उपयबद्ध ह ै|
2. पयररधथथधर्क संविेी जोन के धलए आचंधलक महयर्ोजनय – (1) रयज्र् सरकयर, पयररधथथधर्क संवेिी जोन के प्रर्ोजन के धलए रयजपत्र में अधिसूचनय के प्रकयिन की र्यरीख से िो विा की अवधि के भीर्र, थथयनीर् व्यधिर्ों के परयमिा से और इस अधिसूचनय में संलग् न अनुबंिों के सयमंजथ र् से आंचधलक महयर्ोजनय र्ैर्यर करेगी ।
(2) रयज्र् सरकयर द्वयरय पयररधथ थधर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय इस र्रह, इस अधिसूचनय में धवधनर्िाष् ट रूप र्थय सुसंगर् कें द्रीर् और रयज् र् धवधिर्ों के सयमंजथ र् और कें द्रीर् सरकयर द्वयरय जयरी मयगाधनिेिों, र्दि कोई हों, द्वयरय र्ैर्यर होगी । II (ii) 3
(3) आंचधलक महयर्ोजनय, पर्यावरणीर् और पयररधथथधर्क धवचयरों को समयकधलर् करन ेके धलए रयज् र् सरकयर के सभी संबद्ध धवभयगों के परयमिा से र्ैर्यर होगी, अथयार्प:-- i. पर्यावरण;
ii. वन और वन्र्जीव;
iii. कृधि;
iv. रयजथ व;
v. नगर धवकयस;
vi. पर्ाटन;
vii. ग्रयमीण धवकयस;
viii. हसंचयई और बयढ़ धनर्ंत्रण;
ix. नगरपयधलकय;
x. पंचयर्र्ी रयज;
xi. लोक धन मयाण धव भयग।
(4) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन भू-उपर्ोग, अवसंरचनय और दिर्यकलयपों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय में धवधनर्िाष् ट न हो और आचंधलक महयर्ोजनय सभी अवसंरचनय और दिर्यकलयपों में और अधिक िक्षर्य और पयररधथथधर्क अनुकूलर्य कय संविान करेगी ।
(5) आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबंिन, भूर्ल जल के प्रबंिन, मृिय और नमी संरक्षण, थथयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधथथधर्क और पर्यावरण से संबंधिर् ऐसे अन्र् पहलओूं, धजन पर ध्र्यन िेनय आवश्र्क ह,ै के धलए उपबंि होंगे ।
(6) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय थ थलों, ग्रयमों और िहरी बंिोबथर्ों, वनों के प्रकयर और दकथ मों, कृधि के्षत्रों, ऊपजयऊ भूधम, हररर् क्षते्र जैसे उद्ययन और उसी प्रकयर के थ थयन, उद्ययन कृधि के्षत्र, फलोउद्ययन, झीलों और अन्र् जल धनकयर्ों कय अभ्र्कंन करेगी और इस र्ोजनय के मयनधचत्र द्वयरय धवद्यमयन और प्रथर्यधवर् भूधम के उपर्ोग कय भी धववरण दकर्य जयएगय ।
(7) आंचधलक महयर्ोजनय थ थयनीर् समुियर्ों की जीवकोपयजान को सुधनधश् चर् करने के धलए भी पयररधथथधर्क संवेिी जोन में धवकयस को पयररधथथधर्क अनुकूल धवकयस के धलए सयरणी के सूचीबद्ध दिर्यकलयप धवधनर्धमर् करेगी ।
(8) आंचधलक महयर्ोजनय क्षेत्रीर् धवकयस र्ोजनय के सयथ सह-अंर्क होगी ।
(9) आंचधलक महयर्ोजनय इस अधिसूचनय में दिए गए उपबंिों के अनुसयर में अपने कयर्ों के बयहर ल ेजयन ेके धलए धनगरयनी सधमधर् के धलए एक संिभा िथर्यवेज र्ैर्यर करेगी ।
3. रयज्र् सरकयर द्वयरय दकए जयन े वयल े उपयर्-- रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करने के धलए धनम्नधलधखर् उपयर् करेगी, अथयार्प :-
(1) भ-ूउपर्ोग - (क) पयररधथ थधर्क संवेिी जोन में वनों, उद्ययन-कृधि क्षेत्रों, कृधि क्षेत्रों, आमोि-प्रमोि के प्रर्ोजन के धलए धचधन्हर् दकए गए पयकों और खुल ेथथयनों कय वृहि वयधणधज्र्क र्य वृहि आवयसीर् कयम्पलैक्स औद्योधगक दिर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय:
परंर् ुपयररधथथधर्क संवेिी जोन के भीर्र कृधि भूधम कय संपररवर्ान मयनीटरी सधमधर् की धसफयररि पर और क्षेत्रीर् नगर र्ोजनय अधिधनर्म के अिीन सक्षम प्रयधिकयरी के पूवा अनुमोिन के सयथ और केन्द्रीर्/रयज्र् सरकयर के अन्र् धनर्मों और र्थय लयग ूधवधनर्मों और इस अधिसूचनय के उपबंिों जो थथयनीर् धनवयधसर्ों की आवयसीर् जरूरर्ों को पूरय करन ेके धलए ह,ै को पूरय करने के धलए अनजु्ञयर् होगें जैसे:- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) धवद्यमयन सड़कों को चौड़य करनय और उन्हें सुिढृ करनय र्थय नई सड़कों कय संधनमयाण;
(ii) बुधनर्यिी ढयंचों और नयगररक सुधवियओं कय संधनमयाण और नवीकरण;
(iii) प्रििूण उत्पन्न न करने वयल ेलघ ुउद्योग;
(iv) कुटीर उद्योगों धजसके अंर्गार् ग्रयमीण उद्योग हैं; सुधवियजनक भण्डयर और थथयनीर् सुख-सुधवियओं सहयर्क पयररधथथधर्क पर्ाटन में सधम्मधलर् ग्रह वयस भी ह;ै और
(v) संवर्िार् दिर्यकलयप और अनुच्छेि 4 के अंर्गार् दिर्य गर्य ह:ै परंर् ुर्ह और भी दक क्षेत्रीर् नगर र्ोजनय अधिधनर्म और रयज्र् सरकयर के अन्र् धनर्मों और धवधनर्मों के अिीन सक्षम प्रयधिकयरी के पूवा अनुमोिन र्थय संधवियन के अनचु्छेि 244 और र्त्समर् प्रवृत्त धवधि के उपबंिों के अनुपयलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै वयधणधज्र्क र्य उद्योग धवकयस दिर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय:
परंर् ुर्ह और भी दक पयररधथ थधर्क संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई तु्ररट, मयनीटरी सधमधर् के धवचयर प्रयप्त करने के पश्चयर्प रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमले में एक बयर संिोधिर् होगी और उि तु्ररट के संिोिन की सूचनय कें द्रीर् सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् को िेनी होगी । परंर् ुर्ह और भी दक उपर्ुाि तु्ररट कय संिोिन में इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी ििय में भू-उपर्ोग कय पररवर्ान सधम्मधलर् नहीं होगय । (ख) परंर् ुर्ह और भी दक धजससे हररर् क्षेत्र में जैसे वन क्षेत्र, कृधि क्षेत्र आदि में कोई पयररणयधमक कटौर्ी नहीं होगी और अनप्रर्ुक् र् र्य अनुत् पयिक कृधि क्षेत्रों में पनु: वनीकरण करने के प्रर्यस दकए जयएंग े।
(2) प्रयकृधर्क जल स्रोर् – आचंधलक महयर्ोजनय में सभी प्रयकृधर्क जल स्रोर्ों/ नदिर्ों/ चैनलों की पहचयन की जयएगी और उनके संरक्षण और पुनरुद्भूर्करण के धलए र्ोजनय सधम् मधलर् होगी।
(3) पर्ाटन/पयररधथथधर्क पर्ाटन – (क) पयररधथथधर्क संवेिी जोन के भीर्र नए पर्ाटन संबंिी दिर्यकलयप र्य धवद्यमयन पर्ाटन सम्बंिी दिर्यकलयपों कय धवथर्यर पयररधथथधर्क संवेिी जोन के धलए पर्ाटन महयर्ोजनय के अनुसयर होंग े। (ख) पर्ाटन महयर्ोजनय पर्ाटन धवभयग, द्वयरय रयज्र् पर्यावरण और वन धवभयगों के परयमिा से र्ैर्यर की जयएगे । (ग) पर्ाटन महयर्ोजनय आंचधलक महयर्ोजनय के एक घटक के रूप में जयनय जयर्ेगय । (घ) पर्ाटन संबंिी दिर्यकलयप धनम् नधलधखर् के अिीन धवधनर्धमर् होंग,े अथयार्प :-
(i) वन्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीटर र्क र्य पयररधथथधर्क संवेिी जोन के धवथर्यर र्क इनमें जो भी धनकट ह,ै नर्े वयधणधज्र्क होटल और ररसोटा अनुज्ञयर् नहीं होंगे। र्थयधप, पयररधथथधर्क संवेिी जोन के वन्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीटर की िरूी से आग ेर्क नर्े होटल और ररसोटा कय थथयपन पर्ाटन महयर्ोजनय के अनुसयर पयररधथथधर्क पर्ाटन सुधवियओं के धलए पूवा पररभयधिर् और पियधभधहर् क्षेत्रों के धलए दकर्य जयऐगय ;
(ii) पयररधथथधर्क संवेिी जोन के भीर्र सभी नए पर्ाटन दिर्यकलयपों र्य धवद्यमयन पर्ाटन दिर्यकलयपों कय धवथर्यर कें द्र सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् के मयगाििाक धसद्धयंर्ों के द्वयरय र्थय रयष् ट्रीर् ा र्यघ्र संरक्षण प्रयधिकरण, द्वयरय जयरी पयररधथथधर्क पर्ाटन (समर्-समर् पर र्थय संिोधिर्) मयगाििाक धसद्धयंर्ों के अनुसयर, पयररधथथधर्क पर्ाटन, पर आियररर् होगय;
(iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयने र्क, पर्ाटन के धलए धवकयस और धवद्यमयन पर्ाटन दिर्यकलयपों के धवथर्यर को वयथर्धवक थथल धवधनर्िाष्ट संवीक्षय र्थय मयनीटरी सधमधर् की धसफयररि पर आियररर् संबंधिर् धवधनर्यमक प्रयधिकरणों द्वयरय अनुज्ञयर् दकर्य जयएगय और पयररधथथधर्क संवेिी जोन के भीर्र नर्े होटल/ ररसोटा र्य वयधणधज्र्क थथयपनों कय धवधनमयाण अनुज्ञयर् नहीं दकर्य जयएगय ।
(4) नसैर्गाक धवरयसर् -- पयररधथथधर्क संवेिी जोन में महत्वपूणा नैसर्गाक धवरयसर् के सभी थथलों जैसे सभी जीन कोि आरधक्षर् के्षत्र, िैल धवरचनयएं, जल प्रपयर्ों, झरनों, घयटी मयगों, उपवनों, गुफयए,ं थथलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की II (ii) 5 पहचयन की जयएगी और उन्हें संरधक्षर् दकर्य जयएगय र्थय उनकी सुरक्षय और संरक्षय के धलए उपर्ुि र्ोजनय बनयएगी और ऐसी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगय ।
(5) मयनव धनर्मार् धवरयसर् थ थल - पयररधथ थधर्क संवेिी जोन में भवनों, संरचनयओं, धिल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंथकृधर्क महत्व के क्षेत्रों की पहचयन करनी होगी और उनके संरक्षण की र्ोजनयएं र्ैर्यर करनी होगी र्थय आंचधलक महयर्ोजनय में सधम्मधलर् की जयएगी ।
(6) ध् वधन प्रििूण -- पयररधथथधर्क संवेिी जोन में ध् वधन प्रििूण की रोकथयम और धनर्ंत्रण ध्वधन प्रििूण (धवधनर्मन और धनर्ंत्रण) धनर्मों 2000 के अनुसयर पर्यावरणीर् (संरक्षण) अधिधनर्म, 1986, औ उसमें दकए गए संिोिनों के अिीन र्ैर्यर करेगय ।
(7) वयर् ुप्रििूण -- पयररधथथधर्क संवेिी जोन में, वयर् ुप्रििूण की रोकथयम और धनर्ंत्रण वयर्ु (प्रििूण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) के उपबंिों और उसके अिीन बनयए गए धनर्मों और उनमें दकए गए संिोिनों के अनुसयर र्ैर्यर करेगय ।
(8) बधहस्रयव कय धनथसयरण -- पयररधथथधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनथसयरण सयियरणों मयनकों के धलए पर्यावरणीर् प्रिधूिर् आच्छयदिर् के धनथसयरण के अंर्गार् पर्यावरणीर् (संरक्षण) अधिधनर्म, 1986 और उसके अिीन बनयए गए धनर्मों र्य रयज्र् सरकयर द्वयरय धनर्र् मयनकों, जो भी अधिक कठोर हो, के उपबंिों के अनसुयर होगय।
(9) ठोस अपधिष्ट - ठोस अपधिष्टों कय धनपटयन धनम्नधलधखर् रूप में होगय -
(i) पयररधथथधर्क संवेिी जोन में ठोस अपधिष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थय संिोधिर् अधिसूचनय सं. कय.आ. 1357(आ), र्यरीख 8 अप्रैल, 2016 नगरपयधलक ठोस अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ;
(ii) अकयबाधनक सयमग्री कय धनपटयन पयररधथथधर्क संवेिी जोन के बयहर पहचयन दकए गए थ थल पर दकसी पर्यावरणीर् थवीकयर्ा रीधर् में होगय ।
(iii) पयररधथथधर्क संवेिी जोन में ठोस अपधिष्टों को जलयनय र्य भष्मीकरण और भरयई कय थथयपन अनुज्ञयर् नहीं होगय ;
(10) जैव धचदकत् सीर् अपधिष् ट- जैव धचदकत् सीर् अपधिष् ट प्रबंिन धनम्नधलधखर् रूप में होगय—
(i) पयररधथथधर्क संवेिी जोन में जैव धचदकत्सीर् अपधिष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंिोधिर् अधिसूचनय सय.कय.धन 343 (अ) र्यरीख 28 मयचा 2016 द्वयरय प्रकयधिर् जैव धचदकत्सीर् अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ।
(iii) पयररधथथधर्क संवेिी जोन में कोई सयमयन्र् उपचयर सुधविय र्य भष्मीकरण अनुज्ञयर् नहीं दकर्य जयएगय ।
(11) र्यनीर् पररवहन - पररवहन की र्यनीर् गधर्धवधि प्रयणीर्ों के अनुकूल रीधर् से धवधनर्धमर् की जयएगी और इस संबंि में आंचधलक महयर्ोजनय में धविेि उपबंि सधम्मधलर् दकए जयएंग ेऔर जब र्क ऐसी आंचधलक महयर्ोजनय रयज्र् सरकयर के सक्षम प्रयधिकयरी द्वयरय र्ैर्यर और अनुमोदिर् नहीं दकर्य जयर्य ह ै | मयनीटरी सधमधर् संुसगर् अधिधनर्मों और उसके अिीन बनयए गए धनर्मों धनर्मों और धवधनर्मों के अिीन र्यनीर् गधर्धवधिर्ों के अनुपयलन को मयनीटर करेगी ।
(12) र्यनीर् प्रििूण:- लयगू धवधिर्ों के अनुसयर वयहन प्रििूण की रोकथयम और धनर्ंत्रण कय अनुपयलन दकर्य जयएगय। थवच्छक ईंिन के उपर्ोग के धलए दकए गए प्रर्यस उियहरण के धलए सीएनजी, एलपीजी, आदि हैं ।
(13) प्लयधथटक अपधिष्ट प्रबिंन: - पयररधथथधर्क संवेिी जोन में प्लयधथटक अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंिोधिर् अधिसूचनय सय.कय.धन 340(अ), र्यरीख 18 मयचा, 2016 द्वयरय प्रकयधिर् प्लयधथटक अपधिष्ट प्रबंि धनर्म 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(14) धनमयाण और धवध्वसं अपधिष्ट प्रबिंन: - पयररधथथधर्क संवेिी जोन में संधनमयाण और धवध्वंस अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंिोधिर् अधिसूचनय सय.कय.धन 317(अ), र्यरीख 29 मयचा, 2016 द्वयरय प्रकयधिर् संधनमयाण और धवध्वंस प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(15) ई–अपधिष्ट:- पयररधथथधर्क संवेिी जोन में ई–अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् द्वयरय समर्-समर् पर र्थयसंिोधिर् ई–अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(16) औद्योधगक ईकयइर्य:ं - (i) रयजपत्र में इस अधिसूचनय के प्रकयिन के पश्चयर् र्य प्रकयिन पर, पयररधथथधर्क संवेिी जोन के भीर्र कोई नए प्रिधूिर् उद्योगों की थथयपनय की अनुमधर् नहीं िी जयएगी।
(ii) पयररधथथधर्क संवेिी जोन के भीर्र कें द्रीर् प्रििूण धनर्तं्रण बोडा द्वयरय फरवरी, 2016 जयरी में मयगाििाक धसद्धयंर्ों के अनुसयर धसफा गरै- प्रिधूिर् उद्योगों की थथयपनय के वगीकरण की अनुमधर् िी जयएगी, जब र्क दक इस अधिसूचनय में धवधनर्िाष्ट न हो । इसके अलयवय, गैर-प्रिधूिर् कुटीर उद्योगों को बढ़यवय दिर्य जयएगय।
(17) पहयड़ी ढलयनों को सरंक्षण: - पहयड़ी ढलयनों के संरक्षण के अंर्गार्:
(क) आंचधलक महयर्ोजनय पहयड़ी ढलयनों पर क्षेत्रों कय संकेर् होगय जहयं दकसी भी संधनमयाण की अनुमधर् नहीं िी जयएगी । (ख) कटयव के एक उच्च धडग्री के सयथ धवद्यमयन खड़ी पहयड़ी ढलयनों र्य ढलयनों पर दकसी भी संधनमयाण की अनुमधर् नहीं िी जयएगी ।
(18) अगर र्ह आवश्र्क समझर्य ह,ै इस अधिसूचनय के उपबंिों को प्रभयवी करने में केन्द्रीर् सरकयर और रयज्र् सरकयर, अन्र् उपयर्ों धवधनर्िाष्ट करेगी।
4. पयररधथथधर्क संविेी जोन में प्रधर्धिद्ध और धवधनर्धमर् दकए जयन ेवयल ेदिर्यकलयपों की सचूी - पयररधथथधर्क संवेिी जोन में सभी दिर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) के उपबंिों और र्टीर् धवधनर्मन जोन (सीआरजेड), 2011 और पर्यावरणीर् प्रभयव आकलन (ईआईए ) अधिसूचनय, 2006 और वन (संरक्षण) अधिधनर्म, 1980 (1980 के 69), भयरर्ीर् वन अधिधनर्म, 1927 (1927 के 16), वन्र्जीव (संरक्षण) अधिधनर्म, 1972 (1972 के 53) संिोिनों सधहर् द्वयरय ियधसर् होंगे और नीचे िी गई र्यधलकय में धवधनर्िाष्ट रीधर् में धवधनर्धमर् होंगे, अथयार्प :-- सयरणी िम सं. दिर्यकलयप टीकय-रटप्पणी

(ख) मयननीर् उच्चर्म न्र्यर्यलर् की ररट र्यधचकय (धसधवल) सं. 1995 कय 202 टी.एन. गोहवंिरयमन धथरुमूलपयि बनयम भयरर् सरकयर के मयमले में आिेि र्यरीख 4 अगथर्, 2006 और ररट र्यधचकय (सी) सं. 2012 कय 435 गोवय फयउंडेिन बनयम भयरर् सरकयर के मयमले में र्यरीख 21 अपै्रल, 2014 के अंर्ररम आिेि के कठोर अनुसरण कय प्रचयलन होगय ।
2. जल र्य वयर्ु र्य मृिय र्य ध् वधन प्रििूण, इत्र्यदि कयररर् करने वयले उद्योगों की थ थयपनय । कोई नई र्य पयररधथथधर्क संवेिी जोन में प्रििूण फैलयने वयले उद्योगों के धवथर्यर की अनुमधर् िी जयएगी। पयररधथथधर्क संवेिी जोन के कें द्रीर् प्रििूण धनर्ंत्रण बोडा द्वयरय फरवरी, 2016 में जयरी मयगाििाक धसद्धयंर्ों के अनुसयर धसफा गैर-प्रिधूिर् उद्योगों की थथयपनय के वगीकरण की अनुमधर् िी जयएगी, जब र्क दक इस अधिसूचनय में धवधनर्िाष्ट न हो। इसके अलयवय गैर प्रिधुिर् कुटीर उद्योगों को बढ़यवय दिर्य जयएगय ।
3. नए बृहर् जल धवद्युर् पररर्ोजनय थ थयपनय । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
4. दकसी पररसंकटमर् पियथों कय उपर्ोग र्य उत्पयिन । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) ।
5. प्रयकृधर्क जल धनकयर्ों र्य सर्ही के्षत्र में अनुपचयररर् बधहस्रयाव और ठोस अपधिष्टों कय धनथसयरण । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अनप र्थय उपबंधिर् के धसवयर्) । II (ii) 7
6. ठोस अपधिष्ट धनपटयन थथल और ठोस और जैव धचदकत्सय अपधिष्ट के धलए सयमयन्र् भष्मीकरण की सुधविय की थथयपनय। पयररधथथधर्क संवेिी जोन में ठोस अपधिष्ट धनपटयन थथल कय कोई सयमयन्र् उपचयर सुधविय र्य प्रसंथकरण अनुज्ञयर् नहीं दकर्य जयएगय । इसके अधर्ररि औद्योधगक प्रदिर्य और थवयथथ्र् प्रधर्ष्ठयन/अथपर्यलों आदि से उत्पन्न दकसी भी ठोस अपधिष्ट के उपचयर के धलए सयमयन्र् र्य व्यधिगर् भष्मीकरण की सुधविय कय अधिष्ठयपन प्रधर्धिद्ध ह।ै
7. फमों, कॉपोरेट, कंपधनर्ों द्वयरय बड़े पैमयने पर वयधणधज्र्क पिुिन संपिय और कुक्कुट फयमों की थथयपनय । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
8. नई आरय धमलों की थथयपनय। पयररधथथधर्क संवेिी जोन के भीर्र नई और धवद्यमयन आरय धमलों कय धवथ र्यर अनुज्ञयर् नहीं होगय ।
9. ईंट भट्टों की थथयपनय करनय। लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे । ख. धवधनर्धमर् दिर्यकलयप
10. होटलों और ररसोटों की थथयपनय । पयररधथथधर्क पर्ाटन दिर्यकलयप छोटी अथथयर्ी संरचनयओं के धलए के धसवयर् संरधक्षर् क्षेत्र की सीमय से एक दकलोमीटर र्क र्य पयररधथथधर्क संवेिी जोन के धवथर्यर र्क इनमें जो भी धनकट ह,ै नर्े वयधणधज्र्क होटल और ररसोटा अनजु्ञयर् नहीं होंगे। परंर्ु, वन्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीटर र्क र्य पयररधथथधर्क संवेिी जोन के धवथर्यर र्क इनमें जो भी धनकट ह,ै नर् ेवयधणधज्र्क होटल और ररसोटा अनुज्ञयर् नहीं होंगे। र्थयधप, पयररधथथधर्क संवेिी जोन के वन्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीटर की िरूी से आगे र्क नर्े होटल और ररसोटा कय थथयपन पर्ाटन महयर्ोजनय के अनुसयर पयररधथथधर्क पर्ाटन सुधवियओं के धलए पूवा पररभयधिर् और पियधभधहर् क्षेत्रों के धलए दकर्य जयऐगय।
11. संधनमयाण दिर्यकलयप । संरधक्षर् क्षेत्र र्य पयररधथथधर्क संवेिी जोन जो भी धनकट हो, की सीमय से एक दकलोमीटर के भीर्र दकसी भी प्रकयर कय नर्य वयधणधज्र्क संधनमयाण अनजु्ञयर् नहीं दकर्य जयएगय:
(क) परंर्ु थ थयनीर् लोगों को पैरय 3 के उप पैरय (1) में सूचीबद्ध दिर्यकलयपों सधहर् उनके आवयसीर् उपर्ोग के धलए उनकी भूधम में संधनमयाण करने की अनुमधर् भवन उपधवधिर्ों के अनुसयर िी जयएगी ।
(i) धवद्यमयन सड़कों को चौड़य करनय और उन्हें सुिढृ करनय र्थय नई सड़कों कय संधनमयाण;
(ii) बुधनर्यिी ढयंचों और नयगररक सुख-सुधवियओं कय संधनमयाण और नवीकरण;
(iii) कुटीर उद्योगों धजसके अंर्गार् ग्रयमीण उद्योग; सुधवियजनक भण्डयर और थथयनीर् सुख सुधवियओं पयररधथथधर्क पर्ाटन गृह वयस सधहर् है; और
(iv) इस अधिसूचनय में संवर्िार् दिर्यकलयपों की सूची ।
12. प्रििूण उत्पन्न न करने वयले लघु उद्योग । फरवरी, 2016 में कें द्रीर् प्रििूण धनर्ंत्रण बोडा द्वयरय जयरी उद्योगों के वगीकरण के अनुसयर शे्वर् प्रवगा धनबंधिर् गैर-प्रििूण उद्योग और गैर-पररसंकटमर् लघु उद्योग र्थय पयररधथथधर्क संवेिी जोन से सेवय उद्योग, कृधि, पुष्पकृधि, उद्ययन कृधि र्य कृधि आियररर् उद्योग उत्पयि से िेिी-सयमयग्री सक्षम प्रयधिकयरी द्वयरय अनुज्ञयर् दकए जयएगे।
13. वृक्षों की कटयई । (क) रयज्र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनुमधर् के धबनय वन, सरकयरी र्य रयजथव र्य धनजी भूधम पर र्य वनों में ककंही वृक्षों की कटयई नहीं होगी । (ख) वृक्षों की कटयई, संबंधिर् कें द्रीर् र्य रयज्र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर धवधनर्धमर् होगी ।
14. वन उत्पयिों और गैर-कयष्ठ वन उत्पयिों कय संग्रहण (एन टी एफ पी) । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
15. नयगररक सुख सुधवियओं सधहर् बुधनर्यिी ढयंचे। लयगू धवधिर्ों के अनुसयर न्र्ूनीकरण उपयर्ों धनर्म और धवधनर्मन और उपलब्ि दिियधनिेिों के सयथ दकए जयएंगे।
16. पर्ाटन से संबंधिर् अन्र् दिर्यकलयप जैसे गमा वयर्ु गुब्बयरें, हलेीकयप्टर, ड्रोन, मयइिोलयइटस आदि द्वयरय पयररधथथधर्क संवेिी जोन क्षेत्र के ऊपर से उड़नय जैसे दिर्यकलयप करनय। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
17. धवद्युर् और िरूसंचयर टयवरों कय पररधनमयाण । भूधमगर् केबल को बढ़यवय दिर्य जयएगय।
18. होटलों और लॉज के धवद्यमयन पररसरों में कयटेंियर बयड लगयनय । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
19. प्रयकृधर्क जल धनकयर्ों र्य सर्ही के्षत्र में उपचयररर् बधहस्रयाव कय धनथसयरण । उपचयररर् अपधिष्ट जल/बधह:स्त्रयव कय धनथसयरण को जल धनकयर्ों में नहीं जयने दिर्य जयएगय । उपचयररर् अपधिष्ट जल के पुनचािण र्थय पुनपुार्ोग के धलए प्रर्यस की जयएंगी । अन्र्थय, उपचयररर् अपधिष्ट जल/बधह:स्त्रयव कय धनथसयरण लयगू धवधिर्ों के अनुसयर धवधनर्धमर् दकर्य जयएगय।
20. सर्ह और भूजल के वयधणधज्र्क धनष्किाण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
21. खुले कुआ, बोर कुआ, आदि के धलए कृधि और अन्र् उपर्ोग । धवधनर्धमर् दकए जयएंगे और समुधचर् प्रयधिकयरी द्वयरय दिर्यकलयपों की सख्र्ी से मयनीटरी की जयएगी।
22. वयधणधज् र्क सयइनबोडा और होर्डंग । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
23. वयर्ु, ध्वधन और र्यधनक प्रििूण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
24. धविेिी प्रजयधर्र्ों को लयनय । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
25. पयररधथथधर्क पर्ाटन। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
26. सुरक्षय बल धिधवर। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
27. नए कयष् ठ आियररर् उद्योग । पयररधथ थधर्क संवेिी जोन के भीर्र नए कयष् ठ आियररर् उद्योग की थ थयपनय अनुज्ञयर् नहीं होगी :
परंर्ु पयररधथथधर्क संवेिी जोन में 100% आर्यधर्र् कयष् ठ थ टयक उपभोग करने वयले नए कयष् ठ आियररर् उद्योग की थ थयपनय की जय सकेगी ।
28. पयररधथथधर्क अनुकूल पर्ाटन दिर्यकलयपों हरे्ु पर्ाटकों के अथथयर्ी अधिभोग हरे्ु पयररधथथधर्क अनुकूल कुटीर जैसे र्म्बु, लकड़ी के आवयस। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
29. ठोस अपधिष् ट प्रबंिन। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । ग. सवंर्िार् दिर्यकलयप
30. विया जल संचर्न । सदि र् रूप से बढ़यवय दिर्य जयएगय ।
31. जैधवक खेर्ी। सदि र् रूप से बढ़यवय दिर्य जयएगय ।
32. सभी गधर्धवधिर्ों के धलए हररर् प्रौद्योधगकी को ग्रहण करनय । सदि र् रूप से बढ़यवय दिर्य जयएगय ।
33. कुटीर उद्योगों धजसके अंर्गार् ग्रयमीण कयरीगर भी हैं । सदि र् रूप से बढ़यवय दिर्य जयएगय ।
34. नवीकरणीर् ऊजया स्रोर् और ईंिन कय उपर्ोग । बयर्ोगैस, सौर प्रकयि इत् र्यदि को सदिर् रुप से बढ़यवय दिर्य जयनय ह ै।

5. मयनीटरी सधमधर्- कें द्रीर् सरकयर के द्वयरय, पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 3 की उप-ियरय (3) के अिीन इस अधिसूचनय के उपबंिों की प्रभयवी धनगरयनी के धलए एक धनगरयनी सधमधर् कय गठन दकर्य गर्य, जो धनम्नधलधखर् से धमलकर बनेगी, अथयार्प:--

(iv) प्रकृधर् संरक्षण के क्षेत्र में कयर्ा करन े वयले गरै सरकयरी संगठन कय गुजरयर् सरकयर द्वयरय सिथर्;

6. धनिेि धनबिंन :
(1) मयधन टरी सधमधर् इस अधिसूचनय के उपबंिों के अनुपयलन को मयनीटर करेगी ।

(3) पयररधथथधर्क संवेिी जोन में भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ.
1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अनुसूची में के अिीन सधम्मधलर् दिर्यकलयपों और इस अधिसूचनय के पैरय 4 के अिीन प्रधर्धिद्ध गधर्धवधिर्ों के धसवयर् आन े वयल ेऐसे दिर्यकलयपों की ििय में वयथर्धवक धवधनर्िाष्ट थथलीर् िियओं पर आियररर् पयररधथथधर्क संवेिी जोन मयनीटरी सधमधर् द्वयरय संवीक्षय की जयएगी और उि अधिसूचनय के उपबंिों के अिीन पूवा पर्यावरण धनकयसी के धलए केन्द्रीर् सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् को धनर्िाष्ट की जयएगी । उद्योगों की केवल शे्वर् श्रेधणर्ों को "उद्योगों, 2016 कय वगीकरण" के धलए सीपीसीबी द्वयरय जयरी दिियधनिेिों में धनर्िाष्ट के रूप में मयनय जयएगय।
(4) इस अधिसूचनय के पैरय 4 के अिीन र्थय धवधनर्िाष्ट प्रधर्धिद्ध दिर्यकलयपों के धसवयर्, भयरर् सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् की अधिसूचनय संख्र्यंक कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अधिसूचनय के अनुसूची के अिीन ऐसे दिर्यकलयपों, धजन्हें सधम्मधलर् नहीं दकर्य गर्य ह,ै परंर् ुपयररधथथधर्क संवेिी जोन में आर् ेहैं, ऐसे दिर्यकलयपों की वयथर्धवक धवधनर्िाष्ट थथलीर् िियओं पर आियररर् मयनीटरी सधमधर् द्वयरय संवीक्षय की जयएगी और उसे संबद्ध धवधनर्यमक प्रयधिकरणों को धनर्िाष्ट दकर्य जयएगय ।
(5) मयनीटरी सधमधर् कय सिथर्-सधचव र्य संबद्ध कलक्टर र्य संरधक्षर् के्षत्र कय प्रभयरी ऐसे व्यधि के धवरूद्ध, जो इस अधिसूचनय के दकसी उपबंि कय उल्लंघन करर्य ह,ै पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 19 (1986 कय 29) के अिीन पररवयि फयइल करन ेके धलए सक्षम होगय ।
(6) मयनीटरी सधमधर् मुद्दों के आियर पर अपेक्षयओं पर धनभार रहर्े हुए संबद्ध धवभयगों के प्रधर्धनधिर्ों र्य धविेिज्ञों, औद्योधगक संगमों र्य संबद्ध पणियररर्ों के प्रधर्धनधिर्ों को अपने धवचयर-धवमिा में सहयर्र्य के धलए आमंधत्रर् कर सकेगी ।
(7) मयनीटरी सधमधर् प्रत्र्ेक विा की 31 मयचा र्क रयज् र् के मुख् र् वन् र्जीव वयडान को अपनी वयर्िाक कयरावयई ररपोटा उपयबिं IV में उपबंधिर् रूप में उक् र् विा के 30 जून र्क प्रथर्रु् करेगी ।
(8) केन्द्रीर् सरकयर कय पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् मयनीटरी सधमधर् को अपन े कृत्र्ों के प्रभयवी धनवाहन के धलए समर्-समर् पर ऐसे धनिेि िे सकेगय, जो वह ठीक समझे ।

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the dated the 22 nd December, 2015;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification;
WHEREAS, the Hingolgadh Wildlife Sanctuary is situated between latitude 220 7’ N and 220 10’ N and between 700 18’ E and 710 21’ E longitude in Jasdan Taluka Rajkot District in Saurashtra peninsula of Gujarat and is spread over an area of 6.54 square kilometer and the Sanctuary is situated at a distance of 180 kilometers from Ahmedabad on Ahmedabad-Rajkot State Highway (State Highway.No.8) Rajkot; the District Headquarter is about 77 kilometers from the Sanctuary;
AND WHEREAS, Hingolgadh Wildlife Sanctuary was declared as Sanctuary under section 18 of Wildlife Protected Act, 1972 vide Government notification No. GKH-168/80-WLP-1080-91082-P.2, dated the 29 th August, 1980; after the declaration and settlement of the Sanctuary, it was placed under the management of Gujarat Ecological Education and Research (GEER) Foundation, since 1984; GEER is an autonomous organisation and Public Trust with its head office at Gandhinagar and the Government of Gujarat has renewed the lease period till the year 2020; in the initial years, the Sanctuary was managed through Annual Plans approved by the Chief Conservator Forest (Wildlife) development and management of the Sanctuary was done as per the activities sanctioned by the Government; the current Management Plan of Hingolgadh Wildlife Sanctuary for the period of 2014-24 was sanctioned and the works and activities are carried out accordingly and besides the prime conservation objectives, this Sanctuary is used as a centre for nature, wildlife and environmental education and awareness.
AND WHEREAS, the said Sanctuary has good quality thorn forests along with savannah grass patches harbouring rich bio-diversity comprising 51 tree species, 155 species of herbs and 38 shrubs and 42 species of climbers, 31 grass species, 11 mammal species which include some rare species, 33 species of reptiles and more than 232 species of birds;
AND WHEREAS, main fauna in the Hingolgadh Wildlife Sanctuary are Blue Bull (Boselaphus tragocamelus), Chinkara (Gazella bennettii), Common Mongoose (Herpestes edwardsii), Desert Cat (Felis constantina ornata), Five-striped Palm Squirrel (Funambusus pennati), Flying fox (Pteropus giganetens), Grey musk shrew (Suncus marinus), Indian Fox (Vulpes bengalensis), Indian Wolf (Canis lupus), Indian Gerbils (Tatera indica), Indian Hare (Lepus nigricollis), Indian Porcupine (Hystrix indica), Indian Wild Boar (Sus scrofa), Jackal (Canis aureus), Jungle Cat (Felis chaus), Leopard (Panthera pardus), Pale Hedgehog (Paraechinus micropus), Small Indian Civet (Viverricula indica), Striped Hyena (Hyaena hyaena);
AND WHEREAS, the main flora in the Hingolgadh Wildlife Sanctuary are Gorad (Acacia Senegal), Chhatralo-baval (Acacia planifrons) , Hermobaval (Acacia leucophloea) , Deshibaval (Acacia nilotica), Khijado (Prosopis cineraria), Gando baval (Prosopis juliflora), Subaval (Leucaena leucocephala), Rain tree (Samanea saman), Goras amli (Pithecellobium dulce), Siras( Albizia lebbeck), Ingoriyo (Balanites aegyptiaca), Asitaro (Bauhinia recemosa) , Amli (Tamarindus indica), Sandesaro (Delonix elata), Gul mahor (Delonix regia) , Son mahor (Peltophorum pterocarpum), Kasid (Cassia siamea) , Gormalo (Cassia.
Fistula), Neem (Azadirachta indica), Bakan limado (Melia azedarach) ;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Hingolgadh Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub–section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 1.0 Kilometres to 4.1 Kilometres from the boundary of Hingolgadh Wildlife Sanctuary in the State of Gujarat, as Hingolgadh Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The extent of Eco-sensitive Zone varies from 1.0 Kilometers to 4.1 Kilometers from the boundary Hingolgad Wildlife Sanctuary.
(2) The area of Eco-sensitive Zone is 31.66 square kilometers.
(3) The map of Eco-sensitive Zone boundary together with latitudes – longitudes is appended as Annexure I.
(4) The Eco-sensitive Zone is spread across six villages of Rajkot District of Gujarat State and the list of villages falling within the Eco-sensitive Zone is annexed as Annexure II.
2. Zonal Master Plan for the Eco-sensitive Zone.-
(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:- i. Environment;
ii. Forest and Wildlife;
iii. Agriculture;
iv. Revenue;
v. Urban Development;
vi. Tourism;
vii. Rural Development;
viii. Irrigation and Flood Control;
ix. Municipal;
x. Panchayati Raj;
xi. Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
1. Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other within the Ecosensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant State laws and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as.-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay;
(v) promoted activities and given under para 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant State laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities.
(2) Natural water bodies.- The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/ Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:-
(i) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Ecosensitive Zone.
(10) Bio-medical waste.- Bio medical waste management shall be as under:
(i) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.
(ii) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Vehicular Pollution-Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuels such as CNG, LPG, etc.

(13) Plastic Waste Management:- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(14) Construction and Demolition Waste Management:- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(15) E-waste- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.- The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Remarks

1. Commercial Mining.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 04 August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within Eco sensitive zone.
Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is Prohibited.
7. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
10. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or up to the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. No new commercial construction of any kind shall be permitted within one Kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
(a) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Cottage industries including village industries; convenience stores & local amenities supporting eco-tourism including home stays; and
(iv) Promoted activities listed in this Notification.
12. Small scale non polluting industries. Non polluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
13. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
14. Collection of Forest produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
15. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

5. Monitoring Committee:- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:-
(i) Collector, Rajkot District- Chairman;
(ii) Representative of the Department of Environment and Forests, Government of Gujarat – Member;
(iii) Regional Officer, State Pollution Control Board - Member;
tourism like over flying the ESZ area by hot air balloon, helicopter, drones, Microlites, etc.
17. Erection of electrical and telecommunication towers related infrastructure.
Promote underground cabling.
18. Fencing of existing premises of hotels and lodges.
Regulated under applicable laws.
19. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
20. Commercial extraction of surface and ground water.
Regulated under applicable law.
21. Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
22. Commercial Sign boards and hoardings. Regulated under applicable laws.
23. Air, Noise and vehicular pollution. Regulated under applicable laws.
24. Introduction of Exotic species. Regulated under applicable laws.
25. Eco-tourism. Regulated under applicable laws
26. Security Forces Camp. Regulated under applicable laws.
27. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone. Provided that new wood based industry may be set up in the Eco-sensitive using 100% imported wood stock.
28. Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, etc. for Eco-friendly tourism activities.

29. Solid Waste Management. Regulated under applicable laws.
C. Promoted Activities
30. Rain water harvesting. Shall be actively promoted.
31. Organic farming. Shall be actively promoted.
32. Adoption of green technology for all activities.

(iv) One representative of Non-governmental Organisation working in the field of nature conservation to be nominated by the Government of Gujarat (for a term of three year in each case)– Member;
(v) One expert in ecology or wildlife or birds from reputed institution or University of the State of Gujarat to be nominated by the Government of Gujarat (for a term of three year in each case) - Member;
(vi) Senior Town Planner of area – Member;
(vii) Member State Biodiversity Board – Member;
(viii) Deputy Conservator of Forests, Jamnagar/Devbhumi Dwarka – Member Secretary.
6. Terms of Reference:
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) Tenure of the Monitoring Committee shall be for three (3) years.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the monitoring committee based on site-specific conditions and referred to concerned Regulatory Authority.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
