PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 1806] ubZ fnYyh] cqèkokj] twu 28] 2017@vk"kk<+ 7] 1939 No. 1806] NEW DELHI, WEDNESDAY, JUNE 28, 2017/ASADHA 7, 1939 पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢ ालय अिधसचूना नई िदल्ली, 28 जून, 2017 का.आ. 2028(अ).—ᮧारुप अिधसूचना भारत सरकार, पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं. का. आ. 139 (अ), तारीख 15 जनवरी, 2016, ᳇ारा भारत के राजपᮢ मᱶ ᮧकािशत की गई थी िजसमᱶ उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने की संभावना थी, उस तारीख से, िजसको उस राजपᮢ की ᮧितयां, िजसमᱶ उᲦ अिधसूचना अंतिवर᳥् ह,ै उपलब्ध करा दी गई थᱭ, साठ िदन की अविध के भीतर आक्षेप और सुक्षाव आमंिᮢत िकए गए थे;
और, उᲦ राजपᮢ, िजसमᱶ उᲦ अिधसूचना अंतिवर᳥् ह,ै की ᮧितयां जनता को तारीख 15 जनवरी, 2016, को उपलब्ध करा दी गई थी;
और, ᮧारुप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधािरयᲂ से ᮧा᳙ आक्षेपᲂ और सुक्षावᲂ पर केन्ᮤीय सरकार ᳇ारा िवचार कर िलया गया ह;ै पुष् पािगिर वन् यजीव अभयारण् य, कनार्टक राज् य के कूगर् िजले के उत् तर अक्षांश 12025' से 12040' तथा 75039' से 75045' पूवर् दशेांतर के बीच मᱶ 102.92 वगर् िकलोमीटर क्षेᮢ मᱶ फैला हुआ ह ैकडकामाल िरजवर् वन के िहस्से का गठन िकया गया था;
और, पुष् पािगिर वन् यजीव अभयारण् य के पि᳟मी घाट के भाग की िवशेषताᲐ मᱶ अभयारण्य क्षेᮢ की अत्यिधक खड़ीढाल 35 ᮧितशत से अिधक और ऊबड़-खाबड़ क्षेᮢ 85 ᮧितशत से अिधक ह,ै उᲬ वषार् वाले क्षेᮢ 6000 मी.मी. से 7000 मी.मी. के बीच, ᮧचुर जैव िविवधता, स्थािनक का उᲬ दर और संकटाप᳖ और संकटाप᳖ ᮧजाितयाँ जैसे बाघ (पᱹथेरा टीगरीस), तᱶदआु(पᱹथेरा पाडर्स), जंगली कुᱫा(कून एलीपेनीस), एिशयाई हाथी 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ऐलीफस मैक्सीमुस), गौर और भारतीय भᱹसा (बोस गयरयस), सांभर (रूसा यूनीकोलर), और मुंजक (मैनीटीअक्स मंुनतजक); अन्य छोटे स्तनधािरयᲂ मᱶ नीलिगरी लंगूर (तराचयपीथेकस जोह᳖ी), नीलिगरी िचतराला पंजा रिहत ऊदिबलाव (मारᮝेस गवातीनसी), ऊदिबलाव (लुतरोगोले पेरसपीकील्लटा), भूरा मुसंग (परादोक्यरयस जेरदोनी), तेदआु िबल्ली (परीओनाइलयरअस बेनगालेनसीस), तवांगु (लोरीस लयदᲥेेरीअनअस), तरवनकोर सूरज- भगत (पेटीनोमस फयकोकापील्लस) और अन्य शािमल ह।ᱹ अन्य वन्यजीव मᱶ ᳴कंग कोबरा (ओफीओफगस ह᳖ाह), इंिडयन राक पायथन (पायथन मोलयरूस मोलयरूस) शािमल ह;ᱹ अभयारण्य के पि᳟मी घाट मᱶ एक महत्वपूणर् पक्षी क्षेᮢ मᱶ पि᳟मी घाट की 16 मᱶ से 13 स्थािनक पक्षी पाए जाते ह;ै अभयारण्य मᱶ सुंदर स्थािनक शरण और संकटाप᳖ भी ह ै मालाबर पिᲵत मोर (पपीलीओ बुाहा), पैिरस मोर (पपीलीओ परीस), मालाबार रेवेन (पपीलीओ दरावीदरूम),और मालाबार बᱹिडड स्वेलोटेल (पपीलीओ लीओमेदोन) और मुख्य पिक्षयᲂ मᱶ मालाबार िचतकबरी धनेश (अनथराकोकेरोस कोरोनचुर), मालाबार ᳡ेत धनेश (हरपेकटेस फसकीटूस), मालाबार ᮝायगन (हरपेकटेस फैसीऐटस), मालाबार िचलिबल (मायओफनूस होरसफीइलइइ), वायानद िचलिबल (गररूलाक्स दलेेस्सलेरटी), सफेद तुंदा वृक्ष घालमेल ( दनेदरोकीᲵा लेयुकोगसटरा), पहाड़ी मैना (गराक्यूला रेलीगीसा) और अन्य शािमल ह;ᱹ और, पुष् पािगिर वन् यजीव अभयारण् य मᱶ पाए जाने वाले कई ᮧजाितयᲂ मᱶ गंभीरता से लु᳙ᮧाय और लु᳙ᮧाय ᮧजाितयᲂ जैसे एिशयाई हाथी(ऐलीफस मैक्सीमुस), मालाबार गंध िबलाव (वीवेरार्अ सीवेᲵीना), िसंह पुच्छ लघ ु पुच्छ वानर (मᲥा सीलेनअस), तवांग ु(लोिरस लयदाᲥेरीअनअस), नीलिगरी िचराला ( मारटेस गवाटकीनस्सी), जंगली कुᱫा (क्योन अलपीनेस), समुथ कोिटड ओटर(लुटेरोगल े पेरसपीिकल्लाटा), ᮓमशः का कᱶ ᮤ शािमल ह ै । िविभ᳖ िरज़वर् वनᲂ जैसे बीसले, कीिरबगहा, सुᮩामानया और कदमाकल के चारᲂ ओर, अभयारण्य मᱶ बृहत् स्तनीवगर् एिशयाई हाथी(ऐलीफस मैक्सीमुस) और बाघ(पᱹथेरा टीगरीस) के िलए िवस्तािरत आवास ᮧबंध करते ह ै और हाथी पिरयोजना के अंतगर्त मैसूर हाथी िरज़वर् के भाग के घोिषत िकया गया और यह कनार्टक मᱶ नगराहोले रा᳦ीय उ᳒ान और भाᮤा ᳞ाᮖ िरज़वर् के बीच बृहत् स्तिनयᲂ के िलए महत्वपूणर् गिलयारा ह;ै और, अभयारण्य क्षेᮢ मᱶ एक बहुत अिधक पुष्प एवं जीवजन्तु िविवधता ह ै और अभयारण्य मᱶ शोला घासस्थल के साथ अिधकांश सदाबहार वन िवकीणर् ह।ै [चैिम्पयन और सेथ वगᱮकरण की आई ए/सी3, 2ए/सी2, 1ए/सी3, 8ए(सी1/डी एस1)] जहाँ, वनस्पित के अंतगर्त अत्यंत महत्वपूणर् ᮧजाितयाँ जैसे-डीपटेरोकरपस इंिडकस, अिन्टअरीस टोक्सीकािरया, ᳴कंगीओडेनᮟोन पी᳖ाटम, िडयोस्परोस इबेनम, अलस्टोिनया स्कोलिरस, बीकोिफया जाविनका, स्लोफइलम अपेटलम, सी᳖ामोमुम जेयलानीकम, डलबेरिगया लटीफोिलया, लागेरस्ᮝोइिमया लानिकयोलाटा, पीटरोकरपस मरस्पम, बटेिरया इंिडका, इलइयोकरपस स्पा, कनेमा अᲵेनुअटे, माइरिस्टका स्पा, पालाकूयमम इल्लीपटीकम, गरसीिनया स्पा, मकहीलस मकरानाथा, मेसुआफेररा, होिपया परवीफ्लोरा, जयझोएक्सलम मालाबिरकम, का᳖ारम िस्ᮝकटम, एक्सनथोजयलम टेᮝास्पमर्म, कालोफइलम अपेटुलम, अरᱶगा िवहटी, कोस्सीिनयम फेनुस्ᮝाटम, हयडनोकरपस पᱶटनᮟा, मोउल्लावा स्पीकाटा, मािपया फोइटीडा, गनेटम उला, आिद ह;ै और, यह संरिक्षत क्षेᮢ कुमाराधरा नदी का आवाह क्षेᮢ ह,ै जो पुष् पािगिर वन् यजीव अभयारण्य से ᮧारंभ होती ह ैऔर यह अभयारण्य बारहमासी धाराᲐ और कुमाराधरा नदी की सहायक निदयᲂ जैसे िलंगादाहोले, पारकेहोले, मरीगुंडीहोले, उपांगलाहोले, पड़क् काहोले और कदामाकालहोले के िलए आवाह क्षेᮢ का कायर् करता ह,ै जो पुष् पािगिर वन् यजीव अभयारण्य ᳇ारा ᮧदान की जाने वाली महत् वपूणर् पािरिस् थितक तंᮢ सेवाᲐ को उपदिशर्त करता ह ैऔर अभयारण्य के भीतर कोई ᮕाम नहᱭ ह ै᳴कंतु अभयारण्य की सीमाᲐ के भीतर चार संवे᳥न ह ᱹ(िजसके अंतगर्त दो रबड़ एस् टेट ह)ᱹ ;
¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 और, पािरिस्थितक और पयार्वरणीय दिृष् ट से पािरिस् थितक संवेदी जोन के रूप मᱶ पुष् पािगिर वन् यजीव अभयारण् य के चारो ओर के संरिक्षत क्षेᮢ, िजसका िवस् तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸दर्ष् ट ह,ᱹ को संरिक्षत और सुरिक्षत करना आवश् यक ह ैतथा उᲦ पािरिस्थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ का ᮧचालन और ᮧसंस्करण करने को ᮧितिष करना आवश्यक ह ै;
अतः, अब, केन्ᮤीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पिठत पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते हुए, कनार्टक राज् य मᱶ पुष् पािगिर वन् यजीव अभयारण् य की सीमा से 1 स े 10 िकलोमीटर चारᲂ ओर तक के िवस् तािरत के्षᮢ को पुष् पािगिर वन् यजीव अभयारण् य पािरिस् थितक संवेदी जोन (िजसे इसमᱶ इसके पश् चात् पािरिस् थितक संवेदी जोन कहा गया ह)ै के रूप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथार्त् :--
1. पािरिस्थितक सवंदेी जोन का िवस्तार और उसकी सीमाएं--(1) पािरिस् थितक संवेदी जोन 199.37 वगर् िकलोमीटर (बाडᲂ को छोड़कर) के के्षᮢ मᱶ फैला हुआ ह ैऔर िजसका िवस्तार पुष्पािगिर वन्यजीव अभयारण्य के चारᲂ ओर 1 मीटर स े10 िकलोमीटर ह ैऔर इस जोन की सीमा का वणर्न उपाबधं-I मᱶ िदया गया ह ै।
(2) अक्षांश और दशेान्तर के साथ पािरिस्थितक संवेदी जोन का मानिच ᮢ उपाबधं II के रुप मᱶ उपाब ह ै।
(3) पुष्पािगिर वन्यजीव अभयारण्य की सीमा पर और पािरिस्थितक संवेदी जोन के मुख्य िबन्दᲐु के साथ भू- िनदᱷशांक उपाबंध III के रुप मᱶ उपाब ह ै|
(4) पािरिस्थितक संवेदी जोन के अंतगर्त आने वाले ᮕामᲂ और िरजवर् वन क्षेᮢ का वणर्न उपाबधं IV के रुप मᱶ उपाब ह ै।
2. पािरिस्थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) राज्य सरकार, पािरिस् थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ अिधसूचना के अंितम ᮧकाशन की तारीख स े दो वषर् की अविध के भीतर, स्थानीय ᳞िᲦयᲂ के परामशर् से, इस अिधसूचना मᱶ संलग् न अनुबंधᲂ के सामंजस् य से आंचिलक महायोजना तैयार करेगी । उᲦ महायोजना राज्य सरकार मᱶ सक्षम ᮧािधकारी ᳇ारा अनुमोिदत होगी ।
(2) पािरिस् थितक संवेदी जोन के िलए उᲦ महायोजना इस अिधसूचना मᱶ िविन᳸दर्ष् ट रूप मᱶ ऐसी रीित मᱶ राज् य सरकार तथा सुसगंत कᱶ ᮤीय और राज् य िविधयᲂ के सामंजस् य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागर्िनदᱷश, यिद कोई हᲂ, ᳇ारा तैयार होगी ।
(3) आंचिलक महायोजना, उसमᱶ पािरिस्थितक और पयार्वरणीय मुᲂ को सिम्मिलत करने के िलए सभी संबंिधत राज्य िवभागᲂ के साथ परामशर् से तैयार की जाएगी, िजसके अंतगर्त िन᳜िलिखत ह-ᱹ-
(i) पयार्वरण;
(ii) वन और वन्यजीव;
(iii) कृिष;
(iv) राजस्व;
(v) नगर िवकास;
(vi) पयर्टन;
(vii) ᮕामीण िवकास ;

(viii) िसंचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िनमार्ण िवभाग ।
(4) आंचिलक महायोजना अनुमोिदत िव᳒मान भू-उपयोग, अवसंरचना और िᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक िक इस अिधसूचना मᱶ िविन᳸दर᳥् न हो और आंचिलक महायोजना मᱶ सभी अवसंरचना मᱶ दक्षता और पािरिस्थितक अनुकूलता का संवधर्न करेगी ।
(5) आंचिलक महायोजना मᱶ अनाच्छािदत क्षेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरक्षण, आवाह क्षेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरक्षण, स्थानीय समुदायᲂ की आवश्यकताᲐ तथा पािरिस्थितक और पयार्वरण स ेसबंंिधत ऐस ेअन्य पहलूᲐ, िजन पर ध्यान दनेा आवश्यक ह,ै के िलए उपबंध हᲂग े।
(6) आंचिलक महायोजना सभी िव᳒मान पूजा स् थलᲂ, ᮕामᲂ और नगरीय बंदोबस्तᲂ, वनᲂ के ᮧकार और िकस् मᲂ, जनजातीय क्षेᮢ, कृिष के्षᮢᲂ, ऊपजाऊ भूिम, हिरत क्षेᮢ जैसे उ᳒ान और उसी ᮧकार के स् थान, उ᳒ान कृिष के्षᮢ, आ᳸कर् डᲂ, झीलᲂ और अन्य जल िनकायᲂ का मानिचᮢᲂ के साथ अभ्यकंन करेगी और योजना को मानिचᮢᲂ मᱶ िदए गए िव᳒मान तथा ᮧस्तािवत भूिम उपयोग सिुवधाᲐ के िववरण ᳇ारा समिथर्त िकया जाएगा।
(7) आंचिलक महायोजना पािरिस् थितक संवेदी जोन मᱶ िवकास के पािरिस् थितक अनुकूल िवकास और स् थानीय समुदायᲂ की आजीिवका को सुिनिश् चत करते हुए िविनयिमत होगी ।
(8) आंचिलक महायोजना क्षेᮢीय िवकास योजना के साथ सह-अंतक होगी ।
(9) आंचिलक महायोजना इस अिधसूचना मᱶ िदए गए उपबंधᲂ के संबंध मᱶ अपने कायᲄ के करने के िलए िनगरानी सिमित के िलए एक संदभर् दस्तावेज होगा ।
3. राज्य सरकार ᳇ारा िकए जान ेवाले उपाय-- राज्य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथार्त्:--
(1) भ-ूउपयोग – पािरिस् थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष क्षेᮢᲂ, कृिष क्षेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचिन्हत िकए गए पाकᲄ और खुले स्थानᲂ का वािणिज्यक और औ᳒ोिगक सबं िवकास िᮓयाकलापᲂ के िलए उपयोग या संपिरवतर्न नहᱭ होगा। परंतु पािरिस्थितक संवेदी जोन के भीतर कृिष भूिम का संपिरवतर्न, मानीटरी सिमित की िसफािरश पर और राज्य सरकार के पूवर् अनुमोदन स,े स्थानीय िनवािसयᲂ की आवासीय जरूरतᲂ को पूरा करने के िलए और अधीन िᮓयाकलापᲂ को पूरा करने के िलए अनुज्ञात होगा, अथार्त् :-
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना तथा नई सड़कᲂ का सिंनमार्ण;
(ii) बुिनयादी ढांचᲂ और नागिरक सुिवधाᲐ का संिनमार्ण और नवीकरण;
(iii) ᮧदषूण उत्प᳖ न करन ेवाले लघ ुउ᳒ोग;
(iv) कुटीर उ᳒ोग िजसके अंतगर्त ᮕामीण कारीगर ह;ᱹ सुिवधाजनक भण्डार और स्थानीय सुिवधाᲐ सहायक पािरिस्थितक पयर्टन मᱶ सिम्मिलत ᮕह वास; और
(v) संविधर्त िᮓयाकलाप जो पैरा 4 के अधीन िदए गए ह:ै ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 परंतु यह और िक जनजातीय भूिम का उपयोग राज्य सरकार क्षेᮢीय नगर योजना अिधिनयम और अन्य िनयमᲂ तथा िविनयमᲂ के अधीन सक्षम अिधकारी के पूवर् अनुमोदन और सिंवधान के अनुच् छेद 244 या तत्समय ᮧवृᱫ िविध के उपबंधᲂ िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अिधकारᲂ की मान्यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै के अनुपालन के िबना, वािणिज्यक या उ᳒ोग िवकास िᮓयाकलापᲂ के िलए अनुज्ञात नहᱭ होगा:
परंतु यह और भी िक पािरिस् थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुिट, िनगरानी सिमित के िवचार ᮧा᳙ करने के प᳟ात ्राज्य सरकार ᳇ारा ᮧत्येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुिट के संशोधन की सूचना कᱶ ᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को दनेी होगी । परंतु यह और भी िक उपयुर्Ღ ᮢुिट का सशंोधन मᱶ इस उप परैा के अधीन यथा उपबंिधत के िसवाय िकसी भी दशा मᱶ भू-उपयोग का पिरवतर्न सिम्मिलत नहᱭ होगा । (ख) वनरोपण और वास जीणᲃार िᮓयाकलापᲂ वाले अनᮧयुक् त या अनुत् पादक कृिष के्षᮢᲂ मᱶ पुन:
वनीकरण करने के ᮧयास िकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ या निदयᲂ या जलसरणी की पहचान की जाएगी और उसमᱶ उनके संरक्षण और पुनरुद्भूतकरण के िलए योजना सिम् मिलत होगी ।
(3) पयर्टन/पािरिस्थितक पयर्टन – (क) पािरिस्थितक संवेदी जोन के भीतर सभी नए पािरिस्थितक पयर्टन िᮓयाकलाप या िव᳒मान पयर्टन संबंधी िᮓयाकलाप पािरिस्थितक संवेदी जोन के िलए पयर्टन महायोजना के अनुसार हᲂगे । (ख) पािरिस्थितक पयर्टन महायोजना पयर्टन िवभाग, ᳇ारा राज्य सरकार के पयार्वरण और वन िवभाग के परामशर् से तैयार होगी । (ग) पयर्टन महायोजना आंचिलक महायोजना के एक घटक के रूप मᱶ होगी । (घ) पािरिस्थितक पयर्टन संबंधी िᮓयाकलाप नीचे िदए अनुसार िविनयिमत हᲂगे, अथार्त्:-
(i) वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन के िवस्तार तक, जो भी िनकट हो, िकसी होटल या िरसोटर् का नया संि᳖मार्ण अनुज्ञात नहᱭ िकया जाएगा । तथािप, वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर की दरूी से परे पािरिस्थितक संवेदी जोन के िवस्तार तक नए होटलᲂ और िरसोटᲄ की स्थापना पयर्टन महायोजना के अनुसार पािरिस्थितक पयर्टन सुिवधाᲐ के िलए पूवर् सीमांिकत और पदािभिहत क्षेᮢᲂ मᱶ ही अनुज्ञात की जाएगी ;
(ii) पािरिस्थितक संवेदी जोन के अन्दर सभी नए पयर्टन िᮓया-कलाप या िव᳒मान पयर्टन िᮓयाकलापᲂ के िवस्तार केन्ᮤीय सरकार, पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय ᳇ारा जारी मागर्दशᱮ िसांतᲂ तथा पािरिस्थितक पयर्टन पर बल दतेे हुए रा᳦ीय बाघ संरक्षण ᮧािधकरण ᳇ारा जारी पािरिस्थितक पयर्टन मागर्दशर्क िसांतᲂ (समय-समय पर यथा संशोिधत) के अनुसार होगा ;
(iii) आंचिलक महायोजना का अनुमोदन िकए जाने तक, पयर्टन के िलए िवकास और िव᳒मान पयर्टन िᮓयाकलापᲂ के िवस्तार को वास्तिवक स्थल िविन᳸दर᳥् संवीक्षा तथा मानीटरी सिमित की िसफािरश पर आधािरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनुज्ञात िकया होगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(4) नसैिगर्क िवरासत -- पािरिस्थितक सवेंदी जोन मᱶ महत्वपूणर् नैसिगर्क िवरासत के सभी स्थलᲂ जैसे सभी जीन कोश आरिक्षत क्षेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, स्थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आिद की पहचान की जाएगी और तथा उनका पिररक्षण और संरक्षण के िलए िवरासत संरक्षण योजना तैयार की जाएगी।
(5) मानव िनिमर्त िवरासत स् थल - पािरिस् थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िशल्प-तथ्य, ऐितहािसक, कलात्मक और सांस्कृितक महत्व के के्षᮢᲂ की पहचान करनी होगी और उनके संरक्षण की योजनᲐ के रुप मᱶ आंचिलक महायोजना तैयार की जाएगी।
(6) ध् विन ᮧदषूण - पािरिस्थितक संवेदी जोन मᱶ ध् विन ᮧदषूण का िनवारण और िनयंᮢण पयार्वरणीय (संरक्षण) अिधिनयम, 1986, के अधीन ध्विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम 2000 की अनुपालना मᱶ िकया जाएगा ।
(7) वाय ुᮧदषूण -- पािरिस्थितक संवेदी जोन मᱶ, वायु ᮧदषूण का िनवारण और िनयंᮢण वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार अनुपालन िकया जाएगा ।
(8) बिह᮲ाव का िनस्सारण - पािरिस्थितक संवेदी जोन मᱶ उपचािरत बिह᮲ाव का िनस्सारण पयार्वरण (संरक्षण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ या राज्य सरकार ᳇ारा िनयत मानकᲂ के अन्तगर्त आने वाले पयार्वरणीय ᮧदषूक तत्वᲂ के िनस्सारण के साधारण मानकᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान और ᮧबंधन नीचे िदए अनुसार होगा- (क) पािरिस्थितक संवेदी जोन मᱶ ठोस अपिश᳥ िनपटान और ᮧबंधन समय-समय पर संशोिधत ठोस अपिशष् ट ᮧबधंन िनयम, 2016, जो भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं. का.आ. 1357(अ) तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत िकए गए थे, के उपबंधᲂ के अनुसार िकया जाएगा ;
अकाबर्िनक सामᮕी का िनपटान पािरिस्थितक संवेदी जोन के बाहर पहचान िकए गए स् थल पर िकसी पयार्वरणीय स्वीकृत रीित मᱶ होगा;
(ख) पािरिस्थितक संवेदी जोन मᱶ ठोस अपिशष् टᲂ को जलाना या भष् मीकरण और भूिम भराव के स्थापनᲂ को अनुज्ञात नहᱭ िकया जाएगा ।
(10) जैव िचिकत् सीय अपिशष् ट- जैव िचिकत् सीय अपिशष् ट ᮧबंधन िन᳜िलिखत रूप मᱶ होगा— (क) पािरिस्थितक संवेदी जोन मᱶ जैव िचिकत्सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय-समय पर यथा संशोिधत अिधसूचना सं.का.िन 343 (अ) तारीख 28 माचर् 2016 ᳇ारा ᮧकािशत जैव िचिकत्सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा । (ख) पािरिस्थितक संवेदी जोन मᱶ कोई सामान्य उपचार सिुवधा या भष्मीकरण अनुज्ञात नहᱭ िकया जाएगा ।
(11) प्लािस्टक अपिश᳥ ᮧबंधन: - पािरिस्थितक संवेदी जोन मᱶ प्लािस्टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन 340(अ), तारीख 18 माचर्, 2016 ᳇ारा ᮧकािशत प्लािस्टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार िकया जाएगा। ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
(12) सिंनमार्ण और िवध्वसं अपिश᳥ ᮧबंधन: - पािरिस्थितक संवेदी जोन मᱶ संिनमार्ण और िवध्वंस अपिश᳥ ᮧबंध भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन 317(अ), तारीख 29 माचर्, 2016 ᳇ारा ᮧकािशत संिनमार्ण और िवध्वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा ।
(13) ई–अपिश᳥:- पािरिस्थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय ᳇ारा समय-समय पर यथासंशोिधत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा।
(14) यानीय पिरवहन: - यातायात का यानीय संचालन पयार्वास के अनुकूल रीित मᱶ िविनयिमत होगा और इस संबंध मᱶ आंचिलक महायोजना मᱶ िविन᳸दर᳥् उपबंध समािव᳥ िकए जाएंगे और आंचिलक महायोजना के तैयार होने और राज्य सरकार के सक्षम ᮧािधकारी ᳇ारा के अनुमोिदत होने तक, मानीटरी सिमित सुसगंत अिधिनयमᲂ तथा तदधीन बनाए गए िनयमᲂ और िविनयमᲂ के अधीन यानीय संचलन के अनुपालन को मानीटर करेगी ।
(15) यानीय ᮧदषूण:- लागू िविधयᲂ के अनुसार यानीय ᮧदषूण की रोकथाम और िनयंᮢण का अनुपालन िकया जाएगा। स्वच्छ ईंधन उदाहरण के िलए सीएनजी, एलपीजी, आिद के उपयोग के िलए ᮧयास िकए जाएगे ।
(16)औ᳒ोिगक ईकाइया:ं - (i) राजपᮢ मᱶ इस अिधसचूना के ᮧकाशन पर या उसके बाद पािरिस्थितक संवेदी जोन के भीतर िकन्ही नए ᮧदषूणकारी उ᳒ोगᲂ की स्थापना की अनुमित नहᱭ दी जाएगी।
(ii) पािरिस्थितक संवेदी जोन मᱶ कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा फरवरी, 2016 मᱶ जारी िदशािनदᱷशᲂ मᱶ िसफर् गैर- अᮧदषूणकारी उ᳒ोगᲂ की स्थापना को वगᱮकरण के अनुसार अनुमित दी जाएगी, जब तक िक इस अिधसूचना मᱶ इस ᮧकार िविन᳸दर᳥् न हो। इसके अलावा, गैर-ᮧदषूणकारी कुटीर उ᳒ोगᲂ को ᮧितिष िकया जाएगा।
(17) पहाड़ी ढलानᲂ का सरंक्षण: - पहाड़ी ढलानᲂ का संरक्षण िन᳜ानुसार:
(क) आंचिलक महायोजना मᱶ पहाड़ी ढलानᲂ पर क्षेᮢᲂ को उपदिशर्त िकया जाएगा जहां िकसी भी संिनमार्ण की अनुमित नहᱭ दी जाएगी । (ख) कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर िकसी भी सिंनमार्ण की अनुमित नहᱭ दी जाएगी ।
(18) केन्ᮤीय सरकार और राज्य सरकार, यिद यह आवश्यक समझती ह,ै इस अिधसूचना के उपबंधᲂ को ᮧभावी करने मᱶ अन्य उपाय िविन᳸दर᳥् करेगी।
4. पािरिस्थितक सवंेदी जोन मᱶ ᮧितिष और िविनयिमत िकए जाने वाल े िᮓयाकलापᲂ की सचूी - पािरिस्थितक संवेदी जोन मᱶ सभी िᮓयाकलाप पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और तटीय िविनयमन जोन (सीआरजेड), 2011 और पयार्वरणीय ᮧभाव आकलन (ईआईए) अिधसूचना, 2006 और वन (संरक्षण) अिधिनयम, 1980 (1980 के 69), भारतीय वन अिधिनयम, 1927 (1927 के 16), वन्यजीव (संरक्षण) अिधिनयम, 1972 (1972 के 53) संशोधनᲂ सिहत ᳇ारा शािसत हᲂग े और नीचे दी गई तािलका मᱶ िविन᳸दर᳥् रीित मᱶ िविनयिमत हᲂगे, अथार्त् :-- 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सारणी ᮓम स.ं िᮓयाकलाप िटप्पणी

1. वािणिज्यक खनन, पत्थर की खदान, उनको तोड़ने की इकाइयां । (क) सभी ᮧकार के नए और िव᳒मान खनन (लघ ु और वृहत खिनज), पत्थर की खानᱶ और उनको तोड़ने की इकाइयां वास्तिवक स्थानीय िनवािसयᲂ की घरेलू आवश्यकताᲐ िजसमᱶ िनजी उपयोग के िलए मकानᲂ के सिंनमार्ण या मरम्मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइल्स या ईंटᲂ का िनमार्ण करना भी सिम्मिलत ह,ै के िसवाय नहᱭ हᲂगी ;
(ख) खनन सिंᮓयाएं, माननीय उᲬतम न्यायालय की िरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमर्न िथरुमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अगस्त, 2006 और िरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतिरम आदेश के अनुसरण मᱶ सवर्दा ᮧचालन होगा ।
2. ᮧदषूण जल या वायु या मृदा या ध् विन कािरत करने वाले उ᳒ोगᲂ की स् थापना । (क) कोई नया उ᳒ोग या पािरिस्थितक संवेदी जोन मᱶ ᮧदषूण फैलाने वाले उ᳒ोगᲂ के िवस्तार की अनुमित नहᱭ दी जाएगी। (ख) पािरिस्थितक संवेदी जोन के भीतर कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा फरवरी, 2016 मᱶ जारी िदशािनदᱷशᲂ मᱶ िसफर् गैर- ᮧदिूषत उ᳒ोगᲂ को स्थापना के अनुसार अनुज्ञात िकया जाएगा, जब तक िक इस अिधसूचना मᱶ इस ᮧकार िविन᳸दर᳥् न हो।
3. बृहत जल िव᳒ुत पिरयोजना की स् थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) होगी ।
4. िकन्ही पिरसंकटमय पदाथᲄ का उपयोग या उत्पादन या ᮧस्संकरण । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) होगी ।
5. ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢ मᱶ अनुपचािरत बिह᮲ार्व और ठोस अपिश᳥ᲂ का िनस्सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे ।
6. ठोस अपिश᳥ िनपटान स्थल और ठोस और जैव िचिकत्सा अपिश᳥ के िलए सामान्य भष्मीकरण की सुिवधा की स्थापना। पािरिस्थितक संवेदी जोन के भीतर कोई नई ठोस अपिश᳥ िनपटान स्थल तथा ठोस अपिश᳥ और अपिश᳥ उपचार/ᮧसंस्करण सुिवधा की अनुमित नहᱭ ह।ै इसके अितिरᲦ औ᳒ोिगक ᮧिᮓया और स्वास्थ्य ᮧित᳧ान / ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 अस्पतालᲂ आिद से उत्प᳖ िकसी भी ठोस अपिश᳥ के उपचार के िलए सामान्य या ᳞िᲦगत भष्मीकरण की सिुवधा का संस्थापन ᮧितिष ह।ै
7. फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणिज्यक पशुधन संपदा और कुक्कुट फामᲄ की स्थापना । स्थानीय जरूरतᲂ को पूरा करने के िसवाय लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे।
8. नई आरा िमलᲂ की स्थापना। पािरिस्थितक संवेदी जोन के भीतर नई या िव᳒मान आरा िमलᲂ का िवस् तार अनुज्ञात नहᱭ होगा ।
9. ईंट भᲵᲂ की स्थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे । ख.िविनयिमत िᮓयाकलाप
10. होटलᲂ और िरसोटᲄ का वािणिज्यक स्थापन । पािरिस्थितक अनुकूल पयर्टन िᮓयाकलापᲂ के िलए लघु अस्थायी संरचनाᲐ के िलए संरिक्षत के्षᮢ सीमा के एक िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन के िवस्तार तक ही जो भी िनकट हो कोई नया वािणिज्यक होटल और िरसोटर् अनुज्ञात हᲂगे अन्यथा नहᱭ । परन्तु संरिक्षत क्षेᮢ की सीमा से एक िकलोमीटर परे या पािरिस्थितक संवेदी जोन के िवस्तार तक, जो भी िनकट हो सभी नए पयर्टन िᮓयाकलापᲂ या िव᳒मान िᮓयाकलापᲂ का िवस्तार यथालागू पयर्टन महायोजना के अनुरुप होगा ।
11. सिंनमार्ण िᮓयाकलाप । (क) संरिक्षत के्षᮢ की सीमा से एक िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन के िवस्तार तक जो भी िनकट हो, िकसी भी ᮧकार का वािणिज्यक संिनमार्ण अनुज्ञात नहᱭ िकया जाएगा:
परंतु स् थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब िᮓयाकलापᲂ सिहत उनके उपयोग के िलए उनकी भूिम मᱶ स्थानीय िनवास्यᲂ की आवासीय आवश्यकताᲐ को पूरा करने िलए संिनमार्ण करने की अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी ।
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना तथा नई सड़कᲂ का सिंनमार्ण;
(ii) बुिनयादी ढांचᲂ और नागिरक सुख-सिुवधाᲐ का सिंनमार्ण और नवीकरण;
(iii) फरवरी, 2016 मᱶ कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा िकए गए वगᱮकरण के अनुसार पिरभािषत गैर- ᮧदषूणकारी लघु उ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजनके अंतगर्त ᮕामीण उ᳒ोग हᱹ;
सिुवधा भण्डार और स्थानीय सुख सुिवधाᲐ जो पािरिस्थितक पयर्टन मᱶ िजस मᱶ ᮕह वास भी ह ै सहायक हो; और 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(v) इस अिधसूचना मᱶ सूचीब संविधर्त िᮓयाकलापᲂ की सूची :
परन्तु ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उत् पन् न नहᱭ करते ह,ᱹ से संबंिधत संिनमार्ण िᮓयाकलाप िविनयिमत िकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यिद कोई हᲂ, के अनुसार सक्षम ᮧािधकारी की पूवर् अनुमित से ही न् यूनतम पर रखे जाएंगे । (ख) एक िकलोमीटर से आगे आंचिलक महायोजना की अनुसार िविनयिमत हᲂगे ।
12. ᮧदषूण उत्प᳖ न करने वाले लघु उ᳒ोग । फरवरी, 2016 मᱶ केन्ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा जारी उ᳒ोगᲂ मᱶ वगᱮकरण के अनुसार गैर-ᮧदषूणकारी उ᳒ोग और अपिरसंकट मᱶ, लघु और सेवा उ᳒ोग, कृिष, पुष्प कृिष, उ᳒ान कृिष या पािरिस्थितक संवेदी जोन से दशेी सामᮕी से उत्पादᲂ को उत्प᳖ करने वाले कृिष आधािरत उ᳒ोग सक्षम ᮧािधकारी ᳇ारा अनुज्ञात हᲂगे।
13. जलावन लकड़ी का वािणिज्यक उपयोग। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
14. वृक्षᲂ की कटाई । (क) राज्य सरकार मᱶ सक्षम ᮧािधकारी की पूवर् अनुमित के िबना वन, सरकारी या राजस्व या िनजी भूिम पर वृक्षᲂ की कोई कटाई नहᱭ होगी । (ख) वृक्षᲂ की कटाई संबंिधत कᱶ ᮤीय या राज्य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
15. वन उत्पादᲂ और गैर काष् ठ वन उत्पादᲂ का सᮕंहण (एनटीएफपी) । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
16. िव᳒ुत और दरूसंचार टावरᲂ का पिरिनमार्ण और केबल िबछाना और अन्य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे (भूिमगत केबल िबछाए जाने को बढ़ावा िदया जाएगा)।
17. नागिरक सुख सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ िनयमᲂ और िविनयमᲂ मागᱮ िसांतᲂ के अनुसार न्यूनीकरण की उपायᲂ के साथ, और उपलब्ध िकए जाएंगे ।
18. िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना तथा नई सड़कᲂ का सिं᳖मार्ण । लागू िविधयᲂ िनयमᲂ और िविनयमᲂ मागᱮ िसांतᲂ के अनुसार न्यूनीकरण की उपायᲂ के साथ, और उपलब्ध िकए जाएंगे ।
19. पयर्टन से संबिंधत िᮓयाकलाप करना जैसे गमर् वायु गुब्बारᱶ, हलेीकाप्टर, ᮟोन, माइᮓोलाइटस आिद ᳇ारा पािरिस्थितक संवेदी जोन क्षेᮢ के ऊपर से उड़ना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 11
20. पहाड़ी ढालᲂ और नदी तटᲂ का संरक्षण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
21. रािᮢ मᱶ यानीय यातायात का संचलन। लागू िविधयᲂ के अधीन वािणिज्यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
22. स्थानीय समुदायᲂ ᳇ारा चलाई जा रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जलकृिष और मछली पालन । स्थानीय लोगᲂ के उपयोग के िलए लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
23. ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢ मᱶ उपचािरत अपिश᳥ जल/बिह᮲ार्व का िनस्सारण । उपचािरत अपिश᳥ जल/बिह᮲ार्व का िनस्सारण को जल िनकायᲂ मᱶ ᮧवेश नहᱭ करने िदया जाएगा। अन्यथा लागू िविधयᲂ के अनुसार उपचािरत जल बिह᮲ार्व का िनस्सारण िविनयिमत िकया जाएगा।
24. सतह और भूजल का वािणिज्यक िनष्कषर्ण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. खुले कुआ, बोर कुआ, आिद के िलए कृिष और अन्य उपयोग । िविनयिमत और समुिचत ᮧािधकारी ᳇ारा िᮓयाकलापᲂ की सख्ती से मानीटरी की जाएगी।
26. ठोस अपिशष् ट ᮧबंधन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
27. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. पािरिस्थितक-पयर्टन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
29. पोिलथीन बैगᲂ का उपयोग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
30. वािणिज् यक साइनबोडर् और होिडᲈग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ग.सवंिधर्त िᮓयाकलाप
31. वषार् जल संचयन । सिᮓ य रूप स ेबढ़ावा िदया जाएगा ।
32. जैिवक खेती। सिᮓय रूप से बढ़ावा िदया जाएगा ।

37. पािरिस्थितक अनुकूल पिरवहन का उपयोग । सिᮓ य रूप स ेबढ़ावा िदया जाएगा ।
38. कौशल िवकास । सिᮓय रूप से बढ़ावा िदया जाएगा ।
39. िन᳜ीकृत भूिम या वन या आवास की बहाली । सिᮓय रूप से बढ़ावा िदया जाएगा ।

5. िनगरानी सिमित- कᱶ ᮤीय सरकार, पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते हुए तीन वषर् की अविध के िलए िनगरीनी सिमित गिठत करती ह,ै पािरिस्थितक संवेदी जोन की िनगरानी ᮧभावी के िलए िजसमᱶ िन᳜िलिखत से िमलकर बनेगी:--
(i) ᮧादिेशक आयुक् त, मैसूर अध् यक्ष;
(ii) माननीय सदस् य, िवधानसभा, मदीकेरी िनवार्चन क्षेᮢ, कोदागु िजला -सदस्य;
(iii) पयार्वरण िवभाग, कनार्टक सरकार का ᮧितिनिध -सदस्य;
(iv) शहरी िवकास िवभाग, कनार्टक सरकार का ᮧितिनिध -सदस्य;
(v) पयार्वरण के क्षेᮢ मᱶ कायर् करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगर्त िवरासत संरक्षण भी ह)ै का ᮧत्येक मामले मᱶ तीन वषर् की अविध के िलए कनार्टक राज्य सरकार ᳇ारा नामिन᳸दर᳥् एक ᮧितिनिध -सदस्य;
(vi) ᮧादिेशक अिधकारी, कनार्टक राज् य ᮧदषूण िनयंᮢण बोडर्, मैसूर -सदस्य;
(vii) कनार्टक सरकार ᳇ारा नामिन᳸दर्ष् ट ᮧत्येक मामले मᱶ तीन वषर् की अविध के िलए पािरिस् थितक और पयार्वरण के्षᮢ का एक िवशेषज्ञ -सदस्य;
(viii) सदस्य-सिचव / सदस्य, राज्य जैव िविवधता बोडर्, कनार्टक -सदस्य;
(ix) उपायुक् त या उसका ᮧितिनिध, कोदागु िजला, मदीकेरी -सदस्य;
(x) राज्य जैव-िविवधता बोडर् का सदस्य -सदस्य;
(xi) उप वन संरक्षक, मदीकेरी वन् यजीव ᮧभाग, मदीकेरी -सदस्य- सिचव। * (इस शतर् के अधीन रहते हुए िक कनार्टक राज् य सरकार अन् य बातᲂ के साथ सुसंगत अनुमोदन, िजसके अंतगर्त कनार्टक िवधान सभा के सभापित की अनुज्ञा भी ह,ै यिद अपेिक्षत हो, अिभᮧाप् त करेगी) ।
6. िनदᱷश - िनबंधन
(1) िनगरानी सिमित का कायर्काल तीन वषर् का होगा।
(2) िनगरानी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(3) पािरिस्थितक संवेदी जोन मᱶ भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसूचना सं. का.आ.
1533(अ) तारीख 14 िसतंबर, 2006 की अनुसूची मᱶ सिम्मिलत िᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 सारणी मᱶ िविन᳸दर᳥् ᮧितिष गितिविधयᲂ के िसवाय आने वाले ऐसे िᮓयाकलापᲂ की दशा मᱶ वास्तिवक िविन᳸दर᳥् स्थलीय दशाᲐ पर आधािरत िनगरानी सिमित ᳇ारा संवीक्षा की जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवर् पयार्वरण िनकासी के िलए केन्ᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को िन᳸दर᳥् की जाएगी।
(4) इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸दर᳥् ᮧितिष िᮓयाकलापᲂ के िसवाय, भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसूचना संख्यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अिधसूचना के अनुसूची के अधीन ऐसे िᮓयाकलापᲂ, िजन्हᱶ सिम्मिलत नहᱭ िकया गया ह,ै परंतु पािरिस्थितक सवेंदी जोन मᱶ आते ह,ᱹ ऐसे िᮓयाकलापᲂ की वास्तिवक िविन᳸दर᳥् स्थलीय दशाᲐ पर आधािरत िनगरानी सिमित ᳇ारा संवीक्षा की जाएगी और उस ेसंब िविनयामक ᮧािधकरणᲂ को िन᳸दर᳥् िकया जाएगा । ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13
(5) िनगरानी सिमित का सदस्य-सिचव या संबंिधत कलक्टर या संबंिधत उ᳒ान के उप-वन संरक्षक, कोई ᳞िᲦ जो इस अिधसूचना के िकसी उपबंध का उल्लंघन करता ह,ै उसके िवरु पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 19 के अधीन पिरवाद फाइल करने के िलए सक्षम होगा ।
(6) िनगरानी सिमित मुᲂ के आधार पर अपेक्षाᲐ पर िनभर्र रहते हुए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेषज्ञᲂ, औ᳒ोिगक संगमᲂ या संब पणधािरयᲂ के ᮧितिनिध ᮧित मुे की अपेक्षाᲐ के अनुसार िवचार-िवमशर् मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) िनगरानी सिमित ᮧत्येक वषर् की 31 माचर् तक की अपनी वािषर्क कारर्वाई िरपोटर् राज्य के मुख्य वन्यजीव वाडर्न को उपाबंध V पर उपाब ᮧारूप पर 30 जून तक ᮧस्तुत करेगी ।
(8) केन्ᮤीय सरकार का पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय िनगरानी सिमित को अपने कृत्यᲂ के ᮧभावी िनवर्हन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे ।
7. इस अिधसूचना के उपबंधᲂ को ᮧवृत दनेे के िलए कᱶ ᮤीय सरकार और राज् य सरकार अितिरक् त उपाय, यिद कोई हᲂ, िविन᳸दर्ष् ट कर सकᱶ गे ।

8. कोई अन् य महत् वपूणर् िवषय । 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 28th June, 2017 S.O. 2028(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 139 (E), dated 15th January 2016,inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the dated 15th January 2016;
AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the draft notification were duly considered by the Central Government;
AND WHEREAS, the Pushpagiri Wildlife Sanctuary situated in Northern side of Kodagu District of the State of Karnataka and lying between North Latitude 12o25’ to 12o40’ and the East Longitudes 75o39’ to 75o45’ spread over an area of 102.92 square kilometres was formed by including part of Kadamakal Reserve Forest;
AND WHEREAS, the Pushpagiri Wildlife Sanctuary forming the core of Western Ghats is characterised by, rugged terrain with more than eighty-five percent of the Sanctuary area having very steep slope of more than thirty five per cent, high rainfall ranging between 6000 mm to 7000 mm, and rich biodiversity represented by large mammals including the Tiger (Panthera tigris), Leopard (Panthera pardus), Wild Dog (Cuon alpines), Asiatic Elephant (Elephas maximus), Gaur or Indian Bison (Bos gaurus), Sambar (Rusa unicolor), and Barking Deer (Muntiacus muntjak); other smaller mammals include Nilgiri Langur (Trachypithecus johnii), Nilgiri Marten (Martes gwatkinsii), Otter (Lutrogale perspicillata), Brown Palm Civet (Paradoxurus jerdoni), Leopard Cat (Prionailurus bengalensis), Slender Loris (Loris lydekkerianus), Travancore Flying Squirrel (Petinomys fuscocapillus) and others. Other wildlife includes King Cobra (Ophiophagus Hannah), Indian Rock Python (Python molurus molurus); the Sanctuary has been identified as one of the important bird areas in the Western Ghats as 13 of the 16 endemic birds of the Western Ghats are found here; the Sanctuary also harbors beautiful endemic and endangered papilionids and variety of bird species such as the Malabar Banded Peacock (Papilio Buddha), Paris Peacock (Papilio paris), Malabar Raven (Papilio dravidarum), and Malabar Banded Swallowtail (Papilio liomedon) and major birds including Malabar Pied Hornbill (Anthracoceros coronatus), Malabar Grey Hornbill (Harpactes fasciatus), Malabar Trogon (Harpactes fasciatus), Malabar Whistling Thrush (Myophonus horsfieldii), Wayanad Laughing Thrush (Garrulax delesserti), White-bellied Tree-Pie (Dendrocitta leucogastra), Hill Myna (Gracula religiosa) and others;
AND WHEREAS, many of the species found in the Pushpagiri Wildlife Sanctuary show a high rate of endemism and home for critically endangered and endangered species such as the Asiatic Elephant (Elephas maximus), Malabar Civet (Viverra civettina) and Lion Tailed Macaque (Macaca silenus), Slender Loris (Loris lydekkerianus), Nilgiri Marten (Martes gwatkinsii), Wild Dog (Cuon alpines), Smooth-coated Otter (Lutrogale perspicillata) respectively, and is surrounded by many reserve forests like Bisle, Kiribagha, Subramanya and Kadamakal; the Sanctuary provides extended habitat for large mammalia such as the Asiatic Elephant (Elephas maximus) and Tiger (Panthera tigris)and forms part of the Mysore Elephant Reserve declared under the Project Elephant and it acts as an important corridor for large mammals to move between Nagarahole National Park and Bhadra Tiger Reserve in Karnataka;
AND WHEREAS, the sanctuary area has a very high Floral and Faunal diversity and the sanctuary largely consists of evergreen forests interspersed with shola grasslands [IA/C3, 2A/C2, 1A/C3, 8A (C1/DS1) of Champion and Seth classification] where the vegetation comprises of very important species like Dipterocarpus indicus, Antiaris toxicaria, Kingiodendron pinnatum, Diospyrous ebenum, Alstonia scholaris, Bischofia javanica, Calophyllum apetalum, Cinnamomum zeylanicum, Dalbergia latifolia, Lagerstroemia lanceolata, Pterocarpus marsupium, Vateria indica, Elaeocarpus sp., Knema attenuate, Myrstica sp., Palaquium ellipticum, Garcinia sp., Machilus macarantha, Mesua ferrea, Hopea parviflora, Dysoxylum malabaricum, Cannarium strictum, Xanthoxylum tetraspermum, ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 Calophyllum apetulum, Arenga whitii, Cossinium fenustratum, Hydnocarpus pentandra, Moullava spicata, Mapia foetida, Gnetum ula, etc.;
AND WHEREAS,the protected area is catchment for River Kumaradhara which takes birth within the Pushpagiri Wildlife Sanctuary; and the Sanctuary also acts as an important catchment area for perennial streams and tributaries of River Kumaradhara such as Lingadahole, Perchehole, Marigundihole, Uppangalahole, Padakkahole and Kadamakalhole which depicts the importance of eco-system services offered by Pushpagiri Wildlife Sanctuary and there are no villages within the Sanctuary but there are four enclosures (including two rubber estates) within the Sanctuary limits.
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Pushpagiri Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the powers conferred by sub section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 1 to 10 kilometers from the boundary of Pushpagiri Wildlife Sanctuary in the State of Karnataka as the Pushpagiri Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.—
(1)The total geographical area of Eco-sensitive Zone is 199.37 square kilometers (excluding enclosures) with an extent varying from 1 to 10 kilometres around the boundary of Pushpagiri Wildlife Sanctuary and the boundary description of the Eco-sensitive Zone is given in Annexure – I.
(2) The map of Eco-sensitive Zone boundary together with latitudes longitudes is appended as Annexure II;
(3) The Geo Coordinates of major points on the boundary of Pushpagiri Wildlife Sanctuary and on the boundary of Ecosensitive Zone boundary is appended as Annexure-III.
(4) The list of villages and the details of reserved forest areas falling within the Eco-sensitive Zone is given at Annexure- IV.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial activities:
Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government to meet the residential needs of the local residents, and for activities such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.- The catchment areas of all natural springs, rivers and channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.

(3) Tourism/ Eco-tourism.-
(a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Eco-tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be permitted within one kilometer from the boundary of the Pushpagiri Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone, whichever is nearer :
Provided that the distance of one kilometer from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts may be permited only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism.
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.
(b)no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343(E), dated the 28th March, 2016;
(b) no common treatment facility or incineration shall be permitted within the Eco-sensitive Zone.

(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016.
(12) Construction and demolition waste management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016.
(13) E-waste.- The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.
(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared, and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and the efforts shall be made for use of cleaner fuel for example CNG, etc.
(16) Industrial Units.- (i) No new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries may be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- Table S. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units shall prohibited except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23 matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs.
UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (water, air, soil, noise, etc.).
(a) no new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
(b) only non-polluting industries may be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste shall be permitted within Eco-sensitive Zone, and installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment, hospitals, etc. shall be prohibited.
7. Establishment of large-scale commercial livestock and poultry farms by firms, etc. companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
10. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of the Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per building byelaws to meet their residential needs of the local residents such as:-
(i) Widening and strengthening of existing roads and construction of new roads;

(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution termed as per classification done by the Central Pollution Control Board in the year 2016;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and
(v) Promoted activities listed in this Notification:
(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
12. Small scale non polluting industries.
Non polluting industries as per classification of industries issued by the Central Pollution Control Board in the year 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone may be permitted by the Competent Authority.
13. Commercial use of fire wood. Regulated under applicable laws.
14. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the relevant Central or State Acts and the rules made thereunder.
15. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
16. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law (underground cabling may be promoted).
17. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18. Widening and strengthening of existing roads and construction of new roads.

24. Commercial extraction of surface and ground water.

25. Open well, bore well, etc. for agriculture or other usage.

5. Monitoring Committee.- In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:-
(i) Regional Commissioner, Mysure – Chairman;
(ii) Hon’ble Member of Legislative Assembly, Madikeri Constituency, Kodagu District – Member;
(iii) Representative of the Department of Environment, Government of Karnataka – Member;
(iv) Representative of the Department of Urban Development, Government of Karnataka –Member;
(v) Representative of non-Governmental organisation working in the field of nature conservation (including heritage conservation) to be nominated by the Government of Karnataka for three years – Member;
(vi) Regional Officer, Karnataka State Pollution Control Board, Mysure – Member;
(vii) One expert in Ecology from reputed Institution or University of the State of Karnataka to be nominated by the Government of Karnataka for three years – Member;
(viii) Member-Secretary/Member, State Biodiversity Board, Karnataka – Member;
(ix) Deputy Commissioner or his representative, Kodagu District, Madikeri – Member;
(x) Member, State Biodiversity Board-Member;
(xi) The Deputy Conservator of Forests, Madikeri Wildlife Division, Madikeri – Member-Secretary.

6. Terms of reference:-
(1) The tenure of the Monitoring Committee shall be three yers.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.

Then the line runs in north eastern direction all along the D-Line of Bisile State Forest till it reaches a point SL.No: 18 in the village boundary of Kumaralli bearing GPS coordinates N: 12.700674 E: 75.690777.
East:The Eco-sensitive Zone boundary line then runs at a width of 1 kilometer parallel to the D-Line of Pushpagiri Wildlife Sanctuary passing through the villages of Kumaralli and Forest, Kothanalli, Surlabi, Hammiyala, Kalmakar, Kaloor and Gaalibeedu and Forest till it reaches a point (Sl.No: 26) bearing Geo Co-ordinates N 12.49213 E 75.65322 of the village Galibeedu and Forest.
South and West:Then the line joins the D-line of Kadamakal Reserve Forest of Sampaje Range. Then it runs all along the Eastern, Southern, Western boundary of the Kadamakal reserve forest till it reaches a point Sl.No: 31 on the ‘D’ line of Kadamakal Reserve Forest with a GPS reading N 12.519797, E 75.633166. Then the line run in the western direction through revenue areas of Balagodu village of Sulya taluk till it reaches a point Sl.No:32 on the D-Line of Kiribag Reserve Forest bearing GPS co-ordinates N 12.52399, E 75.632449. Further, the line runs in Northern direction all along the western boundary of Kiribag reserve forest and Subramanya reserve forest till it reaches the starting point.
