PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 1807] No. 1807] NEW DELHI, WEDNESDAY, JUNE 28, 2017/ASADHA 7, 1939 पर्यावरण, वन और जलवयर् ुपररवर्ान मतं्रयलर् अधिसचूनय नई दिल्ली, 27 जून, 2017 कय.आ. 2029(अ).–प्रयरुप अधिसूचनय, भयरर् के रयजपत्र, असयियरण, में भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय संखर्यंक कय.आ. 3550(अ), र्यरीख 30 दिसम्बर, 2015, को प्रकयधिर् की गई थी, धजसमें उन सभी व्यधिर्ों से धजनके उससे प्रभयधवर् होने की संभयवनय थी, उस र्यरीख से, धजसको भयरर् के रयजपत्र में प्रकयधिर् अधिसूचनय की प्रधर्र्यं जनर्य को उपलब्ि करयई गई थीं, सयठ दिन की समयधि के पूवा आक्षेप और सुझयव आमंधत्रर् दकए गए थ;े और, केन्द्रीर् सरकयर उि प्रयरुप अधिसूचनय के उ मेर में सभी व्यधिर्ों और पणियररर्ों से प्रयि आक्षपेों और सुक्षयवों पर द्वयरय सम्र्क रुप से धवचयर दकर्य गर्य;
और, घयटयप्रभय पक्षी अभर्यरण्र्, कनयाटक सरकयर की अधिसूचनय सं. एफईई 58 एफडब् ल् र्-ूएल 96, र्यरीख
8.7.1999 द्वयरय अधिसूधचर् की गई और बेलगयम धजले के गोकयक र्थय हुकेकी में ध थर् हज धजसकय क्षेत्रफल 29.875 वगा दकलोमीटर हज;
और, र्ह एक लघु पक्षी अभर्यरण्र् धजसमें घयटयप्रभय निी कय एक भयग हज और इसमें 22 से अधिक द्वीप हैं । िूपयिल के धनकट 1883 के िौरयन संधनर्मार् बंियरय और बयंि ने इसके बीचोंबीच एक धवियल द्वीप वयलय जलयश् र् उजयन सजधजर् कर दिर्य हज। अभर्यरण्र् के पूवोत् र्र भयग में अवध थर् गोकयक जल प्रपयर् मुख र् पर्ाटन आक्ाण हज;
और, र्ह द्वीप मयचा महीन के कुछ दिनों को छोड़कर जल से धघरय हुआ होर्य हज और अच् छी रेलें र्थय सड़कों के नेटवका से जुड़य हज धजसके प्रधर् बहुर् से पर्ाटक, पक्षी ििाक, कूल धवयारयथआ आकर््ार् होर् ेहैं। र्ह पक्षी प्रयधणजयर् में धवधनदििा ट होने वयली वन्द् र्जीव के संबंि में जन जयगजधर् सजजन के धलए एक सुअवसर प्रियन करर्य हज। र्ह निीर् पयररध थधर्क-प्रणयली कय एक अच् छय उियहरण हज;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, अधिकयंि द्वीप, धजनमें अभर्यरण्र् हैं, बंजर र्थय िु क हज और उनमें से िुपयिल झील के पधश् चमी दििय एक द्वीप िलिल वयलय हज और िसूरय द्वीप में बबूल अरेधबकय, धपथेबॉधबर्म डुलसी और बम्बुसय अरंधडनसेआ, की अच् छी वजधह हज, िोनों ही सधन्द् नधव ट प्रजयधर्र्यं हैं । एकयधसर्य एरयबयइकय और इम् परेेट धसलन्द् डयररकय धविे् धहर् की समझी जयर्ी हज क् र्ोंदक घोंसलय बनयने के धलए अच् छी होर्ी हैं । छोटे जल कौआ (फयइलजकोकोरॉक्स नयइजर), बगुलय (एग्रटे्टय गेजेट और आडेर्ोलय अल्बय), बुज् जय (िकीइओधमस मेलोनजकफेल), कौधडल् लय (िकीइओधमस मेलोनजकफेल), चमरघेंच(सीकोनीधडए), रयपापक्षी (अननगंय अननंगय), फ मेख (आडेडयई), आदि जजसे िेिज पधक्षर्ों को आश्रर् िेने के अधर्ररक् र् र्ह क्षेत्र डेमयइसेले सयरस (ग्रूस वरगो) र्थय र्ूरोपीर् वेर् चमरघेंच (धसधसओनय धसकोररर्य) जजसे प्रवयसी पधक्षर्ों को आकर््ार् करन ेके धलए प्रधसह हज धजन्द् हें नवम् बर से मयचा र्क ििान दकए गए हैं;
और, घयटयप्रभय पक्षी अभर्यरण्र्, के चयरों ओर के क्षेत्र को, धजसकय धवर्यर और सीमयएं इस अधिसूचनय के पजरय 1 में धवधनदििाष्ट हैं, पर्यावरण की िजधष्ट से पयररधथधर्क संवेिी जोन के रूप में सुरधक्षर् और संरधक्षर् करनय र्थय उि पयररधथधर्क संवेिी जोन में उयारोगों र्य उयारोगों के वगो कय प्रचयलन र्थय प्रसंकरण करने को प्रधर्ध्ह करनय आवश्र्क हज ;
अर्ः, अब, केन्द्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) और पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (2) के खंड (v) और खंड (xiv) के सयथ परठर् और उपियरय (1) द्वयरय प्रि मे िधिर्ों कय प्रर्ोग करर् ेहुए, कनयाटक रयज्र् में घयटयप्रभय पक्षी अभर्यरण्र्, की सीमय से धव र्जर् क्षेत्र को घयटयप्रभय पक्षी अभर्यरण्र्, पयररध थधर्क संवेिी जोन (धजसे इसमें इसके पश् चयर्प पयररध थधर्क संवेिी जोन कहय गर्य हज) के रूप में अधिसूधचर् करर्ी हज, धजसकय धववरण धनम्नयनुसयर हज, अथयार्प :--
1. पयररधथधर्क संविेी जोन कय धवर्यर और उसकी सीमयएं--(1) पयररधथधर्क संवेिी जोन उत् र्र अक्षयंि उ.160 10’29.22 से 160 10’26.62 और पूवा िेियंर्र प.ू 740 48’49.32 से 740 48’44.62 के बीच र्थय उत् र्र अक्षयंि 160 11’11.36 से 160 11’06.88 र्क और पूवा िेियंर्र 740 41’28.08 से 740 41’33.15 के बीच ध थर् हज और घयटयप्रभय पक्षी अभर्यरण्र् की आसपयस की सीमय सधहर् 300 मीटर के 22.66 वगा दक लोमीटर र्क के क्षेत्र में फज लय हज और ऐसे जोन कय सीमय वणान उपयबिं I में दिर्य गर्य हज ।
(2) अक्षयंि और िेियन्द्र्र के सयथ पयररधथधर्क संवेिी जोन की सीमय कय मयनधचत्र उपयबिं II के रुप में उपयबह हज ।
(3) घयटयप्रभय पक्षी अभर्यरण्र् की सीमय और पयररधथधर्क संवेिी जोन की सीमय की सीमय के प्रमुख नबंिओुं के भू- धनिेियंक उपयबिं III के रुप में उपयबह हज ।
(4) पयररधथधर्क संवेिी जोन के अंर्गार् आने वयल ेग्रयमों और आरधक्षर् वन क्षेत्रों की सूची उपयबिं IV में िी गई हज ।
2. पयररधथधर्क संविेी जोन के धलए आचंधलक महयर्ोजनय – 1. रयज्र् सरकयर, पयररधथधर्क संवेिी जोन के धलए रयजपत्र में अंधर्म अधिसूचनय के प्रकयिन की र्यरीख से िो व्ा की अवधि के भीर्र, थयनीर् व्यधिर्ों के परयमिा से और इस अधिसूचनय में संलग् न अनुबंिों के सयमंज र् से आंचधलक महयर्ोजनय र्जर्यर करेगी ।
2. रयज्र् सरकयर द्वयरय पयररध थधर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय इस र्रह, इस अधिसूचनय में धवधनदििा ट रूप र्थय सुसंगर् कें रीर् और रयज् र् धवधिर्ों के सयमंज र् और कें रीर् सरकयर द्वयरय जयरी मयगाधनिेिों, र्दि कोई हों, द्वयरय र्जर्यर होगी ।
3. आंचधलक महयर्ोजनय, पर्यावरण और पयररधथधर्क धवचयरों को समयकधलर् करन े के धलए रयज् र् सरकयर के सभी संबह धवभयगों के परयमिा से र्जर्यर होगी, अथयार्प:-- i. पर्यावरण;
ii. वन और वन्द्र्जीव;
iii. कज ध् ;
II (ii) 3 iv. रयज व;
v. नगर धवकयस;
vi. पर्ाटन;
vii. ग्रयमीण धवकयस;
viii. नसंचयई और बयढ़ धनर्ंत्रण;
ix. नगरपयधलकय;
x. पंचयर्र्ी रयज;
xi. लोक धन मयाण धव भयग।
4. आंचधलक महयर्ोजनय अनुमोदिर् धवयारमयन भू-उपर्ोग, अवसंरचनय और दिर्यकलयपों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय में धवधनदििा ट न हो और आचंधलक महयर्ोजनय सभी अवसंरचनय और दिर्यकलयपों में और अधिक िक्षर्य और पयररधथधर्क अनुकूलर्य कय संविान करेगी ।
5. आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षेत्रों के जीणोहयर, धवयारमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबंिन, भूर्ल जल के प्रबंिन, मजिय और नमी संरक्षण, थयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधथधर्क और पर्यावरण से संबंधिर् ऐसे अन्द्र् पहलओूं, धजन पर ध्र्यन िेनय आवश्र्क हज, के धलए उपबंि होंगे ।
6. आंचधलक महयर्ोजनय सभी धवयारमयन पूजय थलों, ग्रयमों और नगरीर् बंिोबर्ों, वनों के प्रकयर और दक मों, कज ध् क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षते्र जजसे उयारयन और उसी प्रकयर के थयन, उयारयन कज ध् के्षत्र, फलोउयारयन, झीलों और अन्द्र् जल धनकयर्ों कय अभ्र्कंन करेगी और इस र्ोजनय के मयनधचत्र द्वयरय धवयारमयन और प्रर्यधवर् भूधम के उपर्ोग कय धववरण दकर्य जयएगय ।
7. आंचधलक महयर्ोजनय पयररधथधर्क संवेिी जोन में धवकयस को धवधनर्धमर् करेगी और सयरणी में सूचीबह प्रधर्ध्ह, धवधनर्धमर् दिर्यकलयपों कय पयलन करेगी र्थय थयनीर् समुियर्ों की आजीधवकय सुरक्षय के धलए, पयररधथधर्क अनुकूल धवकयस सुधनधश् चर् करेगी र्थय संवर्िार् करेगी।
8. आंचधलक महयर्ोजनय क्षेत्रीर् धवकयस र्ोजनय के सयथ सह-अंर्क होगी ।
9. आंचधलक महयर्ोजनय इस अधिसूचनय में दिए गए उपबंिों के संबंि में अपने कयर्ों के बयहर ले जयने के धलए धनगरयनी सधमधर् के धलए एक संिभा िर्यवेज र्जर्यर करेगी ।
3. रयज्र् सरकयर द्वयरय दकए जयन े वयल े उपयर्-- रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करने के धलए धनम्नधलधखर् उपयर् करेगी, अथयार्प:--
(1) भू-उपर्ोग – (क) पयररध थधर्क संवेिी जोन में वनों, उयारयन-कज ध् क्षेत्रों, कज ध् क्षेत्रों, आमोि-प्रमोि के प्रर्ोजन के धलए धचधन्द्हर् दकए गए पयकों और खुल े थयनों कय वयधणधज्र्क और औयारोधगक संबह धवकयस दिर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय।:
परंर् ुपयररधथधर्क संवेिी जोन के भीर्र कज ध् भूधम कय संपररवर्ान धनगरयनी सधमधर् की धसफयररि पर और रयज्र् सरकयर के पूवा अनुमोिन से, क्षेत्रीर् नगर र्ोजनय अधिधनर्म के र्हर् सक्षम प्रयधिकयरी के पूवा अनमुोिन के सयथ और केन्द्रीर्/रयज्र् सरकयर के अन्द्र् धनर्मों और धवधनर्मों के रूप में लयगू होंग,े जो थयनीर् धनवयधसर्ों की आवयसीर् जरूरर्ों को पूरय करन ेके धलए हज, जजसे:-
(i) धवयारमयन सड़कों को चौड़य करनय और उन्द्हें सुिजढ करनय र्थय नई सड़कों कय संधनमयाण;
(ii) बुधनर्यिी ढयंचों और नयगररक सुधवियओं कय संधनमयाण और नवीकरण;
(iii) प्रिू् ण उत्पन्न न करने वयल ेलघ ुउयारोग;
(iv) कुटीर उयारोगों धजसके अंर्गार् ग्रयमीण कयरीगर हैं; सुधवियजनक भण्डयर और थयनीर् सुधवियओं सहयर्क पयररधथधर्क पर्ाटन में सधम्मधलर् गजह वयस; और
(v) संवर्िार् दिर्यकलयप और अनुच्छेि 4 के अंर्गार् दिर्य गर्य हज:
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंर् ुर्ह और भी दक क्षेत्रीर् नगर र्ोजनय अधिधनर्म और अन्द्र् धनर्मों और धवधनर्मों के अंर्गार् रयज्र् सरकयर के पूवा अनुमोिन र्थय संधवियन के अनचु्छेि 244 और र्त्समर् प्रवज मे धवधि के उपबंिों के अनुपयलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्द्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्द्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी हज, वयधणधज्र्क र्य उयारोग धवकयस दिर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय:
परंर् ुर्ह और भी दक पयररध थधर्क संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई तु्ररट, धनगरयनी सधमधर् के धवचयर प्रयि करन ेके पश्चयर्प रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमले में एक बयर संिोधिर् होगी और उि तु्ररट के संिोिन की सूचनय कें रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को िेनी होगी :
परंर् ुर्ह और भी दक उपर्ुाि तु्ररट कय संिोिन में इस उप पजरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी ििय में भू- उपर्ोग कय पररवर्ान सधम्मधलर् नहीं होगय । (ख) धजससे हररर् क्षेत्र में जजसे वन क्षेत्र, कज ध् क्षेत्र आदि में कोई पयररणयधमक कटौर्ी नहीं होगी और अनप्रर्ुक् र् र्य अनुत् पयिक कज ध् क्षेत्रों में पनु: वनीकरण करने के प्रर्यस दकए जयएंग े।
(2) प्रयकज धर्क जल स्रोर् -- आचंधलक महयर्ोजनय में सभी प्रयकज धर्क जल स्रोर्ों र्य नदिर्ों र्य जलसरणी की पहचयन की जयएगी और उसमें उनके संरक्षण और पुनरुद्भूर्करण के धलए र्ोजनय सधम् मधलर् होगी ।
(3) पर्ाटन/पयररधथधर्क पर्ाटन – (क) पयररधथधर्क संवेिी जोन के भीर्र सभी नए पयररधथधर्क पर्ाटन दिर्यकलयप र्य धवयारमयन पर्ाटन संबंिी दिर्यकलयप पयररधथधर्क संवेिी जोन के धलए पर्ाटन महयर्ोजनय के अनुसयर होंगे । (ख) पयररधथधर्क पर्ाटन महयर्ोजनय पर्ाटन धवभयग, द्वयरय रयज्र् सरकयर के पर्यावरण और वन धवभयग के परयमिा से र्जर्यर होगी । (ग) पर्ाटन महयर्ोजनय आंचधलक महयर्ोजनय के एक घटक के रूप में होगी । (घ) पयररधथधर्क पर्ाटन संबंिी दिर्यकलयप धनम् नधलधखर् के अिीन धवधनर्धमर् होंगे, अथयार्प :-
(i) वन्द्र्जीव अभर्रयण्र् की सीमय से एक दकलोमीटर के भीर्र र्य पयररधथधर्क संवेिी जोन के धवर्यर र्क, जो भी धनकट हो, दकसी होटल र्य ररसोटा कय नर्य संधन्नमयाण अनुज्ञयर् नहीं दकर्य जयएगय । र्थयधप, वन्द्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीटर की िरूी से परे पयररधथधर्क संवेिी जोन के धवर्यर र्क नए होटलों और ररसोटों की थयपनय पर्ाटन महयर्ोजनय के अनुसयर पयररधथधर्क पर्ाटन सुधवियओं के धलए पूवा सीमयंदकर् और पियधभधहर् क्षेत्रों में ही अनुज्ञयर् की जयएगी।
(ii) पयररधथधर्क संवेिी जोन के अन्द्िर सभी नए पर्ाटन दिर्य-कलयप र्य धवयारमयन पर्ाटन दिर्यकलयपों के धवर्यर केन्द्रीर् सरकयर, पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् द्वयरय जयरी मयगाििआ धसहयंर्ों र्थय पयररधथधर्क पर्ाटन पर बल िरे्े हुए रयष्ट्रीर् बयघ संरक्षण प्रयधिकरण द्वयरय जयरी पयररधथधर्क पर्ाटन मयगाििआ धसहयंर्ों (समर्- समर् पर र्थय-संिोधिर्) के अनुसयर होगय ।
(iii) जब र्क आंचधलक महयर्ोजनय कय अनुमोिन नहीं कर दिर्य जयर्य हज जब र्क पर्ाटन संबंिी धवकयस र्थय धवयारमयन पर्ाटन दिर्यकलयपों कय धवर्यर धनगरयनी सधमधर् के वयर्धवक थल धवधनदििाष्ट संवीक्षय र्थय धसफयररि के आियर पर सम्बंधिर् धवधनर्यमक प्रयधिकयरी द्वयरय अनजु्ञयर् दकर्य जयएगय और पयररधथधर्क संवेिी जोन क्षेत्र के भीर्र कोई नर्य होटल/ररसयटा र्य वयधणधज्र्क थयपन कय संधन्नमयाण अनुज्ञयर् नहीं दकर्य जयर्य हज ।
(4) नजसर्गाक धवरयसर् -- पयररधथधर्क संवेिी जोन में महत्वपूणा नजसर्गाक धवरयसर् के सभी थलों जजसे सभी जीन कोि आरधक्षर् के्षत्र, िजल धवरचनयएं, जल प्रपयर्ों, झरनों, घयटी मयगों, उपवनों, गुफयए,ं थलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और धवरयसर् संरक्षण र्ोजनय आंचधलक महयर्ोजनय के भयग के रुप में परररक्षण और संरक्षण के धलए र्जर्यर की जयएगी ।
(5) मयनव धनर्मार् धवरयसर् थल - पयररध थधर्क संवेिी जोन में भवनों, संरचनयओं, धिल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंकज धर्क महत्व के क्षेत्रों की पहचयन और उनके संरक्षण के धलए धवरयसर् र्ोजनय आंचधलक महयर्ोजनय के भयग के रुप में र्जर्यर की जयएगी । II (ii) 5
(6) ध् वधन प्रिू् ण -- पयररधथधर्क संवेिी जोन में ध् वधन प्रिू् ण की धनवयरण और धनर्ंत्रण कय ध्वधन पर्यावरण (संरक्षण) अधिधनर्म, 1986, और उसमें दकए गए संिोिनों के अिीन प्रिू् ण (धवधनर्मन और धनर्ंत्रण) धनर्मों 2000 के अनुसयर अनुपयलन दकर्य जयएगय ।
(7) वयर् ुप्रिू् ण -- पयररधथधर्क संवेिी जोन में, वयर् ुप्रिू् ण की रोकथयम और धनर्ंत्रण वयर्ु (प्रिू् ण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) के उपबंिों और उसके अिीन बनयए गए धनर्मों और उनमें दकए गए संिोिनों के अनुसयर अनुपयलन दकर्य जयएगय ।
(8) बधहस्रयव कय धनसयरण -- पयररधथधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनसयरण, सयियरणों मयनकों के अन्द्र्गार् पर्यावरण (संरक्षण) अधिधनर्म, 1986 और उसके अिीन बनयए गए धनर्मों के अिीन आने वयले पर्यावरण प्रिू् ण के धनसयरण के धलए सयियरण मयनकों र्य रयज्र् सरकयर द्वयरय धनर्र् मयनकों, जो भी अधिक कठोर हो, के उपबंिों के अनुसयर होगय।
(9) ठोस अपधिष्ट -- ठोस अपधिष्टों कय धनपटयन और प्रबंिन धनम्नधलधखर् रूप में होगय-- (क) पयररधथधर्क संवेिी जोन में ठोस अपधिष्ट धनपटयन और प्रबंिन ठोस अपधि ट प्रबंिन धनर्म, 2016, जो भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय.आ. 1357(अ) र्यरीख 8 अप्रजल, 2016 द्वयरय प्रकयधिर् दकए गए थ,े के उपबंिों के अनुसयर दकर्य जयएगय ;
(ख) अकयबाधनक सयमग्री कय धनपटयन पयररधथधर्क संवेिी जोन के बयहर पहचयन दकए गए थल पर दकसी पर्यावरण वीकज र् रीधर् में होगय;
(ग) पयररधथधर्क संवेिी जोन में ठोस अपधि टों को जलयनय र्य भमीकरण और भूधम भरयव के थयपनों को अनुज्ञयर् नहीं दकर्य जयएगय ।
(10) जजव धचदकत् सीर् अपधि ट- जजव धचदकत् सीर् अपधि ट प्रबंिन धनम्नधलधखर् रूप में होगय— (क) पयररधथधर्क संवेिी जोन में जजव धचदकत्सीर् अपधिष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 343 (अ) र्यरीख 28 मयचा 2016 द्वयरय प्रकयधिर् जजव धचदकत्सीर् अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय । (ख) पयररधथधर्क संवेिी जोन में कोई सयमयन्द्र् उपचयर सुधविय र्य भमीकरण अनुज्ञयर् नहीं दकर्य जयएगय ।
(11) प्लयधटक अपधिष्ट प्रबिंन: - पयररधथधर्क संवेिी जोन में प्लयधटक अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सय.कय.धन 340(अ), र्यरीख 18 मयचा, 2016 द्वयरय प्रकयधिर् प्लयधटक अपधिष्ट प्रबंि धनर्म 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(12) सधंनमयाण और धवध्वसं अपधिष्ट प्रबिंन: - पयररधथधर्क संवेिी जोन में संधनमयाण और धवध्वंस अपधिष्ट प्रबंि भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सय.कय.धन 317(अ), र्यरीख 29 मयचा, 2016 द्वयरय प्रकयधिर् संधनमयाण और धवध्वंस प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ।
(13) ई–अपधिष्ट:- पयररधथधर्क संवेिी जोन में ई–अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् द्वयरय ई–अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(14) र्यनीर् पररवहन: - पररवहन की र्यनीर् गधर्धवधिर्यं आवयस के अनुकूल धवधनर्धमर् होंगी और इस संबंि में आंचधलक महयर्ोजनय में धविे् उपबंि अधिकधथर् दकए जयएंग ेऔर आंचधलक महयर्ोजनय के र्जर्यर होने और रयज्र् सरकयर के सक्षम प्रयधिकयरी द्वयरय के अनुमोदिर् होने र्क, धनगरयनी सधमधर् प्रवज मे धनर्मों और धवधनर्मों के अनुसयर र्यनीर् गधर्धवधिर्ों के अनुपयलन को धनगरयनी करेगी । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(15) र्यनीर् प्रिू् ण:- लयग ूधवधिर्ों के अनुसयर वयहन प्रिू् ण की रोकथयम और धनर्ंत्रण कय अनुपयलन दकर्य जयएगय। वच्छक ईंिन के उपर्ोग के धलए दकए गए प्रर्यस उियहरण के धलए सीएनजी, एलपीजी, आदि हैं ।
(16) औयारोधगक ईकयइर्य:ं - (i) सरकयरी रयजपत्र में इस अधिसूचनय के प्रकयिन के बयि र्य प्रकयिन में, पयररधथधर्क संवेिी जोन के भीर्र कोई नए प्रिधू्र् उयारोगों की थयपनय की अनजु्ञय नहीं िी जयएगी।
(ii) पयररधथधर्क संवेिी जोन के कें रीर् प्रिू् ण धनर्ंत्रण बोडा द्वयरय जयरी दिियधनिेिों में फरवरी, 2016 के भीर्र धसफा गजर- प्रिधू्र् उयारोगों की थयपनय के वगआकरण की अनुमधर् िी जयएगी, जब र्क दक इस अधिसूचनय में धवधनदििाष्ट न हो। इसके अलयवय, गजर-प्रिधू्र् कुटीर उयारोगों को प्रधर्ध्ह दकर्य जयएगय।
(17) पहयड़ी ढलयनों को सरंक्षण: - पहयड़ी ढलयनों के संरक्षण के अंर्गार्:
(क) आंचधलक महयर्ोजनय पहयड़ी ढलयनों पर क्षेत्रों कय संकेर् होगय जहयं दकसी भी संधनमयाण की अनुज्ञय नहीं िी जयएगी। (ख) कटयव के एक उच्च धडग्री के सयथ धवयारमयन खड़ी पहयड़ी ढलयनों र्य ढलयनों पर दकसी भी संधनमयाण की अनुमधर् नहीं िी जयएगी ।
(18) अगर र्ह आवश्र्क समझर्य हज, इस अधिसूचनय के उपयबंिों को प्रभयवी करन ेमें केन्द्र सरकयर और रयज्र् सरकयर, अन्द्र् उपयर्ों धनदििाष्ट करेगय।
4. पयररधथधर्क संविेी जोन में प्रधर्ध्ह और धवधनर्धमर् दकए जयन ेवयल ेदिर्यकलयपों की सचूी - पयररधथधर्क संवेिी जोन में सभी दिर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) के उपबंिों और र्टीर् धवधनर्मन जोन (सीआरजेड), 2011 और पर्यावरण प्रभयव आकलन (ईआईए ) अधिसूचनय, 2006 और वन (संरक्षण) अधिधनर्म, 1980 (1980 के 69), भयरर्ीर् वन अधिधनर्म, 1927 (1927 के 16), वन्द्र्जीव (संरक्षण) अधिधनर्म, 1972 (1972 के 53) संिोिनों सधहर् द्वयरय ियधसर् होंगे और नीचे िी गई सयरणी में धवधनदििाष्ट रीधर् में धवधनर्धमर् होंगे, अथयार्प :-- सयरणी िम स.ं दिर्यकलयप रटप्पणी

1995 कय 202 टी.एन. गोनवंिरयमन धथरुमूलपयि बनयम भयरर् सरकयर के मयमल े में आिेि र्यरीख 4 अगर्, 2006 और ररट र्यधचकय (सी) सं. 2012 कय 435 गोवय फयउंडेिन बनयम भयरर् सरकयर के मयमल ेमें र्यरीख 21 अप्रजल, 2014 के अंर्ररम आिेि के कठोर अनुसरण कय प्रचयलन होगय ।
2. प्रिू् ण जल र्य वयर्ु र्य मजिय र्य ध् वधन कयररर् करन ेवयले उयारोगों की थयपनय । कोई नर्य उयारोग र्य पयररधथधर्क संवेिी जोन में प्रिू् ण फज लयने वयल े उयारोगों के धवर्यर की अनजु्ञय नहीं िी जयएगी। पयररधथधर्क संवेिी जोन के भीर्र कें रीर् प्रिू् ण धनर्ंत्रण बोडा द्वयरय फरवरी, 2016 में जयरी दिियधनिेिों में धसफा गजर- प्रिधू्र् उयारोगों को थयपनय के अनुसयर अनजु्ञयर् दकर्य जयएगय, जब र्क दक इस II (ii) 7 अधिसूचनय में इस प्रकयर धवधनदििाष्ट न हो।
3. बजहर् जल धवयुारर् पररर्ोजनय की थयपनय । लयग ूधवधिर्ों के अनुसयर प्रधर्ध्ह (अन्द् र्थय उपबंधिर् के धसवयर्) होंगे ।
4. दकसी पररसंकटमर् पियथों कय उपर्ोग र्य उत्पयिन र्य प्रसंकरण । लयग ूधवधिर्ों के अनुसयर प्रधर्ध्ह (अन्द् र्थय उपबंधिर् के धसवयर्) होंगे ।
5. प्रयकज धर्क जल धनकयर्ों र्य सर्ही के्षत्र में अनुपचयररर् बधहस्रयाव और ठोस अपधिष्टों कय धनसयरण । लयग ूधवधिर्ों के अनुसयर प्रधर्ध्ह (अन्द् र्थय उपबंधिर् के धसवयर्) होंगे ।
6. ठोस अपधिष्ट धनपटयन थल और ठोस और जजव धचदकत्सय अपधिष्ट के धलए सयमयन्द्र् भमीकरण की सुधविय की थयपनय। पयररधथधर्क संवेिी जोन के भीर्र कोई नई ठोस अपधिष्ट धनपटयन थल र्थय ठोस अपधिष्ट और अपधिष्ट उपचयर/प्रसंकरण सुधविय की अनुज्ञय नहीं हज। इसके अधर्ररि औयारोधगक प्रदिर्य और वयथ्र् प्रधर्ष्ठयन/अपर्यलों आदि से उत्पन्न दकसी भी ठोस अपधिष्ट के उपचयर के धलए सयमयन्द्र् र्य व्यधिगर् भमीकरण की सुधविय कय संथयपन प्रधर्ध्ह हज।
7. फमों, कॉपोरेट, कंपधनर्ों द्वयरय बडे़ पजमयने पर वयधणधज्र्क पििुन संपिय और कुक्कुट फयमों की थयपनय । थयनीर् जरूरर्ों को परूय करने के धसवयर् लयग ूधवधिर्ों के अनुसयर प्रधर्ध्ह (अन्द् र्थय उपबंधिर् के धसवयर्) होंगे।
8. नई आरय धमलों की थयपनय। पयररधथधर्क संवेिी जोन के भीर्र नई र्य धवयारमयन आरय धमलों कय धव र्यर अनुज्ञयर् नहीं होगय ।
9. ईंट भट्टों की थयपनय करनय। लयगू धवधिर्ों के अनुसयर प्रधर्ध्ह (अन्द् र्थय उपबंधिर् के धसवयर्) होंगे ।
10. जलयवन लकड़ी कय वयधणधज्र्क उपर्ोग। लयगू धवधिर्ों के अनुसयर प्रधर्ध्ह (अन्द् र्थय उपबंधिर् के धसवयर्) होंगे ।
11. पवन धमलों और मोबयइल टॉवर कय धनमयाण लयगू धवधिर्ों के अनुसयर प्रधर्ध्ह (अन्द् र्थय उपबंधिर् के धसवयर्) होंगे ।
12. मत्र् पयलन। लयगू धवधिर्ों के अनुसयर प्रधर्ध्ह (अन्द् र्थय उपबंधिर् के धसवयर्) होंगे । ख. धवधनर्धमर् दिर्यकलयप
13. होटलों और ररसोटों कय थयपन । पयररधथधर्क अनुकूल पर्ाटन दिर्यकलयप से संबंधिर् पर्ाटकों को अथयर्ी अधिभोग के धलए वयस सुधविय के धसवयर् संरधक्षर् क्षेत्र सीमय के एक दकलोमीटर के भीर्र कोई नर्य वयधणधज्र्क होटल और ररसोटा अनुज्ञयर् नहीं होंगे :
परन्द्र् ु वन्द्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीटर से परे और पयररधथधर्क संवेिी जोन के धवर्यर र्क सभी नए पर्ाटन दिर्यकलयपों र्य धवयारमयन दिर्यकलयपों कय धवर्यर पर्ाटन महयर्ोजनय के अनरुुप होगय ।
14. संधनमयाण दिर्यकलयप । (क) संरधक्षर् क्षेत्र र्य पयररधथधर्क संवेिी जोन जो भी धनकट हो, की सीमय से एक दकलोमीटर के भीर्र दकसी भी प्रकयर कय वयधणधज्र्क संधनमयाण अनजु्ञयर् नहीं दकर्य जयएगय:
परंर्ु थयनीर् लोगों को पजरय 3 के उप पजरय (1) में सूचीबह दिर्यकलयपों सधहर् उनके आवयसीर् उपर्ोग के धलए उनकी भूधम में संधनमयाण करन ेकी अनुज्ञय भवन उपधवधिर्ों के अनुसयर िी जयएगी ।
(i) धवयारमयन सड़कों को चौड़य करनय और उन्द्हें सुिजढ करनय र्थय नई सड़कों कय संधनमयाण;

(ii) बुधनर्यिी ढयंचों और नयगररक सुधवियओं कय संधनमयाण और नवीकरण;
(iii) कें रीर् प्रिू् ण धनर्ंत्रण बोडा द्वयरय जयरी दिियधनिेिों में फरवरी, 2016 के भीर्र केवल गजर- प्रिधू्र् उयारोगों की थयपनय के वगआकरण;
(iv) कुटीर उयारोगों धजसके अरं्गार् ग्रयमीण उयारोग हैं; सुधवियजनक भण्डयर और थयनीर् सुख सुधवियओं जो पयररधथधर्क पर्ाटन धजस में सहयर्क हो गजह वयस; और
(v) इस अधिसूचनय में संवर्िार् दिर्यकलयपों की सूची :
परन्द्र् ुऐसे लघु उयारोगों जो प्रिू् ण उत् पन्द् न नहीं करर् ेहैं, से संबंधिर् संधनमयाण दिर्यकलयप धवधनर्धमर् दकए जयएगंे और लयग ूधनर्मों और धवधनर्मों, र्दि कोई हों, के अनुसयर सक्षम प्रयधिकयरी की पूवा अनुमधर् से ही न्द् र्ूनर्म पर रखे जयएंगे । (ख) एक दकलोमीटर से आग े आंचधलक महयर्ोजनय की अनुसयर धवधनर्धमर् होंगे ।
15. प्रिू् ण उत्पन्न न करन ेवयले लघु उयारोग । फरवरी, 2016 में केन्द्रीर् प्रिू् ण धनर्ंत्रण बोडा द्वयरय जयरी उयारोगों में वगआकरण के अनुसयर गजर-प्रिू् णकयरी उयारोग और अपररसकंट में, लघ ु और सेवय उयारोग, कज ध्, पुप कज ध्, उयारयन कज ध् र्य पयररधथधर्क संवेिी जोन से िेिी सयमग्री से उत्पयिों को उत्पन्न करन े वयले कज ध् आियररर् उयारोग सक्षम प्रयधिकयरी द्वयरय अनजु्ञयर् होंगे।
16. वजक्षों की कटयई । (क) रयज्र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनुज्ञय के धबनय वन, सरकयरी र्य रयजव र्य धनजी भूधम पर वजक्षों की कोई कटयई नहीं होगी । (ख) वजक्षों की कटयई संबंधिर् कें रीर् र्य रयज्र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंि के अनुसयर धवधनर्धमर् होगी ।
17. वन उत्पयिों और गजर कय ठ वन उत्पयिों कय संग्रहण (एनटीएफपी) । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
18. धवयुारर् और िरूसंचयर टयवरों कय पररधनमयाण और केबल धबछयनय और अन्द्र् बुधनर्यिी ढयंचे । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । भूधमगर् केबल धबछयए जयने को बढ़यवय दिर्य जयएगय।
19. नयगररक सुख सुधवियओं सधहर् बुधनर्यिी ढयंचे। लयग ूधवधिर्ों धनर्मों और धवधनर्मों मयगाििाक धसहयंर्ों के अनुसयर न्द्र्ूनीकरण की उपयर्ों के सयथ, और उपलब्ि दकए जयएंगे ।
20. धवयारमयन सड़कों को चौड़य करनय और उन्द्हें सुिजढ करनय र्थय नई सड़कों कय संधन्नमयाण । लयग ूधवधिर्ों धनर्मों और धवधनर्मों मयगाििाक धसहयंर्ों के अनुसयर न्द्र्ूनीकरण की उपयर्ों के सयथ, और उपलब्ि दकए जयएंगे ।
21. पर्ाटन से संबंधिर् दिर्यकलयप करनय जजसे गमा वयर्ु गुब्बयरें, हलेीकयप्टर, ड्रोन, मयइिोलयइटस आदि द्वयरय पयररधथधर्क संवेिी जोन क्षेत्र के ऊपर से उड़नय लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
22. पहयड़ी ढयलों और निी र्टों कय संरक्षण । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
23. रयधत्र में र्यनीर् र्यर्यर्यर् कय संचलन । लयगू धवधिर्ों के अिीन वयधणधज्र्क प्रर्ोजन के धलए धवधनर्धमर् II (ii) 9 होंगे।
24. थयनीर् समुियर्ों द्वयरय चलयई जय रही कज ध् और बयगवयनी प्रथयओं के सयथ पिुपयलन, पिुपयलन कज ध्, जलकज ध् और मछली पयलन । थयनीर् लोगों के उपर्ोग के धलए लयग ू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
25. प्रयकज धर्क जल धनकयर्ों र्य सर्ही के्षत्र में उपचयररर् अपधिष्ट जल/बधहस्रयाव कय धनसयरण । उपचयररर् अपधिष्ट जल/बधहस्रयाव कय धनसयरण को जल धनकयर्ों में प्रवेि नहीं करने दिर्य जयएगय। अन्द्र्थय लयगू धवधिर्ों के अनुसयर उपचयररर् जल बधहस्रयाव कय धनसयरण धवधनर्धमर् दकर्य जयएगय।
26. सर्ह और भूजल कय वयधणधज्र्क धनक्ाण । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
27. खुले कुआ, बोर कुआ, आदि के धलए कज ध् और अन्द्र् उपर्ोग । धवधनर्धमर् और समुधचर् प्रयधिकयरी द्वयरय दिर्यकलयपों की सखर्ी से धनगरयनी की जयएगी।
28. ठोस अपधि ट प्रबंिन। लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
29. धविेिी प्रजयधर्र्ों को लयनय । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
30. पयररधथधर्क-पर्ाटन। लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
31. पोधलथीन बजगों कय उपर्ोग । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।

6. धनिेि - धनबिंन
(1) पयररधथधर्क संवेिी जोन सधमधर् इस अधिसूचनय के उपबंिों के अनुपयलन को मयनीटर करेगी।
(2) पयररधथधर्क संवेिी जोन में भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ.
1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अनुसूची में के अिीन सधम्मधलर् दिर्यकलयपों और इस अधिसूचनय के पजरय 4 के अिीन प्रधर्ध्ह गधर्धवधिर्ों के धसवयर् आन े वयल ेऐसे दिर्यकलयपों की ििय में वयर्धवक धवधनदििाष्ट थलीर् िियओं पर आियररर् धनगरयनी सधमधर् द्वयरय संवीक्षय की जयएगी और उि अधिसूचनय के उपबंिों के अिीन पूवा पर्यावरण धनकयसी के धलए केन्द्रीर् सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् को धनदििाष्ट की जयएगी ।
(3) इस अधिसूचनय के पजरय 4 के अिीन र्थय धवधनदििाष्ट प्रधर्ध्ह दिर्यकलयपों के धसवयर्, भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय संखर्यंक कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अधिसूचनय के अनुसूची के अिीन ऐसे दिर्यकलयपों, धजन्द्हें सधम्मधलर् नहीं दकर्य गर्य हज, परंर् ुपयररधथधर्क संवेिी जोन में आर् ेहैं, ऐसे दिर्यकलयपों की वयर्धवक धवधनदििाष्ट थलीर् िियओं पर आियररर् धनगरयनी सधमधर् द्वयरय संवीक्षय की जयएगी और उसे संबह धवधनर्यमक प्रयधिकरणों को धनदििाष्ट दकर्य जयएगय ।
(4) धनगरयनी सधमधर् कय सिर्-सधचव र्य संबह उपयर्ुक् र्, ऐसे व्यधि के धवरूह, जो इस अधिसूचनय के दकसी उपबंि कय उल्लघंन करर्य हज, पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 19 के अिीन पररवयि फयइल करन े के धलए सक्षम होगय ।
(5) धनगरयनी सधमधर् मुद्दय िर मुद्दय के आियर पर अपेक्षयओं पर धनभार रहर् ेहुए संबह धवभयगों के प्रधर्धनधिर्ों र्य धविे्ज्ञों, औयारोधगक संगमों र्य संबह पणियररर्ों के प्रधर्धनधिर्ों को अपन ेधवचयर-धवमिा में सहयर्र्य के धलए आमंधत्रर् कर सकेगी ।
(6) धनगरयनी सधमधर् प्रत्र्ेक व्ा की 31 मयचा र्क की अपनी वयर््ाक कयरावयई ररपोटा रयज्र् के मुखर् जीव वयडान उपयबिं V में उपबंधिर् रूप धवियन के अनुसयर उक् र् व्ा के 30 जून र्क प्रर्रु् करेगी ।

8. कोई अन्द् र् महत् वपूणा धव्र् । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 27th June, 2017 S.O. 2029(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3550(E), dated the 30th December, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, objections and suggestions received from persons and stakeholders in response to the draft notification duly considered by the Central government;
And whereas, Ghataprabha Bird Sanctuary notified vide Government of Karnataka Notification No. FEE 58FWL 96 dated 8.7.1999 and situated in Gokak and Hukkeri Taluks of Belgaum District in the State of Karnataka is spread over an area of 29.875 square kilometers;
And whereas, it is a small bird sanctuary comprising a section of Ghataprabha River and over 22 islands in it and a weir and dam constructed during 1883 near Dhupadal have created a reservoir upstream with a large island in its midst and the Gokak waterfalls located in the eastern part of the Sanctuary is the major tourist attraction;
And whereas, the island surrounded by water throughout the year except few days in March, connected with good network of rail and road attracts many tourists, bird watchers, school children and it gives good opportunity to create awareness among public regarding wildlife to be specific in avifauna and it is a good example of riverine ecosystem;
And whereas, most of the islands that comprise the sanctuary are barren and dry and one of them at western side of Dhupadal Lake is swampy and another has a good growth of Acacia arabica, Pithecollobium dulce and Bambusa arundianaecia, both being introduced species and Acacia arabica and Imperate cylindrica are considered of special interest, as they are good for nesting. Apart from harboring endemic birds like little cormorant (Phylacrocorox niger), Egret(Egretta garzette and Ardeola alba), Ibis(Theskiomis melonacphale), King fisher(Theskiomis melonacphale), Storks (Ciconiidae), Snake birds (Anhinga anhinga), Heron (Ardeidae)etc., the area is noted for having attracted migratory birds like Demoiselle Crane (Grus virgo) and European White Stork (Ciconia ciconia) which have been sighted normally from November to March;
And whereas, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Ghataprabha Bird Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
Now therefore, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of Ghataprabha Bird Sanctuary in the State of Karnataka as the Ghataprabha Bird Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.—(1) The Eco-sensitive Zone lies between the North Latitudes N 16º 10’29.22 to 16º 10’26.62 and East longitudes between E 74º 48’49.32’ E to 74º 48’44.62 and North Latitudes N 16º 11’11.36 N to 16º 11’06.88 and East longitudes between E 74º 41’28.08 to 74º 41’33.15 and spread over an geographical area of 22.66 square kilometers with an extent of 300 meters all around the boundary of Ghataprabha Bird Sanctuary and the boundary description of such Zone is given in Annexure-I.
(2) The map of Eco-sensitive Zone boundary together with latitudes longitudes is appended as Annexure II.
(3) The Geo Coordinates of major points on the boundary of Ghataprabha Bird Sanctuary and on the boundary of Ecosensitive Zone boundary is appended as Annexure-III.

(4) The list of villages and the details of reserved forest areas falling within the Eco-sensitive Zone is given at Annexure- IV.
2. Zonal Master Plan for the Eco-sensitive Zone.-
1. The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
2. The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
3. The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department.
4. The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
5. The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
6. The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.
7. The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in the Table and also ensure and promote eco-friendly development for livelihood security of local communities.
8. The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
9. The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant State laws and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as.- II (ii) 17
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given under para 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant State laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.- The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/ Eco-tourism.-
(a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-tourism Master Plan shall be prepared by the Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism Guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on Eco-tourism.
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Ecosensitive Zone area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act,
1986.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.

(8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016.
(b) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone.
(c) No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- Bio medical waste management shall be as under.-
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016.
(b)No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016.
(13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.
(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.- The protection of hill slopes shall be as under:-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- II (ii) 19 TABLE S No Activity Description

1. Commercial Mining.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of Industries in the Guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification. 3. Establishment of major hydroelectric project.

5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within the Eco-sensitive Zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is prohibited.
7. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
10. Commercial use of fire wood. Prohibited (except as otherwise provided) as per applicable laws.
11. Erection of wind mills and mobile towers.
Prohibited (except as otherwise provided) as per applicable laws.
12. Fishing. Prohibited (except as otherwise provided) as per applicable laws.

13. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
14. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:-
(i) widening and strengthening of existing roads and construction of new roads.
(ii) construction and renovation of infrastructure and civic amenities.
(iii) small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016.
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and
(v) promoted activities listed in this Notification:
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
15. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
16. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
17. Collection of Forest produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws.
18. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law. Underground cabling may be promoted.

19. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
20. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
21. Under taking other activities related to tourism like over flying the ESZ area by hot air balloon, helicopter, drones, Microlites, etc.
Regulated under applicable law.
22. Protection of Hill Slopes and river banks.
Regulated under applicable laws.
23. Movement of vehicular traffic at night.
Regulated for commercial purpose under applicable laws.
24. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
25. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
26. Commercial extraction of surface and ground water Regulated under applicable law.
27. Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
28. Solid Waste Management. Regulated under applicable laws.
29. Introduction of Exotic species. Regulated under applicable laws.
30. Eco-tourism. Regulated under applicable laws.
31. Use of polythene bags. Regulated under applicable laws.
32. Commercial Sign boards and hoardings.
Regulated under applicable laws.
C. Promoted Activities
33. Rain water harvesting. Shall be actively promoted.
34. Organic farming. Shall be actively promoted.
35. Adoption of green technology for all activities.
Shall be actively promoted.
36. Cottage industries including village artisans, etc.
Shall be actively promoted.

5. Monitoring Committee.- (1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:-
(i) Regional Commissioner, Belagaavi –Chairman;
(ii) Hon’ble Member of Legislative Assembly, Arabhavi Constituency, Belagaavi District – Member;
(iii) Hon’ble Member of Legislative Assembly, Gokak Constituency, Belagaavi District – Member;
(iv) Hon’ble Member of Legislative Assembly, Hukkeri Constituency, Belagaavi District – Member;
(v) Representative of the Department of Environment, Government of Karnataka -Member;
(vi) Representative of the Department of Urban Development, Government of Karnataka -Member;
(vii) Representative of Non-governmental Organizations working in the field of natural conservation (including heritage conservation) to be nominated by the Government of Karnataka for three years-Member;
(viii) The Regional Officer, Karnataka State Pollution Control Board, Mysore -Member;
(ix) One expert in Ecology from reputed Institution or University of the State of Karnataka to be nominated by the Government of Karnataka for three years -Member.
(x) Deputy Commissioner or his representative, Belagaavi District –Member;
(xi) Member, State Biodiversity Board-Member
(xii)The Deputy Conservator of Forests, Ghataprabha Division, Gokak – Member-Secretary.
*(Subject to the State Government of Karnataka obtaining relevant approvals inter alia including permission from the Speaker of Legislative Assembly, Karnataka, if required)
6. Terms of Reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
38. Agro-Forestry. Shall be actively promoted.
39. Use of eco-friendly transport. Shall be actively promoted.
40. Skill Development. Shall be actively promoted.
41. Restoration of Degraded Land/ Forests/Habitat.
Shall be actively promoted.
42. Environmental Awareness. Shall be actively promoted.

(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-V.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.

The boundary line starts from the co-ordinate E 74° 40/13.0 N 16° 091 50.0 of Ghodgeri village of Hukkeri Taluk, Belgaum District. Then the line runs 300 meters paralell to the Ghataprabha Bird Sanctuary boundary through Ghodgeri, Konnur, Khanapur, Shingalapur, Godchinmalki, Gokak and Lolasur villages.
North and West:
Then from the above point, the line passes 300 meters parallel to the Ghataprabha Bird Sanctuary through Lolasur, Gokak, Shingalapur, Dhupadal, Shingalapur, Konnur, Shirdan & Sarapur villages of Hukkeri Taluk, Kotabagi, Shirgaon, Awargol, Naginhal Sulthanpur villages and then finally joins the starting point.
