और, उ᭍ त ᮧाᱨप अिधसूचना मᱶ अंतᳶव᭬ ट राजपᮢ, कᳱ ᮧितयां जनता को 7 जनवरी, 2016, को उपल᭣ध करा दी गई थᱭ;

और, पूवᲃᲦ ᮧाᱧप अिधसूचना के ᮧ᭜युᱫर मᱶ ᳞िᲦयᲂ और पणधाᳯरयᲂ से कोई आᭃेप और सुᭃाव ᮧा᳙ नहᱭ ᱟए है;ँ और, कनाᭅटक सरकार ᳇ारा अिधसूचना सं. एएफडी 58 एफड᭣ ᭨ यूएल 74, तारीख 17 जून, 1974 ᳇ारा अिधसूिचत रानेबे᳖ूर ᭣ लैकबक अभयार᭛य कनाᭅटक रा᭔ य के हावेरी िजला के हावेरी और ᭣ यादगी ता᭨ लुकᲂ के रानेबे᳖ूर मᱶ अवि᭭ थत ह ैऔर उ᭜ तर अᭃांश 140 34’ और 140 46’ तथा पूवᭅ दशेांतर 750 30’ और 750 47’ के म᭟य ह ैतथा 119 वगᭅ ᳰकलोमीटर ᭃेᮢफल तक फैला ᱟआ ह ैतथा ᭃेᮢ मु᭎ यत: झाड़ी वन और युकेिल᭡ टस पौधᲂ से ढंका ह ै। और, पेड़ पौधᲂ के अंतगᭅत अकेिशया कटेचू, ᮧोसोिपस जूलीफोरा, डोडोिनया िव᭭ कोसा, अकेिशया संᮟा, िजिजफस माᳯरिशिनया, रᱶिडया ᭭ पेिसया और केिसया ओᳯर᭍ युलेटा, केिसया ᳰफ᭭ टुला, नीम(अजािडरे᭍ टा इंिडका), 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] होलोपटेिलया इंटेिᮕफोिलया, मधुका इंिडका, ᳰफकस ᭭ पेिसया और बांस ह,ᱹ िजनको अभयार᭛य कᳱ सड़कᲂ के साथ रोपा गया ह;ै अभयार᭛य इसके ᭣ लकैबक और लोमड़ी जनसं᭎ या के िलए ᮧिस᳍ ह ᱹ तथा अ᭠ य ᭭ तनधाᳯरयᲂ के अंतगᭅत जंगली सूअर, लोमड़ी, िसयार, लंगूर, साही, सामा᭠ य नेवला, खरगोश और साल ह ै ; अभयार᭛य के ईरानीगु᲻ा ᭃेᮢ मᱶ लकड़ब᭏ घा भी पाए जाते ह;ᱹ अभयार᭛य कᳱ ᭭ थापना स े᭣ लैकबक कᳱ सं᭎ या मᱶ िनरंतर वृि᳍ दखेी गई ह ैऔर वषᭅ 2005 तक अभयार᭛य कᳱ छोटी घास वाले मैदानᲂ, एक बड़ा धावी पᭃी ᮕेट इंिडयन ब᭭ टडᭅ भी दखेा जाता था तथा ᮕेट इंिडयन ब᭭ टडᭅ कᳱ अितᳯर᭍ त अभयार᭛य मᱶ पᭃी-जीवᲂ के अंतगᭅत मोर, कोयल, ᮕे बे᭣ बलर, ᮲ाइक, ᭣ लैक ᮟᲂगो, भूरा तीतर, सᱶड ᮕोउज, बुश ᭍ वैल और बᱟत से अ᭠ य ह ᱹ। और, रानेबे᳖ूर ᭣ लैकबक अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाए ंइस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पाᳯरि᭭थितक और पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक सवेंदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, कनाᭅटक रा᭔ य मᱶ रानेबे᳖ूर ᭣ लकैबक अभयार᭛य कᳱ सीमा से 100 मीटर से 4.60 ᳰकलोमीटर तक के िव᭭ तार तक के ᭃेᮢ को रानेबे᳖ूर ᭣ लकैबक अभयार᭛य पाᳯरि᭭थितक सवेंदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत् :--

1. पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन काकाकाका िव᭭तारिव᭭तारिव᭭तारिव᭭तार औरऔरऔरऔर उसकᳱउसकᳱउसकᳱउसकᳱ सीमाएंसीमाएंसीमाएंसीमाए-ं-(1) पाᳯरि᭭ थितक संवेदी जोन का िव᭭ तार, रानेबे᳖ूर ᭣ लैकबक अभयार᭛य कᳱ सीमा के चारᲂ ओर 100 मीटर से 4.60 ᳰकलोमीटर के िव᭭ तार तक 112.74 वगᭅ ᳰकलोमीटर ᭃेᮢफल मᱶ फैला ᱟआ ह ैऔर ऐसे जोन कᳱ सीमा का िव᭭तृत ᱨप उपाबधं उपाबधं उपाबधं उपाबधं I I I I मᱶ ᳰदया गया ह ै।

(2) पाᳯरि᭭थितक संवेदी जोन के भीतर आने वाल े38 ᮕामᲂ कᳱ सचूी ᮧमुख िब᭠ दᲐु के भ-ूिनदᱷशांकᲂ के साथ उपाबधं उपाबधं उपाबधं उपाबधं IIIIIIII के ᱨप मᱶ उपाब᳍ ह ै।

(3) अᭃांश और दशेा᭠तर के साथ सीमा वणᭅन के साथ पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ उपाबधं उपाबधं उपाबधं उपाबधं IIIIIIIIIIII के ᱨप मᱶ उपाब᳍ ह ᱹ।

(4) पाᳯरि᭭थितक संवेदी जोन के साथ-साथ अभयार᭛य सीमा के ᮧमुख ᳲबदᲐु के भ-ू िनदᱷशांक उपाबधंउपाबधंउपाबधंउपाबधं IVIVIVIV के ᱧप मᱶ उपाब᳍ ह ै।

2222.... पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महायोजनामहायोजनामहायोजनामहायोजना –––– (1) रा᭔य सरकार, पाᳯरि᭭थितक संवेदी जोन के िलए राजपᮢ मᱶ इस अिधसचूना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल᭏ न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।

(2) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3

(3) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करन े के िलए रा᭔ य सरकार के सभी संब᳍ िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत्:--

(i) पयाᭅवरण;

(ii) वन और व᭠यजीव;

(iii) कृिष ;

(iv) राज᭭ व;

(v) नगर िवकास;

(vi) पयᭅटन;

(vii) ᮕामीण िवकास;

(viii) ᳲसचाई और बाढ़ िनयंᮢण;

(ix) नगरपािलका;

(x) पंचायती राज;

(xi) लोक िन माᭅण िव भाग।

(4) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भ-ूउपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनकूुलता का संवधᭅन करेगी ।

(5) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।

(6) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैस े उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी और इस योजना के मानिचᮢ ᳇ारा िव᳒मान और ᮧ᭭तािवत भूिम के उपयोग का िववरण ᳰकया जाएगा ।

(7) आंचिलक महायोजना पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगा और अनु᭒छेद 4 कᳱ सारणी मᱶ सूचीब᳍ ᮧितिष᳍ और िविनयिमत ᳰᮓयाकलापᲂ का पालन करेगा और ᭭थानीय समुदायᲂ कᳱ आजीिवका सुरᭃा के िलए पाᳯरि᭭थितक-अनुकूल िवकास को सुिनि᳟त करेगा और बढ़ावा दगेा।

(8) आंचिलक महायोजना इस अिधसूचना मᱶ ᳰदए गए उपबंधᲂ के संबंध मᱶ अपने कायᲄ के बाहर ले जाने के िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी ।

3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपारा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपारा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपारा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपायययय-------- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत:्--

(1) भूभभूूभू----उपयोग उपयोग उपयोग उपयोग –––– (क) पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢ ᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक सबं᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा।:

4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भिूम का संपᳯरवतᭅन िनगरानी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, रा᭔य सरकार के अ᭠य िनयमᲂ और िविनयमᲂ के ᱨप मᱶ लागू हᲂगे, जो ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन ेके िलए ह,ै जैसे:-

(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढ़ृ करना तथा नई सड़कᲂ का संिनमाᭅण;

(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;

(iii) ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग;

(iv) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुिवधाᲐ सहायक पाᳯरि᭭थितक पयᭅटन मᱶ सि᭥मिलत ᮕह वास; और

(v) अनु᭒छेद 4 के अंतगᭅत ᳰदए गए संवᳶधत ᳰᮓयाकलाप ह:ै परंतु यह और भी रा᭔य सरकार के पूवᭅ अनुमोदन तथा संिवधान के अनु᭒छेद 244 यात᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनसुूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा:

परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भ-ूअिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, िनगरानी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक िजसस ेहᳯरत ᭃेᮢ मᱶ जसैे वन ᭃेᮢ, कृिष ᭃेᮢ, आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अᮧयु᭍ त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएगें ।

(2) ᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ, नᳰदयᲂ और चैनलᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष᳍ करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएगें ।

(3) पयᭅटन पयᭅटन पयᭅटन पयᭅटन –––– (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, कनाᭅटक ᮧदशे सरकार ᳇ारा कनाᭅटक सरकार के राज᭭व िवभाग और वन िवभाग, के परामशᭅ से तैयार कᳱ जाएगी । (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-

(i) पाᳯरि᭭ थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के संबंध मᱶ अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय रानेबे᳖ूर ᭣ लैकबक अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण अनु᭄ात नहᱭ होगा:

¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 पर᭠तु यह ᳰक संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर कᳱ दरूी से परे पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक नए होटल और ᳯरसोटᭅ कᳱ ᭭थापना पयᭅटन महायोजना के अनसुार पाᳯरि᭭थितक पयᭅटन सुिवधा के िलए पूवᭅ पᳯरभािषत और िविन᳸द᳥ ᭭थान मᱶ ही अनु᭄ात ᳰकया जाएगा ;

(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िस᳍ांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ सरंᭃण ᮧािधकरण, (समय-समय पर यथा संशोिधत) ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन मागᭅदशᭅक िस᳍ांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;

(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा िनगरानी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।

(4) नसैᳶगक िवरासत नसैᳶगक िवरासत नसैᳶगक िवरासत नसैᳶगक िवरासत -------- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाए,ं जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।

(5) मानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थल ल ल ल ---- पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और उनके संरᭃण कᳱ योजनाए ंतैयार करनी होगी तथा आचंिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।

(6) ᭟ व᭟ व᭟ व᭟ विन ᮧदषूणिन ᮧदषूणिन ᮧदषूणिन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986,के अधीन बनाए गए ᭟विन ᮧदषूण (िविनयमन और िनयंᮢ ण) िनयम ,2000 के उपबंधᲂ के अनुसार तैयार करेगा

(7) वाय ुᮧदषूणवाय ुᮧदषूणवाय ुᮧदषूणवाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनवारण और िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार तैयार करेगा ।

(8) बिह᮲ाव का िन᭭सारणबिह᮲ाव का िन᭭सारणबिह᮲ाव का िन᭭सारणबिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा तथा पयाᭅवरण कᳱ सरंᭃण के िलए मानक और अिधक कठोर बनाये जा सकते ह।ᱹ

(9) ठोस अपिश᳥ ठोस अपिश᳥ ठोस अपिश᳥ ठोस अपिश᳥ -------- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा-- (क) पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ.

1357(अ), तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ᳰकए गए थे, के उपबंधᲂ के अनसुार ᳰकया जाएगा ;

(ख) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाए ंतयैार करᱶगे ;

(घ) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा।

(10) जवै िचᳰक᭜ सीजवै िचᳰक᭜ सीजवै िचᳰक᭜ सीजवै िचᳰक᭜ सीय अपिश᭬ टय अपिश᭬ टय अपिश᭬ टय अपिश᭬ ट- जैव िचᳰक᭜ सीय अपिश᭬ ट ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा— (क) पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना स.ंका.िन 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जवै िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा । (ख) पाᳯरि᭭थितक संवेदी जोन मᱶ कोई सामा᭠य उपचार सुिवधा या जलाया जाना अनु᭄ात नहᱭ ᳰकया जाएगा ।

(14) यानीय पᳯरवहन: यानीय पᳯरवहन: यानीय पᳯरवहन: यानीय पᳯरवहन: ---- पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएगें और आंचिलक महायोजना के तैयार होने और रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा के अनुमोᳰदत होने तक, िनगरानी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।

2. ᮧदषूण (जल या वायु या मृदा या ᭟ विन आᳰद) काᳯरत करने वाल े उ᳒ोगᲂ कᳱ ᭭ थापना । कोई नई और पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧदषूण फैलाने वाल े उ᳒ोगᲂ के िव᭭तार कᳱ अनुमित दी जाएगी ।पाᳯरि᭭थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना के वगᱮकरण कᳱ अनुमित दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हो । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

3. बृहत जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠यथा उपबंिधत के िसवाय) हᲂगे ।

4. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

5. ᮧाकृितक जल िनकायᲂ या भूिम ᭃेᮢ मᱶ अनुपचाᳯरत ᮧवाह के िनवᭅहन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

6. ठोस अपिश᳥ िनपटान ᭭थल कᳱ ᭭थापना और सामा᭠य जलाए जान े कᳱ सुिवधा के िलए ठोस और जैव िचᳰक᭜सा अपिश᳥। पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ िनपटान कᳱ कोई नई ठोस अपिश᳥ िनपटान ᭭थल और अपिश᳥ उपचाᳯरत/ᮧसं᭭ करण सुिवधा कᳱ अनुमित नहᱭ ह ै । औ᳒ोिगक ᮧᳰᮓया और ᭭वा᭭᭝य ᮧित᳧ान अ᭭पतालᲂ, आᳰद से उ᭜प᳖ या ᳰकसी भी ठोस अपिश᳥ के उपचाᳯरत के िलए सामा᭠य या ᳞िᲦगत जलावतरण कᳱ सुिवधा का अिधकतर ᮧितिष᳍ ह ै।

7. फमᲄ, कंपिनयᲂ आᳰद ᳇ारा बड़ े पैमाने पर वािणि᭔यक पशुधन संपदा और कु᭍कुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को पूरा करन े के िलए लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।

8. नई आरा िमलᲂ कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर नई या िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।

9. ᲊट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

10. जलावन लकिड़यᲂ का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । ख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलाप

11. होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलापᲂ संबंधी पयᭅटकᲂ कᳱ लघ ु संरचनाᲐ के िलए संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात हᲂगे, अ᭠यथा नहᱭ । परंतु, जहा ँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा ह ै वहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना और यथा लागू मागᭅदशᱮ िस᳍ांतᲂ के अनुᱧप होगा।

12. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो, कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:

¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करन े कᳱ अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी ।

(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;

(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;

(iii) कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना के वगᱮकरण;

(iv) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुख सुिवधाᲐ जो पाᳯरि᭭थितक पयᭅटन िजस मᱶ सहायक हो ᮕह वास; और

(v) इस अिधसूचना मᱶ संवᳶधत ᳰᮓयाकलापᲂ कᳱ सचूी :

(ख) पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करत े ह,ᱹ से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएगें और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएगें । (ग) एक ᳰकलोमीटर से आगे आंचिलक महायोजना कᳱ अनुसार िविनयिमत हᲂगे ।

13. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । फरवरी, 2016 मᱶ के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी उ᳒ोगᲂ मᱶ वगᱮकरण के अनुसार गैर-ᮧदषूणकारी उ᳒ोग और अपᳯरसंकट मᱶ, लघु और सेवा उ᳒ोग, कृिष, पु᭬प कृिष, उ᳒ान कृिष या पाᳯरि᭭थितक संवेदी जोन से दशेी सामᮕी से उ᭜पादᲂ को उ᭜प᳖ करने वाले कृिष आधाᳯरत उ᳒ोग सᭃम ᮧािधकारी ᳇ारा अनु᭄ात हᲂगे।

14. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] िविनयिमत होगी ।

15. वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण (एन.टी.एफ.पी.)

। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

16. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण और केबल िबछाना और अ᭠य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे (भूिमगत केबल को बढ़ावा ᳰदया जाएगा)।

17. नागᳯरक सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।

18. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढ़ृ करना । लागू िविधयᲂ के अनुसार ᭠यनूीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।

19. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᱶ, हलेीका᭡टर, ᮟोन, माइᮓोलाइटस और अ᭠य पयᭅटन ᳰᮓयाकलाप आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

20. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

21. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।

22. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष और मछली पालन । ᭭थानीय लोगᲂ के उपयोग के िलए लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

23. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करने और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन ᳰकया जाएगा । अ᭠यथा लागू िविधयᲂ के अधीन उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण/ᮧवाह के िनवᭅहन को िविनयिमत ᳰकया जाएगा।

24. सतह और भजूल के वािणि᭔यक िन᭬कषᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

25. खुले कुआ, बोर कुआ, आᳰद के िलए कृिष और अ᭠य उपयोग । िविनयिमत और उपयुᲦ ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ कᳱ स᭎ती स ेिनगरानी कᳱ जाएगी।

(घ) िवधान सभा के सद᭭य, बयादगी – सद᭭ य;

(ड.) ᭃेᮢीय अिधकारी, कनाᭅटक रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ - सद᭭ य;

(च) कनाᭅटक सरकार के पयाᭅवरण िवभाग का ᮧितिनिध – सद᭭ य;

(छ) कनाᭅटक सरकार के शहरी िवकास िवभाग का ᮧितिनिध – सद᭭ य;

(ठ) सहायक वन सरंᭃक, रानेबे᳖ूर ᭣ लैकबक अभयार᭛य, व᭠ यजीव उपमंडल, रानेबे᭠ नरू –सद᭭ य-सिचव। *(कनाᭅटक रा᭔ य सरकार ᳇ारा अ᭠ य बातᲂ के साथ, सुसगंत अनुमोदन अिभᮧा᭡ त करन ेके अ᭟ यधीन, िजसके अंतगᭅत िवधान सभा᭟ यᭃ, कनाᭅटक कᳱ अनु᭄ा, यᳰद कोई हो, ह)ै

(1) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।

(2) िनगरानी सिमित का कायᭅकाल तीन वषᭅ का होगा।

(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं.

का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अनुसूची के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ िविन᳸द᭬ ट ᮧितिष᳍ गितिविधयᲂ के िसवाय आन ेवाले ऐस ेᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत िनगरानी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवाय ु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी।

(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत िनगरानी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।

(5) िनगरानी सिमित का सद᭭य-सिचव या संब᳍ कल᭍टर या संबंिधत उ᳒ान उप वन सरंᭃक ऐसे ᳞िᲦ के िवᱨ᳍, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लघंन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।

(6) िनगरानी सिमित मु᳎ᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 6th July, 2017 S.O. 2147(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 64 (E), dated the 7th January, 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on dated the 7th January, 2016;

AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification;

AND WHEREAS, the Ranebennur Blackbuck Sanctuary notified vide Government of Karnataka notification No.AFD 58 FWL 74, dated the 17th June, 1974 and situated in Ranebennur, Haveri and Byadgi Taluks of Haveri District in the State of Karnataka lies between the North latitude 140 34’ and 140 46’ and between the East longitude 750 30’ and 750 47’ and is spread over an area of 119 square kilometers and the area is covered mainly by scrub forest and Eucalyptus plantations.

AND WHEREAS, the vegetation consists of Acacia catechu, Prosopis juliflora, Dodonea viscosa, Acacia sundra, Zizyphus mauritiana, Randia specia and Cassia auriculata, Cassia fistula, Neem (Azadirachta indica), Holoptelia integrifolia, Madhuca indica, Ficus specia and Bamboo have been planted along the Sanctuary’s roads; the Sanctuary is known for its Blackbuck and Wolf populations and other mammals include Wild Pig, Fox, Jackal, Langur, Porcupine, Common mongoose, Hare, and Pangolin; Hyenas are also found in the Irani gudda area of the Sanctuary; the population of Blackbuck has seen a constant increase since the establishment of the Sanctuary and the Great Indian Bustard, a large cursorial bird, also used to be sighted in the short grass plains of the Sanctuary till the year 2005 and apart from the Great Indian Bustard, avifauna in the Sanctuary includes Peafowl, Cuckoo, Grey Babbler, Shrike, Black Drongo, Grey Partridge, Sand Grouse, Bush Quail and many others.

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Ranebennur Blackbuck Sanctuary as Ecosensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.

NOW THEREFORE, in exercise of the powers conferred by sub section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule

(3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 100 meters to 4.60 kilometers around the boundary of Ranebennur Blackbuck Sanctuary in the State of Karnataka as the Ranebennur Blackbuck Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone.— (1) The Eco-sensitive Zone is spread over an area of 112.74 square kilometers with an extent varying from 100 meters to 4.60 kilometers around the boundary of Ranebennur Blackbuck Sanctuary and the boundary description of the said Zone is given in Annexure-I.

(2) The list of 38 villages falling within Eco-sensitive Zone along with Geo-coordinates of prominent points is appended as Annexure-II .

(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-III.

(4) The Geo-coordinates of major points on the Eco-sensitive Zone boundary as well as on the Sanctuary boundary are appended as Annexure-IV.

2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Municipal;

(x) Panchayati Raj;

(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities.

(8) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:

Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government to meet the residential needs of the local residents, and for activities such as :-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agriculture area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.- The catchment areas of all natural springs, rivers and channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism.-

(a) The activity relating to tourism within the Eco-Sensitive Zone shall be as per the Tourism Master Plan, which shall form part of the Eco-sensitive Zone.

(b)The Eco-Tourism Master Plan shall be prepared by Department of Tourism, Government of Karnataka in consultation with the Departments of Environment and Forest, Government of Karnatak.

(i) no new construction of hotels and resorts shall be allowed within one kilometer from the boundary of the Ranebennur Blackbuck Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:

Provided that beyond the distance of one kilometer from the boundary of the said Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;;

(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 made under the Environment (Protection) Act, 1986.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes.- Disposal and management of solid wastes shall be as under:-

(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the provisions of Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time;

(b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and nonbiodegradable components;

(d) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone and no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.

(10) Bio-medical waste.- Bio medical waste management shall be as under:-

(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provision of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time;

(b)no common treatment facility or incineration shall be permitted within the Eco-sensitive Zone.

(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.

(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.

(13) E-waste.- The E- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.

(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular Pollution.- Prevention and control of vehicular pollution shall be carried out in accordance with the applicable laws and efforts shall be made for use of cleaner fuel for example CNG etc.

(16) Industrial units: (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.

(b) Only non-polluting industries may be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- 30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S No Activity Remarks

UOI in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (water, air, soil, noise, etc.).

No new industries and expansion of existing polluting industries in the Eco-sensitive Zone shall be permitted, only non-polluting industries may be permitted within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification.

3. Establishment of major hydroelectric project.

Prohibited (except as otherwise provided) as per applicable laws.

4. Use or production or processing of any hazardous substances.

Prohibited (except as otherwise provided) as per applicable laws.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited (except as otherwise provided) as per applicable laws.

6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.

No new solid waste disposal site and waste treatment/processing facility of solid waste shall be permitted within Eco-sensitive Zone, and installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment or hospitals shall be prohibited.

7. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc.

Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.

8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws

10. Commercial use of fire wood. Prohibited (except as otherwise provided) as per applicable laws B. Regulated Activities

11. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:

Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

12. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone, whichever is nearer:

(a) Provided that, local people shall be permitted to undertake ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 31 construction in their land for their residential use including the activities listed in sub paragraph (1) of paragraph 3, as per building byelaws:

(i) Widening and strengthening of existing roads and construction of new roads;

(ii) Construction and renovation of infrastructure and civic amenities;

(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;

(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and

(v) Promoted activities listed in this Notification.

(b) Provided futher that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

13. Small scale non polluting industries.

Non polluting industries as per the classification of industries issued by the Central Pollution Control Board in February, 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone may be permitted by the Concerned Competent Authority.

14. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

15. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).

Regulated under applicable laws.

16. Erection of electrical and communication towers and laying of cables and other infrastructures.

Regulated under applicable law (underground cabling may be promoted).

17. Infrastructure including civic amenities.

Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

18. Widening and strengthening of existing roads and construction of new roads.

5. Monitoring Committee: — (1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:-

(a) Regional Commissioner, Belagaavi -Chairman;

(b) Member of Legislative Assembly, Ranebennur -Member;

(d) Member of Legislative Assembly, Byadgi -Member;

(e) Regional officer, Karnataka State Pollution Control Board -Member;

(f) Representative of the Department of Environment, Government of Karnataka -Member;

(g) Representative of the Department of Urban Development, -Member;

21. Movement of vehicular traffic at night.

22. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

6. Terms of reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring Committee shall be for a period of three years.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to the provisions of this notification.

8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.

Then the line passes along the outer boundary of Sy Nos. 135, 136, 139, 140, 208, 205, 204, 203, 202, 200, 198, 234 then bisects Sy Nos. 232 to meet at bi-junction point of Sy Nos. 232 & 243, then further continue along outer boundary of Sy Nos. 243, 246, 254, 255/A, 256, 299, 316, 328 till it reaches at the tri-junction point of Sy Nos. 328, 309/A of Kalledevaru village and Sy Nos. 68 of Bharadi village. Then the line bisects Sy Nos. 68 to reach bi-junction point of Sy Nos. 68 & 67 of Bharadi village.

From this point the line ruin along the outer boundary of Sy Nos. 67, 60, 61 till the bi-junction point of Sy Nos. 61 & 62 of Bharadi and further the line bisects the Sy Nos. 62, 48 & 50 to meet at the bi-junction point of Sy Nos. 50 & 51, then the line passes along outer boundary of Sy Nos. 51 to meet at bi-junction point on inter village boundary of Bharadiand Kuragundha village. Then the line passes along outer boundary of Sy Nos. 96, 102, 103 and further bisects Sy No. 109 & further meets at bi-junction point Sy Nos. 109 & 108 & then the line passes along outer boundary of Sy Nos. 108, 76, 77 till the bi-junction point of Sy Nos. 77 & 81. Then the line bisects the Sy Nos. 81 to meet at the tri-junction point of Sy Nos. 81, 82 & 83. Then boundary runs along the outer boundary of Sy Nos. 83, 84, 85 & 91 to meet at bi-junction point of Sy Nos. 91 & 87 of Kurugundha village.

East :Then from the above point the boundary line proceeds southwards along the outer boundary of Sy os.91 of Kuragundha village to meet at inter village boundary at Sy Nos. 16 of Hanumapura village.
