10. ofSrt S Ter TS AR, IR G gt % forw s F w9 § el e o forn Rt gt 1 aftrafam F#50 @ asft fefiT b s g et agr, frrs st A, afees A T TAT FTAT FAT FT AT AT AT A F, ITe AT | [T I—a7% 3(ii)] TR 7 T ¢ SR 3 11, STTErR=or 3 erearer @i wEEAt AT WA F qeT A wEeAt £ Tz 7 f, qm aw6w @ g ST fErft STTer Tro w3 et 3 e e G s [T, . am$13-13/2/2023-3.7.111] . o o o ST TOITT FHTT ATSTIAT, T A=A MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 17th May, 2023 S.0. 2192(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India of the erstwhile Ministry of Environment and Forests, number S.0. 1533(E), dated the 14% September, 2006 (hereafter in this notification referred to as the said notification), the Central Government, hereby constitutes the State Level Environment Impact Assessment Authority for West Bengal (hereafter in this notification referred to as the Authority) comprising of following persons, namely: -

(1) Dr. Ashit Kumar Mukherjee, Chairman; 29/43, Panch Kori Ghosh Road, Barisha, Kolkata-700008.

(2) Dr. Nilangshu Bhusan Basu, Member; 7A, Tinkari Ghosh Lane, Kalighat, Kolkata-700026.

(3) Chief Environment Officer Member —Secretary. State Government of West Bengal.

2. The Chairman and member of the Authority shall hold office for a term not exceeding three years from the date of publication of this notification in the Official Gazette.

3. The Authority, shall exercise the powers and follow the procedures specified in the said notification.

4. The Authority shall take its decision on the recommendations of the State Level Expert Appraisal Committee constituted under paragraph 5.

5. For the purpose of assisting the Authority, the Central Government, in consultation with the Government of ‘West Bengal, hereby constitutes the State Level Expert Appraisal Committee (hereafter in the notification referred to as the Committee), West Bengal comprising of the following persons, namely: -

(1) Dr. Anirban Gupta, Chairman; Department of Civil Engineering, Indian Institute, of Engineering Science and Technology, Shibpur, Howrah-711103, West Bengal.

(2) Dr. Pradip Kumar Sikdar. Member; Department of Environment Management, Indian Institute of Social Welfare and Business, Management (IISWBM). Management House, College Square (West), Kolkata-700073)

(3) Dr. Suchandra Bardhan, Member; Department of Architecture, Jadavpur University, Jadavpur, Kolkata-700032.

(4) Dr. Sampa Chakrabarti, Member; Flat No-J-103, V.I.P Enclave, V.LP Road, P.O- Deshbandhu Nagar, Kolkata-700059.

(5) Dr. Aniruddha Mukhopadhyay Member; 35Ballygunge Circular Road, Department of Environmental Science, University of Calcutta, 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Kolkata-700019.

(6) Shri. Shubhendu Bandyopadhyay, LF.S (Retd) Member; Hari Kutir, 2084, Rajdanga Main road, Kolkata-700107.

(7) Dr. Indranath Sinha Member; Department of Mining Engineering Indian Institute of Engineering Science and Technology, Shibpur, Howrah - 711103.

(8) Member Secretary, West Bengal Pollution Control Secretary. Board.

6. The Chairman and members of the Committee, West Bengal shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.

7. In order to avoid any conflict of interest, -

(1) he Chairman and members of the Authority, and the Committee shall,- (a.) declare to which consulting organisation they have been associated with and also the project proponents; (b.) not undertake any consultation or association with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority, or to be appraised by the Committee during their tenure; and

(2) If in the preceding five years, the Chairman or any member of the Authority or the Committee has provided consultancy services or conducted Environment Impact Assessment studies for any project proponent, in that situation they shall recuse themselves from the meetings of the Authority and the Committee from the process of appraisal of any project proposed by such proponents.

8. The Committee shall exercise the powers and follow the procedures specified in the said notification.

9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach consensus in each case, and if they fail to reach consensus the view of the majority shall prevail.

10. The Government of West Bengal shall specify an agency to act as Secretariat of the Authority and the Committee and the Secretariat shall provide financial and logistic support including accommodation, transportation and such other facilities in respect of its statutory functions.

11. The sitting fees, travelling allowances and dearness allowances to the Chairman and members of the Authority, ‘West Bengal and the Chairman and members of the Committee, shall be paid in accordance with the provisions of relevant rules of the Government of West Bengal.
