और, बारनावापारा व᭠ यजीव अभयार᭛ य अपने समृ पयाᭅवास के िलए जाना जाता ह,ै िजसमᱶ िविभ᭠ न ᮧकार के ᮧाणी और वन᭭ पित ह।ᱹ मुय ᮧजाितयᲂ मᱶ तᱶदआु (पᱶथेरा पाडᭅस), जंगली भᱹसा (िबसन िबसन), रीछ (मेलुरसस उᳶसनस), सांभर (ᱧसा यूनीकोलोर), ᭣ ल ू बुल (बोसेलफस ᮝागोकैमेलस), िच᭜ तीदार िहरण (ᱧसा अ᭨ᮨेिड), मंुजक (मुनᳯटयाकस एसपी) , लकड़ब घा (हयेना एसपी), भेिडया (कैिनस ᭨यूपस), िसयार (कैिनस ऑᳯरयस), लोमड़ी (व᭨᭡स व᭨᭡स), जंगली िब᭨ ली (फेिलस चौस), नेवला (हपेᱷि᭭टड े एपी), खरगोश (िलपस एसपी), सामा᭠ य लंगूर (से᳖ोपेटेकस इ᭠टेलस), जंगली कु᭜ ता (लाइकाओन िपटस), बनैला सूअर (सस ᭭ᮓोफा डोमेि᭭टकस), आᳰद ह ᱹ । मह᭜वपूणᭅ पु᭬प ᮧजाितयां शतावरी (असपरागस रेस᭭मॉस), धवरा (अनोगेसस लᳯैटफ़ोिलया), कुसुम (᳣ेले᭒यरा 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ओिलसा), आᳰद और यह महानदी और उसकᳱ सहायक नᳰदयᲂ – बालमदहेी और जᲂक नᳰदयᲂ पर जल आवाह ᭃेᮢ का भी िनमाᭅण करता ह;ै और, बारनावापारा व᭠ यजीव अभयार᭛ य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाए ं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पाᳯरि᭭थितक, पयाᭅवरण और जैव िविवधता कᳱ दिृ᭬ ट से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सरुिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) के साथ पᳯठत और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए, छ᭜ तीसगढ़ रा᭔य मᱶ बारनावापारा व᭠ यजीव अभयार᭛य कᳱ सीमा स े 1 ᳰक लोमीटर से 7.2 ᳰकलोमीटर तक 182.5 वगᭅ ᳰकलोमीटर कᳱ दरूी पर ि᭭थत ह ैबारनावापारा व᭠ यजीव अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजस ेइसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत् :--
1. पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन काकाकाका िव᭭तारिव᭭तारिव᭭तारिव᭭तार औरऔरऔरऔर उसकᳱउसकᳱउसकᳱउसकᳱ सीमाएंसीमाएंसीमाएंसीमाए—ं(1) पाᳯरि᭭थितक सवेंदी जोन बारनावापारा व᭠ यजीव अभयार᭛य कᳱ सीमा के चारᲂ ओर 1 ᳰकलोमीटर से 7.2 ᳰकलोमीटर तक 182.5 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ िव᭭ताᳯरत ह।ै
(2) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा मᱶ िवभािजत बारनावापारा व᭠ यजीव अभयार᭛ य का मानिचᮢ उपाबधं उपाबधं उपाबधं उपाबधं I I I I के ᱨप मᱶ उपाब ह ैऔर भ-ूिनदᱷशांकᲂ कᳱ सचूी उपाबधं उपाबधं उपाबधं उपाबधं IIII----कककक मᱶ ह।ै
(3) मुय िब᭠दᲐु के भू-िनदᱷशांकᲂ के साथ पाᳯरि᭭थितक संवेदी जोन के अंतगᭅत आने वाले ᮕामᲂ कᳱ सूची उपाबधं उपाबधं उपाबधं उपाबधं II II II II के ᱨप मᱶ उपाब ह ै।
2222.... पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महायोजनामहायोजनामहायोजनामहायोजना –––– (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजनᲂ के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख स ेदो वषᭅ कᳱ अविध के भीतर, इस अिधसूचना मᱶ ᳰदए गए अनबंुध का अनुपालन करत ेᱟए, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से आंचिलक महायोजना तैयार करेगी ।
(2) इस ᮧकार तैयार ᳰकए गए आंचिलक महायोजना अिधसूचना मᱶ िविन᳸द᳥ शतᭅ के अनुᱨप हᲂगे और पयाᭅवरणीय ᮧभाव सि᭥मिलत हᲂगे।
(3) आंचिलक महायोजना का रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोदन ᳰकया जाएगा ।
(4) पाᳯरि᭭थितक संवेदी जोन के िलए आचंिलक महायोजना रा᭔ य सरकार ᳇ारा इस अिधसूचना मᱶ यथािविन᳸द᭬ ट रीित मᱶ और सुसंगत कᱶ ᮤीय और रा᭔ य िव िध यᲂ और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िस ांतᲂ, यᳰद कोई हᲂ, के सामंज᭭ य स ेतैयार कᳱ जाएगी ।
(5) आचंिलक महायोजना उसमᱶ पयाᭅवरणीय और पाᳯरि᭭ थितक मुᲂ को सि᭥ मिलत करने के िलए सभी संबंिध त रा᭔ य िव भागᲂ के साथ परामशᭅ से तैयार कᳱ जाएगी, िजसके अंतगᭅत िन᭥ निलिखत ह-ᱹ-
(i) पयाᭅवरण ;
(ii) वन ;
(iii) शहरी िवकास ;
(iv) पयᭅटन ;
(v) नगरपािलका ;

(vi) राज᭭ व ;
(vii) कृिष ;
(viii) छ᭜ तीसगढ़ पयाᭅवरण संरᭃण बोडᭅ ;
(ix) ᳲसचाई ; और
(x) लो क िन माᭅण िव भाग।
(6) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भ-ूउपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ और आचंिलक महायोजना मᱶ सभी अवसंरचना और अिधक ᮧभावी और पाᳯरि᭭ थितक अनुकूल ᳰᮓयाकलाप कारक इस ᮧकार िविन᳸द᭬ ट न हो ।
(7) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण स ेसंबंिधत ऐस ेअ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(8) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जसैे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी और समथᭅनकारी मानिचᮢ और िव᳒मान और ᮧ᭭तािवत भूिम के उपयोग कᳱ िवशेषताᲐ के ᭣यौरे दतेे ᱟए मानिचᮢᲂ ᳇ारा समᳶथत होगी ।
(9) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी और अिधसूचना मᱶ िविन᳸द᳥ ᮧितिष, िविनयम और संवᳶधत ᳰᮓयाकलापᲂ का अनुसरण करेगी।
(10) इस ᮧकार अनुमोᳰदत आंचिलक महायोजना इस अिधसूचना के उपबंधᲂ के अनसुार िनगरानी के अपने कायᲄ को करने के िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी ।
3. रा᭔यरा᭔यरा᭔यरा᭔य सरकारसरकारसरकारसरकार ᳇ा᳇ा᳇ा᳇ारारारारा ᳰकएᳰकएᳰकएᳰकए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय-------- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन ेके िलए िन᳜िलिखत उपाय करेगी, अथाᭅत ्:--
(1) भूभभूूभू----उपयोग उपयोग उपयोग उपयोग ---- पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजनᲂ के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, िनगरानी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन ेके िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के सूचीब ᳰᮓयाकलापᲂ को पूरा करन ेके िलए अनु᭄ात हᲂगे, अथाᭅत ्:-
(i) िव᳒मान सड़कᲂ को चौड़ा तथा सुदढ़ृ करना ;
(ii) ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग ;
(iii) वषाᭅ जल संचयन; और
(iv) कुटीर उ᳒ोग िजसके अंतगᭅत ᮕाम उ᳒ोग, सुिवधा भंडार और ᭭थानीय सुख-सुिवधाए ंभी ह:ᱹ 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और सिंव धान के अनु᭒ छेद 244 तथा त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, इसमᱶ पैरा 3 मᱶ िन᳸द᭬ ट िनगरानी सिमित के िवचार अिभᮧा᳙ करन ेके प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ केवल एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ , कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अन᭜ु पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएगें । ((((2222)))) ᮧाकृितक जल ᮲ोत ᮧाकृितक जल ᮲ोत ᮧाकृितक जल ᮲ोत ᮧाकृितक जल ᮲ोत ---- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ के जल आवाह ᭃेᮢᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा जल आवाह ᭃेᮢᲂ मᱶ िवकास ᳰᮓयाकलाप ᮧितिष और िनबᲈिधत करने के िलए ऐसी रीित से जल आवाह ᮧबंधन योजना के मागᭅिनदᱷश तैयार ᳰकए जाएगें ।
(3) पाᳯरि᭭थितक पयᭅटन पाᳯरि᭭थितक पयᭅटन पाᳯरि᭭थितक पयᭅटन पाᳯरि᭭थितक पयᭅटन –––– (क) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुसार आंचिलक महायोजना के िलए होगा । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, ᳇ारा छᱫीसगढ़ रा᭔य पयाᭅवरण और वन िवभाग के परामशᭅ से तैयार होगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ होगी । (घ) पाᳯरि᭭थितक पयᭅटन सबंंधी ᳰᮓयाकलाप िन᳜ानुसार िविनयिमत हᲂगे, अथाᭅत् :-
(i) बारनावापारा व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट ह,ै नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे। जो कोई व᭠यजीव अभयार᭛य कᳱ सीमा से 1 ᳰकलोमीटर कᳱ दरूी से परे पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक होटलᲂ और सैरगाहᲂ का ᭭थापन केवल पूवᭅ पᳯरिनि᳟त ᭃेᮢᲂ मᱶ पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितक पयᭅटन सुिवधाᲐ के िलए ही अनु᭄ात होगा;
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ सरंᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;

(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान े तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा िनगरानी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा । ((((4444)))) नसैᳶगकनसैᳶगकनसैᳶगकनसैᳶगक िवरासतिवरासतिवरासतिवरासत ---- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाए,ं जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनके पᳯररᭃण और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख स ेछह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । ((((5555) मानव) मानव) मानव) मानव----िनᳶमत िवरासत ᭭ थिनᳶमत िवरासत ᭭ थिनᳶमत िवरासत ᭭ थिनᳶमत िवरासत ᭭ थल ल ल ल ---- पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख स े छह माह के भीतर उनके संरᭃण कᳱ योजनाए ं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ व᭟ व᭟ व᭟ विन ᮧदषूणिन ᮧदषूणिन ᮧदषूणिन ᮧदषूण – पाᳯरि᭭थितक संवेदी जोन मᱶ रा᭔य सरकार का पयाᭅवरण िवभाग या छᱫीसगढ़ रा᭔य सरकार िनवारण और ᭟विन ᮧदषूण िनयंᮢण पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के अधीन ᭟विन (िविनयमन और िनयंᮢण) िनयम 2000 के अनुसार संकिलत ᳰकया जाएगा ।
(7) वायुवायुवायुवायु ᮧदषूणᮧदषूणᮧदषूणᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ वायु ᮧदषूण के िनयंᮢण के िलए वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम 1981 (1981 का 14) और इसके अधीन ᳰकए गए िविनयमᲂ के अनुसार सकंिलत ᳰकया जाएगा ।
(8) बिह᮲ावबिह᮲ावबिह᮲ावबिह᮲ाव काकाकाका िन᭭सारणिन᭭सारणिन᭭सारणिन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण साधारण मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा।
(9) ठोसठोसठोसठोस अपिश᳥अपिश᳥अपिश᳥अपिश᳥ -------- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰᮓयाि᭠वत ᳰकया जाएगा ;
(ii) अकाबᭅिनक सामᮕी पाᳯरि᭭थितक संवेदी जोन बा᳭ पहचान कᳱ गई ᭭थल पर ᭭वीकायᭅ रीित मᱶ ᳞ियत ᳰकया जाएगा ;
(iii) ठोस अपिश᳥ᲂ के ᭔वलन या भ᭭मीकरण और भराई का ᭭थापना पाᳯरि᭭थितक सवेंदी जोन मᱶ अनु᭄ा नहᱭ कᳱ जाएगी ;
(10) जवै िचᳰक᭜ सीजवै िचᳰक᭜ सीजवै िचᳰक᭜ सीजवै िचᳰक᭜ सीय अपिश᭬ टय अपिश᭬ टय अपिश᭬ टय अपिश᭬ ट- (i) पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सा.का.िन 343 (अ), तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।

(iii) पाᳯरि᭭थितक संवेदी जोन मᱶ मौजूद ᳞िᲦगत अ᭭पतालᲂ या िनजी ᭭वा᭭᭝य कᱶ ᮤᲂ के संरिᭃत ᭃेᮢ पर ᮧितकूल असर से बचने के िलए पयाᭅ᳙ अपिश᳥ उपचार ᮧणाली ᮧदान करनी चािहए।

(12) िनमाᭅणिनमाᭅणिनमाᭅणिनमाᭅण औरऔरऔरऔर िव᭟वसंिव᭟वसंिव᭟वसंिव᭟वसं अपिश᳥अपिश᳥अपिश᳥अपिश᳥ ᮧबधंनᮧबधंनᮧबधंनᮧबधंन: : : : ---- पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं.का.िन 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(13) ईईईई––––अपिश᳥अपिश᳥अपिश᳥अपिश᳥::::---- पाᳯरि᭭थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा ᮧकािशत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(14) यानीययानीययानीययानीय पᳯरवहन: पᳯरवहन: पᳯरवहन: पᳯरवहन: ---- पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएगें और आंचिलक महायोजना के तैयार होन े और रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा के अनुमोᳰदत होन ेतक, िनगरानी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को िनगरानी करेगी ।
(15) औ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयां: : : : ---- (क) राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन के प᳟ात या ᮧकाशन पर, पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा नहᱭ दी जाएगी। (ख) पाᳯरि᭭थितक संवेदी जोन के भीतर जल, वाय,ु मृदा, ᮧदषूण िनयंᮢण काᳯरत कोई नए उ᳒ोग ᭭थािपत करन े कᳱ अनु᭄ा नहᱭ होगी।।
(16) अगर यह आव᭫यक समझता ह,ै इस अिधसूचना के उपबंधᲂ को ᮧभावी करन ेमᱶ के᭠ᮤीय सरकार और रा᭔य सरकार, अ᭠य उपायᲂ िविन᳸द᳥ करेगी।

2. आरा िमलᲂ कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
3. ᳰक᭠ही पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन। लाग ू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
4. (जल या वायु या मृदा या ᭟ विन ᮧदषूण) इ᭜याᳰद काᳯरत करन े वाल े उ᳒ोगᲂ कᳱ ᭭ थापना । कोई नई या पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧदषूण फैलान े वाल े उ᳒ोगᲂ के िव᭭तार कᳱ अन᭄ुा नहᱭ दी जाएगी। पाᳯरि᭭थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा फरवरी, 2016 मᱶ जारी मागᭅदशᭅक िसांतᲂ के अनुसार िसफᭅ गरै- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना के वगᱮकरण कᳱ अनु᭄ा दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हो। इसके अलावा गैर ᮧदिूषत कुटीर उ᳒ोगᲂ को बढ़ावा ᳰदया जाएगा ।
5. नई मुय तापीय और जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापना। लाग ू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
6. जलावन लकड़ी का वािणि᭔यक उपयोग। लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
7. ᭡ लाि᭭ टक बैगᲂ का उपयोग। लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
8. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ, हलेीका᭡टर, ᮟोन, माइᮓालाइट, आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लाग ूिविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
9. ᮧाकृितक जल िनकायᲂ या भूिम ᭃेᮢ मᱶ अनपुचाᳯरत ᮧवाह के िनवᭅहन । लाग ू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
10. ठोस अपिश᳥ िनपटान ᭭थल कᳱ ᭭थापना और सामा᭠य जलाए जान े कᳱ सुिवधा के िलए ठोस और जैव िचᳰक᭜सा अपिश᳥। पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ िनपटान कᳱ कोई नई ठोस अपिश᳥ िनपटान ᭭थल और अपिश᳥ उपचाᳯरत/ᮧसं᭭करण सुिवधा कᳱ अनु᭄ा नहᱭ ह ै । औ᳒ोिगक ᮧᳰᮓया और ᭭वा᭭᭝य ᮧित᳧ान/अ᭭पतालᲂ आᳰद से उ᭜प᳖ ᳰकसी भी ठोस अपिश᳥ के उपचार के िलए सामा᭠य या ᳞िᲦगत जलावतरण कᳱ सुिवधा कᳱ अितᳯरᲦ ᭭थापना ᮧितिष ह ै।
11. फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणि᭔यक पशुधन संपदा और कुकुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को पूरा करने के िलए लाग ू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।

13. होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलापᲂ संबंधी पयᭅटकᲂ कᳱ लघ ु संरचनाᲐ के िलए संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात हᲂग,े अ᭠यथा नहᱭ :
परंत,ु संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर के प᳟ात् या िव᭭तार तक पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना और यथा लाग ूमागᭅदशᱮ िसांतᲂ के अनᱧुप होगा।
14. संिनमाᭅण ᳰᮓयाकलाप । संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलामीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक जो भी िनकट हो, ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय लोगᲂ को परैा 6 के उप परैा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करन ेकᳱ अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी ।
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;
(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुख सुिवधाᲐ जो पाᳯरि᭭थितक पयᭅटन िजस मᱶ सहायक हो गृह वास; और
(iv) इस अिधसूचना मᱶ संवᳶधत ᳰᮓयाकलापᲂ कᳱ सूची।
15. खाई का मैदान। नए खाई खोदने के मैदान का ᭭थािपत ᳰकया जाना ᮧितिष ह ै | पुरान े खाई के मैदान लाग ू िविधयᲂ के अधीन िविनयिमत ᳰकए जाएं |
16. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
17. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करन ेऔर अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन ᳰकया जाएगा । उपचाᳯरत अपिश᳥ जल के पनु:चᮓण और पनु:उपयोग के िलए ᮧयास ᳰकए जाएंगे अ᭠यथा लागू िविधयᲂ के अनुसार उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण/ᮧवाह के िनवᭅहन को िविनयिमत ᳰकया जाएगा।
18. वायु और यानीय ᮧदषूण। लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
19. ᭟विन ᮧदषूण। लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
20. सतह और भूजल कᳱ वािणि᭔यक लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 िनकासी ।
21. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनु᭄ा के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
22. ᮧवासी चारागाह े। लाग ू िविधयᲂ और आंचिलक महायोजना के अनुसार िविनयिमत हᲂगे ।
23. िव᳒मान ᮧित᭬ ठापन । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
24. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण और केबल िबछाना और अ᭠य बुिनयादी ढांचे । लाग ू िविधयᲂ के अधीन िविनयिमत हᲂग े । भूिमगत केबलᲂ को बढ़ावा ᳰदया जाएगा।
25. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नवीन सड़कᲂ का संिनमाᭅण । लाग ू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
26. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
27. वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण। (एन.टी.एफ.पी.)
लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
28. नागᳯरक सुिवधाᲐ सिहत बुिनयादी ढांचे। लाग ूिविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
29. रािᮢ मᱶ यािनक यातायात का संचलन । लाग ू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
30. खुले कुआ, बोर कुआ, आᳰद के िलए कृिष और अ᭠य उपयोग । िविनयिमत और उपयुᲦ ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ कᳱ सती से िनगरानी कᳱ जाएगी।
31. ठोस अपिश᭬ ट ᮧबंधन। लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
32. िवदेशी ᮧजाितयᲂ को लाना । लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।
33. पाᳯरि᭭थितक पयᭅटन। लाग ूिविधयᲂ के अधीन िविनयिमत हᲂग े।

(v) छ᭜ तीसगढ़ सरकार ᳇ारा नामिन᳸द᭬ ट ᮧ᭜येक मामल ेमᱶ तीन वषᭅ कᳱ अविध के िलए व᭠यजीव, पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ का एक िवशेष᭄ सद᭭य;
(vi) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाल ेगरै सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै का ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए छ᭜ तीसगढ़ रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध सद᭭य;

(viii) छᱫीसगढ़ ᮧदषूण िनयंᮢण बोडᭅ का ᮧितिनिध सद᭭य;
(ix) अधीᭃक, बारनावापारा व᭠ यजीव अभयार᭛ य सद᭭य; और
(x) ᮧभागीय वन अिधकारी, बलौदा बाजार सद᭭य-सिचव।

(2) िनगरानी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को िनगरानी करेगी ।
(3) िनगरानी सिमित पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ को भी अनु᭄ात नहᱭ करेगा केवल ᳡ेत उ᳒ोग ᮧवगᭅ को के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ (उ᳒ोगᲂ का वगᱮकरण), 2016 ᳇ारा जारी मागᭅदशᭅकᲂ न े यथा िविन᳸द᳥ माना जाएगा ।

(5) िनगरानी सिमित का सद᭭य-सिचव या संब कलटर या संरिᭃत ᭃेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा।
(6) िनगरानी सिमित मुᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहत ेᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

Key species include Leopard (Panthera pardus), Bison (Bison bison), Sloth Bear (Melursus ursinus), Sambhar (Rusa unicolor), Blue Bull (Boselaphus tragocamelus), Spotted Deer (Rusa alfredi), Barking Deer (Muntiakus sp.), Hyena (Hyaena sp.), Wolf (Canis lupus), Jackal (Canis aureus), Fox (Vulpes vulpes), Jungle Cat (Felis chaus), Mongoose (Herpestidae sp.), Hares (Lepus sp.), Common Langur (Semnopithecus entellus), Wild Dog (Lycaon pictus), Wild Boar (Sus scrofa domesticus), etc. Important floral species include Satavar (Asparagus recemosus), Dhawra (Anogeissus latifolia), Kusum (Schleichera oleosa), etc and it forms a watershed for the River Mahanadi and its tributaries – the Balamdehi and Jonk rivers;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of the Barnawapara Wildlife Sanctuary as Ecosensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
NOW THEREFORE , in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent ranging from 1 kilometre to 7.2 kilometres of 182.5 square kilometres around the boundary of Barnawapara Wildlife Sanctuary in the State of Chhattisgarh as the Barnawapara Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:- 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
1. Extent and boundaries of Eco-sensitive Zone.-(1) The Eco-sensitive Zone is spread over an area of 182.5 square kilometres with an extent ranging from 1 kilometre to 7.2 kilometres around the boundary of Barnawapara Wildlife Sanctuary.
(2) The map of Barnawapara Wildlife Sanctuary demarcating the Eco-sensitive Zone boundary is appended at Annexure I and the list of geo co-ordinates is at Annexure I (A).
(3) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure II .
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan so prepared shall commensurate with the stipulation specified in the Notification and include the environmental implications.
(3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Chhattisgarh Environment Conservation Board;
(ix) Irrigation; and
(x) Public Works Department.
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas such as parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.

(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited, regulated and promoted activities specified in the Notification so as to ensure Eco-friendly development for livelihood security of local communities.
(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions with respect to the provisions given in this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:-
(i) widening and strengthening of existing roads;
(ii) small scale industries not causing pollution;
(iii) rainwater harvesting; and
(iv) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or and restrict development activities within the catchment areas.
(3) Eco-tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per the Eco-tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-tourism Master Plan shall be prepared by the Department of Tourism, Government of Chhattisgarh in consultation with Department of Revenue and Forests, Government of Chhattisgarh.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities relating to tourism shall be regulated as under, namely.-
(i) No new construction of hotels and resorts shall be allowed within 1 km. from the boundary of the Barnawapara Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by the National Tiger Conservation Authority with emphasis on ecotourism.
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Chhattisgarh State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000, under the Environment (Protection) Act, 1986.
(7) Air pollution.- Regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with.
(8) Discharge of effluents.- The discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made therein.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016;
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- (i) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016.
(ii) No common treatment facility or incineration shall be permitted within the Eco-sensitive Zone.
(iii) Individual hospitals or private health centres already existing within the Eco-sensitive Zone should provide adequate waste treatment system to avoid adverse impact on the Protected Area.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016.

(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317(E), dated the 29th March, 2016.
(13) E- waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.
(14) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Industrial units.-
(a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Ecosensitive Zone shall be permitted.
(16) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely- Sl. 1. Commercial Mining, stone quarrying and crushing units.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production or processing of any Prohibited (except as otherwise provided) as per applicable 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] hazardous substances. laws.
4. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new industries and expansion of existing polluting industries in the Eco-sensitive Zone shall be permitted.
Only non-polluting industries shall be allowed within Ecosensitive Zone as per classification of Industries in the Guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
5. Establishment of new major thermal and hydroelectric projects.
Prohibited (except as otherwise provided) as per applicable laws.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
7. Use of plastic bags. Prohibited (except as otherwise provided) as per applicable laws.
8. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.
Prohibited (except as otherwise provided) as per applicable laws.
9. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
10. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within Eco sensitive Zone. Further, installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is prohibited.
11. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
12. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
13. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Ecotourism activities:
Provided that, beyond one kilometre from the boundary of ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23 the Protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
14. Construction activities. No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 6 as per building bye-laws to meet the residential needs of the local residents such as,-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) cottage industries including village industries;
convenience stores & local amenities supporting ecotourism including home stays; and
(iv) promoted activities listed in this Notification.
15. Trenching ground. Establishment of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws.
16. Protection of Hill Slopes and river banks. Regulated under applicable laws.
17. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
18. Air and Vehicular Pollution. Regulated under applicable laws.
19. Noise pollution. Regulated under applicable laws.
20. Commercial extraction of surface and ground water.
Regulated under applicable law.
21. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the relevant Central or State Act and 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] the rules made thereunder.
22. Migratory graziers. Regulated under applicable laws and as per Zonal Master Plan.
23. Existing establishments. Regulated under applicable laws.
24. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law. Underground cabling may be promoted.
25. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
26. Fencing of existing premises of hotels and lodges.

C. Promoted Activities
35. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
36. Organic farming. Shall be actively promoted.
37. Adoption of green technology for all activities Shall be actively promoted.
38. Cottage industries including village artisans, etc.
Shall be actively promoted.
39. Rain water harvesting. Shall be actively promoted.
40. Small scale non polluting industries. 5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:- (i.) Collector, District, Balodabazar - Chairman;
(ii.) Chief Executive Officer, District Panchayat, Balodabazar - Member;
(iii.) Superintending Engineer, Public Work Department Balodabazar - Member;
(iv.) Superintending Engineer Public Health Department Balodabazar - Member;
(v.) One expert in the area of wildlife, ecology and environment to be nominated by the Government of Chhattisgarh for a period of three years in each case - Member;
(vi.) Representative of Non-Governmental Organisation working in the field of natural conservation (including heritage conservation) to be nominated by the Government of Chhattisgarh for a period of three years in each case.
- Member;
(vii.) Member/ Member Secretary, State Biodiversity Board - Member;
(viii.) Representative of Chhattisgarh Pollution Control Board - Member;
(ix.) Superintendent, Barnawapara Wildlife Sanctuary - Member; and (x.) Divisional Forest Officer, Balodabazar -Member Secretary.
6. Terms of Reference:
(1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of Notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment, 2006 vide S.O. number 1533 (E), dated the 14th September, 2006, and Coastal Regulation Zone, 2011 vide number S.O. No. 19(E) dated 6th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
41. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted.
42. Agro-Forestry. Shall be actively promoted.
43. Use of eco-friendly transport. Shall be actively promoted.
44. Skill Development. Shall be actively promoted.
45. Restoration of Degraded Land/ Forests/ Habitat.
Shall be actively promoted.
46. Environmental Awareness. Shall be actively promoted.
26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] industries shall be considered as specified in the guidelines issued by the Central Pollution Control Board for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and S.O. 19 (E) dated 6th January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State under intimation to Ministry of Environment Forest and Climate Change as per proforma appended at Annexure III .
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
