PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2015] ubZ fnYyh] c`gLifrokj] tqykbZ 20] 2017@vk"kk<+ 29] 1939 No. 2015] NEW DELHI, THURSDAY, JULY 20, 2017/ASADHA 29, 1939 पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢ ालय अिधसचूना नई िदल्ली 19 जुलाई, 2017 का.आ. 2273(अ).—ᮧारुप अिधसूचना भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं. का.आ. 252(अ), तारीख 27 जनवरी, 2016 ᳇ारा भारत के राजपᮢ असाधारण मᱶ ᮧकािशत की गई थी िजसमᱶ उन सभी ᳞िᲦयᲂ से, िजनको उससे ᮧभािवत होने की संभावना थी, उस तारीख से, िजसको उᲦ अिधसूचना की राजपᮢ की ᮧितयां जनता को उपलब्ध करा दी गई थी, साठ िदन की अविध के भीतर, आक्षेप और सुझाव आमंिᮢत िकए गए थे;
और, उᲦ ᮧारुप अिधसूचना के ᮧत्युᱫर मᱶ ᳞िᲦयᲂ और पणधािरयᲂ से कोई टीका िटप्पिणयां या आक्षेप और सुक्षाव ᮧा᳙ नहᱭ हुए थे;
पामेड वन्यजीव अभयारण्य छᱫीसगढ़ के िजला बीजापुर, मᱶ िस्थत ह ैऔर 442.23 वगर् िकलोमीटर के क्षेᮢ मᱶ फैला हुआ ह।ै अभयारण्य वनस्पित एवं जीवजंतु के िविभ᳖ ᮧजाितयᲂ के समृ ᮧाकृितक वास के िलए ᮧिस ह।ै महᱬवपूणर् वनस्पित मᱶ सागौन (टेक्टोना ᮕᱹिडस), शीशम (डाल्बिगर्या लैिटफ़ोिलया), कुसुम (᳣ेकेचरा ऑिलओसा), महुआ (मधुका इंिडका), तᱶद ु (डायिस्परोस मेलेनोिक्सलॉन), बांस (डेन्ᮟोकालेमास कडक), आिद ह।ᱹ अभयारण्य मᱶ महᱬवपूणर् जीवजंतु तᱶदआु (पᱶथेरा पादर्स), नीलगाय (बोसेलफस ᮝागोकैमेलस), साभंर (रूसा यूनीक्लोरर), बनैला सूअर (सूस स्ᮓोफा), जंगली कुᱫा (लाइकाओन पेक्ट्स), जंगली िबल्ली (फेिलस िसलवेिस्टस), मोर (पावो िᮓस्टटस), लंगूर, लघु पुच्छ वानर (मैकाक एसपी.), चीतल (एिक्सस एिक्सस), रीछ (मेलुस यूरसीन्स), साही (हाइस्ᮝीक्स इंिडका), िसयार (कैिनस ऑिरयस) इत्यािद ह।ᱹ अभयारण्य उष्णकिटबंधीय नम िमि᮰त पणर्पाती वन, 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] उष्णकिटबंधीय शुष्क पणर्पाती वन, िमि᮰त वन, शुष्क सदाबहार वन, और जलीय वनस्पित से िमलकर बना ह।ै अभयारण्य इन्दरावती ᳞ाᮖ िरजवर् के िलए ᮧाकृितक आवास के िवस्तार की भी ᳞वस्था करता ह ै। और, पामेड वन्यजीव अभयारण्य के चारᲂ ओर के के्षᮢ को, िजसका िवस्तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸दर᳥् ह,ᱹ पािरिस्थितक और पयार्वरण की दिृ᳥ से पािरिस्थितक संवेदी जोन के रूप मᱶ सुरिक्षत और संरिक्षत करना तथा उᲦ पािरिस्थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ के ᮧचालन तथा ᮧसंस्करण करने को ᮧितिष करना आवश्यक ह;ै अतः, अब, केन्ᮤीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पिठत पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते हुए, छᱫीसगढ़ राज् य मᱶ पामेड वन्यजीव अभयारण्य के चारᲂ ओर 0 मीटर से 1 िकलोमीटर तक के िवस् तािरत क्षेᮢ को पामेड वन्यजीव अभयारण्य पािरिस् थितक संवेदी जोन (िजसे इसमᱶ इसके पश् चात् पािरिस् थितक सवेंदी जोन कहा गया ह)ै के रूप मᱶ अिधसूिचत करती ह,ै िजसके ब्यौरे िन᳜ानुसार ह,ै अथार्त ्:--
1. पािरिस्थितक सवंदेी जोन का िवस्तार और उसकी सीमाएं--(1) पािरिस् थितक संवेदी जोन अक्षांश 18° 26’ 04” उ० से 18° 11’ 31” उ० और 80° 43’ 57” पू० से 81° 03’ 57” पू० देशांतर के बीच िस्थत ह।ै अभयारण्य के पि᳟मी िदशा के िहस्से को छोड़ते हुए, िजसकी सीमा तेलंगाना राज्य के साथ िमलती ह,ै पामेड वन्यजीव अभयारण्य की सीमा के चारᲂ ओर 1 िकलोमीटर के िवस्तार के साथ 62.73 वगर् िकलोमीटर के क्षेᮢ मᱶ फैला हुआ ह।ै
(2) भ-ूिनदᱷशांकᲂ के साथ-साथ पािरिस्थितक संवेदी जोन की सीमा को िवभािजत करते हुए पामेड वन्यजीव अभयारण्य का मानिचᮢ उपाबंध I के रुप मᱶ संलᲨ ह ै।
(3) ᮧमुख िबंदᲐु के भू-िनदᱷशांकᲂ के साथ-साथ पािरिस्थितक संवेदी जोन के अंतगर्त आने वाले ᮕामᲂ की सूची उपाबधं II के रुप मᱶ संलᲨ है ।
2. पािरिस्थितक सवंदेी जोन के िलए आंचिलक महायोजना –(1) राज्य सरकार, पािरिस् थितक संवेदी जोन के ᮧयोजन के िलए, राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन की तारीख स ेदो वषर् की अविध के भीतर, स्थानीय ᳞िᲦयᲂ के परामशर् से और इस अिधसूचना मᱶ िदए गए अनुबंधᲂ का पालन करते हुए एक आंचिलक महायोजना तैयार करेगी।
(2) इस ᮧकार तैयार की गई आंचिलक महायोजना अिधसूचना मᱶ िविन᳸दर᳥् शतर् के अनुरूप होगी और उसमᱶ पयार्वरणीय िववक्षाएं शािमल हᲂगे।
(3) आंचिलक महायोजना का राज् य सरकार मᱶ सक्षम ᮧािधकारी ᳇ारा अनुमोदन िकया जाएगा ।
(4) पािरिस् थितक संवेदी जोन के िलए आंचिलक महायोजना राज्य सरकार ᳇ारा ऐसी रीित से जो इस अिधसूचना मᱶ िविन᳸दर्ष् ट की जाए और सुसगंत कᱶ ᮤीय और राज् य िविधयᲂ के और कᱶ ᮤीय सरकार ᳇ारा जारी मागर्दशर्क िसांतᲂ, यिद कोई हᲂ, के अनुरुप तैयार की जाएगी ।
(5) आंचिलक महायोजना, सभी संबंिधत राज्य िवभागᲂ के परामशर् से तैयार की जाएगी, अथार्त्:--
(i) पयार्वरण ;
(ii) वन ;
(iii) शहरी िवकास ;
(iv) पयर्टन ;
(v) नगरपािलका ;

(vi) राजस् व ;
(vii) कृिष ;
(viii) छᱫीसगढ़ राज् य ᮧदषूण िनयंᮢण बोडर् ;
(ix) िसंचाई; और
(x) लोक िनमार्ण िवभाग ।
(6) आंचिलक महायोजना अनुमोिदत िव᳒मान भू-उपयोग, अवसंरचनात् मक और िᮓयाकलापᲂ पर तब तक कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक िक इस अिधसूचना मᱶ और आचंिलक महायोजना मᱶ सभी अवसंरचना और अिधक दक्ष और पािरिस् थितक अनुकूल होने वाले िᮓयाकलाप के सुधार मᱶ कारक इस ᮧकार िविन᳸दर्ष् ट न िकए गए ।
(7) आंचिलक महायोजना मᱶ अनाच्छािदत क्षेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरक्षण, आवाह क्षेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, जल के ᮧबंधन, मृदा और आᮤता संरक्षण, स्थानीय समुदायᲂ की आवश्यकताᲐ तथा पािरिस्थितक और पयार्वरण के ऐस ेअन्य पहलुᲐ, िजन पर ध्यान दनेा आवश्यक ह,ै के िलए उपबंध हᲂग े।
(8) आंचिलक महायोजना सभी िव᳒मान पूजा स् थलᲂ, ᮕामᲂ और शहरी बिस्तयᲂ, वनᲂ के ᮧकार और िकस् मᲂ, कबीले के्षᮢᲂ, कृिष क्षेᮢᲂ, ऊपजाऊ भूिम, हिरत क्षेᮢ जैसे उ᳒ान और उसी ᮧकार के स् थान, उ᳒ान कृिष क्षेᮢ, फलोउ᳒ान, दलदली जमीन, झीलᲂ और अन्य जल िनकायᲂ का अभ्यकंन करेगी और इसके साथ समथर्नकारी मानिचᮢ भी होगा योजना िव᳒मान और ᮧस्तािवत भूिम के उपयोग की िवशेषताᲐ के ब्यौरे दतेे हुए मानिचᮢᲂ ᳇ारा समिथर्त होगी ।
(9) आंचिलक महायोजना पािरिस् थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगी और अिधसूचना मᱶ िविन᳸दर᳥् ᮧितिष, िविनयिमत तथा संविधर्त िᮓयाकलापᲂ का अनुसरण करेगी िजससे स्थानीय समुदायᲂ की आजीिवका की सुरक्षा के िलए पािरिस्थितक अनुकूल िवकास सुिनि᳟त िकया जा सकᱶ । ।
(10) आंचिलक महायोजना इस अिधसूचना मᱶ िदए गए उपबंधᲂ के संबंध मᱶ िनगरानी के अपने कायᲄ को करने के िलए िनगरानी सिमित के िलए एक संदभर् दस्तावेज होगा।
3. राज्य सरकार ᳇ारा िकए जान ेवाले उपाय-- राज्य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथार्त् :--
(1) भू-उपयोग - पािरिस् थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष के्षᮢᲂ, कृिष क्षेᮢᲂ, आमोद-ᮧमोद के ᮧयोजनᲂ के िलए अिभिनि᳟त िकए गए पाकᲄ और खुल े स्थानᲂ का वािणिज्यक या औ᳒ोिगक संब िवकास िᮓयाकलापᲂ के िलए उपयोग नहᱭ होगा या उनके िलए क्षेᮢᲂ मᱶ संपिरवतर्न नहᱭ होगा :
परंतु पािरिस्थितक संवेदी जोन के भीतर कृिष भूिम का संपिरवतर्न, िनगरानी सिमित की िसफािरश पर और राज्य सरकार के पूवर् अनुमोदन स,े स्थानीय िनवािसयᲂ की आवासीय जरूरतᲂ को पूरा करने के िलए और पैरा 4 की सारणी के स्तंभ (2) मᱶ सूचीब िᮓयाकलापᲂ के िलए अनुज्ञात हᲂगे, अथार्त् :-
(i) पािरिस् थितक अनुकूल पयर्टन िᮓयाकलापᲂ के िलए पयर्टकᲂ के अस् थायी आवासन के िलए पािरिस् थितक अनुकूल कुटीर जैसे टᱶट, लकड़ी के मकान आिद ;
(ii) िव᳒मान सड़कᲂ को चौड़ा करना तथा उन्हᱶ मजबूत करना ;
(iii) ᮧदषूण उत्प᳖ न करने वाले लघु उ᳒ोग ;
(iv) वषार् जल संचयन; और
(v) कुटीर उ᳒ोगᲂ िजनके अंतगर्त ᮕामीण कारीगर भी ह।ᱹ 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु यह और भी िक राज्य सरकार के पूवर् अनुमोदन तथा संिवधान के अनुच्छेद 244 और तत्समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अिधकारᲂ की मान्यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिज्यक और उ᳒ोग िवकास िᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनुज्ञात नहᱭ होगा:
परंतु यह भी िक पािरिस् थितक संवेदी जोन के भीतर भ-ूअिभलेखᲂ मᱶ कोई ᮢुिट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् राज्य सरकार ᳇ारा ᮧत्येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुिट के संशोधन की सूचना कᱶ ᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को दी जाएगी । परंतु यह और भी िक उपयुर्Ღ ᮢुिट के संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय िकसी भी दशा मᱶ भू-उपयोग का पिरवतर्न सिम्मिलत नहᱭ होगा। परन्तु यह और भी िक हिरत क्षेᮢ जैसे वन के्षᮢ और कृिषक्षेᮢ मᱶ कोई पािरणािमक कटौती नहᱭ होगी और अनᮧयुक् त या अनुत् पादक कृिष क्षेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास िकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोतᲂ -- सभी ᮧाकृितक जल ᮲ोतᲂ के आवाह क्षेᮢᲂ की पहचान की जाएगी और उनके संरक्षण और पुनरुद्भूतकरण के िलए योजनाएं आचंिलक महायोजना सिम् मिलत की जाएंगी और राज् य सरकार ᳇ारा ऐसी के्षᮢ आवाह संबंध योजना ऐसी रीित मᱶ तैयार की जाएगी िजससे आवाह के्षᮢᲂ के भीतर िवकास िᮓयाकलापᲂ ᮧितिष या ᮧितबंिधत िकया जा सके ।
(3) पािरिस्थितक पयर्टन – (क) पािरिस्थितक संवेदी जोन के भीतर पयर्टन संबंधी िᮓयाकलाप पािरिस्थितक पयर्टन महायोजना के अनुसार हᲂगे जो आंचिलक महायोजना का भाग होगा । (ख) पयर्टन महायोजना पयर्टन िवभाग, छᱫीसगढ़ सरकार ᳇ारा राजस्व और वन िवभाग, छᱫीसगढ़ सरकार के परामशर् से तैयार होगी । (ग) पयर्टन महायोजना आंचिलक महायोजना के एक घटक के रूप मᱶ होगी । (घ) पयर्टन सबंंधी िᮓयाकलाप िन᳜ानुसार िविनयिमत हᲂगे, अथार्त् :-
(i) पामेड वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन के िवस्तार तक, इनमᱶ जो भी िनकट ह,ै नये वािणिज्यक होटल और िरसोटर् का संिनमार्ण अनुज्ञात नहᱭ होगा। तथािप, वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर की दरूी से परे पािरिस्थितक संवेदी जोन के िवस्तार तक, नए होटलᲂ और सैरगाहᲂ का स्थापन केवल पूवर् पिरिनि᳟त क्षेᮢᲂ मᱶ पयर्टन महायोजना के अनुसार पािरिस्थितक पयर्टन सुिवधाᲐ के िलए ही अनुज्ञात होगा;
(ii) पािरिस्थितक संवेदी जोन के भीतर नए पयर्टन िᮓयाकलापᲂ या िव᳒मान पयर्टन िᮓयाकलापᲂ का िवस्तार कᱶ ᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय ᳇ारा जारी मागर्दशर्क िसांतᲂ के तथा राष् ᮝीय व् याᮖ संरक्षण ᮧािधकरण, ᳇ारा जारी पािरिस्थितक पयर्टन पर जोर दतेे हुए मागर्दशर्क िसांतᲂ (समय-समय पर यथा संशोिधत) होगा;
(iii) आंचिलक महायोजना का अनुमोदन िकए जाने तक, पयर्टन के िलए िवकास और िव᳒मान पयर्टन िᮓयाकलापᲂ के िवस्तार को वास्तिवक स्थल िविन᳸दर᳥् संवीक्षा तथा मानीटरी सिमित की िसफािरश पर आधािरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनुज्ञात िकया जाएगा । ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(4) नसैिगर्क िवरासत -- पािरिस्थितक संवेदी जोन मᱶ महत्वपूणर् नैसिगर्क िवरासत के सभी स्थलᲂ जैसे सभी जीन कोश आरिक्षत क्षेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, स्थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आिद की पहचान की जाएगी और उन्हᱶ संरिक्षत िकया जाएगा तथा उनकी सरंक्षा और पिररक्षण के िलए इस अिधसूचना के ᮧकाशन की तारीख स ेछह मास की अविध के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगी ।
(5) मानव िनिमर्त िवरासत स् थलᲂ - पािरिस् थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िशल्प-तथ्य तथा ऐितहािसक पुरातत्वीय, कलात्मक और सांस्कृितक महत्व के क्षेᮢᲂ की पहचान करेगी और इस अिधसूचना के ᮧकाशन की तारीख स े छह मास की अविध के भीतर उनके संरक्षण की योजनाएं तैयार की जाएंगी तथा आंचिलक महायोजना मᱶ सिम्मिलत की जाएगी ।
(6) ध् विन ᮧदषूण – राज्य सरकार का पयार्वरण िवभाग या छᱫीसगढ़ राज्य ᮧदषूण िनयंᮢण बोडर् पयार्वरण (संरक्षण) अिधिनयम, 1986 के अधीन ध्विन ᮧदषूण (िविनयमन तथा िनयंᮢण) िनयम, 2000 के अनुबंिधत उपबंधᲂ के अनुसार पािरिस्थितक संवेदी जोन मᱶ ध्विन ᮧदषूण के िनयंᮢण के िलए िविनयमᲂ को िᮓयािन्वत करेगा ।
(7) वाय ु ᮧदषूण -- पािरिस्थितक संवेदी जोन मᱶ वायु ᮧदषूण के िनयंᮢण के िलए वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम 1981 (1981 का 14) और इसके अधीन िकए गए िविनयमᲂ के अनुसार अनुपालन िकया जाएगा ।
(8) बिह᮲ाव का िनस्सारण -- बिह᮲ावᲂ का िनस्सारण पािरिस्थितक जोन मᱶ उपचािरत बिह᮲ाव का िनस्सारण पयार्वरण (संरक्षण) अिधिनयम, 1986 तथा तदधीन बनाए गए िनयमᲂ के अंतगर्त आने वाले पयार्वरणीय ᮧदषूक तत्वᲂ के िनवर्हन के िलए साधारण मानकᲂ के उपाबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत रूप मᱶ होगा -
(i) पािरिस्थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा ;
(ii) अकाबर्िनक सामᮕी का पािरिस्थितक संवेदी जोन बा᳭ पहचान की गई स्थल पर पयार्वरण स्वीकायर् रीित मᱶ ᳞यन िकया जाएगा ;
(iii) ठोस अपिश᳥ᲂ के ज्वलन या भस्मीकरण और भराई के स्थापना को पािरिस्थितक संवेदी जोन मᱶ अनुज्ञा नहᱭ की जाएगी ;
(10) जैव िचिकत् सीय अपिशष् ट- पािरिस्थितक संवेदी जोन मᱶ जैव िचिकत्सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय समय पर यथासंशोिधत अिधसूचना सं.का.िन 343 (अ), तारीख 28 माचर् 2016 ᳇ारा ᮧकािशत जैव िचिकत्सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा ।
(i) पािरिस्थितक संवेदी जोन मᱶ कोई सामान्य उपचार सिुवधा या भस्मीकरण अनुज्ञात नहᱭ िकया जाएगा ।
(ii) पािरिस्थितक संवेदी जोन मᱶ पहले से ही ᳞िᲦगत अस्पतालᲂ या िनजी स्वास्थ्य कᱶ ᮤᲂ के सरंिक्षत के्षᮢ पर ᮧितकूल असर से बचने के िलए पयार्᳙ अपिश᳥ उपचार ᮧणाली ᮧदान करनी चािहए। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(11) प्लािस्टक अपिश᳥ ᮧबधंन: - पािरिस्थितक संवेदी जोन मᱶ प्लािस्टक अपिश᳥ ᮧबंध भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय समय पर यथासंशोिधत अिधसूचना सं.का.िन 340(अ), तारीख 18 माचर्, 2016 ᳇ारा ᮧकािशत प्लािस्टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार िकया जाएगा।
(12) सिंनमार्ण और िवध्वसं अपिश᳥ ᮧबंधन: - पािरिस्थितक संवेदी जोन मᱶ संिनमार्ण और िवध्वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय समय पर यथासशंोिधत अिधसूचना सं.का.िन 317(अ), तारीख 29 माचर्, 2016 ᳇ारा ᮧकािशत संिनमार्ण और िवध्वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा।
(13) ई–अपिश᳥:- पािरिस्थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय ᳇ारा ᮧकािशत और समय समय पर यथा संशोिधत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा।
(14) यानीय पिरवहन: - पिरवहन की यानीय गितिविधयां आवास के अनुकूल रीित मᱶ िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध समािव᳥ िकए जाएंगे और आंचिलक महायोजना के तैयार होने और राज्य सरकार के सक्षम ᮧािधकारी ᳇ारा के अनुमोिदत होने तक, िनगरानी सिमित ससुंगत िनयमᲂ और तीन बनाए गए िविनयमᲂ के अधीन यानीय संचलन के अनुपालन की िनगरानी करेगी ।
(15) औ᳒ोिगक इकाइया:ं - (क) ᮧस्तािवत पािरिस्थितक संवेदी जोन के भीतर नए का᳧ आधािरत उ᳒ोगᲂ की स्थापना की अनुमित िविध के अनुसार स्थािपत िव᳒मान का᳧ आधािरत उ᳒ोगᲂ की दी जाएगी अन्यथा नहᱭ। (ख) ᮧस्तािवत पािरिस्थितक संवेदी जोन के भीतर जल, वायु, मृदा, ध्विन ᮧदषूण कािरत करने वाले िकसी नए उ᳒ोग की स्थापना को अनुमित नहᱭ दी जाएगी ।
(16) यिद यह आवश्यक समझा जाए, इस अिधसूचना के उपबंधᲂ को ᮧभावी करने मᱶ केन्ᮤीय सरकार और राज्य सरकार, अन्य उपायᲂ को िविन᳸दर᳥् करेगी।
4. पािरिस्थितक सवंेदी जोन मᱶ ᮧितिष या िविनयिमत िकए जान ेवाले सवंिधर्त िकए जान ेवाल ेिᮓयाकलापᲂ की सचूी - पािरिस्थितक संवेदी जोन मᱶ सभी िᮓयाकलाप पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई सारणी मᱶ िविन᳸दर᳥् रीित मᱶ िविनयिमत हᲂगे, अथार्त् :-- सारणी ᮓम सं. िᮓयाकलाप टीका-िटप्पणी
(1) (2) (3) ᮧितिष िᮓयाकलाप
1. वािणिज्यक खनन, पत्थर की खदान और उनको तोड़ने की इकाइयां । (क) सभी नए और िव᳒मान (लघु और वृहत खिनज), पत्थर का उत्खनन और उनको तोड़ने की इकाइयां वास्तिवक स्थानीय िनवािसयᲂ की घरेलू आवश्यकताᲐ के िसवाय तुरन्त ᮧभाव से ᮧितिष की जाती ह ᱹिजसमᱶ मकानᲂ के संि᳖मार्ण या मरम्मत के िलए भूिम को खोदना और मकान बनाने तथा अन्य िᮓयाकलापᲂ के िलए दशेी टाइलᲂ या ईटᲂ का िनमार्ण भी सिम्मिलत ह;ै (ख) सभी खनन संिᮓयाएं 1995 की िरट यािचका (सी) सं. 202 मᱶ टी एन गोदा वमर्न िथरुमूलपाद बनाम भारत संघ के मामले मᱶ और 2010 की िरट यािचका (सी) सं. 435 मᱶ गोवा फाउंडेशन बनाम भारत संघ ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 के मामले मᱶ माननीय उᲬतम न्यायालय के आदेश तारीख 4 अगस्त, 2006 और आदशे तारीख 21 अᮧैल, 2014 के अनुसार की जाएंगी ।
2. आरा िमलᲂ की स्थापना । पािरिस्थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िवस् तार अनुज्ञात नहᱭ होगा ।
3. जल या वायु या मृदा या ध् विन ᮧदषूण, इत्यािद कािरत करने वाले उ᳒ोगᲂ की स् थापना । पािरिस्थितक संवेदी जोन मᱶ िकसी नए उ᳒ोगᲂ और ᮧदषूण फैलाने वाले िव᳒मान उ᳒ोगᲂ के िवस्तार की अनुमित नहᱭ दी जाएगी। पािरिस्थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा फरवरी, 2016 मᱶ जारी मागर्दशर्क िसांतᲂ के वगᱮकरण के अनुसार केवल गैर-ᮧदिूषत उ᳒ोगᲂ की स्थापना की अनुमित दी जाएगी, जब तक िक इस अिधसूचना मᱶ इस ᮧकार िविन᳸दर᳥् न हो। इसके अलावा, गैर ᮧदषूणकारी कुटीर उ᳒ोगᲂ को बढ़ावा िदया जाएगा।
4. जलावन लकड़ी का वािणिज्यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
5. नई बृहत जल िव᳒ुत पिरयोजना और िसंचाई पिरयोजना की स्थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
6. िकन्ही पिरसंकटमय पदाथᲄ िजनके अंतगर्त कीटनाशी और कीटनाशक का उपयोग या उत्पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
7. ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢ मᱶ अनुपचािरत बिह᮲ार्व और ठोस अपिश᳥ᲂ का िनस्सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) ।
8. पयर्टन से संबंिधत िᮓयाकलाप जैसे गमर् वायु गुब्बारᲂ, हलेीकाप्टर, ᮟोन, माइᮓालाइट, आिद ᳇ारा पािरिस्थितक संवेदी जोन क्षेᮢ के ऊपर से उड़ना जैसे िᮓयाकलाप करना। लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे ।
9. नए का᳧ आधािरत उ᳒ोग । पािरिस् थितक संवेदी जोन की सीमाᲐ के भीतर नए का᳧ आधािरत उ᳒ोग की स् थापना अनुज्ञात नहᱭ होगी :
परंतु िव᳒मान का᳧ आधािरत उ᳒ोग िविध के अनुसार बना रहगेा । परंतु यह और िक िव᳒मान आरा िमलᲂ की अनुज्ञि᳙यᲂ का नवीकरण उनकी समाि᳙ अविध पर नहᱭ िकया जाएगा ।
10. ठोस अपिश᳥ िनपटान स्थल की स्थापना और ठोस और जैव िचिकत्सा अपिश᳥ के िलए सामान्य जलाए जाने की सुिवधा । पािरिस्थितक संवेदी जोन मᱶ िकसी नए ठोस अपिश᳥ िनपटान स्थल और ठोस अपिश᳥ उपचार/ᮧसंस्करण सुिवधा अनुज्ञात नहᱭ होगी । औ᳒ोिगक ᮧिᮓया और स्वास्थ्य स्थापना/अस्पतालᲂ आिद से उत्प᳖ िकसी भी ᮧकार के ठोस अपिश᳥ के उपचार के िलए सामान्य या ᳞िᲦगत जलावतरण की सुिवधा का अितिरᲦ संस्थापन ᮧितिष ह ै।
11. फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणिज्यक पशुधन संपदा और कुक्कुट फामᲄ की स्थापना । स्थानीय जरूरतᲂ को पूरा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे।
12. ईंट भᲵᲂ की स्थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे । िविनयिमत िᮓयाकलाप
13. प्लािस्टक के कैरी बैग, लैिमलेटᲂ और लागू िविधयᲂ के अनुसार िविनयिमत। प्लािस्टक की वस्तुᲐ, लैिमलेटᲂ 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] टेᮝापैकᲂ का उपयोग । और टेᮝापैकᲂ का िनपटान सवर्दा िविनयिमत और मानीटर िकया जाएगा ।
14. होटलᲂ और िरसोटᲄ की वािणिज्यक स्थापना । पािरिस्थितक पयर्टन िᮓयाकलापᲂ संबंधी पयर्टकᲂ की लघु अस्थायी संरचनाᲐ के िलए संरिक्षत क्षेᮢ की सीमा से एक िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन के िवस्तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणिज्यक होटल और िरसोटर् अनुज्ञात हᲂगे, अन्यथा नहᱭ :
परंतु, संरिक्षत क्षेᮢ की सीमा के एक िकलोमीटर से आगे या पािरिस्थितक संवेदी जोन के िवस्तार तक सभी नए पयर्टक िᮓयाकलाप या िव᳒मान िᮓयाकलाप का िवस्तार पयर्टन महायोजना और यथा लागू मागर्दशᱮ िसांतᲂ के अनुरुप होगा।
15. संिनमार्ण िᮓयाकलाप । संरिक्षत क्षेᮢ की सीमा से एक िकलामीटर के भीतर या पािरिस्थितक संवेदी जोन के िवस्तार तक, जो भी िनकट हो, िकसी भी ᮧकार का वािणिज्यक संिनमार्ण अनुज्ञात नहᱭ िकया जाएगा:
परंतु स् थानीय लोगᲂ को पैरा 6 के उप पैरा (1) मᱶ सूचीब िᮓयाकलापᲂ सिहत उनके उपयोग के िलए उनकी भूिम मᱶ संिनमार्ण करने की अनुमित स्थानीय िनवािसयᲂ की आवासीय आवश्यकताᲐ को पूरा करने की भवन उपिविधयᲂ के अनुसार दी जाएगी ।
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमार्ण;
(ii) बुिनयादी ढांचᲂ और नागिरक सुिवधाᲐ का संिनमार्ण और नवीकरण;
(iii) कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भण्डार और स्थानीय सुख सुिवधाᲐ जो पािरिस्थितक पयर्टन मᱶ िजस मᱶ गृह वास सहायक हो; और
(iv) इस अिधसूचना मᱶ सूचीब संविधर्त िᮓयाकलाप ।
16. वृक्षᲂ की कटाई । (क) राज्य सरकार मᱶ सक्षम ᮧािधकारी की पूवर् अनुमित के िबना वन, सरकारी या राजस्व या िनजी भूिम पर या वनᲂ मᱶ वृक्षᲂ की कटाई नहᱭ होगी । (ख) वृक्षᲂ की कटाई संबंिधत कᱶ ᮤीय या राज्य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार िविनयिमत होगी ।
17. वािणिज्यक जल संसाधन िजसके अंतगर्त भू-जल संचयन भी ह ै। (क) भूिम के अिधभोगी के वास्तिवक कृिष उपयोग और घरेलू खपत के िलए ही सतही और भूिमगत जल का िनष्कषर्ण अनुज्ञात होगा । (ख) औ᳒ोिगक या वािणिज्यक उपयोग के िलए सतही और भूिमगत जल के िनष्कषर्ण िजसके अंतगर्त वह भाग माᮢा िजसका िनष्कषर्ण िकया जा सकती ह ै के िलए संबंिधत िविनयामक ᮧािधकारी से पूवर् िलिखत अनुज्ञा अपेिक्षत होगी । (ग) सतही या भूजल का िवᮓय अनुज्ञात नहᱭ होगा । (घ) िकसी भी ᮲ोत से, िजसके अंतगर्त कृिष भी ह,ै जल के संदषूण या ᮧदषूण को रोकने के िलए सभी उपाय िकए जाएंगे ।
18. िव᳒ुत और दरूसंचार टावरᲂ का पिरिनमार्ण और केबल िबछाना और भूिमगत केबलᲂ को बढ़ावा िदया जाएगा। िव᳒मान िसरोपिर िव᳒ुत केबलᲂ को आंचिलक महायोजना के अनुसार िविन᳸दर᳥् अविध के भीतर ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 अन्य बुिनयादी ढांचे । िव᳒ुतरोधी बनाया जाएगा।
19. होटलᲂ और लॉज के िव᳒मान पिरसरᲂ मᱶ बाड लगाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
20. िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना तथा नवीन सड़कᲂ का संिनमार्ण । लागू िविधयᲂ के अनुसार, न्यूनीकरण के उपायᲂ के साथ, लागू िविधयᲂ िनयम और िविनयमन और उपलब्ध िदशािनदᱷशᲂ के अनुसार होगा।
21. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणिज्यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
22. िवदेशी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
23. पहाड़ी ढालᲂ और नदी तटᲂ का संरक्षण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
24. ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢ मᱶ उपचािरत बिह᮲ार्व का िनस्सारण । उपचािरत उपिश᳥ जल/बिह᮲ार्व के िनस्सारण से बचा जाएगा िजसमᱶ जल िनकायᲂ मᱶ जल ᮧवेश न करे । उपचािरत अपिश᳥ जल के पुन:चᮓण और पुन:उपयोग के िलए ᮧयास िकए जाएंगे अन्यथा लागू िविधयᲂ के अनुसार उपचािरत अपिश᳥ जल/ बिह᮲ार्व के िनस्सारण को िविनयिमत िकया जाएगा।
25. वािणिज् यक साइन बोडर् और होिडᲈग्स । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
26. वन उत्पादᲂ और गैर काष् ठ वन उत्पादᲂ का संᮕहण।(एन.टी.एफ.पी.)
लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
27. वायु और यानीय ᮧदषूण। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. कृिष ᮧणाली मᱶ भारी बदलाव। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
29. नागिरक सुख सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ के अनुसार न्यूनीकरण के उपायᲂ के साथ, िविधयᲂ, िनयमᲂ और िविनयमनᲂ और उपलब्ध िदशािनदᱷशᲂ के अनुसार िविनयिमत हᲂगे।
30. खुले कंुआ, बोर कुआ, आिद के िलए कृिष और अन्य उपयोग । िविनयिमत हᲂगे और समुिचत ᮧािधकारी ᳇ारा िᮓयाकलापᲂ की सख्ती से मानीटरी की जाएगी।
31. ठोस अपिशष् ट ᮧबंधन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
32. पािरिस्थितक पयर्टन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । संविधर्त िᮓयाकलाप
33. स्थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी पितयᲂ के साथ डेयरी, पशुपालन कृिष जलकृिष और मछली पालन । स्थानीय िनवािसयᲂ के उपयोग िक िलए लागू िविधयᲂ के अधीन अनुज्ञात हᲂगे ।
34. ᮧदषूण उत्प᳖ न करने वाले लघु उ᳒ोग । फरवरी, 2016 मᱶ केन्ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा जारी उ᳒ोगᲂ के वगᱮकरण के अनुसार गैर-ᮧदषूणकारी उ᳒ोग और अपिरसंकट मᱶ, लघु और सेवा उ᳒ोग, कृिष, पुष्प कृिष, उ᳒ान कृिष या पािरिस्थितक संवेदी जोन से दशेी सामᮕी से उत्पादᲂ को उत्प᳖ करने वाले कृिष आधािरत उ᳒ोग सक्षम ᮧािधकारी ᳇ारा अनुज्ञात हᲂगे।
35. वषार् जल संचयन । सिᮓ य रूप से बढ़ावा िदया जाएगा ।
36. जैिवक खेती। सिᮓय रूप से बढ़ावा िदया जाएगा ।
37. सभी गितिविधयᲂ के िलए हिरत ᮧौ᳒ोिगकी को अंगीकृत करना । सिᮓय रूप से बढ़ावा िदया जाएगा ।
38. कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण कारीगर भी ह ᱹ। सिᮓय रूप से बढ़ावा िदया जाएगा । 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
39. नवीकरणीय ऊजार् ᮲ोत और ईंधन का उपयोग । बायोगैस, सौर ᮧकाश इत् यािद को सिᮓय रुप से बढ़ावा िदया जाना ह ै।
40. कृिष वािनकी । सिᮓ य रूप से बढ़ावा िदया जाएगा ।
41. पािरिस्थितक अनुकूल पिरवहन का उपयोग । सिᮓय रूप से बढ़ावा िदया जाएगा ।
42. कौशल िवकास । सिᮓ य रूप से बढ़ावा िदया जाएगा ।
43. िन᳜ीकृत भूिम या वन या ᮧाकृितक वास का जीणᲃार । सिᮓय रूप से बढ़ावा िदया जाएगा ।
44. पयार्वरणीय जागरुकता । सिᮓ य रूप से बढ़ावा िदया जाएगा ।
5. मानीटरी सिमित.- (1) कᱶ ᮤीय सरकार, पािरिस्थितक संवेदी जोन की ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत स ेिमलकर बनेगी, अथार्त् :- (क) ᮧभागीय आयुᲦ, जगदलपुर - अध्यक्ष ;
(ख) कलक्टर, िजला बीजापुर– सदस् य ;
(ग) उप िनदशेक, इंᮤावती रा᳦ीय पाकर् , बीजापुर- सदस् य;
(घ) मुख्य कायर्कारी अिधकारी, िजला पंचायत, बीजापुर - सदस् य;
(ङ) अधीक्षण इंजीिनयर, लोक िनमार्ण िवभाग, जगदलपुर – सदस् य ;
(च) अधीक्षण इंजीिनयर, जन स्वास्थ्य इंजीिनयरी, जगदलपुर – सदस् य ;
(छ) तीन वषर् की अविध के िलए छᱫीसगढ़ सरकार ᳇ारा नामिन᳸दर्ष् ट पािरिस् थितक और पयार्वरण क्षेᮢ मᱶ एक िवशेषज्ञ – सदस् य ;
(ज) छᱫीसगढ़ राज्य जैव-िविवधता बोडर् का सदस् य-सिचव या सदस्य -सदस्य;
(झ) पयार्वरण के क्षेᮢ मᱶ कायर् करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगर्त िवरासत संरक्षण भी ह)ै का तीन वषर् की अविध के िलए छᱫीसगढ़ राज्य सरकार ᳇ारा नामिन᳸दर᳥् एक ᮧितिनिध– सदस् य;
(ञ) नगर और ᮕाम्य योजना िवभाग का ᮧितिनिध – सदस् य ;
(ट) छᱫीसगढ़ ᮧदषूण िनयंᮢण बोडर् का ᮧितिनिध– सदस् य ;
(ठ) मुख्य वन संरक्षक (वन्यजीव) और पिरयोजना िनदशेक, इंᮤावती रा᳦ीय पाकर् , जगदलपुर -सिचव । – सदस् य िनदᱷश िनबधंन -
(1) मानीटरी सिमित का कायर्काल अिधसूचना जारी करने की तारीख से तीन वषर् की अविध के िलए होगा।
(2) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(3) मानीटरी सिमित उन िᮓयाकलापᲂ को अनुज्ञात नहᱭ करेगी जो भारत सरकार के तत्कालीन पयार्वरण और वन मंᮢालय की अिधसूचनाᲐ अथार्त् पयार्वरण संजात िनधार्रण, 2006 का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 ᳇ारा और तटीय िविनयमन जोन का.आ. 19(अ), तारीख 6 जनवरी, 2011 और इनमᱶ िकए गए प᳟ात्वतᱮ संशोधनᲂ की अनुसूची के अंतगर्त आते ह ᱹऔर पािरिस्थितक संवेदी जोन के अंतगर्त भी आते ह ᱹिजनके अंतगर्त इसके ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 11 पैरा 4 के अधीन सारणी मᱶ यथािविन᳸दर᳥् ᮧितिष िᮓयाकलाप भी ह ᱹ । ᳡ेत ᮧवगर् के उ᳒ोगᲂ पर “उ᳒ोगᲂ के वगᱮकरण, 2016” के िलए केन्ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा जारी मागर्दशᱮ िसांतᲂ मᱶ िविन᳸दर᳥् िकए गए अनुसार िवचार िकया जाएगा।

(5) मानीटरी सिमित का सदस्य-सिचव या संब आयᲦु ऐसे ᳞िᲦ के िवरू, जो इस अिधसचूना के िकसी उपबंध का उल्लंघन करता ह,ै पयार्वरण (संरक्षण) अिधिनयम, 1986 की धारा 19 के अधीन पिरवाद फाइल करने के िलए सक्षम होगा ।
(6) मानीटरी सिमित मुा दर मुा आधार पर अपेक्षाᲐ पर िनभर्र रहते हुए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेषज्ञᲂ, औ᳒ोिगक संगमᲂ या संब पणधािरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशर् मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) मानीटरी सिमित ᮧत्येक वषर् 31 माचर् तक की अपनी वािषर्क कारर्वाई िरपोटर् राज्य के मुख्य वन्यजीव वाडर्न को उपाबंध III मᱶ संलᲨ रूप िवधान के अनुसार उस वषर् के 30 जून तक ᮧस्तुत करेगी ।
(8) केन्ᮤीय सरकार का पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय मानीटरी सिमित को उनके कृत्यᲂ के ᮧभावी िनवर्हन के िलए समय-समय पर ऐस ेिनदशे द ेसकेगा, जो वह ठीक समझे ।

8. कोई अन् य महत् वपूणर् िवषय । ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, 19th July, 2017 S.O. 2273(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 252 (E), dated 27th January, 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, no comments/objections or suggestions were received from persons and stakeholders in response to the draft notification;
AND WHEREAS, the Pamed Wildlife Sanctuary is situated in Bizapur District of Chhattisgarh and is spread over an area of 442.23 square kilometres. The Sanctuary is known for its rich varieties of flora and fauna. Important flora includes Teak (Tectona grandis), Sisham (Dalbergia latifolia), Kusum (Schleichera oleosa), Mahua (Madhuca indica), Tendu (Diospyros melanoxylon), Bamboo (Dendrocalamus strictus), etc. The fauna of the sanctuary includes Leopard (Panthera pardus), Nilgai (Boselaphus tragocamelus), Sambhar (Rusa unicolor), Wild boar (Sus scrofa), Wild dog (Lycaon pictus), Wild Cat (Felis silvestris), Peacock (Pavo cristatus), Langur, Macaque Monkey (Macaque sp.), Chital (Axis axis), Sloth Bear (Melusus ursinus), Porcupine (Hystrix indica), Jackal (Canis aureus), etc. The sanctuary is composed of tropical moist mixed deciduous forest, tropical dry deciduous forest, mixed forest, dry evergreen forest, and aquatic vegetation. The sanctuary also provides an extension of habitat to Indrawati Tiger Reserve.
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Pamed Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent ranging from 0 metres to 1 km around the boundary of Pamed Wildlife Sanctuary in the State of Chhattisgarh as the Pamed Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1) The Eco sensitive Zone lies between 180 26' 04'' N to 180 11' 31'' N Latitudes and 800 43' 57'' E to 810 03' 57'' E Longitudes. The Eco-Sensitive Zone is spread over an area of
62.73 square kilometers with an extent of 1 km around the boundary of Pamed Wildlife Sanctuary excluding portion on the Western side of the Sanctuary which shares boundary with the State of Telangana.
(2) The map of Pamed Wildlife Sanctuary demarcating the Eco-sensitive Zone boundary along with the geo co-ordinates are appended as Annexure I.
(3) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure II.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan so prepared shall commensurate with the stipulation specified in the Notification and include the environmental implications.
(3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Chhattisgarh State Pollution Control Board;
(ix) Irrigation; and
(x) Public Works Department.
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas such as parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited, regulated and promoted activities specified in the Notification so as to ensure Eco-friendly development for livelihood security of local communities.
(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions with respect to the provisions given in this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism activities;
(ii) Widening and strengthening of existing roads;
(iii) Small scale industries not causing pollution;
(iv) Rainwater harvesting; and
(v) Cottage industries including village artisans.
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or and restrict development activities within the catchment areas.
(3) Eco-Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism, Government of Chhattisgarh in consultation with Department of Revenue and Forests, Government of Chhattisgarh.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities relating to tourism shall be regulated as under, namely.-
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Pamed Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Chhattisgarh State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- Regulations for the control of air pollution in the Eco-Sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein. –
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(i) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone;
(ii) Individual hospitals or private health centres already existing within the Eco Sensitive Zone should provide adequate waste treatment system to avoid adverse impact on the Protected Area.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317(E), dated the 29th March, 2016, as amended from time to time.

(13) E- waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Industrial units.-
(a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Ecosensitive Zone shall be permitted.
(16) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:- TABLE Sl. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

3. Setting up of industries causing water or air or soil or noise pollution.
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, nonpolluting cottage industries shall be promoted.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
5. Establishment of new major hydroelectric projects and irrigation projects.
Prohibited (except as otherwise provided) as per applicable laws.
6. Use or production of any hazardous substances including pesticides and insecticides.
Prohibited (except as otherwise provided) as per applicable laws.
7. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
8. Undertaking activities related to tourism like over-flying the ESZ Area by aircraft, hot air balloon, helicopter, drones, Microlites, etc.
Prohibited (except as otherwise provided) as per applicable laws.
9. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone:
Provided the existing wood-based industry may continue as per law:
Provided further that renewal of licenses of existing saw mills shall not be done on their expiry period.
10. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste are permitted within Eco sensitive zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is Prohibited.
11. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
12. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
Regulated activities
13. Use of plastic carry bags, laminates and Regulated under applicable laws. Disposal of plastic ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 tetra packs. articles, laminates and tetra packs shall be strictly regulated and monitored.
14. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Ecotourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
15. Construction activities. No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as.-
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Cottage industries including village industries;
convenience stores & local amenities supporting ecotourism including home stays; and
(iv) Promoted activities listed in this notification.
16. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
17. Commercial water resources including ground water harvesting.
(a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land;
(b) extraction of surface water and ground water for industrial or commercial use including the amount that can 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] be extracted, shall require prior written permission from the concerned Regulatory Authority;
(c) no sale of surface water or ground water shall be permitted;
(d) steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
18. Erection of electrical and communication towers and laying of cables and other infrastructures.
The existing overhead electric cables shall be insulated within a specified period as per the Zonal Master Plan.
Underground cabling may be promoted.
19. Fencing of existing premises of hotels and lodges.
Regulated under applicable laws.
20. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
21. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
22. Introduction of Exotic species. Regulated under applicable laws.
23. Protection of Hill Slopes and river banks. Regulated under applicable laws.
24. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
25. Commercial Sign boards and hoardings. Regulated under applicable laws.
26. Collection of Forest produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws.
27. Air and vehicular pollution. Regulated under applicable laws.
28. Drastic change of agriculture systems. Regulated under applicable laws.
29. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
30. Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
31. Solid Waste Management. Regulated under applicable laws.
32. Eco-tourism. Regulated under applicable laws.

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(a) Divisional Commissioner, Jagdalpur- Chairman;
(b) Collector, Bijapur Distict- Member;
(c) Deputy. Director, Indravati National Park, Bijapur- Member;
(d) Chief Executive Officer, District Panchayat, Bijapur- Member;
(e) Superintendent Engineer PWD, Jagdalpur- Member;
(f) Superintendent Engineer PHE, Jagdalpur - Member;
(g) One expert in ecology to be nominated by the Government of Chhattisgarh for a period of three years- Member;
(h) Member-Secretary or Member, Chhattisgarh State Biodiversity Board– Member;
Promoted activities
33. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
34. Small scale non polluting industries. Non polluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, smallscale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
35. Rain water harvesting. Shall be actively promoted.
36. Organic farming. Shall be actively promoted.
37. Adoption of green technology for all activities.
Shall be actively promoted.
38. Cottage industries including village artisans.
Shall be actively promoted.
39. Use of renewable energy and fuels Bio gas, solar light etc. to be actively promoted
40. Agro-Forestry Shall be actively promoted.
41. Use of eco-friendly transport Shall be actively promoted.
42. Skill Development Shall be actively promoted.
43. Restoration of Degraded Land/ Forests/ Habitat Shall be actively promoted.
44. Environmental Awareness Shall be actively promoted.

(i) Representative of Non-Governmental Organisation working in the field of natural conservation (including heritage conservation) to be nominated by the Government of Chhattisgarh for a period of three years- Member;
(j) Representative of the Town and Country Planning Department- Member;
(k) Representative of Chhattisgarh Pollution Control Board- Member;
(l) Chief Conservator of Forest (Wildlife) and Project Director, Indrawati National Park, Jagdalpur- Member Secretary.
6. Terms of Reference:
(1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of Notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment, 2006 vide S.O. 1533 (E), dated the 14th September, 2006, and Coastal Regulation Zone, 2011 vide S.O. No. 19(E) dated 6th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and S.O. 19 (E) dated 6th January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State under intimation to this Ministry as per proforma appended at Annexure III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
