4325(अ), तारीख 03 अक्टूबर, 2024, द्वारा प्रकाजित की गई थी, जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करन ेवाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थे;

और, उि रािपत्र अजधसूचना की प्रजतर्ां िनता को तारीख 03 अक्टूबर, 2024 को उपलब्ध करा िी गई थी;

और, उि प्रारुप अजधसूचना की बाबत व्यजिर्ों और पणधाररर्ों से कोई आक्षेप, रटप्पणी और सुझाव प्राप्त नहीं हुए;

और, त्राल वन्र्िीव अभर्ारण्र् श्रीनगर िहर से लगभग 45 दकलोमीटर िजक्षण-पूवा में जस्ट्थत ह।ै र्ह कश्मीर घाटी के पुलवामा जिल ेमें जस्ट्थत ह ैऔर जिला मखुर्ालर् पलुवामा लगभग 30 दकलोमीटर की िरूी पर ह।ै जनकटतम हवाई अड्डा श्रीनगर 50 दकलोमीटर िरू ह ैऔर जनकटतम रेलवे स्ट्टेिन अवंतीपोरा 15 दकलोमीटर िरू ह।ै स.ं 2302] नई दिल्ली, मगंलवार, मई 27, 2025/ज्र्षे्ठ 6, 1947 No. 2302] NEW DELHI, TUESDAY, MAY 27, 2025/JYAISHTHA 6, 1947 सी.जी.-डी.एल.-अ.-28052025-263434 CG-DL-E-28052025-263434 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, ऐजतहाजसक रूप से, संरजक्षत क्षेत्र के कुछ जहस्ट्सों, अथाात् जिकारगाह और खानगुंड (पहले संरक्षण ररिवा के रूप में नामजनर्िाष्ट), को िेि के सबसे पुराने अजधसूजचत संरजक्षत क्षेत्रों में से एक होने का गौरव प्राप्त ह ैऔर र्ह अजधसूचना 1945 की ह,ै िब वे तत्कालीन िम्मू और कश्मीर ररर्ासत के महारािा के खेल जवजधर्ों द्वारा िाजसत थे। और िबदक, 2019 में, इन संरक्षण रजक्षतों को, प्रािेजिक वन क्षेत्रों वाले जनकटवती क्षेत्रों के साथ, वन्र्िीव अभर्ारण्र् में उन्नत दकर्ा दकर्ा गर्ा था और अभर्ारण्र् ग्रेटर जहमालर् पवात के बीहड़ और लहरिार भू-भाग पर फैला हुआ ह,ै िो लगभग 155 वगा दकलोमीटर के क्षेत्र में फैला ह ैऔर राज्र् सरकार की अजधसूचना संखर्ांक एफएसटी/डब्ल्र्ूएल/07/2018 (एसआरओ-639), तारीख 23 अक्टूबर 2019 के द्वारा अजस्ट्तत्व में आर्ा;

और, त्राल वन्र्िीव अभर्ारण्र् और आसपास के क्षेत्र कश्मीर लाल जहरण (हगंलु) के जवतरण क्षेत्र में आत ेहैं, िो वन्र्िीव (संरक्षण) अजधजनर्म, 1972 के अनुसार अनुसूची I की प्रिाजत ह,ै और अंतरााष्ट्रीर् प्रकृजत संरक्षण संघ रेड डाटा बुक में इसे 'गंभीर रूप से संकटग्रस्ट्त' के रूप में नाजमत दकर्ा गर्ा ह ैऔर हगंलु का जवतरण केवल िाचीगाम राष्ट्रीर् उद्यान और कुछ आसपास के क्षेत्रों तक ही सीजमत ह।ै िबदक त्राल वन्र्िीव अभर्ारण्र् िाचीगाम राष्ट्रीर् उद्यान के बाहर के कुछ क्षेत्रों में से एक ह,ै िहां इस गंभीर रूप से लुप्तप्रार् जहरण की आबािी अभी भी िीजवत ह ैऔर अभर्ारण्र् अन्र् महत्वपूणा वन्र्िीव क्षेत्रों िैसे ओवेरा-अरु वन्र्िीव अभर्ारण्र् और खे्रव संरक्षण संरजक्षत से भी िुड़ा हुआ ह ैऔर र्े संरजक्षत क्षेत्र जमलकर समृद्ध िैव जवजवधता का पररिशृ्र् बनाते हैं और िानवरों, पजक्षर्ों और वनस्ट्पजतर्ों की कुछ महत्वपूणा और स्ट्थाजनक प्रिाजतर्ों की अच्छी आबािी को सहारा िेत ेहैं;

और, त्राल वन्र्िीव अभर्ारण्र् कश्मीर लाल जहरण (सवास हगंल ू हगंल)ू, कश्मीर कस्ट्तूरी मृग (मोिस क्रू्जप्रर्स) और कश्मीर ग्र ेलंगरू (सेमनोजपथेकस अिाक्स) िैसी जवजभन्न स्ट्थाजनक प्रिाजतर्ों का घर ह।ै िबदक अभर्ारण्र् में पाई िाने वाली अन्र् िलुाभ, लुप्तप्रार् और संकटग्रस्ट्त प्रिाजतर्ााँ आम तेंिआु (पेंथेरा पाडास), जहमालर्ी जग्रफ़ॉन जगद्ध (जिप्स जहमालर्ेंजसस), िाढी वाले जगद्ध (जिपेटस बारबेटस) और कश्मीर फ्लाईकैचर (फाइजसडुला सबरूबरा) और त्राल के िंगलों में एकोजनटम हटेरोदफलम, अनेजबर्ा बेंथैमी, आटेजमजसर्ा एजब्सजन्थर्म, बबेररस जलजिर्म, बिेजनर्ा जसजलर्ाटा, डाटुरा स्ट्रैमोजनर्म, डार्ोस्ट्कोररर्ा डेल्टोइजडर्ा, लवटेरा कैिमेररर्ाना, स़ॉसुररर्ा कोस्ट्टस और टैक्सस वाजलजचर्ाना िैसे महान औषधीर् महत्व की कई पौधों की प्रिाजतर्ां पाई िाती हैं। और, त्राल वन्र्िीव अभर्ारण्र् िैवभौगोजलक वगीकरण के 2ए प्रांत के अधीन आता ह ै िैसा दक ऱॉिसा एट अल द्वारा सुझार्ा गर्ा ह।ै चैंजपर्न और सेठ (1968) द्वारा वगीकरण के अनुसार, अभर्ारण्र् की वनस्ट्पजत आम तौर पर जहमालर्ी नम िीतोष्ण वन, उप-अल्पाइन वन और अल्पाइन वन प्रकार की ह ैऔर त्राल वन्र्िीव अभर्ारण्र् की वनस्ट्पजत प्रकार प्रमुख पुष्प प्रिाजतर्ों के आवास, रूप और घनत्व द्वारा जनधााररत की िाती ह।ै प्रमुख वनस्ट्पजत जनम्न प्रकार हैं:

(1) निीर्: (1600-2300 मीटर): इस प्रकार की वनस्ट्पजत कम ऊंचाई पर होती ह ै और इसमें एस्ट्कुलस इंजडका, फै्रजक्सनस हुकेरी, पैरोरटओजप्सस िैके्वमोंरटर्ाना और िुग्लान्स रेजिर्ा की चौड़ी पत्ती वाली प्रिाजतर्ां प्रमुख हैं, प्रमुख झाजड़र्ों में इंजडगोफेरा हटेेरंथा, लोजनसेरा प्रिाजतर्ां, जवबनाम, जस्ट्कजमर्ा ल़ॉरेल, िैस्ट्मीनम प्रिाजतर्ां आदि िाजमल हैं।

(2) िकुंधारी वन: (2300-3000 मीटर): इस प्रकार के वनों में ब्लू पाइन (पीनस वाजलजचर्ाना) और फर (एजबस पपंड्रो) प्रमुख प्रिाजतर्ां हैं, िो स्ट्प्रूस (जपजसर्ा जस्ट्मजथर्ाना) के साथ 2300 मीटर की ऊंचाई पर पाई िाती हैं, वुडलैंड कुछ स्ट्थानों पर नालों के दकनारे भी फैले हुए हैं।

(3) अल्पाइन झाजड़र्ााँ और चारागाह: (3000-3500 मी): इस प्रकार के वन में वृक्षजवहीन चारागाह होते हैं जिनमें जबखरी हुई झाड़ीिार वनस्ट्पजत होती ह ै और जबचा (बेतलुा र्ूरटजलस) इस क्षेत्र की सबसे प्रमुख प्रिाजत ह ै िो अल्पाइन से िुड़ी वृक्ष रेखा के पास छार्ािार स्ट्थानों पर िूजनपरस ररकवाा, रोडोडेंड्रोन प्रिाजतर्ां, जवबनाम [भाग II—खण्ड 3(ii)] भारत का रािपत्र : असाधारण 3 प्रिाजतर्ां, लोजनसेरा प्रिाजतर्ां और जप्रमुला तथा वृक्ष रेखा के ऊपर जवस्ट्तृत अल्पाइन घास के मैिान, जिन्हें 'मागा' के नाम से िाना िाता ह,ै में बारहमासी िड़ी-बूरटर्ों और घासों की प्रचुर वृजद्ध होती ह ैतथा र्हां प्रमुख झाड़ी प्रिाजतर्ां मार्ोसोरटस प्रिाजतर्ां, साइनोग्लोसम प्रिाजतर्ां आदि हैं, कुछ स्ट्थानों पर बेटूला र्ूरटजलस भी जबखरी हुई पाई िाती ह।ै

(4) चट्टानी सतहें: (3500 मीटर स ेऊपर): चट्टानी चट्टानों और पहाड़ी चोरटर्ों पर बौने सिाबहार झाजड़र्ों का प्रभुत्व ह,ै जिनमें िूजनपरस ररकवाा, रोडोडेंड्रोन एन्थोपोगोन आदि िाजमल हैं, िो िड़ी-बूरटर्ों, स्ट्टैजचस सेरीजसर्ा, सीवरजसर्ा एलाटा और वेरोजनका मेजलजसफोजलर्ा से िुड़ी हुई हैं। और, त्राल वन्र्िीव अभर्ारण्र् हगंलु की आवािाही के जलए एक महत्वपूणा गजलर्ारा बनाता ह।ै पाररजस्ट्थजतकी- संवेिनिील क्षेत्र की घोषणा से अभर्ारण्र् क्षेत्र के चारों ओर एक बफर बनाने में मिि जमलगेी, जिससे अंजतम बची हुई हगंुल आबािी के जलए एक सुरजक्षत, उपर्ुि और व्यवहार्ा आवास बन सकेगा;

अतः, अब, केन्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना में इसके पश्चात् पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उप-धारा (1) और उप-धारा (2) के खंड (v) और खंड (xiv) तथा उप-धारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, िम्मू और कश्मीर संघ राज्र् क्षेत्र में त्राल वन्र्िीव अभर्ारण्र् की सीमा से िून्र् से 3.26 दकलोमीटर की सीमा तक के क्षेत्र को त्राल वन्र्िीव अभर्ारण्र् पाररजस्ट्थजतकी संवेिी िोन (जिसे इस अजधसूचना में इसके पश्चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती है, जिसका जववरण जनम्नानुसार ह,ै अथाात् :-

(2) त्राल पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तृत जववरण उपाबधं-I में सलंग्न ह।ै

(3) त्राल वन्र्िीव अभर्ारण्र् सीमा के भू-जनिेिांक के साथ-साथ जवजभन्न दििाओं में पाररजस्ट्थजतकी संवेिी िोन का सीमा जववरण उपाबधं-Iक के रूप में सलंग्न ह।ै

(4) पाररजस्ट्थजतकी संवेिी िोन के मानजचत्र, सीमा जववरण सजहत, उपाबधं-II से उपाबधं-II च में संलग्न हैं।

(5) पाररजस्ट्थजतकी संवेिी िोन में आन ेवाले गांवों की सूची और िनसांजखर्की स्ट्वरूप क्रमिः उपाबधं-III और उपाबधं-IV में सलंग्न ह।ै

(6) त्राल वन्र्िीव अभर्ारण्र् में पाए िान ेवाल ेस्ट्तनधाररर्ों और पजक्षर्ों की सूची उपाबधं-V के रूप में संलग्न ह।ै

2. पाररजस्ट्थजतकी सवंिेी जोन के जलए आचंजलक महार्ोिना – (1) संघ राज्र् क्षेत्र सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और संघ राज्र् क्षेत्र सरकार के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए अनुबंधों का पालन करत ेहुए आचंजलक महार्ोिना तैर्ार करेगी।

(2) संघ राज्र् क्षेत्र प्रिासन द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना, ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष्ट की गई ह,ै के अनुसार तथा सुसंगत कें रीर् और संघ राज्र् क्षेत्र जवजधर्ों तथा कें रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों, र्दि कोई हों, के अनरुुप तैर्ार की िाएगी।

(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकीर् और पर्ाावरणीर् तथ्र्ों को समाकजलत करने के जलए संघ राज्र् क्षेत्र प्रिासन के जनम्नजलजखत जवभागों के परामिा स ेतैर्ार की िाएगी: -

(i) पर्ाावरण;

(ii) वन और वन्र्िीवन;

(iii) कृजष;

(iv) रािस्ट्व;

(v) िहरी जवकास;

(vi) पर्ाटन;

(vii) ग्रामीण जवकास;

(viii) पसंचाई और बाढ जनर्ंत्रण;

(ix) प्रिषूण जनर्ंत्रण बोडा;

(x) नगर पाजलका;

(xi) पंचार्ती राि; और

(xii) लोक जनमााण जवभाग । 4) आंचजलक महार्ोिना के अधीन अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं दकर्ा िाएगा िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो और आचंजलक महार्ोिना, सभी अवसंरचना और दक्रर्ाकलापों में, िो अजधक िक्ष और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी। [भाग II—खण्ड 3(ii)] भारत का रािपत्र : असाधारण 5

(5) आचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल स्रोतो के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलओुं, जिन पर ध्र्ान िनेा आवश्र्क ह।ै

(6) आंचजलक महार्ोिना में जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेषताओं के ब्र्ौरों से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट्थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट्मों, कृजष क्षते्रों, उपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट्थान, उद्यान कृजष क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्कंन दकर्ा िाएगा।

(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और पैरा 4 में सारणी में सूचीबद्ध प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट्थानीर् समुिार्ों की िीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत और उसकी अजभवृजद्ध भी करेगी।

(8) आंचजलक महार्ोिना, प्रािेजिक जवकास र्ोिना की सह-जवस्ट्तारी होगी।

(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपन ेकार्ों को करन े के जलए जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी।

3. िम्म ूऔर कश्मीर सघं राज्र् क्षते्र प्रिासन द्वारा दकए िान ेवाल ेउपार्.- संघ राज्र् क्षेत्र सरकार इस अजधसूचना के उपबंधों को प्रभावी करन ेके जलए जनम्नजलजखत उपार् करेगी, अथाात्: -

(1) भ-ूउपर्ोग. – (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजष क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुल े स्ट्थानों सजहत, का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दक्रर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा:

परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर उपर्ुाि भाग (क) में जवजनर्िाष्ट प्रर्ोिनों से जभन्न प्रर्ोिनों के जलए कृजष और अन्र् भूजम का संपररवतान, जनगरानी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्रीर् सरकार र्ा संघ राज्र् क्षेत्र प्रिासन के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करने के जलए अनजु्ञात दकर्ा िाएगा, िैसे:-

(i) जवद्यमान सड़कों को चौड़ा करना और उन्हें सुिढृ करना और नई सड़कों का जनमााण करना;

(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;

(iii) प्रिषूण उत्पन्न न करने वाल ेलघु उद्योग;

(iv) कुटीर उद्योग सजहत ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन में सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं जिसके अंतगात गृह वास सजम्मजलत; और

(v) पैरा-4 के अधीन दिए गए दिए गए संबद्ध जवजनर्जमत दक्रर्ाकलाप और संवर्धात दक्रर्ाकलापः परंतु र्ह और दक संघ राज्र् क्षेत्र प्रिासन के अनुमोिन के जबना और संजवधान के अनचु्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै जिसका अनुपालन क्षेत्रीर् नगर जनर्ोिन अजधजनर्म और अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के उपर्ोग की अनुज्ञा नहीं होगी:

परंत ुर्ह भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर आन ेवाली भूजम के अजभलेखों में उपसंज्ञात दकसी तु्ररट को, म़ॉनीटरी सजमजत के जवचार प्राप्त करने के पश्चात्, संघ राज्र् क्षते्र प्रिासन द्वारा प्रत्र्ेक मामले में एक बार सुधारा िा सकेगा और उि तु्ररट को सुधारे िान ेकी सूचना केन्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी:

परंत ुर्ह और भी दक उपर्ुाि तु्ररट के संिोधन में इस उप परैा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू- उपर्ोग का पररवतान सजम्मजलत नहीं होगा :

(ख) वनरोपण और आवास पुनस्ट्थाापन दक्रर्ाकलापों के माध्र्म से अप्रर्िु र्ा अनुत्पािक कृजष क्षेत्रों को पुनः वनरोपण करन े का प्रर्ास दकर्ा िाएगा।

(2) प्राकृजतक िल स्रोत और झरन े– (1) आंचजलक महार्ोिना में आने वाल ेसभी प्राकृजतक झरनों र्ा नदिर्ों र्ा आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण की र्ोिना सजम्मजलत की िाएगी और संघ राज्र् क्षेत्र प्रिासन द्वारा िल आवाह प्रबंधन र्ोिना ऐसी रीजत से बनाई िाएगी दक उसमें आवाह क्षते्रों में जवकास दक्रर्ाकलापों को प्रजतजषद्ध और जनबंजधत दकर्ा गर्ा हो ।

(2) भूिल का िोहन केवल भूजम के स्ट्वामी र्ा अजधभोगी के वास्ट्तजवक कृजष और घरेल ूउपभोग के जलए ही दकर्ा िाएगा। दकसी भी वाजणजज्र्क र्ा कृजष र्ा पिुधन संचालन से िल स्रोत के संिषूण र्ा प्रिषूण को रोकने के जलए सभी उपार् दकए िाएंगे।

(3) पर्ाटन र्ा पारर-पर्ाटन- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पारर-पर्ाटन, दक्रर्ाकलापों र्ा जवद्यामान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन के जलए पर्ाटन महार्ोिना के अनुसार होगा;

(ख) पर्ाटन महार्ोिना को राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा से संघ राज्र् क्षेत्र प्रिासन द्वारा तैर्ार दकर्ा िाएगा;

(ग) पाररजस्ट्थजतकी-पर्ाटन महार्ोिना आंचजलक महार्ोिना का ही एक घटक होगा और र्ह पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार दकर्ा िाएगा (घ) पाररजस्ट्थजतकी-पर्ाटन की गजतजवजध का जवजनर्मन जनम्नानुसार दकर्ा िाएगा, अथाात्: -

(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें से िो भी समीप हो, नए होटलों और ररस़ॉर्टसा के दकसी भी संजनमााण की अनुमजत नहीं िी िाएगी। परन्तु संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की िरूी से िरू पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, नए होटलों और ररस़ॉर्टसा की स्ट्थापना की अनुमजत केवल पाररजस्ट्थजतकी-पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी-पर्ाटन सुजवधाओं के जलए और अजभजहत क्षेत्रों में ही दकर्े िाने के जलए की िाएगी;

(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नई पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार वषा 2018 में कें रीर् सरकार और पारर-पर्ाटन द्वारा िारी मागा ििाक जसद्धांतों और राष्ट्रीर् बाघ संरक्षण [भाग II—खण्ड 3(ii)] भारत का रािपत्र : असाधारण 7 प्राजधकरण द्वारा िारी पारर-पर्ाटन मागा ििाक जसद्धांतों (समर्-समर् पर संिोजधत) के अनुसार होगा, जिसमें पारर-पर्ाटन, पारर-जिक्षा और पारर-जवकास पर िोर दिर्ा िाएगा;

(iii) िब तक आंचजलक महार्ोिना को अनुमोदित नहीं कर दिर्ा िाता है, तब तक पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार की कोई अनुमजत संबंजधत जनर्ामक प्राजधकरणों द्वारा तथा वास्ट्तजवक स्ट्थल-जवजिष्ट िांच और जनगरानी सजमजत की जसफाररि के आधार पर िी िाएगी।

(4) नसैर्गाक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन में बहुमूल्र् नसैर्गाक जवरासत के सभी स्ट्थलों िैसे दक िीन कोि आरजक्षत क्षेत्र, िलै संरचना, िल प्रपात, झरन,े िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा और,,, संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(5) मानव जनर्मात जवरासत स्ट्थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(6) ध्वजन प्रिषूण.- पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिषूण के जनवारण और जनर्ंत्रण पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रिषूण (जवजनर्मन और जनर्ंत्रण) जनर्म 2000 के अनुसार, र्था संिोजधत अनुपालन दकर्ा िाएंगा।

(7) वार् ुप्रिषूण. - पाररजस्ट्थजतकी संवेिी िोन में वार् ुप्रिषूण का जनवारण और जनर्ंत्रण वार्ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14), और पर्ाावरण अजधजनर्म तथा तद्धीन बनाए गए जनर्मों के अनुसार अनुपालन दकर्ा िाएगा।

(8) अपजिष्टों का जनवाहन- पाररजस्ट्थजतकी संवेिी िोन में िोजधत अपजिष्टों का जनवाहन और िल (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) तथा पर्ाावरण (संरक्षण) अजधजनर्म, 1986 तथा इन अजधजनर्मों के अधीन बनाए गए जनर्मों के उपबंधों के अधीन होगा।

(9) ठोस अपजिष्ट. - ठोस अपजिष्ट का जनपटान और प्रबन्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के र्था संिोजधत उपबंधों के अनुसार दकर्ा िाएगा और अकाबाजनक पिाथों का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर अजभज्ञात दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनरुूप ठोस अपजिष्ट के जनरापि और पर्ाावरण अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।

(10) िवै जचदकत्सा अपजिष्ट. - िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान, समर्-समर् पर र्था संिोजधत, िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी-संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनरुूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन (इएसएम) अनजु्ञात दकर्ा िा सकेगा। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(11) प्लाजस्ट्टक अपजिष्ट का प्रबधंन. – पाररजस्ट्थजतकी-संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन, समर्-समर् पर र्था संिोजधत, प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(12) सजंनमााण और जवध्वसं अपजिष्ट का प्रबधंन.- पाररजस्ट्थजतकी-संवेिी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, समर्-समर् पर र्था संिोजधत, संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी-संवेिी िोन में ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित, समर्-समर् पर र्था संिोजधत, ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(14) र्ानीर् गजतजवजधर्ां-र्ातार्ात.- र्ातार्ात र्ानीर् गजतजवजधर्ों को पर्ाावास-अनुकूल रीजत से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जविेष उपबंध सजम्मजलत दकए िाएंगे। आंचजलक महार्ोिना के तैर्ार होने और संघ राज्र् क्षेत्र प्रिासन के सक्षम प्राजधकारी द्वारा अनुमोदित होन ेतक, म़ॉनीटरी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर्-र्ातार्ात के अनुपालन को म़ॉनीटरी करेगी।

(15) र्ानीर् िजनत प्रिषूण. – र्ानीर् प्रिषूण के जनवारण और जनर्ंत्रण लाग ूजवजधर्ों के अनसुार दकर्ा िाएगा और स्ट्वच्छ ईंधन िैसे संपीजड़त प्राकृजतक गसै, तरलीकृत पेरोजलर्म गैस आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे।

(16) औद्योजगक ईकाइर्ा.ं – रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात्, (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर नए प्रिषूणकारी उद्योगों की स्ट्थापना की अनजु्ञा नहीं िी िाएगी। (ख) केन्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 द्वारा िारी मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी-संवेिी िोन के भीतर केवल गरै-प्रिषूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा। (ग) गैर प्रिषूणकारी कुटीर उद्योगों को बढावा दिर्ा िाएगा।

(17) पहाड़ी ढलानों का सरंक्षण. - पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना में पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी संजनमााण की अनुज्ञा नहीं होगी;

(ख) कटाव के एक उच्च जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों में र्ा ढलानों पर दकसी भी संजनमााण की अनुज्ञा नहीं होगी ।

4. पाररजस्ट्थजतकी-सवंिेी िोन के भीतर प्रजतजसद्ध र्ा जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलाप.- पाररजस्ट्थजतकी-संवेिी जोन में सभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों, उसके अधीन बनाए गए जनर्मों और कें रीर् सरकार की अन्र् अजधसूचनाओं, जवजधर्ों और अजधजनर्मों, तत्कालीन पर्ाावरण और वन मंत्रालर् में पर्ाावरण, वन और वन्र्िीव से संबंजधत अजधसूचना, संखर्ांक 1533(अ ), तारीख 14 जसतंबर, 2006 और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में तत्समर् प्रवृत्त जवजधर्ों द्वारा, समर्-समर् पर र्था संिोजधत, िाजसत होंगे, अथाात्:

1. वाजणजज्र्क खनन, वाजणजज्र्क उत्खनन, पत्थर उत्खनन और अपघषाण इकाइर्ां । (क) पाररजस्ट्थजतकी-संवेिी जोन के भीतर घरों के संजनमााण र्ा मरम्मत के जलए जमट्टी की खुिाई सजहत वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवश्र्कताओं को पूरा करन े के जसवार् सभी नए और जवद्यमान (लघु और प्रमुख खजनि), पत्थर उत्खनन और उनके तोड़न ेकी इकाइर्ों को तत्काल प्रभाव से प्रजतजसद्ध दकर्ा िाता ह।ै (ख) खनन प्रचालन माननीर् उच्चतम न्र्ार्ालर् की ररट र्ाजचका (जस.) सं. 1995 का 202 में टी. एन. गौडावमान जथरुमूलपाि बनाम भारत संघ और ररट र्ाजचका (जस.) सं. 2012 का 435 में गोवा फाउंडेिन बनाम भर संघ और आई.ए. सं. 2003 का 1000 में तारीख 03.06.2022 के जनमााण और तत्पश्र्ात ् आई.ए. सं. 2022 का 131377 में तारीख 26.04.2023 और 28.04.2023 के जनणार् के मामले में आिेिों के अनुसार दकर्ा िाएगा।

2. प्रिषूण (िल, वार्,ु मिृा, ध्वजन, आदि) उत्पन्न करने वाल े उद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगान ेऔर वतामान प्रिषूणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगीः परन्त ुर्ह दक केन्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी-संवेिी िोन के भीतर गैर-प्रिषूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गरै-प्रिषूणकारी कुटीर उद्यागों को बढावा दिर्ा िाएगा।

3. प्रमुख िलजवदु्यत पररर्ोिना की स्ट्थापना। प्रजतजषद्ध।

4. दकसी पररसंकटमर् पिाथा का प्रर्ोग र्ा उत्पािन र्ा प्रस्ट्संकरण । प्रजतजषद्ध।

5. प्राकृजतक िल जनकार्ों र्ा भूजम क्षेत्र में अनुपचाररत अपजिष्टों का जनवाहन। प्रजतजषद्ध।

6. ठोस अपजिष्ट जनपटान स्ट्थल और ठोस तथा िैव जचदकत्सा अपजिष्ट के जलए सामान्र् भस्ट्मीकरण पाररजस्ट्थजतकी- संवेिी िोन के भीतर दकसी भी नए ठोस अपजिष्ट जनपटान स्ट्थल और अपजिष्ट उपचार र्ा ठोस अपजिष्ट प्रसंस्ट्करण सुजवधा की अनुज्ञा नहीं िी िाएगी, और औद्योजगक प्रदक्रर्ा और 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सुजवधा की स्ट्थापना। स्ट्वास्ट्थ्र् स्ट्थापनाओं, अस्ट्पतालों आदि से उत्पन्न दकसी भी प्रकार के ठोस अपजिष्ट के उपचार के जलए सामान्र् र्ा व्यजिगत भस्ट्मीकरण सुजवधा की स्ट्थापना की अनुज्ञा नहीं िी िाएगी।

7. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी-संवेिी िोन के भीतर नई र्ा जवद्यमान आरा जमलों का जवस्ट्तार अनुज्ञात नहीं होगा।

8. ईंट भट्टों की स्ट्थापना। प्रजतजसद्ध।

9. फमों, कंपजनर्ों, क़ॉरपोरेर्टस द्वारा बड़े पैमाने पर वाजणजज्र्क पिधुन और मगुी फामों इत्र्ादि की स्ट्थापना। प्रजतजसद्ध। परन्त ुस्ट्थानीर् दकसानों द्वारा अपनी आिीजवका के जलए छोटे पैमान े पर मगुी फामा स्ट्थाजपत दकए िा सकें ।

10. नव काष्ठ आधाररत उद्योग। पाररजस्ट्थजतकी संवेिी िोन की सीमाओं के भीतर दकसी भी नए काष्ठ आधाररत उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी: परन्त ु जवद्यमान काष्ठ आधाररत उद्योग जवजध के अनुसार िारी रह सकें और जवद्यमान आरा जमलों के अनुज्ञजप्त का नवीनीकरण उनकी समाजप्त पर नहीं दकर्ा िाएगा।

11. पर्ाटन से संबंजधत अन्र् दक्रर्ाकलापों िैसे वार्ुर्ान, गमा वार्ु गुब्बारे, हजेलक़ॉप्टर, ड्रोन, माइक्रोलाइर्टस आदि द्वारा संरजक्षत क्षेत्र और पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उड़न े के दक्रर्ाकलाप करना। प्रजतजषद्ध। तथाजप, वन जवभाग गैर- वाजणजज्र्क प्रर्ोिन के जलए वृत्तजचत्र बनाने के जलए वन, पर्ाावरण और वन्र्िीव संरक्षण पर िागरूकता पैिा करन ेके जलए ड्रोन का उपर्ोग कर सकेगा।

12. जविेिी प्रिाजतर्ों का समावेिन। प्रजतजषद्ध।

13. िलाऊ लकड़ी का व्यावसाजर्क उपर्ोग। प्रजतजषद्ध।

14. दकसी भी खतरनाक पिाथा का उपर्ोग, उत्पािन र्ा प्रसंस्ट्करण । प्रजतजषद्ध। ख.जवजनर्जमत दक्रर्ाकलाप

15. वाजणजज्र्क होटलों और ररस़ॉर्टसा की स्ट्थापना। पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों के जलए लघु अस्ट्थार्ी संरचनाओं के जनमााण के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटो को स्ट्थापना [भाग II—खण्ड 3(ii)] भारत का रािपत्र : असाधारण 11 अनुज्ञात नहीं दकर्ा िाएगा:

संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा सभी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना और र्था लाग ूमागाििाक जसद्धांतों के अनरुूप होगा ।

16. संजनमााण दक्रर्ाकलाप। (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी-संवेिी िोन के जवस्ट्तार तक, िो भी जनकट हो, दकसी भी प्रकार के नए वाजणजज्र्क संजनमााण की अनुज्ञा नहीं िी िाएगी:

(ख) परंत,ु स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने के जलए भवन उपजवजधर्ों के अनुसार परैा 3 के उप-परैा (1) में सूचीबद्ध दक्रर्ाकलापों सजहत स्ट्थानीर् लोगों को उनके उपर्ोग के जलए अपनी भूजम पर संजनमााण करने की अनुज्ञा िी िाएगी:

(ग) एक दकलो मीटर के परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे।

17. गैर प्रिषूणकारी लघ ुउद्योग। फरवरी, 2016 में केन्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा िारी समर्- समर् पर संिोजधत उद्योगों के वगीकरण के अनुसार गरै-प्रिषूणकारी उद्योग और अपररसंकटमर्, लघु और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन की अपनी सामग्री से उत्पािों को उत्पन्न करने वाले कृजष आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनजु्ञात होंगे।

18. वृक्षों की कटाई । (क) संघ राज्र् क्षेत्र प्रिासन के सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं की िाएगी। (ख) वृक्षों की कटाई संबंजधत कें रीर् र्ा राज्र् के अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगें।

19. वन उत्पािों और गरै काष्ठ वन उत्पािों का संग्रहण । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

20. जवदु्यत और संचार ट़ॉवर लगाने, तार-जबछाने तथा अन्र् बुजनर्ािी ढांचे की व्यवस्ट्था । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा और भूजमगत केबल जबछाने को बढावा दिर्ा िाएगा।

21. नागररक सुजवधाओं सजहत बुजनर्ािी ढांचा। लाग ू जवजधर्ों, जनर्मों और जवजनर्मों तथा उपलब्ध मागाििाक जसद्धांतों के अनुसार िमन उपार्ों के साथ दकर्ा िाएगा

22. जवद्यमान सड़कों को चौड़ा करना, उन्हें सुिढृ बनाना और नए सड़कों लागू जवजधर्ों, जनर्मों और जवजनर्मन तथा मागाििाक जसद्धांतों के अनुसार िमन उपार्ों के साथ दकर्ा िाएगा। जवद्यमान सड़कों को 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] का जनमााण। मिबूत बनाने का काम उजचत पर्ाावरणीर् समाघात जनधाारण (राज्र् वन जवभाग और पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को अजनवार्ा रूप से सजम्मजलत करते हुए) और पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित मागाििाक जसद्धांतों "वन्र्िीवों पर रैजखक अवसंरचना के प्रभावों को कम करन ेके जलए पर्ाावरण अनुकूल उपार्" के अनुसार िमन उपार्ों के साथ दकर्ा िाएगा।

23. पहाड़ी ढलानों और निी तटों का संरक्षण। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगें।

24. राजत्र में र्ानीर् र्ातार्ात का संचलन । लाग ूजवजधर्ों के अधीन वाजणजज्र्क उद्देश्र् के जलए जवजनर्जमत।

25. प्राकृजतक िल जनकार्ों र्ा भू-क्षेत्र में उपचाररत अपजिष्ट िल र्ा बजहस्रााव का जनस्ट्सारण । उपचाररत अपजिष्ट िल र्ा बजहस्रााव का िल जनकार्ों में जनस्ट्सारण नहीं होने दिर्ा िार्ेगा और उपचाररत अपजिष्ट िल के पुनचाक्रण और पुन:उपर्ोग के प्रर्ास दकए िाएंगे, अन्र्था उपचाररत अपजिष्ट िल र्ा बजहस्रााव का जनस्ट्सारण लाग ू जवजधर्ों के अनुसार जवजनर्जमत दकर्ा िाएगा।

26. सतही और भूिल का व्यावसाजर्क जनष्कषाण। (क) सतही िल और भूिल के जनष्कषाण की अनुमजत केवल वास्ट्तजवक कृजष उपर्ोग और भूजम के अजधभोगी र्ा स्ट्वामी के घरेलू उपभोग के जलए िी िाएगी। (ख) औद्योजगक र्ा वाजणजज्र्क उपर्ोग के जलए सतही िल और भूिल का जनष्कषाण, जिसमें जनकाली िा सकन े वाली मात्रा भी सजम्मजलत ह,ै के जलए संबंजधत जनर्ामक प्राजधकरण से पूवा अनुमजत और अनुमोदित मास्ट्टर प्लान के अनुसार अनुमजत की आवश्र्कता होगी। ग) पाररजस्ट्थजतकी संवेिी िोन के बाहर दकसी भी स्ट्थान पर सतही िल र्ा भूिल की जबक्री प्रजतजसद्ध ह।ै

27. कृजष र्ा अन्र् उपर्ोग के जलए खुला कुआाँ, बोरवेल आदि। सक्षम प्राजधकारी द्वारा दक्रर्ाकलापों की कड़ाई से जनगरानी और जवजनर्जमत की िानी चाजहए। िघुाटनाओं को रोकने के जलए कुओं को ढकने का उपार् दकर्ा िाएगा।

28. ठोस अपजिष्ट प्रबंधन। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

29. पाररजस्ट्थजतकी- पर्ाटन। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा।

30. वाजणजज्र्क पिुधन और मुगीपालन फामों की स्ट्थापना। स्ट्थानीर् दकसानों द्वारा अपजिष्ट प्रबंधन की उजचत उपार्ों के साथ लाग ूजवजधर्ों के अनुरूप जवजनर्जमत।

31. प़ॉलीजथन/ प्लाजस्ट्टक बैग का प्रर्ोग। लाग ूजवजधर्ों के अनुसार जवजनर्जमत, िहां कैरी बैग की मोटाई 120 माइक्रोन से कम नहीं होनी चाजहए और ऩॉनवोवन प्लाजस्ट्टक कैरी बैग [भाग II—खण्ड 3(ii)] भारत का रािपत्र : असाधारण 13

5. जनगरानी सजमजत.- केन्रीर् सरकार द्वारा इस अजधसूचना के उपबंधों के प्रभावी जनगरानी के जलए, एक जनगरानी सजमजत का गठन दकर्ा गर्ा ह,ै जिसमें जनम्नजलजखत सिस्ट्र् सजम्मजलत हैं, अथाात:्-

वन्र्िीव/पर्ाावरण (जवरासत संरक्षण सजहत) के क्षेत्र में गरै-सरकारी संगठन का एक प्रजतजनजध, जिसे िम्मू और कश्मीर राज्र् सरकार द्वारा समर्-समर् पर प्रत्र्ेक तीन वषा में नामजनर्िाष्ट दकर्ा िाएगा। सिस्ट्र्;

पाररजस्ट्थजतकी और पर्ाावरण में एक जविेषज्ञ को िम्म ूऔर कश्मीर सरकार द्वारा सिस्ट्र्;

35. ग्रामीण कारीगरी सजहत कुटीर उद्योग। सदक्रर् रूप से बढावा दिर्ा िाएगा ।

36. नवीकरणीर् ऊिाा ईंधन का प्रर्ोग । िैजवक गैस, सौर प्रकाि इत्र्ादि को बढावा दिर्ा िाएगा।

37. कृजष वाजनकी । सदक्रर् रूप से बढावा दिर्ा िाएगा ।

38. पाररजस्ट्थजतकी अनुकूल पररवहन का प्रर्ोग । सदक्रर् रूप से बढावा दिर्ा िाएगा ।

39. अवक्रजमत भूजम/वनों/ पर्ाावासों की बहाली । सदक्रर् रूप से बढावा दिर्ा िाएगा ।

6. जनगरानी सजमजत के कार्ा. – जनगरानी सजमजत इस अजधसूचना के उपबंधों के अनुपालन की जनगरानी करेगी:

(1) जनगरानी सजमजत, वास्ट्तजवक स्ट्थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर, उन दक्रर्ाकलापों की संवीक्षा करेगी िो दक भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ा का.आ.1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची में िी गई हैं और पाररजस्ट्थजतकी संवेिी िोन में की िा रही हैं, इसके पैरा 4 की सारणी में जवजनर्िाष्ट प्रजतजषद्ध दक्रर्ाकलापों के जसवार् और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरणीर् अनापजत्त के जलए, र्था जस्ट्थजत, केन्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् र्ा राज्र् पर्ाावरण समाघात जनधाारण प्राजधकरण को संिर्भात की िा रही हो।

(2) िो दक्रर्ाकलाप भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ा का.आ.1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची में न आती हों और पाररजस्ट्थजतकी संवेिी िोन में की िा रही हों, इसके पैरा 4 के अधीन सारणी में जवजनर्िाष्ट प्रजतजसद्ध दक्रर्ाकलापों के जसवार्, की संवीक्षा जनगरानी सजमजत द्वारा वास्ट्तजवक स्ट्थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर की िाएंगी और उससे संबंजधत जनर्ामक प्राजधकरणों को संिर्भात दकर्ा िाएगा।

(3) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबंजधत कलेक्टर र्ा संबंजधत उप वन संरक्षक, इस अजधसूचना के उपबंधों का उल्लंघन करन े वाल े दकसी भी व्यजि के जवरुद्ध पर्ाावरण अजधजनर्म, की धारा 19 के अधीन जिकार्त ििा करने के जलए सक्षम होगा।

(4) जनगरानी सजमजत मामले िर मामल ेके आधार पर आवश्र्कतानुसार जवचार-जवमिा में सहार्ता के जलए संबंजधत जवभाग के प्रजतजनजध र्ा जविेषज्ञ, उद्योग संघों र्ा संबंजधत पणधाररर्ों के प्रजतजनजध को आमंजत्रत कर सकती ह।ै

(5) जनगरानी सजमजत प्रत्र्ेक वषा 31 माचा तक की अवजध की अपनी दक्रर्ाकलापों की वार्षाक कारावाई ररपोटा उसी वषा 30 िून तक इस अजधसूचना में संलग्न उपाबधं-VI में जवजनर्िाष्ट प्ररुप में राज्र् के मुखर् वन्र्िीव वाडान को प्रस्ट्तुत करेगी।

(6) केन्रीर् सरकार, जनगरानी सजमजत को उनके कार्ों के प्रभावी जनवाहन के जलए िो ठीक समझे, जलजखत रूप में ऐसे जनिेि ि ेसकेगी।

7. अजतररि उपार्.- केन्रीर् सरकार और संघ राज्र् क्षेत्र प्रिासन इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए अजतररि उपार्, र्दि कोई हो, जवजनर्िाष्ट कर सकेगी।

8. कोई अन्र् महत्वपूणा मामला। [फा.सं.25/2/2023-ईएसिडे] ड़ॉ. सु. केरकेट्टा, वैज्ञाजनक-‘िी’ MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi,the 26th May, 2025 S.O. 2356(E).—Whereas a draft notification was published in the Gazette of India, Extraordinary, vide number S.O. 4325(E), dated the 3rd October, 2024, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

And whereas, copies of the Gazette containing the said draft notification were made available to the public on 3rd October, 2024;

And whereas, no objections, comments and suggestions were received from persons and stakeholders in respect of the said draft notification;

30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] And whereas, the Tral Wildlife Sanctuary lies about 45 kilometers South-East of Srinagar city. It falls in the Pulwama District of the Kashmir Valley with the district Headquarter Pulwama at a distance about 30 kilometers. The nearest airport, Srinagar is 50 kilometers and the nearest railhead, Awantipora is 15 kilometers. away from the Sanctuary;

And whereas, historically, parts of the protected area, namely Shikargah and Khangund (previously designated as Conservation Reserves), have the distinction of being among the oldest notified protected areas in the country and the notification dates back to 1945, when they were governed by the game laws of the Maharajah of the erstwhile princely state of Jammu and Kashmir.

And whereas, in 2019, these Conservation Reserves, along with the adjoining areas comprising territorial forest compartments, were upgraded to a Wildlife Sanctuary and the sanctuary is spread over the rugged and undulating terrain of the Greater Himalayan Mountains, encompassing an area of around 155 square kilometers and came into existence through State Government notification No.

FST/WL/07/2018 (SRO-639), dated the 23rd October 2019;

And whereas, the Tral Wildlife Sanctuary and adjoining areas fall within the distribution range of the Kashmir Red Deer (Hangul), a Schedule I species as per the Wildlife (Protection) Act, 1972, and designated as 'critically endangered' in the International Union for Conservation of Nature (IUCN) Red Data Book and the distribution of the Hangul is restricted to Dachigam National Park and a few adjoining areas only. And whereas the Tral Wildlife Sanctuary is among the few areas outside Dachigam National Park where a population of this critically endangered deer still survives and the sanctuary is also connected with other important wildlife areas, such as Overa-Aru Wildlife Sanctuary and Khrew Conservation Reserve and these protected areas together form a landscape of rich biodiversity and support good populations of some important and endemic species of animals, birds, and vegetation;

And whereas, the Tral Wildlife Sanctuary is home to various endemic species like Kashmir Red Deer (Cervus hanglu hanglu), Kashmir Musk Deer (Moschus cupreus) and Kashmir Gray Langur (Semnopithecus ajax). While other Rare, Endangered and Threatened species found in the sanctuary are Common Leopard (Panthera pardus), Himalayan Griffon Vulture (Gyps himalayensis), Bearded Vulture (Gypaetus barbatus) and Kashmir Flycatcher (Ficedula subrubra) and the Tral forests are blessed with numerous plant species of great medicinal value like Aconitum heterophyllum, Arnebia benthamii, Artemisia absinthium, Berberis lycium, Bergenia ciliata, Datura stramonium, Dioscorea deltoidea, Lavatera cashmeriana, Saussurea costus and Taxus wallichiana;

And whereas, the Tral Wildlife Sanctuary falls under the 2A province of biogeographic classification as suggested by Rodgers et al. According to the classification by Champion and Seth

(1968), the vegetation of the Sanctuary is typically Himalayan moist temperate forest, sub-alpine forest, and alpine forest types and the vegetation types of the Tral Wildlife Sanctuary are determined by the habitat, form, and density of the dominant floral species. The major vegetation types are:

(1) Riverine: (1600-2300m): This type of vegetation occurs at lower altitudes and is dominated by broad-leaved species of Aesculus indica, Fraxinus hookeri, Parrotiopsis jacquemontiana, and Juglans regia the dominant shrubs include Indigofera heterantha, Lonicera species, Viburnum, Skimmia laurel, Jasminum species etc.

(2) Coniferous Forests: (2300-3000m): This type of forest consists of Blue Pine (Pinus wallichiana) and Fir (Abies pindrow) as dominant species, found in association with Spruce (Picea smithiana) at an altitude of 2300m the woodland also occupies sides of nallahs at some places.

3. Alpine Scrubs and Pastures: (3000-3500m): This type of forest consists of treeless pastures having scattered scrub vegetation and Birch (Betula utilis) is the most dominant species of this area near the tree line associated with Juniperus recurva, Rhododendron species, Viburnum species, Lonicera species and Primula at shady places and extensive alpine [भाग II—खण्ड 3(ii)] भारत का रािपत्र : असाधारण 31 meadows above the tree line known as ‘Margs’ bear a luxuriant growth of perennial herbs and grasses and also dominant shrub species here are Myosotis species, Cynoglossum species etc.

Betula utilis is found dotted at some places.

4. Rock Faces: (above 3500m): The rocky cliffs and hill tops are dominated by dwarf evergreen shrubs including Juniperus recurva, Rhododendron anthopogon etc. associated with herbs, Stachys sericea, Sieversia elata and Veronica melissifolia.

And whereas, the Tral Wildlife Sanctuary forms an important corridor for the movement of Hangul. The declaration of the eco-sensitive zone shall help in creating a buffer around the sanctuary area leading to a secure, suitable and viable habitat for the last remnant Hangul population;

No therefore, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of zero to 3.26 kilometers from the boundary of Tral Wildlife Sanctuary in the Union territory of Jammu and Kashmir as Tral Wildlife Sanctuary Eco-sensitive Zone (hereinafter after referred to as Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-Sensitive Zone — (1) The extent of the Eco-Sensitive Zone around the Tral Wildlife Sanctuary ranges from 0 kilometer to 3.26 kilometer from its boundary, encompassing an area of 127.10 square kilometers, which includes 26 villages and specific extent of the ESZ in different directions is provided below:

(3) The boundary description of Eco-Sensitive Zone in different directions along with geocoordinates of Tral Wildlife Sanctuary boundary is appended as Annexure- IA.

(4) The maps of Eco-Sensitive Zone along with boundary details are appended as Annexure- II to Annexure- IIG.

(5) The list of villages falling in the Eco- sensitive Zone and demographic pattern is appended as Annexure- III & Annexure- IV respectively.

(6) The list of mammals and birds found in the Tral Wildlife Sanctuary is appended as Annexure - V.

2. Zonal Master Plan for the Eco-Sensitive Zone. - (1) The Union territory Government shall, for the purposes of the Eco-Sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the Union territory.

(2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the Union territory Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union territory laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the Union Territory Government, for integrating the ecological and environmental considerations into the said plan:

(i) Environment;

(ii) Forests and wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Pollution Control Board;

(x) Municipality;

(xi) Panchayati Raj; and

(xii) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and ecofriendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.

[भाग II—खण्ड 3(ii)] भारत का रािपत्र : असाधारण 33

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by the Union territory administration of Jammu and Kashmir.- The Union territory Government shall take the following measures for giving effect to the provisions of this notification, namely: -

(1) Land use: (a) Forests, horticulture areas, agricultural areas along with parks and open spaces earmarked for recreational purposes in the Eco-Sensitive Zone shall not be used or converted into areas for commercial, residential, or industrial activities:

Provided that the conversion of agricultural and other lands, for the purpose other than that specified in clause (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or Union territory administration as applicable and vide provisions of this notification, to meet the residential needs of the local residents such as: -

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and

(v) promoted activities and concerned regulated activities given in paragraph 4;

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the Union territory administration and without compliance of the provisions of article 244 of the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the respective Union territory administration, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph;

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural Water Bodies & Springs. – (1) The catchment areas of all natural springs or rivers or channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union territory administration in such a manner as to prohibit development activities at or near these areas as which are detrimental to such areas.

(2) the extraction of ground water shall be permitted for only bonafide agricultural and domestic consumption of the owner or occupier of the land as the case may be. All measures shall be taken to prevent contamination or pollution of water source from any commercial or agricultural or livestock operations.

(3) Tourism or Eco-Tourism. - (a) All new eco-tourism, tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco- Sensitive Zone.

(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism in consultation with Environment and Forest Department of Union territory administration.

(c) The Eco-Tourism Master Plan shall form a component of the Zonal Master Plan and it shall be based on the carrying capacity studies of the Eco-Sensitive Zone.

(d) The activity of Eco-Tourism shall be regulated as under, namely: -

(i) No new construction of hotels and resorts shall be allowed within 1 kilometer from the boundary of the Wildlife Sanctuary or up to the extent of the Eco-Sensitive Zone whichever is nearer:

Provided that beyond the distance of one kilometer from the boundary of the protected area till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas only for eco-tourism facilities as per Eco- Tourism Master Plan;

(ii) All new tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be in accordance with the eco-tourism guidelines issued by Ministry of Environment, Forest and Climate Change in 2018 and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on ecotourism, eco-education and eco-development;

(iii) Until the Zonal Master Plan is prepared and approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site-specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural Heritage. - All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.

(5) Man-made heritage sites. – The buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and plans for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise Pollution. -The prevention and Control of noise pollution in the Eco-Sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act and as amendments thereto.

(7) Air Pollution. – The prevention and control of air pollution in the Eco-Sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981), and the rules made there under.

(8) Discharge of Effluents. -The discharge of untreated effluent and sewage is prohibited and the discharge of treated effluent in the Eco-Sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974), and the rules made there under.

(9) Solid wastes – The disposal and Management of solid wastes shall be as under: -

(a) The solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 as amended from time to time and the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-Sensitive Zone.

(b) Safe and Environmentally Sound Management (ESM) of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(10) Bio-medical waste –The bio medical waste management shall be as under:

(a) The bio-medical waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 and as amended from time to time.

(b) Safe and Environmentally Sound Management (ESM) of bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(11) Plastic waste management - The plastic waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 as amended from time to time.

(12) Construction and demolition waste management - The construction and demolition waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 as amended from time to time.

(13) E-waste - The e- waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 as amended from time to time.

(14) Vehicular traffic – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the Union territory administration, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution -The prevention and control of vehicular pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel such as Compressed Natural Gas, Liquefied petroleum gas, etc.

(16) Industrial units – On or after the publication of this notification in the Official Gazette,

(a) No new polluting industries shall be allowed to be set up within the Eco-Sensitive Zone;

(b) non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of Industries in the guidelines issued by Central Pollution Control Board, unless so specified in that notification;

(c) non polluting cottage industries shall be promoted.

(17) Protection of hill slopes - The protection of hill slopes shall be as under:

(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone - All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act, the rules made there under and other notifications, laws and acts of the Government of India pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time to time specified in the Table below, namely:

(b) The mining operations shall be carried out in accordance with the order (s) of the Hon’ble Supreme Court in the matter of T.N.

Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012 and IA No. 1000 of 2003 judgment dated the 3rd June, 2022 and subsequent IA No. 131377 of 2022 judgment dated the 26th April, 2023 and the 28th April,

2023.

2. Setting up of industries causing pollution. (Water, Air, Soil, Noise, etc.).

New industries and expansion of existing polluting industries in the Eco-Sensitive Zone shall not be permitted:

Provided that, non-polluting industries shall be allowed within Eco-Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the nonpolluting cottage industries shall be promoted.

3. Establishment of major hydroelectric projects.

Prohibited.

4. Use or production or processing of Prohibited.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited.

6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.

No new solid waste disposal site and waste treatment or processing facility of solid waste is permitted within Eco-Sensitive Zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment or hospitals etc. is prohibited.

7. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

8. Setting of Brick Kilns. All new and existing brick kiln units are prohibited.

9. Establishment of large-scale commercial livestock and poultry farms by firms, and companies.

Prohibited;

Provided that small-scale poultry farms by local farmers can be established for sustenance of their livelihood.

10. New wood-based industries. No establishment of new wood-based industry shall be permitted within the limits of Eco-sensitive Zone:

Provided the existing wood-based industry may continue as per law and renewal of licenses of existing saw mills shall not be done on their expiry.

11. Undertaking activities related to tourism like over-flying the Eco Sensitive Zone area by any Aircraft, Hot Air Balloons, Helicopter, Gliders, Parasailing, Drones, Microlites etc.

Prohibited. However, Forest and Wildlife Departments may use Drones for creating awareness on forest, environment and wildlife conservation for making documentaries for non-commercial purpose.

12. Introduction of exotic species. Prohibited.

13. Commercial use of Firewood. Prohibited.

14. Use or production of any hazardous substances.

Prohibited.

Regulated Activities

15. Commercial establishment of hotels and resorts.

New commercial hotels and resorts along with their expansion shall not be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-Sensitive Zone, whichever is nearer, except for small temporary structures only for ecotourism activities;

Beyond one kilometer from the boundary of the protected area, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

16. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-Sensitive Zone whichever is nearer:

Provided that, local people shall be permitted 38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

17. Non-polluting industries. Only non-polluting industries termed as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted with the prior permission from the competent authority as per applicable rules and regulations.

18. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the Union territory administration.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.

19. Collection of forest produce or Non-Timber Forest Produce.

Regulated as per applicable laws.

20. Erection of electrical and communication towers and laying of cables and other infrastructures.

Regulated as per applicable laws. Construction or augmentation and renovation of power transmission lines and cables, telecommunication towers and cables shall be permitted. New underground cabling may be promoted.

21. Infrastructure including civic amenities.

Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

22. Widening and strengthening of existing roads and construction of new roads.

Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines. Strengthening of the existing roads shall be done with proper Environmental Impact Assessment (mandatorily involving the State Forest Department and the Ministry of Environment, Forest, and Climate Change) and mitigation measures as per the guidance document “Eco-Friendly Measures to Mitigate Impacts of Linear Infrastructure on Wildlife." Published by Ministry of Environment, forest and Climate changes.

23. Protection of Hill Slopes and river banks.

Regulated under applicable laws.

24. Movement of vehicular traffic at night.

Regulated under applicable laws.

25. Discharge of treated waste water/ effluents in natural water bodies or land area.

The discharge of treated waste water/ effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water.

Otherwise, the discharge of treated waste water or [भाग II—खण्ड 3(ii)] भारत का रािपत्र : असाधारण 39 effluent shall be regulated as per applicable laws.

26. Commercial extraction of surface and ground water.

(a) The extraction of surface water and ground water shall be permitted only for bonafide agricultural use and domestic consumption of the occupier or owner of the land.

(b) Extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted shall require prior permission from the concerned regulatory authority and as per approved master plan.

(c) Sale of surface water or ground water to any place outside ESZ is prohibited.

27. Open Well, Bore Well etc. for agriculture or other usage.

Regulated and the activity should be strictly monitored by the regulatory authority. Measure shall be taken to cover the wells to prevent accidents.

28. Solid Waste Management. Regulated as per applicable laws.

29. Eco-tourism activities. Regulated as per applicable laws.

30. Establishment of commercial livestock and poultry farms.

Regulated as per applicable laws with proper precautions of waste management by local farmers.

31. Use of polythene/ plastic bags by shopkeepers.

Regulated as per applicable laws, where the thickness of the carry bag should not be less than 120 microns and Non-woven plastic carry bag shall not be less than 60 Gram Per Square Meter (GSM).

Promoted Activities

32. Rain water harvesting. Shall be actively promoted.

33. Organic Farming. Shall be actively promoted.

34. Adoption of green technology for all activities.

Shall be actively promoted.

35. Ongoing agriculture and horticulture practices by local communities Shall be actively promoted. However, excessive expansion of some of these activities should be regulated as per the master plan.

36. Use of renewable energy and clean fuels.

Bio gas, solar light, Compressed Natural Gas, Liquefied petroleum gas etc. to be actively promoted.

37. Agro-Forestry. Shall be actively promoted.

38. Use of eco-friendly transport. Shall be actively promoted.

39. Restoration of Degraded Land/ Forests/ Habitat.

Shall be actively promoted.

40. Environment Awareness. Shall be actively promoted.

5. Monitoring Committee:- There shall be a Committee to be known as Monitoring Committee constituted by the Central Government which shall comprise of the following persons specified in the Table below, namely: -

1. Collector/Deputy Commissioner, Pulwama Chairman ‘ex-officio;

2. Regional officer, Jammu and Kashmir Pollution Control Board Member ‘ex-officio;

3. Representative of Non-Government Organization working in Member;

4. One expert in ecology and environment to be nominated by the Government of Jammu and Kashmir from time to time every three years Member;

5. Divisional Forest Officer, Awantipora Member ‘ex-officio;

6. Wildlife Warden, Shopian Division Member Secretary, ‘ex-officio;

6. Functions of the Monitoring Committee – The Monitoring Committee shall monitor the compliance of the provisions of this notification:

(1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1553 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification.

(2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-Sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the concerned Regulatory Authorities.

(3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.

(4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case-to-case basis.

(5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in proforma specified in Annexure-VI, appended to this notification.

(6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional Measures- The Central Government and the Union territory administration may specify additional measures, if any, for giving effect to provisions of this notification.

8. Supreme Court, etc. orders- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.

(a) Fauna Around 15 species of mammals, including some rare ones are found within the limits of Tral Wildlife Sanctuary and the adjoining areas and these mammal species include:

3. Asiatic Black Bear (Ursus thibetanus)

4. Himalayan Brown Bear (Ursus arctos)

5. Common Leopard (Panthera pardus)

6. Leopard Cat (Prionailurus bengalensis)

7. Jungle Cat (Felis chaus)

8. Red Fox (Vulpes vulpes)

9. Siberian Weasel (Mustela sibirica)

10. Tibetan Wolf (Canis lupus)

11. Golden Jackal (Canis aureus)

12. Yellow-throated Marten (Martes flavigula)

13. Kashmir Grey Langur (Semnopithecus ajax)

14. Rhesus Macaque (Macaca mulatta)

8. Chestnut Thrush (Turdus rubrocanus)

9. Common Rosefinch (Carpodacus erythrinus)

11. European Bee-eater (Merops apiaster)

12. Chestnut-eared Bunting (Emberiza fucata)

13. Pine Bunting (Emberiza leucocephalos)

14. Rock Bunting (Emberiza cia)
