PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन एव ंिलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 16 िनवरी, 2026 का.आ. 238(अ).— भारत के रािपत्र, में भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् की अजधसूचना संख्र्ा का.आ. 2575 (अ), तारीख 12 िून 2025 द्वारा एक मसौिा अजधसूचना प्रकाजित की गई थी, जिसमें उक्त अजधसूचना की प्रजतर्ां िनता को उपलब्ध कराए िाने की तारीख से साठ दिनों की अवजध के भीतर इससे प्रभाजवत होने वाले सभी व्यजक्तर्ों से आक्षपे और सुझाव आमंजत्रत दकए गए थ;े और, उक्त प्रारुप अजधसूचना को अतंर्वाष्ट करन ेवाली रािपत्र की प्रजतर्ां िनता को तारीख तारीख 13 िून 2025 को उपलब्ध करा िी गई थी; और, उक्त प्रारुप अजधसूचना के संबंध में व्यजक्तर्ों और पणधाररर्ों से प्राप्त आक्षेप और सुझावों पर कें द्रीर् सरकार द्वारा जवचार दकर्ा गर्ा ह;ै और कंुभलगढ़ वन्र्िीव अभर्ारण्र् अरावली पवातमाला के सबसे नािुक पाररजस्ट्थजतकी तंत्रों में से एक में जस्ट्थत ह ैऔर स.ं 216] नई दिल्ली, िुक्रवार, िनवरी 16, 2026/पौष 26, 1947 25/आषाढ़ 3, 1947 No216] NEW DELHI, FRIDAY, JANUARY 16, 2026/PAUSHA 26, 1947 SHADHA 3, 1947 सी.जी.-डी.एल.-अ.-16012026-269376 CG-DL-E-16012026-269376 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सुरम्र् झील िहर उिर्पुर से लगभग 80 दकलोमीटर उत्तर में जस्ट्थत ह।ै भौगोजलक िजृष्ट से, अभर्ारण्र् 73°02′ से 73°30′ पूवी िेिांतर और 25°00′ से 25°40′ उत्तरी अक्षांि के बीच जस्ट्थत ह।ै र्ह 610.528 वगा दकलोमीटर के्षत्र में फैला हुआ ह,ै िो रािस्ट्थान राज्र् के रािसमिं, पाली और उिर्पुर जिलों के कुछ जहस्ट्सों को घरेता ह;ै और कंुभलगढ़ वन्र्िीव अभर्ारण्र् पजिम में जस्ट्थत अरावली के पहाडी िंगलों और थार रेजगस्ट्तान के बीच एक पाररजस्ट्थजतकी तंत्र बनाता ह।ै कंुभलगढ़ की पहाजडर्ााँ एक अवरोधक की तरह काम करती हैं, िो रेजगस्ट्तान के पूवा की ओर जवस्ट्तार को रोकती हैं। पहाडी के ऊपर जस्ट्थत प्रजसद्ध कंुभलगढ़ दकला पर्ाटकों के जलए आकषाण का कें द्र ह।ै अभर्ारण्र् का पूवी भाग अजधकतर समुद्र तल से 3500 फीट से अजधक ऊाँ चाई वाली पवातमाला ह,ै िबदक अभर्ारण्र् का पजिमी भाग मारवाड के मैिानों से सटा हुआ ह;ै और अभर्ारण्र् में जवजवध स्ट्थलाकृजत ह,ै इसजलए इसका महत्व और भी बढ़ िाता ह ैक्र्ोंदक र्ह िेि के िो प्रमुख िलग्रहण क्षेत्रों के बीच एक जवभािन रेखा भी बनाता ह।ै इसका पूवी भाग बनास निी का स्रोत माना िाता ह,ै िो बंगाल की खाडी में जगरती ह।ै पजिमी ढलान पर वषाा का पानी सुकडी, जमठडी, सुमेर और कोट िैसी छोटी नदिर्ों के रूप में बहती ह,ै रे् सभी लूनी निी की सहार्क नदिर्ााँ बनती हैं िो अतंतः अरब सागर में जवलीन हो िाती हैं; और अभर्ारण्र् समृद्ध और अजद्वतीर् िैव जवजवधता का समथान करता ह ैिो िंगली सूअर (सस स्ट्क्रोफा), ग्रे मस्ट्क श्रू (संचस मुररनस), चमगािड (सार्नोप्टेरस सस्ट्फंक्स), फ्लाइंग फॉक्स (पेरोपस जगिेंरटकस), सामान्र् तेंिआु (पैंथरेा पाडास), धारीिार लकडबग्घा (हएना हर्ाना), िंगली जबल्ली (फेजलस चाउस), पांच धारीिार ताड जगलहरी (फनमबुलस पेनांती), िैसी प्रिाजतर्ों का घर ह।ै भारतीर् पैंगोजलन (मैजनस कैराजसकाउडाटा), भारतीर् लोमडी (वुल्पसे बेंगालेंजसस), आम नेवला (हपेस्ट्टेस एडवडासी), नीला बैल (बोसेलाफस रैगोकैमलेस), भारतीर् साही (जहजस्ट्रक्स इंजडका), सचंकारा (गिेला गिेला), जसर्ार (कैजनस ऑररर्स), भारतीर् छोटा जसवेट (जववाररकुला इंजडका) आदि। िबदक अभर्ारण्र् में पाए िान े वाल े महत्वपूणा पक्षी हैं पेंटेड फ्रैं कोजलन (फ्रैं कोजलनस जपक्टस), ग्र े फ्रैं कोजलन (एफ. पोंजडसेररर्नस), कॉमन के्वइल (कोटर्नाक्स कोटर्नाक्स), रेन के्वइल (सी. कोरोमेडेजलक), रॉक बुि के्वइल (पेर्डाकुला आगााउंडाह), पीले पैर वाल ेबटन के्वइल (टर्नाक्स टंकी), बैरड बटन के्वइल (टी. सजस्ट्कटेटर), भारतीर् मोर (पावो दक्रस्ट्टेटस), रूडी िेल्डक (टैडोराना फेरुजगजनर्ा), गडवाल (अनास स्ट्रेपेरा), कॉमन टील (ए. के्रका), गागानी (ए. के्वकेडुला), आदि; और उक्त अजधसूचना के परैा 1 में जनर्िाष्ट कंुभलगढ़ वन्र्िीव अभर्ारण्र् के के्षत्र, जवस्ट्तार और सीमा को पाररजस्ट्थजतक, पर्ाावरणीर् और िैव जवजवधता के िजृष्टकोण से संरजक्षत और सुरजक्षत करना आवश्र्क ह ै तथा उक्त पाररजस्ट्थजतक संवेिनिील के्षत्र में उद्योगों र्ा उद्योगों के वगा तथा उनके संचालन और प्रदक्रर्ाओं पर प्रजतबंध लगाना आवश्र्क ह;ै अतः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इसमें इसके पिात ्अजधसूचना में आग ेपर्ाावरण अजधजनर्म कहा गर्ा ह)ै की उपधारा (1) और उपधारा (2) के खंड (v) और (xiv) तथा धारा 3 की उपधारा

(3) द्वारा प्रित्त िजक्तर्ों का प्रर्ोग करत ेहुए, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के साथ परठत, रािस्ट्थान राज्र् में कंुभलगढ़ वन्र्िीव अभर्ारण्र् की सीमा के आसपास िून्र् से एक दकलोमीटर के के्षत्र को कंुभलगढ़ वन्र्िीव अभर्ारण्र्, पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पिात् अजधसूचना में आग ेपाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका ब्र्ौरा जनम्नानुसार ह:ै -

(1) पाररजस्ट्थजतकी-सवंिेी िोन का जवस्ट्तार और सीमा.— (1 ) पाररजस्ट्थजतकी संवेिी िोन की सीमा कंुभलगढ़ वन्र्िीव अभर्ारण्र् की सीमा के आसपास िून्र् से एक दकलोमीटर तक ह,ै जिसमें 243 वगा दकलोमीटर का पाररजस्ट्थजतकी संवेिी िोन के्षत्र सजम्मजलत ह।ै अभर्ारण्र् की उत्तरी सीमा में पाररजस्ट्थजतकी संवेिी िोन की िून्र् सीमा रावली टॉडगढ़ वन्र्िीव अभर्ारण्र् के साथ साझा सीमा के कारण ह।ै जवजभन्न दििाओं में पाररजस्ट्थजतकी संवेिी िोन की सीमा इस प्रकार ह:ै उत्तर 0 दकलोमीटर उत्तर-पूवा 1.00 दकलोमीटर पूवा 1.00 दकलोमीटर िजक्षण-पूवा 1.00 दकलोमीटर िजक्षण 1.00 दकलोमीटर िजक्षण-पजिम 1.00 दकलोमीटर पजिम 1.00 दकलोमीटर उत्तर-पजिम 1.00 दकलोमीटर

(2) पाररजस्ट्थजतकी संवेिी िोन का सीमा जववरण उपाबधं-I में संलग्न ह।ै

(3) पाररजस्ट्थजतकी संवेिी िोन के मानजचत्र सीमा जववरण सजहत उपाबधं-II क, उपाबधं-II ख और उपाबधं-II ग में संलग्न हैं। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(4) संरजक्षत के्षत्र और उसके पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू-जनिेिांक क्रमिः उपाबधं-III और उपाबधं-IV में संलग्न हैं।

(5) पाररजस्ट्थजतकी संवेिी िोन में आन ेवाल े94 गांवों की सूची उपाबधं-V में संलग्न ह।ै

2. पाररजस्ट्थजतकी -सवंिेी िोन के जलए आचंजलक महार्ोिना. —(1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए इस अजधसूचना में दिए गए उपबंधों के अनुसरण में रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो वषा के भीतर, स्ट्थानीर् व्यजक्तर्ों के परामिा से और भीतर राज्र् सरकार में सक्षम प्राजधकारी के अनुमोिन के जलए एक आंचजलक महार्ोिना तैर्ार और अजधसूजचत करेगी।

(2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना को इस अजधसूचना में जवजनर्िाष् ट तत्समर् प्रवृत जवजध के जलए सुसंगत जवजधर्ों तथा केन्द्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों के अनुरूप र्दि कोई हों, तैर्ार दकर्ा िार्ेगा।

(3) आंचजलक महार्ोिना को उक्त र्ोिना में पाररजस्ट्थजतकी तथा पर्ाावरण जवचारों को समाजहत करन े के जलए, राज्र् सरकार जनम्नजलजखत जवभागों के परामिा से तैर्ार दकर्ा िाएगा, अथाात् :

(i) पर्ाावरण;

(ii) वन और वन्र्िीव

(iii) िहरी जवकास;

(iv) पंचार्ती राि और ग्रामीण जवकास;

(v) पर्ाटन;

(vi) रािस्ट्व;

(vii) कृजष;

(viii) रािस्ट्थान राज्र् प्रिषूण जनर्ंत्रण बोडा;

(ix) ससंचाई और बाढ़ जनर्ंत्रण;

(x) नगर पाजलका; और,

(xi) लोक जनमााण जवभाग और रािमागा।

(4) िब तक इस अजधसूचना में जवजनर्िाष्ट न हो, आंचजलक महार्ोिना में अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं दकर्ा िाएगा तथा आचंजलक महार्ोिना में सभी अवसंरचनाओं और दक्रर्ाकलापों में सुधार करके उन्ह े अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनाने की व्यवस्ट्था की िाएगी। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5

(5) इस आंचजलक महार्ोिना में वनरजहत और अवक्रजमत क्षते्रों के िीणोंद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी एवं पर्ाावरण से संबंजधत ऐसे अन्र् पहलओुं के जलए उपबंध दकर् े िार्ेंग े जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै

(6) इस आंचजलक महार्ोिना में सभी जवद्यमान पूिा स् थलों, ग्रामों एवं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एवं दकस् मों, कृजष क्षेत्रों, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्र् िल जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा और प्रस्ट्ताजवत भू-उपर्ोग की जविेषताओं का ब्र्ौरा भी दिर्ा िाएंगा।

(7) आंचजलक महार्ोिना में पाररजस्ट्थजतकी संवेिी िोन में जवकास का जवजनर्मन दकर्ा िाएगा और सारणी के परैा 4 में सूचीबद्ध प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन दकर्ा िाएगा और इसमें स्ट् थानीर् समुिार् की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास को भी सुजनजित दकर्ा िाएगा और संवधान दकर्ा िाएगा।

(8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना के साथ सह-काजलक होगी।

(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक प्रजत जनिेि िस्ट्तावेि का काम करेगी जिससे वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपन ेकताव्यों का जनवाहन कर सके।

3. राज्र् सरकार द्वारा दकए िान े वाल े उपार् .— राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्: -

(1) भ-ूउपर्ोग – (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए अजभज्ञात उद्यानों और खुले स्ट्थानों का वाजणजज्र्क र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान नही होगा: परंत ुपाररजस्ट्थजतकी संवेिी िोन के भीतर उपर्ुाक्त भाग (क) में जवजनर्िाष्ट प्रर्ोिन से जभन्न दकसी अन्र् प्रर्ोिन के जलए कृजष और अन्र् भूजम का संपररवतान जनगरानी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लागू केन्द्रीर् सरकार र्ा राज्र् के्षत्र सरकार के अन्र् जनर्मों एवं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से और इस अजधसूचना के उपबंधों के द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करने के जलए अनुज्ञात दकर्ा िा सकेगा:-

(i) जवद्यमान सडकों को चौडा करना और उन्हें सुिढृ़ करना तथा नई सडकों का जनमााण करना;

(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;

(iii) प्रिषूण उत्पन्न न करने वाल े लघु उद्योग;

(iv) ग्राम उद्योग सजहत कुटीर उद्योग; पाररजस्ट्थजतकी पर्ाटन में सहार्क सुजवधा भण्डार, और गृह वास सजहत स्ट्थानीर् सुजवधाएं; और

(v) पैरा 4 में िी गई संवर्धात दक्रर्ाकलाप और संबंजधत जवजनर्जमत दक्रर्ाकलाप; परंतु र्ह और दक क्षेत्रीर् नगर र्ोिना अजधजनर्म और राज्र् सरकार के अन्र् जवजनर्मों और जवजनर्मों के अनुमोिन के जबना और भारत के संजवधान के अनचु्छेि 244 के उपबंधों तथा जिसके अधीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के प्रर्ोग की अनुज्ञा नहीं होगी; 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंत ुर्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के भीतर आने वाली भूजम के अजभलेखों में उपसंिात दकसी तु्ररट को, जनगरानी सजमजत के जवचार प्राप्त करन ेके पिात,् संघ िाजसत राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार सुधारा िा सकेगा और उक्त तु्ररट को सुधारे िान ेकी संसूचना कें द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी; परंतु र्ह भी दक तु्ररट के संिोधन में इस उप परैा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा ; (ख) वनीकरण तथा पर्ाावास पुनः स्ट्थापन कार्ाकलापों के माध्र्म से अप्रर्ुक् त र्ा अनुत् पािक कृजष क्षेत्रों में पुन: वनीकरण करने के प्रर्ास दकए िाएंगे ;

(2) प्राकृजतक िल स्रोत.— सभी प्राकृजतक झरनों र्ा नदिर्ों र्ा चैनलों िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना में उनके संरक्षण और बहाली की र्ोिना सजम् मजलत की िाएगी और राज्र् सरकार द्वारा मागाििाक जसद्धांत इस रीजत से तैर्ार दकए िाएगंे दक उसमें िो ऐसे क्षेत्रों के जलए हाजनकारक हैं र्ा उसके पास जवकास दक्रर्ाकलापों को प्रजतजषद्ध दकर्ा गर्ा हो।

(3) पर्ाटन एव ंपाररजस्ट्थजतकी पर्ाटन. —(क) पाररजस्ट्थजतकी-संवेिी िोन में सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी- संवेिी िोन संबंधी पर्ाटन महार्ोिना के अनुसार होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा से पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना एक घटक के रूप में होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी-संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम् नानुसार जवजनर्जमत दकए िाएंग,े अथाात:्-

(i) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक, इनमें से िो भी अजधक जनकट हो: दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमााण अनुमत नहीं दकर्ा िाएगा, परंत ु र्ह, पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए संरजक्षत के्षत्र की सीमा से एक दकलोमीटर की िरूी से परे पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक पूवा पररभाजषत और अभीजहत क्षेत्रों में पर्ाटन महार्ोिना के अनुसार, नए होटलों और ररिॉटा की स्ट्थापना अनुमत होगी;

(ii) पाररजस्ट्थजतकी-संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मतं्रालर् द्वारा िारी मागाििाक जसद्धांतों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िनेे वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी मागाििाक जसद्धांतों के अनुसार होगा; [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7

(iii) िब तक आंचजलक महार्ोिना के अनुमोिन नहीं जमल िाता, तब तक पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को स्ट्थल-जवजिष्ट संवीक्षा और जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन में दकसी नर् े होटल, ररिाटा र्ा वाजणजज्र्क प्रजतष्ठान का संजनमााण की अनुमजत नहीं िी िाएगी।

(4) प्राकृजतक जवरासत .— पाररजस्ट्थजतकी संवेिी िोन में बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पलू ररज़वा के्षत्र, िैल संरचना, िल प्रपात, झरने, िरे, उपवन, गुफाएं, स्ट्थल, वनपथ, रोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एवं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(5) मानव जनर्मात जवरासत स्ट् थल.— पाररजस्ट्थजतकी-संवेिी िोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(6) ध् वजन प्रिषूण.— पाररजस्ट्थजतकी-संवेिी िोन में ध्वजन प्रिषूण की जनवारण और जनर्ंत्रण का अनपुालन पर्ाावरण (संरक्षण) अजधजनर्म 1986 के अधीन ध्वजन प्रिषूण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार दकर्ा िाएंगा ।

(7) वार् ु प्रिषूण.— पाररजस्ट्थजतकी-संवेिी िोन में वार् ु प्रिषूण का जनवारण और जनर्ंत्रण का अनुपालन वार् ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14), तथा तद्धीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा ।

(8) बजहस्राव का जनस्ट्सरण. — पाररजस्ट्थजतकी-संवेिी िोन में उपचाररत बजहःस्राव का जनवाहन िल (प्रिषूण जनवारण एवं जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके अधीन बनाए गए जनर्मों र्ा राज्र् सरकार द्वारा जनधााररत मानिडंों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार दकर्ा िाएगा।

(9) ठोस अपजिष्ट.— ठोस अपजिष्टों का जनपटान जनम्नजलजखत रूप में होगा-- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबन्धन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1357 (अ), तारीख 8 अप्रलै, 2016 के अधीन प्रकाजित ठोस अपजिष् ट प्रबंधन जनर्म, 2016, उपबंधों अनुसार दकर्ा िाएगा; अकाबाजनक सामग्री का जनपटान पर्ाावरणीर् रीजत में पाररजस्ट्थजतकी संवेिी िोन से बाहर अजभज्ञात स्ट्थल पर दकर्ा िाएगा । (ख) पाररजस्ट्थजतकी संवेिी िोन के भीतर मान्र् अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुज्ञात दकर्ा िार्ेगा।

(10) िवै जचदकत्सा अपजिष्ट.— िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नजलजखत रूप में होगा- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना संख्र्ा सा.का.जन. 343 (अ), तारीख 28 माचा, 2016 के अधीन प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016, के उपबंधों के अनुसार दकर्ा िाएगा। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) पाररजस्ट्थजतकी संवेिी िोन में अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत ेहुए जवद्यमान जनर्मों और जवजनर्मों के अनरुूप िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुमत दकर्ा िार्ेगा।

(11) प्लाजस्ट्टक अपजिष्ट का प्रबधंन.— पाररजस्ट्थजतकी-संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् की अजधसूचना संख्र्ा सा.का.जन. 340 (अ), तारीख 28 माचा, 2016, के अधीन प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा।

(12) सजन्नमााण और जवध्वसं अपजिष्ट का प्रबधंन.— पाररजस्ट्थजतकी-संवेिी िोन में सजन्नमााण और जवध्वंस अपजिष्ट का प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना संख्र्ा सा.का.जन. 317 (अ), तारीख 29 माचा, 2016 के अधीन प्रकाजित सजन्नमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(13) ई–अपजिष्ट.— पाररजस्ट्थजतकी-संवेिी िोन में ई–अपजिष्ट का प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित और ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(14) वाहन र्ातार्ात.— वाहन र्ातार्ात को पर्ाावास-अनुकूल रीजत से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जवजिष्ट उपबंध सजम्मजलत दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी से अनुमोदित होन ेतक, जनगरानी सजमजत सुसंगत अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एवं जवजनर्मों के अनुसार वाहन र्ातार्ात के अनुपालन की जनगरानी करेगी।

(15) वाहन प्रिषूण.— वाहन प्रिषूण की रोकथाम और जनर्तं्रण लाग ूजवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छ ईंधन िैसे सीएनिी, एलपीिी आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे।

(16) औद्योजगक ईकाइर्ा.ं — (क) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पिात् पाररजस्ट्थजतकी-संवेिी िोन के भीतर कोई नए प्रिषूणकारी उद्योगों की स्ट्थापना की अनुमजत नहीं िी िाएगी। (ख) केन्द्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016, द्वारा िारी मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी-संवेिी िोन के भीतर केवल गरै-प्रिषूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररक्त, गैर प्रिषूणकारी उद्योगों का संवधान िाएगा।

(17) पहाडी ढलानों का सरंक्षण. —पहाडी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा: - (क) आंचजलक महार्ोिना में पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी प्रकार के जनमााण कार्ा की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों में अत्र्जधक भू-क्षरण होता ह ैउनमें दकसी भी प्रकार के जनमााण कार्ा की अनुज्ञा नहीं होगी । [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9

4. पाररजस्ट्थजतकी-सवंिेी िोन में प्रजतजषद्ध र्ा जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सचूी.— पाररजस्ट्थजतकी-संवेिी िोन में सभी दक्रर्ाकलाप पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके अधीन बनाए गए जनर्मों तथा पर्ाावरण, वन और वन्र्िीवों से संबंजधत भारत सरकार की अन्र् अजधसूचनाओं, जवजधर्ों और अजधजनर्मों, पूवावती पर्ाावरण एवं वन मंत्रालर् की अजधसूचना संख्र्ा 1533(अ), तारीख 14 जसतंबर, 2006 और तत्समर् प्रवृत जवजधर्ों द्वारा जवजनर्जमत होंगी, िैसा दक नीचे िी गई सारणी में जवजनर्िाष्ट ह;ै अथाात:्- सारणी क्रम स.ं दक्रर्ाकलाप रटप्पणी क. प्रजतजषद्ध दक्रर्ाकलाप 1 वाजणजज्र्क खनन, पत्थर उत्खनन और अपघषाण इकाईर्ााँ । (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर घरों के जनमााण र्ा मरम्मत के जलए जमट्टी खोिने सजहत स्ट्थानीर् जनवाजसर्ों की घरेल ू िरूरतों को परूा करने को छोडकर, सभी नए और जवद्यमान खनन (लघु और प्रमुख खजनि), पत्थर उत्खनन और उनके तोडने की इकाइर्ों पर तत्काल प्रभाव से प्रजतबंध लगार्ा गर्ा ह;ै (ख) खनन प्रचलन, िो टी.एन. गोिावमान जथरुमलुपाि बनाम र्ूओआई के डब्ल्र्.ूपी.(सी) संख्र्ा 202/1995 के मामल े में; तारीख 21 अप्रलै, 2014 के आिेि (आिेिों) के अनुसार, िो गोवा फाउंडेिन बनाम र्ओूआई के डब्ल्र्.ूपी.(सी) संख्र्ा 435/2012 और आईए संख्र्ा 1000/2003 तारीख 03 िून, 2022 और उसके बाि आईए संख्र्ा 131377/2022 जनणार् तारीख 26 अप्रलै, 2023 और 28 अप्रलै, 2023 के मामले में दिए गए थ;े माननीर् उच्चतम न्र्ार्ालर् के दिनांक 4 अगस्ट्त, 2006 के आिेि के अनुसार दकए िाएंगे। 2 प्रिषूण (िल, वार्ु, मृिा, ध्वजन, आदि) पैिा करन े वाल े उद्योगों की स्ट्थापना। पाररजस्ट्थजतकी-संवेिी िोन में नर् े उद्योगों और वतामान प्रिषूणकारी उद्योगों का जवस्ट्तार करने की अनुमजत नहीं होगी। जवद्यमान उद्योगों द्वारा प्रिषूण जनवारण प्रौद्योजगदकर्ां और ध्वजन अवरोधक स्ट्थाजपत दकए िाने चाजहए। 3 बडी िल जवदु्यत पररर्ोिनाओं की स्ट्थापना। प्रजतजषद्ध । 4 दकसी पररसंकटमर् पिाथा का प्रर्ोग र्ा उत्पािन र्ा प्रस्ट्संकरण । प्रजतजषद्ध । 5 प्राकृजतक िल जनकार्ों र्ा भूजम के्षत्र में अनपुचाररत बजहस्रावों प्रजतजषद्ध । 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] का जनस्ट्सरण । 6 नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी-संवेिी िोन के भीतर नई और जवद्यमान आरा मीलों के जवस्ट्तार की अनुमजत नहीं होगी। 7 ईंट भट्टों की स्ट्थापना करना। प्रजतजषद्ध। 8 िलावन लकडी का वाजणजज्र्क उपर्ोग। प्रजतजषद्ध। 9 नई पवन चदिर्ों का जनमााण प्रजतजषद्ध। 10 फमों और कंपजनर्ों द्वारा बड े पैमाने पर वाजणजज्र्क पिुधन और कुक्कुट पालन इत्र्ादि की स्ट्थापना। प्रजतजषद्ध; परंत ु दक स्ट्थानीर् दकसानों द्वारा छोटे पैमान े पर कुक्कुट पालन समर्-समर् पर र्था संिोजधत सीपीसीबी मागाििक जसद्धांतों 2016 के अनुसार स्ट्थाजपत दकए िा सकते हैं। ख.जवजनर्जमत दक्रर्ाकलाप 11 होटलों और ररसोटों की वाजणजज्र्क स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघ ु व अस्ट्थार्ी संरचनाओं के जनमााण के जसवार्, संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, नए होटलों, ररसोटों और व्यापाररक प्रजतष्ठानों के स्ट्थापना की अनुमजत नहीं होगी: परंतु दक संरजक्षत के्षत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लागू मागाििाक जसद्धांतों के अनुसार सभी नए पर्ाटन दक्रर्ाकलाप करन े र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करने की अनुज्ञा होगी । 12 संजनमााण दक्रर्ाकलाप । (क) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर िार्रे में र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकटतम हो, दकसी भी प्रकार के नए वाजणजज्र्क जनमााण की अनुमजत नहीं िी िाएगी: परंत,ु स्ट्थानीर् लोगों को स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को परूा करन े के जलए भवन उप-जनर्मों के अनुसार परैाग्राफ 3 के उप-परैा (1) में सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम पर जनमााण कार्ा करन े की अनुमजत िी िा सकेगी: परंत ुर्ह और दक प्रिषूण न फैलाने वाले लघ ुउद्योगों से संबंजधत जनमााण संबंधी दक्रर्ाकलापों को प्रर्ोज् र् जनर्मों और जवजनर्मों, [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 र्दि कोई हो, के अनुसार तथा सक्षम प्राजधकारी से पूवा अनुमोिन से जवजनर्जमत दकर्ा िाएगा और न्र्नूतम ही रखा िाएगा। (ख) एक दकलोमीटर के िार्रे से आग ेइसे आंचजलक महार्ोिना के अनुसार जवजनर्जमत दकर्ा िाएगा। 13 लघु पैमाने के प्रिषूण न फैलान े वाले उद्योग। फरवरी, 2016 में केन्द्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों के वगीकरण, समर्-समर् पर र्था संिोजधत के अनसुार प्रिषूण न फैलाने वाले उद्योग, तथा पाररजस्ट्थजतकी संवेिी िोन से स्ट्विेिी सामजग्रर्ों से उत्पाि बनाने वाले िोजखम रजहत, लघु एवं सेवा उद्योग, कृजष, पुष्प-कृजष, बागवानी र्ा कृजष-आधाररत उद्योगों को सक्षम प्राजधकारी द्वारा अनुमजत िी िाएगी। 14 वृक्षों की कटाई। (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन, सरकारी, रािस्ट्व र्ा जनिी भूजम पर से वृक्षों की कटाई की अनुज्ञा नहीं होगी। (ख) वृक्षों की कटाई को संबंजधत केन्द्रीर् र्ा राज्र् अजधजनर्म तथा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत दकर्ा िाएगा। 15 वन उत् पाि र्ा काष्ठतेर वन उत् पाि का संग्रहण। लाग ूजवजधर्ों के अधीन जवजनर्जमत। 16 जवदु्यत एवं संचार टावरों का जनमााण तथा केबल जबछाना एवं अन्र् अवसंरचनाएं। लाग ू जवजधर्ों के अधीन जवजनर्जमत (भूजमगत केबसलगं का संवधान दकर्ा िा सकता ह)ै। 17 नागररक सुजवधाओं सजहत अवसंरचना। लाग ू जवजधर्ों, जनर्मों और जवजनर्मों तथा उपलब्ध मागाििाक जसद्धांतों के अनुसार िमन के साथ दकर्ा िाएगा। 18 जवद्यमान सडकों का चौडीकरण एवं सुिढृ़ीकरण तथा नई सडकों का जनमााण। लाग ू जवजधर्ों, जनर्मों और जवजनर्मों तथा उपलब्ध मागाििाक जसद्धांतों के अनुसार िमन के साथ दकर्ा िाएगा। 19 पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िैसे पाररजस्ट्थजतकी संवेिी िोन के ऊपर हॉटर बलून, हलेीकॉप्टर, ड्रोन, माइक्रोलाइट्स, आदि का उडान भरना। लाग ूजवजधर्ों के अधीन जवजनर्जमत। 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 20 पहाडी ढलानों और निी तटों का संरक्षण। लाग ूजवजधर्ों के अधीन जवजनर्जमत। 21 रात के समर् वाहनों का आवागमन। लाग ू जवजधर्ों के अधीन व् र्ावसाजर्क उद्देश्र् के जलए जवजनर्जमत। 22 स्ट्थानीर् समुिार्ों द्वारा डेर्री, डेर्री फार्मंग, िलीर् कृजष और मत्स्ट्र् पालन के साथ-साथ की िा रही कृजष और बागवानी कार्ा प्रथाएाँ। स्ट्थानीर् लोगों के उपर्ोग के उद्देश् र् से लाग ू जवजधर्ों के अधीन अनुमजत िी गई ह।ै 23 फमों, कॉपोरेटों और कंपजनर्ों द्वारा बड े पैमान े पर व् र्ावसाजर्क पिुधन और मुगीपालन की स्ट्थापना। स्ट्थानीर् आवश्र्कताओं को पूरा करन े के अलावा लाग ू जवजधर्ों के अधीन जवजनर्जमत। 24 प्राकृजतक िल जनकार्ों र्ा भूजम के्षत्र में उपचाररत अपजिष्ट िल/अपजिष्टों का जनवाहन। उपचाररत अपजिष्ट िल र्ा अपजिष्टों को िल जनकार्ों में िान े से रोका िाएगा और उपचाररत अपजिष्ट िल के पुनचाक्रण और पुनः उपर्ोग के जलए प्रर्ास दकए िाएंगे। अन्र्था, अनुपचाररत अपजिष्ट िल/अपजिष्टों के जनवाहन को लाग ू जवजधर्ों के अधीन जवजनर्जमत दकर्ा िाएगा। 25 सतही और भूिल का वाजणजज्र्क जनष्कषाण । लाग ूजवजधर्ों के अधीन जवजनर्जमत। 26 कृजष र्ा अन्र् उपर्ोग के खुला कुआाँ, बोरवेल आदि। लाग ूजवजधर्ों के अधीन जवजनर्जमत। 27 ठोस अपजिष्ट प्रबंधन। लाग ूजवजधर्ों के अधीन जवजनर्जमत। 28 जविेिी प्रिाजतर्ों का समावेिन। लाग ूजवजधर्ों के अधीन जवजनर्जमत। 29 पाररजस्ट्थजतकी-पर्ाटन लाग ूजवजधर्ों के अधीन जवजनर्जमत। 30 व् र्ावसाजर्क साइन बोडा और होर्डंग्स। लाग ूजवजधर्ों के अधीन जवजनर्जमत। 31 कृजष प्रणाजलर्ों में व्यापक पररवतान लाग ूजवजधर्ों के अधीन जवजनर्जमत। 32 होटल और लॉि के पररसर की बाड लगाना लाग ूजवजधर्ों के अधीन जवजनर्जमत। 33 वार्,ु वाहन और ध्वजन प्रिषूण लाग ूजवजधर्ों के अधीन 5.जनगरानी सजमजत- पर्ाावरण अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अधीन इस अजधसूचना के उपबंधों की प्रभावी जनगरानी के जलए कें द्रीर् सरकार जनम्नजलजखत सिस्ट्र्ों से जमलकर एक जनगरानी सजमजत का गठन करती ह,ै अथाात.्.. क्र.स. जनगरानी सजमजत के घटक पि 1 जिला कलेक्टर, रािसमंि अध् र्क्ष, पिेन; 2 पर्ाावरण र्ा वन्र्िीव (जवरासत संरक्षण सजहत) के के्षत्र में काम करने वाले गरै-सरकारी संगठन के प्रजतजनजध जिसे राज्र् सरकार द्वारा समर्-समर् पर प्रत्र्ेक तीन वषा में नामजनर्िाष्ट दकर्ा िाएगा। सिस्ट्र्; 3 जवरासत संरक्षण सजहत वन्र्िीवन के के्षत्र में काम करने वाल े गैर-सरकारी संगठन का एक प्रजतजनजध राज्र् सरकार द्वारा समर् -समर् पर प्रत्र्ेक तीन वषा में नामजनर्िाष्ट दकर्ा िाएगा। सिस्ट्र्; 4 नगर जनर्ोिन जवभाग के प्रजतजनजध, रािसमंि सिस्ट्र्, पिेन; 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 5 लोक जनमााण जवभाग के प्रजतजनजध, रािसमंि सिस्ट्र्, पिेन; 6 उपजवभागीर् अजधकारी कंुभलगढ़/िेसूरी/बाली/गोगनु्िा सिस्ट्र्, पिेन; 7 क्षेत्रीर् अजधकारी, रािस्ट्थान राज्र् प्रिषूण जनर्ंत्रण बोडा, रािसमंि सिस्ट्र्, पिेन; 8 उप वन संरक्षक पाली/उिर्परु सिस्ट्र्, पिेन; 9 उप वन संरक्षक (वन्र्िीव), रािसमंि सिस्ट्र् सजचव, पिने।

6. जनगरानी सजमजत के कृत्र्: -(1) पाररजस्ट्थजतकी-संवेिी िोन में भारत सरकार के तत् कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना सं. का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अनुसूची के अधीन सजम्मजलत दक्रर्ाकलापों और इस अजधसूचना के परैा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजषद्ध दक्रर्ाकलापों के जसवार् आने वाले ऐसे दक्रर्ाकलापों की ििा में वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं पर आधाररत जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उक्त अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त लनेे के जलए केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को जवजनर्िाष्ट की िाएगी।

(2) िो दक्रर्ाकलाप भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ा का.आ.1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची में न आती हों और पाररजस्ट्थजतकी संवेिी िोन में की िा रही हों, इसके पैरा 4 के अधीन ताजलका में जवजनर्िाष्ट प्रजतजषद्ध दक्रर्ाकलापों को छोडकर, की संवीक्षा जनगरानी सजमजत द्वारा वास्ट्तजवक स्ट्थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर की िाएगंी और उससे संबंजधत जनर्ामक प्राजधकरणों को संिर्भात दकर्ा िाएगा।

(3) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबंजधत कलक्टर र्ा उपवन संरक्षक ऐसे व्यजक्त के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता ह,ै पर्ाावरण अजधजनर्म की धारा 19 के अधीन पररवाि िार्र करन ेके जलए सक्षम होगा।

(4) जनगरानी सजमजत संबंजधत जवभागों के प्रजतजनजधर्ों र्ा जविेषज्ञों, औद्योजगक संगमों के प्रजतजनजधर्ों र्ा पणधाररर्ों को, प्रत्र्ेक मामले म ेअपके्षा के अनसुार, अपन ेजवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी ।

(5) जनगरानी सजमजत प्रत्र्ेक वषा 31 माचा की जस्ट्थजत के अनसुार अपनी वार्षाक कारावाई ररपोटा राज्र् के मखु्र् वन्र्िीव वाडान को, उपाबंध-VI में जवजनर्िाष्ट प्रपत्र के अनुसार, उस वषा की 30 िून तक प्रस्ट्ततु करेगी, इस अजधसूचना के साथ संलग्न ह ै।

(6) केन्द्रीर् सरकार का पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् जनगरानी सजमजत को उसके कृत्र्ों के प्रभावी जनवाहन के जलए ऐसे जनििे िे सकेगा िो वह उजचत समझे ।

7. अजतररक् त उपार्.- इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए कें द्रीर् सरकार और राज्र् सरकार, अजतररक् त उपार्, र्दि कोई हों, जवजनर्िाष् ट कर सकेंगी।

8. कोई अन् र् महत्वपूणा मामला। [फा.सं. 25/08/2020-ईएसिेड] डॉ. सु. केरकेट्टा, वैज्ञाजनक 'िी' [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 29 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, 16 th January,2026 S.O.238 (E).— WHEREAS a draft notification was published in the Gazette of India, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 2575 (E), dated the 12th June 2025, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS copies of the Gazette containing the said draft notification were made available to the public on the 13th June, 2025; AND WHEREAS objections and suggestions received from persons and stakeholders in respect of the said draft notification have been considered by the Central Government; AND WHEREAS, the Kumbhalgarh Wildlife Sanctuary is situated in one of the most fragile ecosystems of the Aravalli range and lies approximately eighty kilometres north of the picturesque Lake City of Udaipur. Geographically, the sanctuary is located between 73°13′ to 73°48′ East longitude and 24°51′ to 25°25′ North latitude. It spans an area of 610.528 square kilometres, covering parts of Rajsamand, Pali, and Udaipur districts in the state of Rajasthan; AND WHEREAS the Kumbhalgarh Wildlife Sanctuary makes an ecotone between hilly forests of Aravallis and Thar Desert situated in the west. Kumbhalgarh hills acts like a barrier, checking eastward extension of desert. Famous Kumbhalgarh Fort situated atop of a hill is an attraction for tourists. The eastern part of the Sanctuary is mostly ranges having an altitude of more than 3500 feets above sea level, while the western part of the Sanctuary is adjoined to the Marwar plains; AND WHEREAS the Sanctuary offers diverse topography, adding more to its significance as it also forms a dividing line between the two major watersheds of the country. Its eastern part is considered as source of river Banas, which falls into the Bay of Bengal. The rainwater on the western slope flow in the form of the small rivers like Sukdi, Mithdi, Sumer and Kot, all these forming the tributaries of river Luni which ultimately merges into the Arabian Sea; AND WHEREAS the sanctuary supports rich and unique biodiversity which is home for species like wild boar (Sus scrofa), grey musk shrew (Sunchus murinus), bat (Cyanopterus sphynx), flying fox (Pteropus gigenticus), Common leopard (Panthera pardus), striped hyena (Hyaena hyaena), jungle cat (Felis chaus), five striped palm squirrel (Funambulus pennanti), Indian pangolin (Manis carassicaudata), Indian fox (Vulpes bengalensis), common mongoose (Herpestes edwardsi), blue bull (Boselaphus tragocamelus), Indian porcupine (Hystrix indica), chinkara (Gazella gazella), jackal (Canis aureus), Indian small civet (Vivaricula indica) etc. While important birds found in the Sanctuary are painted francolin (Francolinus pictus), grey francolin (F. pondicerianus), common quail (Coturnix coturnix), rain quail (C. coromadelica), rock bush quail (Perdicula argoundah), yellow-legged button quail (Turnix tanki), barred button quail (T. suscitator), Indian peafowl (Pavo cristatus), ruddy shelduck (Tadorana ferruginea), gadwal (Anas strepera), common teal (A. crecca), garganey (A. querquedula), etc.; 30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS the major flora found in the Sanctuary are khair (Acacia catechu), ronjh (Acaia leucophloea), desi bawalia (Acacia nilotica), kumta (Acacia senegal), haldu (Adina cordifolia), bili (Aegle marmelos), ardusa, paba (Ailanthus excelsa), ankol (Alangium salvifolium), black siris (Albizzia leibbeck), safed siris (Albizzia odoratissima), safed siris (Albizzia procera), sitaphal (Annona sequamosa), dhokda (Anogeissus pendula), dhavda (Anogeissus latifolia), adrukh, indok (Anogeissus sericea), neem (Azadirachta indica), hingot (Balanites aegyptica), semal (Bombax ceiba), salar (Boswellia serrata), khakhro (Butea monosperma), karmela (Cassia fistula), kasid (Cassia siamea), gunda, lisoda (Cordia mixa), varna (Crataeva religiosa), sissoo (Dalbergia sissoo), timru (Diospyros melanoxylon), tambolia (Ehretia laevis), amla (Emblica officinalis), dhed khakhro (Erythrina suberosa), umara (Ficus racemosa), piplo (Ficus religiosa), kankan (Flacourtia montana), dikamari (Gardenia resinifera), khad dhaman (Grewia hirsuta) etc.; AND WHEREAS it is necessary to conserve and protect the area, extent and boundary of Kumbhalgarh Wildlife Sanctuary which is specified in paragraph 1 the said notification as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub section (1) and clauses (v) and

(xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Envirnoment Act) read with sub-rule (3) of Rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies as to an extent of zero to one kilometre area around the boundary of Kumbhalgarh Wildlife Sanctuary in the State of Rajasthan as the Kumbhalgarh Wildlife Sanctuary, Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: -

1. Extent and boundaries of Eco-sensitive Zone. – (1) the extent of Eco-Sensitive Zone is zero to one kilometre around the boundary of Kumbhalgarh Wildlife Sanctuary and the area of Ecosensitive Zone 243 square kilometres. The Zero extent of Eco-sensitive Zone in the northern boundary of Sanctuary is due to common border with the Raoli Todgarh Wildlife Sanctuary. The extent of Eco-sensitive Zone at different directions are: North 0 kilometre North- East 1.00 kilometre East 1.00 kilometre South-East 1.00 kilometre South 1.00 kilometre South-West 1.00 kilometre West 1.00 kilometre North-West 1.00 kilometre

(2) The boundary description of Eco-sensitive Zone is appended as Annexure- I.

(3) The maps of the Eco-Sensitive Zone along with boundary details are appended as Annexure- II A, Annexure-II B and Annexure- II C. [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 31

(4) The geo-coordinates of the boundary of protected area and its Eco-sensitive Zone is appended as Annexure- III and Annexure- IV respectively.

(5) The list of 94 villages falling within the Eco-sensitive Zone is appended as Annexure- V.

2. Zonal Master Plan for Eco-Sensitive Zone. – (1) The State Government shall, for the purposes of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State.

2. The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

3. The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan: i. Environment; ii. Forest and Wildlife; iii. Urban Development; iv. Panchayati Raj and Rural Development; v. Tourism; vi. Revenue; vii. Agriculture; viii. Rajasthan State Pollution Control Board; ix. Irrigation and Flood Control; x. Municipality; and xi. Public Works and Highways.

4. The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and ecofriendly.

5. The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

6. The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

7. The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities.

8. The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

9. The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

2. Measures to be taken by the State Government. -The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or residential or industrial activities;

Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: – i. widening and strengthening of existing roads and construction of new roads; ii. construction and renovation of infrastructure and civic amenities; iii. small scale industries not causing pollution; iv. cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and v. promoted activities given under paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.– The catchment areas of all natural springs or rivers or channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or Eco-tourism.– (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; a) the Eco-Tourism Master Plan shall be prepared by State Department of Tourism in consultation with State Departments of Environment and Forests; b) the Tourism Master Plan shall form a component of the Zonal Master Plan; [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 33 c) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- Sensitive Zone; d) the activities of eco-tourism shall be regulated as under, namely:-

(i) New construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-Sensitive Zone, whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco- Sensitive Zone area.

(4) Natural heritage.– All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.– Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution.– Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.

(7) Air pollution.– Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.

(8) Discharge of effluents.– Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes.– Disposal and Management of solid wastes shall be as under:- a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. b) Safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(10) Bio-medical waste.– Bio medical waste management shall be as under: – a) The Bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016. b) Safe and Environmentally Sound Management of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- Sensitive Zone.

(11) Plastic waste management.– The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016.

(12) Construction and demolition waste management.– The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016.

(13) E-waste.– The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.

(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.– Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and efforts to be made for use of cleaner fuel like CNG, LPG, etc.

(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by Central Pollution Control Board in February, 2016 unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes.– The protection of hill slopes shall be as under: –

(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.

(b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 35

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.– All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 and the rules made there under and other notifications, laws and Acts of the Government of India pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner specified in the Table below, namely TABLE S No Activity Description

1. Commercial Mining, stone quarrying and crushing units.

(a) All new and existing (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Ecosensitive Zone;

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012; and IA No. 1000 of 2003 dated the 03rd June, 2022 and subsequent IA No. 131377 of 2022 judgment dated the 26th April, 2023 and the 28th April, 2023.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). Establishement of new and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted. Pollution prevention technologies and noise barriers should be installed by existing industries.

3. Establishment of major hydroelectric project. Prohibited.

4. Use or production or processing of any hazardous substances. Prohibited.

5. Discharge of untreated effluents in natural water bodies or land area. Prohibited.

6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited.

8. Commerical Use of firewood Prohibited.

9. Erection of new wind mills Prohibited.

10. Establishment of large scale commercial livestock and Prohibited; Provided that small scale poultry farms by local farmers can be established as per Central Pollution 36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] S No Activity Description

(1) (2) (3) poultry farms by firms, company, corporate etc. Control Board guidelines, 2016. B. Regulated Activities

11. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for ecotourism activities:

Provided that, beyond one kilometre from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

12. Construction activities.

(a) New commercial construction of any kind shall not be permitted within one kilometre from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph

(1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:

Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.

13. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.

14. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central Act or State Act and the rules made there under.

15. Collection of Forest produce or Non-Timber Forest Produce Regulated under applicable laws. [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 37 S No Activity Description

(1) (2) (3) (NTFP).

16. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated as per the applicable law (Underground cabling may be promoted).

17. Infrastructure including civic amenities. Shall be done with mitigation measures, as per the applicable laws, rules and regulations available guidelines.

18. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per the applicable laws, rules and regulations available guidelines.

19. Under taking other activities related to tourism like over flying the ESZ area by hot air balloon, helicopter, drones, Microlites, etc. Regulated as per the applicable laws

20. Protection of Hill Slopes and river banks Regulated as per the applicable laws.

21. Movement of vehicular traffic at night. Regulated for commercial purpose as per the applicable laws.

22. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals.

23. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies. Regulated as per the applicable laws except for meeting local needs.

24. Discharge of treated waste water/effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts to be made for recycle and reuse of treated wastewater. Otherwise the discharge of treated waste water or effluent shall be regulated as per applicable laws.

25. Commercial extraction of surface and ground water. Regulated as per the applicable law.

26. Open Well, Bore Well etc. for agriculture or other usage. Regulated as per the applicable law.

27. Solid Waste Management. Regulated as per the applicable laws.

28. Introduction of Exotic species. Regulated as per the applicable laws.

29. Eco-tourism. Regulated as per the applicable laws.

5. Monitoring Committee.- For effective monitoring of the provisions of this notification under subsection (3) of section 3 of the Environment Act, 1986 the Central Government hereby constitutes a monitoring committee comprise of the following, namely: - S.No. Constituent of the Monitoring Committee Designation

6. Functions of Monitoring Committee.–

(1) The Monitoring Committee shall, based on the actual site-specific conditions, scrutinise the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and refer to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification.

(2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.

(3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.

(4) The Monitoring Committee may invite representative or expert from concerned Department, industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case-to-case basis.

(5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-VI, appended to this notification.

(6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional measures: - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8.
