PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 2113] No. 2113] NEW DELHI, FRIDAY, JULY 28, 2017/SRAVANA 6, 1939 पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् अधिसचूनय नई दिल्ली, 26 जुलयई, 2017 कय.आ. 2404(अ).—भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय.आ. 1976 (अ), र्यरीख 3 जून, 2016, द्वयरय भयरर् के रयजपत्र, असयियरण में एक अधिसूचनय, उन सभी व्यधिर्ों स े धजनके उससे प्रभयधवर् होने की संभयवनय थी, उि अधिसूचनय के रयजपत्र की प्रधर्र्यं जनर्य को उपलब्ि होन ेकी र्यरीख स ेसयठ दिन की अवधि के भीर्र आक्षेप और सुझयव आमंधत्रर् दकए गए थे;
और प्ररूप अधिसूचनय के प्रत्र्ुत्तर में जनर्य और पणियररर्ों से कोई रिप्पधणर्यं/ आक्षेप प्रयप्त नहीं हुए थ;े और, रक्छम-धचिकुल वन्र्जीव अभर्यरण्र्, धहमयचल प्रिशे के दकन्नौर धजले में अवधथथर् ह ैर्ह 304.00 वगा दकलोमीिर क्षेत्र में फैलय हुआ ह;ै और, इस अभर्यरण्र् में वनथपधर् और जीव जन्र्ु की समृद्ध जैधवकीर् महत्व कय प्रधर्धनधित्व है। इस अभर्यरण्र् में कयलय भयलू (अरसूस थप), भूरय भयलू (अरसूस अरकिोस), कथ र्ूरी धह रन (मोसचचुस थप), र्ेंिआु (पेन्थेरय पयरडस), धहमप्रिशेीर् र्ेंिआु (पेन्थेरय अनसीअल), मोनल (लोपोपोरूस थप), चकोर (अलेकिोरीस चकुर), आदि;
और, अब इस क्षेत्र कय पररक्षण और संरक्षण करनय आवश्र्क ह ैधजसकय धवथर्यर और सीमयए ंइस अधिसूचनय के पैरय 1 में धवनर्िाष्ट हैं, रक्छम-धचिकुल वन्र्जीव अभर्यरण्र् के चयरों और के क्षेत्र को पयररधथथधर्क संवेिी जोन के रूप में पयररधथथधर्क और पर्यावरण की िषृ्टी से संरधक्षर् करनय आवश्र्क हो गर्य ह ैर्थय उद्योगों र्य उद्योगों के वगा को र्थय उनकी संदिर्यओं और प्रदकर्यओं को उि पयररधथथधर्क संवेिी जोन में प्रधर्धिद्ध करनय आवर्श्क ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अर्ः, अब, केन्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के सयथ परठर् पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (2) के खंड (v) और खंड (xiv) के सयथ परठर् और उपियरय (1) द्वयरय शधिर्ों कय प्रर्ोग करर्े हुए, धहमयचल प्रिशे रयज्र् रक्छम-धचिकुल वन्र्जीव अभर्यरण्र् की सीमय के चयरो ओर 0 मीिर से 15 दकलोमीिर र्क के धवथर्यररर् क्षेत्र को रक्छम-धचिकुल वन्र्जीव अभर्यरण्र् पयररधथथधर्क सवंेिी जोन (धजस ेइसमें इसके पश् चयर्प पयररधथ थधर्क संवेिी जोन कहय गर्य ह)ै के रूप में अधिसूधचर् करर्ी ह,ै धजसके ब्र्ौरे धनम्नयनुसयर हैं, अथयार्प :—
1. पयररधथथधर्क सवंिेी जोन कय धवथर्यर और उसकी सीमयए.ं—(1) पयररधथथधर्क संवेिी जोन सयंगलय घयिी (रक्छम-धचिकुल) वन्र्जीव अभर्यरण्र् स े0 मीिर से 15 दकलोमीिर र्क धवथर्यररर् क्षेत्र में होगय। िधक्षण पधिम की ओर पयररधथथधर्क संवेिी जोन उत्तरयखंड के सयथ अंर्ररयधज्र्क सीमय के कयरण ह ैऔर र्ह गोंधवि पयशु रयष्ट्रीर् उद्ययन उत्तरयखंड के सयथ सीमय बयंिर्य ह।ै पयररधथथधर्क संवेिी जोन कय क्षेत्रफल 666. वगा दकलोमीिर ह।ै
(2) रक्छम-धचिकुल वन्र्जीव अभर्यरण्र् के पयररधथ थधर्क संवेिी जोन को धचधन्हर् करर्े हुए मयनधचत्र उपयबिं I के रुप में उपयबद्ध ह ै।
(3) रक्छम-धचिकुल वन्र्जीव अभर्यरण्र् और इसके पयररधथ थधर्क संवेिी जोन की सीमय पर महत्तवपूणा थथयनों के भ-ू उपिशाकों की सूची उपयबिं II के रुप में उपयबद्ध ह।ै
(4) पयररधथथधर्क संवेिी जोन के भीर्र कोई ग्रयम नहीं आर्य ह ै।
2. पयररधथथधर्क सवंिेी जोन के धलए आचंधलक महयर्ोजनय.—(1) रयज्र् सरकयर, पयररधथ थधर्क संवेिी जोन के प्रर्ोजन के धलए रयजपत्र में इस अधिसूचनय के अंधर्म प्रकयशन की र्यरीख स ेिो विा की अवधि के भीर्र, इस अधिसूचनय में दिए गए उपिशो कय अनुपयलन करर् ेहुए, थथयनीर् व्यधिर्ों के परयमशा से आंचधलक महयर्ोजनय र्ैर्यर करेगी ।
(2) इस प्रकयर र्ैर्यर आचंधलक महयर्ोजनय अधिसचूनय में धवधनदिष्ट उपिशो के अनुसयर होगी और धजसमें पर्यावरणीर् धवधवक्षयए ंसधममधलर् होंगी।
(3) उि र्ोजनय को रयज्र् सरकयर में सक्षम प्रयधिकयरी द्वयरय अनुमोदिर् दकर्य जयएगय।
(4) पयररधथ थधर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय रयज् र् सरकयर द्वयरय इस अधिसूचनय में र्थयधवधनदिष्ट रीधर् में और सुसंगर् कें रीर् और रयज् र् धवधिर्ों और कें रीर् सरकयर द्वयरय जयरी मयगाधनिशे कय धसद्धयंर्ो, र्दि कोई हों, के सयमंजथ र् से र्ैर्यर की जयएगी।
(5) आंचधलक महयर्ोजनय, उसमें पर्यावरणीर् और पयररधथथधर्क मुद्दों को सधममधलर् करन ेके धलए संबंधिर् रयज् र् धवभयगों के सयथ परयमशा से र्ैर्यर की जयएगी, धजसके अरं्गार् धनम्नधलधखर् ह,ै अथयार्प:—
(i) पर्यावरण ;
(ii) वन ;
(iii) शहरी धवकयस ;
(iv) पर्ािन ;
(v) नगरपयधलकय ;
(vi) रयजथ व ;
(vii) कृधि ;
(viii) ससंचयई;
(ix) लोक धन मयाण धव भयग; और II (ii) 3
(x) धहमयचल प्रिशे रयज् र् प्रििूण धनर्ंत्रण बोडा।
(6) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन भू-उपर्ोग, अवसंरचनय और दिर्यकलयपों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय में इस प्रकयर धवधनर्िाष् ि न दकर्य जयए और उि आचंधलक महयर्ोजनय सभी अवसंरचनय और कयर्ाकलयपों में िक्षर्य और पयररधथथधर्क अनुकूलर्य कय सुियर करेगी ।
(7) आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबंिन, भूर्ल जल के प्रबंिन, मृिय और नमी संरक्षण, थथयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधथथधर्क और पर्यावरण स ेसंबंधिर् ऐसे अन्र् पहलूओं, धजन पर ध्र्यन िनेय आवश्र्क ह,ै के धलए उपबंि होंग े।
(8) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय थ थलों, ग्रयमों और नगरीर् बंिोबथर्ों, वनों के प्रकयर और दकथ मों, कृधि क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षेत्र जैसे उद्ययन और उसी प्रकयर के थ थयन, उद्ययन कृधि क्षेत्र, आर्काडो, झीलों और अन्र् जल धनकयर्ों कय अभ्र्कंन करेगी ।
(9) आंचधलक महयर्ोजनय पयररधथथधर्क संवेिी जोन में धवकयस कय धवधनर्मन करेगी र्यदक थ थयनीर् समुियर्ों के पयररधथथधर्क अनकूुल धवकयस कय उनके जीवकोपयजान को सुरधक्षर् करने के धलए सुधनधिर् दकर्य जय सके।
(10) आंचधलक महयर्ोजनय मयनीिरी सधमधर् के धलए उसके कृत्र्ों को अधिसूधचनय में दिए गए उपबंिो के संबंि में पूरय करन ेके धलए एक संिभा िथर्यवेजी होगी।
3. रयज्र् सरकयर द्वयरय दकए जयन ेवयल ेउपयर्.—रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करन ेके धलए धनम्नधलधखर् उपयर् करेगी, अथयार्प:—
(1) भ-ूउपर्ोग – (क) पयररधथ थधर्क संवेिी जोन में आमोि-प्रमोि के प्रर्ोजनों के धलए धचधन्हर् दकए गए वनों, उद्ययन-कृधि क्षेत्रों, कृधि क्षेत्रों, पयकों और खुले थथयनों कय वयधणधज्र्क और औद्योधगक संबद्ध धवकयस दिर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय:
परंर्ु पयररधथथधर्क संवेिी जोन के भीर्र कृधि भूधम कय संपररवर्ान, मयनीिरी सधमधर् की धसफयररश पर और रयज्र् सरकयर के पूवा अनुमोिन स,े थथयनीर् धनवयधसर्ों की आवयसीर् जरूरर्ों को पूरय करन ेके धलए और पैरय 4 की सयरणी के थर्ंभ (2) में सूचीबद्ध दिर्यकलयपों को पूरय करन ेके धलए अनुज्ञयर् होंगे, अथयार्प :—
(i) पयररधथथधर्क अनुकूल पर्ािन दिर्यकलयपों के धलए पर्ािकों के अथ थयर्ी आवयसन के धलए पयररधथथधर्क अनुकूल आरयमगयह जैसे िेंि, लकडी के मकयन आदि;
(ii) धवद्यमयन सडकों को चौडय करनय और उन्हें सुिढृ करनय र्थय नई सडकों कय संधनमयाण;
(iii) प्रििूण उत्पन्न न करन ेवयले लघु उद्योग;
(iv) विया जल संचर्।
(v) कुिीर उद्योग, धजसके अंर्गार् ग्रयमीण उद्योग, सुधविय भंडयर और थथयनीर् सुधवियए ंसधममधलर् हैं;
परंर्ु र्ह और दक रयज्र् सरकयर के पूवा अनुमोिन और भयरर् के संधवियन के अनचु्छेि 266 और र्त्समर् प्रवृत्त धवधि के उपबंिों के अनुपयलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै वयधणधज्र्क र्य उद्योग धवकयस दिर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय:
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंर्ु र्ह भी दक पयररधथ थधर्क संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई त्रुरि, मयनीिरी सधमधर् के धवचयर प्रयप्त करन ेके पियर्प रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमल ेमें केवल एक बयर संशोधिर् होगी और उि त्रुरि के संशोिन की भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को सचूनय िनेी होगी । परंर्ु र्ह और भी दक उपर्ुाि त्रुरि कय संशोिन में इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी िशय में भू-उपर्ोग कय पररवर्ान सधममधलर् नहीं होगय । परंर्ु र्ह और भी दक हररर् क्षेत्र में जसैे वन क्षेत्र, कृधि क्षेत्र आदि में कोई पयररणयधमक किौर्ी नहीं होगी और अनप्रर्ुक् र् र्य अनुत् पयिक कृधि क्षेत्रों में पुन: वनीकरण करने के प्रर्यस दकए जयएगें।
(2) प्रयकृधर्क झरनें – आचंधलक महयर्ोजनय में सभी प्रयकृधर्क झरनों की पहचयन की जयएगी और उनके सरंक्षण और पुनरुद्भूर्करण के धलए र्ोजनय सधम मधलर् होगी और रयज् र् सरकयर द्वयरय ऐसे क्षते्रों पर र्य उनके धनकि धवकयस दिर्यकलयप प्रधर्धिद्ध करने के धलए ऐसी रीधर् से मयगाधनिशे र्ैर्यर दकए जयएगें ।
(3) पयररधथथधर्क-पर्ािन – (क) पयररधथथधर्क संवेिी जोन के भीर्र पर्ािन संबंिी दिर्यकलयप, पर्ािन महयर्ोजनय के अनुसयर होंगे जो दक आंचधलक महयर्ोजनय के भयग बनेंगे । (ख) पयररधथथधर्क पर्ािन महयर्ोजनय धवभयग, धहमयचल प्रिशे सरकयर द्वयरय वन और पर्यावरण धवभयग, धहमयचल प्रिशे सरकयर के परयमशा से र्ैर्यर की जयएगी। (ग) पर्ािन महयर्ोजनय आंचधलक महयर्ोजनय कय एक सघंिक होगी । (घ) पर्ािन संबंिी दिर्यकलयप धनम नधलधखर् के अिीन धवधनर्धमर् होंगे, अथयार्प :—
(i) सयंगलय घयिी (रक्छम-धचिकुल) वन्र्जीव अभर्यरण्र् की सीमय 1 दकलोमीिर के भीर्र र्य पयररधथथधर्क संवेिी जोन के धवथर्यर र्क, इसमें जो भी नजिीक हो होिल और ररसोिा के नए सधंनमयाण अनुज्ञयर् नहीं होगे। र्थयधप वन्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीिर की िरूी से परे पयररधथथधर्क संवेिी जोन के धवथर्यर र्क नए होिल और ररसोिो की थथयपनय को पूवा पररभयधिर् और धवधनर्िाष्ट क्षेत्रों में पयररधथथधर्क पर्ािन कयर्ाकलयपो के धलए पर्ािन महयर्ोजनय के अनुसयर अनुज्ञयर् दकर्य जयएगय;
(ii) पयररधथथधर्क संविेी जोन के भीर्र सभी नए पर्ािन दिर्यकलयपों र्य धवद्यमयन पर्ािन दिर्यकलयपों कय धवथर्यर रयष् रीर् ा र्यघ्र स संरक्षण प्रयधिकरण, पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् द्वयरय जयरी (समर्-समर् पर र्थय संशोधिर्) मयगाधनिशेों के अनुसयर होगय धजसमें पयररधथथधर्क पर्ािन, पयररधथथधर्क धशक्षय और पयररधथथधर्क धवकयस को महत्व दिर्य जयएगय और पयररधथथधर्क संवेिी जोन की वहन क्षमर्य के अध्र्र्न पर आियररर् होगय;
(iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयने र्क, पर्ािन के धलए धवकयस और धवद्यमयन पर्ािन दिर्यकलयपों के धवथर्यर को वयथर्धवक थथल धवधनर्िाष्ट संवीक्षय र्थय मयनीिरी सधमधर् की धसफयररश पर आियररर् संबंधिर् धवधनर्यमक प्रयधिकरणों द्वयरय अनुज्ञयर् दकर्य होगय ।
(6) नसैर्गाक धवरयसर् -- पयररधथथधर्क संवेिी जोन में महत्वपूणा नैसर्गाक धवरयसर् के सभी थथलों जैसे सभी जीन कोश आरधक्षर् क्षेत्र, शैल धवरचनयए,ं जल प्रपयर्ों, झरनों, घयिी मयगों, उपवनों, गुफयए,ं थथलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और उन्हें संरधक्षर् दकर्य जयएगय र्थय उनकी सरुक्षय और संरक्षय के धलए इस अधिसूचनय के अंधर्म प्रकयशन की र्यरीख से छह मयस के भीर्र, उपर्ुि र्ोजनय बनयएगी और ऐसी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगय । II (ii) 5
(5) मयनव धनर्मार् धवरयसर् थ थल - पयररधथ थधर्क संवेिी जोन में भवनों, संरचनयओं, धशल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंथकृधर्क महत्व के क्षेत्रों की पहचयन की जयएगी और इस अधिसूचनय के प्रकयशन की र्यरीख से छह मयस के भीर्र उनके सरंक्षण की र्ोजनय र्ैर्यर करनी होगी र्थय आंचधलक महयर्ोजनय में सधममधलर् की जयएगी ।
(6) ध् वधन प्रििूण—पयररधथथधर्क संवेिी जोन में ध् वधन प्रििूण के धनर्ंत्रण के धलए रयज् र् सरकयर कय पर्यावरण धवभयग और धहमयचल प्रिशे धनर्ंत्रण बोडा ध्वधन प्रििूण (धवधनर्मन और धनर्ंत्रण) धनर्मों के अनुसयर पर्यावरणीर् (संरक्षण) अधिधनर्म, 19 6, 2000 अंर्गार् र्ैर्यर करेगय ।
(7) वयर् ुप्रििूण —पयररधथथधर्क संवेिी जोन में, वयर् ुप्रििूण कय धनर्ंत्रण और वयर्ु धनवयरण(प्रििूण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और उसके अिीन बनयए गए धनर्मों के उपबिंों के अनुसरण में दकर्य जयएगय ( ) बधहस्रयव कय धनथसयरण—पयररधथथधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनथसयरण पर्यावरणीर् (संरक्षण) अधिधनर्म, 19 6 और उसके अिीन बनयए गए धनर्मों के अन्र्गार् आन ेवयल ेपर्यावरणीर् प्रििूण के धनथसयरण संबंिी सयियरण मयनकों के उपबंिों के अनुसयर होगय।
(9) ठोस अपधशष्ट—ठोस अपधशष्टों कय धनपियन धनम्नधलधखर् रूप में होगय-
(i) पयररधथथधर्क संवेिी जोन में ठोस अपधशष्टों कय धनपियन, ठोस अपधशष्ट प्रबंिन, धनर्म, 2016, जो भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्- समर् पर र्थय संशोधिर् अधिसूचनय स.ं कय.आ. 1357(अ), र्यरीख अपै्रल, 2016 द्वयरय प्रकयधशर् दकए गए थी, के उपबंिों के अनुसयर दकर्य जयएगय ;
(ii) जैधवक सयमग्री कय धनपियन पर्यावरणीर् रूप से थवीकयर्ा रीधर् में पयररधथथधर्क संवेिी जोन से बयहर पहचयन दकए गए दकसी थथल पर दकर्य जय सके ।
(iii) ठोस अपधशष्ट को जलयनय र्य भथमीकरण और पयररधथथधर्क संवेिी जोन में मलबय डयलने को अनुज्ञयर् नहीं दकर्य जयएगय ।
(10) जवै धचदकत् सीर् अपधशष् ि—पयररधथथधर्क संवेिी जोन में जैव धचदकत्सय अपधशष्ट कय धनपियन, जैव अपधशष्ट प्रबंि धनर्म, 2016 भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थय संशोधिर् अधिसूचनय सं.कय.आ. 363(अ) र्यरीख 28 मयचा 2016 द्वयरय प्रकयधशर् की गई थी के उपबंिों के अनुसयर दकर्य जयएगय ।
(i) पयररधथथधर्क संवेिी जोन के भीर्र भथमीकरण के धलए कोई सयमयन्र् उपचयर सुधविय अनुज्ञयर् नहीं की जयएगी।
(ii) व्यधष्टक अथपर्यल र्य प्रयइवेि थथयथथ्र् कें रों को, जो पहले से ही पयररधथथधर्क संवेिी जोन में धवद्यमयन ह,ै संरधक्षर् क्षेत्र पर प्रधर्कूल सघंयर् से बचने के धलए पर्याप्त अपधशष्ट उपचयर प्रणयली उपलब्ि करयनी चयधहए।
(11) प्लयधथिक अपधशष्ट प्रबिंन.—पयररधथथधर्क संवेिी जोन में प्लयधथिक अपधशष्ट प्रबंि, प्लयधथिक अपधशष्ट प्रबंि धनर्म 2016 के अनसुयर और भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थय संशोधिर् प्रकयधशर् अधिसूचनय सं.सय.कय.धन 360(अ), र्यरीख 1 मयचा, 2016 के अनुसयर दकर्य जयएगय। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(12) धनमयाण और धवध्वसं अपधशष्ट प्रबिंन.—पयररधथथधर्क संवेिी जोन में संधनमयाण और धवध्वंस अपधशष्ट प्रबंिन, संधनमयाण और धवध्वंस अपधशष्ट प्रबंिन धनर्म, 2016 के उपबंिों के अनसुयर और भयरर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थय संशोधिर् प्रकयधशर् अधिसूचनय सं.कय.धन 317(अ), र्यरीख 29 मयचा, 2016 के अनुसयर दकर्य जयएगय।
(13) ईलकै्रयधनकी–अपधशष्ट.—पयररधथथधर्क संवेिी जोन में ईलैक्रयधनकी–अपधशष्ट धनर्म, 2016, भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थय संशोधिर् प्रकयधशर् दकए गए थे, के अनुसयर दकर्य जयएगय।
(14) र्यनीर् पररवहन.—पररवहन की र्यनीर् गधर्धवधिर्यं आवयस के अनुकूल धवधनर्धमर् होंगी और इस संबंि में आंचधलक महयर्ोजनय में धवशेि उपबंि अधिकधथर् दकए जयएगें और आंचधलक महयर्ोजनय के र्ैर्यर होने और पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् के अनुमोदिर् होन र्क, रयज्र् थर्रीर् पयररधथथधर्क संवेिी जोन मयनीिरी सधमधर् प्रवृत्त धनर्मों औरधवधनर्मों के अनसुयर र्यनीर् गधर्धवधिर्ों के अनुपयलन को मयनीिर करेगी।
(15) औद्योधगक ईकयइर्य.ं—(क) प्रथर्यधवर् पयररधथथधर्क संवेिी जोन में नए कयष्ठ आियररर् उद्योगों की थथयपनय को धसवयर् धवधि के अनुसयर थथयधपर् धवद्यमयन कयष्ठ आियररर् उद्योगों के अनुज्ञयर् नहीं दकर्य जयएगय। (ख) जल, वयर्ु, मृिय, ध्वधन प्रििूण कयररर् करने वयले दकसी नए उद्योग की प्रथर्यधवर् पयररधथथधर्क संवेिी जोन में थथयपनय को अनुज्ञयर् नहीं दकर्य जयएगय।
(16) अगर र्ह आवश्र्क समझर्य ह,ै इस अधिसूचनय के प्रयवियनों को प्रभयवी करने में केन्र सरकयर और रयज्र् सरकयर, अन्र् उपयर्ों धनर्िाष्ट करेगय।
6. पयररधथथधर्क सवंेिी जोन में प्रधर्धिद्ध और धवधनर्धमर् दिर्यकलयपों की सचूी.—पयररधथथधर्क संवेिी जोन में सभी दिर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (19 6 कय 29) के उपबंिों द्वयरय शयधसर् होंग ेऔर नीच ेिी गई सयरणी में धवधनर्िाष्ट रीधर् में धवधनर्धमर् होंग,े अथयार्प :— सयरणी िम स.ं दिर्यकलयप रिप्पधणर्य ं

1. वयधणधज्र्क खनन, पत्थर की खियन और उनको र्ोडने की इकयइर्य ं। (क) सभी नए और धवद्यमयन खनन (लघु और वृहर् खधनज), पत्थर की खयनें और उनको र्ोडन ेकी इकयइर्यं प्रधर्धिद्ध हैं, धसवयर् धनवयधसर्ों की सद्धयवपूणा घरेलू आवश्र्कर्यओं के नहीं होगी, धजसके अंर्गार् गृहों के संधनमयाण र्य मरममर् के धलए धमट्टी की खुियई और व्यधिक उपभोग के धलए गृहों के धनमयाण के धलए िशेी ियइलों र्य ईिों कय संधनमयाण भी ह।ै (ख) खनन संदिर्यए,ं मयननीर् उच्चर्म न्र्यर्यलर् की ररि र्यधचकय (धसधवल) सं. 1995 कय 202 िी.एन. गौडयबमान धथरुमूलपयि बनयम भयरर् सरकयर के मयमल ेमें आिशे र्यरीख 4 अगथर्, 2006 और ररि र्यधचकय (सी) सं. 2012 कय 435 गोवय फयउंडशेन बनयम भयरर् सरकयर के मयमले में र्यरीख 21 अपै्रल, 2014 के अंर्ररम आिशे के अनुसरण में सवािय प्रचयलन होगय । II (ii) 7
2. नई आरय धमलों की थथयपनय। पयररधथथधर्क संवेिी जोन के भीर्र नई और धवद्यमयन आरय धमलों कय धवथ र्यर अनुज्ञयर् नहीं होगय ।
3. दकसी पररसंकिमर् पियथों कय उपर्ोग र्य उत्पयिन । लयगू धवधिर्ों के अनसुयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) ।
4. जल र्य वयर्ु र्य मृिय र्य ध् वधन प्रििूण कयररर् करने वयले उद्योगों की थथयपनय। कोई नर्य उद्योग र्य पयररधथथधर्क संवेिी जोन में प्रििूण फैलयने वयले उद्योगों के धवथर्यर की अनुमधर् नहीं िी जयएगी। पयररधथथधर्क संवेिी जोन के भीर्र कें रीर् प्रििूण धनर्ंत्रण बोडा द्वयरय फरवरी, 2016 में जयरी दिशयधनिशेों में धसफा गैर- प्रिधूिर् उद्योगों को थथयपनय के अनुसयर अनुज्ञयर् दकर्य जयएगय, जब र्क दक इस अधिसूचनय में इस प्रकयर धवधनर्िाष्ट न हो।
5. बृहर् जल धवद्युर् पररर्ोजनय की थ थयपनय । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) ।
6. जलयवन लकडी कय वयधणधज्र्क उपर्ोग। लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) ।
7. प्रयकृधर्क जल धनकयर्ों र्य सर्ही क्षेत्र में अनुपचयररर् बधहस्रयाव । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) ।
8. ठोस अपधशष्ट धनपियन थथल और ठोस और जैव धचदकत्सय अपधशष्ट के धनपियन के धलए सयमयन्र् भष्मीकरण सुधवियओं की थथयपनय। पयररधथथधर्क संवेिी जोन के भीर्र कोई नई ठोस अपधशष्ट धनपियन थथल और अपधशष्ट उपचयर/ठोसय अपधशष्ट के प्रसंथकरण की सुधविय की अनुज्ञयर् नहीं ह।ै इसके अधर्ररि औद्योधगक प्रदिर्य और थवयथथ्र् थ थयपन/अथपर्यलों आदि से सृधज र् ठोस अपधशष्ट के कीसी भी रूप के भष्मीकरण के उपचयर की सयमयन् र् र्य व्यधष्टक सुधविय की संथथयपनय अनुज्ञयर् नहीं होगी।
9. फमों, धनगम, कंपधनर्ों द्वयरय बड े पैमयने के वयधणधज्र्क पशुपयलन और कुक्कुि पयलन की थथयपनय । धसवयर् थथयनीर् जरूरर्ों को पूरय करने के लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) ।
10. ईंि भट्टों की थथयपनय । लयगू धवधिर्ों के अनसुयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) । धवधनर्धमर् दिर्यकलयप
11. िकुयनियर द्वयरय प्लयधथिक के थैलय कय उपर्ोग । पयररधथथधर्क संवेिी जोन के भीर्र पॉधलथीन बैग के उपर्ोग की अनुमधर् ह।ै हयलयंदक, धवधशष्ट आवश्र्कर्य के आियर पर, र्ह लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
12. पर्ािन से संबंधिर् दिर्यकलयप करनय जैसे गमा वयर्ु गुब्बयरें, हलेीकयप्िर, ड्रोन, मयइिोलयइिस आदि द्वयरय पयररधथथधर्क संवेिी जोन क्षेत्र के ऊपर से उडनय। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
13. होिलों और ररसोिों कय वयधणधज्र्क थथयपनय । रयष्ट्रीर् पयका की सीमय के 1 दकलोमीिर के भीर्र नए वयधणधज्र्क होिलों और ररसोिो की थथयपनय को धसवयर् पयररधथथधर्क के अनुकूल पर्ािन कयर्ाकलयपों से सबंंधिर् पर्ािको के धलए अथथयर्ी आवयस के धलए अनुज्ञयर् नहीं दकर्य जयएगय। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परन्र्ु संरधक्षर् क्षेत्र की सीमय से एक दकलोमीिर परे र्य पयररधथथधर्क संवेिी जोन के धवथर्यर र्क, जो भी धनकि हो सभी नए पर्ािन दिर्यकलयपों र्य धवद्यमयन दिर्यकलयपों कय धवथर्यर र्थय लयगू पर्ािन महयर्ोजनय के अनुरुप होगय ।
14. संधनमयाण दिर्यकलयप । संरधक्षर् क्षेत्र की सीमय स े एक दकलोमीिर के भीर्र र्य पयररधथथधर्क संवेिी जोन, इनमें से जो भी नजिीक हो, में दकसी भी प्रकयर के नए वयधणधज्र्क संधनमयाण को अनजु्ञयर् नहीं दकर्य जयएगय:
परंर्ु थ थयनीर् लोगों को उनके आवयसीर् उपर्ोग के धलए उनकी भूमी में संधनमयाण धजसके अंर्गार् पैरय 6 के उप पैरय
(1) में सूचीबद्ध दिर्यकलयप भी ह ैको करने के धलए अनुज्ञयर् दकर्य जयएगय, जसै े
(i) धवद्यमयन सडकों को चौडय करनय और उन्हें सुिढृ करनय र्थय नई सडकों कय संधनमयाण;
(ii) अवसंरचनय और नयगररक सुख-सुधवियओं कय संधनमयाण और नवीकरण;
(iii) कुिीर उद्योगों धजनके अंर्गार् ग्रयमीण उद्योग, सुधविय भण्डयर और थथयनीर् सुधवियए,ं जो पयररधथथधर्क पर्ािन की सहयर्र्य करर्ी ह ै धजसके अंर्गार् गृह वयस ह,ै सधममधलर् हैं; और
(iv) इस अधिसूचनय में सूचीबद्ध संविान दिर्यकलयप :
15. रेसन्चंग ग्रयउंड। नए रेसन्चंग ग्रयउंड की थथयपनय प्रधर्धिद्ध है। रेसन्चंग ग्रयउंड को लयगू धवधिर्ों के अनुसयर धवधनर्धमर् दकर्य जयएगय।
16. प्रयकृधर्क जल धनकयर्ों र्य सर्ही क्षेत्र में उपचयररर् बधहस्रयाव कय धनथसयरण । प्रयकृधर्क जल धनकयर्ों र्य सर्ही क्षेत्र में उपचयररर् अपधशष्ट जल/ अबधशष्टों के बधहस्रयाव के जल धनकयर्ों में प्रवेश होने स े बचय जयएगय। उपचयररर् अपधशष्ट जल के पुन: चिण और पुन: उपर्ोग के धलए प्रर्यस दकए जयएगें। अन्र्थय प्रयकृधर्क जल धनकयर्ों र्य सर्ही क्षेत्र में उपचयररर् अपधशष्ट जल/अबधशष्टों के बधहस्रयाव को लयगू धवधिर्ों के अनुसयर धवधनर्धमर् दकर्य जयएगय।
17. वयर्ु और र्यनीर् प्रििूण। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
18. ध् वधन प्रििूण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
19. भूधमगर् जल की धनकयसी। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
20. वृक्षों की कियई । (क) रयज्र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनुमधर् के धबनय वन, सरकयरी र्य रयजथव र्य धनजी भूधम पर वृक्षों की कोई कियई नहीं होगी । II (ii) 9 (ख) वृक्षों की कियई संबंधिर् कें रीर् र्य रयज्र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंि के अनसुयर धवधनर्धमर् होगी ।
21. प्रवयसी चरवयह।े लयगू धवधिर्ों और आंचधलक महयर्ोजनय के अनुसयर धवधनर्धमर् होंगे ।
22. धवद्युर् कय पररधनमयाण और धवद्युर् लयइनों कय इन्सुलेशन और संचयर ियवर र्थय केबलों और केबलों को धबछयनय और अन्र् अवसंरचयए।ं लयगू धवधिर्ों के अिीन धवधनर्धमर् । भूधमगर् केबलीकरण कय संविान दकर्य जयएगय।
23. धवद्यमयन सडकों को चौडय करनय और उन्हें सुिढृ करनय र्थय नई सडकों कय संधन्नमयाण । उधचर् पर्यावरण समयघयर् धनियारण और न्र्ूनीकरण उपयर् र्थय लयगू अनुसयर होगें
24. होिलों और लॉज के धवद्यमयन पररसरों में बयड लगयनय । लयगू धवधिर्ों के अिीन धवधनर्धमर् होगय । वन् र्जीव के मुक् र् संचलन को अनुज्ञयर् करन े के धलए पयररधथथधर्क संवेिी जोन के भीर्र होिलों र्य अन् र् वयधणधज् र्क थ थयपन अपनी पररसंपधत् र्र्ों में कयिेियर स ेबयड नहीं लगयएगें और कोई भी बयड 1 मीिर से ऊंची नहीं होगी । कोई धवद्यमयन बयड, जो इस उपिशा कय अनुपयलन नहीं करर्ी ह,ै को आंचधलक महयर्ोजनय में वर्णार् समर्-सीमय के अनसुयर उपयंर्ररर् दकर्य जयएगय ।
25. वन उत्पयिों और गैर कयष् ठ वन उत्पयिों कय संग्रहण (एनिीएफपी) । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
26. कृधि प्रणयली में आमूल बिलयव। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
27. प्रयकृधर्क जल संसयिनों कय वयधणधज्र्क उपर्ोग, धजसके अंर्गार् भू-जल संचर्न भी ह।ै लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
28. रयधत्र में र्यनीर् र्यर्यर्यर् कय संचलन । लयगू धवधिर्ों के अिीन वयधणधज्र्क प्रर्ोजन के धलए धवधनर्धमर् होंगे ।
29. धविशेी प्रजयधर्र्ों को लयनय । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
30. वयधणधज् र्क सयइनबोडा और होर्डाग। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
31. पहयडी ढयलों और निी र्िों कय संरक्षण । पहयडी ढयलों और निी र्िों कय संरक्षण ।

46. विया जल संचर्न । सदि र् रूप से बढयवय दिर्य जयएगय ।
47. कुिीर उद्योगों धजसके अंर्गार् ग्रयमीण कयरीगर आदि भी हैं। सदि र् रूप से बढयवय दिर्य जयएगय ।
48. नवीकरणीर् ऊजया स्रोर् कय उपर्ोग । जैव गैस, सौर प्रकयश आदि कय संविान दकर्य जयएगय ।

5. मयनीिरी सधमधर्- (1) कें रीर् सरकयर, पयररधथथधर्क संवेिी जोन के प्रभयवी मयनीिरी के धलए एक मयनीिरी सधमधर् कय गठन करर्ी ह,ै जो धनम्नधलधखर् से धमलकर बनेगी, अथयार्प :— (क) धजलय मधजथरेि, दकन्नौर - अध्र्क्ष;
(ख) पयररधथ थधर्क और पर्यावरण क्षेत्र से धहमयचल प्रिशे सरकयर द्वयरय र्ीन विा के धलए नयमधनर्िाष् ि दकर्य जयए वयलय एक धवशेिज्ञ -सिथर्;
(ग) धहमयचल प्रिशे सरकयर द्वयरय गैर सरकयरी संगठन (पर्यावरण के क्षेत्र में कयर्ा करने वयले, धजसके अंर्गार् धवरयसर् संरक्षण भी ह)ै गैर सरकयरी संगठन कय र्ीन विा के धलए नयमधनर्िाष् ि दकर्य जयने वयलय एक प्रधर्धनधि - सिथर्;
(घ) धहमयचल प्रिशे रयज्र् जैव-धवधविर्य बोडा कय सिथर्/सधचव र्य सिथर्, - सिथर्;
II (ii) 11 (ड.) कयर्ापयलक इंजीधनर्र, धहमयचल प्रिशे प्रििूण धनर्ंत्रण बोडा - सिथर्;
(च) उप धजलय मधजथरेि, कलपय - सिथर्;
(छ) प्रभयगीर् वन अधिकयरी, रयज्र् क्षेत्रीर् - सिथर्;
(ज) प्रभयगीर् वन अधिकयरी (वन्र्जीव) - सिथर्- सिथर् । धनिशे धनबिंन (1) मयनीिरी सधमधर् की अवधि इस अधिसूचनय की र्यरीख से र्ीन विा होगी।
(2) मयनीिरी सधमधर् इस अधिसूचनय के उपबंिों के अनुपयलन को मयनीिर करेगी ।
(3) पयररधथथधर्क संवेिी जोन में भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ. 1533(अ), र्यरीख 14 धसर्ंबर, 2006 की अनुसूची में के अिीन सधममधलर् दिर्यकलयपों और इस अधिसूचनय के पैरय 6 के अिीन प्रधर्धिद्ध गधर्धवधिर्ों के धसवयर् आने वयले ऐसे दिर्यकलयपों की िशय में वयथर्धवक धवधनर्िाष्ट थथलीर् िशयओं पर आियररर् रयज्र् थर्रीर् पयररधथथधर्क संवेिी जोन मयनीिरी सधमधर् द्वयरय संवीक्षय की जयएगी और उि अधिसूचनय के उपबंिों के अिीन पूवा पर्यावरण धनकयसी के धलए केन्रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को धनर्िाष्ट की जयएगी।
(6) इस अधिसूचनय के पैरय 6 के अिीन र्थय धवधनर्िाष्ट प्रधर्धिद्ध दिर्यकलयपों के धसवयर्, भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय संखर्यंक कय.आ. 1533(अ), र्यरीख 14 धसर्ंबर, 2006 की अधिसूचनय के अनुसूची के अिीन ऐसे दिर्यकलयपों, धजन्हें सधममधलर् नहीं दकर्य गर्य ह,ै परंर्ु पयररधथथधर्क संविेी जोन में आर्े हैं, ऐसे दिर्यकलयपों की वयथर्धवक धवधनर्िाष्ट थथलीर् िशयओं पर आियररर् मयनीिरी सधमधर् द्वयरय संवीक्षय की जयएगी और उसे संबद्ध धवधनर्यमक प्रयधिकरणों को धनर्िाष्ट दकर्य जयएगय ।
(5) मयनीिरी सधमधर् कय सिथर्-सधचव र्य संबद्ध कलक्िर र्य सरंधक्षर् क्षेत्र कय प्रभयरी ऐसे व्यधि के धवरूद्ध, जो इस अधिसूचनय के दकसी उपबंि कय उल्लंघन करर्य ह,ै पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 19 के अिीन पररवयि फयइल करन ेके धलए सक्षम होगय ।
(6) मयनीिरी सधमधर् मुद्दों के आियर पर अपेक्षयओं पर धनभार रहर् ेहुए संबद्ध धवभयगों के प्रधर्धनधिर्ों र्य धवशेिज्ञों, औद्योधगक संगमों र्य संबद्ध पणियररर्ों के प्रधर्धनधिर्ों को अपने धवचयर-धवमशा में सहयर्र्य के धलए आमंधत्रर् कर सकेगी ।
(7) मयनीिरी सधमधर् प्रत्र्ेक विा की 31 मयचा र्क कें रीर् सरकयर के पर्यावरण, वन, और जलवयर्ु पररवर्ान मंत्रयलर् को अपनी वयर्िाक कयरावयई ररपोिा उपयबिं III में उपबंधिर् रूप में उक् र् विा के 30 जून र्क प्रथर्ुर् करेगी ।

8. कोई अन् र् महत् वपूणा धविर् । 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 26th July, 2017 S.O. 2404(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 1976 (E), dated 3 rd June, 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, no comments/objections and suggestions were received from persons and stakeholders in response to the draft notification;
AND WHEREAS, The Rakchham-Chitkul Wildlife Sanctuary is situated in the Kinnaur district of Himachal Pradesh and covers an area of about 304 square kilometres;
AND WHEREAS, the flora and fauna represent rich biological significance of this Sanctuary. The Sanctuary is the habitat of Black Bear (Ursus sp.,), Brown Bear (Ursus arctos), Musk Deer (Moschus sp.), Leopard (Panthera pardus), Snow Leopard (Panthera uncial), Monal (Lophophorus sp.), Chakor (Alectoris chukar), etc.;
AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Rakchham-Chitkul Wildlife Sanctuary as Ecosensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said eco-sensitive zone.
NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the environment (protection) act, 1986 (29 of 1986) read with sub- rule (3) of rule 5 of the environment (protection) rules, 1986, the Central Government hereby notifies an area to an extent ranging from 0 metres to 15 kilometres around the boundary of Rakchham-Chitkul Wildlife Sanctuary in the state of Himachal Pradesh as the Rakchham-Chitkul Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the eco-sensitive zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.—(1)The extent of Eco-sensitive Zone varies from 0 metres to 15 kilometres from the boundary of the Sangla Valley (Rakchham-Chitkul) Wildlife Sanctuary. 0 Eco- Sensitive Zone towards the Southern and South-Western sides is due to interstate boundary with Uttarakhand and shares boundary with Govind Pashu National Park of Uttarakhand. The area of the Eco- sensitive Zone is 464.8 sq. km.
(2) The map of Rakchham-Chitkul Wildlife Sanctuary demarcating the Eco-sensitive Zone is appended as Annexure I.
(3) The list of Geo Co-ordinates of prominent locations of the boundary of Rakchham-Chitkul Wildlife Sanctuary and its Eco-Sensitive Zone is appended as Annexure II.
(4) No villages fall within the proposed Eco-Sensitive Zone.
2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan so prepared shall commensurate with the stipulation specified in the Notification and include the environmental implications.
(3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:—
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Irrigation;
(ix) Public Works Department; and
(x) Himachal Pradesh State Pollution Control Board.

(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas such as parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited, regulated and promoted activities specified in the Notification so as to ensure Eco-friendly development for livelihood security of local communities.
(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions with respect to the provisions given in this notification.
3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:—
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism activities;
(ii) widening and strengthening of existing roads and construction of new roads;
(iii) small scale industries not causing pollution;
(iv) rain water harvesting; and
(v) cottage industries including village industries, convenience stores and local amenities;
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or and restrict development activities within the catchment areas.
(3) Eco-Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism, Government of Himachal Pradesh in consultation with Department of Revenue and Forests, Government of Himachal Pradesh.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities relating to tourism shall be regulated as under, namely.-
(i) New construction of hotels and resorts shall not be allowed within 1 km from the boundary of the Sangla Valley (Rakchham-Chitkul) Wildlife Sanctuary or upto the extent of the Eco-Sensitive Zone whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Bihar State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- Regulations for the control of air pollution in the Eco-Sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein.—
(9) Solid wastes. - Disposal of solid wastes shall be as under:—
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8 th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343(E), dated the 28 th March, 2016, as amended from time to time.
(i) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone;
(ii) Individual hospitals or private health centres already existing within the Eco Sensitive Zone should provide adequate waste treatment system to avoid adverse impact on the Protected Area.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.—The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Industrial units.—
(a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Ecosensitive Zone shall be permitted.
(16) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.—All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:

UOI in W.P.(C) No. 435 of 2012.
2. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
4. Setting up of industries causing water or air or soil or noise pollution.
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within ECO-SENSITIVE ZONE as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
5. Establishment of new major hydroelectric projects Prohibited (except as otherwise provided) as per applicable laws.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
7. Discharge of untreated effluents in natural water bodies or land area.

9. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.

13. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Ecotourism activities:
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
14. Construction activities No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:-
(d) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) cottage industries including village industries;
convenience stores & local amenities supporting ecotourism including home stays; and
(iv) promoted activities listed in this Notification.
15. Trenching ground Establishing of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws.
16. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water.
Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
17. Air and Vehicular Pollution Regulated under applicable laws.
18. Noise pollution Regulated under applicable laws.

20. Felling of Trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

5. Monitoring Committee.—(1) The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:—
(a) District Magistrate, Kinnaur —Chairman;
(b) An expert in the area of ecology and environment to be nominated by the Government of Himachal Pradesh for a period of three years —Member;
(c) One representative of non-Governmental Organisation (working in the field of environment including heritage conservation) to be nominated by the Government of Himachal Pradesh for a period of three years —Member;
(d) Member Secretary or Member, Himachal Pradesh State Biodiversity Board —Member;
(e) Executive Engineer, Himachal Pradesh State Pollution Control Board —Member;
(f) Sub District Magistrate, Kalpa —Member;

Terms of Reference:
(1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of Notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14 th September, 2006 and are falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
Promoted Activities
42. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
43. Organic farming. Shall be actively promoted.
44. Adoption of green technology for all activities Shall be actively promoted.
45. Small scale non polluting industries. Non polluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February, 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
46. Rain water harvesting Shall be actively promoted.
47. Cottage industries including village artisans, etc.
Shall be actively promoted.
48. Use of renewable energy and fuels Bio gas, solar light etc. to be actively promoted
49. Agro-Forestry Shall be actively promoted.
50. Use of eco-friendly transport Shall be actively promoted.
51. Skill Development Shall be actively promoted.
52. Restoration of Degraded Land/ Forests/ Habitat Shall be actively promoted.
53. Environmental Awareness Shall be actively promoted.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wild Life Warden of the State under intimation to this Ministry as per proforma appended at Annexure III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
