2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, गंगा नदी के 'दषूण के 'भावी उपशमन और संरDण के िलए के0 Iीय सरकार और राJ य सरकार� के सामिुहक 'यास� को सुदढ़ृ करने के िलए एक योजना, िवF पोषण, मॉिनटरी और सम0 वय 'ािधकरण क" आव? यकता ह;ै अत:, अब, के0 Iीय सरकार, पया5वरण (संरDण) अिधिनयम, 1986 (1986 का 29) (िजस ेइसम< इसके प? चात् उN त अिधिनयम कहा गया ह)ै क" धारा 3 क" उप-धारा (1) और उप-धारा (3) �ारा 'दF शिOय� का 'योग करते Aए, और त कालीन पया5वरण और वन मं7ालय, भारत सरकार क" अिधसचूना सं: या का.आ. 521 (अ) तारीख 20 फरवरी, 2009 को उन बात� के िसवाय अिधPांत करते Aए िज0 ह< ऐस ेअितPमण से पहले �कया गया है या करने से लोप �कया गया ह,ै गंगा नदी के 'दषूण का 'भावी उपशमन करने और संरDण के उपाय करने के िलए रा% &ीय गंगा नदी बेिसन का गठन करती ह।ै 1. �ािधकरण का नाम�ािधकरण का नाम�ािधकरण का नाम�ािधकरण का नाम – इस अिधसूचना के अधीन गHठत 'ािधकरण ‘रा% &ीय गंगा नदी बेिसन 'ािधकरण’ (िजस ेइसम< इसके प? चात् 'ािधकरण कहा गया ह)ै के नाम से Sात होगा। 2. 2. 2. 2. �ािधकरण का गठन�ािधकरण का गठन�ािधकरण का गठन�ािधकरण का गठन – (1) 'ािधकरण िन� निलिखत सद� य� स ेिमलकर बनेगा अथा5त:्- (क) 'धानमं7ी अ@ यD; (ख) संघ का जल संसाधन, नदी िवकास और गंगा संरDण मं7ी उपा@ यD; (ग) संघ का पया5वरण, वन और जलवायु पHरवत5न मं7ी सद� य; (घ) संघ का िव त म7ंी सद� य; (ड.) संघ का शहरी िवकास म7ंी सद� य; (च) संघ का िव,ुत मं7ी सद� य; (छ) संघ का िवSान और 'ौ,ोिगक" मं7ी सद� य; (ज) संघ का Wामीण िवकास मं7ी सद� य; (झ) संघ का पेयजल और � वX छता म7ंी सद� य; (ञ) संघ का पोत पHरवहन मं7ी सद� य; (ट) संघ का पय5टन राJ य म7ंी सद� य; (ठ) उपा@ यD, योजना आयोग सद� य; (ड) मु: यम7ंी, उFराखंड सद� य; (ढ) मु: यम7ंी, उFर 'देश सद� य; (ण) मु: यम7ंी, िबहार सद� य; (त) मु:यम7ंी, झारखंड सद� य; (थ) मु: यम7ंी, पf”pमी बंगाल सद� य; और (द) सिचव, जल संसाधन, नदी िवकास और गंगा संरDण मं7ालय सद� य-सिचव (2) 'ािधकरण, उन राJ य� से िज0 ह< उपपैरा (1) म< 'ितिनिध व नह[ �दया गया है और िजनम< गंगा नदी क" ऐसी 'मखु सहायक न�दयां ह\, िजससे गंगा नदी क" जलगुणवFा के 'भािवत होने क" संभावना ह,ै �कसी एक या अिधक मु: यमंि7य� को सद� य के ]प म< सहयोिजत कर सकेगा; (3) 'ािधकरण, संघ के एक या अिधक मिं7य� को भी य�द आव? यक समझ<, सद� य के ]प म< सहयोिजत कर सकेगा;

(4) 'ािधकरण ऐसे दस से अनिधक ऐसे सद� य� को जो नदी संरDण जल िवSान, पया5वरणीय अिभयांि7क", जन–जागरण और अ0 य सुसंगत Dे7� के िवशेषS ह�, सद� य के ]प म< सहयोिजत कर सकेगा। पर0 तु इस 'कार सहयोिजत िवशेषS सद� य� का काय5काल दो वष5 का होगा, िजसे 'ािधकरण �ारा उतनी अविध तक बढ़ाया जा सकता ह ैिजतनी वह आव? यक समझे। (5) 'ािधकरण का मु: यालय नई �द� ली म< होगा। 3. �ािधकरण क� शि�यां और कृ� य�ािधकरण क� शि�यां और कृ� य�ािधकरण क� शि�यां और कृ� य�ािधकरण क� शि�यां और कृ� य.... – (1) उN त अिधिनयम के उपबंध� के अधीन रहते Aए 'ािधकरण को ऐसे सभी उपाय करने और कृ य� का िनवा5हन करने क" शिO होगी, िज0 ह< वह गंगा नदी के 'दषूण के 'भावी उपशमन और संरDण के िलए तथा सत~त िवकास क" आव? यकता को दिृEगत रखते Aए आव? यक अथवा समीचीन समझे। (2) िविश% टतयाa और उप-पैरा (1) के उपबंध� क" . यापकता पर 'ितकूल 'भाव डाले िबना, ऐसे उपाय� म< बेिसन Dे7 म< िन� निलिखत उपाय� म< से सभी या कोई उपाय सि�मिलत ह�गे, अथा5त्:- (क) गंगा नदी क" जलगुणवFा को बनाए रखने और उसम< नदी बेिसन 'बंधन योजना के िवकास तथा उसम< होने वाल े'दषूण के िनवारण, िनयं7ण और उपशमन के िलए लिDत �Pयाकलाप� को िविनयिमत करना और ऐस ेअ0 य उपाय करना, जो गंगा बेिसन राJ य� म< नदी पाHरि�थितक" और 'बंधन स ेसुसगंत हो; (ख) जल क" गुणवFा और पया5वरण क" दिृE से सत~त िवकास सुिनf”pत करने के उGे? य स ेगंगा नदी म< 0 यूनतम पाHरि�थितक"य बहाव� का अवधारण और रDण; (ग) गंगा नदी म< पदषूण के उपशमन, िजसके अंतग5त मलवहन अवसंरचना, जलागम Dे7 उपचार का 'सारण भी ह,ै बाढ़ वाले मैदान� को संरDण, जन जागृित पैदा करने, जलीय जीवन और जैव-िविवधता संरDण संबंधी काय5Pम� क" योजना बनाने; िवF पोषण करने और उ0 ह< िन% पा�दत करने के िलए आव? यक उपाय करना और पया5वरण क" दिृE से सr~r नदी संरDण को 'ो0 नत करने के अ0 य उपाय करना; (घ) गंगा नदी म< पया5वरणीय 'दषूण से संबंिधत सचूना का संWहण, िव? लेषण और 'सार करना; (ङ) गंगा नदी के पया5वरणीय 'दषूण और संरDण क" सम� या_ से संबंिधत अ0 वेषण और अनुसंधान; (च) 'ािधकरण म< िनिहत काय` के �Pया0 वयन के िलए यथा उिचत, िवशेषS 'योजन यान� का सजृन; (छ) जल संरDण पaितय�, िजनके अंतग5त पुनच5Pण और पुन'5योग भी ह,ै वषा5 जल सचंयन और िवके0 Iीकृत मलवहन शोधन 'णािलय� को 'ो0 नत करना; (ज) गंगा नदी म< 'दषूण िनवारण, िनयं7ण और उपशमन के िलए �कए जाने वाले िविभ0 न काय5Pम� अथवा �Pयाकलाप� के �Pया0 वयन को मॉिनटर करना और उसका पुन�वलोकन; और (झ) उN त अिधिनयम क" धारा 5 के अधीन उपयु5N त सभी अथवा �क0ह[ कृ य� का 'योग और अनुपालन करने के 'योजन के िलए िनदशे जारी करना और ऐसे अ0 य उपाय करना, िज0 ह< 'ािधकरण अपने उG?े य� क" 'ािb के िलए आव? यक अथवा समीचीन समझे। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(3) 'ािधकरण क" शिOया ंऔर कृ य �कसी के0 Iीय अथवा राJ य अिधिनयम के अधीन राJ य� को 'दF ऐसी �क0 ह[ शिOय� पर 'ितकूल 'भाव डाले िबना ह�गे, जो पया5वरण (संरDण) अिधिनयम, 1986 (1986 का 29) के उपबंध� से असंगत न ह�। (4) 'ािधकरण राज् य सरकार� और उनके सं� थान� के सहयोग एवं उनके साथ सम0 वय करते Aए उप-पैरा (1) और उप-पैरा (2) म< उि�लिखत िविनयामक और िवकासा मक कृ य� को करेगा। 4. �ािधकरण क� बैठक��ािधकरण क� बैठक��ािधकरण क� बैठक��ािधकरण क� बैठक� – (1) 'ािधकरण, अपनी बैठक� सिहत, अपने काय5 सचंालन के िलए अपनी � वयं क" '�Pयाएं िविनयिमत कर सकेगा। (2) अ@ यD क" अनुपि�थित म< उपा@ यD 'ािधकरण क" बैठक� क" अ@ यDता करेगा और उसक" काय5वाही का संचालन करेगा। (3) उपा@ यD को, 'ािधकरण क" दो बैठक� के आयोजन के बीच ऐसे िविन? चय करने क" शिO होगी जो 'ािधकरण को अपने उGे? य� को 'ाc त करने के िलए आव? यक ह� और ऐसा अगली बैठक म< उसके अनुसमथ5न के अ@ यधीन होगा। 5. �ािधकरण क� अिधका रता�ािधकरण क� अिधका रता�ािधकरण क� अिधका रता�ािधकरण क� अिधका रता – गंगा नदी के 'दषूण के 'भावी उपशमन और संरDण के 'योजन के िलए 'ािधकरण क" अिधकाHरता उन राJ य� तक, िजनसे होकर गंगा नदी बहती है, अथा5त् उFराखंड, उFर 'दशे, िबहार, झारखंड और पf”pमी बंगाल और ऐसे अ0 य राJ य� तक, जो 'ािधकरण िविन? चय करे, िजनम< गंगा नदी क" 'मुख सहायक न�दयां ह\, और िव� ताHरत होगी। 6. गंगा नदी के �दषूण के �भावी उपशमन और संर�ण को मानीटर करनागंगा नदी के �दषूण के �भावी उपशमन और संर�ण को मानीटर करनागंगा नदी के �दषूण के �भावी उपशमन और संर�ण को मानीटर करनागंगा नदी के �दषूण के �भावी उपशमन और संर�ण को मानीटर करना – 'ािधकरण गंगा नदी के 'दषूण के 'भावी उपशमन और संरDण को मानीटर करने के िलए अपना � वयं का तं7 िवकिसत कर सकेगा और उN त 'योजन के िलए उN त अिधिनयम क" धारा 5 के अधीन उसके िलए िनदेश जारी कर सकेगा। 7. �ािधकरण क� सम* िनिध�ािधकरण क� सम* िनिध�ािधकरण क� सम* िनिध�ािधकरण क� सम* िनिध – के0 Iीय सरकार �ारा ऐसी पHरयोजना_, काय5Pम� और अ0 य �Pयाकलाप� जो 'ािधकरण �ारा िविनf”pत �कए जाएं, को �Pयाि0वत करने के िलए उपलd ध कराई गई एक समW िनिध होगी। 8. �ािधकरण को �शासिनक और तकनीक� समथ,न�ािधकरण को �शासिनक और तकनीक� समथ,न�ािधकरण को �शासिनक और तकनीक� समथ,न�ािधकरण को �शासिनक और तकनीक� समथ,न – (1) 'ािधकरण को जल संसाधन, नदी िवकास और गंगा संरDण मं7ालय, जो �क नोडल मं7ालय होगा, के0 Iीय सरकार �ारा 'शासिनक और तकनीक" समथ5न उपलd ध कराया जाएगा। (2) 'ािधकरण अपने िविन? चय� के �Pया0 वयन के िलए एक समुिचत तं7 िवकिसत कर सकेगा। 9. रा- यरा- यरा- यरा- य नदी संर�ण �ािधकरण. का गठन नदी संर�ण �ािधकरण. का गठन नदी संर�ण �ािधकरण. का गठन नदी संर�ण �ािधकरण. का गठन – संबंिधत राJ य सरकार< राJ य � तर पर गंगा नदी संरDण �Pयाकलाप� म< सहयोग, उनके सम0 वय और �Pया0 वयन के िलए म:ु यमं7ी क" अ@ यDता म< ऐसी संरचना और शिOय� सिहत, जैसी वह उिचत समझे, राJ य गंगा नदी संरDण 'ािधकरण गHठत कर<गी। 10. रा- यरा- यरा- यरा- य म� वृहत् �बधंन म� वृहत् �बधंन म� वृहत् �बधंन म� वृहत् �बधंन – रा% &ीय गंगा नदी बेिसन 'ािधकरण �ारा तैयार क" गई एक"कृत बेिसन 'बंधन योजना और �कए गए िविन? चय� के आधार पर, राJ य सरकार< अपने-अपने 'ािधकरण� के मा@ यम स ेराJ य� म< नदी के व ृहत् 'बंधन के िलए कदम उठाएंगी। [फा. सं. एन.सी.-06/2014-15/393/एनएमसीजी/एनजीआरबीए-सेल] राजीव रंजन िमeा, संयुN त सिचव ¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 5 MINISTRY OF WATER RESOURCES, RIVER DEVELOPMENT AND GANGA REJUVENATION NOTIFICATION New Delhi, the 29th September, 2014 S.O. 2539(E).—Whereas the river Ganga is of unique importance ascribed to reasons that are geographical, historical, socio-cultural and economic giving it the status of a national river;
And whereas the river Ganga has been facing serious threat due to discharge of increasing quantities of sewage effluents, trade effluents and other pollutants on account of rapid urbanization and industrialization;
And whereas, the demand for river water is growing for irrigation, drinking purposes, industrial use and power due to increase in population, urbanisation, industrialisation and growth in infrastructure, and taking into account the need to meet competing demands;
And whereas there is urgent need, --
(a) to ensure effective abatement of pollution and rejuvenation of the river Ganga by adopting a river basin approach to promote inter-sectoral co-ordination for comprehensive planning and management; and
(b) to maintain minimum ecological flows in the river Ganga with the aim of ensuring water quality and environmentally sustainable development;
And whereas it is required to have a planning, financing, monitoring and coordinating authority for strengthening the collective efforts of the Central Government and the State Governments for effective abatement of pollution and rejuvenation of the river Ganga;
Now, therefore, in exercise of the powers conferred by Sub-sections (1) and (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereinafter referred to as the said Act), and in supersession of the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 521(E), dated the 20 th February, 2009, except as respects things done or omitted to be done before such supersession, the Central Government hereby constitutes the National Ganga River Basin Authority for taking measures for effective abatement of pollution and rejuvenation of the river Ganga, namely :-.
1. Name of the Authority:– The Authority constituted under this notification shall be know as the “National Ganga River Basin Authority” (hereinafter referred to as the Authority).
2. Composition of Authority: – (1) The Authority shall consist of the following members, namely:—
(a) Prime Minister —Chairperson;
(b) Union Minister for Water Resources, —Vice Chairperson;
River Development and Ganga Rejuvenation
(c) Union Minister for Environment, Forest —Member;
and Climate Change
(d) Union Minister for Finance —Member;
(e) Union Minister for Urban Development —Member;
(f) Union Minister for Power —Member;
(g) Union Minister for Science and Technology —Member;
(h) Union Minister for Rural Development —Member;
(i) Union Minister for Drinking Water and Sanitation —Member;
(j) Union Minister for Shipping —Member;
(k) Union Minister of State, Tourism —Member;
(l) Deputy Chairman, Planning Commission —Member;
(m) Chief Minister, Uttarakhand —Member;
(n) Chief Minister, Uttar Pradesh —Member;
(o) Chief Minister, Bihar —Member;

(p) Chief Minister, Jharkhand —Member;
(q) Chief Minister, West Bengal —Member; and
(r) Secretary in the Ministry of —Member Secretary Water Resources, River Development and Ganga Rejuvenation
(2) The Authority may co-opt one or more Chief Ministers from the States not represented in subparagraph (1), having major tributaries of the river Ganga, which are likely to affect the water quality in the river Ganga, as Member.
(3) The Authority may also co-opt one or more Union Ministers, if it considers necessary, as Member.
(4) The Authority may also co-opt not exceeding ten persons, who are experts in the fields of river rejuvenation, hydrology, environmental engineering, social mobilisation and other relevant fields, as Members.
Provided that the term of the expert members so co-opted shall be for a period of two years, which may be extended by the Authority for such period, as it may consider necessary.
(5) The headquarters of the Authority shall be at New Delhi.
3. Powers and Functions of Authority:-- (1) Subject to the provisions of the said Act, the Authority shall have the power to take all such measures and discharge functions as it deems necessary or expedient for effective abatement of pollution and rejuvenation of the river Ganga in keeping with sustainable developmental needs.
(2) In particular, and without prejudice to the generality of the provisions of sub-paragraph (1), such measures may include measures with respect to all or any of the following matters in the basin area, namely:—
(a) Development of river basin management plan and regulation of activities aimed at the prevention, control and abatement of pollution in the river Ganga to maintain its water quality, and to take such other measures relevant to river ecology and management in the Ganga Basin States;
(b) Determination and maintenance of minimum ecological flows in the river Ganga with the aim of ensuring water quality and environmentally sustainable development;
(c) Measures necessary for planning, financing and execution of programmes for abatement of pollution in the river Ganga including augmentation of sewerage infrastructure, catchment area treatment, protection of flood plains, creating public awareness, conservation of aquatic life and biodiversity and such other measures for promoting environmentally sustainable river rejuvenation;
(d) Collection, analysis and dissemination of information relating to environmental pollution in the river Ganga;
(e) Investigation and research regarding problems of environmental pollution and rejuvenation of the river Ganga;
(f) Creation of special purpose vehicles, as appropriate, for implementation of works vested with the Authority;
(g) Promotion of water conservation practices including recycling and reuse, rain water harvesting, and decentralized sewage treatment systems;
(h) Monitoring and review of the implementation of various programmes or activities taken up for prevention, control and abatement of pollution in the river Ganga; and
(i) Issuance of directions under Section 5 of the said Act for the purposes of exercising and performing all or any of the above functions and to take such other measures as the Authority deems necessary or expedient, for achievement of its objectives.

(3) The powers and functions of the Authority shall be without prejudice to any of the powers conferred upon the States under any Central or State Act, being not inconsistent with the provisions of the Environment (Protection) Act, 1986 (29 of 1986).
(4) The Authority shall exercise its regulatory and developmental functions as stated in subparagraphs (1) and (2) in co-operation and co-ordination with the State Governments and their institutions.
4. Meetings of Authority:—(1) The Authority may regulate its own procedure for transacting its business including its meetings.
(2) The Vice Chairperson shall preside over the meetings of the Authority and conduct its business in absence of the Chairperson.
(3) The Vice Chairperson shall have the power to take decisions necessary for the Authority to achieve its objectives, in between the conduct of two meetings of the Authority, subject to ratification in the next meeting.
5. Jurisdiction of Authority:—The jurisdiction of the Authority shall extend to the States through which the river Ganga flows, namely, Uttarakhand, Uttar Pradesh, Bihar, Jharkhand and West Bengal and such other States, having major tributaries of the river Ganga, as the Authority may decide for the purposes of effective abatement of pollution and rejuvenation of the river Ganga.
6. Monitoring of effective abatement of pollution and rejuvenation of river Ganga: -- The Authority may evolve its own mechanism for monitoring of effective abatement of pollution and rejuvenation of the river Ganga and issue directions thereof, under Section 5 of the said Act, for the said purpose.
7. Corpus of Authority: -- There shall be a corpus of funds provided by the Central Government for implementing such projects, programmes and other activities as may be decided by the Authority.
8. Administrative and technical support to Authority: -- (1) The Authority shall be provided administrative and technical support by Central Government in the Ministry of Water Resources, River Development and Ganga Rejuvenation which shall be the nodal Ministry.
(2) The Authority may evolve an appropriate mechanism for implementation of its decisions.
9. Constitution of State River Conservation Authorities :-- The State Governments concerned shall constitute a State Ganga River Conservation Authority under the Chairmanship of the Chief Minister with such composition and such powers as it deems fit, for co-operating, co-ordinating and implementing the river rejuvenation activities at the State level.
10. Comprehensive management in the State: -- Based on the integrated basin management plan drawn and decisions taken by the National Ganga River Basin Authority, the State Governments shall take steps for comprehensive management of the river in the States through their respective Authorities.
