(v) of sub-section (2) of section (3) of the Environment (Protection) Act, 1986 read with clause (d) of sub-rule
(3) of rule 5 of die Environment (Protection) Rules, 1986, die Central Government directed that on or from the dates of its publication, the required construction of new projects or activities or the expansion or modernization of existing projects or activities listed in the Schedule to the said notification entailing the capacity addition with change in process and or technology shall be undertaken in any part of India only after prior environmental clearance from the Central Government or as die case may be, by the State Level Environment Impact Assessment Authority, duly constituted by the Central Government under sub-section
(3) of section 3 of the said Act in accordance widi die procedure specified therein;
[*qn 3tii>] 'Ulld JJ d ,J.d : 3WcTn?T[ And whereas the Hon'ble Principal Bench of National Green Tribunal vide its order in Appeal No. 05 of 2014. dated 27,h May. 2014. in the matter of M/s. Ardent Steel Limited, Orissa vs. Union of India, held that pelletization plants are covered tinder the Environment Impact Assessment Notification. 2006 and should take prior Environment Clearance and had given one year time for obtaining such clearance to the existing pelletization plants:
And whereas a number of representations have been received from the pellet manufacturers seeking exemption from public consultation for obtaining Environment Clearance since they are already operating standalone pelletization plants and to mitigate undue hardships it has been decided to allow the Pelletization plants to exempt from the process of undertaking public consultation:
And whereas clause (a) of sub-rule (3) of rule 5 of the said Environment (Protection) Rules provides that, whenever the Central Government considers that prohibition or restrictions of any industry or carrying on any processes or operation in any area should be imposed, it shall give notice of its intention to do so:
And whereas sub-rule (4) of rule 5 of the said Environment (Protection) Rules. 1986 provides that, notwithstanding anything contained in sub-rule (3). whenever it appears to the Central Government that it ls in public interest to do so. it may dispense with the requirement of notice under clause (a.) of sub-rule (3):
Now therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section
(2) of section 3 of the said Environment (Protection) Act. 1986 read with clause (d) of sub-rule (3) of rule 5 of the said Environment Protection Rules. 1986 the Central Government hereby makes the following further amendments in the said notification, namely:— In the said Notification, in paragraph 7. in sub-paragraph III relating to Stage (3»-Public Consultation.
m clause < i >. al ter sub-clause <g>. the following sub-clause shall be inserted, namely:— ■'(h» all standalone pelletization plants, which were in existence and in operation on or before the 27" da\ of Max. 2014 and have xalid consent to establish and consent to operate from rhe concerned State Pollution Control Board or the Union Territory Pollution Control Committee.”.
