और ईपीसीए का गठन पर्ाावरण की गुणवत् ता सुरजित करने और सुधारन ेतथा राष्ट रीर् रािधानी िेत्र में पर्ाावरणीर् प्रदषूण को जनवाररत और जनर्ंजत्रत करने के उदे्दश् र् के साथ दकर्ा गर्ा था;

और ईपीसीए का कार्ाकाल 30 मािा, 2020 को समाप् त हो गर्ा ह;ै अत: अब केन्द रीर् सरकार, पर्ाावरण (संरिण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूिना में इसके पश् िात उक् त अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1) और उपधारा (3) द्वारा प्रदत् त िजिर्ों का प्रर्ोग करते हुए और पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् में भारत सरकार की अजधसूिना सं. 382 (अ), तारीख 27 िनवरी, 2020 का, उन बातों के जसवार् अजधक्ांत करते हुए, जिन्द हें ऐसे अजधक्मण से पूवा दकर्ा गर्ा ह ै र्ा करने का लोप दकर्ा गर्ा ह,ै जनम् नजलजखत व् र्जिर्ों से र्ुक् त पर्ाावरण प्रदषूण (जनवारण और जनर्ंत्रण) प्राजधकरण का पुनगाठन करती ह,ै नामत: :—

2. ईपीसीए, जनम् नजलजखत िजिर्ों का प्रर्ोग करेगा और पर्ाावरण की क् वाजलटी की संरिा और सुधार के जलए तथा पर्ाावरणीर् प्रदषूण के जनवारण, जनर्ंत्रण और उपिमन के जलए जनम् नजलजखत कार्ा करेगा, नामत: :- दकसी प्राजधकारी के आदिे के अजतक्मण से संबंजधत पररवाद की बाबत र्ा जनम् नजलजखत से संबंजधत जवजनर्दाष्ट ट उपार्ों के जलए जनददेशि िारी करने के जलए उक् त अजधजनर्म की धारा 5 के अधीन िजिर्ों का प्रर्ोग करेगा — [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 i. पर्ाावरण के जवजभन्द न आर्ामों के संबंध में उसकी गुणवत् ता के जलए मानक;
ii. जवजभ न्द न ्ोतों से पर्ाावरणीर् प्रदषूकों के उत् सिान र्ा जनस्ट् सारण के जलए मानक;
iii. उन िेत्रों का जनबंधन, जिनमें कोई उद्योग, उद्योगों के वगा की संदक्र्ाए ं र्ा प्रसंस्ट् करण र्ा प्रसंस्ट् करण नह िलाए िाएगें र्ा कु रिोपार्ों के अधीन रहते हुए िलाए िाएगें;
iv. ऐसी दघुाटनाए ंजिनसे पर्ाावरणीर् प्रदषूण होता ह,ै की रोकथाम के जलर्े प्रदक्र्ाए ं व सुरिा के उपार् तथा ऐसी दघुाटनाओं के जलर्े उपिारात् मक उपार्;
v. खतरनाक पदाथों के रखरखाव के जलए प्रदक्र्ाए ंऔर सुरिोपार्। ऊपर वर्णात जवषर्ों को स्ट् वपे्ररणा र्ा पर्ाावरण के िेत्र में कार्ा कर रह े दकसी व् र्जिक, प्रजतजनजध जनकार् र्ा संगठन द्वारा दकए गए पररवाद के आधार पर उठाने की िजि होगी और ऐसे पररवाद कोई उद्योग, सदंक्र्ा र्ा प्रसंस्ट् करण िला रह ेदकसी व् र्जिक, संघ, कंपनी, पजललक उपक्म र्ा स्ट् थानीर् जनकार् के जवरूध ह हो सकें गे।
3. ईपीसीए, वाहन प्रदषूण का जनर्ंत्रण करन े के जलए र्ानों द्वारा जवजनर्दाष्ट ट उत् सिान मानकों की अनुपालना सुजनजित करने के जलए सभी आवश् र्क कदम उठाएगा, जिनके अंतगात र्ानों के प्रदषूण की िािं के जलए उपस्ट् कर का उजित अंिांकन, ईंधन क् वाजलटी मानकों का अनुपालन सुजनजित करना, र्ातार्ात जनर्ोिन और प्रबंधन के जलए जनगरानी और समन्द वर् करने का कार्ा सजम्मजलत ह।ै
4. ईपीसीए को जवजनर्दाष्ट ट पररवेिी ध् वजन मानकों का अनुरिण सुजनजित करन े के जलए उक् त अजधजनर्म की धारा 5 के अधीन जनदिे दनेे की िजि होगी, जिसके अंतगात ध् वजन का उत् सिान करने वाल े दकसी उद्योग, प्रसंस्ट् करण र्ा संदक्र्ा पर पाबंदी लगाना र्ा जनबंजधत करना सजम्मजलत ह।ै
5. ईपीसीए, राष्ट रीर् रािधानी िेत्र से संबंजधत पर्ाावरणीर् मुद्दों पर, िो उस े कें र सरकार द्वारा जनर्दाष्ट ट दकए िाए,ं कारावाई करेगा।
6. ईपीसीए, इस आदिे के पैरा 2 के अधीन की िान ेवाली कोई कारावाई के बाबत उक् त अजधजनर्म की धारा 10 के अधीन प्रवेि, जनरीिण, तलािी और अजभग्रहण करने की िजिर्ों का प्रर्ोग करेगा।
7. ईपीसीए, इस आदिे के पैरा 2 के अधीन की िाने वाली दकसी भी कारावाई के बाबत उक् त अजधजनर्म की धारा 11 के अधीन नमूना लेने की िजि का प्रर्ोग करेगा।
8. ईपीसीए, उक् त अजधजनर्म के अधीन अपराधों के जवरूध ह पररवाद करने के जलए और इस आदिे के पैरा 2 के अधीन उसके द्वारा िारी दकए गए जनदिेों की अनुपालना न करने के जलए उक् त अजधजनर्म की धारा 19 के अधीन िजिर्ों का प्रर्ोग करेगा।
9. ईपीसीए को राष्ट रीर् रािधानी िेत्र र्ोिना बोडा अजधजनर्म, 1985 (1985 का 2) की धारा 2 के खंड (ि) में र्थापररभाजषत राष्ट रीर् रािधानी िेत्र पर अजध काररता होगी।
10. ईपीसीए की पूवागामी िजिर्ााँ और कार्ा, संपूणात: कें रीर् सरकार के अधीिण और जनर्ंत्रण के अधीन होंगे।
11. ईपीसीए का कार्ाकाल 30 जसतम् बर, 2020 तक होगा।
12. ईपीसीए, अपने दक्र्ाकलापों के बारे में एक प्रगजत ररपोटा महीने में एक बार कें रीर् सरकार को दगेा।
13. ईपीसीए का मुख् र्ालर् राष्ट रीर् रािधानी िेत्र में होगा।
14. सदस्ट् र् सजिव, अध् र्ि के अनमुोदन से ईपीसीए की बैठकें आर्ोजित करेगा। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
15. ईपीसीए की बैठक आर्ोजित करने और दकसी जनणार् तक पहुिंने के जलए इसके सदस्ट् र्ों के एक- जतहाई की न्द र्ूनतम गणपूर्ता होगी।
16. ईपीसीए की ओर स ेसभी पत्रािार, अध् र्ि के अनुमोदन से सदस्ट् र् सजिव के माध् र्म से र्ा इस प्रर्ोिन से जवजिष्ट ट रूप से प्राजधकृत दकसी अजधकारी के माध् र्म से दकर्ा िाएगा। [फा. सं. क् र्-ू18011/13/2000-सीपीए (पाटा.)] अरजवन्द द कुमार नौरटर्ाल, संर्ुक् त सजिव MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE ORDER New Delhi, the 5th August, 2020 S.O. 2587(E).— Whereas in pursuance of the order dated the 7 th January, 1998 of the Hon’ble Supreme Court in Writ Petition (C) No. 13029 of 1985, the Central Government constituted the Environment Pollution (Prevention and Control) Authority (hereafter in this notification referred to as the ‘EPCA’), vide notification of the Government of India, in the erstwhile Ministry of Environment and Forests, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 93(E), dated the 29 th January, 1998 and this notification was superseded vide notification of the Government of India, in the Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 5120(E), dated the 3 rd October, 2018;
And whereas, the EPCA was constituted with the objective of protecting and improving the quality of the environment and preventing and controlling the environmental pollution in the National Capital Region;
And whereas, the EPCA is assisting the Hon’ble Supreme Court in various environment related matters in the National Capital Region in terms of the aforesaid notification number S.O.
5120(E), dated the 3 rd October, 2018;
And whereas, the tenure of the EPCA was extended from time to time by the Central Government and lastly it was extended up to the 30 th August, 2019 vide notification of the Government of India, in the Ministry of Environment, Forests and Climate Change, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 2522(E), dated the 15 th July, 2019;
And whereas, the tenure of the EPCA expired on the 30 th March,2020;
Now, therefore, in exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the said Act), and in supersession of the notification of the Government of India, in the Ministry of Environment, Forest and Climate change number S.O. 382(E), dated the 27 th January, 2020, except as respects things done or omitted to be done before such supersession, the Central Government hereby re-constitutes the Environment Pollution (Prevention and Control) Authority, consisting of the following persons, namely:-

2. The EPCA shall exercise the following powers and discharge the following functions for protecting and improving the quality of the environment and preventing, controlling and abating environmental pollution, namely: -
(a) the powers under section 5 of the said Act for issuing directions in respect of complaints relating to the violation of an order by any authority or measure specified pertaining to—
(i) standards for the quality of the environment in its various aspects;
(ii) standards for emission or discharge of environmental pollutants from various sources;
(iii) restriction of areas in which any industries, operations or processes of class of industries or process shall not be carried out or shall be carried out subject to certain safeguards;
(iv) procedures and safeguards for the prevention of accidents which may cause environmental pollution and remedial measures for such accidents;
(v) procedures and safeguards for the handling of hazardous substances;
(b) the power to take up matters as mentioned above, suo-motu, or on the basis of complaints made by any individual, representative body or organisation functioning in the field of environment and such complaints may be against any individual, association, company, public undertaking or local body carrying on any industry, operation or process.
3. The EPCA shall, for controlling vehicular pollution, take all necessary steps to ensure compliance of specified emission standards by vehicles including proper calibration of the equipment for testing vehicular pollution, ensuring compliance of fuel quality standards, monitoring and coordinating action for traffic planning and management.
4. The EPCA shall, for ensuring maintenance of the prescribed ambient noise standards, have the power to issue directions under section 5 of the said Act, including banning or restricting any industry, process or operation emitting noise.
5. The EPCA shall deal with environmental issues pertaining to the National Capital Region which may be referred to it by the Central Government.

6. The EPCA shall exercise the powers of entry, inspection, search and seizure under section 10 of the said Act, in respect of any action to be taken under paragraph 2.
7. The EPCA shall exercise the power to take samples under section 11 of the said Act, in respect of any action to be taken under paragraph 2.
8. The EPCA shall exercise the powers under section 19 of the said Act, for making complaints against offences under the said Act and for non-compliance of directions issued by it under paragraph 2.
9. The EPCA shall have jurisdiction over the National Capital Region as defined in clause (f) of section 2 of the National Capital Region Planning Board Act, 1985 (2 of 1985).
10. The foregoing powers and functions of the EPCA shall be subject to the supervision and control of the Central Government.
11. The tenure of the EPCA shall be till the 30 th September, 2020.
12. The EPCA shall furnish a progress report about its activities once in a month to the Central Government.
13. The EPCA shall have its headquarters in the National Capital Region.
14. The Member Secretary shall organise meetings of the EPCA with the approval of the Chairman.
15. A minimum quorum of one third of the members shall be observed for holding a meeting of the EPCA and for arriving at any decision.
16. All correspondence on behalf of the EPCA may be made with the approval of Chairman through the Member Secretary or through any officer specifically authorised in this behalf.
