PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 2284] No. 2284] NEW DELHI, FRIDAY, AUGUST 11, 2017/SRAVANA 20, 1939 पर्यावरण, वन और जलवयर् ुपररवर्ान मतं्रयलर् अधिसचूनय नई दिल्ली, 11 अगस्र्, 2017 कय.आ.2605(अ).—भयरर् सरकयर, पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय. आ. 4109 (अ) र्यरीख 21 दिसम्बर, 2016 द्वयरय उन सभी व्यधिर्ों से, धजनके उससे प्रभयधवर् होने की संभयवनय थी, उस र्यरीख से, धजसको उस रयजपत्र की प्रधर्र्यं, धजसमें र्ह अधिसूचनय अंर्र्वाष्ट ह,ै उपलब्ि करय िी गई थी, सयठ दिन की अवधि के भीर्र आक्षेप और सुक्षयव आमंधत्रर् करर्े हुए एक प्रयरुप अधिसूचनय प्रकयधिर् की गई थी;
और, उि प्रयरुप अधिसूचनय अन्र्र्वाष्ट करने वयले रयजपत्र की प्रधर्र्यं जनर्य को र्यरीख 21 दिसम्बर, 2016 को उपलब्ि करय िी गई थी;
और, उि प्रयरुप अधिसूचनय के प्रत्र्ुत्तर में सभी व्यधिर्ों और पणियररर्ों से कोई आक्षेप और सुझयव प्रयप्त नहीं हुए है;
और, रयर्यपयनी और ससंघोरी वन्र्जीव अभर्यरण्र् मध्र् प्रििे रयज्र् में रयर्सेन धजलय में अवधस्थर् ह ैजो क्षेत्र के 1201.29 वगा दकलोमीटर में फैलय हुआ है;
और, रयर्यपयनी और ससंघोरी वन्र्जीव अभर्यरण् र् में प्रचुर वनस् पधर् और जीव जन्र्ु और स्थयधनक प्रजयधर्र्ों की सं्र्य कय आवयस ह ै। रयर्यपयनी और ससंघोरी वन्र्जीव अभर्यरण् र् में प्रचुर जैव धवधविर्य ह ै। इस वन्र्जीव क्षेत्रों के अंर्गार् अिा िुष्क वन्र्जीव जोन-IVख गुजरयर् रयजपूर्यनय, रोजर और पवयर वगीकरण के अंर्गार् वगीकृर् ह ै। इस अभर्यरण्र् में क्षेत्र के सभी सयमयन्र् पिु बसे हुए ह ैजैसे मयंसयहयरी के बीच बयघ (पैंथरय रटगररस), र्ेंिआु (पैंथरय पयरडस), भेध़िर्य (कैधनस लूपस), धसर्यर (कैधनस औरेर्स), भयरर्ीर् लोम़िी (वुलपेस बेंगयलेधनधसस), धचत्तीियर लक़िबग्घय (हरे्नय हरे्नय), रीछ (मेलोरस र्ूधसनस) और ियकयहयरी के बीच धचत्तीियर धहरण (एधससस एधससस), सयंभर (के्रवस र्ूधनकलर), नील गयर् (बोसेलफस टे्रगोकैसलस), सचंकयरय (गैजेलय गैजेले बेन्नेटी), बनैलय सूअर (सस स्क्रोफय), चौससंगय (टेट्रयधसरस क्वयरधडकोधनस) और कयलय धहरण (एधन्टलोप कयरवीकयपरय) हैं । इसके अलयवय, रयर्यपयनी और ससंघोरी वन्र्जीव अभर्यरण् र् में मगरम्छघघध़िर्यल भी दिखयई िरे्े ह ै। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, रयर्यपयनी और ससंघोरी वन्र्जीव अभर्यरण् र् में 129 वृक्षों की प्रजयधर्र्यं, 73 ज़िी बूरटर्ों और झयध़िर्ों की प्रजयधर्र्यं, 33 पवार्रोधहर्ों और परजीवी की प्रजयधर्र्यं, 35 घयसों और बयंस की प्रजयधर्र्यं, 35 स्र्नियरी, 205 पधक्षर्ों, 14 मछली, 33 सरीसृपों और 10 उभर्चरों की प्रजयधर्र्यं अधभधलधखर् ह ै। और, रयर्यपयनी और ससंघोरी वन्र्जीव अभर्यरण् र् के चयरों रर के क्षेत्र को, धजसकय धवस्र्यर और सीमयएं इस अधिसूचनय के पैरय 1 में धवधनर्िाष्ट हैं, पर्यावरण की िधृष्ट से पयररधस्थधर्क संवेिी जोन के रूप में सुरधक्षर् और संरधक्षर् करनय र्थय उि पयररधस्थधर्क संवेिी जोन में उद्योगों र्य उद्योगों के वगो के प्रचयलन र्थय प्रसंस्करण करने को प्रधर्धिद्ध करनय आवश्र्क ह;ै और अर्ः अब, केन्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के सयथ परठर् पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (1), उपियरय (2) के खंड (v) और खंड (xiv) और उपियरय (3) द्वयरय प्रित्त िधिर्ों कय प्रर्ोग करर्े हुए, रयर्यपयनी और ससंघोरी वन्र्जीव अभर्यरण् र् की सीमय एक दकलोमीटर र्क के धवस्र्यररर् क्षेत्र को रयर्यपयनी और ससंघोरी वन्र्जीव अभर्यरण् र् पयररधस् थधर्क संवेिी जोन (धजसे इसमें इसके पश् चयर्प पयररधस् थधर्क संवेिी जोन कहय गर्य ह)ै के रूप में अधिसूधचर् करर्ी है, धजसकय ब्र्ौरय धनम्नयनुसयर ह,ै अथयार्प :--
1. पयररधस्थधर्क संविेी जोन कय धवस्र्यर और उसकी सीमयएं--(1) पयररधस् थधर्क संवेिी जोन कय धवस् र्यर, रयर्यपयनी और ससंघोरी वन्र्जीव अभर्यरण् र् की सीमय से 1 दकलोमीटर र्क और पररवेि िो दकलोमीटर र्क ह।ै पयररधस्थधर्क संवेिी जोन कय क्षेत्र 546.52 वगा दकलोमीटर ह ै। वन्र्जीव अभर्यरण्र् और पयररधस्थधर्क संवेिी जोन के धनििेयंकों को क्रमि: उपयबिं- I और II में दिर्य गर्य ह।ै
(2) उि पयररधस्थधर्क संवेिी जोन के अंर्गार् आने वयले धनििेयंकों और 72 ग्रयमों की सूची उपयबिं-III के रूप में उपयबद्ध ह ै।
(3) अक्षयंि और ििेयंर्र और सीमय वणान के सयथ पयररधस्थधर्क संवेिी जोन कय मयनधचत्र उपयबंि- IV के रूप में उपयबद्ध है ।
2. पयररधस्थधर्क सवंेिी जोन के धलए आचंधलक महयर्ोजनय – (1) रयज्र् सरकयर, पयररधस् थधर्क संवेिी जोन के धलए रयजपत्र में अंधर्म अधिसूचनय के प्रकयिन की र्यरीख से िो विा की अवधि के भीर्र, स्थयनीर् व्यधिर्ों के परयमिा से और इस अधिसूचनय में सलंग् न अनबुंिों के सयमंजस् र् से आंचधलक महयर्ोजनय र्ैर्यर करेगी ।
(2) रयज्र् सरकयर द्वयरय पयररधस् थधर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय इस र्रह, इस अधिसूचनय में धवधनर्िाष् ट रूप र्थय सुसंगर् कें रीर् और रयज् र् धवधिर्ों के सयमंजस् र् और कें रीर् सरकयर द्वयरय जयरी मयगाधनििेों, र्दि कोई हों, द्वयरय र्ैर्यर होगी ।
(3) आंचधलक महयर्ोजनय, पर्यावरणीर् और पयररधस्थधर्क धवचयरों को समयकधलर् करने के धलए रयज् र् सरकयर के सभी सबंद्ध धवभयगों के परयमिा से र्ैर्यर होगी, अथयार्प:--
(i) पर्यावरण;
(ii) वन और वन्र्जीव;
(iii) कृधि और बयगवयनी;
(iv) रयजस् व;
(v) िहरी धवकयस;
(vi) पर्ाटन सधहर् पर्यावरण पर्ाटन;
(vii) ग्रयमीण धवकयस;
(viii) ससंचयई और बयढ़ धनर्ंत्रण;
(ix) नगरपयधलक और िहरी धवकयस;
(x) पंचयर्र्ी रयज; और
(xi) लोक धन मयाण धव भयग। II (ii) 3
(4) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन भू-उपर्ोग, अवसंरचनय और दक्रर्यकलयपों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय में धवधनर्िाष् ट न हो और आचंधलक महयर्ोजनय सभी अवसंरचनय और दक्रर्यकलयपों में और अधिक िक्षर्य और पयररधस्थधर्क अनुकूलर्य कय संविान करेगी ।
(5) आंचधलक महयर्ोजनय में अनय्छयदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल- संभरों के प्रबंिन, भूर्ल जल के प्रबंिन, मृिय और नमी संरक्षण, स्थयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधस्थधर्क और पर्यावरण से संबंधिर् ऐसे अन्र् पहलूओं, धजन पर ध्र्यन िनेय आवश्र्क है, के धलए उपबंि होंगे ।
(6) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय स् थलों, ग्रयमों और िहरी बंिोबस्र्ों, वनों के प्रकयर और दकस् मों, कृधि क्षते्रों, ऊपजयऊ भूधम, हररर् क्षेत्र जैसे उद्ययन और उसी प्रकयर के स् थयन, उद्ययन कृधि क्षेत्र, फलोउद्ययन, झीलों और अन्र् जल धनकयर्ों कय अभ्र्कंन करेगी। इस र्ोजनय के मयनधचत्र द्वयरय धवद्यमयन और प्रस्र्यधवर् भूधम के उपर्ोग कय भी धववरण दकर्य जयएगय ।
(7) आंचधलक महयर्ोजनय स् थयनीर् समुियर्ों की जीवकोपयजान को सुधनधश् चर् करने के धलए भी पयररधस्थधर्क संवेिी जोन में धवकयस को पयररधस्थधर्क अनुकूल धवकयस के धलए सयरणी के सूचीबद्ध दक्रर्यकलयप धवधनर्धमर् करेगी ।
(8) आंचधलक महयर्ोजनय क्षेत्रीर् धवकयस र्ोजनय के सयथ सह-अंर्क होगी ।
(9) आंचधलक महयर्ोजनय इस अधिसूचनय में दिए गए उपबंिों के अनुसयर में अपने कृत्र्ों के दक्रर्यन्वर्न के धलए धनगरयनी सधमधर् के धलए ऐसय अनुमोदिर् एक संिभा िस्र्यवेज र्ैर्यर करेगी ।
3. रयज्र् सरकयर द्वयरय दकए जयन ेवयल ेउपयर्-- रयज्र् सरकयर, इस अधिसूचनय के उपबंिों को प्रभयवी करने के धलए धनम्नधलधखर् उपयर् करेगी, अथयार्प:--
(1) भ-ूउपर्ोग – (क) पयररधस् थधर्क संवेिी जोन में वनों, उद्ययन-कृधि क्षेत्रों, कृधि क्षेत्रों, आमोि-प्रमोि के प्रर्ोजन के धलए धचधन्हर् दकए गए पयकों और खुले स्थयनों कय वयधणधज्र्क और औद्योधगक संबद्ध धवकयस दक्रर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय।:
परंर्ु पयररधस्थधर्क संवेिी जोन के भीर्र भयग (क) में धवधनर्िाष्ट प्रर्ोजन से धभन्न प्रर्ोजन के धलए कृधि और अन्र् भूधम कय संपररवर्ान धनगरयनी सधमधर् की धसफयररि पर और र्थय लयगू और क्षेत्रीर् नगर र्ोजनय अधिधनर्म र्थय केन्रीर्घरयज्र् सरकयर के अन्र् धनर्मों र्थय धवधनर्मों के अिीन सक्षम प्रयधिकयरी के पूवा अनुमोिन से, र्थय इस अधिसूचनय के उपबंिों द्वयरय स्थयनीर् धनवयधसर्ों की धनम्नधलधखर् आवयसीर् जरूरर्ों को पूरय करने के धलए अनुज्ञयर् दकर्य जयएगय, जैसे:-
(i) धवद्यमयन स़िकों को चौ़िय करनय और उन्हें सुिढृ करनय र्थय नई स़िकों कय संधनमयाण;
(ii) बुधनर्यिी ढयंचों और नयगररक सुधवियओं कय संधनमयाण और नवीकरण;
(iii) प्रििूण उत्पन्न न करने वयले लघु उद्योग;
(iv) कुटीर उद्योगों धजसके अंर्गार् ग्रयमीण कयरीगर हैं; सुधवियजनक भण्डयर और स्थयनीर् सुधवियओं सहयर्क पयररधस्थधर्क पर्ाटन में सधम्मधलर् गृह वयस; और
(v) संवर्िार् दक्रर्यकलयप और अनु्छेि 4 के अंर्गार् दिर्य गर्य ह:ै परंर्ु र्ह और भी दकसी जनजयर्ीर् भूधम कय उपर्ोग रयज्र् सरकयर के संबद्ध रयज्र् धवधिर्ों और अन्र् धनर्मों र्थय धवधनर्मों के अिीन सक्षम प्रयधिकयरी के पूवा अनुमोिन र्थय संधवियन के अनु्छेि 244 प्रवृत्त धवधि के उपबिंों के अनुपयलन के धबनय, र्य र्त्समर् प्रवतृ्त धवधि धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै वयधणधज्र्क र्य उद्योग धवकयस दक्रर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय:
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंर्ु र्ह और भी दक पयररधस् थधर्क संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई त्रुरट, धनगरयनी सधमधर् के धवचयर प्रयप्त करने के पश्चयर्प रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमले में एक बयर संिोधिर् होगी और उि त्रुरट के संिोिन की सूचनय कें रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को िनेी होगी । परंर्ु र्ह और भी दक उपर्ुाि त्रुरट कय संिोिन में इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी ििय में भू-उपर्ोग कय पररवर्ान सधम्मधलर् नहीं होगय। (ख) वनीकरण र्थय वयस जीणोद्धयर दक्रर्यकलयपों सधहर् अनप्रर्ुस र् र्य अनुत् पयिक कृधि क्षेत्रों में पुन: वनीकरण करने के प्रर्यस दकए जयएंगे ।
(2) प्रयकृधर्क जल स्रोर् -- आचंधलक महयर्ोजनय में सभी प्रयकृधर्क जल स्रोर्ोंघनदिर्ोंघ चैनलों की पहचयन की जयएगी और उनके संरक्षण और पुनरुद्भूर्करण के धलए र्ोजनय सधम् मधलर् होगी।
(3) पर्ाटनघपयररधस्थधर्क-पर्ाटन – (क) पयररधस्थधर्क संवेिी जोन के भीर्र पर्ाटन संबंिी दक्रर्यकलयप पर्ाटन महयर्ोजनय के अनसुयर होंग े जो दक आंचधलक महयर्ोजनय के भयग रूप में होगी । (ख) पयररधस्थधर्क पर्ाटन महयर्ोजनय, पर्यावरण और वन के रयज्र् धवभयगों के परयमिा , पर्ाटन धवभयग द्वयरय र्ैर्यर दकर्य जयएगय । (ग) पर्ाटन महयर्ोजनय आंचधलक महयर्ोजनय के एक घटक के रूप में जयनय जयर्ेगय । (घ) पर्ाटन संबंिी दक्रर्यकलयप धनम् नधलधखर् के अिीन धवधनर्धमर् होंगे, अथयार्प :-
(i) वन्र्जीव अभर्रयण्र् की सीमय से 1 दकलोमीटर के भीर्र र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क, जो भी धनकट हो, दकसी होटल र्य ररसोटा कय नर्य संधन्नमयाण अनुज्ञयर् नहीं दकर्य जयएगय । र्थयधप, वन्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीटर की िरूी से परे पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क नए होटलों और ररसोटों की स्थयपनय पर्ाटन महयर्ोजनय के अनुसयर पयररधस्थधर्क पर्ाटन सुधवियओं के धलए पूवा सीमयंदकर् और पियधभधहर् क्षेत्रों में ही अनुज्ञयर् की जयएगी;
(ii) पयररधस्थधर्क संवेिी जोन के भीर्र सभी नए पर्ाटन दक्रर्यकलयपों र्य धवद्यमयन पर्ाटन दक्रर्यकलयपों कय धवस्र्यर कें रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् के मयगाििाक धसद्धयंर्ों के द्वयरय र्थय रयष् ट्रीर् ा र्यघ्र स संरक्षण प्रयधिकरण, द्वयरय जयरी पयररधस्थधर्क पर्ाटन (समर्-समर् पर र्थय संिोधिर्) मयगाििाक धसद्धयंर्ों के अनुसयर, पयररधस्थधर्क पर्ाटन, पयररधस्थधर्क धिक्षय और पयररधस्थधर्क धवकयस को महत्व िरे्े हुए पयररधस्थधर्क संवेिी जोन की वहन क्षमर्य के अध्र्र्न पर आियररर् होगय;
(iii) जब र्क आंचधलक महयर्ोजनय कय अनुमोिन नहीं कर दिर्य जयर्य ह ैजब र्क पर्ाटन संबंिी धवकयस र्थय धवद्यमयन पर्ाटन दक्रर्यकलयपों कय धवस्र्यर धनगरयनी सधमधर् के वयस्र्धवक स्थल धवधनर्िाष्ट संवीक्षय र्थय धसफयररि के आियर पर सम्बंधिर् धवधनर्यमक प्रयधिकयरी द्वयरय अनुज्ञयर् दकर्य जयएगय और पयररधस्थधर्क संवेिी जोन क्षेत्र के भीर्र कोई नर्य होटलघररसोटा र्य वयधणधज्र्क स्थयपन कय संधन्नमयाण अनुज्ञयर् नहीं दकर्य जयर्य है ।
(4) नसैर्गाक धवरयसर्- पयररधस्थधर्क संवेिी जोन में महत्वपूणा नैसर्गाक धवरयसर् के सभी स्थलों जैसे सभी जीन कोि आरधक्षर् क्षेत्र, िैल धवरचनयएं, जल प्रपयर्ों, झरनों, घयटी मयगों, उपवनों, गुफयएं, स्थलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और धवरयसर् संरक्षण र्ोजनय आंचधलक महयर्ोजनय के भयग के रुप में परररक्षण और संपका के धलए र्ैर्यर करेगी ।
(5) मयनव धनर्मार् धवरयसर् स् थल - पयररधस् थधर्क संवेिी जोन में भवनों, संरचनयओं, धिल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंस्कृधर्क महत्व के क्षेत्रों की पहचयन करनी होगी और उनके संरक्षण की र्ोजनयएं र्ैर्यर करनी होगी र्थय आंचधलक महयर्ोजनय में भयग होगी ।
(6) ध् वधन प्रििूण – पयररधस्थधर्क संवेिी जोन में धनवयरण और ध्वधन प्रििूण धनर्ंत्रण पर्यावरण (संरक्षण) अधिधनर्म, 1986 के अिीन ध्वधन (धवधनर्मन और धनर्ंत्रण) धनर्म 2000 के अनुसयर संकधलर् दकर्य जयएगय ।
(7) वयर् ुप्रििूण - पयररधस्थधर्क संवेिी जोन में धनवयरण और धनर्तं्रण, वयर्ु (प्रििूण धनवयरण और धनर्ंत्रण) अधिधनर्म 1981 (1981 कय 14) और इसके अिीन दकए गए धनर्मों के अनुसयर संकधलर् दकर्य जयएगय । II (ii) 5
(8) बधहस्रयव कय धनस्सयरण -- पयररधस्थधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनस्सयरण सयियरण मयनकों के धलए पर्यावरणीर् प्रिधूिर् आ्छयदिर् के धनस्सयरण के अंर्गार् पर्यावरणीर् (संरक्षण) अधिधनर्म, 1986 और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर होगय।
(9) ठोस अपधिष्ट - ठोस अपधिष्टों कय धनपटयन और प्रबंिन धनम्नधलधखर् रूप में होगय-- (क)पयररधस्थधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनस्सयरण, समर्-समर् पर संिोधिर् ठोस अपधिष् ट प्रबंिन धनर्म, 2016, जो भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय.आ. 1357(अ) र्यरीख 8 अप्रैल, 2016 द्वयरय प्रकयधिर् दकए गए थे, के उपबंिों के अनुसयर दकर्य जयएगय ;
अकयबाधनक सयमग्री कय धनपटयन पयररधस्थधर्क संवेिी जोन के बयहर पहचयन दकए गए स् थल पर दकसी पर्यावरणीर् स्वीकयर्ा रीधर् में होगय;
(ख) पयररधस्थधर्क संवेिी जोन के अंर्गार् जैव-धचदकत्सय अपधिष्टों के सुरधक्षर् और पर्यावरणीर् ध्वधन प्रबंिन (ईएसएम) की पहचयन की गई र्कनीकों के उपर्ोग की धवद्यमयन धनर्मों और धवधनर्मों के अनुरूप अनुज्ञय िी जयएगी।
(10) जैव धचदकत् सीर् अपधिष् ट.-जैव धचदकत् सीर् अपधिष् ट प्रबंिन धनम्नधलधखर् रूप में होगय— (क) पयररधस्थधर्क संवेिी जोन में जैव धचदकत्सीर् अपधिष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मतं्रयलर् की अधिसूचनय सं.कय.धन 343 (अ), र्यरीख 28 मयचा 2016 द्वयरय प्रकयधिर् जैव धचदकत्सीर् अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय । (ख) पयररधस्थधर्क संवेिी जोन के अंर्गार् जैव-धचदकत्सय अपधिष्टों के सुरधक्षर् और पर्यावरणीर् ध्वधन प्रबंिन (ईएसएम) की पहचयन की गई र्कनीकों के उपर्ोग की धवद्यमयन धनर्मों और धवधनर्मों के अनुरूप अनुज्ञय िी जयएगी।
(11) प्लयधस्टक अपधिष्ट प्रबिंन: - पयररधस्थधर्क संवेिी जोन में प्लयधस्टक अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 340(अ), र्यरीख 18 मयचा, 2016 द्वयरय प्रकयधिर् प्लयधस्टक अपधिष्ट प्रबंि धनर्म 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(12) धनमयाण और धवध्वसं अपधिष्ट प्रबंिन: - पयररधस्थधर्क संवेिी जोन में संधनमयाण और धवध्वंस अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 317(अ), र्यरीख 29 मयचा, 2016 द्वयरय प्रकयधिर् संधनमयाण और धवध्वंस प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(13) ई–अपधिष्ट:- पयररधस्थधर्क संवेिी जोन में ई–अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् द्वयरय प्रकयधिर् ई–अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(14) र्यनीर् पररवहन: - पररवहन की र्यनीर् गधर्धवधिर्य ंआवयस के अनुकूल धवधनर्धमर् होंगी और इस संबंि में आंचधलक महयर्ोजनय में धविेि उपबंि धनर्धमर् दकए जयएंगे और आंचधलक महयर्ोजनय के र्ैर्यर होने और रयज्र् सरकयर के सक्षम प्रयधिकयरी द्वयरय के अनुमोदिर् होने र्क, धनगरयनी सधमधर् प्रवृत्त धनर्मों और धवधनर्मों के अनुसयर र्यनीर् गधर्धवधिर्ों के अनुपयलन को धनगरयनी करेगी ।
(15) र्यनीर् प्रििूण:- धवधिर्ों के अनुसयर वयहन प्रििूण की धनवयरण और धनर्ंत्रण कय अनुपयलन दकर्य जयएगय। स्व्छक ईंिन के उपर्ोग के धलए दकए गए प्रर्यस उियहरण के धलए सीएनजी, एलपीजी, आदि हैं ।
(16) औद्योधगक ईकयइर्य:ं - (i) रयजपत्र में इस अधिसूचनय के प्रकयिन के पश्चयर् र्य प्रकयिन में, पयररधस्थधर्क संवेिी जोन के भीर्र कोई नए प्रिधूिर् उद्योगों की स्थयपनय की अनुज्ञय नहीं िी जयएगी।
(ii) केवल गैर प्रििूण उद्योग, फरवरी, 2016 में जयरी मयगाििाक धसद्धयंर् में उद्योगों के वगीकरण अनुज्ञय िी जयएगी जब र्क इस अधिसूचनय में धवधनर्िाष्ट न हो और इसके अधर्ररि, गैर प्रिधूिर् उद्योगों को संविाक दकर्य जयएगय।
(17) पहय़िी ढलयनों को संरक्षण: - पहय़िी ढलयनों के संरक्षण के धनम्नयनुसयर होगय:

(18) इस अधिसूचनय के उपयबंिों को प्रभयवी करने में केन्रीर् सरकयर और रयज्र् सरकयर, अधर्ररि उपयर्ों धवधनर्िाष्ट करेगय।
4. पयररधस्थधर्क सवंेिी जोन में प्रधर्धिद्ध और धवधनर्धमर् दकए जयन ेवयल े दक्रर्यकलयपों की सचूी - पयररधस्थधर्क संवेिी जोन में सभी दक्रर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) के उपबंिों और र्टीर् धवधनर्मन जोन 2011 और पर्यावरणीर् प्रभयव आकलन अधिसूचनय, 2006 और वन (संरक्षण) अधिधनर्म, 1980 (1980 के 69), भयरर्ीर् वन अधिधनर्म, 1927 (1927 के 16), वन्र्जीव (संरक्षण) अधिधनर्म, 1972 (1972 के 53) संिोिनों सधहर् द्वयरय ियधसर् होंगे और नीच ेिी गई सयरणी में धवधनर्िाष्ट रीधर् में धवधनर्धमर् होंगे, अथयार्प :-- सयरणी क्रम स.ं दक्रर्यकलयप रटप्पधणर्य ं

1. वयधणधज्र्क खनन । (क) सभी नए और धवद्यमयन खनन (लघु और वृहर् खधनज), पत्थर उत्खनन और उनको र्ो़िने की इकयइर्यं प्रधर्धिद्ध हैं, धसवयर् धनवयधसर्ों की वयस्र्धवक ििेी आवश्र्कर्यओं के नहीं होंगी, धजसके अंर्गार् गृहों के संधनमयाण र्य मरम् मर् के धलए धम्ी की खुियई और ा र्धस र्क उपभोग के धलए गृहों के धनमयाण के धलए ििेी टयइलों र्य ईंटों कय संधनमयाण भी ह ै। (ख) खनन संदक्रर्यएं, मयननीर् उच्चर्म न्र्यर्यलर् की ररट र्यधचकय (धसधवल) सं. 1995 कय 202 टी.एन. गौडयबमान धथरुमूलपयि बनयम भयरर् सरकयर के मयमले में आििे र्यरीख 4 अगस्र्, 2006 और ररट र्यधचकय (सी) सं. 2012 कय 435 गोवय फयउंडेिन बनयम भयरर् सरकयर के मयमले में र्यरीख 21 अप्रैल, 2014 के अंर्ररम आििे के अनुसरण में सवािय प्रचयलन होगय ।
2. प्रििूण (जल र्य वयर्ु र्य मृिय र्य ध् वधन, आदि) कयररर् करने वयले उद्योगों की स् थयपनय । कोई नर्य उद्योग र्य पयररधस्थधर्क संवेिी जोन में प्रििूण फैलयने वयले उद्योगों के धवस्र्यर की अनुज्ञय नहीं िी जयएगी। पयररधस्थधर्क संवेिी जोन के भीर्र कें रीर् प्रििूण धनर्ंत्रण बोडा द्वयरय फरवरी, 2016 में जयरी दिियधनििेों में धसफा गैर- प्रिधूिर् कुटीर उद्योगों को स्थयपनय के अनुसयर अनुज्ञयर् दकर्य जयएगय, जब र्क दक इस अधिसूचनय में इस प्रकयर धवधनर्िाष्ट न हो।
3. बृहर् जल धवद्युर् पररर्ोजनय की स् थयपनय । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
4. दकसी पररसंकटमर् पियथों कय उपर्ोग र्य उत्पयिन र्य प्रस्संकरण । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
5. प्रयकृधर्क जल धनकयर्ों र्य भूधम क्षेत्र में अनुपचयररर् प्रवयह के धनवाहन । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
6. नई आरय धमलों की स्थयपनय। पयररधस्थधर्क संवेिी जोन के भीर्र नई और धवद्यमयन आरय धमलों कय धवस् र्यर अनुज्ञयर् नहीं होगय ।
7. ईंट भ्ों की स्थयपनय करनय। लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
8. प्लयधस्टक के थैलों कय उपर्ोग। लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
9. जलयवन लकध़िर्ों कय वयधणधज्र्क उपर्ोग । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
10. नए कयष् ठ आियररर् उद्योग । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
11. मछली पयलन । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे । II (ii) 7 ख. धवधनर्धमर् दक्रर्यकलयप
12. वयधणधज्र्क होटलों और ररसोटों की स्थयपनय । पयररधस्थधर्क पर्ाटन दक्रर्यकलयपों संबंिी पर्ाटकों की लघु संरचनयओं के धलए संरधक्षर् क्षेत्र की सीमय से एक दकलोमीटर र्क र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क, इनमें जो भी धनकट ह,ै नए वयधणधज्र्क होटल और ररसोटा अनुज्ञयर् होंगे, अन्र्थय नहीं । परंर्ु, जहयाँ पयररधस्थधर्क संवेिी जोन कय धवस्र्यर एक दकलोमीटर से परे है वहयाँ, एक दकलोमीटर से परे और पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क सभी नए पर्ाटक दक्रर्यकलयप र्य धवद्यमयन दक्रर्यकलयप कय धवस्र्यर पर्ाटन महयर्ोजनय और र्थय लयगू मयगाििी धसद्धयंर्ों के अनुरुप होगय।
13. फमों, कॉपोरेट, कंपधनर्ों द्वयरय ब़ेि पैमयने पर वयधणधज्र्क पिुिन संपिय और कुसकुट फयमों की स्थयपनय । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
14. संधनमयाण दक्रर्यकलयप । (क) संरधक्षर् क्षेत्र र्य पयररधस्थधर्क संवेिी जोन जो भी धनकट हो, की सीमय से एक दकलोमीटर के भीर्र दकसी भी प्रकयर कय वयधणधज्र्क संधनमयाण अनुज्ञयर् नहीं दकर्य जयएगय:
(क) परंर्ु स् थयनीर् लोगों को पैरय 3 के उप पैरय (1) में सूचीबद्ध दक्रर्यकलयपों सधहर् उनके आवयसीर् उपर्ोग के धलए उनकी भूधम में संधनमयाण करने की अनुज्ञय भवन, उपधवधिर्ों के अनुसयर िी जयएगी जैसे.-
(i) धवद्यमयन स़िकों को चौ़िय करनय और उन्हें सुिढृ करनय र्थय नई स़िकों कय संधनमयाण;
(ii) बुधनर्यिी ढयंचों और नयगररक सुधवियओं कय संधनमयाण और नवीकरण;
(iii) कें रीर् प्रििूण धनर्ंत्रण बोडा द्वयरय जयरी दिियधनििेों में फरवरी, 2016 के भीर्र धसफा गैर- प्रिधूिर् लघु उद्योगों की स्थयपनय के वगीकरण;
(iv) कुटीर उद्योगों धजसके अंर्गार् ग्रयमीण उद्योग हैं; सुधवियजनक भण्डयर और स्थयनीर् सुख सुधवियओं जो पयररधस्थधर्क पर्ाटन धजस में सहयर्क हो गृह वयस; और
(v) इस अधिसूचनय में संवर्िार् दक्रर्यकलयपों की सूची। (ख) परन्र्ु ऐसे लघु उद्योगों जो प्रििूण उत् पन् न नहीं करर्े हैं, से संबंधिर् संधनमयाण दक्रर्यकलयप धवधनर्धमर् दकए जयएंगे और लयगू धनर्मों और धवधनर्मों, र्दि कोई हों, के अनुसयर सक्षम प्रयधिकयरी की पूवा अनुमधर् से ही न् र्ूनर्म पर रखे जयएंगे । (ग) एक दकलोमीटर से आगे आंचधलक महयर्ोजनय की अनुसयर धवधनर्धमर् होंगे ।
15. प्रििूण उत्पन्न न करने वयले लघु उद्योग । फरवरी, 2016 में केन्रीर् प्रििूण धनर्ंत्रण बोडा द्वयरय जयरी उद्योगों में वगीकरण के अनुसयर गैर-प्रििूणकयरी उद्योग और अपररसंकट में, लघु और सेवय उद्योग, कृधि, पुष्प कृधि, उद्ययन कृधि र्य पयररधस्थधर्क संवेिी जोन से ििेी सयमग्री से उत्पयिों को उत्पन्न करने वयले कृधि आियररर् उद्योग सक्षम प्रयधिकयरी द्वयरय अनुज्ञयर् होंगे।
16. वयधणधज्र्क बकरी और भे़ि खेर्ी। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
17. वृक्षों की कटयई । (क) रयज्र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनुज्ञय के धबनय वन, सरकयरी र्य रयजस्व र्य धनजी भूधम पर र्य वनों में ककंही वृक्षों की कटयई नहीं होगी । (ख) वृक्षों की कटयई संबंधिर् कें रीर् र्य रयज्र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंि के अनुसयर धवधनर्धमर् होगी ।

19. धवद्युर् और िरूसंचयर टयवरों कय पररधनमयाण और केबल धबछयनय और अन्र् बुधनर्यिी ढयंचे । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे। भूधमगर् केबल धबछयए जयने को बढ़यवय दिर्य जयएगय।
20. नयगररक सुख सुधवियओं सधहर् बुधनर्यिी ढयंचे। लयग ू धवधिर्ों धनर्मों और धवधनर्मों मयगी धसद्धयंर्ों के अनुसयर न्र्नूीकरण की उपयर्ों के सयथ, और उपलब्ि दकए जयएंगे ।
21. धवद्यमयन स़िकों को चौ़िय करनय और उन्हें सुिढृ करनय र्थय नई स़िकों कय संधन्नमयाण । लयग ू धवधिर्ों धनर्मों और धवधनर्मों मयगी धसद्धयंर्ों के अनुसयर न्र्नूीकरण की उपयर्ों के सयथ, और उपलब्ि दकए जयएंगे ।
22. पर्ाटन से संबंधिर् दक्रर्यकलयप जैसे गमा वयर्ु गुब्बयरें, हेलीकयप्टर, ड्रोन, मयइक्रोलयइटस और अन्र् पर्ाटन दक्रर्यकलयप आदि द्वयरय पयररधस्थधर्क संवेिी जोन क्षेत्र के ऊपर से उ़िनय जैसे दक्रर्यकलयप करनय। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
23. पहय़िी ढयलों और निी र्टों कय संरक्षण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
24. रयधत्र में र्यधनक र्यर्यर्यर् कय संचलन । लयगू धवधिर्ों के अिीन वयधणधज्र्क प्रर्ोजन के धलए धवधनर्धमर् होंगे ।
25. स्थयनीर् समुियर्ों द्वयरय चल रही कृधि और बयगवयनी प्रथयओं के सयथ पिुपयलन, पिुपयलन कृधि और मछली पयलन । स्थयनीर् लोगों के उपर्ोग के धलए लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
26. प्रयकृधर्क जल धनकयर्ों र्य सर्ही क्षेत्र में उपचयररर् बधहस्रयाव कय धनस्सयरण । उपचयररर् अपधिष्ट जलघबधहस्रयाव कय धनस्सयरण जल धनकयर्ों में प्रवेि नहीं करने दिर्य जयएगय। उपचयररर् अपधिष्ट जल के पुनचाक्रण और पुन:उपर्ोग के धलए प्रर्यस दकए जयएंगे। उपचयररर् अपधिष्ट जलघबधहस्रयावों कय धनस्सयरण लयगू धवधिर्ों के अनुसयर धवधनर्धमर् दकर्य जयएगय ।
27. सर्ह और भूजल के वयधणधज्र्क धनष्किाण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
28. खुले कुआ, बोर कुआ, आदि के धलए कृधि और अन्र् उपर्ोग । धवधनर्धमर् और उपर्ुि प्रयधिकयरी द्वयरय दक्रर्यकलयपों की स्र्ी से धनगरयनी की जयएगी।
29. ठोस अपधिष् ट प्रबंिनघजैव-धचदकत्सीर् अपधिष् ट प्रबिंन। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
30. धवििेी प्रजयधर्र्ों को लयनय । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
31. पयररधस्थधर्क पर्ाटन। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
32. वयधणधज् र्क सयइनबोडा और होर्डंग । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । ग. सवंर्िार् दक्रर्यकलयप
33. विया जल संचर्न । सदक्र र् रूप से बढ़यवय दिर्य जयएगय ।
34. जैधवक खेर्ी। सदक्र र् रूप से बढ़यवय दिर्य जयएगय ।

(3) पयररधस्थधर्क संवेिी जोन में भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अनुसूची में के अिीन सधम्मधलर् दक्रर्यकलयपों और इस अधिसूचनय के पैरय 4 के अिीन प्रधर्धिद्ध गधर्धवधिर्ों के धसवयर् आन ेवयले ऐसे दक्रर्यकलयपों की ििय में वयस्र्धवक धवधनर्िाष्ट स्थलीर् िियओं पर आियररर् धनगरयनी सधमधर् द्वयरय संवीक्षय की जयएगी और उि अधिसूचनय के उपबंिों के अिीन पूवा पर्यावरण धनकयसी के धलए केन्रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को धनर्िाष्ट की जयएगी ।
(4) इस अधिसूचनय के पैरय 4 के अिीन र्थय धवधनर्िाष्ट प्रधर्धिद्ध दक्रर्यकलयपों के धसवयर्, भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं्र्यंक कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अधिसूचनय के अनुसूची के अिीन ऐसे दक्रर्यकलयपों, धजन्हें सधम्मधलर् नहीं दकर्य गर्य है, परंर्ु पयररधस्थधर्क संवेिी जोन में आर् ेहैं, ऐसे दक्रर्यकलयपों की वयस्र्धवक धवधनर्िाष्ट स्थलीर् िियओं पर आियररर् धनगरयनी सधमधर् द्वयरय संवीक्षय की जयएगी और उसे संबद्ध धवधनर्यमक प्रयधिकरणों को धनर्िाष्ट दकर्य जयएगय ।
(5) धनगरयनी सधमधर् कय सिस्र्-सधचव र्य संबद्ध उपयर्ुस र्, ऐस े व्यधि के धवरूद्ध, जो इस अधिसचूनय के दकसी उपबंि कय उल्लंघन करर्य है, पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 19 के अिीन पररवयि फयइल करने के धलए सक्षम होगय ।

8. कोई अन् र् महत् वपूणा धविर् । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 11th August, 2017 S.O.2605(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.
4109 (E), dated the 21 st December, 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, the copies of the Gazette were made available to the public on the dated the 21 st December, 2016.
AND WHEREAS, no objections and suggestions received from persons and stakeholders in response to the draft notification;
AND WHEREAS, the Ratapani and Singhori Wildlife Sanctuary spreads over an area of 1201.29 Square Kilometers is located in Raisen district in the State of Madhya Pradesh;
AND WHEREAS, the Ratapani and Singhori Wildlife Sanctuary is extremely rich in flora and fauna and harbours a number of endemic species. Ratapani and Singhori Wildlife Sanctuary are rich in biodiversity. These wildlife areas are classified into semi arid wildlife zone - IV B Gujarat Rajputana, under Roger and Pawar classification.
The sanctuary is inhabited by all the usual animals of the region, such as Tiger (Panthera tigris) leopard (Panthera pardus), Wolf (Canis lupus), Jackal (Canis aureus), indian fox (Vulpes bengalensis), Striped hyena (Hyaena hyaena) Sloth bear (Melursus ursinus) among carnivores and spotted deer (Axis axis), Sambhar (Cervus unicolor), Nilgai (Boselaphus tragocamelus), Chinkara (Gazella gazelle bennetti), Wild pig (Sus scrofa), Chowsingha (Tetracerus quadriconis) and Blackbuck (Antelope cervicapra), amongst herbivores. Apart from these, crocodiles/gharials can also be seen in Ratapani and Singhori Wildlife Sanctuary.
AND WHEREAS, it contains 129 tree species, 73 herbs and shrubs species, 33 climbers and parasites, 35 grasses and bamboo species, 35 mammals, 205 birds, 14 fish, 33 reptiles and 10 species of amphibians have been recorded in Ratapani and Singhori Wildlife Sanctuary.
AND WHEREAS, it is necessary to conserve and protect the area to the extent and boundaries of which is specified in paragraph 1 of this notification, around the protected area of Ratapani and Singhori Wildlife Sanctuary as Eco-sensitive zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; and 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] NOW THEREFORE, in exercise of the powers conferred by sub-section(1) read with clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with subrule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent one kilo meter around the boundary of Ratapani and Singhori Wildlife Sanctuary of the Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The extent of Eco-sensitive Zone is one kilometer in the revenue area and two kilometer in the surrounding forest area from the boundary of Ratapani and Singhori Wildlife Sanctuary. The area of Eco sensitive Zone is 546.52 square kilometers. The boundary description of Eco-sensitive Zone and co-ordinates of Wildlife Sanctuary and Eco-sensitive Zone are given in Annexure-I and II respectively.
(2) The list of 72 villages and their co-ordinates falling under the said Eco-sensitive Zone is annexed as Annexure-III.
(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-IV.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture & Horticulture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism including eco-tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal & urban development;
(x) Panchayati Raj; and
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant State laws and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as.-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given under para 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant State laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities.
(2) Natural water bodies.- The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/ Eco-tourism.- (a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Eco-tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Eco-sensitive Zone area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016;
the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone.
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste.- Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number G.S.R. 343 (E), dated the 28 th March, 2016.
(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016,.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016,.
(13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.
(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and the efforts to be made for use of cleaner fuel for example CNG, LPG, etc.

(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.- The protection of hill slopes shall be as under:-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S No Activity Description

1. Commercial Mining.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification.
In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
8. Use of polythene bags. Prohibited (except as otherwise provided) as per applicable laws.
9. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
10. New wood based industry. Prohibited (except as otherwise provided) as per applicable laws.
11. Fishing . Prohibited (except as otherwise provided) as per applicable laws.

12. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
13. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Regulated under applicable laws.
14. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
(a) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and
(v) Promoted activities listed in this Notification.
(b) Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
15. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
16. Commercial Goat and sheep farming.
Regulated under applicable laws.
17. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
18. Collection of Forest produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws.
19. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law. Underground cabling may be promoted.
20. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulation.

5. Monitoring Committee:- In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:—
(i) Divisional Commissioner, Bhopal —Chairman;
(ii) One representative of Non-Governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Madhya Pradesh —Member;
(iii) An expert in the area of ecology and environment to be —Member;
nominated by the Government of Madhya Pradesh
(iv) Representative of Madhya Pradesh Pollution Control —Member;
Board
(v) Chief Conservator of Forests, Bhopal —Member
21. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation.
22. Under taking other activities related to tourism like over flying the Ecosensitive area by hot air balloon, helicopter, drones, Microlites, etc.
Regulated under applicable law.
23. Protection of Hill Slopes and river banks.
Regulated under applicable laws.
24. Movement of vehicular traffic at night.
Regulated for commercial purpose under applicable laws.
25. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
26. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
27. Commercial extraction of surface and ground water.
Regulated under applicable law.
28. Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
29. Solid Waste Management/Biomedical Waste Management.
Regulated under applicable laws.
30. Introduction of Exotic species. Regulated under applicable laws.
31. Eco-tourism. Regulated under applicable laws.

6. Terms of Reference: (1) The tenure of the monitoring committee shall be three years or till the constitution of the new committee by the State Govt.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure-V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
