PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 238] ubZ fnYyh] 'kqØokj] tuojh 29] 2016@ek?k 9] 1937 No. 238] NEW DELHI, FRIDAY, JANUARY 29, 2016/MAGHA 9, 1937 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 28 जनवरी, 2016. का.आ. 268(अ).—के᭠ ᮤ ीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उप-धारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए और त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 (िजसे इसमᱶ इसके प᳟ात् उᲦ अिधसूचना कहा गया ह)ै के अनुसरण मᱶ, रा᭔य ᭭तरीय पयाᭅवरण समाधात िनधाᭅरण ᮧािधकरण, (एसईआईएए) ज᭥मू और क᭫मीर (िजसे इसमे इसके प᳟ात ज᭥मू और क᭫मीर के िलए ᮧािधकरण कहा गया ह)ै का गठन करती ह,ै जो िन᳜िलिखत सद᭭यᲂ से िमलकर बनगेी, अथाᭅत् :—

2. ᮰ी महो᭥मद अमीन नौशहरी 7, ᭠यु कालोनी, नगम हजरतबल, ᮰ीनगर-190006 —सद᭭य
3. िनदेशक, पयाᭅवरण, पाᳯरि᭭थितकᳱ और दरू संवेदी िवभाग, ज᭥मू और क᭫मीर सरकार —सद᭭य-सिचव
2. ज᭥मू और क᭫मीर ᮧािधकरण के अ᭟यᭃ और सद᭭य इस अिधसूचना के राजपᮢ मᱶ ᮧकािशत ᳰकए जान े कᳱ तारीख से तीन वषᭅ कᳱ पदाविध के िलए पद धारण करᱶग े। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
3. ज᭥मू और क᭫मीर ᮧािधकरण ऐसी शिᲦयᲂ का ᮧयोग करेगा और ऐसी ᮧᳰᮓयाᲐ का अनुसरण करेगा जो ᳰक उᲦ अिधसूचना मᱶ िविन᳸द᳥ ह ै।
4. ज᭥मू और क᭫मीर ᮧािधकरण अपने िविन᳟य को पैरा 5 के अधीन ज᭥मू और क᭫मीर रा᭔य के िलए गᳯठत रा᭔य ᭭तरीय िवशेष᭄ अंकन सिमित कᳱ िसफाᳯरशᲂ पर आधाᳯरत करेगा ।
5. कᱶ ᮤीय सरकार, ज᭥मू और क᭫मीर सरकार के परामशᭅ से, ज᭥मू और क᭫मीर ᮧािधकरण कᳱ सहायता करने के ᮧयोजनᲂ हतेु रा᭔य ᭭तरीय िवशेष᭄ अंकन सिमित, ज᭥मू और क᭫मीर का गठन करती ह,ै जो िन᳜िलिखत सद᭭यᲂ से िमलकर बनेगी, अथाᭅत् :-

8. एसईएसी ज᭥मू और क᭫मीर सामूिहक उᱫरदािय᭜व के िसांत पर कायᭅ करेगी और अ᭟यᭃ ᮧ᭜येक मामल ेमᱶ मतैय पर पᱟचंने का ᮧयास करᱶग ेऔर यᳰद मतैय पर नहᱭ पᱟचंा जा सकता हो तो बᱟसंया का िवचार अिभभावी होगा ।
9. ज᭥मू और क᭫मीर सरकार, ज᭥मू और क᭫मीर ᮧािधकरण और एसईएसी, ज᭥मू और क᭫मीर के सिचवालय के ᱨप मᱶ कायᭅ करन े के िलए एक अिभकरण को अिधसूिचत करेगी और सभी संिविधक कृ᭜यᲂ के संबंध मᱶ सभी िवᱫीय और संभार-तंᮢ, का समथᭅन का उपबंध करेगा िजसके अंतगᭅत वास-सुिवधा और अ᭠य सुिवधाएं भी ह ै।
10. ज᭥मू और क᭫मीर ᮧािधकरण के अ᭟यᭃ और सद᭭यᲂ तथा एसईएसी ज᭥मू और क᭫मीर के अ᭟यᭃ और सद᭭यᲂ को ज᭥मू और क᭫मीर सरकार के संब िनयमᲂ के अनुसार बैठक फᳱस, याᮢा भᱫा और मंहगाई भᱫा संदᱫ ᳰकया जाएगा । [सं. जे-11013/31/2007-आई. ए. II (I)] मनोज कुमार ᳲसह, संयुᲦ सिचव MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 28th January, 2016 S.O. 268(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority (SEIAA), Jammu and Kashmir (hereinafter referred to as the Authority for Jammu and Kashmir) comprising of the following members, namely:—
1. Shri S.D Swatantra House No. 7, Sector -8, Trikuta Nagar, Jammu -180012. —Chairman
2. Shri Mohammad Amin Nowshahri 7, New Colony, Nagam Hazratbal, Srinagar-190006. —Member
3. Director, Department of Environment, Ecology and Remote Sensing, Government of Jammu and Kashmir. —Member-Secretary
2. The Chairman and members of the Authority for Jammu and Kashmir shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.
3. The Authority for Jammu and Kashmir shall exercise such powers and follow such procedures as specified in the said notification.
4. The Authority for Jammu and Kashmir shall base its decision on the recommendations of the State Level Expert Appraisal Committee constituted under paragraph 5 for the State of Jammu and Kashmir.
5. For the purposes of assisting the Authority for Jammu and Kashmir, the Central Government, in consultation with the Government of Jammu and Kashmir, hereby constitutes the State Level Expert Appraisal Committee, Jammu and Kashmir comprising of the following members, namely :— 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

6. The Chairman and Members of State Level Expert Appraisal Committee, Jammu and Kashmir shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.
7. The State Level Expert Appraisal Committee, Jammu and Kashmir shall exercise such powers and follow the procedures as specified in the said notification.
8. The State Level Expert Appraisal Committee, Jammu and Kashmir shall function on the principle of collective responsibility and the Chairman shall endeavor to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.
9. The Government of Jammu and Kashmir shall notify an agency to act as Secretariat for the Authority for Jammu and Kashmir and the State Level Expert Appraisal Committee, Jammu and Kashmir, and shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all its statutory functions.
10. The sitting fee, travelling allowance and dearness allowance to the Chairman and Members of the Authority for Jammu and Kashmir and the Chairman and Members of the State Level Expert Appraisal Committee, Jammu and Kashmir shall be paid in accordance with the concerned rules of the Government of Jammu and Kashmir.
