और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃपेᲂ और सुझावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक ᱧप से िवचार ᳰकया गया;

कावेरी व᭠ यजीव अभयार᭛य, िजसे कनाᭅटक रा᭔ य सरकार कᳱ अिधसूचना सं. एफईई 302 एफड᭣ ᭨ यू एल 2011-(iv), तारीख 27 नवंबर, 2011 ᳇ारा अिधसूिचत ᳰकया गया था, कनाᭅटक के तीन िजलᲂ अथाᭅत् रामानगर(कनकपरुा तालुक), चमरंज नगर (कोलगेैला तालुक) और म᭛ डयार (मलाव᭨ ली तालुक) 1027.53 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ ह ैतथा उ᭜ तर अᭃांश 11056’ 54.38” उ से 12024’ 35.78 उ और पूवᭅ देशांतर 77009’ 41.02 प ूसे 77046’ 39.84” प ूके बीच अवि᭭ थत ह;ै और, कावेरी व᭠यजीव अभयार᭛य कनाᭅटक के दिᭃण भारतीय शु᭬क पणᭅपाती ᳰक᭭म के वनᲂ का एक मह᭜वपूणᭅ िह᭭सा ह,ै िजसे पारंपᳯरक ᱨप से बाघᲂ और इसके िशकार के िलए सवᲃᱫम और संभािवत िनवास के ᱧप मᱶ जाना जाता ह ैऔर अिधसूचना सं᭎या एफईई 231 एफड᭣᭨यूएल 2000, तारीख 25 नवंबर, 2002 ᳇ारा 6724.87 वगᭅ ᳰकलोमीटर के िह᭭से मᱶ ह ैऔर िजसे भारत सरकार, वन और पयाᭅवरण मंᮢालय, के हाथी पᳯरयोजना का स᭥यक अनमुोदन ᮧा᳙ ह ैतथा अभयार᭛य के पाᳯरि᭭थितक मह᭜व को दशाᭅते ᱟए एिशयाई हािथयᲂ के अ᭒छे अनुकूल सघनता का समथᭅन करता ह;ै और, कावेरी व᭠यजीव अभयार᭛य कᳱ दिᭃणी पि᭫ चमी ᳰदशा मᱶ मलाइमहादेशवरा व᭠ यजीव अभयार᭛य तथा इडयाराह᭨ ली-डोडासंपीजी ᳯरजवᭅ वनᲂ के गिलयारे से होत ेᱟए िबिलिगᳯररंगा᭭ वामी मि᭠ दर बाघ ᳯरजवᭅ से जुड़ा ᱟआ ह ैऔर अभयार᭛य के उ᭜ तर भाग मᱶ, रामदेवाराबेᲵा-चवरकल ᳯरजवᭅ वन से होते ᱟए ब᭠ नरेघाटा रा᭬ ᮝीय उ᳒ान से जुड़ा ᱟआ ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, अभयार᭛य कुछ बड़े ᭭तनधाᳯरयᲂ के िलए ᮧाकृितक आवास ह ैजैसे रॉयल बंगाल बाघ (पᱹथेरा टीगरीस), तᱶदआु (पᱹथरेा पाडᭅस), धोल ेएवं जंगली कु᭜ ता (᭍यूओन ंअलपीनस), िसयार (कनीस अयरेअस), िचᱫीदार लकड़ब᭏घा (हयेना हयेना), भारतीय लोमड़ी (वुलपुस बेदगाले᭠सीस), रीछ (मेलरू᭭स अरसीनअस), छोटा भारतीय मुसंग (वीवेरᱮकूला इंिडका), एिश यन मुसंग (पराडू᭍सनअरस हरेमापहरेोदीटूस), जंगली िब᭨ली (फैिलस चाउस), र᭭टी-᭭पॉटीड िचᱫीदार िब᭨ली (पेरीओनाइलउᱨस ᱨबीगीनोसूस), ᮕ े नेवला (हरेपेसटेस इडवारडसी) और ᱨ᲻ी नेवला (हरेपेसटेस समीथी) आᳰद., इस अभयार᭛य मᱶ पाए जाने वाल ेमांसाहारी और कुछ अनगिलत/ शाकाहाᳯरयᲂ/िशकार ᮧजाितयᲂ मᱶ गौर (बोस गौयᱨस), सांभर िहरण (ᱨसा यूनीकोलर), चीतल एवं िचᱫीदार िहरण (एि᭍सस एि᭍सस), जंगली सूअर (सूस ᭭कोफाᭅ), चौᳲसगा मृग एवं चौᳲसगा (टेराकेरअस ᭍यूडरीकोरनीस), काला िहरण एवं भारतीय मृग (अनटीलोप े केरवीकापारा), मंुजक और भारतीय मुनटजक (मुनटीकस मुनटजक) और िपसूरी एवं भारतीय छोटा क᭭तूरी-मृग (मोसचीओला इंिडका) और ᭣लैक-ने᭡ड खरगोश (लेपुस नीगरीको᭨लस) आᳰद शािमल ह;ᱹ और, कावेरी व᭠ यजीव अभयार᭛य के तटवतᱮ वन कनाᭅटक रा᭔य मᱶ केवल एक ऐसा ᭭ थान ह ैजो भूरी िवशालकाय िगलहरी(रतुबुना मैकोरा) कᳱ संकटाप᳖ ᮧजाितयां (ᮧकृित संरᭃण के िलए अंतराᭅ᳦ीय संघ) ह,ै जो दिᭃण भारत और ᮰ीलकंा के िलए ᭭थािनक ह ैऔर हाल ही मᱶ कावेरी व᭠यजीव अभयार᭛य से हनी बेजर या रतल (मेलेवोरा कैपेिसस) को पहली बार कैमरा मᱶ कैद ᳰकया और ᳯरकॉडᭅ ᳰकया गया ह,ै जो दलुᭅभ, लु᳙ ᮧाय और संकटाप᳖ (आरईटी) ᮧजाितयᲂ के संरᭃण और सुरᭃा के संदभᭅ मᱶ कावेरी व᭠यजीव अभयार᭛य के मह᭜व और अि᳇तीयता को उपदᳶशत करता ह;ै और, कावेरी नदी व᭠यजीव अभयार᭛य के म᭟य से बहती ह ैऔर यह संकटाप᳖ तथा ᭭थािनक मिछलयᲂ के ᮧजाितयᲂ के िलए िनवास ह ैिजहᱶ दᲥन महशीर (टोर खुदᱮ) कहा जाता ह,ै जो एक मह᭜वपूणᭅ ताजाजल फलगै िशप मह᭜वपूणᭅ ᮧजाित हᱹ और कावेरी व᭠यजीव अभयार᭛य कᳱ नदी पाᳯरि᭭थितक तंᮢ भी कमजोर ᮧजाितयᲂ के अंितम शेष गढ़ ह ै जैसे ᭭मूथ कोटेड औटर (लूटरा पᳶससेलाटाटा), ओᳯरएंटल ᭍लौट औटर (एओने᭍स िसनेᳯरया) और सामा᭠य औटर (लूटरा लूटरा) ह ᱹऔर इस व᭠यजीव अभयार᭛य के िवशेष आवास मᱶ भी अ᭠य जलीय ᮧजाितयᲂ का समथᭅन करत े ह ᱹ जैसे मगर या माशᭅ मगरम᭒छ (ᮓोकोडयलूस पलू᭭ᮝीस) और सॉ᭢ट शे᭨ड कछुए (ए᭭पीडेरेटेस गनगेटी᭍स) ह;ᱹ और, कावेरी व᭠यजीव अभयार᭛य मᱶ संकटाप᳖ भारतीय साल (मािनस कै᭭सीकयूडाटा), ᭭थािनक मᮤास वृᭃ ि᮰व (अनाथाना इिलयोᳯट) और िनकट संकटाप᳖ और ᭭थािनक को᭨लगेल भूिम गेᲥो (गेककोइ᭨ला को᭨लगेलनेसीस) का भी भरण पोषण रता ह ैह;ै और, कावेरी व᭠यजीव अभयार᭛य को वषᭅ 2004 मᱶ बडᭅ लाइफ इंटरनेशनल ᳇ारा मह᭜वपूणᭅ पᭃी ᭃ᭄े (आईबीए) के ᱨप मᱶ पदािभिहत ᳰकया गया ह,ै ᭍यᲂᳰक यह पिᭃयᲂ कᳱ 280 से अिधक ᮧजाितयᲂ का भरणपोषण करता ह,ै िजसमᱶ गंभीर ᱨप से संकटाप᳖ सफेद चकᱫे वाले िग᳍ (जीयेपस बᱶगलᱶिसस) और भारतीय िग᳍ (जीयेपस इंिड᭍स), संकटाप᳖ िग᳍ (सैरकोजाईपस कालवस) शािमल ह ᱹकावेरी से ᳯरपोटᭅ कᳱ गई दलुᭅभ और कमजोर पिᭃयᲂ कᳱ ᮧजाितयᲂ मᱶ नीलगीरी कᳱ धारा (कोलूबा इलफेइन᭭टो᳖ी), ᮕेटर ᭭पोटेड ईगल (᭍लगेा ᭍लेगा), ᭪हाइट नेपड ᳯटट (पारस नूचा᭨लीस), पाइड-ᮓे᭭टेड ᳯटट (पारस नूचा᭨लीस), और य᭨लो-ᮣोएटेड बुलबुल (पायनोटस ᭍सअनथोलामूस) और अभयार᭛य मᱶ यूरोपीय मधुम᭍खी (मेरोपस अपीइसटीर), पि᳟मी घाट ᮧजाित जैसे भारतीय कोरिसयर (कोरेसोरीअस कोरोउमनडे᭨ली᭍स) और कुछ ᮧवासी पिᭃयᲂ का भरण पोषण करता ह।ै मालाबार पैराकᳱट (पेसीᲵाकुला कोलूमबोइडेस) और िव᳡ ᭭तर पर संकटाप᳖ ᮕेटर ᭭पेटेड ईगल (अ᭍यूइला चलेनजा और ᭍यूनजा) के िलए मह᭜वपूणᭅ सदᱮ ᭃेᮢ ह;ै और, कावेरी व᭠यजीव अभयार᭛य, के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ का ᮧचालन तथा ᮧसं᭭करण को ᮧितिष᳍ करना आव᭫यक ह ै;

अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 उपधारा (1)कᳱ उपधारा (2) के खंड (v) और खंड (xiv) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, कनाᭅटक रा᭔य मᱶ कावेरी व᭠यजीव अभयार᭛य, कᳱ सीमा से 1.0 ᳰकलोमीटर से 14.5 ᳰकलोमीटर तक िव᭭ तृत ᭃेᮢ को कावेरी व᭠यजीव अभयार᭛य, पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:-- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3

1. पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक संवदेीसंवदेीसंवदेीसंवदेी जोनजोनजोनजोन काकाकाका िव᭭तारिव᭭तारिव᭭तारिव᭭तार औरऔरऔरऔर उसकᳱउसकᳱउसकᳱउसकᳱ सीमाएंसीमाएंसीमाएंसीमाएं—

(1) पाᳯरि᭭थितक संवेदी जोन का कुल भौगोिलक ᭃेᮢ 600.7 वगᭅ ᳰकलोमीटर मᱶ फैला ᱟआ ह ैऔर िजसका िव᭭ तार कावेरी व᭠ यजीव अभयार᭛य 1.0 ᳰकलोमीटर से 14.5 ᳰकलोमीटर के बीच ह ैतथा िजसकᳱ सीमाᲐ का वणᭅन उपाबधं उपाबधं उपाबधं उपाबधं IIII मᱶ ᳰदया गया ह ै।

(2) कावेरी व᭠यजीव अभयार᭛य के पाᳯरि᭭थितक संवेदी जोन मᱶ कावेरी व᭠यजीव अभयार᭛य कᳱ सीमा के बाहर अवि᭭थत

501.25 वगᭅ ᳰकलोमीटर के भौगोिलक ᭃेᮢ के साथ 72 राज᭭व ᮕाम सि᭥मिलत ह ᱹ और तीन अलग-अलग िजलᲂ के तीन तालुकᲂ मᱶ फैला ह।ै पाᳯरि᭭थितक संवेदी जोन के को᭨लगेल तालुक (चामराजनगर िजले) 28 राज᭭व ᮕाम िव᳒मान ह,ᱹ पाᳯरि᭭थितक संवेदी जोन के मालाव᭨ली तालुक (मंᲽा िजले) मᱶ 21 राज᭭व ᮕाम िव᳒मान ह ᱹऔर पाᳯरि᭭थितक संवेदी जोन के कनकपुरा तालुक (रामानगर िजले) मᱶ 23 राज᭭व ᮕाम िव᳒मान ह ᱹ। कावेरी व᭠यजीव अभयार᭛य के पाᳯरि᭭थितक संवेदी जोन मᱶ कावेरी व᭠यजीव अभयार᭛य कᳱ बाहरी सीमा के अंतगᭅत िव᳒मान 35 संलᲨ ᮕामᲂ (वन ᮕाम) भी सि᭥मिलत ह ᱹ िजनका कुल भौगोिलक ᭃेᮢ 38.79 वगᭅ ᳰकलोमीटर ह।ै

(3) कावेरी व᭠यजीव अभयार᭛य के पाᳯरि᭭ थितक संवेदी जोन के अंतगᭅत अवि᭭थत 107 (िजनके अंतगᭅत 35 वन ᮕाम/संलᲨ ᮕाम भी ह)ᱹ ᮕामᲂ कᳱ सूची उपाबधंउपाबधंउपाबधंउपाबधं II II II II के ᱧप मᱶ संलᲨ ह ै।

(4) 107 ᮕाम जो कावेरी व᭠यजीव अभयार᭛य के पाᳯरि᭭थितक संवेदी जोन का भाग ह ैइसमᱶ सथेगल जागीर वन (कावेरी व᭠यजीव अभयार᭛य के सं᭭पशᱮ 37.66 वगᭅ ᳰकमी खंड 4 अिधसूिचत ᭃेᮢ) ह ैऔर कावेरी व᭠यजीव अभयार᭛य के हनरू रा᭔य वन के सं᭭पशᱮ एकाडᱟलीगडुा का ᭃेᮢ 3.12 वगᭅ ᳰकलोमीटर ह।ै कावेरी व᭠यजीव अभयार᭛य के पाᳯरि᭭थितक संवेदी जोन के अंतगᭅत अवि᭭थत उᲦ अिधसूिचत ᭃेᮢ के ᭣यौरे ᭃेᮢ उपाबधंउपाबधंउपाबधंउपाबधं III III III III के ᱧप मᱶ संलᲨ ह ै।

(5) रामानगर िजला मᱶ कावेरी व᭠यजीव अभयार᭛य के सं᭭पशᱮ दो आरिᭃत वनᲂ को भी कावेरी व᭠यजीव अभयार᭛य के पाᳯरि᭭थितक संवेदी जोन शािमल ᳰकया गया था । उᲦ व᭠यजीव अभयार᭛य सीमा के बाहर अवि᭭थत इन दो आरिᭃत वनᲂ का कुल ᭃेᮢ ह ैलेᳰकन पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा कᳱ 19.8862 वगᭅ ᳰकलोमीटर के ᱧप मᱶ संगणना कᳱ जाती ह;ै और पाᳯरि᭭थितक संवेदी जोन के अतंगᭅत अवि᭭थत आरिᭃत वनᲂ कᳱ सूची उपाबधंउपाबधंउपाबधंउपाबधं IV IV IV IV के ᱧप मᱶ संलᲨ ह ै।

(6) पाᳯरि᭭थितक संवेदी जोन सीमा के अंतगᭅत िव᳒मान भूिमयᲂ कᳱ िविधक ᮧाि᭭थित मु᭎यतः राज᭭व भूिम, पᲵा भूिम, बाडᲂ आरिᭃत वन जो कनाᭅटक वन अिधिनयम, 1963 कᳱ धारा-4 के अधीन अिधसूिचत वन ह ᱹअनुमान वन ᭃेᮢ, सड़क और तालाब आᳰद समझे गए ह।ᱹ

(7) सीमा वणᭅन और अᭃांश और देशांतर के साथ पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ उपाबधंउपाबधंउपाबधंउपाबधं V V V V के ᱧप मᱶ संलᲨ ह ै।

(8) कावेरी व᭠यजीव अभयार᭛य कᳱ सीमा और पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा के मु᭎य ᳲबदओु के भू-िनदᱷशांक उपाबधंउपाबधंउपाबधंउपाबधं VI VI VI VI के ᱧप मᱶ संलᲨ ह ै।

2222.... पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक संवदेीसंवदेीसंवदेीसंवदेी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महामहामहामहायोजनायोजनायोजनायोजना –––– (1) रा᭔य सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ ᳰदए गए अनुबंधᲂ का पालन करते ᱟए आंचिलक महायोजना तैयार करेगी ।

(2) रा᭔य सरकार पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित मᱶ जो इस तरह, इस अिधसूचना मᱶ िविन᳸द᭬ ट कᳱ जाए तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, के अनुᱧप तैयार होगी ।

(3) आंचिलक महायोजना, पाᳯरि᭭थितक और पयाᭅवरणीय बातᲂ को समाकिलत करने के िलए िन᳜िलिखत रा᭔ य सरकार के िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत:्--

(i) पयाᭅवरण;

(ii) वन और व᭠यजीव;

(iii) कृिष ;

(iv) राज᭭ व;

(v) शहरी िवकास;

(vi) पयᭅटन;

(vii) ᮕामीण िवकास;

(viii) ᳲसचाई और बाढ़ िनयंᮢण;

(ix) नगरपािलक;

(x) पंचायती राज;

(xi) लोक िन माᭅण िव भाग।

(4) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन तब तक अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।

(5) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलᲐू, िजन पर ᭟यान देने कᳱ आव᭫यकता ह,ै के िलए उपबंध हᲂगे ।

(6) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बि᭭तयᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का सहायक मानिचᮢ के साथ अ᭤यकंन करेगी। इस योजना के मानिचᮢ ᳇ारा िव᳒मान और ᮧ᭭तािवत भूिम के उपयोग िवशेषताᲐ का ᭣यौरे दतेे ᱟए मानिचᮢᲂ ᳇ारा समᳶथत होगी।

(7) आंचिलक महायोजना पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगी और पैरा 4 कᳱ सारणी मᱶ सूचीब᳍ ᮧितिष᳍, िविनयिमत और संवᳶधत ᳰᮓयाकलापᲂ का अनुपालन करेगी तथा ᭭ थानीय समुदायᲂ के पाᳯरि᭭थितक अनुकूल िवकास के िलए जीवकोपाजᭅन कᳱ सुरᭃा को भी सुिनि᳟त करेगी।

(8) इस ᮧकार अनुमोᳰदत आंचिलक महायोजना इस अिधसूचना के उपबंधᲂ के अनुसार मानीटरी के अपने कायᲄ को करन ेके िलए मानीटरी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी ।

3. रा᭔यरा᭔यरा᭔यरा᭔य सरकारसरकारसरकारसरकार ᳇ारा᳇ारा᳇ारा᳇ारा ᳰकएᳰकएᳰकएᳰकए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय-------- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत्:--

(1) भूभभूूभू----उपयोगः उपयोगः उपयोगः उपयोगः पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजनᲂ के िलए उᳰ᳎᳥ ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा। परंत ुपाᳯरि᭭थितक संवेदी जोन के भीतर कृिष और अ᭠य भूिम का संपᳯरवतᭅन मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, जो ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन े के िलए तथा िन᳜िलिखत ᳰᮓयाकलापᲂ के िलए अनु᭄ात हो सकेगा, जैसे:-

(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;

(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;

(iii) ᮧदषूण उ᭜प᳖ न करने वाल ेलघ ुउ᳒ोग;

(iv) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुिवधाᲐ सहायक पाᳯरि᭭थितक पयᭅटन मᱶ सि᭥मिलत ᮕह वास; और

(v) संवᳶधत ᳰᮓयाकलाप जो परैा 4 मᱶ ᳰदए गए ह:ᱹ परंत ुयह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन के िबना तथा संिवधान के अनु᭒छेद 244 या त᭜समय ᮧवृᱫ िविध िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 भी ह,ै के उपबंधᲂ के अनुपालन के िबना, वािणि᭔यक और औ᳒ोिगक िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा:

परंत ुयह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ ᮧकट होने वाली कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात ्रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार ठीक कᳱ जाएगी और उᲦ ᮢुᳯट का सुधार कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को देनी होगी । परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का सुधार इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ करेगा । परंत ुयह और भी ᳰक हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और तथा वास जीणᲃ᳇ार ᳰᮓयाकलाप वाल ेअनᮧयु᭍ त या अनु᭜ पादक कृिष ᭃेᮢ ᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।

(2) ᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ, नᳰदयᲂ और आवाह ᭃेᮢᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और नवीकरण के िलए योजना सि᭥ मिलत होगी।

(3) पयᭅटन/पाᳯरि᭭थितक पयᭅटन पयᭅटन/पाᳯरि᭭थितक पयᭅटन पयᭅटन/पाᳯरि᭭थितक पयᭅटन पयᭅटन/पाᳯरि᭭थितक पयᭅटन –––– (क) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पाᳯरि᭭थितक पयᭅटन संबंधी ᳰᮓयाकलाप या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुसार हᲂगे । (ख) पाᳯरि᭭थितक पयᭅटन महायोजना रा᭔य पयᭅटन िवभाग, ᳇ारा रा᭔य के पयाᭅवरण और वन िवभाग के परामशᭅ से तैयार होगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक संघटक का भाग ᱨप होगा । (घ) पाᳯरि᭭थितक पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत:्-

(i) कावेरी व᭠यजीव अभयरा᭛य कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, जो भी िनकट हो, ᳰकसी होटल या ᳯरसोटᭅ का नया संि᳖माᭅण अनु᭄ात नहᱭ ᳰकया जाएगा पर᭠तु अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर कᳱ दरूी से परे पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक नए होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितक पाᳯरि᭭थित पयᭅटन सुिवधाᲐ के िलए पूवᭅ सीमांᳰकत और पदािभिहत ᭃेᮢᲂ मᱶ ही अनु᭄ात कᳱ जाएगी;

(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा जारी मागᭅदशᭅक िस᳍ांतᲂ के तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;

(iii) जब तक आंचिलक महायोजना का अनुमोदन नहᱭ कर ᳰदया जाता ह ै तब तक पयᭅटन संबंधी िवकास तथा िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार मानीटरी सिमित के वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा िसफाᳯरश के आधार पर स᭥बंिधत िविनयामक ᮧािधकारी ᳇ारा अनु᭄ात ᳰकया जाएगा ।

(4) नैसᳶगकनैसᳶगकनैसᳶगकनैसᳶगक िवरासतिवरासतिवरासतिवरासत---- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और िवरासत संरᭃण योजना आंचिलक महायोजना के भाग के ᱧप मᱶ पᳯररᭃण और संरᭃण के िलए तैयार कᳱ जाएगी ।

(5) मानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थल ल ल ल ---- पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण कᳱ योजनाएं आंचिलक महायोजना के भाग के ᱧप मᱶ तैयार कᳱ जाएगी ।

(6) ᭟ व᭟ व᭟ व᭟ विन ᮧदषूणिन ᮧदषूणिन ᮧदषूणिन ᮧदषूण – पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟विन ᮧदषूण िनवारण और िनयंᮢण पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के अधीन ᭟विन (िविनयमन और िनयंᮢण) िनयम 2000 के अनुसार ᳰकया जाएगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(7) वायुवायुवायुवायु ᮧदषूणᮧदषूणᮧदषूणᮧदषूण - पाᳯरि᭭थितक संवेदी जोन मᱶ िनयंᮢण िनवारण और वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम 1981 (1981 का 14) और इसके अधीन ᳰकए गए िनयमᲂ के अनुसार ᳰकया जाएगा ।

(8) बिह᮲ावबिह᮲ावबिह᮲ावबिह᮲ाव काकाकाका िन᭭सारणिन᭭सारणिन᭭सारणिन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के अ᭠तगᭅत आन ेवाल ेपयाᭅवरणीय ᮧदषूकᲂ के िन᭭सारण के िलए साधारण मानकᲂ या रा᭔य सरकार ᳇ारा िनयत मानकᲂ जो भी अिधक कठोर हᲂ के उपबंधᲂ के अनुसार होगा।

(9) ठोसठोसठोसठोस अपिश᳥ अपिश᳥ अपिश᳥ अपिश᳥ -------- ठोस अपिश᳥ᲂ का िनपटान और ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा-- (क) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ िनपटान और ᮧबंधन ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1357(अ) तारीख 8 अᮧलै, 2016 समय समय पर यथा संशोिधत ᳇ारा ᮧकािशत ᳰकए गए थ,े के अनुसार ᳰकया जाएगा और अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरण ᱧप से ᭭वीकायᭅ रीित मᱶ होगा;

(ख) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭭मीकरण और भूिम भराव के ᭭थापनᲂ को अनु᭄ात नहᱭ ᳰकया जाएगा ।

(10) जैव िचᳰक᭜ सीजैव िचᳰक᭜ सीजैव िचᳰक᭜ सीजैव िचᳰक᭜ सीय अपिश᭬ टय अपिश᭬ टय अपिश᭬ टय अपिश᭬ ट- जैव िचᳰक᭜ सीय अपिश᭬ ट ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा— (क) पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं.का.िन 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 समय समय पर यथा संशोिधत के अनुसार ᳰकया जाएगा । (ख) पाᳯरि᭭थितक संवेदी जोन मᱶ कोई सामा᭠य उपचार सुिवधा या भ᭭मीकरण अनु᭄ात नहᱭ ᳰकया जाएगा ।

(11) ᭡लाि᭭टक᭡लाि᭭टक᭡लाि᭭टक᭡लाि᭭टक अपिशअपिशअपिशअपिश᳥᳥᳥᳥ ᮧबधंनᮧबधंनᮧबधंनᮧबधंन: : : : ---- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं.का.िन 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 समय समय पर यथा संशोिधत के उपबंधᲂ के अनुसार ᳰकया जाएगा।

(12) संिनमाᭅणसंिनमाᭅणसंिनमाᭅणसंिनमाᭅण औरऔरऔरऔर िव᭟वसंिव᭟वसंिव᭟वसंिव᭟वसं अपिश᳥अपिश᳥अपिश᳥अपिश᳥ ᮧबधंनᮧबधंनᮧबधंनᮧबधंन: : : : ---- पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ िनपटान ᮧबंध भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं.का.िन 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 समय समय पर यथा संशोिधत के उपबंधᲂ के अनुसार ᳰकया जाएगा।

(13) ईईईई––––अपिश᳥अपिश᳥अपिश᳥अपिश᳥::::---- पाᳯरि᭭थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा ᮧकािशत ई–अपिश᳥ ᮧबंध िनयम, 2016 समय समय पर यथा संशोिधत के उपबंधᲂ के अनुसार ᳰकया जाएगा।

(14)यानीययानीययानीययानीय पᳯरवहन: पᳯरवहन: पᳯरवहन: पᳯरवहन: ---- यातायात का यानीय संचलन आवास के अनुकूल रीित मᱶ िविनयिमत होगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िविन᳸द᳥ उपबंध समािव᳥ ᳰकए जाएंग ेऔर आंचिलक महायोजना के तैयार होने तक और रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा के अनुमोᳰदत होने तक, मानीटरी सिमित सुसंगत अिधिनयमᲂ और तदधीन बनाए गए िनयमᲂ और िविनयमᲂ के अधीन यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।

(15)यानीययानीययानीययानीय ᮧदषूणᮧदषूणᮧदषूणᮧदषूण::::---- लाग ूिविधयᲂ के अनुसार यानीय ᮧदषूण कᳱ रोकथाम और िनयंᮢण ᳰकया जाएगा और ᭭व᭒छक ᲊधन उदाहरण के िलए सीएनजी, एलपीजी, आᳰद के उपयोग के िलए ᳰकए गए ᮧयास ᳰकए जाएंग े।

(16)औ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयां: : : : ---- (i) पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए ᮧदषूणकारी उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनुमित नहᱭ दी जाएगी।

(ii) फरवरी, 2016 मᱶ पाᳯरि᭭थितक संवेदी जोन के भीतर कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ िसफᭅ गैर- ᮧदषूणकारी उ᳒ोगᲂ का उ᳒ोगᲂ के वगᱮकरण कᳱ अनुमित दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ अ᭠यथा िविन᳸द᳥ न हो।

(17) पहाड़ीपहाड़ीपहाड़ीपहाड़ी ढलानᲂढलानᲂढलानᲂढलानᲂ कोकोकोको सरंᭃणसरंᭃणसरंᭃणसरंᭃण: : : : ---- पहाड़ी ढलानᲂ का संरᭃण िन᳜ानुसार होगा:

¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 (क) आंचिलक महायोजना पहाड़ी ढलानᲂ पर ᭃेᮢᲂ को वहां उपदᳶशत करेगी जहां ᳰकसी भी संिनमाᭅण कᳱ अनुमित नहᱭ दी जाएगी । (ख) कटाव कᳱ उᲬ िडᮕी वाले िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर ᳰकसी भी संिनमाᭅण कᳱ अनुमित नहᱭ दी जाएगी ।

(18)(18)(18)(18) के᭠ᮤीय सरकार और रा᭔य सरकार, यᳰद वह यह आव᭫यक समझे तो इस अिधसूचना के उपबंधᲂ को ᮧभावी करने मᱶ अ᭠य अितᳯरᲦ उपायᲂ को िविन᳸द᳥ करेगी।

1. वािणि᭔यक खनन, प᭜थर उ᭜ खनन और उनको तोड़ने कᳱ इकाइयां । (क) सभी ᮧकार के खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ को पूरा करने के िसवाय तुर᭠त ᮧभाव से ᮧितिष᳍ होगी िजसमᱶ िनजी उपभोग के िलए मकानᲂ के संि᳖माᭅण या मर᭥मत के िलए भूिम को खोदना और मकान बनाने के िलए दशेी टाइलᲂ या ईटᲂ का िनमाᭅण भी सि᭥मिलत है;

(ख) माननीय उᲬतम ᭠यायालय के ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गोᳲवदरामन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के आदशे के अनुसार खनन संᳰᮓयाएं कᳱ जाएंगी ।

2. ᮧदषूण (जल या वायु या मृदा या ᭟ विन) काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । कोई नया उ᳒ोग और पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧदषूण फैलाने वाले उ᳒ोगᲂ के िव᭭तार कᳱ अनुमित नहᱭ दी जाएगी। पाᳯरि᭭थितक संवेदी जोन के भीतर कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा फरवरी, 2016 मᱶ जारी ᳰदशािनदᱷशᲂ मᱶ उ᳒ोगᲂ के वगᱮकरण के अनुसार िसफᭅ गैर- ᮧदषूणकारी उ᳒ोगᲂ को अनु᭄ात ᳰकया जाएगा, जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᳥ न हो।

3. नए बृहत जल िव᳒ुत पᳯरयोजनाᲐ कᳱ ᭭ थापना । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

4. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन या ᮧसं᭭करण । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

5. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

6. ठोस अपिश᳥ िनपटान ᭭थल और ठोस और जैव िचᳰक᭜सा अपिश᳥ के िलए सामा᭠य जलाए जाने कᳱ सुिवधा कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ कᳱ कोई नई ठोस अपिश᳥ िनपटान ᭭थल और अपिश᳥ उपचार या ᮧसं᭭करण सुिवधा कᳱ अनुमित नहᱭ होगी। इसके अितᳯरᲦ औ᳒ोिगक ᮧᳰᮓया और ᭭वा᭭᭝य ᮧित᳧ान, अ᭭पतालᲂ आᳰद स े उ᭜प᳖ ᳰकसी भी ठोस अपिश᳥ ᳰकसी भी के उपचार के िलए सामा᭠य या ᳞िᲦगत भ᭭मीकरण कᳱ सुिवधा का सं᭭थापन ᮧितिष᳍ ह।ै 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

7. फमᲄ, कॉपᲃरेट, कंपिनयᲂ आᳰद ᳇ारा बड़े पैमाने पर वािणि᭔यक पशुधन संपदा और कु᭍कुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को पूरा करने के िसवाय लागू िविधयᲂ के अनुसार (यथा अ᭠ यथा उपबंिधत के िसवाय) ᮧितिष᳍ हᲂगे।

8. नई आरा िमलᲂ कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नई या िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।

9. ᲊट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार (अ᭠ यथा उपबंिधत के िसवाय) ᮧितिष᳍ हᲂगे ।

10. जलावन लकिड़यᲂ का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार (अ᭠ यथा उपबंिधत के िसवाय) ᮧितिष᳍ हᲂगे । ख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलाप

11. वािणि᭔यक होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलापᲂ संबंधी लघु अ᭭थायी संरचनाᲐ के के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगेः परंतु, जहाँ संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर से ह ै पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक वहां एक जो भी िनकट हो सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना और यथा लागू मागᭅदशᱮ िस᳍ांतᲂ के अनुᱧप होगा।

12. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो, कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:

परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ िविन᳸द᳥ ᳰᮓयाकलापᲂ सिहत उनके उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ अनुमित ᭭थानीय िनवािसयᲂ कᳱ आवासीय आव᭫यकताᲐ को पूरा करने के िलए भवन उपिविधयᲂ के अनुसार दी जाएगी ।

(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;

(ii) अवसंरचना और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;

(iii) कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी वगᱮकरण के अनुसार िनबंिधत गैर- ᮧदषूणकारी लघु उ᳒ोग ;

(iv) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुख सुिवधाएं जो पाᳯरि᭭थितक पयᭅटन िजस मᱶ गृह वास मᱶ सहायक है; और

(v) इस अिधसूचना मᱶ संवᳶधत ᳰᮓयाकलापᲂ कᳱ सूची :

(ख) ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते ह,ᱹ से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंगे । (ग) एक ᳰकलोमीटर से आगे आंचिलक महायोजना कᳱ अनुसार िविनयिमत हᲂगे ।

13. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । फरवरी, 2016 मᱶ के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी उ᳒ोगᲂ मᱶ वगᱮकरण के अनुसार गैर-ᮧदषूणकारी उ᳒ोग और अपᳯरसंकटमय लघु और ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 सेवा उ᳒ोग, कृिष, पु᭬प कृिष, उ᳒ान कृिष या पाᳯरि᭭थितक संवेदी जोन से दशेी सामᮕी से उ᭜पादᲂ को उ᭜प᳖ करने वाले कृिष आधाᳯरत उ᳒ोग सᭃम ᮧािधकारी ᳇ारा अनु᭄ात हᲂगे।

14. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन कᳱ सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।

15. वन उ᭜पादᲂ या गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण (एनटीएफपी) । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

16. िव᳒ुत और दरूसंचार टावरᲂ का पᳯरिनमाᭅण और केबल िबछाना और अ᭠य बुिनयादी ढांचे। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे (भूिमगत केबल िबछाए जान े को बढ़ावा ᳰदया जाएगा)।

17. नागᳯरक सुख सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ िनयमᲂ और िविनयमᲂ तथा मागᭅदशᱮ िस᳍ातंᲂ के अनुसार ᭠यूनीकरण के उपायᲂ के साथ, ᳰकए जाएंगे ।

18. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संि᳖माᭅण । लागू िविधयᲂ िनयमᲂ और िविनयमᲂ तथा मागᭅदशᱮ िस᳍ातंᲂ के अनुसार ᭠यूनीकरण के उपायᲂ के साथ, ᳰकए जाएंगे ।

19. पयᭅटन से संबंिधत अ᭠य ᳰᮓयाकलापᲂ जैसे गमᭅ वायु गु᭣बारᱶ, हेलीका᭡टर, ᮟोन, माइᮓोलाइटस आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना, का ᳰकया जाना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

20. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

21. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।

22. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ द᭏ुधशाला, डेरी कृिष, जलकृिष और मछली पालन । ᭭थानीय लोगᲂ के उपयोग के िलए लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।

23. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत अपिश᳥ जल या बिह᮲ाᭅव का िन᭭सारण ।।।। उपचाᳯरत अपिश᳥ जल या बिह᮲ाᭅवᲂ का िन᭭सारण जल िनकायᲂ मᱶ ᮧवेश नहᱭ करने ᳰदया जाएगा और उपचाᳯरत अपिश᳥ जल के पुनःचᮓण और पुनः उपयोग के िलए ᮧयास ᳰकए जाएंगे तथा उपचाᳯरत अपिश᳥ के िलए ᮧयास ᳰकए जाएंगे तथा उपचाᳯरत अपिश᳥ जल या बिह᮲ाᭅव के िन᭭सारण को लागू िविधयᲂ के अनुसार िविनयिमत ᳰकया जाएगा।

24. सतह और भूजल के वािणि᭔यक िन᭬कषᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

25. खुले कुआ, बोर कुआ, आᳰद के िलए कृिष या अ᭠य उपयोग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे और संब᳍ ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ कᳱ स᭎ती से मानीटरी कᳱ जाएगी।

26. ठोस अपिश᭬ ट ᮧबंधन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

27. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

28. पाᳯरि᭭थितक-पयᭅटन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

29. पोिलथीन बैगᲂ का उपयोग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(ग) माननीय िवधान सभा सद᭭ य, मालावली िनवाᭅचन ᭃेᮢ, मंडया िजला - सद᭭ य;

(घ) माननीय िवधान सभा सद᭭ य, कनकपुरा िनवाᭅचन ᭃेᮢ, रामानगर िजला - सद᭭ य;

(ड.) पयाᭅवरण िवभाग, कनाᭅटक सरकार का ᮧितिनिध -सद᭭ य ;

(च) शहरी िवकास िवभाग, कनाᭅटक सरकार का ᮧितिनिध -सद᭭ य ;

(झ) कनाᭅटक रा᭔य िव᭎यात सं᭭था या िव᳡िव᳒ालय से पाᳯरि᭭थितकᳱ मᱶ कनाᭅटक सरकार ᳇ारा तीन वषᭅ के िलए नािमत ᳰकए जाने वाला एक िवशेष᭄ - सद᭭य ;

(ञ) रा᭔य जैव-िविवधता बोडᭅ का सद᭭य (ट) उपायु᭍ त या उसका ᮧितिनिध, चमराजानगर, मंडया और रामानगर -सद᭭ य ;

(ठ)उप वन संरᭃक, कावेरी व᭠ यजीव अभयार᭛य, को᭨लगेल -सद᭭ य सिचव । * (अ᭠ य बातᲂ के साथ, सुसंगत अनुमोदन अिभᮧा᭡ त करते ᱟए, कनाᭅटक सरकार िजसके अंतगᭅत अ᭟ यᭃ, िवधान सभा, कनाᭅटक से अन᭄ुा भी ह,ै यᳰद अपेिᭃत हो, के अ᭟ यधीन)

(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंत ुपाᳯरि᭭थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।

(5) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ उपायु᭍ त, ऐसे ᳞िᲦ के िवᱨ᳍, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लघंन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन े के िलए सᭃम होगा ।

(6) मानीटरी सिमित मु᳎ा दर मु᳎ा के आधार पर अपेᭃाᲐ पर िनभᭅर रहत े ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपन ेिवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

(7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मु᭎य जीव वाडᭅन उपाबधंउपाबधंउपाबधंउपाबधं VIIVIIVIIVII मᱶ उपबंिधत ᱨप िवधान के अनुसार उ᭍ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।

(8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपन े कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे ।

बना᳖ ेऔर स᭥बापुरा ᮕाम। इसके बाद यह भी िचलानदावदी आरिᭃत वन के संलᲨ ᮕामᲂ मᱶ सि᭥मिलत ह ै जैसे ह᭏ेगानुर, वीरासानदरा, चीलानदवदी, संगम, बो᭥मासानदरा, ᱠलया और मᲥाला᭠धा ᮕाम । मु᭏गरु आरिᭃत वन के संलᲨ ᮕामᲂ मᱶ AND WHEREAS , the copies of the Gazette containing the said draft notification were made available to the public on the 4th march, 2016;

AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the draft notification were duly considered by the Central government;

AND WHEREAS, the Cauvery Wildlife Sanctuary which was notified vide notification of the Government of Karnataka No. FEE 302 FWL 2011- (IV), dated the 27th November, 2011, is spread over an area of 1027.53 square kilometers within the three districts of Karnataka, namely, Ramanagara (Kanakapura Taluk), Chamrajnagara (Kollegala Taluk) and Mandya (Malavalli Taluk) and lies between the North Latitudes 11° 56' 54.38" N to 12° 24' 35.78" N and the East Longitudes 77° 09' 41.02" E to 77° 46' 39.84" E;

AND WHEREAS, the Cauvery Wildlife Sanctuary forms an important part of the South Indian Dry Deciduous type forests of Karnataka, which are traditionally known to be the best and potential habitats for tigers and its prey and also forms part of the 6724.87 square kilometres Mysore Elephant Reserve declared by the Government of Karnataka vide notification No. FEE 231 FWL 2000, dated the 25th November,2002, with the due approval of Project Elephant, Ministry of Forest and Environment, Government of India and supports good densities of Asian elephants depicting the ecological importance of the Sanctuary;

AND WHEREAS, the Cauvery Wildlife Sanctuary is connected to Biligiri Ranganathaswamy Temple Tiger Reserve through Malai Mahadeswara Wildlife Sanctuary and Edyarahalli-Doddasampige Reserved Forests corridor on the south-western side and the Sanctuary is connected to Bannerghatta National Park through Ramdevarabetta-Chavarkal Reserve Forest corridor on the northern side;

AND WHEREAS, the Sanctuary is natural habitat for some of the large mammals like the Royal Bengal tiger (Panthera tigris), leopard (Panthera pardus), dhole or wild dog (Cuon alpinus), jackal (Canis aureus), stripped hyena (Hyaena hyaena), Indian fox (Vulpus bengalensis), sloth bear (Melursus ursinus), small Indian civet (Viverricula indica), Asian palm civet (Paradoxurus hermaphroditus), jungle cat (Felis chaus), rusty-spotted cat (Prionailurus rubiginosus), grey mongoose (Herpestes edwardsii) and ruddy mongoose (Herpestes smithii), etc., among the carnivores and some of the ungulates/herbivores/prey species found in this Sanctuary include the gaur (Bos gaurus), sambar deer (Rusa unicolor), chital or Spotted deer (Axis axis), wild pig (Sus scrofa), four-horned antelope or Chowsingha (Tetracerus quadricornis), Blackbuck or Indian antelope (Antilope cervicapra), Barking deer or Indian muntjac (Muntiacus muntjak) and Mouse deer or Indian chevrotain (Moschiola indica) and Black-naped hare (Lepus nigricollis nigricollis), etc;

AND WHEREAS, the riparian forest of the Cauvery Wildlife Sanctuary is the only habitat in the State of Karnataka for near threatened (International Union for Conservation of Nature) species of grizzled giant squirrel (Ratufa macroura) which is endemic to southern India and Sri Lanka and very recently Honey badger or Ratel (Mellivora capensis) has been camera trapped and recorded for the first time from the Cauvery wildlife sanctuary, which indicate the importance and uniqueness of the Cauvery Wildlife Sanctuary in terms of protection and conservation of rare, endangered and threatened (RET) species;

AND WHEREAS, the river Cauvery flowing at middle of the Wildlife Sanctuary remains home for the endangered and endemic fish species called Deccan Mahsheer (Tor khurdee), an important freshwater flagship species and the riverine ecosystem of Cauvery Wildlife Sanctuary is also the last remaining strongholds of the vulnerable species like smooth-coated otter (Lutra perspicillata), Oriental small clawed otter (Aonyx cinerea) and common otter (Lutra lutra) and this special habitat of the Wildlife Sanctuary also support other aquatic species like mugger or the marsh crocodile (Crocodylus palustris) and soft shelled turtle (Aspideretes gangeticus);

AND WHEREAS, the Cauvery Wildlife Sanctuary also supports the Endangered Indian Pangolin (Manis crassicaudata), an Endemic Madras tree shrew (Anathana ellioti) and Near Threatened and Endemic Kollegal ground gecko (Geckoella collegalensis);

AND WHEREAS, Cauvery Wildlife Sanctuary is designated as Important Bird Area (IBA) by BirdLife International in the year 2004, as it support more than 280 species of birds, which includes critically endangered white-rumped vulture (Gyps bengalensis) and Indian vulture (Gyps indicus), Near Threatened 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Red-headed Vulture (Sarcogyps calvus) and some of the rare and vulnerable bird species reported from Cauvery includes Nilgiri wood-pigeon (Columba elphinstonii), greater spotted eagle (Clanga clanga), whitenaped tit (Parus nuchalis), Pied-crested Tit (Parus nuchalis), and yellow-throated bulbul (Pycnonotus xantholaemus) and the Sanctuary support some of the migratory birds like European bee-eater (Merops apiaster), western Ghats species like Indian courser (Cursorius coromandelicus) and Malabar parakeet (Psittacula columboides) and is important wintering area for the globally threatened Greater Spotted Eagle (Aquila clanga or Clunga clunga);

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of the Cauvery Wildlife sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.

NOW THEREFORE, in exercise of the powers conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 1.0 kilometer to 14.5 kilometers around the boundary of the Cauvery Wildlife Sanctuary in the State of Karnataka as the Cauvery Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and Boundaries of Eco-sensitive Zone.—

(1) The total geographical area of Eco-sensitive Zone is 600.7 square kilometers with an extent varying from 1.0 kilometer to 14.5 kilometers around the boundary of the Cauvery Wildlife Sanctuary and the boundary details of the said Zone is given in Annexure–I .

(2) The Eco-sensitive Zone of Cauvery Wildlife Sanctuary includes 72 revenue villages with a geographical area of 501.25 square kilometer located outside the boundary of Cauvery Wildlife Sanctuary and is spread across three Talukas of three different districts and there are 28 revenue villages present in the Eco-sensitive Zone of Kollegal Taluk (Chamarajanagar district), 21 revenue villages present in the Eco-sensitive Zone of Malavalli Taluk (Mandya district) and 23 revenue villages present in the Eco-sensitive Zone of Kanakapura Taluk (Ramanagara district), and the Eco-sensitive Zone of Cauvery Wildlife Sanctuary also includes 35 enclosures villages (forest villages) present within the outer boundary of the Cauvery Wildlife Sanctuary with the total geographical area of 38.79 square kilometer.

(3) The list of 107 villages (including 35 forest villages/enclosure villages) located within the Ecosensitive Zone of Cauvery Wildlife Sanctuary is appended as Annexure-II.

(4) The 107 villages which forms part of the Eco-sensitive Zone of Cauvery Wildlife Sanctuary includes Sathegal Jagir forest (about 37.66 square kilometers area notified by the Government of Karnataka under section 4 of the Karnataka Forest Act,1963 abutting the Cauvery Wildlife Sanctuary) and 3.12 square kilometers area of Ikkadahalli gudda abutting Hanur State Forest of Cauvery Wildlife Sanctuary and the detail of the said notified area located within the Eco-sensitive Zone of Cauvery Wildlife Sanctuary is appended as Annexure –III.

(5) Two Reserved Forests abutting the Cauvery Wildlife Sanctuary in the Ramanagara district were also included as part of Eco-sensitive Zone of Cauvery Wildlife Sanctuary and the total area of these two Reserve Forests located outside the said wildlife sanctuary boundary, but within the Eco-sensitive Zone boundary is calculated as 19.8862 square kilometers; and the list of reserved forests located within the Eco-sensitive Zone is appended as Annexure –IV .

(6) The legal status of the lands present within the Eco-sensitive Zone boundary are mainly revenue lands, patta lands, enclosures, reserved forests, forests notified under section-4 of the Karnataka Forest Act,1963, deemed forest area, roads and ponds, etc.

(7) The map of the Eco-sensitive Zone along with boundary details and latitude and longitude is appended as Annexure – V .

(8) The Geo Coordinates of major points on the boundary of Cauvery Wildlife Sanctuary and on the boundary of Eco-sensitive Zone is appended as Annexure-VI.

2. Zonal Master Plan for the Eco-sensitive Zone.-

(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan, namely:-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Municipal;

(x) Panchayati Raj;

(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated and promoted activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities.

(8) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government.— The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities:

Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of the local residents and for activities such as,-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and

(v) promoted activities given in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.- The catchment areas of all natural springs, rivers and channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.

(3) Tourism/ Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b)The Eco-Tourism Master Plan shall be prepared by State Department of Tourism in consultation with State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The activities of eco-tourism shall be regulated as under, namely:-

(i) no new construction of hotels and resorts shall be allowed within one kilometre from the boundary of the Cauvery Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer provided that, beyond the distance of one kilometre from the boundary of the Sanctuary till the extent of the Ecosensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan.

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;

(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution.- Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes.- Disposal and management of solid wastes shall be as under:-

(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), the dated 8th April, 2016 as amended from time to time, and the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone;

(b)No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Ecosensitive Zone.

(10) Bio-medical waste.- Bio- medical waste management shall be as under:-

(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time;

(b) no common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.

(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.

(12) Construction and demolition waste management. - The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.

(13) E-waste.- The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change as amended from time to time.

(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example CNG, etc.

(16) Industrial units.- (i) No new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.

(a) (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption .

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 04th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs.

UOI in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (water, air, soil, noise, etc.)

(a) No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.

(b) Only non-polluting industries may shall be permitted within Ecosensitive zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification.

3. Establishment of major hydroelectric projects.

Prohibited (except as otherwise provided) as per applicable laws.

4. Use or production or processing of any hazardous substances.

Prohibited (except as otherwise provided) as per applicable laws.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited (except as otherwise provided) as per applicable laws

6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste .

No new solid waste disposal site and waste treatment or processing facility of solid waste shall be permitted within Eco-sensitive Zone and installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishments, hospitals, etc. shall be prohibited.

7. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc.

Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.

8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.

10. Commercial use of fire wood Prohibited (except as otherwise provided) as per applicable laws.

B. Regulated Activities

11. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Ecosensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:

Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone , whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

12. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities specified in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:

(i) Widening and strengthening of existing roads and construction of new roads;

(ii) Construction and renovation of infrastructure and civic amenities;

(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;

(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and

(v) Promoted activities listed in this Notification.

(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.

13. Small scale non polluting industries.

Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.

14. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.

15. Collection of forest produce or Non-Timber Forest Produce (NTFP).

Regulated under applicable laws.

16. Erection of electrical and communication towers and laying of cables and other infrastructures.

Regulated under applicable laws (Underground cabling may be promoted).

17. Infrastructure including civic amenities.

Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

18. Widening and strengthening of existing roads and construction of new roads.

Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

19. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

20. Protection of hill slopes and river banks.

21. Movement of vehicular traffic at night.

Regulated for commercial purpose under applicable laws.

22. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

23. Discharge of treated waste water or effluents in natural water bodies or land area.

The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water, and the discharge of treated waste water or effluent shall be regulated as per applicable laws.

24. Commercial extraction of surface and ground water.

Regulated under applicable laws.

25. Open well, bore well, etc. for agriculture or other usage.

Regulated under applicable laws and the activity shall be strictly monitored by the concerned authority.

26. Solid waste management. Regulated under applicable laws.

27. Introduction of exotic species. Regulated under applicable laws.

28. Eco-tourism. Regulated under applicable laws.

29. Use of polythene bags. Regulated under applicable laws.

30. Commercial Sign boards and hoardings.

33. Adoption of green technology for all activities.

5. Monitoring Committee.- (1)T he Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-

(a) Regional Commissioner, Mysore - Chairman;

(b) Hon’ble Member of Legislative Assembly, Hanur Constituency, Chamarajanagar District* - Member;

(c) Hon’ble Member of Legislative Assembly, Malavalli Constituency, Mandya District * - Member;

(d) Hon’ble Member of Legislative Assembly, Kanakapura Constituency, Ramanagara District* - Member;

(e) Representative of the Department of Environment, Government of Karnataka - Member;

(f) Representative of the Department of Urban Development, Government of Karnataka - Member;

(g) Representative of non-Governmental Organisations working in the field of nature conservation (including heritage conservation) to be nominated by the Government of Karnataka for three years - Member;

(h) Regional Officer, Karnataka State Pollution Control Board, Mysore - Member;

(i) One expert in Ecology from reputed Institution or University of the State of Karnataka to be nominated by the Government of Karnataka - Member;

for three years

(j) Member, State Biodiversity Board - Member;

(k) Deputy Commissioner or his representative, Chamarajanagar, - Member;

Mandya and Ramanagar

(l) The Deputy Conservator of Forests, Cauvery - Member Secretary.

Wildlife Sanctuary Kollegal * (Subject to the State Government of Karnataka obtaining relevant approvals inter alia including permission from the Speaker of Legislative Assembly, Karnataka, if required)

6. Terms of reference.-

(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring Committee shall be three years.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table

36. Agro-forestry. Shall be actively promoted.

37. Use of eco-friendly transport. Shall be actively promoted.

38. Skill development. Shall be actively promoted.

39. Restoration of degraded land/ forests/ habitat.

Shall be actively promoted.

40. Environmental awareness. Shall be actively promoted.

(5) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-VII.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional Measures.-The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. Orders of Supreme Court, etc.-The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.

The Survey numbers of the above mentioned villages of Kanakapura Taluk are included in the eco-sensitive zone which are within 1000 meters distance from the boundary of the Cauvery Wildlife Sanctuary. Survey numbers which are not included above but are within 1000 meters distance from the boundary of Cauvery Wildlife Sanctuary are also included in the eco-sensitive zone.

The Eco-sensitive zone consists of following enclosure villages of Basavanabetta Reserved forest Talavadi, Basavegowdanadoddi, Dalanakatte, Solaba, Muthalakatte, Basavanahalli, Konangundi, Soligere, Muthathi, Kurimande, Bananne and Sambapura villages. Then it also includes enclosure villages of Chilandavadi Reserved forest like Hegganur, Veerasandra, Cheelandvadi, Sangam, Bommasandra, Hoolya and Makkalandha villages. The enclosure villages of Muggur Reserved forest include Muggur, Kongevadi and Madivala villages. Then it also includes Honniganahalli village located within the Chavarkal Reserved forest.

East: At Eastern side, the boundary line of Cauvery Wildlife Sanctuary Eco-Sensitive Zone begins from interstate boundary of Karnataka and Tamilnadu starting from point where Hunasanahalli ends with interstate border and runs along interstate border till the line meets river Cauvery and continues up to point where Palar river meets river Cauvery. Then the boundary line further continues all along the boundary line of Cauvery Wildlife Sanctuary and Malai Mahadeswara Wildlife Sanctuary.

The Eco-sensitive zone consists of following enclosure villages of Mahadeshwara Malai Reserve Forest viz., Padasalanatta, Thekani (Nagamalai), Gopinatham, Panchalane, Bejjalane, Dantalli, Indiganatta villages. Hogennakal and Alambadi are not revenue enclosure, but an encroached forest lands.

South: At southern side, the boundary line of of Cauvery Wildlife Sanctuary Eco-sensitive Zone starts from a junction point where Palar River meets Cauvery River in the interstate border. Then the boundary further continues along the boundary of Cauvery Wildlife Sanctuary and Malai Mahadeswara Wildlife Sanctuary.

Then the line meets southern boundary of Cauvery Wildlife Sanctuary and moves along the D-line of the Sanctuary and meets village boundary of Kuratti Hosur, Shettahalli, Badrayyanahalli, Koudalli, Doddalathur, Changadarahalli and Edyarahalli Reserve Forest touching southern boundary of Changadarahalli and meets the tri-junction point of Ramapura, Ajjipura and Changadarahalli. Survey numbers 772, 769, 273, 280, 277, 276, 274, 292, 275, 279, 278, 767, 748, 768, 750, 751, 290, 289, 788, 288, 287, 293, 770, 295, 292, 294, 771, 419, 420, 421, 434, 423, 424, 425, 437, 436, 773, 438, 439, 440, 441, 446, 448, 447 and 449 of Ajjipura village are included in the eco-sensitive zone of Cauvery Wildlife Sanctuary. And grama thana limits of Ajjipura village does not fall under Eco-sensitive zone. Then the line runs along the border of Hanur Reserve Forest boundary in the northern direction along the border of Chinnagudda. Then the line moves along northern part of Hanur Reserve Forest in the western direction till a cart track which runs northern and eastern direction touches Tatte Halla and then the line runs all along Tatte Halla till Tatte Halla meets Dodda Halla.

The line moves towards west along Dodda Halla passing through Managalli, Chinchahalli, Gundapura and then meets the Mangala village. Then the line moves in the southern direction all along the common boundary of Gundapura and Mangala and touches at a distance of 100 meters from Kollegal-Ramapura Road. Then the Eco-sensitive Zone boundary line runs all along 100 meters distance from the Kollegal-Ramapura Road till the point where it touches the irrigation channel at Doddinduvadi. Then it takes northern direction moves all along the channel and passes through villages Chikkinduvadi, Palya, Uganeeya, Sathegala and touches a road which connects Gavipuram Temple to Bharachukki road. Then the boundary line runs along the 100 meters distance parallel to the National Highway 209 and then crosses the river Cauvery along the bridge.

The Eco-Sensitive Zone includes following enclosure villages namely Arabgere in Cowdally Reserve Forest and Ganigamangala in Chikkyalur Reserve Forest.

West: On the western side, the Eco-Sensitive Zone boundary line of Cauvery Wildlife Sanctuary starts from 1000 meters distance from the Sanctuary boundary on the West direction of Shivansamudra. Then the boundary line moves towards North-western side of Belakavadi village, then the line moves towards northern side of Gaganachukki and then the line move towards northern side of Hosahalli village. Then the boundary line move towards South-eastern side of Manchanahalli village by crossing the main power line of Shivanasamudra Power Generation unit. Then the line move towards South-western side of Hebbani village and then the line move towards South-western side of Nettkal Betta by crossing Nettkallu to Chottanahalli road. Then the boundary line move towards south-western side of Dabbahalli and it move towards southwestern side of Dabbahalli. Then the line move towards south-western side of Dhanagur by crossing Hulaballa. Later, the line move towards southern side of the Halashalli village and then it move towards North western side of Ganalu crossing main power line & Shimsha River. Later, the line move towards Southwestern side of Byadarahalli and then it move towards southern side of the Doddayelachagere by crossing the main power line and then the line joins at the south side of Chikka yelachagere village.
