PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2395] ubZ fnYyh] eaxyokj] vxLr 22] 2017@Jko.k 31] 1939 No. 2395] NEW DELHI, TUESDAY, AUGUST 22, 2017/SRAVANA 31, 1939 पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢ ालय अिधसचूना नई िदल्ली, 22 अगस्त, 2017 का.आ 2734(अ).—भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न की अिधसूचना सं.का.आ.1247(अ) तारीख 29 माचर्, 2016 ᳇ारा भारत के राजपᮢ, आसाधारण मᱶ ᮧकािशत की गई थी, उन सभी ᳞िᲦयᲂ से िजनके उससे ᮧभािवत होने की संभावना थी, उᲦ अिधसूचना के राजपᮢ की ᮧितयां, जनता को उपलब्ध होने की तारीख से साठ िदन की अविध के भीतर आक्षेप और सुझाव आमंिᮢत िकए गए थ;े और, ᮧारुप अिधसूचना के ᮧितउᱫर मᱶ सभी ᳞िᲦयᲂ और पणधािरयᲂ से ᮧा᳙ आक्षेपᲂ और सुक्षावᲂ पर केन्ᮤीय सरकार ᳇ारा िवचार कर िलया गया ह;ै और, जलदापाडा रा᳦ीय उ᳒ान, पि᳟म बंगाल के अलीपुर᳇ार िजले मᱶ 234.51 वगर् िकलोमीटर मᱶ फैला हुआ ह।ै रा᳦ीय उ᳒ान सघन मानव जनसंख्या से िघरा हुआ ह।ै उ᳒ान कोछबेहर िजला मᱶ भूटान पहािड़यᲂ से लेकर तेराई सीमा तक फैला हुआ ह।ै यह के्षᮢ पािरिस्थितक भंगुर और पािरिस्थितक संवेदी ह।ै उ᳒ान के बाहर के िᮓयाकलाप/उ᳒ोग उ᳒ान के िनवास स्थान और पानी की ᳞वस्था को ᮧभािवत करते ह।ᱹ जलदापाडा रा᳦ीय उ᳒ान के आसपास के िᮓयाकलाप मᱶ कुछ िनयमन का ᮧयोग िकया जाता ह,ै तो शेष चरागाहᲂ और ᮧजाितयᲂ पर िनभर्र रहने के िलए उन्हᱶ जीिवत रहने का बेहतर मौका िमलता ह।ै मानव और पशुᲐ की बढ़ती जनसंख्या से रा᳦ीय उ᳒ान के संसाधनᲂ पर भारी दबाव डाला जा रहा ह।ै के्षᮢ के ᮧमुख आिथर्क िᮓयाकलाप कृिष, चाय बागान, मवेशी चराई हᱹ और उ᳒ान ᮧशासन ने पािरिस्थितक पयर्टन को बढ़ाकर और संयुᲦ वन ᮧबंधन के जिरए वन संसाधनᲂ की िनभर्रता कम करने की कोिशश की ह;ै और, इस अभयारण्य मᱶ वनस्पित और जीवजन्तु की समृ जैिवक महᱫा इसकी िवशेषता ह।ै जलदापाडा रा᳦ीय उ᳒ान मᱶ कुल 585 पहचाने गए पौधᲂ की ᮧजाितयां शािमल ह ᱹिजसमᱶ 429 जीनस, 111 पिरवारᲂ मᱶ 91 घास ᮧजाितयां और 19 आ᳸कर् ड ᮧजाितयां सिम्मिलत ह।ै क्षेᮢ की वनस्पित मᱶ साल (सोरेअ रोबुसता), चीलायनी 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (सकीमा वाल्लीची), चीकरासी (चुकरासीअ टेबुलारीस), चैम्प (मीचालीअ चामपका), बहरेा (टेरमीनालीआ बेलारीका), सीधा (लागेरᮝेरोइमीअ पारवीफलोरा), पनीसाज (टेरमीनालीआ मायरीओकारमा), लमपाटी (दअुबानगा सो᳖ेराटीओडेस), लाली (अमौरा वाल्लीची), लाहासुने (अमौरा रोहीतुका), कैनजल (बीसस्कोफा जावानीका), सीमुल (बोमब्क्स कीबा), खैर (अकैिशआ कटेचु), सीसस ू (डालबैिरया सीसस)ू, सीरीस (सीसस ू अलिबिजआ स्पा.) ह।ᱹ जलदापाडा वन्यजीव अभयारण्य मᱶ बृहत पािरिस्थितक महत्व ह ै क्यᲂिक यह नेपाल और असम के बाहर बृहत भारतीय एक-सᱭग वाले गᱹडा के िलए जीन पूल आरिक्षत बनाता ह।ै जलदापाडा मᱶ मांसाहारी और शाकाहारी की 33 ᮧजाित यां ह,ᱹ लगभग पिक्ष यᲂ की 246 ᮧजाितया,ं सरीसृप की 29 ᮧजाितयां कछुए की 8 ᮧजाितया,ं मछिलयᲂ की 54 ᮧजाितयां और अन्य सू᭯मजीवᲂ की ᮧजाितयां जैसे गᱹडा(रीहीनोकेरोस यूनीकोरनीस), हाथी (ऐलीफस मैᲥीमुस), तᱶदआु (पैथैरा पारडूस), गौर (बौस गअरूस), हॉग बेजर(अरकटोनयक कोल्लारीस), रीछ (मेलुरसुस अरसीनुस), िहिस्पड खरगोश (कापरोलागुस हीसपीडूस), बंगाल फ्लोिरᲣ (इयपोडोटीस बेनगालेनसीस), पायथन (पायथन रेटीकूलाटूस), इंिडयन साल (मनीस करासीसीकायडाटा) ह;ᱹ और, जलदापाडा रा᳦ीय उ᳒ान, के चारᲂ ओर के क्षेᮢ को, िजसका िवस्तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸दर᳥् ह,ᱹ पािरिस्थितक तथा पयार्वरण की दिृ᳥ से पािरिस्थितक संवेदी जोन के रूप मᱶ सुरिक्षत और संरिक्षत करना तथा उᲦ पािरिस्थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ का ᮧचालन तथा ᮧसंस्करण करने को ᮧितिष करना आवश्यक ह ै;
अतः, अब, केन्ᮤीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पिठत पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड
(xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते हुए, पि᳟म बंगाल राज्य मᱶ जलदापाडा रा᳦ीय उ᳒ान, की सीमा से 5 िकलोमीटर के के्षᮢ को जलदापाडा रा᳦ीय उ᳒ान, पािरिस् थितक संवेदी जोन (िजसे इसमᱶ इसके पश् चात् पािरिस् थितक संवेदी जोन कहा गया ह)ै के रूप मᱶ अिधसिूचत करती ह,ै िजसके ब्यौरे िन᳜ानुसार ह,ै अथार्त् :--
1. पािरिस्थितक सवंदेी जोन का िवस्तार और उसकी सीमाएं-(1) पािरिस्थितक संवेदी जोन के जलदापाडा रा᳦ीय उ᳒ान के चारᲂ ओर शून्य (भूटान के िनकटवतᱮ उᱫरी भाग पर) से 5.0 िकलोमीटर तक क्षेᮢ 458 वगर् िकलोमीटर मᱶ फैला ह ैऔर इस जोन की सीमा का िववरण उपाबधं I के रूप मᱶ उपाब ह।ै
(2) पािरिस्थितक संवेदी जोन के भीतर आने वाले ᮕामᲂ की सूची मुख्य िबन्दᲐु के भू-िनदᱷशांक उपाबधं II के रूप मᱶ उपाब ह।ै
(3) पािरिस्थितक संवेदी जोन का मानिचᮢ उसकी सीमा के ब्यौरᲂ और अक्षांश और दशेांतर सिहत उपाबधं III के रूप मᱶ उपाब ह।ै
2. पािरिस्थितक सवंदेी जोन के िलए आंचिलक महायोजना – (1) राज्य सरकार, पािरिस्थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन की तारीख स ेदो वषर् की अविध के भीतर, स्थानीय ᳞िᲦयᲂ के परामशर् से और इस अिधसूचना मᱶ िदए गए अनुबंधᲂ का पालन करते हुए आंचिलक महायोजना तैयार करेगी।
(2) राज्य सरकार ᳇ारा पािरिस् थितक संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित जो इस अिधसूचना मᱶ िविन᳸दर्ष् ट ह ैतथा ससुंगत कᱶ ᮤीय और राज् य िविधयᲂ के अनुरुप और कᱶ ᮤीय सरकार ᳇ारा जारी मागर्िनदᱷशᲂ, यिद कोई हᲂ, ᳇ारा तैयार होगी ।
(3) आंचिलक महायोजना, पयार्वरणीय और पािरिस्थितक संबंधी बातᲂ को समाकिलत करने के िलए राज् य सरकार के सभी संब िवभागᲂ के परामशर् से तैयार की जाएगी, अथार्त्:--
(i) पयार्वरण;

(ii) वन और वन्यजीव;
(iii) कृिष और बागवानी ;
(iv) राजस् व;
(v) शहरी िवकास;
(vi) पािरिस्थितक पयर्टन सिहत पयर्टन;
(vii) ᮕामीण िवकास;
(viii) िसंचाई और बाढ़ िनयंᮢण;
(ix) नगर और शहर िवकास;
(x) पंचायती राज;
(xi) लोक िन मार्ण िव भाग।
(4) आंचिलक महायोजना अनुमोिदत िव᳒मान भू-उपयोग, अवसंरचना और िᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक िक इस अिधसूचना मᱶ इस ᮧकार िविन᳸दर्ष् ट न हो और आचंिलक महायोजना सभी अवसंरचना और िᮓयाकलापᲂ मᱶ जो अिधक दक्षता और पािरिस्थितक अनुकूल हᲂ का संवधर्न करेगी ।
(5) आंचिलक महायोजना मᱶ अनाच्छािदत क्षेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरक्षण, आवाह के्षᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरक्षण, स्थानीय समुदायᲂ की आवश्यकताᲐ तथा पािरिस्थितक और पयार्वरण स ेसंबंिधत ऐस ेअन्य पहलुᲐ, िजन पर ध्यान देना आवश्यक ह,ै के िलए उपबंध हᲂग े।
(6) आंचिलक महायोजना सभी िव᳒मान पूजा स् थलᲂ, ᮕामᲂ और नगरीय बिस्तयᲂ, वनᲂ के ᮧकार और िकस् मᲂ, कृिष क्षेᮢᲂ, ऊपजाऊ भूिम, हिरत क्षेᮢ जैसे उ᳒ान और उसी ᮧकार के स् थान, उ᳒ान कृिष के्षᮢ, फलोउ᳒ान, झीलᲂ और अन्य जल िनकायᲂ का अभ्यकंन करेगी और इस योजना के मानिचᮢ के साथ िव᳒मान और ᮧस्तािवत भूिम उपयोग िवशेषताᲐ का िववरण संलᲨ होगा ।
(7) आंचिलक महायोजना पािरिस्थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगी और सारणी मᱶ सूचीब ᮧितिष, िविनयिमत िᮓयाकलापᲂ का पालन करेगी तथा स् थानीय समुदायᲂ की आजीिवका सुरक्षा के िलए, पािरिस्थितक अनुकूल िवकास सुिनिश् चत करेगी तथा संविधर्त करेगी।
(8) आंचिलक महायोजना क्षेᮢीय िवकास योजना की सह-िवस्तारी होगी ।
(9) इस ᮧकार अनुमोिदत आंचिलक महायोजना इस अिधसूचना के उपबंधᲂ के अनुसार मानीटरी के अपने कृत्यᲂ को करने के िलए मानीटरी सिमित के िलए एक संदभर् दस्तावेज होगी ।
3. राज्य सरकार ᳇ारा िकए जान ेवाल ेउपाय-- राज्य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथार्त:्--
(1) भ-ूउपयोग–(क) पािरिस् थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष क्षेᮢᲂ, कृिष के्षᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचिन्हत िकए गए पाकᲄ और खुल ेस्थानᲂ का वािणिज्यक और औ᳒ोिगक सबं िवकास िᮓयाकलापᲂ के िलए उपयोग या सपंिरवतर्न नहᱭ होगा।:
परंतु पािरिस्थितक संवेदी जोन के भीतर मᱶ िविन᳸दर᳥् ᮧयोजन से िभ᳖ ᮧयोजन के िलए कृिष और अन्य भूिम का संपिरवतर्न मानीटरी सिमित की िसफािरश पर और यथा-लागू और संबंिधत राज्य कानून तथा केन्ᮤीय/राज्य सरकार 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] के अन्य िनयमᲂ तथा िविनयमᲂ के अधीन सक्षम ᮧािधकारी के पूवर् अनुमोदन स,े तथा इस अिधसूचना के उपबंधᲂ ᳇ारा स्थानीय िनवािसयᲂ की िन᳜िलिखत आवासीय जरूरतᲂ को पूरा करने के िलए अनुज्ञात िकया जाएगा, जैसे:-
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना तथा नई सड़कᲂ का सिंनमार्ण;
(ii) बुिनयादी ढांचᲂ और नागिरक सुिवधाᲐ का संिनमार्ण और नवीकरण;
(iii) ᮧदषूण उत्प᳖ न करने वाल ेलघु उ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भण्डार और स्थानीय सुख-सुिवधाᲐ जो पािरिस्थितक पयर्टन मᱶ सहायक ह ᱹिजसमᱶ गृह वास सिम्मिलत ह;ै और
(v) संविधर्त िᮓयाकलाप और जो पैरा 4 के अधीन दी गई ह:ै परंतु यह और भी िक के्षᮢीय नगर योजना अिधिनयम और अन्य िनयमᲂ और िविनयमᲂ के अधीन राज्य सरकार के पूवर् अनुमोदन तथा संिवधान के अनुच्छेद 244 और तत्समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अिधकारᲂ की मान्यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिज्यक या उ᳒ोग िवकास िᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनुज्ञात नहᱭ होगा:
परंतु यह और भी िक पािरिस् थितक संवेदी जोन के भीतर भ-ूअिभलेखᲂ मᱶ ᮧकट होने वाली कोई ᮢुिट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् राज्य सरकार ᳇ारा ᮧत्येक मामले मᱶ एक बार सशंोिधत होगी और उᲦ ᮢुिट के संशोधन की सूचना कᱶ ᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को दनेी होगी :
परंतु यह और भी िक उपयुर्Ღ ᮢुिट के सशंोधन मᱶ इस उप पैरा के अधीन यथा-उपबंिधत के िसवाय िकसी भी दशा मᱶ भू-उपयोग का पिरवतर्न सिम्मिलत नहᱭ होगा । (ख) वनरोपण और वास जीणᲃार िᮓयाकलापᲂ वाले अनᮧयुक् त या अनुत् पादक कृिष के्षᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास िकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ/निदयᲂ/जलसरणी की पहचान की जाएगी और उसमᱶ उनके संरक्षण और पुनरुद्भूतकरण के िलए योजना सिम् मिलत होगी ।
(3) पयर्टन/पािरिस्थितक पयर्टन –(क) पािरिस्थितक संवेदी जोन के भीतर सभी नए पािरिस्थितक पयर्टन िᮓयाकलाप या िव᳒मान पयर्टन संबंधी िᮓयाकलाप पािरिस्थितक संवेदी जोन के िलए पयर्टन महायोजना के अनुसार हᲂगे । (ख) पािरिस्थितक पयर्टन महायोजना पयर्टन िवभाग, ᳇ारा राज्य सरकार के पयार्वरण और वन िवभाग के परामशर् से तैयार होगी । (ग) पयर्टन महायोजना आंचिलक महायोजना के एक घटक के रूप मᱶ होगी । (घ) पािरिस्थितक पयर्टन संबंधी िᮓयाकलाप िनम् निलिखत के अधीन िविनयिमत हᲂगे, अथार्त् :-
(i) जलदापाडा रा᳦ीय उ᳒ान की सीमा से एक िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन के िवस्तार तक, जो भी िनकट हो, िकसी होटल या िरसोटर् का नया संि᳖मार्ण अनुज्ञात नहᱭ िकया जाएगा । तथािप, वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर की दरूी से परे पािरिस्थितक संवेदी जोन के िवस्तार तक नए होटलᲂ और िरसोटᲄ की स्थापना पयर्टन महायोजना के अनुसार पािरिस्थितक पयर्टन सिुवधाᲐ के िलए पूवर् सीमांिकत और पदािभिहत क्षेᮢᲂ मᱶ ही अनुज्ञात की जाएगी।
(ii) पािरिस्थितक संवेदी जोन के अन्दर सभी नए पयर्टन िᮓया-कलाप या िव᳒मान पयर्टन िᮓयाकलापᲂ के ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 िवस्तार केन्ᮤीय सरकार, पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय ᳇ारा जारी मागर्दशᱮ िसांतᲂ तथा पािरिस्थितक पयर्टन पर बल दतेे हुए रा᳦ीय बाघ संरक्षण ᮧािधकरण ᳇ारा जारी पािरिस्थितक पयर्टन मागर्दशᱮ िसांतᲂ (समय-समय पर यथा-संशोिधत) के अनुसार होगा ।
(iii) जब तक आंचिलक महायोजना का अनुमोदन नहᱭ कर िदया जाता ह ैजब तक पयर्टन संबंधी िवकास तथा िव᳒मान पयर्टन िᮓयाकलापᲂ का िवस्तार मानीटरी सिमित के वास्तिवक स्थल िविन᳸दर᳥् संवीक्षा तथा िसफािरश के आधार पर सम्बंिधत िविनयामक ᮧािधकारी ᳇ारा अनुज्ञात िकया जाएगा और पािरिस्थितक संवेदी जोन के्षᮢ के भीतर कोई नया होटल/िरसाटर् या वािणिज्यक स्थापन का संि᳖मार्ण अनुज्ञात नहᱭ िकया जाता ह ै।
(4) नैसिगर्क िवरासत -- पािरिस्थितक संवेदी जोन मᱶ महत्वपूणर् नैसिगर्क िवरासत के सभी स्थलᲂ जैसे सभी जीन कोश आरिक्षत क्षेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, स्थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आिद की पहचान की जाएगी और िवरासत संरक्षण योजना आंचिलक महायोजना के भाग के रुप मᱶ पिररक्षण और संरक्षण के िलए तैयार की जाएगी ।
(5) मानव िनिमर्त िवरासत स् थल - पािरिस् थितक सवेंदी जोन मᱶ भवनᲂ, संरचनाᲐ, िशल्प-तथ्य, ऐितहािसक, कलात्मक और सांस्कृितक महत्व के क्षेᮢᲂ की पहचान और उनके संरक्षण के िलए िवरासत योजना आंचिलक महायोजना के भाग के रुप मᱶ तैयार की जाएगी ।
(6) ध् विन ᮧदषूण -- पािरिस्थितक संवेदी जोन मᱶ ध् विन ᮧदषूण की रोकथाम और िनयंᮢण का ध्विन ᮧदषूण पयार्वरणीय (संरक्षण) अिधिनयम, 1986, और उसमᱶ िकए गए संशोधनᲂ के अधीन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ 2000 के अनुसार अनुपालन िकया जाएगा ।
(7) वाय ुᮧदषूण -- पािरिस्थितक संवेदी जोन मᱶ, वायु ᮧदषूण की रोकथाम और िनयंᮢण वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) के उपबंधᲂ और उसके अधीन बनाए गए िनयमᲂ और उनमᱶ िकए गए संशोधनᲂ के अनुसार अनुपालन िकया जाएगा ।
(8) बिह᮲ाव का िनस्सारण -- पािरिस्थितक संवेदी जोन मᱶ उपचािरत बिह᮲ाव का िनस्सारण, साधारणᲂ मानकᲂ के अन्तगर्त पयार्वरणीय (संरक्षण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के अधीन आने वाले पयार्वरणीय ᮧदषूण के िनस्सारण के िलए साधारण मानकᲂ या राज्य सरकार ᳇ारा िनयत मानकᲂ, जो भी अिधक कठोर हो, के उपबंधᲂ के अनुसार होगा।
(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान और ᮧबंधन िन᳜िलिखत रूप मᱶ होगा-- (क) पािरिस्थितक संवेदी जोन मᱶ ठोस अपिश᳥ िनपटान और ᮧबंधन समय-समय पर संशोिधत ठोस अपिशष् ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना स.ं का.आ. 1357(अ) तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत िकए गए थे, के उपबंधᲂ के अनुसार िकया जाएगा । अकाबर्िनक सामᮕी का िनपटान पािरिस्थितक संवेदी जोन के बाहर पहचान िकए गए स् थल पर िकसी पयार्वरणीय स्वीकृत रीित मᱶ होगा। (ख) पहचानी गई ᮧौ᳒ोिगिकयᲂ का उपयोग करते हुए िव᳒मान िनयमᲂ और िविनयमᲂ के अनुरूप ठोस अपिश᳧ का ᮧंबंधन सुरिक्षत पयार्वरणीय ठोस ᮧंबंधन से पािरिस्थितक संवेदी जोन के भीतर अनुज्ञात िकया जाएगा।
(10) जैव िचिकत् सीय अपिशष् ट- जैव िचिकत् सीय अपिशष् ट ᮧबंधन िन᳜िलिखत रूप मᱶ होगा— (क) पािरिस्थितक संवेदी जोन मᱶ जैव िचिकत्सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय-समय पर यथा-संशोिधत अिधसूचना सं.का.िन 343 (अ) तारीख 28 माचर् 2016 ᳇ारा ᮧकािशत जैव िचिकत्सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) पािरिस्थितक संवेदी जोन के अंतगर्त जैव -िचिकत्सा अपिश᳥ᲂ के सुरिक्षत और पयार्वरणीय ध्विन ᮧबंधन )ईएसएम (की पहचान की गई तकनीकᲂ के उपयोग की िव᳒मान िनयमᲂ और िविनयमᲂ के अनुरूप अनुमित दी जाएगी।
(11) प्लािस्टक अपिश᳥ ᮧबधंन: - पािरिस्थितक संवेदी जोन मᱶ प्लािस्टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन 340(अ), तारीख 18 माचर्, 2016 ᳇ारा ᮧकािशत प्लािस्टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार िकया जाएगा।
(12) सिंनमार्ण और िवध्वसं अपिश᳥ ᮧबंधन: - पािरिस्थितक संवेदी जोन मᱶ संिनमार्ण और िवध्वंस अपिश᳥ ᮧबंध भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन 317(अ), तारीख 29 माचर्, 2016 ᳇ारा ᮧकािशत संिनमार्ण और िवध्वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा ।
(13) ई–अपिश᳥:- पािरिस्थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय ᳇ारा समय-समय पर यथासंशोिधत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा।
(14) यानीय पिरवहन: - पिरवहन की यानीय संचालन आवास के अनुकूल रीित मᱶ िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िविन᳸दर᳥् उपबंध समािव᳥ िकए जाएंगे और आंचिलक महायोजना के तैयार होन ेऔर राज्य सरकार के सक्षम ᮧािधकारी ᳇ारा के अनुमोिदत होन ेतक, मानीटरी सिमित ससुंगत अिधिनयमᲂ तथा तदधीन बनाए गए िनयमᲂ और िविनयमᲂ के अधीन यानीय संचलन के अनुपालन को मानीटर करेगी ।
(15) यानीय ᮧदषूण:- लाग ू िविधयᲂ के अनुसार वाहन ᮧदषूण की रोकथाम और िनयंᮢण का अनुपालन िकया जाएगा। स्वच्छक ईंधन उदाहरण के िलए सीएनजी, एलपीजी, आिद के उपयोग के िलए ᮧयास िकए जाएगे ।
(16) औ᳒ोिगक ईकाइया:ं - (i) राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन पर या उसके बाद पािरिस्थितक संवेदी जोन के भीतर िकन्ही नए ᮧदषूणकारी उ᳒ोगᲂ की स्थापना की अनुमित नहᱭ दी जाएगी।
(ii) पािरिस्थितक संवेदी जोन मᱶ कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा फरवरी, 2016 मᱶ जारी िदशािनदᱷशᲂ मᱶ िसफर् गैर- केवल अᮧदषूणकारी उ᳒ोगᲂ की स्थापना को वगᱮकरण के अनुसार अनुमित दी जाएगी, जब तक िक इस अिधसूचना मᱶ इस ᮧकार िविन᳸दर᳥् न हो। इसके अलावा, गैर-ᮧदषूणकारी कुटीर उ᳒ोगᲂ को ᮧितिष िकया जाएगा।
(17) पहाड़ी ढलानᲂ का सरंक्षण: - पहाड़ी ढलानᲂ का संरक्षण िन᳜ानुसार:
(क) आंचिलक महायोजना मᱶ पहाड़ी ढलानᲂ पर ऐसे क्षेᮢᲂ को उपदिशर्त िकया जाएगा जहां िकसी भी सिंनमार्ण की अनुमित नहᱭ दी जाएगी । (ख) अवक्षयण की एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर िकसी भी संिनमार्ण की अनुमित नहᱭ दी जाएगी ।
(18) केन्ᮤीय सरकार और राज्य सरकार, यिद यह आवश्यक समझती ह,ै इस अिधसूचना के उपबंधᲂ को ᮧभावी करने मᱶ अन्य उपाय िविन᳸दर᳥् करेगी।
4. पािरिस्थितक सवंदेी जोन मᱶ ᮧितिष या िविनयिमत िकए जाने वाल ेिᮓयाकलापᲂ की सचूी - पािरिस्थितक संवेदी जोन मᱶ सभी िᮓयाकलाप पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और तटीय िविनयमन जोन (सीआरजेड), 2011 और पयार्वरणीय ᮧभाव आकलन (ईआईए ) अिधसूचना, 2006 और वन (संरक्षण) अिधिनयम, 1980 (1980 के 69), भारतीय वन अिधिनयम, 1927 (1927 के 16), वन्यजीव (संरक्षण) ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 अिधिनयम, 1972 (1972 के 53) के उपबंधᲂ तथा उनमᱶ िकए गए संशोधनᲂ ᳇ारा शािसत हᲂग ेऔर नीचे दी गई सारणी मᱶ िविन᳸दर᳥् रीित मᱶ िविनयिमत हᲂग,े अथार्त् :-- सारणी ᮓम स.ं िᮓयाकलाप टीका-िटप्पणी

1. वािणिज्यक खनन । (क) सभी ᮧकार के खनन (लघु और वृहत खिनज), पत्थर की खानᱶ और उनको तोड़न े की इकाइयां वास्तिवक स्थानीय िनवािसयᲂ की घरेलू आवश्यकताᲐ के िसवाय नहᱭ हᲂगी िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संि᳖मार्ण या मरम्मत के िलए भूिम को खोदना और मकान बनाने के िलए दशेी टाइलᲂ का िनमार्ण भी सिम्मिलत ह;ै (ख) माननीय उᲬतम न्यायालय की िरट यािचका (िसिवल) सं.
1995 का 202 टी.एन. गोिवंदरामन िथरुमूलपाद बनाम भारत सरकार के मामल े मᱶ आदशे तारीख 4 अगस्त, 2006 और िरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामल ेमᱶ तारीख 21 अᮧैल, 2014 के अंतिरम आदशे के कठोर अनुसरण का ᮧचालन होगा ।
2. ᮧदषूण (जल वायु मृदा ध् विन आिद) कािरत करने वाले उ᳒ोगᲂ की स् थापना । पािरिस्थितक संवेदी जोन मᱶ नए उ᳒ोग और उ᳒ोगᲂ मᱶ िव᳒मान ᮧदषूण का िवस्तार अनुज्ञा नहᱭ होगी। फरवरी, 2016 मᱶ जब तक िक इस ᮧकार अिधसूचना मᱶ िविन᳸दर᳥् न हो, कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा जारी िदशािनदᱷशᲂ मᱶ उ᳒ोगᲂ के वगᱮकरण के अनुसार पािरिस्थितक संवेदी जोन के भीतर केवल गैर- ᮧदषूण कुटीर उ᳒ोगᲂ की अनुज्ञा दी जाएगी।
3. बृहत जल िव᳒ुत पिरयोजना की स् थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे ।
4. िकसी पिरसकंटमय पदाथᲄ का उपयोग या उत्पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे ।
5. ᮧाकृितक जल िनकायᲂ या भूिम क्षेᮢ मᱶ अनुपचािरत बिह᮲ावᲂ का िनस्सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे ।
6. फमᲄ, कंपिनयᲂ, ᳇ारा बड़े पैमाने पर वािणिज्यक पशुधन और कुक्कुट फामᲄ की स्थापना । स्थानीय आवश्यकताᲐ को पूरा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष (यथा अन् यथा उपबंिधत के िसवाय) हᲂगे अन्यथा नहᱭ।
7. नई आरा िमलᲂ की स्थापना। पािरिस्थितक संवेदी जोन के भीतर नई या िव᳒मान आरा िमलᲂ का िवस् तार अनजु्ञात नहᱭ होगा ।
8. ईंट भᲵᲂ की स्थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
9. पोिलथीन बैगᲂ का उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे ।
10. जलावन लकड़ी का वािणिज्यक उपयोग। लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे ।
11. नए काष् ठ आधािरत उ᳒ोग। लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे । ख. िविनयिमत िᮓयाकलाप
12. होटलᲂ और िरसोटᲄ की वािणिज्यक स्थापना । पािरिस्थितक पयर्टन िᮓयाकलापᲂ संबंधी लघु अस्थायी संरचनाᲐ के िलए संरिक्षत के्षᮢ की सीमा से एक िकलोमीटर भीतर या पािरिस्थितक संवेदी जोन के िवस्तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणिज्यक होटल और िरसोटर् अनुज्ञात हᲂगे, अन्यथा नहᱭ :
परंतु, संरिक्षत के्षᮢ की सीमा से 1 िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन के िवस्तार तक, जो भी िनकट हो, िकसी भी नए वािणिज्यक होटल एवं िरसोटᲄ को ही अनुज्ञात िकया जाएगा अन्यथा नहᱭ ।
13. संिनमार्ण िᮓयाकलाप । (क) सरंिक्षत क्षेᮢ की सीमा से एक िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन के िवस्तार तक जो भी िनकट हो, िकसी भी ᮧकार का वािणिज्यक संिनमार्ण अनुज्ञात नहᱭ िकया जाएगा:
परंतु स् थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब िᮓयाकलापᲂ सिहत उनके उपयोग के िलए उनकी भूिम मᱶ स्थानीय िनवास्यᲂ की आवासीय आवश्यकताᲐ को पूरा करने िलए संिनमार्ण करने की अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी ।
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना तथा नई सड़कᲂ का सिंनमार्ण;
(ii) बुिनयादी ढांचᲂ और नागिरक सुख-सिुवधाᲐ का संिनमार्ण और नवीकरण;
(iii) फरवरी, 2016 मᱶ कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा िकए गए वगᱮकरण के अनुसार पिरभािषत गैर- ᮧदषूणकारी लघु उ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजनके अंतगर्त ᮕामीण उ᳒ोग ह;ᱹ सुिवधा भण्डार और स्थानीय सखु सुिवधाᲐ जो पािरिस्थितक पयर्टन मᱶ िजस मᱶ ᮕह वास भी ह ैसहायक हो; और
(v) इस अिधसूचना मᱶ सूचीब संविधर्त िᮓयाकलापᲂ की सूची :
परन्तु ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उत् पन् न नहᱭ करते ह,ᱹ से संबंिधत संिनमार्ण िᮓयाकलाप िविनयिमत िकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यिद कोई हᲂ, के अनुसार सक्षम ᮧािधकारी की पूवर् अनुमित से ही न् यूनतम पर रखे जाएंगे । ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 (ख) एक िकलोमीटर से आगे आंचिलक महायोजना की अनुसार िविनयिमत हᲂगे ।
14. ᮧदषूण उत्प᳖ न करने वाले लघु उ᳒ोग । फरवरी, 2016 मᱶ केन्ᮤीय ᮧदषूण बोडर् ᳇ारा जारी उ᳒ोगᲂ के वगᱮकरण के अनुसार गैर-ᮧदषूणकारी उ᳒ोग और अपिरसंकट मᱶ, लघु और सेवा उ᳒ोग, कृिष, पुष्प कृिष उ᳒ान, जो पािरिस्थितक संवेदी जोन से दशेी सामिᮕयᲂ से बने उत्पादᲂ का उत्पादन करते ह,ᱹ सक्षम ᮧािधकारी ᳇ारा अनुज्ञात हᲂगे।
15. वृक्षᲂ की कटाई । (क) राज्य सरकार मᱶ सक्षम ᮧािधकारी की पूवर् अनुमित के िबना वन, सरकारी या राजस्व या िनजी भूिम पर या वनᲂ मᱶ ᳴कंही वृक्षᲂ की कटाई नहᱭ होगी । (ख) वृक्षᲂ की कटाई संबंिधत कᱶ ᮤीय या राज्य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
16. वन उत्पादᲂ और गैर काष् ठ वन उत्पादᲂ का सᮕंहण (एनटीएफपी) । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
17. ᮧवासी चरवाह।े लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
18. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पिरिनमार्ण और केबलᲂ का िबछाए जाना और अन्य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । भूिमगत केबल के िबछाए जाने को बढ़ावा िदया जाएगा।
19. नागिरक सुख-सिुवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ िनयमᲂ और िविनयमᲂ और उपलब्ध िदशािनदᱷशᲂ के अनुसार न्यूनीकरण की उपायᲂ के साथ िविनयिमत िकए जाएंगे।
20. िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमार्ण । लागू िविधयᲂ िनयमᲂ और िविनयमᲂ और उपलब्ध िदशािनदᱷशᲂ के अनुसार न्यूनीकरण की उपायᲂ के साथ िविनयिमत िकए जाएंगे।
21. पयर्टन से संबंिधत िᮓयाकलाप जैसे गमर् वायु गुब्बारᱶ, हलेीकाप्टर, ᮟोन, माइᮓोलाइटस और अन्य पयर्टन िᮓयाकलाप आिद ᳇ारा पािरिस्थितक संवेदी जोन के्षᮢ के ऊपर से उड़ान जैसे िᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
22. पहाड़ी ढालᲂ और नदी तटᲂ का संरक्षण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
23. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणिज्यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
24. स्थानीय समुदायᲂ ᳇ारा चलाई जा रही कृिष और बागवानी पितयᲂ के साथ पशुपालन, पशुपालन कृिष जल कृिष और मछली पालन। स्थानीय लोगᲂ के उपयोग के िलए लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. ᮧाकृितक जल िनकायᲂ / सतही क्षेᮢ मᱶ उपचािरत बिह᮲ार्व का िनस्सारण । उपचािरत अपिश᳥ जल/बिह᮲ार्व का िनस्सारण जल िनकायᲂ मᱶ ᮧवेश नहᱭ करने िदया जाएगा और उपचािरत अपिश᳥ जल के 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पुनचर्ᮓण और पनु:उपयोग के िलए ᮧयास िकए जाएंगे और उपचािरत अपिश᳥ जल/बिह᮲ार्वᲂ का िनस्सारण लागू िविधयᲂ के अनुसार िविनयिमत िकया जाएगा।
26. सतह और भूजल के वािणिज्यक िनष्कषर्ण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
27. कृिष या अन्य उपयोग के िलए खुल े कुआ, बोर कुआ, आिद । िविनयिमत और सम्ब ᮧािधकारी ᳇ारा िᮓयाकलाप की मानीटरी की जाएगी।
28. ठोस अपिशष् ट ᮧबंधन/ जैव-िचिकत्सा अपिश᳥ ᮧबंधन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
29. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
30. पािरिस्थितक पयर्टन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
31. वािणिज् यक साइनबोडर् और होिडᲈग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ग. संविधर्त िᮓयाकलाप
32. वषार् जल संचयन । सिᮓ य रूप स ेबढ़ावा िदया जाएगा ।
33. जैिवक खेती। सिᮓ य रूप स ेबढ़ावा िदया जाएगा ।
34. सभी गितिविधयᲂ के िलए हिरत ᮧौ᳒ोिगकी को ᮕहण करना । सिᮓ य रूप स ेबढ़ावा िदया जाएगा ।
35. कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण कारीगर भी ह ᱹ। सिᮓ य रूप स ेबढ़ावा िदया जाएगा ।
36. नवीकरणीय ऊजार् और ईंधन का उपयोग । बायोगैस, सौर ᮧकाश इत् यािद को बढ़ावा िदया जाना ह ै।
37. कृिष वािनकी । सिᮓ य रूप स ेबढ़ावा िदया जाएगा ।
38. पािरिस्थितक अनुकूल पिरवहन का उपयोग । सिᮓ य रूप स ेबढ़ावा िदया जाएगा ।
39. कौशल िवकास । सिᮓ य रूप स ेबढ़ावा िदया जाएगा ।
40. िन᳜ीकृत भूिम या वन या पयार्वास की बहाली । सिᮓ य रूप स ेबढ़ावा िदया जाएगा ।
41. पयार्वरणीय जागरुकता । सिᮓ य रूप स ेबढ़ावा िदया जाएगा ।
5. मानीटरी सिमित- कᱶ ᮤीय सरकार, पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते हुए तीन वषर् की अविध के िलए पािरिस्थितक संवेदी जोन की िनगरानी ᮧभावी के िलए मानीटरी सिमित गिठत करती ह,ै जो िन᳜िलिखत से िमलकर बनेगी:--
(i) उपायुᲦ, अलीपुर᳇ार अध्यक्ष;
(ii) पि᳟म बंगाल सरकार ᳇ारा पािरिस्थितक और पयार्वरण के क्षेᮢ से तीन वषर् की अविध के िलए नामिन᳸दर᳥् िकया जाने वाला एक ᮧितिनिध सदस् य;
(iii) पि᳟म बंगाल सरकार ᳇ारा वाले गरै-सरकारी संगठनᲂ का (पयार्वरण, िजसके अंतगर्त िवरासत संरक्षण ह,ै के क्षेᮢ मᱶ कायर् करने वाले) तीन वषर् की अविध के सदस् य;

(iv) कायर्पालक इंजीिनयर, पि᳟म बंगाल ᮧदषूण िनयंᮢण बोडर् सदस् य;
(v) ᮧभागीय वन अिधकारी (बक्सा बाघ आरिक्षती) सदस् य;
(vi) ᮧभागीय वन अिधकारी (जलदापाडा) सदस् य;

6. िनदᱷश - िनबधंनः (1) पािरिस्थितक सवेंदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी।
(2) पािरिस्थितक संवेदी जोन मᱶ भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसूचना सं.
का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अनुसूची मᱶ के अधीन सिम्मिलत िᮓयाकलापᲂ और इस अिधसचूना के पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸दर᳥् ᮧितिष गितिविधयᲂ के िसवाय आन ेवाले ऐस ेिᮓयाकलापᲂ की दशा मᱶ वास्तिवक िविन᳸दर᳥् स्थलीय दशाᲐ पर आधािरत मानीटरी सिमित ᳇ारा संवीक्षा की जाएगी और उᲦ अिधसचूना के उपबंधᲂ के अधीन पूवर् पयार्वरण अनापिᱫ के िलए केन्ᮤीय सरकार के पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢालय को िन᳸दर᳥् की जाएगी।
(3) इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸दर᳥् ᮧितिष िᮓयाकलापᲂ के िसवाय, भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसूचना संख्यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अिधसूचना के अनुसूची के अधीन ऐस ेिᮓयाकलापᲂ, िजन्हᱶ सिम्मिलत नहᱭ िकया गया ह,ै परंतु पािरिस्थितक संवेदी जोन मᱶ आत े ह,ᱹ ऐस े िᮓयाकलापᲂ की वास्तिवक िविन᳸दर᳥् स्थलीय दशाᲐ पर आधािरत मानीटरी सिमित ᳇ारा संवीक्षा की जाएगी और उस ेसंब िविनयामक ᮧािधकरणᲂ को िन᳸दर᳥् िकया जाएगा ।
(4) मानीटरी सिमित का सदस्य-सिचव या संब उपायुक् त या संब उ᳒ान उप वन संरक्षक ऐस े ᳞िᲦ के िवरू, जो इस अिधसूचना के िकसी उपबंध का उल्लंघन करता ह,ै पयार्वरण (संरक्षण) अिधिनयम, 1986 की धारा 19 के अधीन पिरवाद फाइल करने के िलए सक्षम होगा ।
(5) मानीटरी सिमित मुा दर मुा के आधार पर अपेक्षाᲐ पर िनभर्र रहते हुए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेषज्ञᲂ, औ᳒ोिगक सगंमᲂ या संब पणधािरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशर् मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(6) मानीटरी सिमित ᮧत्येक वषर् की 31 माचर् तक की अपनी वािषर्क कारर्वाई िरपोटर् राज्य के मुख्य वन्य जीव वाडर्न को उपाबंध IV मᱶ उपबंिधत रूप िवधान के अनुसार उक् त वषर् के 30 जून तक ᮧस्तुत करेगी ।
(7) केन्ᮤीय सरकार का पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय मानीटरी सिमित को अपने कृत्यᲂ के ᮧभावी िनवर्हन के िलए ऐसे िनदशे द ेसकेगा, जो वह ठीक समझे ।

8. कोई अन् य महत् वपूणर् िवषय । 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 22nd August, 2017 S.O. 2734(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 1247(E), dated the 29th March, 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
WHEREAS, objections and suggestions received from persons and stakeholders in response to the draft notification were duly considered by the Central Government;
AND WHEREAS, the Jaldapara National Park located in Alipurduar District, in the state of West Bengal is spread over an area of 234.51 square kilometres. The National Park is surrounded by dense human population. The Park extends from Bhutan Hills to the Terai bordering Coochbehar district. The area is eco fragile and eco sensitive. The activities/ industries outside the park influence the habitat and water regime of the park. The remaining grassland and species dependent upon them have a better chance of survival if some regulation is exercised on the activities in the vicinity of Jaldapara National Park. The ever increasing population of human beings and cattle are putting enormous pressure on resources of the said National park. Agriculture, Tea Plantation, cattle grazing are major economic activities of the region and the Park administration has tried to reduce the dependence of forest resources by increasing Eco-tourism and by way of Joint Forest Management;
AND WHEREAS, the flora and fauna represent rich biological significance of this Sanctuary. The Jaldapara National Park contains a total 585 Nos. of identified plants species which belongs to 429 genus, 111 families including 91 grass species and 19 orchid species. The flora area Sal (Shorea robusta). Chilauni (Schima wallichi), Chikrasi (Chukrasia tabularis), Champ (Michelia champaca), Bahera (Terminalia belerica), Sidha (Lagerstroemia parviflora), Panisaj (Terminalia myriocarpa), Lampati (Duabanga sonneratioides), Lali (Amoora wallichi), Lahasune (Amoora rohituka), Kainjal (Bischofia javanica), Simul (Bombax ciba), Khair (Acacia catechu), Sissoo (Dalbergia sissoo) Siris (Albizzia spp).The Jaldapara Wildlife Sanctuary has great ecological significance as it forms the gene pool reserve for the great Indian onehorned Rhinoceros outside Nepal and Assam. Jaldapara has 33 species of carnivores and herbivores, approximately 246 species of birds, 29 species of reptiles, 8 species of turtles, 54 species of fishes and a host of other microfauna Rhinoceros (Rhinoceros unicornis), Elephant (Elephas maximus), Leopard (Panthera pardus) Gaur (Bos gaurus), Hog badger (Arctonyx collaris), Sloth Bear (Melursus ursinus), Hispid hare (Caprolagus hispidus), Bengal florican (Eupodotis bengalensis), Python (Python reticulatus), Indian Pangolin (Manis crassicaudata) ;
AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Jaldapara National Park as Eco-sensitive Zone from ecological, environmental and biodiversity point of view.
NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent upto five kilometres around the boundary of the Jaldapara National Park in the State of West Bengal as the Jaldapara National Park Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundary of Eco-sensitive Zone.-
(1) The Eco-sensitive Zone is spread over an area of 458 square kilometres with an extent zero (on the Northern side due to adjacent to Bhutan) to 5.0 kilo meters around the Jaldapara National Park and the boundary description of the said Zone is appended as Annexure-I.
(2) The list of villages falling in the Eco-sensitive Zone alongwith co-ordinates of prominent points is appended as Annexure-II.
(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-III.

2. Zonal Master Plan for Eco-sensitive Zone.-
(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture & Horticulture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism including eco-tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal & urban development;
(x) Panchayati Raj;
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
1. Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant State laws and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as.-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given under para 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant State laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities.
(2) Natural water bodies.- The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/ Eco-tourism.-
(a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Eco-tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km. from the boundary of the Jaldapara National Park or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism.
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Ecosensitive Zone area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 framed under the Environment (Protection) Act, 1986.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; and the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive Zone.
(10) Bio-medical waste.- Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016.
(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016.
(13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.
(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and the efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.- The protection of hill slopes shall be as under:-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone(CRZ), 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S No Activity Description A. 1. Commercial Mining.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the orders of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N.
Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated
21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of
2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new industries and expansion of existing polluting industries in the Ecosensitive zone shall be permitted.
Only non-polluting industries shall be allowed within the Eco-sensitive zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
7. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
8. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
9. Use of polythene bags. Prohibited (except as otherwise provided) as per applicable laws.
10. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws
11. New wood based industry. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
12. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of the Ecosensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometre from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
13. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per the building bye-laws to meet the residential needs of the local residents such as -
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution termed as per Classification done by the Central Pollution Control Board of February 2016;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays;
and
(v) Promoted activities listed in this Notification:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23
5. Monitoring Committee:- (1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:- Deputy Commissioner, Alipurduar —Chairman;
(i) An expert in the area of ecology and environment to be nominated by the —Member;
regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
14. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, smallscale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the competent Authority.
15. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
16. Collection of Forest produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws.
17. Migratory graziers. Regulated under applicable laws.
18. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law. Underground cabling may be promoted.
19. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
20. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
21. Under taking other activities related to tourism like over flying the Ecosensitive zone area by hot air balloon, helicopter, drones, Microlites, etc.
Regulated under applicable law.
22. Protection of Hill Slopes and river banks. Regulated under applicable laws.
23. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
24. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
25. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
26. Commercial extraction of surface and ground water.
Regulated under applicable law.
27. Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
28. Solid Waste Management/Bio-medical Waste Management.
Regulated under applicable laws.
29. Introduction of Exotic species. Regulated under applicable laws.
30. Eco-tourism. Regulated under applicable laws.
31. Commercial Sign boards and hoardings. Regulated under applicable laws.
C. Promoted Activities
32. Rain water harvesting. Shall be actively promoted.
33. Organic farming. Shall be actively promoted.
34. Adoption of green technology for all activities.
Shall be actively promoted.
35. Cottage industries including village artisans, etc.

36. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted.
37. Agro-Forestry. Shall be actively promoted.
38. Use of eco-friendly transport. Shall be actively promoted.
39. Skill Development. Shall be actively promoted.
40. Restoration of Degraded Land/ Forests/ Habitat.
Shall be actively promoted.
41. Environmental Awareness. Shall be actively promoted.

(vii) Member, State Biodiversity Board —Member;
(viii) Chief Conservator of Forests —Member-Secretary.
6. Terms of Reference: (1)The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(4) The Member Secretary of the Monitoring Committee or the concerned Collectoror the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV.
(7) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
