आ. 1823 (अ), तारीख 26 मई, 2016 ᳇ारा उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उᲦ अिधसूचना से युᲦ राजपᮢ कᳱ ᮧितयां, जनता को उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत करते ᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;
और, ᮧाᱧप अिधसूचना स ेयᲦु राजपᮢ कᳱ ᮧितयां 26 मई, 2016 को जनता को उपल᭣ध करा दी गई थी;
और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुᭃावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक ᱧप से िवचार ᳰकया गया;
और, कुशेशवर अ᭭ थान पᭃी अभयार᭛ य, िबहार के दरभंगा िजले मᱶ ि᭭थत ह ैऔर 29.21 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ फैला ᱟआ ह;ै और, कुशेशवर अ᭭ थान पᭃी अभयार᭛ य जो ताजे जल कᳱ झील ह ैऔर उसके आसपास का ᭃेᮢ असीम पाᳯरि᭭ थ ितक, जीवजंतु, वन᭭ पित, भू-आकृित वै᭄ािनक, धाᳶमक और ᮧाकृितक के िलए महᱬवपूणᭅ ह ैऔर असं य जलीय वन᭭ पित और जीवजतंु भी ह;ै और, कुशे᭫ वर अ᭭ थान पᭃी अभयार᭛ य मᱶ जल पौधᲂ कᳱ कई ᮧजाितयᲂ, मछली कᳱ ᮧचुर ᮧजाितयᲂ, ᭭ थानीय पिᭃ यᲂ कᳱ कम से कम 40 ᮧजाितयᲂ के साथ ᮧवासी पिᭃ यᲂ कᳱ 15 दलुᭅभ और संकटाप᭠ न ᮧजाितयᲂ के िलए नेपाल, ित᭣ बत, भूटान अफगािन᭭ तान, चीन, पाᳰक᭭ तान, मंगोिलया एवं साइबेᳯरया और अ᭠ य दशे िनवास ᭭ थान ह ैजो सदᭅ ऋतु मᱶ और सरीसृप 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ᭃेᮢ के समूह ह ैऔर अभयार᭛ य मᱶ भगवान िश व का मंᳰदर महाका᭪ य समय के िलए दबुारा खोजा गया और इसका िवशाल धाᳶमक मह᭜ व ह;ै और, इस ᭃेᮢ मᱶ उपि᭭थ ित अंकन कᳱ कुछ मह᭜ वपूणᭅ पिᭃ यᲂ कᳱ ᮧजाितयᲂ मᱶ दलमटैन पेलीकन (पेलीकनस दरूीसुपस्), भारतीय डरटर (अनᳲलगा ᱨफा), बार हिेडड कलहसं, वाइट ᳲवगड वुड ब᭜ तख (कैरीवा सकुटुलाटा), माबᭅलड टोल (मरमरोनेᲵा अन यू᭭ टीरो᭭ टृीस), बेइरस पॉचᭅड (अय᭝ या बेरी), साइबेᳯरयन करेन (ᮕुस िलयोᮕेनस), भारतीय ᭭ कᳱ᭥ मर (रयनचोपस अलीबीकोलस), ओᳳरयटल युसᱹडर (मेर यसू गुसᱹडर), िवसᳲलग टील, कौि़ड᭨ ला, बᱹगनी मूर–मुगᱮ आᳰद ह;ᱹ सामा᭠ य ᭭ थलीय व᭠ यजीव मᱶ लघुपू᭒ छ वानर, बनैला सअूर, िसयार, नीलगाय आᳰद ह ᱹऔर सरीसृपᲂ मᱶ कछुआ मᱶ जैसे ᳰक हरही एवं अᱟआ और जल सांपᲂ मᱶ चेरना, मचलीदीही, बसमहा और दरराह सि᭥म िलत ह;ᱹ जबᳰक मह᭜वपूणᭅ मछली ᮧजाितयां ह ᱹरीᱟ, कटला, ᳲसिग, गराई, बामी, इᲥा, इ᭜याᳰद;
और, अभयार᭛य कᳱ मह᭜वपूणᭅ पौधे ᮧजाितयां बेल (एजेले ममᱷलोस), िसरीस (अि᭨बिज़या िचनेिसस), नीम (अज़ािडराचल इंिडका), सेमल (ब᭥बॉस सीईबा), बरगद (ᳰफकस बᱶगलᱶिसस), पीपल (ᳰफकस रेिलिगओसा), आम (मंिगफेरा इंिडका), खजूर (फᳱिनस डिैटिलफेरा), जामुन (सायिजयम कुिमिन) और अजुᭅन टᳶमनिलया अजुᭅन, आᳰद; और कुछ मह᭜वपूणᭅ जलीय पौधे ᮧजाितयां जलकु᭥मी, नरकट, जंगली चावल, ᭣लू वाटर िलली, हाइᮟलेा, म᭭कᮕास आᳰद ह।ᱹ और, अभयार᭛ य कमला बलन, पुरानी कमला, कोसी, भूतही एवं जीव᭒ च बाढ़ जल फैलाने वाली नᳰदयᲂ स ेबाढ़ और कृिष भूिम के िनकट जल जमाव को रोकने के िलए जल ᮧा᭡ त करती ह ैऔर अत: यह जलाशय के ᱨप मᱶ और भ-ूजल ᳯरचाजᭅ कᳱ ᮧᳰᮓया मᱶ भी कायᭅ करता ह;ै और, कुशेशवर अ᭭थान पᭃी अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाए ंइस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सरुिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (3) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए, िबहार रा᭔ य मᱶ कुशेशवर अ᭭थान पᭃी अभयार᭛य कᳱ सीमा से 0.5 ᳰकलोमीटर से 3 ᳰकलोमीटर तक के िव᭭ तार तक के ᭃेᮢ को कुशेशवर अ᭭थान पᭃी अभयार᭛य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसके ᭣यौरे िन᳜ानुसार ह,ै अथाᭅत् :--
(1) (1) (1) (1) पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन काकाकाका िव᭭तारिव᭭तारिव᭭तारिव᭭तार औरऔरऔरऔर उसकᳱउसकᳱउसकᳱउसकᳱ सीमाएंसीमाएंसीमाएंसीमाएं----(1)(1)(1)(1) पाᳯरि᭭थितक संवेदी जोन कुशेशवर अ᭭थान पᭃी अभयार᭛य 0.5 ᳰकलोमीटर स े3 ᳰकलोमीटर के िव᭭तार तक 32.93 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ ह ैऔर अᭃांश और दशेांतर के साथ पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ उपाबधंउपाबधंउपाबधंउपाबधं IIII के ᱨप मᱶ उपाब ह।ै
(2) कुशेशवर अ᭭ थान पᭃी कᳱ सीमा का वणᭅन और पाᳯरि᭭थितक संवेदी जोन के िनदᱷशांकᲂ के साथ अभयार᭛ य के िनदᱷशांक उपाबधंउपाबधंउपाबधंउपाबधं IIIIIIII----क क क क और उपाबधंउपाबधंउपाबधंउपाबधं IIIIIIII----खखखख के ᱧप मᱶ उपाब ह।ै
(3) पाᳯरि᭭थितक संवेदी जोन िबहार के दरभंगा िजले मᱶ 36 ᮕामᲂ तक फैला ᱟआ ह ै। पाᳯरि᭭थितक संवेदी जोन के भीतर आन ेवाल ेᮕामᲂ कᳱ सचूी ᮧमुख ᳲबदᲐु के िनदᱷशांक के साथ उपाबधंउपाबधंउपाबधंउपाबधं IIIIIIIIIIII के ᱨप मᱶ उपाब ह।ै ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
2222.... पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंेदीसवंेदीसवंेदीसवंेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महायोजनामहायोजनामहायोजनामहायोजना –––– (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के िलए राजपᮢ मᱶ ᮧकाशन कᳱ तारीख स ेदो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसचूना मᱶ िविन᳸द᭬ ट ᱨप तथा ससुंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िसांतᲂ यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करन ेके िलए रा᭔ य सरकार के सभी संब िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत:्--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पयᭅटन ;
(v) नगरपािलका ;
(vi) राज᭭ व ;
(vii) कृिष ;
(viii) पशु और म᭜᭭य संसाधन;
(ix) जल संसाधन (ᳲसचाई);
(x) लोक िनमाᭅण (सड़क िनमाᭅण); और
(xi) िबहार रा᭔य ᮧदषूण िनयंᮢण बोडᭅ।
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भ-ूउपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आंचिलक महायोजना सभी अवसरंचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭ थितक अनुकूलता का संवधᭅन करेगी ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण स ेसंबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(8) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सिुनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
3. रा᭔यरा᭔यरा᭔यरा᭔य सरकारसरकारसरकारसरकार ᳇ारा᳇ारा᳇ारा᳇ारा ᳰकएᳰकएᳰकएᳰकए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय----रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन ेके िलए िन᳜िलिखत उपाय करेगी, अथाᭅत:्-- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(1) भूभभूूभू----उपयोग उपयोग उपयोग उपयोग ---- पाᳯरि᭭थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजनᲂ के िलए पाकᲄ और मनोरंजना᭜मक ᮧयोजनᲂ के िलए अिभिनि᳟त खुले ᭭थानᲂ को वािणि᭔यक या आवासीय पᳯरसर या औ᳒ोिगक ᳰᮓयाकलापᲂ के िलए उपयोग नहᱭ ᳰकया जाएगा या उनके िनए ᭃेᮢᲂ मᱶ सपंᳯरवᳶतत नहᱭ ᳰकया जाएगा। परंत ुपाᳯरि᭭थितक संवेदी जोन के भीतर कृिष और अ᭠य भूिम का संपᳯरवतᭅन मानीटरी सिमित कᳱ िसफाᳯरश पर और िविध के अधीन सᭃम ᮧािधकारी के पूवᭅ अनुमोदन स ेअनु᭄ात ᳰकया जा सकेगा और यथा लागू के᭠ᮤीय सरकार के अ᭠य िनयम जैस े िविनयम तथा रा᭔य सरकार के पूवᭅ अनुमोदन से ᭭थानीय आव᭫यकताᲐ को और ऐसी ᳰᮓयाकलापᲂ के पूरा ᳰकया जा सकेगा जसै:े-
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;
(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजनके अंतगᭅत ᮕामीण कारीगर भी ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुिवधाᲐ सहायक पाᳯरि᭭थितक पयᭅटन मᱶ सि᭥मिलत गृह वास; और
(v) संवᳶधत ᳰᮓयाकलाप पैरा 4 मᱶ ᳰदया गया ह:ै परंतु यह और भी ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन तथा संिवधान के अनु᭒छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक और उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा:
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करन ेके प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा :
परंतु यह और भी ᳰक िजसस ेहᳯरत ᭃेᮢ मᱶ जैस ेवन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अन᭜ु पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएगें । ((((2222)))) ᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोतᮧाकृितक जल ᮲ोत - आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएगें ।
(3) पयᭅटनपयᭅटनपयᭅटनपयᭅटन–––– (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनसुार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी । (ख) पयᭅटन महायोजना पयाᭅवरण और वन के रा᭔य िवभागᲂ के परामशᭅ से रा᭔य पयᭅटन िवभाग ᳇ारा तैयार कᳱ जाएगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ होगा । (घ) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत्:-
(i) कुशेशवर अ᭭ थान पᭃी अभयार᭛य संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट ह,ै नये वािणि᭔यक होटलᲂ और ᳯरसोटᲄ अनु᭄ात नहᱭ ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 हᲂगे। तथािप व᭠यजीव अभयार᭛य कᳱ सीमा उᲦ पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक एक ᳰकलोमीटर से परे नए होटलᲂ तथा ᳯरसोटᲄ कᳱ ᭭थापना के िलए पूवᭅ अ᭤यांᳰकत और नामिन᳸द᳥ ᭃेᮢᲂ मᱶ ही अनु᭄ात ᳰकया जाएगा;
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा मागᭅदशᭅक िसांतᲂ के तथा रा᭬ ᮝीय ᭪ याᮖ सरंᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार पाᳯरि᭭थितक पयᭅटन पर बल दतेे ᱟए होगा;
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ सवंीᭃा तथा िनगरानी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगकनसैᳶगकनसैᳶगकनसैᳶगक िवरासतिवरासतिवरासतिवरासत ---- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाए,ं जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाᲐ, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ पᳯररिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगी ।
(5) मानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थल ल ल ल ---- पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाए ंतैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ व᭟ व᭟ व᭟ विन ᮧदषूणिन ᮧदषूणिन ᮧदषूणिन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण िनवारण और िनयंᮢण पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 के अनुसार कायाᭅि᭠वत करेगा ।
(7) वायुवायुवायुवायु ᮧदषूणᮧदषूणᮧदषूणᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनवारण के िलए वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार अनुपा᭨य ᳰकया जाएगा ।
(8) बिह᮲ावबिह᮲ावबिह᮲ावबिह᮲ाव काकाकाका िन᭭सारणिन᭭सारणिन᭭सारणिन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण जल (ᮧदषूण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(9) ठोसठोसठोसठोस अपिश᳥अपिश᳥अपिश᳥अपिश᳥ ---- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकायᭅ रीित मᱶ होगा;
(iii) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭭मीकरण और भूिम भराव के ᭭थापनᲂ को अनु᭄ात नहᱭ ᳰकया जाएगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(10) जवै िचᳰक᭜ सीजवै िचᳰक᭜ सीजवै िचᳰक᭜ सीजवै िचᳰक᭜ सीय अपिश᭬ टय अपिश᭬ टय अपिश᭬ टय अपिश᭬ ट- जैव िच ᳰक ᭜ सीय अपिश ᳥ ᮧबंध िन᳜िलिखत के अनुसार होगा-
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜ सीय अपिश᭬ ट िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा सशंोिधत अिधसूचना सं.का.िन 343 (अ) तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(ii) पाᳯरि᭭थितक संवेदी जोन मᱶ कोई साधारण उपचार सुिवधा या भ᭭मीकरण अनु᭄ात नहᱭ ᳰकया जाएगा ।
(11) यानीययानीययानीययानीय पᳯरवहनपᳯरवहनपᳯरवहनपᳯरवहन....- पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल रीित मᱶ िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िविन᳸द᳥ उपबंध समािव᳥ ᳰकए जाएगें और ऐसे समय तक जब तक आंचिलक महायोजना के तैयार होती ह ैऔर रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होन ेतक, िनगरानी सिमित सुसंगत अिधिनयमᲂ तथा उनके अधीन बनाए गए िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को िनगरानी करेगी ।
(12) यानीययानीययानीययानीय ᮧदषूᮧदषूᮧदषूᮧदषूणणणण::::---- लागू िविधयᲂ के अनुसार वाहन ᮧदषूण कᳱ रोकथाम और िनयंᮢण का अनुपालन ᳰकया जाएगा। ᭭व᭒छक धन उदाहरण के िलए सीएनजी, आᳰद के उपयोग के िलए ᮧयास ᳰकए जाएगें ।
(13) ᭡लाि᭭टक᭡लाि᭭टक᭡लाि᭭टक᭡लाि᭭टक अपिश᳥अपिश᳥अपिश᳥अपिश᳥ ᮧबधंनᮧबधंनᮧबधंनᮧबधंन: : : : ---- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासशंोिधत अिधसूचना सा.का.िन 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(14) सिंनमाᭅणसिंनमाᭅणसिंनमाᭅणसिंनमाᭅण औरऔरऔरऔर िव᭟वसंिव᭟वसंिव᭟वसंिव᭟वसं अपिश᳥अपिश᳥अपिश᳥अपिश᳥ ᮧबधंनᮧबधंनᮧबधंनᮧबधंन: : : : ---- पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध भारत सरकार के पयाᭅवरण, वन और जलवाय ु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(15) ईईईई––––अपिश᳥अपिश᳥अपिश᳥अपिश᳥::::---- पाᳯरि᭭थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा समय-समय पर यथासंशोिधत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(16) औ᳒ोिगक ईकाऔ᳒ोिगक ईकाऔ᳒ोिगक ईकाऔ᳒ोिगक ईकाइयांइयांइयांइयां: : : : ---- (i) पाᳯरि᭭थितक संवेदी जोन के भीतर ᳰक᭠ही नए ᮧदषूणकारी उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा नहᱭ दी जाएगी।
(ii) पाᳯरि᭭थितक संवेदी जोन मᱶ कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा फरवरी, 2016 मᱶ जारी ᳰदशािनदᱷशᲂ मᱶ केवल गैर- केवल अᮧदषूणकारी उ᳒ोगᲂ कᳱ ᭭थापना को वगᱮकरण के अनसुार अनु᭄ा दी जाएगी, जब तक ᳰक अ᭠यथा इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᳥ न हो।

2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के खनन आदशे के अनुसरण का ᮧचालन होगा ।
2. जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । (क) कोई नई या पाᳯरि᭭थितक सवेंदी जोन मᱶ ᮧदषूण फैलाने वाले उ᳒ोगᲂ के िव᭭तार कᳱ अनुमित दी जाएगी। (ख) हᳯरत या ᳡ते कृिष आधाᳯरत लघु उ᳒ोगᲂ सिहत के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ वगᱮकरण के ᱨप मᱶ वगᱮकृत उ᳒ोगᲂ को िनयमᲂ के अनसुार िविनयिमत ᳰकया जाएगा।
3. जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) होगᱶ ।
4. नई बृहत ताप और जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) होगᱶ ।
5. यांिᮢक साधनᲂ ᳇ारा मछली पकडना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) होगᱶ ।
6. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । जब तक आंचिलक महायोजना के अधीन अनु᭄ात न ᳰकया जाए जब तक 1 से 10 मीटर के पहाड़ी ढलानᲂ पर और ᳰकसी नदी तट और ᮧाकृितक नाले से 100 मीटर तक कोई संि᭠ न माᭅण ᳰᮓयाकलाप नहᱭ ᳰकया जाएगा।
7. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) होगᱶ ।

9. ट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
10. फमᲄ, कंपिनयᲂ, आᳰद ᳇ारा बड़ े पैमाने पर वािणि᭔यक पशुधन संपदा और कुकुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को पूरा करन े के िसवाय लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे। िविनयिमत ᳰᮓयाकलापिविनयिमत ᳰᮓयाकलापिविनयिमत ᳰᮓयाकलापिविनयिमत ᳰᮓयाकलाप
11. होटलᲂ और ᳯरसोटᲄ का वािणि᭔यक ᭭थापन । पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए लघु अ᭭थायी संरचनाᲐ के िलए सरंिᭃत ᭃेᮢ सीमा के एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक ही जो भी िनकट हो कोई नया वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात हᲂगे अ᭠यथा नहᱭ । पर᭠तु संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर परे या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, जो भी िनकट हो सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार यथा लागू पयᭅटन महायोजना के अनुᱧप होगा ।
12. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक जो भी िनकट हो, ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके उपयोग के िलए उनकᳱ भूिम मᱶ ᭭थानीय िनवा᭭यᲂ कᳱ आवासीय आव᭫यकताᲐ को पूरा करने िलए संिनमाᭅण करने कᳱ अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी। (ख) इसके अितᳯर त, एक ᳰकलोमीटर से परे पाᳯरि᭭थितक संवेदी जोन के िव᭭ तार तक सावपूवᭅक ᭭थानीय आव᭫यकताᲐ के िलए संिनमाᭅण और अ᭠य संिनमाᭅण ᳰᮓयाकलापᲂ को महायोजना के अनुसार िविनयिमत ᳰकया जाएगा। (ग) पाᳯरि᭭थितक संवेदी जोन संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुसार हᲂगे।
13. नए सकरी-िबरौल कुशे᭫ वर अ᭭ थान - हसनपुर रेलवे लाइन का संिनमाᭅण और संचालन । व᭠यजीव (संरᭃण) अिधिनयम 1972 (1972 के 53) और भूिम (संरᭃण और ᮧबंधन) िनयम 2010 के अधीन अनुमितयᲂ पर आकि᭭मक होना चािहए और इसके तहत लगाए गए मुिᲦ, ᮧितपूरक और िविनयामक उपायᲂ के अधीन होगा। परंत,ु पाᳯरि᭭थितक-संवेदी जोन सीमा के बाहर रेलवे ᭭टेशन का संिनमाᭅण ᳰकया जाएगा।
14. ᮧदषूण उ᭜प᳖ न करन े वाल े लघ ु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन से गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग कृिष, पु᭬ प कृिष, उ᳒ान कृिष, या कृिष आधाᳯरत उ᳒ोग दशेीय माल स े औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई ᮧितकूल ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात हᲂगे ।
15. पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ हतेु पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए पाᳯरि᭭थितक अनुकूल कुटीर जसैे त᭥बु, लकड़ी के आवास। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9
16. ठोस अपिश᭬ ट ᮧबंधन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
17. पाᳯरि᭭थितक-पयᭅटन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
18. ᭡लाि᭭टक बैग का उपयोग। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे।
19. ᮧाकृितक जल िनकायᲂ मᱶ बिह᮲ाᭅव और ठोस अपिश᭬ ट का िन᭭सारण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे।
20. वायु और यािनक ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
21. ᭟ विन ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
22. भूिमगत जल का िन᭬ कषᭅण। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
23. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी । (ग) आरिᭃत वनᲂ और सरंिᭃत वनᲂ कᳱ दशा कायᭅयोजना मᱶ ᳰदए गए िववरण का अनुसरण ᳰकया जाएगा ।
24. रोपवे का संिनमाᭅण। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. िव᳒ुत और दरूसंचार टावरᲂ का पᳯरिनमाᭅण और केबल िबछाना और अ᭠य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे (भूिमगत केबल िबछाए जाने को बढ़ावा ᳰदया जाएगा)।
26. सुरᭃा कᱹप कᳱ ᭭थापना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

28. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना। लागू िविधयᲂ के अधीन िविनयिमत होगा (वन् यजीव के मु त संचलन को अनु᭄ात करने के िलए पाᳯरि᭭ थितक संवेदी जोन के भीतर होटलᲂ या अ᭠ य वािणि᭔ यक ᭭ थापना अपनी पᳯरसंपि᭜ तयᲂ मᱶ काटेदार स े बाड नहᱭ लगाएगें और कोई भी बाड़ एक मीटर से ऊंची नहᱭ होगी। कोई िव᳒मान बाड़, जो इस उपदशᭅ का अनुपालन नहᱭ करती ह,ै को आंचिलक महायोजना मᱶ वᳶणत समय-सीमा के अनुसार उपांतᳯरत ᳰकया जाएगा) ।
29. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᱶ, हलेीका᭡टर, ᮟोन, माइᮓोलाइटस और अ᭠य पयᭅटन ᳰᮓयाकलाप आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन के ऊपर से उड़ना जैसे अ᭠य ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(vi) लोक िनमाᭅण िवभाग , िबहार सरकार का एक ᮧितिनिध -सद᭭य ;
(vii) िबहार संरकार ᳇ारा पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै गैर सरकारी संगठन का तीन वषᭅ के िलए नामिन᳸द᭬ ट ᳰकया जाने वाला एक ᮧितिनिध - सद᭭य ;
(viii) पाᳯरि᭭ थितक और पयाᭅवरण के ᭃेᮢ से िबहार सरकार ᳇ारा तीन वषᭅ कᳱ अविध के िलए नामिन᳸द᭬ ट ᳰकया जाने वाला एक िवशेष᭄ - सद᭭य ;
(ix) ᭃेᮢीय अिधकारी, िबहार ᮧदषूण िनयंᮢण बोडᭅ, पटना - सद᭭य ;
(x) रा᭔य जैव-िविवधता बोडᭅ का सद᭭य - सद᭭य ;

6.6.6.6.िनदᱷश िनबधंनिनदᱷश िनबधंनिनदᱷश िनबधंनिनदᱷश िनबधंन:::: (1) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(2) मानीटरी सिमित का कायᭅकाल राजपᮢ मᱶ इस अिधसूचना ᮧकाशन कᳱ तारीख से तीन वषᭅ कᳱ अविध के िलए होगा।
(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं.

(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै और जो पाᳯरि᭭थितक संवेदी जोन मᱶ आते ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(5) मानीटरी सिमित का सद᭭य-सिचव या संब कलटर या संरिᭃत ᭃेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा।
(6) मानीटरी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहत ेᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

AND WHEREAS, copies of the Gazette containing the draft notification were made available to the public on the 26th May, 2016;
AND WHEREAS, all objections and suggestions received from persons and stakeholders in response to the draft notification were duly considered by the Central Government;
AND WHEREAS, the Kusheshwar Asthan Bird Sanctuary is situated in Darbhanga district of Bihar and is spread over an area of 29.21 square kilometers.
AND WHEREAS, the Kusheshwar Asthan Bird Sanctuary has a fresh water lake, and its adjoining area is of immense ecological, faunal, floral, geomorphological, religious and natural importance and has myriad aquatic flora and fauna;
AND WHEREAS, the Kusheshwar Asthan Bird Sanctuary is home to many species of water plants, abundant species of fish around forty species of local birds with fifteen rare and endangered species of migratory birds from Nepal, Tibet, Bhutan, Afghanistan, China, Pakistan, Mongolia Siberia and other countries, which flock to the area in the winter season, and the temple of Lord Shiva inside the Sanctuary is traced back to the epic period and is of immense religious importance;
AND WHEREAS, some important bird species marking presence in this area are Dalmatian Pelican (Pelicanus erisups), Indian Darter (Anlinga rufa), Bar-Headed Goose, White Winged Wood Duck (Cairiva scutulata), Marbled Teal (Marmaronetta anqustirostris), Baers Pochard (Aythya baeri), Siberian Crane (Grus leuogranus), Indian Skimmer (Rynchops albicollis), Oriental Qoosander (Merqus goosander), Whistling Teal, Kingfisher, Purple Moor-Hen, etc;
Terrestrial wildlife commonly contain, Rhesus macaque, Wild Boar, Jackal, Nilgai, etc. and reptiles include tortoises such as Harhi and Ahua and water snakes Cherna, Machalidihi, Basmha and Darrar; whereas important fish species are Rehu, Katla, Singhi, Garai, Bami, Ichna, etc.
AND WHEREAS, important plant species of the Sanctuary are Bel (Aegle marmelos), Siris (Albizia chinensis), Neem (Azadirachta indica), Semal (Bombox ceiba), Bargad (Ficus benghalensis), Pipal (Ficus religiosa), Mango (Mangifera indica), Khajur (Phoenix dactylifera), Jamun (Syzygium cumini) and Arjun Terminalia arjuna, etc; and some important aquatic plant species are Jalkumbhi, Narkat, Wild Rice, Blue Water Lili, Hydrela, Muskgrass, etc.
AND WHEREAS, the Sanctuary receives water from flood spill of rivers Kamla Balan, Purani Kamla, Kosi, Bhutahi and Jeevachh thereby preventing flooding and water logging of nearby agricultural lands and therefore, it acts as a water reservoir and also recharges the ground water in the process;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of the Kusheshwar Asthan Bird Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent varying from 0.5 kilomotre to 3 kilometres around the boundary of Kusheshwar Asthan Bird Sanctuary in the State of Bihar as the Kusheshwar Asthan Bird Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is spread over an area of 32.93 square kilometres with an extent varying from 0.5 kilometre to 3 kilometres from the boundary of Kusheshwar Asthan Bird Sanctuary and the map of the Eco-sensitive Zone along with latitudes and longitudes is appended as Annexure-I.
(2) The boundary description of the Kusheshwar Asthan Wildlife Sanctuary and its Eco-sensitive Zone along with the coordinates is appended as Annexures II-A and II-B .
(3) The Eco-sensitive Zone is spread over across 36 villages in the Darbhanga District of Bihar and the list of villages included in the Eco-sensitive Zone along with co-ordinates of prominent points is appended as Annexure-III.

2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The said Plan shall be approved by the competent authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Animal and Fishery Resources;
(viii) Water Resources (Irrigation);
(x) Public Works (Road Construction); and
(ix) Bihar State Pollution Control Board;
for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of the local residents, and for the activities such as,-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in para graph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within 1 km. from the boundary of the Kusheshwar Asthan Bird Sanctuary or upto the extent of the Eco-sensitive Zone, whichever is nearer and beyond the distance of 1 km. from the boundary of the said Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the ecotourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on ecotourism.
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation within six monthly from the date of publication of this notification in the official Gazette and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared within six months from the date of publication of this notification in the official Gazetted and in corporate in the Zonal Master Plan.
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the water (Prevention and control of Pollution) Act, 1974 (6 of 1974)
(9) Solid wastes. - Disposal and management of solid wastes shall be as under:-
(i) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016;
(ii) the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Ecosensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of land fills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- Bio-medical waste management shall be as under:-
(i) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016.

(ii) no common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Vehicular pollution.- Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example CNG, etc.
(13) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016.
(14) Construction and demolition waste management. - The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016.
(15) E-waste. - The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.
(16) Industrial units.- (i) No new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. Prohibited Regulated and Promoted activity.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Remarks

2. Setting up of industries causing water or air or soil or noise pollution.
(a)No new or expansion of polluting industries in the Eco-sensitive zone shall be permitted.
(b)Industries categorised as Green or White in the Central Pollution 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Control Board Classification including agro-based small scale industries shall be regulated as per applicable regulations.
3. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
4. Establishment of new major hydroelectric projects.
Prohibited (except as otherwise provided) as per applicable laws.
5. Fishing by mechanical means. Prohibited (except as otherwise provided) as per applicable laws.
6. Protection of natural slopes and river banks.
No construction activity except for bona fide needs for local residents shall be undertaken on the hill with slopes more than 1 to 10 and also up to 100 meters from the banks of any river, and natural nallah.
7. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
8. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
10. Establishment of large-scale commercial livestock and poultry farms by firms, companies etc.

Regulated Activities
11. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
12. Construction activities.
(a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone, whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws.
(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
13. Construction and operation of new Sakri –Biraul Kuseshwar Asthan- Hasanpur Railway line Shall be contingent upon permissions under Wildlife (Protection) Act 1972 (53 of 1972) and Wetland (Conservation and Management) Rules 2010 and subject to mitigation, compensatory ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 and regulatory measures imposed thereunder, however, the railway station shall be constructed outside the Eco-sensitive Zone boundary.
14. Small scale industries not causing pollution.
Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the Competent Authority.
15. Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, etc. for eco-friendly tourism activities.

16. Solid waste management. Regulated under applicable laws.
17. Eco-tourism. Regulated under applicable laws.
18. Use of plastic bags. Regulated under applicable laws.
19. Discharge of effluents and solid waste in natural water bodies or land area.

22. Extraction of ground water. Regulated under applicable laws.
23. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.
(c) In case of reserve forests and protected forests the Working Plan prescriptions shall be followed.
24. Construction of ropeways. Regulated under applicable laws.
25. Erection of electrical cables, Transmission lines and telecommunication towers.
Regulated under applicable laws (underground cabling may be promoted).
26. Setting up of security camps. Regulated under applicable laws.
27. Widening and strengthening of existing roads and construction of new roads, rail tract, etc.

Regulated under applicable laws (In order to allow free movement of wildlife, hotels or other commercial establishments within the Eco-sensitive Zone shall not fence their properties with barbed wire and no fence shall be higher than 1 meter and any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan).
29. Under taking other activities related to tourism like over flying the Ecosensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

30. Introduction of exotic species. Regulated under applicable laws.
31. Movement of vehicular traffic at night. Regulated under applicable laws.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions Eco-sensitive Zone comprising of the following, namely:-

Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted under.
34. Collection of small fodder and other non timber forest produce.

36. Fisheries. Regulated under applicable laws.
Promoted Activities
37. Rain water harvesting Shall be actively promoted.

(vi) A representative of the Department of Public Works (RCD), Government of Bihar - Member;
(vii) One representative of Non-Governmental Organisation working in the field of environment (including heritage conservation) to be nominated by the Government of Bihar for a period of up to three years at a time - Member;

6. Terms of reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the monitoring committee shall be for three years from the date of publication of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Park in-charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the State Government as per proforma appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification are subject to the orders, if any, passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
