¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 पा"रिDथितक$ संवेदी जोन म� उCोग/ या उCोग/ के वगk के �चालन तथा �संDकरण करने को �ितिषH करना आवbयक ह;ै अतः, अब, के4mीय सरकार, पया�वरण (संर:ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प"ठत पया�वरण (संर:ण) अिधिनयम, 1986 (1986 का 29) क$ धारा 3 क$ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप धारा (3) 'ारा �द> शि.य/ का �योग करत े@ए, िहमाचल �दशे राnय म� इंदर�कला राBीय उCान क$ सीमा के चारो ओर 469 मीटर स े 2.125 �कलोमीटर के :े� को इंदर�कला राBीय उCान पा"रिDथितक$ संवेदी जोन (िजसे इसम� इसके पb चात् पा"रिDथितक$ संवेदी जोन कहा गया ह)ै के aप म� अिधसूिचत करती ह,ै िजसका 7यौरा िनqानुसार ह,ै अथा�त् :--
1. पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� सवेंदीसवेंदीसवेंदीसवेंदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर उसक�उसक�उसक�उसक� सीमाएंसीमाएंसीमाएंसीमाएं-(1) पा"रिDथितक$ संवदेी जोन से 469 मीटर से
2.125 �कलोमीटर तक फैला @आ है इंदर�कला राBीय उCान क$ सीमा और पा"रिDथितक$ संवेदी जोन :े� 47.2 वग� �कलोमीटर है और पा"रिDथितक$ संवेदी जोन क$ सीमा का िववरण उपाबंधउपाबंधउपाबंधउपाबंध IIII के aप म� उपाबH ह ै। ।
(2) पा"रिDथितक$ संवेदी जोन का मानिच� और सीमा के 7यौरे तथा इसके अ:ांश और दशेा4तर के साथ उपाबंधउपाबंधउपाबंधउपाबंध IIIIIIII कककक----खखखख के aप म� उपाबH ह ै।
(3) संरि:त :े� के भू-मंडलीय िDथित �णाली के िनदdशांक और पा"रिDथितक$ संवेदी जोन उपाबंधउपाबंधउपाबंधउपाबंध IIIIIIIIIIII के aप म� उपाबH ह ै।
(4) पा"रिDथितक$ संवेदी जोन के अंतग�त कोई Tाम नह8 आते हh ।
2222.... पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� सवेंदीसवेंदीसवेंदीसवेंदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महायोजनामहायोजनामहायोजनामहायोजना –––– (1) राnय सरकार, पा"रिDथितक$ संवेदी जोन के �योजन/ के िलए राजप� म� इस अिधसूचना के अंितम �काशन क$ तारीख से दो वष� क$ अविध के भीतर, स:म �ािधकारी के अनुमोदन के िलए Dथानीय -ि.य/ के परामश� से, और इस अिधसचूना म� �दए गए अनुबंध/ का पालन करते @ए आंचिलक महायोजना तैयार करेगी ।
(2) पा"रिDथितक$ संवेदी जोन के िलए आंचिलक महायोजना राnय सरकार 'ारा ऐसी रीित जैसा इस अिधसूचना म� िविनjद6 ह ै और सुसंगत के4mीय और राnय िविधय/ तथा के4mीय सरकार 'ारा जारी माग�दश�क िसHांत/, य�द कोई हो, के अनुaप भी तैयार क$ जाएगी |
(3) आंचिलक महायोजना सभी संबH राnय िव भाग/ के साथ परामश� स ेपया�वरणीय और पा"रिDथितक$ िवचारण/ को उसम� एक$कृत करन ेके िलए तैयार क$ जाएगी, अथा�त्:-
(i) पया�वरण;
(ii) वन;
(iii) शहरी िवकास;
(iv) पय�टन;
(v) नगरपािलक;
(vi) राजD व;
(vii) कृिष;
(viii) िहमाचल �दशे राn य �दषूण िनयं�ण बोड�;

(x) लोक िनमा�ण िवभाग;
(4) आंचिलक महायोजना अनुमो�दत िवCमान भ-ूउपयोग, अवसंरचना और �sयाकलाप/ पर कोई िनबtधन अिधरोिपत नह8 करेगी जब तक �क इस अिधसूचना म� िविनjदu ट न हो और आचंिलक महायोजना सभी अवसरंचना और �sयाकलाप/ म� और अिधक द:ता और पा"रिDथितक$ अनुकूलता का संवध�न करेगी ।
(5) आंचिलक महायोजना म� अनाvछा�दत :े�/ के जीणkHार, िवCमान जल िनकाय/ के संर:ण, आवाह :े�/ के �बंधन, जल-संभर/ के �बंधन, भूतल जल के �बंधन, मृदा और नमी संर:ण, Dथानीय समुदाय/ क$ आवbयकताx तथा पा"रिDथितक$ और पया�वरण स ेसंबंिधत ऐसे अ4य पहलूx, िजन पर yयान दनेा आवbयक ह,ै के िलए उपबंध ह/गे ।
(6) आंचिलक महायोजना सभी िवCमान पूजा D थल/, Tाम/ और नगरीय बंदोबDत/, वन/ के �कार और �कD म/, जनजातीय :े�/, कृिष :े�/, ऊपजाऊ भूिम, ह"रत :े� जसैे उCान और उसी �कार के D थान, उCान कृिष :े�, फलोउCान, झील/ और अ4य जल िनकाय/ का अ{यकंन करेगी। योजना का मानिच� म� िवCमान और �Dतािवत भूिम के उपयोग क$ िवशेषताx के िववरण �कया जाएगा ।
(7) आंचिलक महायोजना D थानीय समुदाय/ क$ जीवकोपाज�न को सुिनिb चत करन ेके िलए, पा"रिDथितक$ संवदेी जोन म� िवकास को पा"रिDथितक$ अनकूुल िवकास के िलए पैरा 4 क$ सारणी म� सूची बH िविनयिमत करेगी और अिधसूचना म� िविनjद6 �ितिषH, िविनयम और संव5धत �sयाकलाप/ का अनुसरण करेगी।
(8) आंचिलक महायोजना :े�ीय िवकास योजना के साथ सह-कािलक होगा।
(9) आंचिलक महायोजना D थानीय समुदाय/ क$ जीवकोपाज�न को सुिनिb चत करन ेके िलए, पा"रिDथितक$ संवदेी जोन म� िवकास को पा"रिDथितक$ अनकूुल िवकास के िलए िविनयिमत करेगी ।
(10) आंचिलक महायोजना इस अिधसूचना म� �दए गए उपबंध/ के संबंध म� अपने काय} के बाहर ले जान ेके िलए िनगरानी सिमित के िलए एक संदभ� दDतावेज तैयार करेगी ।
3.3.3.3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय-------- राnय सरकार इस अिधसूचना के उपबंध/ को �भावी करन ेके िलए िनqिलिखत उपाय करेगी, अथा�त ्:-
(1) भिूमभिूमभिूमभिूम----उपयोग उपयोग उपयोग उपयोग ---- (क) पा"रिDथितक$ संवेदी जोन म� वन/, उCान-कृिष :े�/, कृिष :े�/, आमोद-�मोद के �योजन के िलए िचि4हत �कए गए पाक} और खुले Dथान/ का वृहद वािणिnयक या वृहद आवासीय काeपलैNस औCोिगक �sयाकलाप/ के िलए उपयोग या संप"रवत�न नह8 होगा:
(ख) परंत ुपा"रिDथितक$ संवेदी जोन के भीतर भाग (क) म� िविनjद6 �योजन स ेिभi �योजन के िलए कृिष और अ4य भूिम का संप"रवत�न, िनगरानी सिमित क$ िसफा"रश पर और यथा लागू और :�ेीय नगर योजना अिधिनयम तथा के4mीय/राnय सरकार के अ4य िनयम/ तथा िविनयम/ के अधीन स:म �ािधकारी के पूव� अनुमोदन से, तथा इस अिधसूचना के उपबंध/ 'ारा Dथानीय िनवािसय/ क$ िनqिलिखत आवासीय जaरत/ को पूरा करन ेके िलए अनु�ात �कया जाएगा, जसै े�क:-
(i) िवCमान सड़क/ को चौड़ा करना और उ4ह� सुदढृ करना और नई सड़क/ का संिनमा�ण;
(ii) बुिनयादी ढांच/ और नाग"रक सुिवधाx का संिनमा�ण और नवीकरण;
(iii) �दषूण उ=पi न करन ेवाले लघु उCोग,
(iv) कुटीर उCोग/ िजसके अंतग�त Tामीण उCोग हh; सुिवधाजनक भFडार और Dथानीय सुख-सुिवधाx जो ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 पा"रिDथितक$ पय�टन म� सहायक हh िजसम� गृह वास सिeमिलत ह;ैऔर
(v) संव5धत �sयाकलाप और Dतंभ के पैरा 4 के अधीन �दया गया ह:ै परंत ुयह भी �क :े�ीय शहरी िनयोजन अिधिनयम के अधीन स:म �ािधकारी के पूव� अनुमोदन के िबना तथा राnय सरकार के अ4य िनयम/ एवं िविनयम/ का अनुपालन �कए िबना तथा संिवधान के अनvुछेद 244 के उपबंध/ तथा त=समय �वृ> िविध, िजसके अंतग�त अनुसूिचत जनजाित और अ4य परंपरागत वन िनवासी (वन अिधकार/ क$ मा4यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै के अनुपालन के िबना वािणिnयक या औCोिगक िवकास �sयाकलाप/ के िलए जनजातीय भूिम का �योग अनु�ात नह8 होगा। परंत ुयह भी �क पा"रिD थितक$ संवेदी जोन के भीतर क$ भूिम के अिभलेख/ म� उ=पi �कसी �ु"ट क$, िनगरानी सिमित के िवचार �ा? करन ेके प�ात,् राnय सरकार 'ारा �=येक मामले म� एक बार शुिH क$ जाएगी और उ.
�ु"ट के शुिHकरण क$ सचूना क� mीय सरकार के पया�वरण, वन और जलवायु प"रवत�न मं�ालय को दी जाएगी । परंत ुयह भी �क उपयु�. �ु"ट के शुिHकरण म�, इस उप-पैरा म� यथा उपबंिधत के िसवाय, �कसी भी दशा म� भू- उपयोग का प"रवत�न सिeमिलत नह8 होगा । (ख) अनु�युN त या अनु= पादक कृिष :े�/ म� पुन: वनीकरण के तथा पया�वास और जैव-िविवधता क$ बहाली के �यास �कए जाएगंे ।
(2) �ाकृितक जल �ोते�ाकृितक जल �ोते�ाकृितक जल �ोते�ाकृितक जल �ोते - आचंिलक महायोजना म� सभी �ाकृितक जल �ोत/ क$ पहचान क$ जाएगी और उनके संर:ण और पुन��भूतकरण के िलए योजना सिe मिलत होगी और राn य सरकार 'ारा ऐसे :े�/ पर या उनके िनकट िवकास �sयाकलाप �ितिषH करने के िलए ऐसी रीित से माग�िनदdश तैयार �कए जाएगंे ।
(3) पय�टन/पा�रि�थितक� पय�टन पय�टन/पा�रि�थितक� पय�टन पय�टन/पा�रि�थितक� पय�टन पय�टन/पा�रि�थितक� पय�टन –––– (क) पा"रिDथितक$ संवेदी जोन के भीतर सभी नए पा"रिDथितक$ पय�टन �sयाकलाप या िवCमान पय�टन �sयाकलाप/ का िवDतार पा"रिDथितक$ संवेदी जोन सeबंधी पय�टन महायोजना के अनुसार होगा । (ख) पा"रिDथितक$ पय�टन महायोजना पय�टन िवभाग 'ारा राnय सरकार के पया�वरण और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना का एक घटक होगी । (घ) पय�टन संबंधी �sयाकलाप िनe नानुसार िविनयिमत �कए जाएगंे, अथा�त् :- (क) राBीय उCान क$ सीमा 1 �कलोमीटर के भीतर या पा"रिDथितक$ संवेदी जोन के िवDतार तक, इसम� जो भी नजदीक हो होटल और "रसोट� के नए संिनमा�ण अनु�ात नह8 होगे। तथािप राBीय उCान क$ सीमा से एक �कलोमीटर क$ दरूी से परे पा"रिDथितक$ संवेदी जोन के िवDतार तक नए होटल और "रसोटk क$ Dथापना को पूव� प"रभािषत और िविनjद6 :े�/ म� पा"रिDथितक$ पय�टन काय�कलापो के िलए पय�टन महायोजना के अनुसार अनु�ात �कया जाएगा;
(ख) पा"रिDथितक$ संवेदी जोन के भीतर सभी नए पय�टन �sयाकलाप/ या िवCमान पय�टन �sयाकलाप/ का िवDतार राu Pीय Y या� संर:ण �ािधकरण, पया�वरण, वन और जलवायु प"रवत�न मं�ालय 'ारा जारी (समय-समय पर यथा संशोिधत) माग�िनदशे/ के अनुसार होगा िजसम� पा"रिDथितक$ पय�टन, पा"रिDथितक$ 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] िश:ा और पा"रिDथितक$ िवकास को मह=व �दया जाएगा और पा"रिDथितक$ संवेदी जोन क$ वहन :मता के अyययन पर आधा"रत होगा;
(ग) आंचिलक महायोजना का अनुमोदन �कए जान े तक, पय�टन के िलए िवकास और िवCमान पय�टन �sयाकलाप/ के िवDतार को वाDतिवक Dथल िविनjद6 संवी:ा तथा िनगरानी सिमित क$ िसफा"रश पर आधा"रत संबंिधत िविनयामक �ािधकरण/ 'ारा अनु�ात �कया होगा ।
(4) नैस$गकनैस$गकनैस$गकनैस$गक िवरासतिवरासतिवरासतिवरासत ---- पा"रिDथितक$ संवेदी जोन म� मह=वपूण� नैस5गक िवरासत के सभी Dथल/ जैस ेसभी जीन कोश आरि:त :े�, शैल िवरचनाए,ं जल �पात/, झरन/, घाटी माग}, उपवन/, गुफाए,ं Dथल/, �मण, अ�रोहण, �पातो आ�द क$ पहचान क$ जाएगी और उ4ह� संरि:त �कया जाएगा तथा उनक$ सरु:ा और संर:ा के िलए ऐसी योजना आंचिलक महायोजना का भाग होगा ।

22. होटल# और लॉज के िव�मान प�रसर# मE बाड लगाना । लागू िविधय# के अधीन िविनयिमत होगा । पा�रिFथितक� संवेदी जोन के भीतर व@यजीव के अबाध संचलन को अनुHात करने के िलए होटल# या अ@य वािणि�यक Fथापन# को कांटेदार तार से उनक� संपिiय# क� बाड नह* लगाई जाएगी और कोई भी बाड एक मीटर से अिधक क� नह* होगी । इस अनुबंध का अनुपालन न करने वाली िव�मान बाड को आंचिलक महायोजना मE उिjलिखत समय सीमा) के अनुसार उपांत�रत �कया जाएगा।

(1) पा"रिDथितक$ संवेदी जोन सिमित इस अिधसूचना के उपबंध/ के अनुपालन को मानीटर करेगी ।
(2) िनगरानी सिमित का काय�काल तीन वष� तक या राnय सरकार 'ारा नई सिमित का पुन: गठन �कए जान े तक होगा और बाद म� िनगरानी सिमित राnय सरकार 'ारा ग"ठत क$ जाएगी।
(3) पा"रिDथितक$ संवेदी जोन म� भारत सरकार के त= कालीन पया�वरण और वन मं�ालय क$ अिधसूचना का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 क$ अनुसूची म� के अधीन सिeमिलत �sयाकलाप/ और इस अिधसूचना के पैरा 4 के अधीन �ितिषH गितिविधय/ के िसवाय आने वाले ऐसे �sयाकलाप/ क$ दशा म� वाDतिवक िविनjद6 Dथलीय दशाx पर आधा"रत िनगरानी सिमित 'ारा संवी:ा क$ जाएगी और उ. अिधसूचना के उपबंध/ के अधीन पूव� पया�वरण िनकासी के िलए के4mीय सरकार के पया�वरण, वन और जलवायु प"रवत�न मं�ालय को िनjद6 क$ जाएगी ।

AND WHEREAS, copies of the Gazette containing the draft notification were made available to the public on the 21 st July 2016.
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification;
AND WHEREAS, the Inderkila National Park situated in Kullu District of Himachal Pradesh over an area of about 104 sq km square kilometers;
AND WHEREAS, the flora and fauna represent rich biological significance of this sanctuary;

AND WHEREAS, important flora reported from the Inderkila Wildlife Sanctuary are Spruce (Picea smithiana), Fir (Abies pindrow), Kharshu (Quercus semicarpifolia), Burans (Rhododendron arboretum), Rakhal (Taxus baccata), Khanor (Aesculus indica), Boxwood (Buxus wallichiana), Walnut (Juglans regia), Bhojpatara (Betula utilis), Prunus (Prunus sp), Ash (Fraxinus micrantha), and Maple (Acer pictum) etc.
While, the important herbs and shrubs of the National Park are Rubus (Rubus ellipticus), Kashmal (Berberis aristata), Guchhi (Morchella esculanta), Kathi (Indigofera pulchella), Rose (Rosa moschata), Bekhal (Prinsepia utilis), Ivy (Hedra spp), Spirea (Spirea elegans), Sarcococca (Sarcococca saligna), Iris (Iris spp), Desbergla (Debregesia sp), Gerardiana (Gerardiania hetrophylla), Daphne(Daphne papyracea), Plectranthus(Plectranthus rugosus), Lonicera (Lonicera spp.), Thilectrum (Thallictrum spp.), Salvia (Salvia spp.), Castor (Ricinus communis), Shingli mingli (Dioscorea deltoidea), Patish (Aconitum spp.), Dhoop (Jurinea macrocephala), Cotonester (Cotoneaster spp), Valeriana (Valeriana wallichii), Canabis (Canabis sativa), Kurroa (Gentiana Kurroo), Artemesia (Artemisia spp), Salam panja (Orcis latifolia), Thymus (Thymus spp.), Anemone (Anemone spp.), Deutzia (Deutzia compacta), Rumex (Rumex hastatus), Polygonum (Polygonum spp.), Strobilanthus (Strobilanthus spp), Balsam (Impatiens spp.), Banaksha (Viola spp.), Primula (Primula spp.), Ranunculus (Ranunculus spp.), Saxifraga (Saxifraga ligulata), Wild strawberry (Fragaria nubicola) etc;
AND WHEREAS, Snow leopard (Uncia uncial), Himalayan Brown Bear (Ursus arctos), Himalayan Tahr (Hemitragus jemlahicus), Black bear (Ursus thibetanus), Himalayan Ibex (Capra ibex), Musk Deer (Moschus chrysogaster), Himalayan Griffon (Gyps himalayensis), Rakhal (Taxus baccata), Bhojpatara (Betula utilis), Maple (Acer pictum), Gerardiana (Gerardiania hetrophylla), Shingli mingli (Dioscorea deltoidea), Patish (Aconitum spp), Dhoop (Jurinea macrocephala), Artemesia (Artemisia spp.), Salam panja (Orcis latifolia), Banaksha (Viola spp) etc. are the important rare, endangered, threatened flora and fauna of the National Park;
AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of the Inderkila National Park as Eco- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent 469 meter to 2.125 kilometer around the boundary of the Inderkila National Park in the State of Himachal Pradesh as the Inderkila National Park Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone shall be an extent of 469 meter to 2.125 kilometers from the boundary of the Inderkila National Park and the Eco-sensitive Zone area is 47.2 square kilometers and the boundary description of the said Eco-sensitive Zone is appended as Annexure-I.
(2) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-IIA-B.
(3) The Global Positioning System co-ordinates of Protected Area and Eco-sensitive Zone are appended as Annexure-III.
(4) No villages falling in the proposed Eco-sensitive Zone.
2. Zonal Master Plan for Eco-sensitive Zone.-
(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority of State.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan, namely:-
(a) Environment;
(b) Forest;
(c) Urban Development;
(d) Tourism;
(e) Municipal;
(f) Revenue;
(g) Agriculture;

(h) Himachal Pradesh State Pollution Control Board;
(i) Irrigation; and
(j) Public Works Department,
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The said Master Plan shall regulate development in the Eco-sensitive Zone so as to ensure ecofriendly development for livelihood security of local communities.
(10) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the State Government - The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use. –
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant laws of the Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given under paragraph 4 of the column:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant laws of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism/ Eco-tourism.-
(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(a) No new construction of hotels and resorts shall be allowed within 1 kilometer from the boundary of the National Park or upto the extent of the Eco-sensitive Zone whichever is nearer. However, beyond the distance of 1 km from the boundary of the National Park till the extent of the Ecosensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per the Tourism Master Plan.
(b) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] National Tiger Conservation Authority (as amended from time to time) with emphasis on ecotourism;
(c) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc.
shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution. - Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 .
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents. - Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and the rules made thereunder and standards stipulated by the State Government.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016 and the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive Zone.
(10) Bio-medical waste. – Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23 Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28 th March,
2016.
(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
(11) Plastic Waste Management. - The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016.
(12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March,
2016.
(13) E-waste. - The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution. - Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws.
(16) Industrial Units. –
(i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes. - The protection of hill slopes shall be as under:-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.

(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:- TABLE S.No. Activity Remarks

(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited except for the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal use.
(b) The mining operations shall strictly be in accordance with the interim orders of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon’ble Supreme Court dated the 21 st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012.
2. Setting up of saw mills and wood based industry.
No new or expansion of existing saw mills and wood based industries shall be permitted within the Eco-sensitive Zone.

3. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
4. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted.
5. Establishment of new major thermal and hydro-electric projects.
Prohibited (except as otherwise provided) as per applicable laws.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
7. Use of polythene bags by shopkeeper.
Prohibited (except as otherwise provided) as per applicable laws.
8. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
9 Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
Regulated Activities
10.
Undertaking activities related to tourism like over-flying the national park area by aircraft, hot-air balloons.
Regulated under applicable laws.
11.
Establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or the boundary of Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities.
12. Construction activities.
No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area or of the Eco-sensitive Zone whichever is nearer:
Provided that local people shall be permitted to undertake construction in their 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] land for residential use including the activities listed in sub-paragraph (1) of paragraph 3:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum with the prior permission from the competent authority as per applicable rules and regulations, if any.
13. Trenching ground. Establishment of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws.
14. Discharge of treated effluents and solid waste in natural water bodies or land area.
Regulated under applicable laws.
15. Air and vehicular pollution. Regulated under applicable laws.
16. Noise pollution. Regulated under applicable laws.
17. Extraction of ground water. Regulated under applicable laws.
18. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the relevant Central or State Acts and the rules made thereunder.
(c) In case of reserve forests and protected forests, the working plan prescriptions shall be followed.
19. Migratory graziers. Regulated under applicable laws and as per Zonal Master Plan.
20. Erection of electric lines. Promote underground cabling. All existing electric lines passing through the Ecosensitive Zone shall be adequately insulated in the time frame prescribed under the Zonal Master Plan.

21. Widening and strengthening of existing roads.
Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
22. Fencing of existing premises of hotels and lodges.
Regulated under applicable laws.
In order to allow free movement of wildlife, hotels or other commercial establishments within the Eco-sensitive Zone shall not fence their properties with barbed wire and no fence shall be higher than 1 meter. Any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan.
23. Collection of Non-timber forest products.
Regulated under applicable laws.
24.
Drastic change of agricultural system.
Regulated under applicable laws.
25. Commercial use of natural water resource including ground water harvesting.
Regulated under applicable laws.
26. Movement of vehicular traffic at night.
Regulated under applicable laws.
27. Introduction of exotic species. Regulated under applicable laws.
28. Fishing. Regulated (except as otherwise provided) as per applicable laws.
29. Sign board and hoardings. Regulated under applicable laws.
30. Protection of hill slopes and river banks.
No construction activity unless otherwise permitted by or under the Zonal Master Plan shall be undertaken on the hill with slopes more than 1 to 10 and also upto 100 meters from the banks of any river, and natural nallah.
31. Small scale industries not causing pollution.
Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee for three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) Conservator of Forests, Kullu - Chairman
(ii) An expert in the area of ecology and environment - Member to be nominated by the Government of Himachal Pradesh for a period of three years
(iii) One representative of non-Governmental Organisation - Member (Working in the field of environment including heritage Conservation) to be nominated by the Government of Himachal Pradesh for a period of three years
(iv) Regional Executive Engineer, Himachal Pradesh State Pollution - Member Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
32. Solid Waste Management. Regulated under applicable laws.
33. Eco-tourism. Regulated under applicable laws.
Promoted Activities
34. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Shall be actively promoted.
35. Organic farming. Shall be actively promoted.
36. Adoption of green technology for all activities.
Shall be actively promoted.
37. Rain water harvesting. Shall be actively promoted.
38. Cottage industries including village artisans.
Shall be actively promoted.
39. Use of renewable energy sources.

40. Agro Forestry. Shall be actively promoted.
41. Environmental Awareness. Shall be actively promoted.

6. Terms of Reference. –
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be for a period of three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment, Forest and Climate Change number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma given in Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
