PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2504] ubZ fnYyh] 'kqØokj] flrEcj 1] 2017@Hkkæ 10] 1939 No. 2504] NEW DELHI, FRIDAY, SEPTEMBER 1, 2017/BHADRA 10, 1939 पयाᭅवरणपयाᭅवरणपयाᭅवरणपयाᭅवरण, वन और जलवाय ुपᳯरवतᭅनवन और जलवाय ुपᳯरवतᭅनवन और जलवाय ुपᳯरवतᭅनवन और जलवाय ुपᳯरवतᭅन मंᮢ ालयमंᮢ ालयमंᮢ ालयमंᮢ ालय अिधसचूनाअिधसचूनाअिधसचूनाअिधसचूना नई ᳰद᭨ली, 30 अग᭭त, 2017 काकाकाका....आआआआ. 2859(. 2859(. 2859(. 2859(अअअअ))))....————एक ᮧाᱧप अिधसूचना भारत के राजपᮢ असाधारण मᱶ भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 2629(अ), तारीख 5 अग᭭त, 2016 ᳇ारा ᮧकािशत कᳱ गई थी िजसमᱶ ऐसे सभी ᳞िᲦयᲂ से, िजनकᳱ उससे ᮧभािवत होन ेकᳱ संभावना थी, उस तारीख से, िजसको अिधसूचना को अ᭠तᳶव᳥ करन े वाले राजपᮢ कᳱ ᮧितयां जनता को उपल᭣ध करा दी गई थᱭ, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमंिᮢत ᳰकए गए थ;े और, पूवᲃᲦ ᮧाᱧप अिधसूचना के ᮧ᭜युᱫर मᱶ ᳞िᲦयᲂ और पणधाᳯरयᲂ से कोई आᭃेप और सुझाव ᮧा᳙ नहᱭ ᱟए थ;े और, ᳰक᳖ेरसानी व᭠यजीव अभयार᭛य 640.33 वगᭅ ᳰकलोमीटर ᭃेᮢ के साथ तेलगंाना रा᭔य के ख᭥मम िजले मᱶ पालᲂचा क᭭बे से उᱫर मᱶ 12 ᳰकलोमीटर कᳱ दरूी पर ि᭭थत ह ैऔर यह दᲥन ᮧाय᳇ीपीय जैव भौगोिलक जोन मᱶ आता ह;ै और, ᳰक᳖ेरसानी व᭠यजीव अभयार᭛य अ᭜यिधक वनᲂ वाला पहाड़ी इलाका ह ै जो कᳱ ᮧचुर जैविविवधता को पोिषत करता ह-ै और िजसमᱶ िविवध ᮧकार के वन᭭पित और जीव ज᭠तु ह ᱹऔर अभयार᭛य मᱶ मु᭎य वन ᮧकार मᱶ अिधकतर दिᭃणी शु᭬क िमि᮰त पणᭅपाती वन ह;ᱹ और, अभयार᭛य मᱶ सामा᭠यतः पौधᲂ कᳱ ᮧजाितयां जैसेः हाडᭅिवᳰकया िबनाटा, ᭡टेरोकापᭅस मासुᭅिपयम, अदीना कॉᳶडफोिलआ, अनोगइे᭭सुस लटैीफ़ोिलआ, टᳶमनािलया टोमे᭠टोसा, टᳶमनािलया बे᭨लेᳯरका, बॉिहिनया रसमोसा, अकाᳰकया ᮧजाितयां, िडऑसपाइरोस मेलनो᭍सीलोन, एंगल े मरमेलोस, फेरोिनया एलेफेनटम, अज़ािडराचटा इंिडका, डᱶᮟोकालमस ि᭭ᮝ᭍टस, िज़ज़ीफुस ᮧजाितयां और ᳰफकस ᮧजाितयां पाये जाते ह ᱹ;

और, ᳰक᳖ेरसानी व᭠यजीव अभयार᭛य मᱶ अनेक पशु ᮧजाितयᲂ का वास ᭭थल ह ै जैसे जंगली भैसा, बाघ, तᱶदआु, जंगली िब᭨ली, छोटा भारतीय गंधिबलाव, मुसंग, जंगली कुᱫा, रीछ, िसयार, लकड़ब᭏ घा, भारतीय बृहत िगलहरी, सांभर, िचᱫीदार िहरण के साथ पिᭃयᲂ कᳱ ᮧजाितयᲂ का वास ᭭थल भी ह ै;

2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, ᳰक᳖रेसानी व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड

(xiv) और उपधारा (3) के साथ पᳯठत ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए, तेलगंाना रा᭔ य मᱶ ᳰक᳖ेरसानी व᭠यजीव अभयार᭛य कᳱ सीमा से 1 ᳰकलोमीटर से 21 ᳰकलोमीटर तक के िव᭭ ताᳯरत ᭃेᮢ को ᳰक᳖ेरसानी व᭠यजीव अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:—

1. पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन काकाकाका िव᭭तारिव᭭तारिव᭭तारिव᭭तार औरऔरऔरऔर उसकᳱउसकᳱउसकᳱउसकᳱ सीमाएंसीमाएंसीमाएंसीमाएं.—(1) पाᳯरि᭭ थितक संवेदी जोन का िव᭭तार तलेगांना रा᭔य मᱶ ᳰक᳖ेरसानी व᭠यजीव अभयार᭛य के चारᲂ ओर 1 ᳰकलोमीटर से 21 ᳰकलोमीटर के िव᭭ताᳯरत ᭃेᮢ मᱶ 1449.44 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ ह,ै पाᳯरि᭭थितक संवेदी जोन के अंतगᭅत 70 ᮕाम ि᭭थत ह ᱹ।

(2) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का िववरण उपाबधंउपाबधंउपाबधंउपाबधं I के ᱧप मᱶ उपाब᳍ ह ैऔर ᮕामᲂ कᳱ सूची उपाबधंउपाबधंउपाबधंउपाबधं II के ᱧप मᱶ दी गई ह ै।

(3) अᭃांश और देशांतर सिहत पाᳯरि᭭थितक संवेदी जोन सीमा का मानिचᮢ इस अिधसूचना के साथ उपाबधंउपाबधंउपाबधंउपाबधं III के ᱧप मᱶ उपाब᳍ ह ै।

2222.... पाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितकपाᳯरि᭭थितक सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महायोजनामहायोजनामहायोजनामहायोजना....————(1) रा᭔य सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ ᳰदए गए अनुबंधᲂ का पालन करते ᱟए आंचिलक महायोजना तैयार करेगी।

(2) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित जो इस अिधसूचना मᱶ िविन᳸द᭬ ट ह ैतथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के अनुᱧप और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।

(3) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक संबंधी बातᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब᳍ िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत:्—

(i) पयाᭅवरण;

(ii) वन और व᭠यजीव;

(iii) कृिष और बागवानी ;

(iv) राज᭭ व;

(v) शहरी िवकास;

(vi) पयᭅटन सिहत पाᳯरि᭭थितक पयᭅटन;

(vii) ᮕामीण िवकास;

(viii) ᳲसचाई और बाढ़ िनयंᮢण;

(ix) नगरपािलक और शहरी िवकास;

(x) पंचायती राज;

(4) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ जो अिधक दᭃता और पाᳯरि᭭थितक अनुकूल हᲂ का संवधᭅन करेगी ।

(5) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलुᲐ, िजन पर ᭟यान देना आव᭫यक ह,ै के िलए उपबंध हᲂगे ।

(6) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी और इस योजना के मानिचᮢ के साथ िव᳒मान और ᮧ᭭तािवत भूिम उपयोग िवशेषताᲐ का िववरण संलᲨ होगा ।

(7) आंचिलक महायोजना पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगी और सारणी मᱶ सूचीब᳍ ᮧितिष᳍, िविनयिमत ᳰᮓयाकलापᲂ का पालन करेगी तथा ᭭ थानीय समुदायᲂ कᳱ आजीिवका सुरᭃा के िलए, पाᳯरि᭭थितक अनुकूल िवकास सुिनि᭫ चत करेगी तथा संवᳶधत करेगी।

(8) आंचिलक महायोजना ᭃेᮢीय िवकास योजना कᳱ सह िव᭭तारी होगी ।

(9) इस ᮧकार अनुमोᳰदत आंचिलक महायोजना इस अिधसूचना के उपबंधᲂ के अनुसार मानीटरी के अपने कृ᭜यᲂ को करने के िलए एक संदभᭅ द᭭तावेज मानीटरी सिमित के िलए होगी ।

3. रा᭔यरा᭔यरा᭔यरा᭔य सरकारसरकारसरकारसरकार ᳇ारा᳇ारा᳇ारा᳇ारा ᳰकएᳰकएᳰकएᳰकए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय....————रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन े के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत्:—

(1) भूभभूूभू----उपयोगउपयोगउपयोगउपयोग....————(क) पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुल े᭭थानᲂ का वृहद वािणि᭔यक या वृहद आवासीय का᭥पलै᭍स औ᳒ोिगक ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा:

परंत ुपाᳯरि᭭थितक संवेदी जोन के ᮧयोजन से िभ᳖ ᮧयोजन के िलए कृिष और अ᭠य भूिम का संपᳯरवतᭅन मानीटरी सिमित कᳱ िसफाᳯरश पर और यथा लाग ूऔर ᭃेᮢीय नगर योजना अिधिनयम तथा के᭠ᮤीय/रा᭔य सरकार के अ᭠य िनयमᲂ तथा िविनयमᲂ के अधीन सᭃम ᮧािधकारी के पूवᭅ अनुमोदन से, तथा इस अिधसूचना के उपबंधᲂ ᳇ारा ᭭थानीय िनवािसयᲂ कᳱ िन᳜िलिखत आवासीय जᱨरतᲂ को पूरा करने के िलए अनु᭄ात ᳰकया जाएगा, जैसे:-

(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;

(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;

(iii) ᮧदषूण उ᭜प᳖ न करने वाल ेलघ ुउ᳒ोग;

(iv) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुख-सुिवधाᲐ जो पाᳯरि᭭थितक पयᭅटन मᱶ सहायक ह ᱹिजसमᱶ ᮕह वास सि᭥मिलत ह;ै और

(v) संवᳶधत ᳰᮓयाकलाप और जो पैरा 4 के अधीन ᳰदए गए ह।ᱹ परंत ुयह और भी ᳰक ᭃेᮢीय नगर योजना अिधिनयम और अ᭠य िनयमᲂ और िविनयमᲂ के अधीन रा᭔य सरकार के पूवᭅ अनुमोदन तथा संिवधान के अनु᭒छेद 244 और त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा:

परंत ुयह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ ᮧकट होने वाली कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करन े के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामल े मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को देनी होगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट के संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । (ख) वनरोपण और वास जीणᲃ᳍ार ᳰᮓयाकलापᲂ वाले अनᮧयु᭍ त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।

(2) ᮧाकृितक जल ᮧाकृितक जल ᮧाकृितक जल ᮧाकृितक जल िनकायिनकायिनकायिनकाय.—आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ/नᳰदयᲂ/जलसरणी कᳱ पहचान कᳱ जाएगी और उसमᱶ उनके संरᭃण और पनुᱧ᳍ार के िलए योजना सि᭥ मिलत होगी ।

(3) पयᭅटन/पाᳯरि᭭थितक पयᭅटन पयᭅटन/पाᳯरि᭭थितक पयᭅटन पयᭅटन/पाᳯरि᭭थितक पयᭅटन पयᭅटन/पाᳯरि᭭थितक पयᭅटन –––– (क) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप या िव᳒मान पयᭅटन संबंधी ᳰᮓयाकलाप पाᳯरि᭭थितक संवेदी जोन के िलए पयᭅटन महायोजना के अनुसार हᲂगे । (ख) पाᳯरि᭭थितक पयᭅटन महायोजना पयᭅटन िवभाग, ᳇ारा रा᭔य सरकार के पयाᭅवरण और वन िवभाग के परामशᭅ से तैयार होगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ होगी । (घ) पाᳯरि᭭थितक पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत ्:—

(i) व᭠यजीव अभयरा᭛य कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, जो भी िनकट हो, ᳰकसी होटल या ᳯरसोटᭅ का नया संि᳖माᭅण अन᭄ुात नहᱭ ᳰकया जाएगा । तथािप, व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर कᳱ दरूी से परे पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक नए होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितक पयᭅटन सुिवधाᲐ के िलए पूवᭅ सीमांᳰकत और पदािभिहत ᭃेᮢᲂ मᱶ ही अनु᭄ात कᳱ जाएगी।

(ii) पाᳯरि᭭थितक संवेदी जोन के अ᭠दर सभी नए पयᭅटन ᳰᮓया-कलाप या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार के᭠ᮤीय सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा जारी मागᭅदशᱮ िस᳍ांतᲂ तथा पाᳯरि᭭थितक पयᭅटन पर बल दतेे ᱟए रा᳦ीय बाघ संरᭃण ᮧािधकरण ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन मागᭅदशᱮ िस᳍ांतᲂ (समय- समय पर यथा संशोिधत) के अनुसार होगा ।

(iii) जब तक आंचिलक महायोजना का अनुमोदन नहᱭ कर ᳰदया जाता ह ैजब तक पयᭅटन संबंधी िवकास तथा िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार मानीटरी सिमित के वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा िसफाᳯरश के आधार पर स᭥बंिधत िविनयामक ᮧािधकारी ᳇ारा अन᭄ुात ᳰकया जाएगा और पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के भीतर कोई नया होटल और ᳯरसाटᭅ और वािणि᭔यक ᭭थापन का संि᳖माᭅण अनु᭄ात नहᱭ ᳰकया जाता ह ै।

(4) नसैᳶगकनसैᳶगकनसैᳶगकनसैᳶगक िवरासतिवरासतिवरासतिवरासत....————पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और िवरासत संरᭃण योजना आंचिलक महायोजना के भाग के ᱧप मᱶ पᳯररᭃण और संरᭃण के िलए तैयार कᳱ जाएगी ।

(5) मानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थमानव िनᳶमत िवरासत ᭭ थलललल....————पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान और उनके संरᭃण के िलए िवरासत योजना आंचिलक महायोजना के भाग के ᱧप मᱶ तैयार कᳱ जाएगी ।

(6) ᭟ व᭟ व᭟ व᭟ विन ᮧदषूणिन ᮧदषूणिन ᮧदषूणिन ᮧदषूण.—पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण का िनयंᮢण रा᭔ य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ के अनुसार पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, 2000 कᳱ अनुपालन मᱶ होगा ।

(7) वायुवायुवायुवायु ᮧदषूणᮧदषूणᮧदषूणᮧदषूण.—पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण कᳱ रोकथाम और िनयंᮢण वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) के उपबंधᲂ और उसके अधीन बनाए गए िनयमᲂ और उनमᱶ ᳰकए गए संशोधनᲂ के अनुसार ᳰकया जाएगा ।

(8) बिह᮲ावबिह᮲ावबिह᮲ावबिह᮲ाव काकाकाका िन᭭सारणिन᭭सारणिन᭭सारणिन᭭सारण.—पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, साधारणᲂ मानकᲂ के अ᭠तगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के अधीन आन ेवाल ेपयाᭅवरणीय ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 ᮧदषूण के िन᭭सारण के िलए साधारण मानकᲂ या रा᭔य सरकार ᳇ारा िनयत मानकᲂ, जो भी अिधक कठोर हो, के उपबंधᲂ के अनुसार होगा।

(9) ठोसठोसठोसठोस अपिश᳥अपिश᳥अपिश᳥अपिश᳥....————ठोस अपिश᳥ᲂ का िनपटान और ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा— (क) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ िनपटान और ᮧबंधन समय-समय पर संशोिधत ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं.

का.आ. 1357(अ) तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ᳰकए गए थ,े के उपबंधᲂ के अनुसार ᳰकया जाएगा ;

अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा;

(ख) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण और भूिम भराव के ᭭थापनᲂ को अनु᭄ात नहᱭ ᳰकया जाएगा ।

(10) जैव िचᳰक᭜ सीजैव िचᳰक᭜ सीजैव िचᳰक᭜ सीजैव िचᳰक᭜ सीय अपिश᭬ टय अपिश᭬ टय अपिश᭬ टय अपिश᭬ ट.—जैव िचᳰक᭜ सीय अपिश᭬ ट ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा— (क) पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं.का.िन 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा । (ख) पाᳯरि᭭थितक संवेदी जोन मᱶ कोई सामा᭠य उपचार सुिवधा या भ᭬मीकरण अनु᭄ात नहᱭ ᳰकया जाएगा ।

(11) ᭡लाि᭭ट᭡लाि᭭ट᭡लाि᭭ट᭡लाि᭭टक अपिश᳥ ᮧबधंनक अपिश᳥ ᮧबधंनक अपिश᳥ ᮧबधंनक अपिश᳥ ᮧबधंन....————पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।

(13) ईईईई––––अपिश᳥अपिश᳥अपिश᳥अपिश᳥....————पाᳯरि᭭थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा समय-समय पर यथासंशोिधत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।

(14) यानीय पᳯरवहनयानीय पᳯरवहनयानीय पᳯरवहनयानीय पᳯरवहन....————पᳯरवहन कᳱ यानीय संचालन आवास के अनुकूल रीित मᱶ िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िविन᳸द᳥ उपबंध समािव᳥ ᳰकए जाएंग ेऔर आंचिलक महायोजना के तैयार होने और रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा के अनुमोᳰदत होने तक, मानीटरी सिमित सुसंगत अिधिनयमᲂ तथा तदधीन बनाए गए िनयमᲂ और िविनयमᲂ के अधीन यानीय संचलन के अनुपालन को मानीटर करेगी ।

(15) यानीय ᮧदषूणयानीय ᮧदषूणयानीय ᮧदषूणयानीय ᮧदषूण....————लागू िविधयᲂ के अनुसार वाहन ᮧदषूण कᳱ रोकथाम और िनयंᮢण का अनुपालन ᳰकया जाएगा। ᭭व᭒छक ᲊधन उदाहरण के िलए सीएनजी, एलपीजी, आᳰद के उपयोग के िलए ᮧयास ᳰकए जाएगे ।

(16) औ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयांऔ᳒ोिगक ईकाइयां....————(i) सरकारी राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन पर या उसके बाद पाᳯरि᭭थितक संवेदी जोन के भीतर ᳰक᭠ही नए ᮧदषूणकारी उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनुमित नहᱭ दी जाएगी।

(ii) पाᳯरि᭭थितक संवेदी जोन मᱶ कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा फरवरी, 2016 मᱶ जारी ᳰदशािनदᱷशᲂ मᱶ िसफᭅ गरै- केवल अᮧदषूणकारी उ᳒ोगᲂ कᳱ ᭭थापना को वगᱮकरण के अनुसार अनुमित दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᳥ न हो। इसके अलावा, गैर-ᮧदषूणकारी कुटीर उ᳒ोगᲂ को ᮧितिष᳍ ᳰकया जाएगा।

1. वािणि᭔यक खनन । (क) सभी ᮧकार के नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िसवाय नहᱭ हᲂगी िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संि᳖माᭅण या मर᭥मत के िलए भूिम को खोदना और मकान बनाने के िलए दशेी टाइलᲂ का िनमाᭅण भी सि᭥मिलत ह;ै (ख) माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं.

1995 का 202 टी.एन. गोᳲवदरामन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के कठोर अनुसरण का ᮧचालन होगा ।

2. ᮧदषूण (जल या वायु या मृदा या ᭟ विन, आᳰद) काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । कोई नया उ᳒ोग या पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧदषूण फैलाने वाले उ᳒ोगᲂ के िव᭭तार कᳱ अनुमित नहᱭ दी जाएगी। पाᳯरि᭭थितक संवेदी जोन के भीतर कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा फरवरी, 2016 मᱶ जारी ᳰदशािनदᱷशᲂ मᱶ िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ को ᭭थापना के अनुसार अनु᭄ात ᳰकया जाएगा, जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᳥ न हो।

3. बृहत जल िव᳒ुत पᳯरयोजना कᳱ ᭭ थापना । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

4. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन या ᮧ᭭संकरण । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

5. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

6. ठोस अपिश᳥ िनपटान ᭭थल और ठोस और जैव िचᳰक᭜सा अपिश᳥ के िलए सामा᭠य भ᭬मीकरण कᳱ सुिवधा कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नई ठोस अपिश᳥ िनपटान ᭭थल तथा ठोस अपिश᳥ और अपिश᳥ उपचार/ᮧसं᭭करण सुिवधा कᳱ अनुमित नहᱭ ह।ै इसके अितᳯरᲦ औ᳒ोिगक ᮧᳰᮓया और ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 ᭭वा᭭᭝य ᮧित᳧ान / अ᭭पतालᲂ आᳰद से उ᭜प᳖ ᳰकसी भी ठोस अपिश᳥ के उपचार के िलए सामा᭠य या ᳞िᲦगत भ᭬मीकरण कᳱ सुिवधा का सं᭭थापन ᮧितिष᳍ ह।ै

7. फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणि᭔यक पशुधन संपदा और कु᭍कुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को पूरा करने के िसवाय लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।

8. नई आरा िमलᲂ कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर नई या िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।

9. ᲊट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

10. ᭡लाि᭭टक बैग का उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

11. जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

12. का᳧ आधाᳯरत नए उ᳒ोग। लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । ख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलापख. िविनयिमत ᳰᮓयाकलाप

13. होटलᲂ और ᳯरसोटᲄ का वािणि᭔यक ᭭थापन । पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए लघु अ᭭थायी संरचनाᲐ के िलए संरिᭃत ᭃेᮢ सीमा के एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक ही जो भी िनकट हो कोई नया वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात हᲂगे अ᭠यथा नहᱭ। पर᭠तु संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर परे या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, जो भी िनकट हो सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार यथालागू पयᭅटन महायोजना के अनुᱧप होगा ।

14. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ कᳱ सीमा स े एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक जो भी िनकट हो, ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:

परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलापᲂ सिहत उनके उपयोग के िलए उनकᳱ भूिम मᱶ ᭭थानीय िनवा᭭यᲂ कᳱ आवासीय आव᭫यकताᲐ को पूरा करने िलए संिनमाᭅण करने कᳱ अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी ।

(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;

(ii) बुिनयादी ढांचᲂ और नागᳯरक सुख-सुिवधाᲐ का सिंनमाᭅण और नवीकरण;

(iii) फरवरी, 2016 मᱶ कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा ᳰकए गए वगᱮकरण के अनुसार पᳯरभािषत गैर- ᮧदषूणकारी लघु उ᳒ोग;

(iv) कुटीर उ᳒ोगᲂ िजनके अंतगᭅत ᮕामीण उ᳒ोग ह;ᱹ सुिवधा भ᭛डार और ᭭थानीय सुख सुिवधाᲐ जो पाᳯरि᭭थितक पयᭅटन मᱶ िजस मᱶ ᮕह वास भी ह ैसहायक हो; और 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(v) इस अिधसूचना मᱶ सूचीब᳍ संवᳶधत ᳰᮓयाकलापᲂ कᳱ सूची :

(ख) पर᭠तु ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते हᱹ, से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंगे । (ग) एक ᳰकलोमीटर से परे यह आंचिलक महायोजना के अनुसार िविनयिमत हᲂगे ।

15. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । फरवरी, 2016 मᱶ के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी उ᳒ोगᲂ मᱶ वगᱮकरण के अनुसार गैर-ᮧदषूणकारी उ᳒ोग और अपᳯरसंकट मᱶ, लघु और सेवा उ᳒ोग, कृिष, पु᭬प कृिष, उ᳒ान कृिष या पाᳯरि᭭थितक संवेदी जोन से दशेी सामᮕी से उ᭜पादᲂ को उ᭜प᳖ करने वाले कृिष आधाᳯरत उ᳒ोग सᭃम ᮧािधकारी ᳇ारा अनु᭄ात हᲂगे।

16. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर वृᭃᲂ कᳱ कोई कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।

17. वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण (एनटीएफपी) । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

18. िव᳒ुत और दरूसंचार टावरᲂ का पᳯरिनमाᭅण और केबल िबछाना और अ᭠य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । भूिमगत केबल िबछाए जाने को बढ़ावा ᳰदया जाएगा।

19. नागᳯरक सुख सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ िनयमᲂ और िविनयमᲂ मागᱮ िस᳍ांतᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, और उपल᭣ध ᳰकए जाएंगे ।

20. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संि᳖माᭅण। लागू िविधयᲂ िनयमᲂ और िविनयमᲂ मागᱮ िस᳍ांतᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, और उपल᭣ध ᳰकए जाएंगे ।

21. पयᭅटन से संबंिधत ᳰᮓयाकलाप करना जैसे गमᭅ वायु गु᭣बारᱶ, हेलीका᭡टर, ᮟोन, माइᮓोलाइटस आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

22. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

23. रािᮢ मᱶ यानीय यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।

24. ᭭थानीय समुदायᲂ ᳇ारा चलाई जा रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जलकृिष और मछली पालन । ᭭थानीय लोगᲂ के उपयोग के िलए लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

25. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत अपिश᳥ जल/बिह᮲ाᭅव का िन᭭सारण।।।। उपचाᳯरत अपिश᳥ जल/बिह᮲ाᭅव का िन᭭सारण को जल िनकायᲂ मᱶ ᮧवेश नहᱭ करने ᳰदया जाएगा। अ᭠यथा लागू िविधयᲂ के अनुसार उपचाᳯरत जल बिह᮲ाᭅव का िन᭭सारण िविनयिमत ᳰकया जाएगा।

(ग) तेलगंाना सरकार ᳇ारा नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ ᮧ᭜येक मामल ेमᱶ तीन वषᭅ कᳱ अविध के िलए एक िवशेष᭄ -सद᭭य;

(घ) ᮧादेिशक अिधकारी, रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ -सद᭭य;

(ङ) ᭃेᮢ का ᭔ये᳧ नगर योजनाकार/मु᭎य शहरी योजनाकार/नगर योजनाकार -सद᭭य;

(च) रा᭔य जैव िविवधता बोडᭅ का सद᭭य -सद᭭य;

(2) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी।

(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष᳍ गितिविधयᲂ के िसवाय आन ेवाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संिवᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को उᲦ अिधसूचना के उपबंधो के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए िन᳸द᳥ कᳱ जाएगी।

1533(अ), तारीख 14 िसतंबर, 2006 के अधीन नहᱭ आतᱶ ह।ै और पाᳯरि᭭थितक संवेदी जोन मᱶ आते ह,ै सारणी के पैरा 4 के अधीन िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय उनकᳱ संवीᭃा वा᭭तिवक ᭭थल िविन᳸द᳥ ि᭭थितयᲂ के आधार पर मानीटरी सिमित ᳇ारा कᳱ जाएगी और संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा।

(5) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ कल᭍टर या संबंिधत उ᳒ान का उप वन संरᭃक ऐसे ᳞िᲦ के िवᱨ᳍, जो इस अिधसूचना के कᳱसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा ।

(6) मानीटरी सिमित मु᳎ा दर मु᳎ा के आधार पर अपेᭃाᲐ पर िनभᭅर करते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपन ेिवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 30th August, 2017 S.O. 2859(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 2629(E), dated 5th August, 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS , no objections and suggestions received from persons and stakeholders in response to the draft notification;

AND WHEREAS , the Kinnerasani Wildlife Sanctuary with an area of 640.33 sq kms is located at a distance of 12 kilometres North from Paloncha town of Khammam District, Telangana State and falls in Deccan peninsular bio-geographic zone;

AND WHEREAS , the Kinnerasani Wildlife Sanctuary has a hilly terrain with luxuriant forests harbouring rich biodiversity consisting of varied flora and fauna and the major forest type in the Sanctuary is mostly Southern Dry Mixed Deciduous forests;

AND WHEREAS , the plant species commonly found in the Sanctuary are: Hardwickia binata, Pterocarpus marsupium, Adina cordifolia, Anogeissus latifolia, Terminalia tomentosa, Terminalia bellerica, Bauhinia racemosa, Acacia species, Diospyros melanoxylon, Aegle marmelos, Feronia elephantum, Azadirachta indica, Dendrocalamus strictus, Zizyphus species and Ficus Species;

AND WHEREAS , Kinnersani Wildlife Sanctuary harbours many animal species like Bison, Tiger, Panther, Jungle Cat, Small Indian Civet, Palm Civet, Wild Dog, Sloth Bear, Wild Boar, Jackal, Hyena, Indian Gaint Squirrel, Sambar, Spotted Deer along with bird species ;

AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the boundary of the Kinnersani Wildlife Sanctuary as Ecosensitive Zone from ecological and environmental point of view and to prohibit industries or and their operations and processes in the said Eco-sensitive Zone;

¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) and clause (xiv) of sub–section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from 1 kilometer to 21 kilometer from the boundary of the Kinnersani Wildlife Sanctuary in the State of Telangana as the Kinnersani Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundary of Eco-sensitive Zone.-(1) The Eco-sensitive Zone is spread over an area of

1449.44 square kilometers with an extent varying from 1 kilometer to 21 kilometers from the boundary of the Kinnersani Wildlife Sanctuary in the State of Telangana and there are 70 villages situated in the proposed Ecosensitive Zone area.

(2) The boundary description of the Eco-sensitive Zone is appended as Annexure I and the list of villages are given in Annexure-II.

(3) The map of Eco-sensitive Zone boundary together with latitudes –longitudes is appended with this notification as Annexure III.

2. Zonal Master Plan for the Eco-sensitive Zone.-

(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent Authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture and Horticulture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism including eco-tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Municipal & urban development;

(x) Panchayati Raj;

(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

1. Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:

Provided that the conversion of agricultural and other lands, for the purpose other within the Ecosensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant State laws and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as.-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and

(v) promoted activities and given under para 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant State laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities.

(2) Natural water bodies.- The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.

(3) Tourism/ Eco-tourism.-

(a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b)The Eco-tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The activities of Eco-tourism shall be regulated as under, namely:-

(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km.

¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23 from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.

(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism.

(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel or resort or commercial establishment construction is permitted within Eco-sensitive Zone area.

(4) Natural Heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs and the like shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution.—Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.

(7) Air pollution.— Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.

(8) Discharge of effluents.—Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government.

(9) Solid wastes.—Disposal and Management of solid wastes shall be as under:-

(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016;

the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone.

(b)No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.

(10) Bio-medical waste.—Bio medical waste management shall be as under:

(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016.

(b) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.

(11) Plastic Waste Management.—The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016,.

(12) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016,.

(13) E-waste.—The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.

(14) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular Pollution.—Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and the efforts to be made for use of cleaner fuel. For example CNG, LPG, etc.

(16) Industrial Units.—(i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.

(17) Protection of Hill Slopes.—The protection of hill slopes shall be as under:—

(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.

(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.— All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:— TABLE Sl. 1. Commercial Mining

(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).

No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.

Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification.

In addition, non-polluting cottage industries shall be promoted.

3. Establishment of major hydroelectric project.

Prohibited (except as otherwise provided) as per applicable laws.

4. Use or production or processing of any hazardous substances.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited (except as otherwise provided) as per applicable laws.

6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within Eco sensitive zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is Prohibited.

7. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.

Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.

8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws

10. Use of polythene bags. Prohibited (except as otherwise provided) as per applicable laws

11. Commercial use of firewood Prohibited (except as otherwise provided) as per applicable laws

12. New wood based industry Prohibited (except as otherwise provided) as per applicable laws B. Regulated Activities

13. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.

Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

14. Construction activities (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:

(i) Widening and strengthening of existing roads and construction of new roads;

(ii) Construction and renovation of infrastructure and civic amenities;

(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;

(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and

(v) Promoted activities listed in this Notification.

(b) Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.

15. Small scale non polluting industries.

Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.

16. Felling of Trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

17. Collection of Forest produce or Non-Timber Forest Produce (NTFP).

Regulated under applicable laws.

18. Erection of electrical and communication towers and laying of cables and other infrastructures Regulated under applicable law. Underground cabling may be promoted.

19. Infrastructure including civic amenities Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

20. Widening and strengthening of existing roads and construction of new roads.

Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

21. Undertaking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

26. Commercial extraction of surface and ground water Regulated under applicable law.

27. Open Well, Bore Well etc. for agriculture or other usage Regulated and the activity should be strictly monitored by the appropriate authority.

28. Solid Waste Management. Regulated under applicable laws

29. Introduction of Exotic species. Regulated under applicable laws.

30. Eco-tourism Regulated under applicable laws

31. Commercial Sign boards and hoardings.

C. Promoted Activities

5. Monitoring Committee:- (1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:-

(a) District Collector, Khammam - Chairman

(b) One representative of Non-Governmental Organisation working in the field of environment to be nominated by the Government of Telangana for a term of three years in each case - Member

(c) One expert in the area of ecology and environment to be nominated by the Government of Telangana for a term of three years in each case – Member

(d) Regional Officer, State Pollution Control Board – Member

(e) Senior Town Planner of the area/Chief Urban Planner/City Planner – Member

(f) Member, State Biodiversity Board, - Member

(g) Wildlife Warden, Paloncha, Khammam District – Member-Secretary Terms of Reference:

(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the concerned Regulatory Authorities.

(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

34. Adoption of green technology for all activities Shall be actively promoted.

35. Cottage industries including village artisans, etc.

Shall be actively promoted.

36. Use of renewable energy and fuels Bio gas, solar light etc. to be actively promoted

38. Use of eco-friendly transport Shall be actively promoted.

39. Skill Development Shall be actively promoted.

40. Restoration of Degraded Land/ Forests/ Habitat Shall be actively promoted.

41. Environmental Awareness Shall be actively promoted.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV.

(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.

No. 25/16/2014-ESZ] LALIT KAPUR, Scientist ‘G’ Annexure I Boundary Description of the Eco-Sensitive Zone of Kinnerasani Wildlife Sanctuary, Western side A to B (Station No.1 to 30): The boundary of the proposed Eco-Sensitive Zone starts at ‘A’ as shown in the map i.e., coordinate 17.94742 Lat- 80.34579 Long (station No. 1) at enclosure of Sayanapalli Village boundary of Damartogu R.F. of Kothagudem Forest Division. The station No. 1 is located at a distance of 1.00 KMs from south-western corner of Sayanapalli enclosure on road point, which connects Gundala and Sayanapalli Villages. The line starts from station No. 1 runs towards eastern, north-easternly, northerly up to station No.7 and then runs westernly, northenly, north-westernly to station No. 12, reaches Venkatapuram enclosure of Damertogu R.F and then runs easternly, northenly up to station No. 21 and runs north eastern direction through Demaratogu R.F. and reaches ‘B’ (station No. 30).

Northern side B to C (Station No. 30 to 59): From station No. B the boundary line runs south easterly up to station No. 34 through Damartogu R.F. of Kothagudem Forest Division. From station No. 34 the boundary line runs along the Khamman District boundary Kothagudem village enclosure of Janampeta R.F. Paloncha Division in zig zag manner towards northern direction and reaches ‘C’ (station No. 59).

North side/Eastern side C to D (Station No. 59 to 124): From station No. ‘C’, the boundary line runs towards south-easternly, easternly, northenly, easternly northenly, southernly through Janampeta R.F. of Paloncha Division over a length of 2.93 Kms and reaches station No. 102 and then runs in zig zag manner towards southern directions and reaches ‘D’ (station no. 124)near Rallavagu.

Eastern side D to E (Station No. 124 to 171): The boundary line runs from station No. 124 (D) towards southern direction, easternly upto 145 and then the boundary line passes through Kondapur Forest Block and towards Southern direction upto 160 and then the line runs South Eastern Direction and Eastern Direction through Kondaigudem and Kondapur Forest Block and reaches ‘E’ (station No. 171).

Eastern side E to F (Station No. 171 to 214): The boundary line passes from ‘E’ (station No. 171) runs towards southern direction up to station No. 173 through Kondapur Block and then the line runs along Aswapuram Block towards southern direction up to station No. 181 and the line runs Western direction to station No. 183 and then the line runs through Aswapuram Extension-I Block up to station No. 185 and then the boundary line runs towards southern direction along Aswapuram Forest Block and south eastern direction and western direction through Nellipaka A & B Forest Blocks up to station No. 205 and then the line runs middle of the Kistasagar Forest Block towards southern direction up to station No. 210 and then the line runs up to ‘F’ (station No. 214) through nonforest area over a length of 5.7 KMs. ‘F’ is located at Morampalli Banzar village near ‘X’ road.

Southern side F to G (Station No. 214 to 284): From ‘F’ point the boundary line runs through non-forest area towards western direction to a length of 3.62 KMs up to station No. 217, which is located on Kinnerasani River.

Then the boundary line runs along Kinnersani River up to station No. 229 towards Western, North-Western direction and then runs along Suraram R.F. upto Station.232 and then the line runs towards southern direction upto station No. 237 excluding Punukula Village and Revenue lands and existing KTPS complex with ash ponds and joins to station no. 253 of Chathakonda RF of Kothagudem Division. From station No. 253 the boundary line runs ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 29 through Chathakonda Forest Block of Kothagudem Division towards slight eastern, southern up to station No.

259, and again western direction up to station No. 271. Then boundary line towards north direction up to station No. 278 and runs along Chatakonda RF towards western and southern direction along the Chatakonda R.F.

From Station No. 337 the boundary line passes through Gundala Forest Block upto Station No. 342 towards Northern direction and then reaches Station No. 345 towards Eastern and Northern direction.
