क! िवशेषता है, जो िनरंतर नह< ह ैऔर कम ऊंचाई वाले छोटे वृ?5 क! छत के नीचे पूरा �कया जाता है, बांस आमतौर पर नम ?े ो से आती ह ै; इपीफाइटस् �चुर मा ा म- पाए जाते है कुछ पव�तारोिहय5 और िडdटरोकारोeस के साथ पाए जाते ह ैकेवल Hथानीय पैच म- ही दलुभ� होते ह ैऔर वृ? �कार के होते ह ैजैसे मेसुअ फेरा , माकरानगा �पा, दअुबांगा �पा, इयुगेना जुमबोलीना, ट�मनािलया मयरोकारपा, ट�मनािलया चेबुला, वीट�स प�दुकुंलारीस, वीट�स नेगंुदो, मेचेिल चामपाका, गमेिलना अरबोरेअ, डायसो�यलुम बेनेकटीफे�म और अमौरा वाि"लची ह;ै और, नरपुह वDयजीव अभयराEय के चार5 ओर के ?े को, िजसका िवHतार और सीमाएं इस अिधसूचना के पैरा 1 म- िविनgद9 ह\, पया�वरण और पा�रिHथितक क! दिृ9 से पा�रिHथितक संवेदी जोन के �प म- सुरि?त और संरि?त करना तथा उ4 पा�रिHथितक संवेदी जोन म- उLोग5 और उLोग5 के वगh और उनके �चालन तथा �संHकरण करने को �ितिषi करना आवXयक ह ै; अतः, अब, केD^ीय सरकार, पया�वरण (संर?ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प�ठत पया�वरण (संर?ण) अिधिनयम, 1986 (1986 का 29) क! धारा 3 क! उपधारा (1) उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ,ारा �दB शि4य5 का �योग करते Mए, मेघालय राj य म- नरपुह वD यजीव अभयारEय क! सीमा से 1.20 �कलोमीटर से 7.70 �कलोमीटर तक के िवH ता�रत ?े को नरपुह अभयारEय पा�रिH थितक! संवेदी जोन (िजसे इसम- इसके पX चात् पा�रिH थितक संवेदी जोन कहा गया ह)ै के �प म- अिधसूिचत करती ह,ै िजसका िववरण िनmानुसार ह,ै अथा�त् :-- 1. पा�रि�थितकपा�रि�थितकपा�रि�थितकपा�रि�थितक संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर उसक�उसक�उसक�उसक� सीमाएंसीमाएंसीमाएंसीमाएं–(1) पा�रिH थितक संवेदी जोन का िवH तार, नरपुह वD यजीव अभयारEय क! सीमा से 1.20 �कलोमीटर5 से 7.70 �कलोमीटर म- 194.23 वग� �कलोमीटर फैला Mआ ह ैसीमाq का वण�न उपाबंधउपाबंधउपाबंधउपाबंध I म- �दया गया ह।ै (2) पा�रिHथितक संवेदी जोन के अंतग�त आने वाले Pाम5 क! सूची उपाबंधउपाबंधउपाबंधउपाबंध IIIII म- दी गई ह ै। (3) नरपुह वD यजीव अभयारEय क! सीमा के साथ भू-मंडलीय िHथत �णाली के िनदrशांको के sबद ुउपाबंधउपाबंधउपाबंधउपाबंध IIIIIIII(क)(क)(क)(क) के �प म- उपाबi ह ै। (4) पा�रिHथितक संवेदी जोन का मानिच उपाबंधउपाबंधउपाबंधउपाबंध IIIIIIIII I I I के �प म- उपाबi ह\ । 2222.... पा�रि�थितकपा�रि�थितकपा�रि�थितकपा�रि�थितक संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महायोजनामहायोजनामहायोजनामहायोजना –––– (1) राjय सरकार, पा�रिHथितक संवेदी जोन के �योजन के िलए राजप म- अंितम अिधसूचना के �काशन क! तारीख से दो वष� क! अविध के भीतर, Hथानीय 3ि4य5 के परामश� से और इस अिधसूचना म- �दए गए अनुबंध5 का पालन करते Mए आंचिलक महायोजना तैयार करेगी। (2) राjय सरकार ,ारा पा�रिH थितक संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित जो इस अिधसूचना म- िविनgदI ट ह ैतथा सुसंगत क- ^ीय और राj य िविधय5 के अनुtप और क- ^ीय सरकार ,ारा जारी माग�िनदrश5, य�द कोई ह5, ,ारा तैयार होगी । (3) आंचिलक महायोजना, पया�वरणीय और पा�रिHथितक संबंधी बात5 को समाकिलत करने के िलए राj य सरकार के सभी संबi िवभाग5 के परामश� से तैयार होगी --
(i) पया�वरण;
(ii) वन और वDयजीव;
(iii) कृिष और बागवानी ;
(iv) राजH व;
(v) शहरी िवकास;
(vi) पय�टन सिहत पा�रिHथितक पय�टन ; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(vii) Pामीण िवकास;
(viii) sसचाई और बाढ़ िनयं ण;
(ix) नगरपािलक और शहरी िवकास;
(x) पंचायती राज;
(xi) लोक िन मा�ण िव भाग। (4) आंचिलक महायोजना अनुमो�दत िवLमान भू-उपयोग, अवसंरचना और �uयाकलाप5 पर कोई िनबvधन अिधरोिपत नह< करेगी जब तक �क इस अिधसूचना म- िविनgदI ट न हो और आचंिलक महायोजना सभी अवसंरचना और �uयाकलाप5 म- और अिधक द?ता और पा�रिHथितक अनुकूलता का संवध�न करेगी । (5) आंचिलक महायोजना म- अनाwछा�दत ?े 5 के जीणhiार, िवLमान जल िनकाय5 के संर?ण, आवाह ?े 5 के �बंधन, जल-संभर5 ?े ो के �बंधन, भूतल जल के �बंधन, मृदा और नमी संर?ण, Hथानीय समुदाय5 क! आवXयकताq तथा पा�रिHथितक और पया�वरण से संबंिधत ऐसे अDय पहलूq, िजन पर xयान दनेा आवXयक ह,ै के िलए उपबंध ह5गे । (6) आंचिलक महायोजना सभी िवLमान पूजा H थल5, Pाम5 और नगरीय बंदोबHत5, वन5 के �कार और �कH म5, कृिष ?े 5, ऊपजाऊ भूिम, ह�रत ?े जैसे उLान और उसी �कार के H थान, उLान कृिष ?े , फलोउLान, झील5 और अDय जल िनकाय5 का अyयकंन करेगी और इस योजना के मानिच के साथ िवLमान और �Hतािवत भूिम उपयोग िवशेषताq का िववरण संलz होगा । (7) आंचिलक महायोजना पा�रिHथितक संवेदी जोन म- िवकास को िविनयिमत करेगी और पैरा 4 के सारणी म- सूचीबi �ितिषi, िविनयिमत �uयाकलाप5 का पालन करेगी तथा H थानीय समुदाय5 क! आजीिवका सुर?ा के िलए, पा�रिHथितक अनुकूल िवकास सुिनिX चत करेगी तथा संव8धत करेगी। (8) आंचिलक महायोजना इस अिधसूचना म- �दए गए उपबंध5 के संबंध म- अपने काय{ के बाहर ले जाने के िलए िनगरानी सिमित के िलए एक संदभ� दHतावेज तैयार करेगी । 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय––––राjय सरकार इस अिधसूचना के उपबंध5 को �भावी करने के िलए िनmिलिखत उपाय करेगी, अथा�त्:-- (1) भूभूभूभू----उपयोग उपयोग उपयोग उपयोग ––––पा�रिH थितक संवेदी जोन म- वन5, उLान-कृिष ?े 5, कृिष ?े 5, आमोद-�मोद के �योजन के िलए िचिDहत �कए गए पाक{ और खुले Hथान5 का वािणिjयक और औLोिगक संबi िवकास �uयाकलाप5 के िलए उपयोग या संप�रवत�न नह< होगा: परंतु पा�रिHथितक संवेदी जोन के भीतर कृिष भूिम और अDय भूिमय5 का संप�रवत�न िनगरानी सिमित क! िसफा�रश पर और राjय सरकार के पूव� अनुमोदन से, जो Hथानीय िनवािसय5 क! आवासीय ज�रत5 को पूरा करने के िलए ह ैतथा �uयाकलाप5 के िलए जैसे:- (i) िवLमान सड़के और नई सड़क5 संिनमा�ण को चौड़ा और सुदढृ करना; (ii) बुिनयादी ढांच5 और नाग�रक सुिवधाq का संिनमा�ण और नवीकरण; (iii) �दषूण उKपR न करने वाले लघु उLोग; (iv) कुटीर उLोग5 िजसके अंतग�त Pामीण कारीगर ह\; सुिवधाजनक भEडार और Hथानीय सुिवधाq सहायक पा�रिHथितक पय�टन म- सि मिलत Pह वास; और (v) संव8धत �uयाकलाप और अनुwछेद 4 के अंतग�त �दया गया ह:ै 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु यह और भी संिवधान के अनुwछेद 244 और तKसमय �वृB िविध के उपबंध5 के अनुपालन के िबना, िजसके अंतग�त अनुसूिचत जनजाित और अDय परंपरागत वन िनवासी (वन अिधकार5 क! माDयता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिjयक या उLोग िवकास �uयाकलाप5 के िलए जनजातीय भूिम का उपयोग अनु~ात नह< होगा: परंतु यह और भी �क पा�रिH थितक संवेदी जोन के भीतर भू-अिभलेख5 म- उपसंजात कोई ु�ट, िनगरानी सिमित के िवचार �ाC करने के पNात ्राjय सरकार ,ारा �Kयेक मामले म- एक बार संशोिधत होगी और उ4 ु�ट के संशोधन क! सूचना क- ^ीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं ालय को दी जाएगी: परंतु यह और भी �क उपयु�4 ु�ट का संशोधन म- इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म- भू-उपयोग का प�रवत�न सि मिलत नह< होगा; परंतु यह और भी �क िजससे ह�रत ?े म- जैसे वन ?े , कृिष ?े आ�द म- कोई पा�रणािमक कटौती नह< होगी और अन�यु� त या अनुK पादक कृिष ?े 5 म- पुन: वनीकरण करने के �यास �कए जाएंगे । (2) �ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत-आचंिलक महायोजना म- सभी �ाकृितक जल �ोत5/न�दय5/जलसरणी क! पहचान क! जाएगी और उसम- उनके संर?ण और पुनt�भूतकरण के िलए योजना सि मिलत होगी । (3) पय�टनपय�टनपय�टनपय�टन–––– (क) पा�रिHथितक संवेदी जोन के भीतर सभी नए पा�रिHथितक पय�टन �uयाकलाप या िवLमान पय�टन संबंधी �uयाकलाप पा�रिHथितक संवेदी जोन के िलए पय�टन महायोजना के अनुसार ह5गे । (ख) पा�रिHथितक पय�टन महायोजना पय�टन िवभाग, ,ारा राjय सरकार के पया�वरण और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के �प म- होगी । (घ) पा�रिHथितक पय�टन संबंधी �uयाकलाप िन निलिखत के अधीन िविनयिमत ह5गे, अथा�त् :- (i) नरपुह वD यजीव अभयारEय क! सीमा से एक �कलोमीटर के भीतर या पा�रिHथितक संवेदी जोन के िवHतार तक, जो भी िनकट हो, �कसी होटल या �रसोट� का नया संिRमा�ण अनु~ात नह< �कया जाएगा परंत,ु वDयजीव अभयारEय क! सीमा से एक �कलोमीटर क! दरूी से परे पा�रिHथितक संवेदी जोन के िवHतार तक नए होटल5 और �रसोट{ क! Hथापना पय�टन महायोजना के अनुसार पा�रिHथितक पय�टन सुिवधाq के िलए पूव� सीमां�कत और पदािभिहत ?े 5 म- ही अनु~ात क! जाएगी। (ii) पा�रिHथितक संवेदी जोन के अDदर सभी नए पय�टन �uया-कलाप- या िवLमान पय�टन �uयाकलाप5 के िवHतार केD^ीय सरकार, पया�वरण, वन और जलवायु प�रवत�न मं ालय ,ारा जारी माग�दशO िसiांत5 तथा पा�रिHथितक पय�टन पर बल दतेे Mए रा�ीय बाघ संर?ण �ािधकरण ,ारा जारी पा�रिHथितक पय�टन माग�दशO िसiांत5 (समय-समय पर यथा संशोिधत) के अनुसार होगा । (iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक, पय�टन के िलए िवकास और िवLमान पय�टन �uयाकलाप5 के िवHतार को वाHतिवक Hथल िविनgद9 संवी?ा तथा िनगरानी सिमित क! िसफा�रश पर आधा�रत संबंिधत िविनयामक �ािधकरण5 ,ारा अनु~ात �कया होगा । (4) नैस"गकनैस"गकनैस"गकनैस"गक िवरासतिवरासतिवरासतिवरासत –––– पा�रिHथितक संवेदी जोन म- महKवपूण� नैस8गक िवरासत के सभी Hथल5 जैसे सभी जीन कोश आरि?त ?े , शैल िवरचनाएं, जल �पात5, झरन5, घाटी माग{, उपवन5, गुफाएं, Hथल5, �मण, अ�रोहण, �पात5 आ�द क! पहचान क! जाएगी और िवरासत संर?ण योजना उनक! सुर?ा और संर?ा के िलए तैयार क! जाएगी जो ऐसी आंचिलक महायोजना का भाग होगी । (5) मानव िनमानव िनमानव िनमानव िन"मत िवरासत � थ"मत िवरासत � थ"मत िवरासत � थ"मत िवरासत � थल ल ल ल –––– पा�रिH थितक संवेदी जोन म- भवन5, संरचनाq, िश�प-त�य, ऐितहािसक, कलाKमक, स�दय�परक और सांHकृितक महKव के ?े 5 और प�रवेश क! पहचान क! जाएगी और उनके संर?ण के िलए िवरासत संर?ण योजना आंचिलक महायोजना के �प म- तैयार क! जाएगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5

Hथापना । Hथानीय ज�रत5 को पूरा करने के िसवाय लागू िविधय5 के अनुसार �ितिषi (अD यथा उपबंिधत के िसवाय) ह5गे। 13. �दषूण उKपR न करने वाले लघु उLोग । फरवरी, 2016 म- केD^ीय �दषूण िनयं ण बोड� ,ारा जारी उLोग5 म- वगOकरण के अनुसार गैर-�दषूणकारी उLोग और अप�रसंकट म-, लघु और सेवा उLोग, कृिष, पुIप कृिष, उLान कृिष या पा�रिHथितक! संवेदी जोन से दशेी सामPी से उKपाद5 को उKपR करने वाले कृिष आधा�रत उLोग स?म �ािधकारी ,ारा अनु~ात ह5गे। 14. वृ?5 क! कटाई । (क) राjय सरकार म- स?म �ािधकारी क! पूव� अनु~ा के िबना वन, सरकारी या राजHव या िनजी भूिम पर या वन5 म- �कही वृ?5 क! कटाई नह< होगी । (ख) वृ?5 क! कटाई संबंिधत क- ^ीय या राjय अिधिनयम या उसके अधीन बनाए गए िनयम5 के उपबंध के अनुसार िविनयिमत होगी । 15. वन उKपाद5 और गैर काI ठ वन उKपाद5 का संPहण (एनटीएफपी) । लागू िविधय5 के अधीन िविनयिमत ह5गे । 16. िवLुत केबल5 और दरूसंचार टावर5 का प�रिनमा�ण और केबल5 के िबछाए जाने और अDय बुिनयादी ढांचे । लागू िविधय5 के अधीन िविनयिमत ह5गे । भूिमगत केबल के िबछाए जाने को बढ़ावा �दया जाएगा। 17. नाग�रक सुख-सुिवधाq सिहत बुिनयादी ढांचे। लागू िविधय5 िनयम5 और िविनयम5 और उपल;ध �दशािनदrश5 के अनुसार Dयूनीकरण क! उपाय5 के साथ िविनयिमत �कए जाएंगे। 18. िवLमान सड़क5 को चौड़ा करना और उDह- सुदढृ करना और नई सड़क5 का संिनमा�ण । लागू िविधय5 िनयम5 और िविनयम5 और उपल;ध �दशािनदrश5 के अनुसार Dयूनीकरण क! उपाय5 के साथ िविनयिमत �कए जाएंगे। 19. पय�टन से संबंिधत �uयाकलाप जैसे गम� वायु गु;बार-, हेलीकाeटर, �ोन, माइuोलाइटस और अDय पय�टन �uयाकलाप आ�द ,ारा पा�रिHथितक संवेदी जोन ?े के ऊपर से उड़ना जैसे �uयाकलाप करना। लागू िविधय5 के अधीन िविनयिमत ह5गे ।
20. पहाड़ी ढाल5 और नदी तट5 का संर?ण । लागू िविधय5 के अधीन िविनयिमत ह5गे । 21. राि म- यािनक यातायात का संचलन । लागू िविधय5 के अधीन वािणिjयक �योजन के िलए िविनयिमत ह5गे । 22. धारा 19 के अधीन दज� क! गई िशकायत5 का सारांश । 8. कोई अD य महK वपूण� िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 6th September, 2017 S.O.2942(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O 3124(E), dated 20 th November 2015,inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, the copies of the Gazette containing the draft notification were made available to the public on the 20 th November, 2015; AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the draft notification were duly considered; AND WHEREAS, the Narpuh Wildlife Sanctuary, East Janita Hills Jowai, Meghalaya is lying between 25°05’19” to 25°06’14” North latitudes and 92°21’04” to 92°31’38” East latitudes; AND WHEREAS, the flora and fauna represent rich biological significance of this Sanctuary which is bounded by the Reserved Forests around it, except a part of South West and Eastern part which is bounded by villages, and the state of Assam; the Northern part is bounded by the Lukha River forming a physical barrier; the entire area is very rich in plant and animal species which are of economical and medicinal significance; the Sanctuary is one of the few remaining wildlife habitat and is having diverse species of mammals viz., Hoollock Gibbon, Serow, Slow Loris, Sloth Bear, Large Indian Civet, Leopard Cat, Clouded Leopard, Barking Deer and different varieties of Squirrel viz., the Orange bellied Himalayan Squirrel, Northern Palm Squirrel, Irrawaddy Squirrel, Otter, Mongoose and varieties of fruit Bats viz., the Allied Horse Shoe Bat, great eastern Horse Bat, etc; the Narpuh Reserved Block II is also a habitat for varieties of birds where the India Horn Bill can still be sighted, butterfly and fishes of different varieties, some of which are endangered and endemic to these areas; AND WHEREAS, the area is blessed with high rainfall during summer, high humidity and high temperature for much of the year and all these factors ensure a profuse range of diverse species of plants; the vegetation is mixed forest and no single species dominate the area and the vegetation is fairly undisturbed due to the inaccessibility of the area; this forest type is characterised by tall evergreen trees forming the bulk of the main top canopy, which is not continuous and is completed by a lower canopy of smaller trees of lower height making the canopy uneven at place; bamboos commonly ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17 occurred in badly drain moist areas; epiphytes are found in abundance along with few climbers and Diptherocarpos occurred very rarely in localised patches only and those type constitute trees such as Mesua ferra, macaranga, sp, Duabanga sp, Eugena jumbolina, Terminalia myrocarpa, Terminalia Chebula, Vitex penduncularis, Vitex Negundo, Mechelia champaca, Gmelina arborea, Dysoxylum benectiferum and Amoora wallichi; AND WHEREAS; it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Narpuh Wildlife Sanctuary as Eco-sensitive zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from
1.20 kilo meter to 7.70 kilometer from the boundary of Narpuh Wildlife Sanctuary in the State of Meghalaya as the Narpuh Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone shall be of 194.23 square kilometres with an extent varying from 1.20 kilometers to 7.70 kilometer from the boundary of Narpuh Wildlife Sanctuary and the boundary details are given in Annexure-I.
(2) The list of villages falling in Eco-sensitive Zone are given in Annexure-II.
(3) The Global Position System Co-ordinates of points along the boundary of Narpuh Wildlife Sanctuary are given in Annexure-II A.
(4) The map of the Eco-sensitive Zone is appended as Annexure-III.
2. Zonal Master Plan for the Eco-sensitive Zone.- ( 1)The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture and Horticulture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism including eco-tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal and urban development;
(x) Panchayati Raj;
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in the in paragraph 4 Table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8)The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
1. Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government to meet the residential needs of the local residents and for activate such as:
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in the table in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism .- (a) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within one kilometer from the boundary of the Narpuh Wildlife Sanctuary or upto the extent of the Eco- Sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometer from the boundary of the Wildlife Sanctuary till the extent of the eco-sensitive Zone, the ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural Heritage: All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act,
1986.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder. 8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (prevention and control of pollution) Act, 1974 (6 of 1974) and rules made thereunder.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste.-Bio medical waste management shall be as under.-
(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.
(b) safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11). Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12). Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(13). E-waste.- The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14). Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15). Vehicular Pollution.- Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example CNG, etc.
(16). Industrial Units.- (i) No new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be permitted within the Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification.
(17). Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) New and (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries including new oil and gas exploration causing pollution (water, air, soil, noise, etc.). No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted. Only non-polluting industries shall be permitted within the Eco-sensitive zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless specified in this notification.
3. Establishment of major thermal and major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21
6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
8. Commercial use of fire wood. Prohibited (except as otherwise provided) as per applicable laws.
9. Use of plastic bags. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities
10. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Ecosensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and
(v) Promoted activities listed in this Notification.
(b) Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
12. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc. Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
13. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority.
14. Felling of trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.
15. Collection of Forest Produce or Non-Timber Forest Produce (NTFP). Regulated under applicable laws.
16. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws. underground cabling may be promoted.
17. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines. 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
5. Monitoring Committee and its terms of reference.- (1) The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) Deputy Commissioner, East Jantia Hills Jowai - Chairman;
(ii) An expert in the area of ecology and environment - Member; to be nominated by the Government of Meghalaya
(iii) One representatives of Non-governmental Organization - Member; (working in the field of environment including heritage Conservation) to be nominated by the Government of Meghalaya
18. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
19. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated under applicable laws.
20. Protection of hill slopes and river banks. Regulated under applicable laws.
21. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
22. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals.
23. Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
24. Commercial extraction of surface and ground water. Regulated under applicable laws.
25. Open well, bore well etc. for agriculture or other usage. Regulated (under applicable laws) and the activity shall be monitored by the concerned.
26. Solid waste management or biomedical waste management. Regulated under applicable laws.
27. Introduction of exotic. species. Regulated under applicable laws.
28. Eco-tourism. Regulated under applicable laws.
29. Commercial sign boards and hoardings. Regulated under applicable laws. C. Promoted Activities
30. Rain water harvesting. Shall be actively promoted.
31. Organic farming. Shall be actively promoted.
32. Adoption of green technology for all activities. Shall be actively promoted.
33. Cottage industries including village artisans, etc. Shall be actively promoted.
34. Use of renewable energy and fuels. Bio gas, solar light, etc. to be actively promoted.
35. Agro-forestry Shall be actively promoted.
36. Use of eco-friendly transport. Shall be actively promoted.
37. Skill development. Shall be actively promoted.
38. Restoration of degraded land/ forests/ habitat. Shall be actively promoted.

(iv) Executive Engineer, Meghalaya Pollution Control Board - Member;
(v) Chief Forest Officer, state Govt. - Member;
(vi) Expert in Biodiversity nominated by State Government . - Member;
(vii) Divisional Forest Officer (Wildlife) - Member-Secretary .
6. Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring Committee shall be three years or till it is reconstituted by the State Government, and after the expiry of the tenure of the Monitoring Committee, the subsequent Monitoring Committee shall be reconstituted by the State Government in accordance with the provision of sub-paragraph (1).
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14 th September, 2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector or the concerned park incharge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Central Government in the Ministry of Environment, Forest and Climate Change as per pro forma given in Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Supreme Court, etc, orders.- The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
