PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2244] ubZ fnYyh] c`gLifrokj] flrEcj 15] 2016@Hkkæ 24] 1938 No. 2244] NEW DELHI, THURSDAY, SEPTEMBER 15, 2016/BHADRA 24, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 14 िसत᭥ बर, 2016 का.आ. 2944(अ).— के᭠ ᮤ ीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उप िनयम (4) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1) और उपधारा (2) के खंड (5) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए, लोकिहत मᱶ उ त िनयम के िनयम 5 के उपिनयम (3) के खंड (क) के अधीन सूचना कᳱ अपेᭃा से छूट ᮧदान करन े के प᭫ चात् त᭜ कालीन भारत सरकार, पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं या 1533(अ), तारीख 14 िसतंबर, 2006 मᱶ िन᭥ निलिखत और संशोधन करती ह,ै अथाᭅत्:- उ त अिधसूचना मᱶ, पयाᭅवरणीय अनापि᭜ त(ईसी) कᳱ िविधमा᭠ यता स े सबंंिधत पैरा 9 के ᭭ थान पर िन᭥ निलिखत पैरा रखा जाएगा, अथाᭅत्:- ''9. पयाᭅवरणीय अनापि᭜ त (ईसी) कᳱ िविधमा᭠ यता:
(i) “पयाᭅवरणीय अनापि᭜ त कᳱ िविधमा᭠ यता से वह अविध अिभᮧेत ह ै िजससे िविनयामक ᮧािधकरण ᳇ारा पूवᭅ पयाᭅवरणीय अनापि᭜ त मंजूर कᳱ जाती ह ैया आवेदक ᳇ारा यह समझा जा सकेगा ᳰक यह ऊपर पैरा 8 के उप पैरा
(iii) के अधीन पᳯरयोजना या ᳰᮓयाकलाप ᳇ारा उ᭜ पादन ᮧचालन आरंभ करने या संिनमाᭅण पᳯरयोजना कᳱ दशा मᱶ (अनुसूची कᳱ मद 8) सभी संिनमाᭅण ᮧचालन पूरा करन,े िजसके िलए पूवᭅ पयाᭅवरण अनापि᭜ त के िलए आवेदन का िनदᱷश करता ह,ै मंजूर कᳱ गई ह ै। ᳰकसी पᳯरयोजना या ᳰᮓयाकलाप के िलए नदी घाटी पᳯरयोजनाᲐ (अनूसूची कᳱ मद 1(ग) कᳱ दशा मᱶ, दस वषᭅ कᳱ अविध के िलए, िवशेष᭄ आंकलन सिमित या रा᭔ य ᭭ तरीय िवशेष᭄ आंकलन 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सिमित या िजला ᭭ तरीय िवशेष᭄ आंकलन सिमित ᳇ारा यथा ᮧा किलत पᳯरयोजना कᳱ अविध खनन पᳯरयोजनाᲐ के िलए अिधकतम तीस वषᲄ के िलए और सभी अ᭠ य पᳯरयोजनाᲐ तथा ᳰᮓयाकलापᲂ कᳱ दशा मᱶ सात वषᭅ होगी ।
(ii) ᭃेᮢ िवकास पᳯरयोजनाᲐ और नगरᲂ कᳱ दशा मᱶ (मद 8(ख) सात वषᭅ कᳱ िविधमा᭠ य अविध केवल ऐस े ᳰᮓयाकलापᲂ तक सीिमत होगी जो िवकासकताᭅ के ᱨप मᱶ आवेदक का उ᭜ तरदािय᭜ व हो:
परंतु उपरो त पैरा (i) और पैरा (ii) के सबंंध मᱶ िविधमा᭠ यता कᳱ इस अविध को संबंिधत िविनयामक ᮧािधकरण ᳇ारा तीन वषᭅ कᳱ अिधकतम अविध तक बढ़ाया जा सकेगा, यᳰद कोई आवेदक ᳇ारा िविनयामक ᮧािधकरण को संिनमाᭅण पᳯरयोजनाᲐ या ᳰᮓयाकलापᲂ के िलए (अनुसूची कᳱ मद 8) अ᳒तन ᮧᱨप 1 और अनुपूरक ᮧᱨप 1क सिहत िविधमा᭠ य अविध के भीतर आवेदन ᳰकया जाता ह:ै परंतु यह और ᳰक िविनयामक ᮧािधकरण यथाि᭭ थित, िवशेष᭄ आंकलन सिमित या रा᭔ य ᭭ तरीय िवशेष᭄ आंकलन सिमित या िजला ᭭ तरीय िवशेष᭄ आंकलन सिमित से, ऐसा िव᭭ तार मंजूर करने के िलए परामशᭅ कर सकेगा ।
(iii) जहां उपरो त उप पैरा (i) और उप पैरा (ii) के अधीन िव᭭ तार के िलए आवेदन- (क) पयाᭅवरणीय अनापि᭜ त कᳱ िविधमा᭠ य अविध के प᭫ चात् तीस ᳰदन के भीतर फाइल ᳰकया गया ह ैवहां ऐस े मामले संब िवशेष᭄ आंकलन सिमित या रा᭔ य ᭭ तरीय िवशेष᭄ आंकलन सिमित या िजला ᭭ तरीय िवशेष᭄ आंकलन सिमित के िन᳸द᭬ ट ᳰकए जाएंगे और उनकᳱ िसफाᳯरशᲂ के आधार पर, िवलबं, यथाि᭭ थित, पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय के संयु त सिचव या सद᭭ य सिचव, रा᭔ य ᭭ तरीय िवशेष᭄ आंकलन सिमित या सद᭭ य सिचव, िजला ᭭ तरीय िवशेष᭄ आंकलन सिमित के स् तर पर माफ ᳰकया जा सकेगा ;
(ख) जब पयाᭅवरणीय अनापि᭜ त कᳱ िविधमा᭠ य अविध के प᭫ चात् तीस ᳰदन से अिधक ᳴कत ुऐसी िविधमा᭠ य अविध के प᭫ चात् न᭣ बे ᳰदन स ेकम के भीतर फाइल ᳰकया गया ह ैतब िवशेष᭄ आंकलन सिमित या रा᭔ य ᭭ तरीय िवशेष᭄ आंकलन सिमित या िजला स् तरीय िवशेष᭄ आंकलन सिमित कᳱ िसफाᳯरशᲂ के आधार पर िवलंब, यथाि᭭ थित पयाᭅवरण वन और जलवायु पᳯरवतᭅन मंᮢी या अ᭟ यᭃ के अनुमोदन से माफ ᳰकया जा सकेगा:

1141(अ), तारीख 29 अᮧैल, 2015, का.आ. 1834(अ), तारीख 6 जुलाई, 2015, का.आ. 2571(अ), तारीख 31 अग᭭ त, 2015, का.आ. 2572(अ), तारीख 14 िसतंबर, 2015, का.आ. 141(अ), तारीख 15 जनवरी, 2016 और का.आ. 648(अ), तारीख 3 माचᭅ, 2016 ᳇ारा संशोिधत ᳰकए गए थे। MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 14 th September, 2016 S.O. 2944(E).— In exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment(Protection) Act, 1986 (29 of 1986) read with sub-rule(4) of rule 5 of the Environment(Protection) Rules, 1986, the Central Government, after having dispensed with the requirement of notice under clause(a) of sub-rule(3) of rule 5 of the said rule, in public interest, hereby makes the following further amendments in the notification of the Government of India, in the erstwhile Ministry of Environment and Forests number S.O.1533(E), dated the 14th September, 2006 namely:- In the said notification, for paragraph, 9 relating to Validity to Environment Clearance (EC), the following paragraph shall be substituted, namely:- “9.Validity of Environmental Clearance (EC):
(i) The “Validity of Environmental Clearance” is meant the period from which a prior environmental clearance is granted by the regulatory authority, or may be presumed by the applicant to have been granted under sub-paragraph (iii) of paragraph 8, to the start of production operations by the project or activity, or completion of all construction operations in case of construction projects (item 8 of the Schedule), to which the application for prior environmental clearance refers. The prior environmental clearance granted for a project or activity shall be valid for a period of ten years in the case of River Valley projects [item 1(c) of the Schedule], project life as estimated by the Expert Appraisal Committee or State Level Expert Appraisal Committee or District Level Expert Appraisal Committee subject to a maximum of thirty years for mining projects and seven years in the case of all other projects and activities.
(ii) In the case of Area Development projects and Townships [item 8(b)], the validity period of seven years shall be limited only to such activities as may be the responsibility of the applicant as a developer:
Provided that this period of validity with respect to sub-paragraphs (i) and (ii) above may be extended by the regulatory authority concerned by a maximum period of three years if an application is made to the regulatory authority by the applicant within the validity period, together with an updated Form I, and Supplementary Form IA, for Construction projects or activities (item 8 of the Schedule):
Provided further that the regulatory authority may also consult the Expert Appraisal Committee or State Level Expert Appraisal Committee or District Level Expert Appraisal Committee, as the case may be, for grant of such extension.
(iii) Where the application for extension under sub-paragraphs (i) and (ii) above has been filed-
(a) within thirty days after the validity period of Environmental Clearance, such cases shall be referred to concerned Expert Appraisal Committee or State Level Expert Appraisal Committee or District Level Expert Appraisal Committee and based on their recommendations, the delay shall be condoned at the level of the Joint Secretary in the Ministry of Environment, Forest and Climate Change or Member Secretary, State Level Expert Appraisal Committee or Member Secretary, District Level Expert Appraisal Committee, as the case may be;

(b) more than thirty days after the validity period of Environmental Clearance but less than ninety days after such validity period, then, based on the recommendations of the Expert Appraisal Committee or State Level Expert Appraisal Committee or District Level Expert Appraisal Committee, the delay shall be condoned with the approval of the Minister in charge of Environment, Forest and Climate Change or Chairman, as the case may be :
Provided that no condonation for delay shall be granted for any application for extension filed beyond ninety days after the validity period of Environmental Clearance.”.
