(2) पा�रिEथितक� संवेदी जोन क� सीमा के अभयारAय का मानिच� और भ-ूिनदjशांक उपाबंध उपाबंधउपाबंध उपाबंध I और औरऔर और उपाबंध उपाबंधउपाबंध उपाबंध I क कक क के Uप म< उपाबN ह।ै
(3) मुkय lबंदु̀ के साथ भ-ूिनदjशांक, के साथ पा�रिEथितक� संवेदी जोन के अंतग�त आने वाले 323 nाम, क� सूची उपाबंध उपाबंधउपाबंध उपाबंध II के Uप म< उपाबN ह।ै 2 22
2. .. . पा�रि�थितक� पा�रि�थितक�पा�रि�थितक� पा�रि�थितक� संवेदी संवेदीसंवेदी संवेदी जोन जोनजोन जोन के केके के िलए िलएिलए िलए आंचिल आंचिलआंचिल आंचिलक कक क महायोजना महायोजनामहायोजना महायोजना — —— —(1) राbय सरकार, पा�रिEथितक� संवेदी जोन के िलए राजप� म< अंितम अिधसूचना के .काशन क� तारीख से दो वष� क� अविध के भीतर, Eथानीय *ि+य, के परामश� से और इस अिधसूचना म< संलP न अनुबंध, के सामंजE य से आंचिलक महायोजना तैयार करेगी ।
(2) इस म< तैयार �कए गए आंचिलक महायोजना इस अिधसूचना म< िविनZद�[ अनुबंध के साथ आनुपाितक ह,गे और पया�वरणीय िववि5त सि@मिलत होगी।
(3) आचंिलक महायोजना राb य सरकार म< स5म .ािधकारी (ारा अनुमो�दत होगी ।
(4) राbय सरकार (ारा पा�रिEथितक� संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना म< िविनZद�o ट Uप तथा सुसंगत क< ?ीय और राb य िविधय, के सामजंE य और क< ?ीय सरकार (ारा जारी माग�िनदjश,, य�द कोई ह,, (ारा तैयार होगी ।
(5) आंचिलक महायोजना, पया�वरणीय और पा�रिEथितक� िवचार, को समाकिलत करने के िलए राb य सरकार के सभी संबN िवभाग, के परामश� से तैयार होगी, अथा�त्:--
(i) पया�वरण;
(ii) वन;
(iii) शहरी िवकास;
(iv) पय�टन;
(v) नगरपािलक;
(vi) राजE व;
(vii) कृिष;
(viii) पशु और म:Eय संसाधन;
(ix) िबहार राb य .दषूण िनयं�ण बोड� ;

(xi) पुरातrव; और
(xii) लोक िनमा�ण काय� (सड़क संिनमा�ण) ।
(6) आंचिलक महायोजना अनुमो�दत िवCमान भ-ूउपयोग, अवसंरचना और �_याकलाप, पर कोई िनबtधन अिधरोिपत नहu करेगी जब तक �क इस अिधसूचना म< िविनZद�o ट न हो और आंचिलक महायोजना सभी अवसंरचना और �_याकलाप, म< और अिधक द5ता और पा�रिEथितक� अनुकूलता का संवध�न करेगी ।
(7) आंचिलक महायोजना म< अनाvछा�दत 5े�, के जीण\Nार, िवCमान जल िनकाय, के संर5ण, आवाह 5े�, के .बंधन, जल-संभर, के .बंधन, भूतल जल के .बंधन, मृदा और नमी संर5ण, Eथानीय समुदाय, क� आवVयकता` तथा पा�रिEथितक� और पया�वरण से संबंिधत ऐस ेअ>य पहलू̀ , िजन पर Jयान दनेा आवVयक ह,ै के िलए उपबंध ह,गे ।
(8) आंचिलक महायोजना सभी िवCमान पूजा Eथल,, पुराताि:वक Eमारक, िवरासत संरचनाएं, nाम, और नगरीय बंदोबEत,, वन, के .कार और �कE म,, कृिष 5े�,, ऊपजाऊ भिूम, ह�रत 5े� जसेै उCान और उसी .कार के E थान, उCान कृिष 5े�, फलोउCान, झील, और अ>य जल िनकाय, का अyयकंन करेगी और समथ�नकारी मानिच� और िवCमान और .Eतािवत भूिम के उपयोग क� िवशेषता` के 1यौरे दतेे 6ए मानिच�, (ारा सम{थ�त होगी ।
(9) आंचिलक महायोजना पा�रिE थितक संवेदी जोन म< िवकास को िविनयिमत करेगी और अिधसूचना म< िविनZद�[ .ितिषN, िविनयिमत तथा संव{ध�त �_याकलाप, का अनुसरण करेगी िजससे Eथानीय समुदाय, क� आजीिवका क� सुर5ा के िलए पा�रिEथितक अनुकूल िवकास सुिनिDत �कया जा सके ।
(10) आंचिलक महायोजना इस अिधसूचना म< �दए गए उपबंध, के संबंध म< िनगरानी के अपने काय^ को करने के िलए िनगरानी सिमित के िलए एक संदभ� दEतावेज होगा।
3. रा�य रा�यरा�य रा�य सरकार सरकारसरकार सरकार �ारा �ारा�ारा �ारा �कए �कए�कए �कए जाने जानेजाने जाने वाले वालेवाले वाले उपाय उपायउपाय उपाय-- ---- -- राbय सरकार इस अिधसूचना के उपबंध, को .भावी करने के िलए िनeिलिखत उपाय करेगी, अथा�त् :—
(1) भू भभूू भू- -- -उपयोग उपयोग उपयोग उपयोग - -- - पा�रिE थितक संवेदी जोन म< वन,, उCान-कृिष 5े�,, कृिष 5े�,, आमोद-.मोद के .योजन, के िलए अिभिनिDत �कए गए पाक^ और खुले Eथान, का वािणिbयक या औCोिगक संबN िवकास �_याकलाप, के िलए उपयोग नहu होगा या उनके िलए 5े�, म< सपं�रवत�न नहu होगा : परंतु पा�रिEथितक संवेदी जोन के भीतर कृिष भूिम का संप�रवत�न, िनगरानी सिमित क� िसफा�रश पर और राbय सरकार के पूव� अनुमोदन स,े Eथानीय िनवािसय, क� आवासीय जUरत, को पूरा करने के िलए और पैरा 4 क� सारणी के Eतंभ (2) म< सूचीबN �_याकलाप, के िलए अनुWात ह,गे, अथा�त् :-
(i) पा�रिEथितक� अनुकूल पय�टन �_याकलाप, के िलए पय�टक, के अE थायी आवासन के िलए पा�रिEथितक� अनुकूल आरामगाह जैसे ट<ट, लकड़ी के मकान आ�द ;
(ii) िवCमान सड़क, को चौड़ा और सुदढ़ृ बनाना और नई सड़क, का सिंनमा�ण;
(iii) .दषूण का�रत न करने वाले लघु उCोग;
(iv) वषा� जल संचयन; और
(v) कुटीर उCोग, िजसके अंतग�त nामीण उCोग, सिुवधा भंडार और E थानीय सुख-सिुवधाएं हQ । परंतु यह और भी �क राbय सरकार के पूव� अनुमोदन और संिवधान के अनुv छेद 244 के उपबंध, और त:समय .वृ; िविध के उपबंध, के अनुपालन के िबना, िजसके अंतग�त अनुसिूचत जनजाित और अ>य परंपरागत वन िनवासी (वन अिधकार, क� मा>यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणिbयक या उCोग िवकास �_याकलाप, के िलए जनजातीय भूिम का उपयोग अनुWात नहu होगा : परंतु यह और भी �क पा�रिE थितक संवेदी जोन के भीतर भ-ूअिभलेख, म< उपसंजात कोई �ु�ट िनगरानी सिमित के िवचार .ा= करने के पDात् राbय सरकार (ारा .:येक मामले म< केवल एक बार संशोिधत होगी और उ+ �ु�ट के संशोधन क� क< ?ीय सरकार के पया�वरण वन और जलवायु प�रवत�न म�ंालय को सूचना दनेी होगी । परंतु यह और भी �क उपयु�+ �ु�ट का संशोधन म< इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म< भ-ूउपयोग का प�रवत�न सि@मिलत नहu होगा । परंतु यह और भी �क िजससे ह�रत 5े� म< जैसे वन 5े�, कृिष 5े� आ�द म< कोई पा�रणािमक कटौती नहu होगी और अन.यु+ या अनु:पादक कृिष 5े�, म< पुन: वनीकरण करन ेके .यास �कए जाएंगे । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(2) �ाकृितक जल �ोत �ाकृितक जल �ोत �ाकृितक जल �ोत �ाकृितक जल �ोत - आचंिलक महायोजना म< सभी .ाकृितक जल Tोत, क� पहचान क� जाएगी और उनके संर5ण और पुन8~भूतकरण के िलए योजना सि@ मिलत होगी और राb य सरकार (ारा ऐसे 5े�, पर या उनके िनकट िवकास �_याकलाप .ितिषN करने के िलए ऐसी रीित से माग�िनदjश तैयार �कए जाएंगे ।
(3) पय�टन पय�टन पय�टन पय�टन – –– – (क) पा�रिEथितक� संवेदी जोन के भीतर पय�टन संबंधी �_याकलाप पय�टन महायोजना के अनुसार ह,गे जो �क आंचिलक महायोजना के भाग Uप म< होगी । (ख) िबहार राbय के पय�टन िवभाग (ारा िबहार सरकार के पया�वरण और वन िवभाग के परामश� स े पय�टन आंचिलक महायोजना तैयार �कया जाएगा । (ग) पय�टन संबंधी �_याकलाप िन@ निलिखत के अधीन िविनयिमत ह,गे, अथा�त् :-
(i) वा�मी�क टाइगर �रजव� क� सीमा से 1 �कलोमीटर के भीतर या पा�रिEथितक संवेदी जोन के िवEतार तक, जो भी िनकट हो, �कसी होटल या �रसोट� का नया संिRमा�ण अनुWात नहu �कया जाएगा । बशतj, व>यजीव अभयारAय क� सीमा से एक �कलोमीटर क� दरूी से परे पा�रिEथितक संवेदी जोन के िवEतार तक नए होटल, और �रसोट^ क� Eथापना पय�टन महायोजना के अनुसार पा�रिEथितक पय�टन सिुवधा` के िलए पूव� सीमां�कत और पदािभिहत 5े�, म< ही अनुWात क� जाएगी;
(ii) पा�रिEथितक संवेदी जोन के भीतर सभी नए पय�टन �_याकलाप, या िवCमान पय�टन �_याकलाप, का िवEतार क< ?ीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय के माग�दश�क िसNांत, के (ारा तथा राo �ीय � या� सरं5ण .ािधकरण, (ारा जारी पा�रिEथितक पय�टन (समय-समय पर यथा संशोिधत) माग�दश�क िसNांत, के अनुसार, पा�रिEथितक पय�टन, पा�रिEथितक िश5ा और पा�रिEथितक िवकास को मह:व दतेे 6ए पा�रिEथितक संवेदी जोन क� वहन 5मता के अJययन पर आधा�रत होगा;
(iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक, पय�टन के िलए िवकास और िवCमान पय�टन �_याकलाप, के िवEतार को वाEतिवक Eथल िविनZद�[ संवी5ा तथा िनगरानी सिमित क� िसफा�रश पर आधा�रत संबंिधत िविनयामक .ािधकरण, (ारा अनुWात �कया होगा ।
(4) नैस#ग�क नैस#ग�कनैस#ग�क नैस#ग�क िवरासत िवरासतिवरासत िवरासत - -- - पा�रिEथितक� संवेदी जोन म< मह:वपूण� नैस{ग�क िवरासत के सभी Eथल, जैसे सभी जीन कोश आरि5त 5े�, शैल िवरचनाएं, जल .पात,, झरन,, घाटी माग^, उपवन,, गुफा`, Eथल,, �मण, अ�रोहण, .पातो आ�द क� पहचान क� जाएगी और उ>ह< प�ररि5त �कया जाएगा तथा उनक� सुर5ा और संर5ा के िलए इस अिधसूचना के .काशन क� तारीख से छह मास के भीतर, उपयु+ योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगी ।
(5) मानव िन#म�त िवरासत � थ मानव िन#म�त िवरासत � थमानव िन#म�त िवरासत � थ मानव िन#म�त िवरासत � थल ल ल ल - -- - पा�रिEथितक� संवेदी जोन म< भवन,, संरचना`, िश�प-त�य, ऐितहािसक, कला:मक और सांEकृितक मह:व के 5े�, क� पहचान करनी होगी और इस अिधसूचना के अंितम .काशन क� तारीख से छह माह के भीतर उनके संर5ण क� योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म< सि@मिलत क� जाएगी ।
(6) % व % व% व % विन �दषूण िन �दषूणिन �दषूण िन �दषूण - % व % व% व % विन �दषूण िन �दषूणिन �दषूण िन �दषूण – पा�रिEथितक संवेदी जोन म< िनवारण और Jविन .दषूण िनयं�ण पया�वरण (संर5ण) अिधिनयम, 1986 के अधीन Jविन (िविनयमन और िनयं�ण) िनयम 2000 के अनुसार संकिलत �कया जाएगा ।
(7) वायु वायुवायु वायु �दषूण �दषूण�दषूण �दषूण - पा�रिEथितक� संवेदी जोन म<, वायु .दषूण के िनयं�ण के िलए राbय सरकार का पया�वरण िवभाग, या िबहार राbय पया�वरण संर5ण बोड�, वायु (.दषूण िनवारण और िनयं�ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम, के उपबंध, के अनुसरण म< माग�दश�क िसNांत और िविनयम तैयार करेगा ।
(8) बिह�ाव बिह�ावबिह�ाव बिह�ाव का काका का िन�सारण िन�सारणिन�सारण िन�सारण - पा�रिEथितक संवेदी जोन म< उपचा�रत बिहTाव का िनEसारण साधारण मानक, के िलए पया�वरणीय .दिूषत आvछा�दत के िनEसारण के अंतग�त पया�वरण (संर5ण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयम, के उपबंध, के अनुसार होगा।
(9) ठोस अपिश. ठोस अपिश. ठोस अपिश. ठोस अपिश. - -- - ठोस अपिश[, का िनपटान िनeिलिखत Uप म< होगा -
(i) पा�रिEथितक� संवेदी जोन म< ठोस अपिश[, का िनपटान भारत सरकार के त:कालीन पया�वरण, वन और जलवायु प�रवत�न मं�ालय क� समय-समय पर यथा संशोिधत अिधसूचना स.ं का.आ. 1357(आ), तारीख 8 अ.ैल, 2016 नगरपािलक ठोस अपिश[ .बंध िनयम, 2016 के उपबंध, के अनुसार �कया जाएगा ;
(ii) अकाब�िनक सामnी का िनपटान पा�रिEथितक� संवेदी जोन के बाहर पहचान �कए गए E थल पर �कसी पया�वरणीय Eवीकाय� रीित म< होगा;
(iii) पा�रिEथितक� संवेदी जोन म< ठोस अपिशo ट, को जलाना या भEमीकरण अनुWात नहu होगा।

8. कोई अ> य मह: वपूण� िवषय । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23 MINISTRY OF ENVIRONMENT, FORESTS AND CLIMATE CHANGE NOTIFICATION New Delhi, the 13th September, 2017 S.O. 3026(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 1824 (E), dated the 19 th May, 2016 inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 19 th May, 2016; AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the draft notification have been duly considered; AND WHEREAS, the Valmiki Wildlife Sanctuary, Valmiki National Park and Valmiki Tiger Reserve are situated in the West Champaran District of Bihar and are spread over an area of
898.73 square kilometers and the Sanctuary is bound by India Nepal border in the north and Uttar Pradesh - Bihar border along River Gandak in the west; AND WHEREAS, the Valmiki Wildlife Sanctuary, Valmiki National Park and Valmiki Tiger Reserve have special and locally unique landscapes and vegetation comprising of Terai areas of the outer Siwaliks of the Himalayan foothills, these are composed of mosaic of varied landforms and ecosystems consisting of forested hills and valleys, riverine open woodlands, grasslands and swampy areas sheltering rich diversity of flora and fauna; the fauna includes Tiger (Panthera tigris), Leopard (Panthera pardus), Wolf (Canis lupus), Wild dog (Cuon alpinus), Hyena (Hyaena sp.), Jungle Cat (Felis chaus), Civets (Viverricula spp.), Otter (Lutrogale perspicillata), Gaur (Bos gaurus), Sambhar (Rusa unicolor), Chital (Axis axis), Barking Deer (Muntiacus muntjak), Hog Deer (Hyelaphus porcinus), Sloth bear (Melursus ursinus), Python (Pythonidae spp.), Mugger (Crocodilus palustris), Langur (Semnopithecus spp.), etc.; bird species like Peacock (Pavo cristatus), Vultures (Gyps spp.) and numerous species of birds inhabit the Sanctuary, some being endangered or vulnerable; AND WHEREAS, the tract of Valmiki Tiger Reserve is the source region of two major rivers Gandak and Burhi Gandak of the North Bihar plains yielding long term ecological and environmental significance of the area; AND WHEREAS, the fringes of Valmiki Tiger Reserve are also inhabited by Tharu tribe as a major community in the landscape and other tribes in pockets which enrich the ethnic, cultural and anthropological significance of the area; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Valmiki Tiger Reserve including Valmiki Wildlife Sanctuary and Valmiki National Park as Ecosensitive Zone from ecological and environmental point of view by habitat management aiming at improving and preserving the genetic resources of the aforesaid protected area, reintroduction and rehabilitation of local species, promote environmental education and ecological research and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent ranging from 0 metre to 9 kilometres around the boundary of the Valmiki Wildlife Sanctuary, Valmiki National Park and Valmiki Tiger 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Reserve in the State of Bihar as the Valmiki Wildlife Sanctuary, Valmiki National Park and Valmiki Tiger Reserve Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1)The extent of the Eco-sensitive Zone varies from 0 metre to 9 kilometres from the boundary of the Valmiki Wildlife Sanctuary, Valmiki National Park and Valmiki Tiger Reserve, zero extent is towards Western side sharing inter-state boundary with Uttar Pradesh and towards Northern side sharing international boundary with Nepal and the area of the Eco-Sensitive Zone is 835.76 square kilometres.
(2) The map of the Sanctuary demarcating the Eco-sensitive Zone boundary and the geo coordinates are appended as Annexure I and Annexure I A.
(3) The list of 323 villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure II.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan so prepared shall be commensurate with the stipulations specified in this notification and include the environmental implications.
(3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Animal and Fishery Resources;
(ix) Bihar State Pollution Control Board;
(x) Water Resources (Irrigation);
(xi) Archaeology; and
(xii) Public Works (Road Construction), for integrating environmental and ecological considerations into it.
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 25
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, archaeological monuments, heritage structures, villages and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas such as parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.
(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited, regulated and promoted activities specified in this notification so as to ensure ecofriendly development for livelihood security of local communities.
(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions in accordance with the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the following activities listed in column (2) of the Table in paragraph 4, namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism activities;
(ii) widening and strengthening of existing roads and construction of new roads;
(iii) small scale industries not causing pollution;
(iv) rainwater harvesting; and
(v) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or development activities within the catchment areas. 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(3) Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Bihar in consultation with Department of Revenue and Forests, Government of Bihar.
(c) The activities relating to tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be permitted within 1 kilometre from the boundary of the Valmiki Tiger Reserve or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government or Bihar State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Ecosensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmental by acceptable manner at site identified outside the Eco-sensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 27 number G.S.R 343 (E), dated the 28 th March, 2016, as amended from time to time, and no common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.- The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Industrial units.- (a) No establishment of new wood based industries within the Eco-sensitive zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil and noise pollution within the proposed Eco-sensitive Zone shall be permitted.
(16) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated or promoted within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto, and be regulated in the manner specified in the Table below, namely:- TABLE Sl. 1. Commercial mining, stone quarrying, sand mining and crushing units.
(a) New (minor and major minerals), stone quarrying and crushing units shall be prohibited except for meeting the domestic needs of bona fide local residents including 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting up of industries causing pollution (water, air, soil, noise, etc.).
(a) No new industries or expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
(b) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification.
3. Establishment of major hydroelectric projects. Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.
6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
7. Commercial use of fire wood. Prohibited (except as otherwise provided) as per applicable laws.
8. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities
9. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area of Valmiki Tiger Reserve or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
10. Under taking other activities related to tourism like over flying the Ecosensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Prohibited (except as otherwise provided) as per applicable laws.
11. Construction activities. No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone, ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 29 whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) cottage industries including village industries; convenience stores & local amenities supporting ecotourism including home stays; and
(iv) promoted activities listed in this Notification.
12. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.
13. Collection of forest produce, small fodder and Non-Timber Forest Produce (NTFP). Regulated under applicable laws.
14. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable law (underground cabling may be promoted).
15. Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts to be made for recycle and reuse of treated waste water, and the discharge of treated waste water or effluents shall be regulated as per applicable laws.
16. Widening and strengthening of existing roads and construction of new roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as per applicable laws.
17. Protection of hill slopes and river banks. Regulated under applicable laws.
18. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
19. Commercial extraction of surface and ground water. Regulated under applicable laws.
20. Introduction of exotic species. Regulated under applicable laws.
21. Use of polythene bags. Regulated under applicable laws.

23. Fencing of existing premises of hotels and resorts. Regulated under applicable laws.
24. Fishing in river or natural water bodies. Regulated under applicable laws.

26. Establishment of security forces camp. Regulated under applicable laws.
27. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
28. Open well, bore well, etc. for agriculture or other usage. Regulated under applicable laws and the activity shall be monitored by the concerned authority.
29. Solid waste and biomedical waste management. Regulated under applicable laws.
30. Eco-tourism. Regulated under applicable laws. C. Promoted Activities
31. Rain water harvesting. Shall be actively promoted.
32. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, poultry farming, aquaculture and fisheries. Permitted under applicable laws for use of locals.
33. Organic farming. Shall be actively promoted.
34. Adoption of green technology for all activities. Shall be actively promoted.
35. Cottage industries including village artisans, etc. Shall be actively promoted.
36. Small scale non polluting industries. Non polluting industries termed as white category as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, smallscale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
37. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted.
38. Agro-forestry. Shall be actively promoted.
39. Use of eco-friendly transport. Shall be actively promoted.
40. Skill development. Shall be actively promoted.
41. Restoration of degraded land/ forests/ habitat. Shall be actively promoted.

5. Monitoring Committee.-(1) The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) Commissioner, Tirhut, Muzaffarpur Division -Chairperson;
(ii) Field Director, Valmiki Tiger Reserve, West Champaran -Member;
(iii) District Magistrate, W. Champaran -Member;
(iv) An expert in the area of ecology and environment to be nominated by the Government of Bihar for a period not exceeding three years at a time. -Member;
(v) One representative of non-Governmental Organisation (working in the field of environment including heritage Conservation) to be nominated by the Government of Bihar for a period not exceeding three years at a time. -Member;
(vi) Member Secretary or Member, Bihar State Biodiversity Board -Member;
(vii) Regional Officer, Bihar State Pollution Control Board -Member;
(viii) Representative of Department of Revenue, Government of Bihar -Member;
(ix) Representative of Department of Water Resources, Government of Bihar - Member;
(x) Representative of Department of Mines and Geology, Government of Bihar -Member;
(xi) Representative of Department of Agriculture, Government of Bihar -Member;
(xii) Representative of Department of Animal and Fish Resources, Government of Bihar -Member;
(xiii) Divisional Forest Officer, Valmiki Tiger Reserve, Division-I/II by rotation for period of three years -Member Secretary.
6. Terms of reference.- (1) The tenure of the Monitoring Committee shall be for a period of three years from the date of publication of this notification in Official Gazette.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wild Life Warden of the State as per proforma appended at Annexure III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal. [F.
