PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 2652] No. 2652] NEW DELHI, WEDNESDAY, SEPTEMBER 13, 2017/BHADRA 22, 1939 पर्यावरण, वन और जलवयर् ुपररवर्ान मतं्रयलर् अधिसचूनय नई दिल्ली, 13 धसर्म् बर, 2017 कय.आ. 3029(अ).—प्रयरूप अधिसूचनय महयरयष्ट्र रयज्र् में पेंच रयष्ट्रीर् उद्ययन और मयनससंगिेव वन्र्जीव अभर्यरण्र् के आसपयस पयररधथिधर्की संवेिी जोन को अधिसूधचर् करन ेके धलए एक अधिसूचनय, भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. 1150 (अ), र्यरीख 17 मयचा, 2016, उन सभी व्यधिर्ों से, धजनके उससे प्रभयधवर् होने की संभयवनय िी, उस र्यरीख से, धजसको उस रयजपत्र की प्रधर्र्यं, धजसमें र्ह अधिसूचनय अंर्र्वाष्ट िी, उपलब्ि करय िी गई िी, सयठ दिन की अवधि के भीर्र आक्षेप और सुझयव आमंधत्रर् करर्े हुए एक प्रयरूप अधिसूचनय प्रकयधिर् की गई िी;
और उि रयजपत्र, धजसमें उक् र् अधिसूचनय अंर्र्वा् ह,, की प्रधर्र्यं जनर्य को 17 मयचा, 2016 को उपलब्ि करय िी गई िीं ;
और, उि प्रयरूप अधिसूचनय के उत्तर में सभी व्यधिर्ों और पणियररर्ों से प्रयप्त आक्षपेों और सुझयवों पर कें द्रीर् सरकयर द्वयरय सम्र्क् रूप से धवचयर दकर्य गर्य;
और, कें द्रीर् सरकयर के धवचयर से पेंच रयष्ट्रीर् उद्ययन और मयनससंगिेव वन्र्जीव अभर्यरण्र् महयरयष्ट्र के नयगपरु धजले में धथिर् ह, और 21° 39′ 36.53′′ से 21° 27′ 13.53′′ उत्तर अक्षयंि के बीच और 79° 09′ 01.78′′ से 79° 13′

और, पेंच रयष्ट्रीर् उद्ययन और मयनससंगिेव वन्र्जीव अभर्यरण्र् के चयरों ओर के क्षेत्र को, धजसकय धवथर्यर और सीमयए ं इस अधिसूचनय के प,रय 1 में धवधनर्िाष्ट ह , पर्यावरण की िधृष्ट से पयररधथिधर्की संवेिी जोन के रूप में सुरधक्षर् और संरधक्षर् करनय र्िय उि पयररधथिधर्की संवेिी जोन में उद्योगों र्य उद्योगों के वगो के प्रचयलन र्िय प्रसंथकरण करन ेको प्रधर्धिद्ध करनय आवश्र्क ह,;
अर्ः, अब, केन्द्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) और पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (2) के खंड (v) और खंड (xiv) और उपियरय (3) के सयि परठर् उपियरय (1) द्वयरय प्रित्त िधिर्ों कय प्रर्ोग करर्े हुए, महयरयष्ट्र रयज्र् में पेंच रयष्ट्रीर् उद्ययन और मयनससंगिेव वन्र्जीव अभर्यरण्र् की सीमय 0.12 से 9.5 दकलोमी र की सीमय र्क के क्षेत्र को पेंच रयष्ट्रीर् उद्ययन और मयनससंगिेव वन्र्जीव अभर्यरण्र् पयररधथिधर्की संवेिी जोन (धजसे इसें इसके पश्चयर् ्पयररधथिधर्की संवेिी जोन कहय गर्य ह,) के रूप में अधिसूधचर् करर्ी ह,, धजसकय धववरण धनम्नयनुसयर ह,, अियार् ्:-
1. पयररधथिधर्की संविेी जोन कय धवथर्यर और उसकी सीमयए.ं—(1) पयररधथिधर्की संवेिी जोन 419.40 वगा दकलोमी र के क्षेत्र में फ, लय हुआ ह, धजसकय धवथर्यर मध्र् प्रिेि के सयि अन्र्रयाज्र्ीर् सीमय को सयझयं करन ेवयल ेभयग के धसवयर् महयरयष्ट्र रयज्र् के पेंच रयष्ट्रीर् उद्ययन और मयनससंगिेव वन्र्जीव अभर्यरण्र् की सीमय से 0.12 से 9.5 के धबच ह, और मध्र् प्रििे रयज्र् से संलग्न सीमय की ओर िून्र् धवथर्यर कय उल्लेख ह, और उि जोन की सीमय वणान उपयबिं I में दिर्य गर्य ह, ।
(2) पयररधथिधर्की संवेिी जोन महयरयष्ट्र के नयगपरु धजले में 63 ग्रयमों में फ, लय हुआ ह, ।
(3) अक्षयंि और िेियंर्र के सयि पयररधथिधर्की संवेिी जोन कय मयनधचत्र उपयबिं II के रूप में संलग्न ह, ।
(4) अक्षयंि और िेियंर्र के सयि पयररधथिधर्की संवेिी जोन के सयि-सयि संरधक्षर् क्षेत्र के भू-धनिेियंक उपयबिं IIIक और उपयबिं IIIख के रूप में संलग्न ह, ।
(5) पयररधथिधर्की संवेिी जोन के अन्र्गार् आन ेवयले ग्रयमों की सूची के सयि मुख्र् धबन्िओुं के धनिेियंक उपयबिं IV के रूप में उपयबद्ध ह, ।
2. पयररधथिधर्की संविेी जोन के धलए आचंधलक महयर्ोजनय.—(1) रयज्र् सरकयर, पयररधथिधर्की संवेिी जोन के धलए रयजपत्र में इस अधिसूचनय के प्रकयिन की र्यरीख से िो विा की अवधि के भीर्र, थियनीर् व्यधिर्ों के परयमिा से और इस अधिसूचनय में संलग् न अनुबंिों के सयमंजथ र् से आंचधलक महयर्ोजनय र्,र्यर करेगी ।
(2) आंचधलक महयर्ोजनय रयज् र् सरकयर में सक्षम प्रयधिकयरी द्वयरय अनुमोदिर् होगी ।
(3) पयररधथिधर्की संवेिी जोन के धलए आंचधलक महयर्ोजनय, रयज् र् सरकयर द्वयरय इस अधिसूचनय में धवधनर्िा् रूप में ऐसी रीधर् में र्िय सुसंगर् कें द्रीर् और रयज् र् धवधिर्ों के सयमंजथ र् में भी र्िय कें द्रीर् सरकयर द्वयरय जयरी मयगाधनिेि, र्दि कोई हों, द्वयरय र्,र्यर की जयएगी ।
(4) आंचधलक महयर्ोजनय, उि र्ोजनय में पर्यावरणीर् और पयररधथिधर्की धवचयरों को समयकधलर् करने के धलए रयज् र् के धनम्नधलधखर् धवभयगों के परयमिा से र्,र्यर की जयएगी, अियार्:्—
(i) पर्यावरण ;
(ii) वन और वन्र्जीव ;
(iii) कृधि;
(iv) रयजथ व;
(v) िहरी धवकयस;
(vi) पर्ा न;

(vii) ग्रयमीण धवकयस;
(viii) ससंचयई और बयढ़ धनर्ंत्रण;
(ix) नगरपयधलक;
(x) पंचयर्र्ी रयज; और
(xi) लोक धनमयाण धवभयग।
(5) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन भू-उपर्ोग, अवसंरचनय और दक्रर्यकलयपों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय में धवधनर्िा् न हो और उक् र् महयर्ोजनय में सभी अवसंरचनय और दक्रर्यकलयपों में िक्षर्य र्िय पयररधथ िधर्कीर् अनुकूलर्य कय संविान करेगी ।
(6) आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबंिन, भूर्ल जल के प्रबंिन, मृिय और नमी संरक्षण, थियनीर् समुियर्ों की आवश्र्कर्यओं र्िय पयररधथिधर्की और पर्यावरण से संबंधिर् ऐसे अन्र् पहलओुं, धजन पर ध्र्यन िेनय आवश्र्क ह,, के धलए उपबंि होंगे ।
(7) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय थ िलों, ग्रयमों और नगरीर् बंिोबथर्ों, वनों के प्रकयर और दकथ मों, जनजयर्ीर् क्षेत्र, कृधि क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षेत्र ज,से उद्ययन और उसी प्रकयर के थ ियन, उद्ययन कृधि के्षत्र, आर्काडों, झीलों और अन्र् जल धनकयर्ों कय अभ्र्कंन करेगी ।
(8) आंचधलक महयर्ोजनय पयररधथिधर्की संवेिी जोन में धवकयस को धवधनर्धमर् करेगी र्यदक थ ियनीर् समुियर्ों की आजीधवकय और पयररधथिधर्की अनुकूल धवकयस को सुधनधश् चर् दकर्य जय सके ।
(9) ऐसी अनुमोदिर् आंचधलक महयर्ोजनय इस अधिसूचनय के उपबंिों के अनुसयर मयनी री के कयर्ो को मयनी री सधमधर् के धलए एक संिभा िथर्यवेज होगी ।
3. रयज्र् सरकयर द्वयरय दकए जयन े वयल े उपयर्.—रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करन े के धलए धनम्नधलधखर् उपयर् करेगी, अियार्् :—
(1) भ-ूउपर्ोग.—पयररधथिधर्की संवेिी जोन में वनों, उद्ययन-कृधि क्षेत्रों, कृधि क्षेत्रों, आमोि-प्रमोि के प्रर्ोजन के धलए धचधन्हर् दकए गए पयकों और खुल ेथियनों कय प्रर्ोग र्य संपररवर्ान वयधणधज्र्क नहीं दकर्य जयएगय। औद्योधगक र्य ररहयर्िी प्रक्षेत्र र्य दक्रर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय :
परंर् ुपयररधथिधर्की संवेिी जोन के भीर्र कृधि र्य अन्र् भूधम कय संपररवर्ान मयनी री सधमधर् की धसफयररि पर और रयज्र् सरकयर के पूवा अनुमोिन से, जो थियनीर् धनवयधसर्ों की आवयसीर् जरूरर्ों को पूरय करने के धलए और दक्रर्यकलयपों के धलए अनुज्ञयर् अनजु्ञयर् दकर्य जय सकेगय ज,से:—
(i) धवद्यमयन सडकों को चौडय और सुिढृ करनय र्िय नई सडकों कय संधनमयाण;
(ii) बुधनर्यिी ढयंचों और नयगररक सुधवियओं कय संधनमयाण और नवीकरण;
(iii) प्रििूण कयररर् न करन ेवयले लघु उद्योग;
(iv) कु ीर उद्योगों धजसके अंर्गार् ग्रयमीण कयरीगर ह ; सुधवियजनक भण्डयर और थियनीर् सुधवियओं सहयर्क पयररधथिधर्की पर्ा न धजसमें ग्रह वयस भी ह,; और
(v) सयरणी के प,रय 4 में दिए गए संवर्िार् दक्रर्यकलयप:
परंर् ुर्ह और दक जनजयर्ीर् भूधम कय उपर्ोग रयज्र् सरकयर के पूवा अनुमोिन और संधवियन के अनचु् छेि 244 र्य र्त्समर् प्रवृत्त धवधि के उपबंिों के अनुपयलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,, वयधणधज्र्क र्य उद्योग धवकयस दक्रर्यकलयपों के धलए अनुज्ञयर् नहीं होगय :
परंर् ुर्ह और भी दक पयररधथिधर्की संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई तु्रर , मयनी री सधमधर् के धवचयर प्रयप्त करन ेके पश्चयर् ्रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमले में एक बयर संिोधिर् की जयएगी और उि तु्रर के संिोिन की सूचनय कें द्रीर् सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् को िी जयएगी । परंर् ुर्ह और भी दक उपर्ुाि तु्रर कय संिोिन इस उप प,रय के अिीन र्िय उपबंधिर् के धसवयर् दकसी भी ििय में भू-उपर्ोग कय पररवर्ान सधम्मधलर् नहीं होगय । परंर् ुर्ह और भी दक धजससे हररर् क्षेत्र में ज,से वन क्षेत्र, कृधि क्षेत्र आदि में कोई पयररणयधमक क ौर्ी नहीं होगी और अनप्रर्ुक् र् र्य अनुत् पयिक कृधि क्षेत्रों में पुन: वनीकरण करन ेके प्रर्यस दकए जयएंगे । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(2) प्रयकृधर्क जल स्रोर्.—सभी प्रयकृधर्क जल स्रोर्ों की आचंधलक महयर्ोजनय में उनके संरक्षण और पनुरुद्भूर्करण के धलए र्ोजनय सधम् मधलर् की जयएगी और रयज् र् सरकयर द्वयरय ऐसे क्षते्रों पर र्य उनके धनक जो ऐसे क्षेत्रों के धनक हयधनकयरक ह , धवकयस दक्रर्यकलयप ऐसी रीधर् में प्रधर्धिद्ध करने के धलए मयगाधनिेि र्,र्यर दकए जयएगंे ।
(3) पर्ा न.—(क) पयररधथिधर्की संवेिी जोन के भीर्र सभी नए पर्ा न संबंिी दक्रर्यकलयप र्य धवद्यमयन दक्रर्यकलयप कय धवथर्यर पयररधथिधर्की संवेिी जोन के धलए आंचधलक महयर्ोजनय के अनुसयर होगय । (ख) पर्ा न महयर्ोजनय, रयज्र् पर्ा न धवभयग, द्वयरय रयज्र् पर्यावरण और वन धवभयग के परयमिा से र्,र्यर की जयएगी । (ग) पर्ा न महयर्ोजनय आंचधलक महयर्ोजनय के एक घ क के रूप में होगी । (घ) पर्ा न संबंिी दक्रर्यकलयप धनम् नधलधखर् के अिीन धवधनर्धमर् होंग,े अियार् ्:—
(i) पेंच रयष्ट्रीर् उद्ययन और मयनससंगिेव वन्र्जीव अभर्यरण्र् की सीमय से एक दकलोमी र के भीर्र र्य पयररधथिधर्की संवेिी जोन के धवथर्यर र्क, जो भी धनक हो, दकसी हो ल र्य ररसो ा कय नर्य संधिमयाण अनुज्ञयर् नहीं दकर्य जयएगय :
परन्र्,ु पेंच रयष्ट्रीर् उद्ययन और मयनससंगिेव वन्र्जीव अभर्यरण्र् की सीमय से एक दकलोमी र की िरूी से परे पयररधथिधर्की संवेिी जोन के धवथर्यर र्क नए हो लों और ररसो ों की थियपनय पर्ा न महयर्ोजनय के अनुसयर पयररधथिधर्की पर्ा न सुधवियओं के धलए पूवा सीमयंदकर् और पियधभधहर् क्षेत्रों में ही अनुज्ञयर् की जयएगी;
(ii) पयररधथिधर्की संवेिी जोन के भीर्र सभी नए पर्ा न दक्रर्यकलयपों र्य धवद्यमयन पर्ा न दक्रर्यकलयपों कय धवथर्यर कें द्रीर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् के मयगाििाक धसद्धयंर्ों के द्वयरय र्िय रय् ट्रीर् व् र्यघ्र स संरक्षण प्रयधिकरण, द्वयरय जयरी पयररधथिधर्की पर्ा न (समर्-समर् पर र्िय संिोधिर्) मयगाििाक धसद्धयंर्ों के अनुसयर, पयररधथिधर्की पर्ा न, पयररधथिधर्की धिक्षय और पयररधथिधर्की धवकयस को महत्व िेर् े हुए पयररधथिधर्की संवेिी जोन की वहन क्षमर्य के अध्र्र्न पर आियररर् होगय;
(iii) जब र्क आंचधलक महयर्ोजनय कय अनुमोिन नहीं कर दिर्य जयर्य ह, र्ब र्क पर्ा न संबंिी धवकयस र्िय धवद्यमयन पर्ा न दक्रर्यकलयपों कय धवथर्यर मयनी री सधमधर् के वयथर्धवक थिल धवधनर्िाष्ट संवीक्षय र्िय धसफयररि के आियर पर सम्बंधिर् धवधनर्यमक प्रयधिकयरी द्वयरय अनजु्ञयर् दकर्य जयएगय और पयररधथिधर्की संवेिी जोन क्षेत्र के भीर्र कोई नर्य हो ल और ररसय ा र्य वयधणधज्र्क थियपन कय संधिमयाण अनुज्ञयर् नहीं दकर्य जयएगय ।
(4) न,सर्गाक धवरयसर् -- पयररधथिधर्की संवेिी जोन में सभी महत्वपूणा न,सर्गाक धवरयसर् के सभी थिलों ज,से सभी जीन कोि आरधक्षर् के्षत्र, ि,ल धवरचनयएं, जल प्रपयर्ों, झरनों, घय ी मयगों, उपवनों, गुफयए,ं थिलों, भ्रमण, अश्वरोहण, प्रपयर्ो आदि की पहचयन की जयएगी और उनकी सुरक्षय और संरक्षय के धलए रयजपत्र में इस अधिसूचनय के प्रकयिन की र्यरीख से छः मयस के भीर्र धवरयसर् संरक्षण र्,र्यर की जयएगी और ऐसी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगी ।
(5) मयनव धनर्मार् धवरयसर् थ िल - पयररधथिधर्की संवेिी जोन में भवनों, संरचनयओं, धिल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंथकृधर्क महत्व के क्षेत्रों की पहचयन की जयएगी और रयजपत्र में इस अधिसूचनय के प्रकयिन की र्यरीख से छह मयस के भीर्र उनकी सुरक्षय और संरक्षय के धलए धवरयसर् संरक्षण र्ोजनय र्,र्यर की जयएगी और ऐसी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगी ।
(6) ध् वधन प्रििूण -- पयररधथिधर्की संवेिी जोन में ध् वधन प्रििूण धनवयरण और पर्यावरण (संरक्षण) अधिधनर्म, 1986, के अिीन ध्वधन प्रििूण (धवधनर्मन और धनर्ंत्रण) धनर्म, 2000 के अनुसयर दकर्य जयएगय ।
(7) वयर् ु प्रििूण -- पयररधथिधर्की संवेिी जोन में, वयर्ु प्रििूण धनवयरण और धनर्ंत्रण वयर् ु (प्रििूण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर होगय ।
(8) बधहस्रयव कय धनथसयरण -- पयररधथिधर्की संवेिी जोन में उपचयररर् बधहस्रयव कय धनथसयरण जल (प्रििूण धनवयरण और धनर्ंत्रण) 1974 (1974 कय 6) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर होगय ।
(9) ठोस अपधिष्ट -- ठोस अपधिष्टों कय धनप यन और प्रबंिन धनम्नधलधखर् रूप में होगय--
(i) पयररधथिधर्की संवेिी जोन में ठोस अपधिष्ट धनप यन जो भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय.आ. 1357(अ) र्यरीख 8 अप्र,ल, 2016 द्वयरय प्रकयधिर् ठोस अपधि् प्रबंिन धनर्म, 2016, के उपबंिों के अनुसयर दकर्य जयएगय ;
(ii) अकयबाधनक सयमग्री कय धनप यन पयररधथिधर्की संवेिी जोन के बयहर पहचयन दकए गए थ िल पर दकसी पर्यावरणीर् थवीकृर् रीधर् में होगय;

(iii) पयररधथिधर्की संवेिी जोन में ठोस अपधि् ों को जलयनय र्य भ् मीकरण अनुज्ञयर् नहीं होगय।
(10) ज,व धचदकत् सीर् अपधि् .-ज,व धचदकत् सीर् अपधि् प्रबंिन धनम्नधलधखर् रूप में होगय—
(i) पयररधथिधर्की संवेिी जोन में ज,व धचदकत्सीर् अपधिष्ट कय धनप यन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्ियसंिोधिर् अधिसूचनय सं.कय.धन 343 (अ) र्यरीख 28 मयचा 2016 द्वयरय प्रकयधिर् ज,व धचदकत्सीर् अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ।
(ii) पयररधथिधर्की संवेिी जोन में कोई सयमयन्र् उपचयर सुधविय र्य भथमीकरण अनुज्ञयर् नहीं दकर्य जयएगय ।
(11) र्यनीर् पररवहन - पररवहन की र्यनीर् गधर्धवधिर्यं आवयस के अनुकूल धवधनर्धमर् होंगी और इस संबंि में आंचधलक महयर्ोजनय में धविेि उपबंि अधिकधिर् दकए जयएंग ेऔर आंचधलक महयर्ोजनय के र्,र्यर होने और रयज् र् सरकयर के सक्षम प्रयधिकयरी के द्वयरय अनुमोदिर् होने र्क, मयनी री सधमधर् प्रवृत्त धनर्मों और धवधनर्मों के अनुसयर र्यनीर् गधर्धवधिर्ों के अनुपयलन को मयनी र करेगी ।
(12) र्यनीर् प्रििूण.- पयररधथिधर्की संवेिी जोन में र्यनीर् प्रििूण धनवयरण और धनर्ंत्रण लयग ूधवधिर्ों के अनुसयर दकर्य जयएगय और थवच्छक ईंिन के उपर्ोग के धलए दकए गए प्रर्यस उियहरण के धलए सीएनजी, एलपीजी, आदि, दकए जयएंग े।
(13) प्लयधथ क अपधिष्ट प्रबिंन.- पयररधथिधर्की संवेिी जोन में प्लयधथ क अपधिष्ट प्रबंिन कय धनप यन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्ियसंिोधिर् अधिसूचनय सं.कय.धन 340(अ), र्यरीख 18 मयचा, 2016 द्वयरय प्रकयधिर् प्लयधथ क अपधिष्ट प्रबंि धनर्म 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(14) धनमयाण और धवध्वसं अपधिष्ट प्रबिंन.- पयररधथिधर्की संवेिी जोन में संधनमयाण और धवध्वंस अपधिष्ट प्रबंिन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्ियसंिोधिर् अधिसूचनय सं.कय.धन 317(अ), र्यरीख 29 मयचा, 2016 द्वयरय प्रकयधिर् संधनमयाण और धवध्वंस प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ।
(15) इलके्ट्रोधनक–अपधिष्ट.- पयररधथिधर्की संवेिी जोन में ई–अपधिष्ट प्रबंिन भयरर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्ियसंिोधिर् द्वयरय प्रकयधिर् ई–अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(16) औद्योधगक ईकयइर्य.ं- (i) पयररधथिधर्की संवेिी जोन के भीर्र कोई नए प्रिधूिर् कयररर् करने वयल ेउद्योगों की थियपनय की अनुमधर् नहीं िी जयएगी।
(ii) पयररधथिधर्की संवेिी जोन के भीर्र केवल ग,र-प्रििूण कयररर् करन े वयले उद्योग, फरवरी 2016 में केन्द्रीर् प्रििूण धनर्ंत्रण बोडा द्वयरय जयरी दििय धनिेिों में उद्योगों के वगीकरण के अनुसयर, जब र्क इस अधिसूचनय में अन्र्िय धवधनर्िाष्ट न हो, अनुज्ञयर् होंगे।
(17) पहयडी ढलयनों को सरंक्षण: - पहयडी ढलयनों कय संरक्षण धनम्नयनुसयर होगय :- (क) आंचधलक महयर्ोजनय पहयडी ढलयनों पर क्षेत्रों को उपिर्िार् करेगय जहयं कोई संधनमयाण अनुज्ञयर् नहीं होगय । (ख) क यव के एक उच्च धडग्री के सयि धवद्यमयन खडी पहयडी ढलयनों र्य ढलयनों पर कोई संधनमयाण अनुज्ञयर् नहीं होगय ।
(18) केन्द्रीर् सरकयर और रयज्र् सरकयर, र्दि र्ह आवश्र्क समझर्ी ह,, इस अधिसूचनय के उपबंिों को प्रभयवी करन ेमें अन्र् उपयर् धवधनर्िाष्ट करेगय।
4. प्रधर्धिद्ध, धवधनर्धमर् और संवर्िार् दक्रर्यकलयप .- पयररधथिधर्की संवेिी जोन में सभी दक्रर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) के उपबंिों और र्द्धीन बनयए गए धनर्मों द्वयरय ियधसर् होंगे और नीचे िी गई सयरणी में धवधनर्िाष्ट रीधर् में धवधनर्धमर् होंगे, अियार् ्:-- सयरणी क्रम स.ं दक्रर्यकलयप ीकय-र प्पणी
(1) (2) (3) क.प्रधर्धिद्ध दक्रर्यकलयप
1. वयधणधज्र्क खनन, पत्िर उत्खनन, उनको र्ोडने की इकयइर्यं । (क) सभी नए एवं धवद्यमयन खनन (लघु और वृहर् खधनज), पत्िर उत्खनन और उनको र्ोडने की इकयइर्यं वयथर्धवक थियनीर् धनवयधसर्ों की घरेलू आवश्र्कर्यओं धजसमें धनजी उपर्ोग के धलए के धलए मकयनों के संधनमयाण र्य मरम्मर् के धलए िरर्ी को खोिनय 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और मकयन बनयने के धलए ििेी यइल्स र्य ईं ों कय धनमयाण करनय भी सधम्मधलर् ह,, के धसवयर् नहीं होंगी ;
(ख) खनन संदक्रर्यएं, मयननीर् उच्चर्म न्र्यर्यलर् की रर र्यधचकय (धसधवल) सं. 1995 कय 202 ी.एन. गौडयबमान धिरुमूलपयि बनयम भयरर् सरकयर के मयमले में आििे र्यरीख 4 अगथर्, 2006 और रर र्यधचकय (सी) सं. 2012 कय 435 गोवय फयउंडेिन बनयम भयरर् सरकयर के मयमले में र्यरीख 21 अप्र,ल, 2014 के अंर्ररम आििे के अनुसरण में सवािय प्रचयलन होगय ।
2. प्रििूण कयररर् (जल, वयर्ु, मृिय, ध् वधन आदि,) करने वयले उद्योगों की थ ियपनय । (क) कोई नई र्य पयररधथिधर्की संवेिी जोन में प्रििूण कयररर् करने वयले उद्योगों कय धवथर्यर अनुज्ञयर् नहीं होगय। (ख) प्रििूण कयररर् नहीं करने वयले लघु उद्योगों से संबंधिर् संधनमयाण दक्रर्यकलयप, लयगू धनर्मों और धवधनर्मों, र्दि कोई हो, के अनुसयर सक्षम प्रयधिकयरी की पूवा अनुज्ञय से न्र्ूनर्म पर रखे जयएंगे और धवधनर्धमर् होंगे।
3. बृहर् जल धवद्युर् पररर्ोजनय की थियपन । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्िय उपबंधिर् के धसवयर्) होंगे ।
4. दकसी पररसंक मर् पियिों कय उपर्ोग र्य उत्पयिन र्य प्रसंथकरण। लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्िय उपबंधिर् के धसवयर्) होंगे ।
5. प्रयकृधर्क जल धनकयर्ों र्य सर्ही क्षेत्र में अनुपचयररर् बधहस्रयाव और ठोस अपधिष्टों कय धनथसयरण । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्िय उपबंधिर् के धसवयर्) होंगे ।
6. ठोस अपधिष्ट धनप यन थिल की थियपनय और ठोस र्िय ज,व धचदकत्सय अपधिष्ट के धलए सयमयन्र् भ्मीकरण की सुधविय। पयररधथिधर्की संवेिी जोन में ठोस अपधिष्ट धनप यन की कोई नर्य ठोस अपधिष्ट धनप यन थिल और अपधिष्ट उपचयर/प्रसंथकरण सुधविय की अनुमधर् नहीं ह,। औद्योधगक प्रदक्रर्य और थवयथथ्र् थियपनअथपर्यलों आदि से उत्पि दकसी भी ठोस अपधिष्ट के दकसी भी प्रकयर के उपचयर के धलए सयमयन्र् र्य व्यधिगर् भ्मीकरण की सुधविय कय संथियपन प्रधर्धिद्ध ह,।
7. नई आरय धमलों की थियपनय। पयररधथिधर्की संवेिी जोन के भीर्र नई और धवद्यमयन आरय धमलों कय धवथ र्यर अनुज्ञयर् नहीं होगय ।
8. ईं भट्टों की थियपनय करनय। लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्िय उपबंधिर् के धसवयर्) होंगे । ख. धवधनर्धमर् दक्रर्यकलयप
9. हो लों और ररसो ों की थियपनय। पयररधथिधर्की अनुकूल पर्ा न दक्रर्यकलयप से संबंधिर् पर्ा कों के अथियर्ी अधिभोग के धलए वयस सधुविय के धसवयर् संरधक्षर् क्षेत्र की सीमय से एक दकलोमी र र्क र्य पयररधथिधर्की संवेिी जोन के धवथर्यर र्क इनमें जो भी धनक ह,, नर्े वयधणधज्र्क हो ल और ररसो ा अनुज्ञयर् नहीं होंगे। परंर्ु, जहयाँ पयररधथिधर्की संवेिी जोन कय धवथर्यर एक दकलोमी र से परे ह, वहयाँ, एक दकलोमी र से परे और पयररधथिधर्की संवेिी जोन के धवथर्यर र्क सभी नए पर्ा क दक्रर्यकलयप र्य धवद्यमयन दक्रर्यकलयप कय धवथर्यर पर्ा न महयर्ोजनय और रय् ट्रीर् व् र्यघ्र स संरक्षण प्रयधिकरण के अनुसयर होगय।
10. संधनमयाण दक्रर्यकलयप । (क) महयरयष्ट्र रयज्र् में पेंच रयष्ट्रीर् उद्ययन और मयनससंगिवे वन्र्जीव अभर्यरण्र् की सीमय से 250 मी र के अंर्गार् दकसी भी प्रकयर कय कोई नर्य वयधणधज्र्क संधनमयाण अनुज्ञयर् नहीं होगय:
परन्र्ु इस क्षेत्र कय धसफा 5 प्रधर्िर् भयग संधनमयाण दकर्य जय सकेगय । परंर्ु थ ियनीर् व् र्धक् र्र्ों को अपने आवयसीर् उपर्ोग, धजसके II (ii) 7 अंर्गार् प,रय 3 के उपप,रय (1) में सूचीबद्ध दक्रर्यकलयप भी ह , के धलए अपनी भूधम पर संधनमयाण अनुज्ञयर् होगय । (ख) पयररधथिधर्की संवेिी जोन के भीर्र केवल ग,र-प्रििूण कयररर् करने वयले उद्योग, फरवरी 2016 में केन्द्रीर् प्रििूण धनर्ंत्रण बोडा द्वयरय जयरी दििय धनििेों में उद्योगों के वगीकरण के अनुसयर, जब र्क इस अधिसूचनय में अन्र्िय धवधनर्िाष्ट न हो, अनुज्ञयर् होंगे। (ग) एक दकलोमी र से आगे र्ह आंचधलक महयर्ोजनय की अनुसयर धवधनर्धमर् होंगे ।
11. प्रििूण कयररर् न करने वयले लघु उद्योग । फरवरी, 2016 में केन्द्रीर् प्रििुण धनर्त्रण बोडा द्वयरय जयरी उद्योगो के वगीकरण के अनुसयर ग,र-प्रििूण कयररर् करने वयले उद्योगों और पयररधथिधर्की संवेिी जोन से ग,र पररसंक मर्, लघु और सेवय उद्योग, कृधि, उद्ययन कृधि, पु्प कृधि र्य ििेीर् सयमग्री से उत्पयिों कय उत्पयिन करने वयले कृधि आियररर् उद्योग को सक्षम प्रयधिकयरी द्वयरय अनुज्ञयर् दकर्य जयएगय।
12. वृक्षों की क यई । (क) रयज्र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनुमधर् के धबनय वन में र्य सरकयरी र्य रयजथव र्य धनजी भूधम पर वृक्षों की कोई क यई नहीं होगी। (ख) वृक्षों की क यई संबंधिर् कें द्रीर् र्य रयज्र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंि के अनुसयर धवधनर्धमर् होगी ।
13. वन उत्पयिों र्य ग,र कय् ठ वन उत्पयिों (एन ी एफ ी) कय संग्रहण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
14. धवद्युर् और िरूसंचयर यवरों कय पररधनमयाण और केबल धबछयनय र्िय अन्र् बुधनर्यिी ढयंचे । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । (भूधमगर् केबल धबछयए जयने को बढ़यवय दिर्य जयएगय)।
15. अवसंरचनयत्मक धजसके अंर्गार् नयगररक सुख सुधवियओं बुधनर्यिी ढयंचे भी ह । न्र्ूनीकरण की उपयर्ों के सयि, लयग ूधवधिर्ों धनर्मों और धवधनर्मों और उपलब्ि मयगाििाक धसद्धयंर्ो के अनुसयर दकर्य जयएगय।
16. धवद्यमयन सडकों को चौडय और सुिढृ़ करनय र्िय नई सडकों कय संधनमयाण । न्र्ूनीकरण की उपयर्ों के सयि, लयग ूधवधिर्ों धनर्मों और धवधनर्मों और उपलब्ि मयगाििाक धसद्धयंर्ो के अनुसयर दकर्य जयएगय।
17. पहयडी ढयलों और निी र् ों कय संरक्षण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
18. रयधत्र में र्यधनक र्यर्यर्यर् कय संचलन । लयगू धवधिर्ों के अिीन वयधणधज्र्क प्रर्ोजन के धलए धवधनर्धमर् होंग े।
19. थियनीर् समुियर्ों द्वयरय चलयई जय रही कृधि और बयगवयनी प्रियओं के सयि पिुपयलन, पिुपयलन कृधि, जल कृधि और मछली पयलन । थियनीर् लोगों के उपर्ोग के धलए लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
20. प्रयकृधर्क जल धनकयर्ों भू क्षेत्र में उपचयररर् अपधिष्ट जल/ बधहस्रयावों कय धनथसयरण । उपचयररर् अपधिष्ट जल/ बधहस्रयावों के धनथसयरण को जल धनकयर्ों में प्रवेि से बचयर्य जयएगय जल उपचयररर् अपधिष्ट जल के पुनचक्रण और पुन: उपर्ोग के धलए दकए जयने वयले प्रर्यस लयगू धवधिर्ों के अनुसयर उपचयररर् अपधिष्ट जल/ बधहस्रयाव कय धनथसयरण धवधनर्धमर् दकर्य जयएगय।
21. सर्ह और भूजल कय वयधणधज्र्क धन्किाण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
22. खुले कंुआ, बोर कंुआ, आदि के धलए कृधि और अन्र् उपर्ोग । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे और सम्बद्घ सुधनधश्चर् प्रयधिकयरी द्वयरय दक्रर्यकलयप मयनी री दकए जयएंगे।
23. ठोस अपधि् प्रबंिन। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
24. धवििेी प्रजयधर्र्ों को लयनय । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
25. पयररधथिधर्की-पर्ा न। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।

32. कु ीर उद्योगों धजसके अंर्गार् ग्रयमीण कयरीगर आदि भी ह । सदक्र र् रूप से बढ़यवय दिर्य जयएगय ।
33. नवीकरणीर् ऊजया स्रोर् कय उपर्ोग । बयर्ोग,स, सौर रोिनी आदि को बढ़यवय दिर्य जयए।

39. सयमुियधर्क प्रकृधर् संरक्षण। पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर्, वन्र्जीव प्रभयग, रयष्ट्रीर् बयघ संरक्षण प्रयधिकरण और भयरर् के वन्र्जीव संथियन के सयि परयमिा में पररचयलनयत्मक रूपरेखय को अंधर्म रूप िनेे के बयि पयर्ल पररर्ोजनय के रूप में अनुज्ञयर् होगय ।
5. मयनी री सधमधर् .- कें द्रीर् सरकयर, पयररधथिधर्की संवेिी जोन के प्रभयवी मयनी री के धलए एक मयनी री सधमधर् कय गठन करेगी जो धनम्नधलधखर् से धमलकर बनेगी, अियार्:्- (क) कलेक् र, नयगपुर – अध्र्क्ष;
(ख) पर्यावरण के क्षेत्र में कयर्ा करन ेवयले ग,र सरकयरी संगठनों (धजसके अंर्गार् धवरयसर् संरक्षण भी ह,) कय प्रत्र्ेक मयमले में र्ीन विा की अवधि के धलए महयरयष्ट्र रयज्र् सरकयर द्वयरय नयमधनर्िाष्ट एक प्रधर्धनधि – सिथर्;
(ग) क्षेत्रीर् अधिकयरी, महयरयष्ट्र रयज्र् प्रििूण धनर्ंत्रण बोडा – सिथर्;
(घ) क्षेत्र कय ज्रे्ष्ठ नगर र्ोजनयकयर – सिथर्;
(ङ) रयजथव धवभयग, महयरयष्ट्र सरकयर कय प्रधर्धनधि – सिथर्;
(च) ससंचयई धवभयग, महयरयष्ट्र सरकयर कय प्रधर्धनधि -सिथर् ;
(छ) लोक धनमयाण धवभयग, महयरयष्ट्र सरकयर कय प्रधर्धनधि – सिथर्;

6. धनिेि धनबिंन.- (1) मयनी री सधमधर् कय कयर्ाकयल इस अधिसूचनय के प्रकयिन की र्यरीख से र्ीन विा की अवधि के धलए होगय। II (ii) 9
(2) मयनी री सधमधर् इस अधिसूचनय के उपबंिों के अनुपयलन को मयनी र करेगी।
(3) पयररधथिधर्की संवेिी जोन में भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ.

(4) इस अधिसूचनय के सयरणी के प,रय 4 के अिीन र्िय धवधनर्िाष्ट प्रधर्धिद्ध दक्रर्यकलयपों के धसवयर्, भयरर् सरकयर के र्त् कयलीन पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् की अधिसूचनय संख्र्यंक कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अधिसूचनय के अनुसूची के अिीन ऐसे दक्रर्यकलयपों, धजन्हें सधम्मधलर् नहीं दकर्य गर्य ह,, परंर् ु पयररधथिधर्की संवेिी जोन में आर् े ह , ऐसे दक्रर्यकलयपों की वयथर्धवक धवधनर्िाष्ट थिलीर् िियओं पर आियररर् मयनी री सधमधर् द्वयरय संवीक्षय की जयएगी और उसे संबद्ध धवधनर्यमक प्रयधिकरणों को धनर्िाष्ट दकर्य जयएगय ।
(5) मयनी री सधमधर् कय सिथर्-सधचव र्य संबंधिर् कलक् र र्य संबंधिर् उद्ययन के उप-वन संरक्षक, कोई व्यधि जो इस अधिसूचनय के दकसी उपबंि कय उल्लंघन करर्य ह,, उसके धवरुद्ध पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 19 के अिीन पररवयि फयइल करने के धलए सक्षम होगय ।
(6) मयनी री सधमधर् मुद्दों के आियर पर अपेक्षयओं पर धनभार रहर् ेहुए संबद्ध धवभयगों के प्रधर्धनधिर्ों र्य धविेिज्ञों, औद्योधगक संगमों र्य संबद्ध पणियररर्ों के प्रधर्धनधि प्रधर् मदेु्द की अपेक्षयओं के अनुसयर धवचयर-धवमिा में सहयर्र्य के धलए आमंधत्रर् कर सकेगी ।
(7) मयनी री सधमधर् प्रत्र्ेक विा की 31 मयचा र्क की रयज्र् के मुख्र् वन्र्जीव वयडान को अपनी वयर्िाक कयरावयई ररपो ा उपयबिं V पर उपयबद्ध प्रयरूप पर 30 जून र्क प्रथर्रु् करेगी ।

8. महत् र्य कय कोई अन् र् धविर् । [फय. सं. 25/205/2015-ईएसजेड/आरई] लधलर् कपूर, व,ज्ञयधनक ‘जी’ MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 13 th September , 2017 S.O. 3029(E).—WHEREAS, a draft notification, for notifying Eco-sensitive Zone around Pench National Park and the Mansinghdeo Wildlife Sanctuary in the State of Maharashtra, was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 1150 (E), dated the 17 March, 2016, inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 17 March, 2016;
AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
II (ii) 15 AND WHEREAS, the Central Government considers the Pench National Park and the Mansinghdeo Wildlife Sanctuary (hereinafter referred to as the Park and Sanctuary) are located in Nagpur District in the State of Maharashtra between North 21° 39′ 36.53′′ to 21° 27′ 13.53′′ latitude and between East 79° 09′
01.78′′ to 79° 13′ 09.13′′ longitude and are spread over an area of 442.29 square kilometres;
AND WHEREAS, the Park and Sanctuary are located on the junction of the two States, viz., Maharashtra and Madhya Pradesh on the southern fringes of Satpuda hills and Ambagarh hills;
AND WHEREAS, the aforesaid Park comprises the core or critical tiger habitat of Pench Tiger Reserve as notified vide notification of the State Government of Maharashtra number WLP. 10-07/C.R.297/ F-1, dated the 27th December, 2007;
AND WHEREAS, the Park and Sanctuary is home to 33 species of mammals, 170 species of birds, 33 species of fish, 7 species of amphibians, 49 species of reptiles, and a wide variety of insect life and the birds include both resident and migratory birds like Little cormorant (Phalacrocorax niger), Brahminy kite(Haliasture indus), Indian white backed vulture(Gyps benghalensis), Indian pitta (Pitta brachyuran), Grey-headed fishing eagle (Ichyophaga iethyaetus), Openbilled stork (Amastomus oscitan), etc, and the area also supports important wildlife such as Tiger (Panthera tigris), Leopard (Panthera pardus), Jungle Cat (Felis chaus), Nilgai (Boselaphus tragocamelus), Sambhar (Cervus unicolor), Chital (Axis axis), Barking Deer (Mantiacus muntjak), Wild Pig (Sus scrofa), Sloth Bear (Melursus ursinus), Common Langur (Presbytis entellus), Wild dog (Canis alpinus), Jackal (Canis aureus), etc.;
AND WHEREAS, the aforesaid area has very high floral diversity and the flora of this area is represented by Southern Tropical Dry Deciduous Forests and the vegetation of the area has Teak (Tectona grandis) as predominant species with common associates such as Ain (Terminalia tomentosa), Beheda (Terminalia bellerica), Jarul (Lagerstroema parviflora), Dhawada (Anogeisus latifolia), etc.;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the Park and Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries, or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0.12 to 9.5 kilometres from the boundary of Pench National Park and Mansinghdeo Wildlife Sanctuary in the State of Maharashtra as the Pench National Park and Mansinghdeo Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco- sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is spread over an area of 419.40 square kilometres with an extent varying from 0.12 to 9.5 kilometres from the boundary of the Pench National Park and Mansinghdeo Wildlife Sanctuary in the State of Maharashtra except the portion sharing the inter-State boundary with Madhya Pradesh and Zero extent is mentioned towards the boundary adjoining the State of Madhya Pradesh and the boundary description of the said Zone is given in Annexure-I.
(2) The Eco sensitive Zone is spread across 63 villages in Nagpur district of Maharashtra.
(3) The map of the Eco sensitive Zone along with latitude and longitude is appended as Annexure-II.
(4) The Geo-coordinates of protected area as well as the Eco-sensitive Zone along with latitude and longitude is appended as Annexure-III-A and Annexure-III-B.
(5) The list of the villages falling within the Eco-sensitive Zone along with co-ordinates of the prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.

(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal ;
(x) Panchayati Raj ; and
(xi) Public Works Department.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development and livelihood security of local communities.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities :
Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of the local residents, and for activity such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in the Table to paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) All new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be permitted within one kilometer from the boundary of the Pench National Park and Mansinghdeo Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometer from the boundary of the Pench National Park and Mansinghdeo Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within the Eco-sensitive Zone.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation within six months from the date of publication of this notification in the Official Gazatte and such plan shall from part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared within six months from the date of publication of this notification in the Official Gazatte and such plan shall from part of the Zonal Master Plan.

(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution ) Act, 1974 (6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal and management of solid wastes shall be as under:-
(i) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Ecosensitive Zone.
(10) Bio-medical waste.- Bio-medical waste management shall be as under:-
(i) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time;
(ii) no common treatment facility or incineration shall be permitted within the Eco- sensitive Zone.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Vehicular pollution.- Prevention and control of vehicular pollution in the Eco-sensitive Zone shall be carried out in accordance with the applicable laws and effort shall be made for use of cleaner fuel for example CNG, etc.
(13) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(14) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(15) E-waste- The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(16) Industrial units.- (i) No new polluting industries shall be permitted to be set up within the Ecosensitive Zone.
(ii) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in the this notification.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. Prohibited, regulated and promoted activities.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under, and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) New mining (minor and major minerals), stone quarrying and crushing units shall be prohibited except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs.
UOI in W.P.(C) No.435 of 2012.
2. Setting up of industries causing pollution (water,air, soil, noise, etc.).
(a) No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
(b) Only non-polluting industries shall be permitted within Ecosensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in the this notification.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of solid waste disposal site and common incineration facility for solid and bio-medical waste.
No new solid waste disposal site and waste treatment or processing facility of solid waste shall be permitted within Eco-sensitive Zone and installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment, hospitals, etc. shall be prohibited.
7. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
8. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
9. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:

Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
10. Construction activities. (a) No new commercial construction of any kind shall be permitted within 250 meters from the boundary of the Pench National Park and Mansingdeo Wildlife Sanctuary in the State of Maharashtra:
Provided that only 5% of the area can be constructed:
Provided further that local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3.
(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
11. Small scale non-polluting industries.
Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority.
12. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.
13. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
14. Erection of electrical and communication towers and lying of cables and other infrastructures.
Regulated under applicable law (underground cabling may be promoted).
15. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulations and available guidelines.
16. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulations and available guidelines.
17. Protection of hill slopes and river banks.

18. Movement of vehicular traffic at night.
Regulated for commercial purpose under applicable laws.
19. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
20. Discharge of treated waste water or effluents in natural water bodies or land area.
The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water and the discharge of treated waste water or effluents shall be regulated as per applicable laws.
21. Commercial extraction of surface and ground water.
Regulated under applicable laws.
22. Open well, bore wells, etc. for agriculture or other usage.
Regulated under applicable laws and the activity shall be monitored by the concerned appropriate authority.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco sensitive Zone, which shall comprise of the following, namely;
(a) Collector, Nagpur - Chairman;
(b) a representative of Non-governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Maharashtra for a term of three year in each case – Member;
(c) Regional Officer, Maharashtra State Pollution Control Board – Member;
(d) Senior Town Planner of the area - Member;
(e) a representative of the Department of Revenue, Government of Maharashtra – Member;
(f) a representative of the Department of Irrigation, Government of Maharashtra – Member;
(g) a representative of the Public Works Department, Government of Maharashtra – Member;
(h) a representative of Chief Conservator of Forests and Field Director, Pench Tiger Project, Nagpur – Member;
(i) one expert in the area of ecology and environment from reputed Institution or University of the State to be nominated by the Government of Maharashtra for a term of three year in each case - Member;
(j) Deputy Conservator of Forests (T), Nagpur Division –Member Secretary.
23. Solid waste management. Regulated under applicable laws.
24. Introduction of exotic species. Regulated under applicable laws.
25. Eco-tourism. Regulated under applicable laws.
26. Use of polythene bags. Use of polythene bags within the Eco-sensitive Zone shall be permitted based on specific requirement, and it shall be regulated under applicable laws.
27. Commercial sign boards and hoardings.
Regulated under applicable laws.
28. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

30. Organic farming. Shall be actively promoted.
31. Adoption of green technology for all activities.

33. Use of renewable energy and fuels. Bio gas, solar light, etc. shall be actively promoted.
34. Agro-forestry. Shall be actively promoted.
35. Use of eco-friendly transport. Shall be actively promoted.
36. Skill development. Shall be actively promoted.
37. Restoration of degraded land/ forests/ habitat.
Shall be actively promoted.
38. Environmental awareness. Shall be actively promoted.
39. Community Nature Conservancy. Shall be permitted as pilot project after finalising the operational modalities in consultation with Ministry of Environment Forest & Climate Change, Wildlife division, National Tiger Conservation Authority and Wildlife Institute of India.

6. Terms of reference.- (1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wild Life Warden of the State Government under intimation the Ministry of Environment, Forest and Climate Change as per proforma appended at Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the the High Court or National Green Tribunal.
