1. पा�रि�थितक पा�रि�थितकपा�रि�थितक पा�रि�थितक सवेंदी सवेंदीसवेंदी सवेंदी जोन जोनजोन जोन का काका का िव�तार िव�तारिव�तार िव�तार और औरऔर और उसक� उसक�उसक� उसक� सीमाएं सीमाएंसीमाएं सीमाएं.— (1) पा�रिJथितक संवेदी जोन 143.12 वग� �कलोमीटर के =े म0 फैला Gआ ह ैऔर िजसका िवJ तार मलाई महादेKरा वE यजीव अभयारL य क! सीमा के इद� िगद� 0.45 �कलोमीटर से 4.20 �कलोमीटर के बीच ह ैऔर ऐसे जोन क! सीमाy के :यौरे सिहत उपाबंध उपाबंधउपाबंध उपाबंध I के 2प म0 संलz ह ै। मलाई महादKेरा वE यजीव अभयारL य के पा�रिJथितक संवेदी जोन के चमराजनगर िजले के कोलेगल तालकु म0 8 राजJव eाम और 18 संलz eाम आते ह।̀ कावेरी वEयजीव अभयारLय और बीआरटी बाघ आरि=ती के पा�रिJथितक संवेदी जोन क! मलाई महादKेरा वE यजीव अभयारL य के िनकट eाम5 अित3ािF ह,ै जो �क मलाई महादKेरा वE यजीव अभयारL य के पा�रिJथितक संवेदी जोन म0 सि�मिलत नहA ह।ै मलाई महादKेरा वE यजीव अभयारL य के पा�रिJथितक संवेदी जोन के अEतग�त आरि=त वन नहA ह।ै
(2) अ=ांश और दशेांतर के साथ पा�रिJथितक संवेदी जोन क! सीमा का मानिच उपाबंध उपाबंधउपाबंध उपाबंध II के 2प म0 सलंz ह ै।
(3) मलाई महादKेरा वE यजीव अभयारL य क! सीमा और पा�रिJथितक संवेदी जोन क! सीमा पर मु{ य dबंदyु के भ ू िनद|शांक उपाबंध उपाबंधउपाबंध उपाबंध III के 2प म0 संलz ह ै।

2. .. . पा�रि�थितक पा�रि�थितकपा�रि�थितक पा�रि�थितक संवेदी संवेदीसंवेदी संवेदी जोन जोनजोन जोन के केके के िलए िलएिलए िलए आंचिलक आंचिलकआंचिलक आंचिलक महायोजना महायोजनामहायोजना महायोजना. .. .—(1) राIय सरकार, पा�रिJ थितक संवेदी जोन के 1योजन के िलए राजप म0 इस अिधसूचना के 1काशन क! तारीख से दो वष� क! अविध के भीतर, Jथानीय 3ि4य5 के परामश� से और इस अिधसूचना म0 �दए गए अनुबंध5 का पालन करते Gए राIय सरकार म0 स=म 1ािधकारी के अनुमोदन के िलए आंचिलक महायोजना तैयार करेगी ।
(2) पा�रिJ थितक संवेदी जोन के िलए आचिंलक महायोजना राIय सरकार .ारा इस अिधसूचना म0 यथािविनpद�} ट रीित म0 और ससंुगत क0 nीय और राI य िविधय5 और क0 nीय सरकार .ारा जारी माग�िनद|श5 िसfांत5, य�द कोई हो, के अनु2प तैयार क! जाएगी।
(3) आंचिलक महायोजना, पया�वरणीय और पा�रिJथितक बात5 को समाकिलत करने के िलए राI य सरकार के सभी संबf िवभाग5 के परामश� से तैयार होगी, अथा�त्:—
(i) पया�वरण;
(ii) वन और वEयजीव;
(iii) कृिष और बागबानी ;
(iv) राजJ व;
(v) शहरी िवकास;
(vi) पय�टन सिहत पा�रिJथितक पय�टन;
(vii) eामीण िवकास;
(viii) dसंचाई और बाढ़ िनयं ण;
(ix) नगरपािलक और शहरी िवकास;
(x) पंचायती राज;
(xi) लोक िन मा�ण िव भाग।
(4) आंचिलक महायोजना अनुमो�दत िवrमान भ-ूउपयोग, अवसंरचना और ��याकलाप5 पर कोई िनब�धन तब तक अिधरोिपत नहA करेगी जब तक �क इस अिधसूचना म0 िविनpद�} ट न हो और आचंिलक महायोजना सभी अवसंरचना और ��याकलाप5 म0 और अिधक द=ता और पा�रिJथितक अनुकूलता का संवध�न करेगी ।
(5) आंचिलक महायोजना म0 अनाWछा�दत =े 5 के जीण�fार, िवrमान जल िनकाय5 के संर=ण, आवाह =े 5 के 1बंधन, जल-सभंर5 =े ो के 1बंधन, भूतल जल के 1बंधन, मृदा और नमी संर=ण, Jथानीय समुदाय5 क! आवtयकताy तथा पा�रिJथितक और पया�वरण स ेसंबंिधत ऐसे अEय पहलुy, िजन पर �यान दनेा आवtयक ह,ै के िलए उपबंध ह5गे ।
(6) आंचिलक महायोजना सभी िवrमान पूजा J थल5, eाम5 और नगरीय बंदोबJत5, वन5 के 1कार और �कJ म5, कृिष =े 5, ऊपजाऊ भिूम, ह�रत =े जैसे उrान और उसी 1कार के J थान, उrान कृिष =े , फलोउrान, झील5 और अEय जल िनकाय5 का अ�यकंन करेगी और योजना को िवrमान और 1Jतािवत भूिम उपयोग क! िवशेषताy के :यौरे दतेे Gए मानिच .ारा सम�थ�त �कया जाएगा ।
(7) आंचिलक महायोजना पा�रिJथितक संवेदी जोन म0 िवकास को िविनयिमत करेगी और सारणी म0 सूचीबf 1ितिषf और िविनयिमत काय�कलाप5 का पालन करेगी तथा J थानीय समदुाय5 के पा�रिJथितक! अनुकूल िवकास के िलए जीवकोपाज�न को सुरि=त करने को सुिनि\त �कया जा सकेगा।
(8) आंचिलक महायोजना =े ीय िवकास योजना के साथ सह-िवJतारी होगी ।
(9) आंचिलक महायोजना इस अिधसूचना म0 �दए गए उपबंध5 के संबंध म0 अपने काय� करने के िलए िनगरानी सिमित के िलए एक संदभ� दJतावेज तैयार करेगी ।
3. रा�य रा�यरा�य रा�य सरकार सरकारसरकार सरकार �ारा �ारा�ारा �ारा �कए �कए�कए �कए जाने जानेजाने जाने वाले वालेवाले वाले उपाय उपायउपाय उपाय. .. .—राIय सरकार, इस अिधसूचना के उपबंध5 को 1भावी करने के िलए िनvिलिखत उपाय करेगी, अथा�त्:— 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(1) भू भभूू भू- -- -उपयोग उपयोग उपयोग उपयोग – –– – (क) पा�रिJ थितक संवेदी जोन म0 वन5, उrान-कृिष =े 5, कृिष =े 5, आमोद-1मोद के 1योजन के िलए िचिEहत �कए गए पाकs और खुल ेJथान5 का वािणिIयक और औrोिगक संबf िवकास ��याकलाप5 के िलए उपयोग या संप�रवत�न नहA होगा।: (ख) परंतु पा�रिJथितक संवेदी जोन के भीतर भाग (क) म0 िविनpद�q 1योजन स ेिभ� 1योजन के िलए कृिष और अEय भिूम का संप�रवत�न मानीटरी सिमित क! िसफा�रश पर और यथा लागू =े ीय नगर योजना अिधिनयम तथा केEnीय/राIय सरकार के अEय िनयम5 तथा िविनयम5 के अधीन स=म 1ािधकारी के पूव� अनुमोदन से, तथा इस अिधसूचना के उपबंध5 .ारा Jथानीय िनवािसय5 क! िनvिलिखत आवासीय ज2रत5 को पूरा करने के िलए अनु�ात �कया जाएगा, जैसे:—
(i) िवrमान सड़क5 को चौड़ा करना और उEह0 सुदढृ करना तथा नई सड़क5 का संिनमा�ण;
(ii) बुिनयादी ढांच5 और नाग�रक सुिवधाy का संिनमा�ण और नवीकरण;
(iii) 1दषूण उCप� न करने वाले लघु उrोग;
(iv) कुटीर उrोग5 िजसके अंतग�त eामीण कारीगर भी ह;̀ सुिवधाजनक भLडार और गृह वास सिहत Jथानीय सुख सुिवधाy म0 सहायक पा�रिJथितक पय�टन म0; और
(v) संव�ध�त ��याकलाप पैरा 4 के अधीन �दया गया ह:ै (ग) परंतु यह और �क �कसी जनजातीय भिूम का उपयोग राIय सरकार के संबf =े ीय नगर योजना अिधिनयम और अEय िनयम5 तथा िविनयम5 के अधीन स=म 1ािधकारी के पूव� अनुमोदन तथा सिंवधान के अनुWछेद 244 1वृD िविध के उपबंध5 के अनुपालन के िबना, या तCसमय 1वृD िविध िजसके अंतग�त अनुसूिचत जनजाित और अEय परंपरागत वन िनवासी (वन अिधकार5 क! माEयता) अिधिनयम, 2006 (2007 का 2) भी है, वािणिIयक या उrोग िवकास ��याकलाप5 के िलए जनजातीय भूिम का उपयोग अनु�ात नहA होगा: (घ) परंतु यह और भी �क पा�रिJ थितक संवेदी जोन के भीतर भ-ूअिभलेख5 म0 कोई ु�ट, िनगरानी सिमित के िवचार 1ाF करने के प\ात् राIय सरकार .ारा 1Cयेक मामले म0 एक बार ठीक क! जाएगी और उ4 ु�ट के ठीक �कए जाने क! सूचना क0 nीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं ालय को दी जाएगी । (ङ) परंतु यह भी �क उपयु�4 ु�ट को ठीक करना इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म0 भ-ू उपयोग का प�रवत�न सि�मिलत नहA होगा। (च) वनीकरण तथा वास जीण�fार ��याकलाप5 सिहत अन1युa त या अनुC पादक कृिष =े 5 म0 पनु: वनीकरण करने के 1यास �कए जाएंगे ।
(2) �ाकृितक जल िनकाय �ाकृितक जल िनकाय�ाकृितक जल िनकाय �ाकृितक जल िनकाय. .. .—आचंिलक महायोजना म0 सभी 1ाकृितक जल �ोत5/न�दय5/चनैल5 क! पहचान क! जाएगी और उनके सरं=ण और पुनB�भूतकरण के िलए योजना सि� मिलत होगी।
(3) पय�टन/पा�रि�थ पय�टन/पा�रि�थपय�टन/पा�रि�थ पय�टन/पा�रि�थितक पय�टन ितक पय�टनितक पय�टन ितक पय�टन. .. .—(क) पा�रिJथितक संवेदी जोन के भीतर सभी नए पा�रिJथितक पय�टन ��याकलाप या िवrमान पय�टन संबंधी ��याकलाप5 का िवJतार पा�रिJथितक संवेदी जोन के िलए पय�टन महायोजना के अनुसार ह5गे । (ख) पा�रिJथितक पय�टन महायोजना पय�टन िवभाग, .ारा राIय सरकार के पया�वरण और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के 2प म0 होगी । (घ) पा�रिJथितक पय�टन संबंधी ��याकलाप िन� निलिखत के अधीन िविनयिमत ह5गे, अथा�त् :—
(i) वEयजीव अभयारLय क! सीमा से एक �कलोमीटर के भीतर या पा�रिJथितक संवेदी जोन के िवJतार तक, जो भी िनकट हो, �कसी होटल या �रसोट� का नया संि�मा�ण अनु�ात नहA �कया जाएगा । तथािप, वEयजीव अभयारLय क! सीमा से एक �कलोमीटर क! दरूी से परे पा�रिJथितक संवेदी जोन के िवJतार तक नए होटल5 और �रसोटs क! Jथापना पय�टन महायोजना के अनुसार पा�रिJथितक पय�टन सुिवधाy के िलए पूव� सीमा�ंकत और पदािभिहत =े 5 म0 ही अनु�ात क! जाएगी।
(ii) पा�रिJथितक संवेदी जोन के अEदर सभी नए पय�टन ��या-कलाप या िवrमान पय�टन ��याकलाप5 के िवJतार केEnीय सरकार, पया�वरण, वन और जलवायु प�रवत�न मं ालय .ारा जारी माग�दशO िसfांत5 तथा पा�रिJथितक पय�टन पर बल दतेे Gए रा�ीय बाघ संर=ण 1ािधकरण .ारा जारी पा�रिJथितक पय�टन माग�दशO िसfांत5 (समय-समय पर यथा संशोिधत) के अनुसार होगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(iii) जब तक आंचिलक महायोजना का अनमुोदन नहA कर �दया जाता ह ैजब तक पय�टन संबंधी िवकास तथा िवrमान पय�टन ��याकलाप5 का िवJतार मानीटरी सिमित के वाJतिवक Jथल िविनpद�q संवी=ा तथा िसफा�रश के आधार पर स�बंिधत िविनयामक 1ािधकारी .ारा अनु�ात �कया जाएगा और पा�रिJथितक संवेदी जोन =े के भीतर कोई नया होटल/�रसाट� या वािणिIयक Jथापन का संि�मा�ण अनु�ात नहA �कया जाएगा ।
(4) नैस!ग�क नैस!ग�कनैस!ग�क नैस!ग�क िवरासत िवरासतिवरासत िवरासत. .. .—पा�रिJथितक संवेदी जोन म0 महCवपूण� नैस�ग�क िवरासत के सभी Jथल5 जैसे सभी जीन कोश आरि=त =े , शैल िवरचनाएं, जल 1पात5, झरन5, घाटी मागs, उपवन5, गुफाएं, Jथल5, �मण, अKरोहण, 1पात5 आ�द क! पहचान क! जाएगी और िवरासत संर=ण योजना आंचिलक महायोजना के भाग के Bप म0 प�रर=ण और संर=ण के िलए तैयार क! जाएगी ।

14. वृO� क� कटाई । (क) रा�य सरकार म� सOम ,ािधकारी क� पूव% अनुमित के िबना वन, सरकारी या राज�व या िनजी भूिम पर या वन� म� hकंही वृO� क� कटाई नहA होगी । (ख) वृO� क� कटाई संबंिधत क� Bीय या रा�य अिधिनयम या उसके अधीन बनाए गए िनयम� के उपबंध के अनुसार िविनयिमत होगी ।
15. वन उ�पाद� और गैर काU ठ वन उ�पाद� का सं_हण (एनटीएफपी) । लागू िविधय� के अधीन िविनयिमत ह�गे ।
16. िव ुत और दरूसंचार टावर� का प3रिनमा%ण और केबल िबछाना और अ$य बुिनयादी ढांचे । लागू िविधय� के अधीन िविनयिमत ह�गे। भूिमगत केबल िबछाए जाने को बढ़ावा 1दया जाएगा।
17. नाग3रक सुख सुिवधा� सिहत बुिनयादी ढांचे। लागू िविधय�, िनयम� और िविनयम� तथा उपलjध माग%दशF िस.ांत� के अनुसार $यूनीकरण के उपाय� के साथ, 1कए जाएंगे ।

22. �थानीय समुदाय� Dारा चलाई जा रही कृिष और बागवानी ,था� के साथ साथ पशुपालन, पशुपालन कृिष और मछली पालन । �थानीय लोग� के उपयोग के िलए लागू िविधय� के अधीन िविनयिमत ह�गे ।

8. कोई अE य महC वपूण� िवषय । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 13th September, 2017 S.O. 3031(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification number S.O 1274 (E), dated 31st March, 2016 inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette were made available to the public on the dated 31 st March, 2016; AND WHEREAS, no objections and suggestions received from persons and stakeholders in response to the draft notification; AND WHEREAS, the Malai Mahadeshwara Wildlife Sanctuary was notified vide notification No: FEE 90 WL 2013 dated 07.05.2013 situated in Chamrajanagara district (HanurTaluk) of Karnataka State situated between the North Latitudes 11°44'54.29"N to 12° 9'32.51"N and the East Longitudes 77°15'28.54"E to 77°40'6.35"E is spread over an area of 906.187 square kilometers; AND WHEREAS, Malai Mahadeshwara Wildlife Sanctuary forms important part of the savannah woodland forests of Karnataka and also forms part of the Mysore Elephant Reserve declared by Project Elephant which supports good densities of Asian elephants depicting the ecological importance of the Sanctuary and recently tigers have also been documented in this Wildlife Sanctuary; AND WHEREAS, the western side of the Sanctuary is connected to Biligirirangaswamy Temple Tiger Reserve through a very narrow corridor, southern side is connected to Satyamangalam Tiger Reserve (1,411.6 square kilometres) and eastern part is connected to North Baragur Reserve Forest (451.5 square kilometres) both of which are in Tamil Nadu which forms a contiguous habitat for wide ranging species in over 3,000 square kilometres, one of the largest in the country where some of the large mammals are found which include tiger, leopard, wild dog, striped hyena, sloth bear, elephant, gaur, sambar, chital and fourhorned antelope, smooth coated-otter and marsh crocodile are two important riverine wildlife species and the sanctuary is also famous for the endangered fish Deccan Mahasheer, the River Paalar flows through the Sanctuary and forms the interstate boundary on the eastern side of the Sanctuary, and there are 19 enclosure villages inside the Sanctuary; AND WHEREAS, RET species of flora found in Malai Mahadeshwara Wildlife Sanctuary are Bilvapathre (Aeglemarmelos),Dindiga (Anogeissiuslatifolia), Muttuga (Buteamonosperma), Urugalu (CholeoxylonSwictenia), Beete (Dalbergialatifolia), Kamara (Hardiwiekeabinata), Honne(Pterocarpusmarsupium), Shrigandha (Santalum album), Sagade(Schleicheraoleosa), Matti (Terminaliatomentosa), Tare (Terminaliabellerica), Hale, Halgouri (Wrightiatinctoria), Jalari (Shorea)etc.; AND WHEREAS, RET species of mammals & reptiles found in Malai Mahadeshwara Wildlife Sanctuary are Indian wild dog or dhole (Cuon alpines), Golden jackal (Canisaureus), Striped hyaena (Hyaenahyaena), Sloth bear (Melursusursinus), Jungle cat (Felischaus), Rusty-spotted cat (Prionailurusrubiginosus), Smooth-coated otter (Lutrogaleperspicillata), Oriental small-clawed otter (Aonyxcinerea), Common otter (Lutralutra), Honey badger (Mellivoracapensis), Indian porcupine (Hystrixindica), Indian pangolin (Maniscrassicaudata), Small Indian civet (Viverriculaindica), Common palm civet (Paradoxurus hermaphrodites), Ruddy mangoose (Herpestessmithii), Stripe-necked Mongoose (Herpestesvitticolis), Grey mongoose (Herpestesedwardsii), Asian elephant (Elephasmaximus), Gaur (Bosgaurus), Sambar (Rusa unicolor), Chital (Axis axis), Four horned antelope (Tetracerusquadricornis), Blackbuck (Antilopecervicapra), Wild pig (Susscrofa), Indian muntjac (Muntiacusmuntjak), Indian Spotted chevrotain (Moschiolaindica), Southern plains gray langur (Semnopithecusdussumieri), Bonnet macaque (Macacaradiata), Black-naped hare (Lepusnigricollis), Grizzled giant squirrel (Ratufamacroura), Indian giant flying squirrel (Petauristaphilippensis), Madras tree shrew (Anathanaellioti), Marsh crocodile (Crocodyluspalustris), Indian monitor lizard (Varanusbengalensis), Deccan mahseer (Tor khudree), Indian fox (Vulpesbengalensis), Brown Mongoose (Herpestessp) etc.; AND WHEREAS, it is necessary to conserve and protect the geographical area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Malai Mahadeshwara Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view, to conserve and protect the biodiversity and wildlife therein and its environment and to prohibit industries or 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] class of industries and their operations and processes in the said Eco-sensitive Zone to protect wildlife and their habitat therein or its environment; NOW THEREFORE, in exercise of the powers conferred by sub section (1) and clauses (v) and
(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0.45 Kilometer to 4.20 Kilometers around the boundary of MalaiMahadeshwara Wildlife Sanctuary in the State of Karnataka as the MalaiMahadeshwara Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
(1) Extent and Boundary of Eco-Sensitive Zone.- (1) The Eco-Sensitive Zone is spread over an area
143.12 square kilometres with an extent varying from 0.45 Kilometer to 4.20 Kilometers around the boundary of Malai Mahadeshwara Wildlife Sanctuary and the boundary details of such Zone are given in Annexure-I. The Eco-sensitive Zone of Malai Mahadeshwara Wildlife Sanctuary is spread in 08 revenue villages and 18 enclosure villages in Kollegal Taluka of Chamarajanagara District. The Eco-sensitive Zone of Cauvery Wildlife Sanctuary and BRT Tiger Reserve overlaps with the villages adjacent to Malai Mahadeshwara Wildlife Sanctuary, which have not been included in the ecosensitive zone of Malai Mahadeshwara Wildlife Sanctuary. There are no Reserve Forests within the Eco-sensitive Zone of Malai Mahadeshwara Wildlife Sanctuary.
(2) The map of Eco-sensitive Zone boundary with latitudes longitudes is appended as Annexure -II.
(3) The Geo Coordinates of major points on the boundary of Malai Mahadeshwara Wildlife Sanctuary and on the boundary of Eco-sensitive Zone boundary is appended as Annexure-III.
(4) The list of 26 villages (Enclosure & Revenue villages) and the details of areas falling within the Ecosensitive Zone is given at Annexure-IV.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture and Horticulture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism including eco-tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal and urban development;
(x) Panchayati Raj;
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17 moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.—
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities.
(b) Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) Promoted activities and given under para 4.
(c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
(d) Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
(e) Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(f) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.- The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/ Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests. 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:—
(i) no new construction of hotels and resorts shall be allowed within 1 kilometre from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer. However, beyond the distance of 1 kilometre from the boundary of the Wildlife Sanctuary till the extent of the Ecosensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste.- Bio medical waste management shall be as under:
(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.
(b) safe and Environmentally Sound Management of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.- The protection of hill slopes shall be as under:
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:— TABLE S No Activity Description

1. Commercial Mining.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted. Only non-polluting industries shall be allowed within Ecosensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.
6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
8. Commercial use of fire wood. Prohibited (except as otherwise provided) as per applicable laws.
9. New wood based industry. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities
10. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies. Regulated as per applicable laws.
12. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution termed as per Classification done by Central Pollution Control ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 Board of February 2016;
(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stays; and
(v) promoted activities listed in this Notification.
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
13. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the competent Authority.
14. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
15. Collection of Forest produce or Non-Timber Forest Produce (NTFP). Regulated as per applicable laws.
16. Erection of electrical and communication towers and laying of cables and other infrastructures . Regulated under applicable law. Underground cabling may be promoted.
17. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
19. Under taking other activities related to tourism like over flying the ESZ area by hot air balloon, helicopter, drones, Microlites, etc. Regulated as per applicable laws.
20. Protection of Hill Slopes and river banks. Regulated as per applicable laws.
21. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
22. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per applicable laws for use of locals. 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
5. Monitoring Committee.—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:—
(i) Regional Commissioner, Mysuru -Chairman;
(ii) Hon’ble Member of Legislative Assembly, Hanur Constituency, Chamarajanagar District -Member;
(iii) Representative of the Department of Environment, Government of Karnataka -Member;
(iv) Representative of the Department of Urban Development, Government of Karnataka -Member;
(v) Representative of Non-governmental Organizations working in the field of natural conservation (including heritage conservation) to be nominated by the Ministry of Environment and Forests, Government of India -Member;
23. Discharge of treated waste water/effluents in natural water bodies or land area. The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
24. Commercial extraction of surface and ground water. Regulated as per applicable laws.
25. Open Well, Bore Well etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority.
26. Solid Waste Management/Biomedical Waste Management. Regulated as per applicable laws.
27. Introduction of Exotic species. Regulated as per applicable laws.
28. Eco-tourism. Regulated as per applicable laws.
29. Use of polythene bags. Regulated as per applicable laws.

(vi) The Regional Officer, Karnataka State Pollution Control Board, Mysuru -Member;
(vii) One expert in Ecology from reputed Institution or University of the State of Karnataka to be nominated by the Ministry of Environment and Forests, Government of India -Member;
(viii) Deputy Commissioner or his representative, Chamarajanagar -Member;
(ix) Biodiversity Expert -Member;
(x) The Deputy Conservator of Forests, Malai Mahadeswara Wildlife Sanctuary, Kollegala -Member Secretary.
Note: Subject to the State Government of Karnataka obtaining relevant approvals inter alia including permission from the Speaker of Legislative Assembly, Karnataka, if required
6. Terms of Reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Committee shall be three years or till the constitution of the new committee by the state Govt.
(3) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30 th June of that year to the Chief Wildlife Warden of the State as per proforma appended at Annexure-V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F. No. 25/162/2015-ESZ] LALIT KAPUR, Scientist ’G’ 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ANNEXURE – I Boundary Description of Eco-sensitive Zone of Malai Mahadeswara Wildlife Sanctuary Most of the village areas in the fringes (outside) the Malai Mahadeshwara Wildlife Sanctuary which are supposed to be included in the eco-sensitive zone of the Malai Mahadeshwara Wildlife Sanctuary are already included with in the eco-sensitive zone boundary limits of B.R.T Wildlife Sanctuary on the eastern part and by the Cauvery Wildlife Sanctuary on the northern part (some portion) & the remaining northern portion of the Malai Mahadeshwara Wildlife Sanctuary is contiguous with the Cauvery Wildlife Sanctuary. The southern portion of the entire Malai Mahadeshwara Wildlife Sanctuary forms interstate boundary between Karnataka & Tamil Nadu States. Hence, the Tamil nadu Forests Department authorities has been requested to maintain eco-sensitive zone as per the Ministry of Environment of Forests, New Delhi directions/guidelines vide letter no. FN 1-9/2007 WL I(Pt) dated: 09.02.2011.Further, all enclosures within the three Reserved Forests namely, M.M.Hills Reserve Forest, Edayarahalli Reserve Forest and Hanur Reseved Forest forming MalaiMahadeshwara Wildlife Sanctuary are included as eco-sensitive zone to maintain the ecological integrity of the Sanctuary. The revenue areas included with in the eco-sensitive zone of Malai Mahadeshwara Wildlife Sanctuary are divided into two parts namely PART-I and PART-II as these two parts are separated at the northern portion of Hanur Reserved Forest as the part of eco-sensitive zone of Cauvery Wildlife Sanctuary is overlapping/coinciding with the boundary of Malai Mahadeshwara Wildlife Sanctuary on the northern part of Hanur Reserve Forest. South: The boundary point starts at a point on the eastern portion of Hanur Reserve Forest with co-ordinates N 12°02’ 49” E 77° 17’ 16” and runs westwards all along the southern boundary of Hanur village through the outer boundary of Sy. Nos. 355, 175, 176, 147, 150, 198, 200, 201, 14, 204, 203, 205, 221, 168, 222, 234 & 235 till it reaches bi-junction point of Sy. Nos. 235 & 167 of Hanur & Belathur villages respectively on the common village boundary with co-ordinates N 12° 02’ 58” E 77° 15’ 51”. West: From the above co-ordinate the boundary runs in north-east direction all along the Lokkanahalli- Hanur Major District road leading to Hanur town till it reaches the tri-junction point of Belathur, Hanur & Uddanur villages. From this point the line runs along same road further in north-east direction through Hanur village till it reaches point with co-ordinates N 12° 04’ 50” E 77° 18’ 02”. From this point the line continues to run along the same road leading to Kaudalli in north-east direction till it reaches tri-junction point of Sy. Nos. 496 & 412 of Hanur village and Sy.No.213 of Doddamaridevarayasamundra village on the common village boundary of Hanur & Doddamaridevarayasamundra villages. Then the line runs northwards for some distance and then passes along the northern portion of Hanur village along the inter village boundary westwards till reaches a point on the stream with co-ordinates N 12° 05’ 58” E 77° 19’ 16”. North: Then the line runs along the stream on the common village boundary of Doddamaridevarayasamundra, Bathuguppa & Chengarahalli villages till it reaches a point with co-ordinates N 12° 06’ 22” E 77° 20’ 27”. Then the line descends southwards along the Eco-sensitive zone boundary of Cauvery Wildlife Sanctuary to reach the north-eastern most tip of Hanur Reserved Forest. North and East: The point starts at a point on the boundary of Hanur Reserve Forest with co-ordinates N 12° 03’ 09” E 77° 20’ 30” and then continues in south-east direction all along the Hanur-Ramapuram road till it reaches a point on common village boundary of Ajjipuram & Ramapuram villages with co-ordinates N 12° 00’ 38” E 77° 22’ 46”. Then the line continues along the north-east direction along the common village boundary of Ajjipuram & Ramapuram till it reaches a tri-junction point of Ajjipuram, Ramapuram & Chengarahalli villages. Then the line descends in south-east direction along the common village boundary of Ramapuram & Chengarahalli villages till it reaches a point with co-ordinates N 12° 00’ 43” E 77° 24’ 05”. Further, the boundary line continues to run along the common village boundary of Ramapuram & Chengarahalli villages till it reaches the north-eastern most tip of Chengarahalli & Ramapuram villages on Edayarahalli Reserve Forest boundary with co-ordinates N 12° 00’ 28” E 77° 25’ 28”.
