(3) ऐसे जोन के जीपीएस िनदgशांक सीमा के साथ उपाबंध-II पर है।
(4) पा रि+थितक संवेदी जोन का मानिच1 सीमा िववरण अ�ांश व देशा�तर के साथ उपाबंध-III पर उपाब? ह|ै 2 22

(1) राcय सरकार, पा रि+ थितक संवेदी जोन के �योजन& के िलए राजप1 म; इस अिधसूचना के अंितम �काशन क� तारीख से दो वष� क� अविध के भीतर, +थानीय :ि%य& के परामश� से, और इस अिधसूचना म; �दए गए अनुबंध& का पालन करते )ए आंचिलक महायोजना तैयार करेगी।
(2) आंचिलक महायोजना का अनुमोदन राcय सरकार म; स�म �ािधकारी "ारा �कया जाएगा|
(3) पा रि+थितक�य संवेदी जोन के िलए आंचिलक महायोजना राcय सरकार "ारा ऐसी रीित जैसा इस अिधसूचना म; िविन@द= ह ै और सुसंगत के��ीय और राcय िविधय& तथा के��ीय सरकार "ारा जारी माग�दश�क िस?ांत&, य�द कोई हो, के अनु�प भी तैयार क� जाएगी|
(4) आंचिलक महायोजना सभी संब? राcय िव भाग& के साथ परामश� से पया�वरणीय और पा रि+थितक�य िवचारण& को उसम; एक�कृत करने के िलए तैयार क� जाएगी, अथा�त्:
(i) पया�वरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पय�टन ;
(v) नगरपािलक ;
(vi) राज+ व ;
(vii) कृिष ;
(viii) िहमाचल �दशे राc य �दषूण िनयं1ण बोड�,
(ix) kसचाई
(x) लोक िनमा�ण िवभाग
(5) आंचिलक महायोजना अनुमो�दत िव`मान भू-उपयोग, अवसंरचनाI मक और �aयाकलाप& पर कोई िनबlधन अिधरोिपत नहm करेगी जब तक �क इस अिधसूचना म; इस �कार िविन@द= न हो और आंचिलक महायोजना सभी अवसंरचना और काय�कलाप& म; द�ता और पा र ि+ थ ितक�य अनुकूलता का संव?�न करेगी।
(6) आंचिलक महायोजना म; अनाoछा�दत �े1& के जीणq?ार, िव`मान जल िनकाय& के संर�ण, आवाह �े1& के �बंधन, जल-संभर& के �बंधन, भूतल जल के �बंधन, मृदा और नमी संर�ण, +थानीय समुदाय& क� आव8यकता\ तथा पा रि+थितक� और पया�वरण से संबंिधत ऐसे अ�य पहलु\, िजन पर rयान दनेा आव8यक ह,ै के िलए उपबंध ह&गे। ¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(7) आंचिलक महायोजना सभी िव`मान पूजा + थल&, Zाम& और नगरीय बंदोब+त&, वन& के �कार और �क+ म&, कृिष �े1&, ऊपजाऊ भूिम, ह रत �े1 जैसे उ`ान और उसी �कार के + थान, उ`ान कृिष �े1, आ@कड&, झील& और अ�य जल िनकाय& का अt यंकन करेगी।
(8) आंचिलक महायोजना पा रि+थितक संवेदी जोन म; िवकास को िविनयिमत करेगी िजससे �क + थानीय समुदाय& के पा रि+थितक�ज�य िवकास और जीिवका को सुिनि8 चत �कया जा सके ।
3. रा�य रा�यरा�य रा�य सरकार सरकारसरकार सरकार �ारा �ारा�ारा �ारा �कए �कए�कए �कए जाने जानेजाने जाने वाले वालेवाले वाले उपाय उपायउपाय उपाय-- ---- -- राcय सरकार इस अिधसूचना के उपबंध& को �भावी करने के िलए िन�िलिखत उपाय करेगी, अथा�त् :-
(1) भू भूभू भू- -- -उपयोग उपयोग उपयोग उपयोग - -- - पा रि+ थितक संवेदी जोन म; वन&, उ`ान-कृिष �े1&, कृिष �े1&, आमोद-�मोद के �योजन के िलए िचि�हत �कए गए पाकu और खुले +थान& का वािणिcयक और औ`ोिगक संब? िवकास �aयाकलाप& के िलए उपयोग या संप रवत�न नहm होगा : परंतु पा रि+थितक संवेदी जोन के भीतर कृिष भूिम का संप रवत�न के अधीन मानीटरी सिमित क� िसफा रश पर और राcय सरकार के पूव� अनुमोदन से, +थानीय िनवािसय& क� आवासीय ज�रत& को पूरा करने के िलए और पैरा 4 क� सारणी के +तंभ (2) के अधीन �म �म �म �म सं. सं.सं. सं. 10, 21, 35, 36, और 37 म; सूचीब? �aयाकलाप& को पूरा करने के िलए अनुwात ह&गे, अथा�त् :-
(ii) पय�टक& के अ+थायी अिधभोग हतुे पा रि+थितक अनुकूल पय�टन �aयाकलाप& के िलए त�बू, काx गृह आ�द जैसे पा रि+थितक अनुकूल कुटीर ;
(ii) िव`मान सड़क& को चौड़ा और सुदढ़ृ करना और नई सड़क& का सि{मा�ण
(iii) �दषूण उIप{ न करने वाले लघु उ`ोग;
(iv) वषा� जल संचय, और
(v) कुटीर उ`ोग, िजसके अंतग�त Zामीण उ`ोग, सुिवधा भंडार और +थानीय सुिवधाएं सि�मिलत ह5 | परंतु यह और �क राcय सरकार के पूव� अनुमोदन और संिव धान के अनुo छेद 244 तथा तIसमय �वृ# िविध के उपबंध& के अनुपालन के िबना, िजसके अंतग�त अनुसूिचत जनजाित और अ�य परंपरागत वन िनवासी (वन अिधकार& क� मा�यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिcयक या उ`ोग िवकास �aयाकलाप& के िलए जनजातीय भूिम का उपयोग अनुwात नहm होगा : परंतु यह और भी �क पा रि+ थितक संवेदी जोन के भीतर भू-अिभलेख& म; उपसंजात कोई 1ु ट मानीटरी सिमित के िवचार �ा7 करने के प|ात ्राcय सरकार "ारा �Iयेक मामले म; एक बार संशोिधत होगी और उ% 1ु ट के संशोधन क� भारत सरकार के पया�वरण, वन और जलवायु प रवत�न मं1ालय को सूचना दनेी होगी। परंतु यह और भी �क उपयु�% 1ु ट का संशोधन म; इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म; भू-उपयोग का प रवत�न सि�मिलत नहm होगा। परंतु यह और भी �क िजससे ह रत �े1 म; जैसे वन �े1, कृिष �े1 आ�द म; कोई पा रणािमक कटौती नहm होगी और अन�युT त या अनुIपादक कृिष �े1& म; पुन: वनीकरण करने के �यास �कए जाएंगे।
(2) �ाकृितक !ोत �ाकृितक !ोत �ाकृितक !ोत �ाकृितक !ोत – –– – सभी �ाकृितक }ोत& के आवाह �े1 क� पहचान क� जाएगी और उनके संर�ण और पुनन�वीकरण के िलए योजना\ को आंचिलक महायोजना म; सि�मिलत �कया जाएगा तथा राcय सरकार "ारा ऐसी रीित मे माग�दश�क िस?ांत तैयार �कए जाएंगे िजससे �क इन �े1& म; या इनके समीप िवकास �aयाकलाप& को रोका जा सके जो ऐसे �े1& के िलए हािनकारक ह5|
(3) पय�टन पय�टन पय�टन पय�टन – –– – (क) पा रि+थितक संवेदी जोन के भीतर पय�टन संबंधी �aयाकलाप, जो आंचिलक महायोजना का भाग �प म; िन�िलिखत �प म; ह&गे। (ख) पय�टन महायोजना, पय�टन िवभाग "ारा वन और पया�वरण िवभाग, राcय सरकार के परामश� से तैयार होगी। (ग) पय�टन संबंधी �aयाकलाप िन� निलिखत के अधीन िविनयिमत ह&गे, अथा�त् :-
(i) पा रि+थितक संवेदी जोन के भीतर सभी नए पय�टन �aयाकलाप& या िव`मान पय�टन �aयाकलाप& का िव+तार रा_ ~ीय � या� संर�ण �ािधकरण, पया�वरण, वन और जलवायु प रवत�न मं1ालय "ारा जारी (समय-समय पर यथा संशोिधत) माग�िनदशे& के अनुसार होगा िजसम; पा रि+थितक पय�टन, पा रि+थितक िश�ा और पा रि+थितक िवकास को महIव �दया जाएगा ; 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(ii) प&ग डमै लेक व�यजीव अभयारDय क� सीमा से एक �कलोमीटर के भीतर नए होटल& और िव�ाम+थल& के नए सि{मा�ण क� अनुwा पा रि+थितक अनुकूल पय�टन �aयाकलाप& से संबंिधत पय�टक& के अ+थायी अिधभोग के िलए आवास के िसवाए नहm दी जाएगी ; पर�तु पा रि+थितक संवेदी जोन के िव+तार तक संरि�त �े1& क� सीमा से एक �कलोमीटर क� दरूी से परे पय�टन महायोजना के अनुसार पा रि+थितक पय�टन सुिवधा\ के िलए पूव�-प रभािषत और अिभिहत �े1& म; ही नए होटल& और िव�ाम+थल& क� +थापना क� अनुwा दी जाएगी|
(iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक, पय�टन के िलए िवकास और िव`मान पय�टन �aयाकलाप& के िव+तार को वा+तिवक +थल िविन@द= संवी�ा तथा मानीटरी सिमित क� िसफा रश पर आधा रत संबंिधत िविनयामक �ािधका रय& "ारा अनुwात �कया होगा।
(4) नैस%ग नैस%गनैस%ग नैस%गक कक क िवरासत िवरासतिवरासत िवरासत -- ---- -- पा रि+थितक संवेदी जोन म; महIवपूण� नैस<गक िवरासत के सभी +थल& जैसे सभी जीन कोश आरि�त �े1, शैल िवरचनाएं, जल �पात&, झरन&, घाटी मागu, उपवन&, गुफाएं, +थल&, �मण, अ�रोहण, �पात& आ�द क� पहचान क� जाएगी और उ�ह; संरि�त �कया जाएगा तथा उनक� सुर�ा और संर�ा के िलए इस अिधसूचना के �काशन क� तारीख से छह मास के भीतर, उपयु% योजना बनाएगी और ऐसी योजना जोनल मा+टर Vलान का भाग होगा।
(5) मानव िन%मत िवरासत � थ मानव िन%मत िवरासत � थमानव िन%मत िवरासत � थ मानव िन%मत िवरासत � थल ल ल ल - -- - पा रि+ थितक संवेदी जोन म; भवन&, संरचना\, िश�प-त�य, ऐितहािसक, कलाIमक और सां+कृितक महIव के �े1& क� पहचान करनी होगी और इस अिधसूचना के �काशन क� तारीख से छह माह के भीतर उनके संर�ण क� योजनाएं तैयार करनी ह&गी तथा आंचिलक महायोजना म; सि�मिलत क� जाएगी।
(6) ' व ' व' व ' विन �दषूण िन �दषूणिन �दषूण िन �दषूण -- पा रि+थितक संवेदी जोन म; r विन �दषूण के िनयं1ण के िलए राc य सरकार का पया�वरण िवभाग वायु (�दषूण िनवारण और िनयं1ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम& के उपबंध& के अनुसरण म; माग�दश�क िस?ांत और िविनयम तैयार करेगा।
(7) वायु वायुवायु वायु �दषूण �दषूण�दषूण �दषूण -- पा रि+थितक संवेदी जोन म;, वायु �दषूण के िनयं1ण के िलए राcय सरकार या िहमाचल �दशे राcय �दषूण िनयं1ण बोड� का पया�वरण िवभाग वायु (�दषूण िनवारण और िनयं1ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम& के उपबंध& के अनुसरण म; माग�दश�क िस?ांत और िविनयम तैयार करेगा।
(8) बिह!ाव बिह!ावबिह!ाव बिह!ाव का काका का िन�सारण िन�सारणिन�सारण िन�सारण -- पा रि+थितक संवेदी जोन म; उपचा रत बिह}ाव का िन+सारण जल (�दषूण िनवारण तथा िनयं1ण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयम& के उपबंध& के अनुसार होगा।
(9) ठोस ठोसठोस ठोस अपिश/ अपिश/अपिश/ अपिश/ -- ---- -- ठोस अपिश=& का िनपटान िन�िलिखत �प म; होगा -
(i) पा रि+थितक संवेदी जोन म; ठोस अपिश=& का िनपटान भारत सरकार के तIकालीन पया�वरण और वन मं1ालय क� समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख 25 िसतंबर, 2000 नगरपािलक ठोस अपिश= (�बंध और हथालन) िनयम, 2000 के उपबंध& के अनुसार �कया जाएगा ;
(ii) +थानीय �ािधकरण जैव िन�ीकरणीय और अजैव िन�ीकरणीय संघटक& म; ठोस अपिश=& के संपृथ�न के िलए योजनाएं तैयार कर;गे ;
(iii) जैव िन�ीकरणीय सामZी को अिधमानतः खाद बनाकर या कृिम खेती के माrयम से पुनःच�aत �कया जाएगा ;
(iv) अकाब�िनक सामZी का िनपटान पा रि+थितक संवेदी जोन के बाहर पहचान �कए गए + थल पर �कसी पया�वरणीय +वीकृत रीित म; होगा और पा रि+थितक संवेदी जोन म; ठोस अपिश_ ट& को जलाना या भ_ मीकरण अनुwात नहm होगा।
(10) जैव िच�क2 सी जैव िच�क2 सीजैव िच�क2 सी जैव िच�क2 सीय अपिश3 ट य अपिश3 टय अपिश3 ट य अपिश3 ट- पा रि+थितक संवेदी जोन म; जैव िच�कIसीय अपिश=& का िनपटान भारत सरकार के तIकालीन "ारा पया�वरण और वन मं1ालय क� समय-समय पर यथासंशोिधत अिधसूचना सं.का.आ.630 (अ) तारीख 20 जुलाई, 1998 "ारा �कािशत जैव िच�कIसीय अपिश= (�बंध और हथालन) िनयम, 1998 के उपबंध& के अनुसार �कया जाएगा।

11. सि{मा�ण �aयाकलाप (क) संरि�त �े1 क� सीमा से एक �कलोमीटर के भीतर �कसी भी �कार के नए वािणिcयक सि{मा�ण क� अनुwा नहm दी जाएगी| पर�तु +थानीय लोग& को पैरा 3 के उप पैरा (1) म; सूचीब? �aयाकलाप& सिहत अपने रहायशी उपयोग के िलए अपनी भूिम पर सि{मा�ण करने क� अनुwा दी जाएगी| (ख) पर�तु यह और �क �दषूण न का रत करने वाले लघु उ`ोग& से संबंिधत सि{मा�ण �aयाकलाप& को िविनयिमत �कया जाएगा और लागू िनयम& और िविनयम&, य�द कोई ह5, के अनुसार स�म �ािधकारी से पूव� अनुwा के साथ �यूनतम तक रखा जाएगा| (ग) पा रि+थितक संवेदी के जोन क� सीमा से एक �कलोमीटर के आगे वा+तिवक +थानीय आव8यकता\ के िलए सि{मा�ण क� अनुwा दी जाएगी और अ�य सि{मा�ण �aयाकलाप& का िविनयमन आंचिलक महायोजना के अनुसार �कया जाएगा|

14. वायु और यानीय �दषूण लागू िविधय& के अधीन िविनयिमत ह&गे।

16. भू-जल उIकष�ण लागू िविधय& के अधीन िविनयिमत ह&गे।
17. वृ�& क� कटाई (क) राcय सरकार म; स�म �ािधकारी क� पूव� अनुमित के िबना वन, सरकारी या राज+व या िनजी भूिम पर या वन& म; �कही वृ�& क� कटाई नहm होगी। (ख) वृ�& क� कटाई संबंिधत के�ीय या राcय अिधिनयम या उसके अधीन बनाए गए िनयम& के उपबंध के अनुसार िविनयिमत होगी। (ग) आरि�त वन& और संरि�त वन& क� दशा म; काय� योजना अनुदशे& का पालन �कया जाएगा|

22. होटल& और लॉज के िव`मान प रसर& म; बाङ लगाना लागू िविधय& के अधीन िविनयिमत ह&गे। व�यजीव के मु% संचरण को अनुwात करने के िलए, पा रि+थितक संवेदी जोन के भीतर होटल& या अ�य वािणिcयक �ित_ ठान& क� स� पि#य& को कंटीले तार& से नहm घेरा जायेगा और कोई घेरा 1 मीटर से ऊंचा नहm होगा| इस अनुबंध का पालन न करने वाले �कसी िव`मान घेरे को आंचिलक महायोजना म; िविन@द_ ट समय-सीमा के भीतर उपा�त रत �कया जाएगा|

8. कोई अ�य महIवपूण� मामला। MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 16th November, 2015 S.O.3099(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and subsection (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at: - esz-mef@nic.in. Draft Notification Whereas, the Pong Dam Lake Wildlife Sanctuary located in Kangra District, Himachal Pradesh and lying between latitude 31049’50” N to 32014’36” N and longitude 76053’31” E to 77017’53” E is spread over an area of 207.59 Square Kilometres. And whereas, the flora and fauna represent rich biological significance of this sanctuary. Birds: 230 species of the belonging to about 54 bird families out of 77 families of the birds recorded in India. Among the waterfowl’s main species are bar-headed geese, pintails, poachards, coots, grebes, cormorants and storks etc. Butterflies: Indian fritilary, striped tiger, orange oakleaf, yellow pansy, grey danid eggfly etc. Animals: nilgai, oorcupine, civets, mongoose, leopard etc. And whereas, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification surrounding the protected area of Pong Dam Lake Wildlife Sanctuary as Eco-sensitive zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone. Now therefore, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent upto 1.5 kilo metre around the boundary of Pong Dam Lake Wildlife Sanctuary in the State of Himachal Pradesh as the Pong ¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 13 Dam Lake Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone shall be of 46.31 Square Kilometre with an varying extent upto 1.5 km around the boundary of Pong Dam Lake Wildlife Sanctuary.
(2) The list of villages falling in Eco-sensitive Zone are given at Annexure-I.
(3) The Global Positioning System co-ordinates of points along the boundary of such zone are given at Annexure-II.
(4) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-III.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall for the purpose of the Ecosensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Himachal Pradesh State Pollution Control Board;
(ix) Irrigation;
(x) Public Works Department; for integrating environment and ecological consideration into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 10,21,35,36 and 37 in column (2) of the Table in paragraph 4, namely:- 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities,
(ii) widening and strengthening of existing roads and construction of new roads.
(iii) small scale industries not causing pollution,
(iv) rainwater harvesting, and
(v) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Pong Dam Lake Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Ecofriendly tourism activities:
Provided that beyond the distance of one kilometre from the boundary of the protected Areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for Eco-tourism facilities as per tourism Master Plan;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Himachal Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in ¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 15 accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government or Himachal Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25 th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units
(a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Ecosensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Remarks

1. Commercial Mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units are prohibited except for the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal use.
(b) The mining operations shall strictly be in accordance with the orders of the Hon’ble Supreme Court dated
04.08.2006 in the matter of T.N. Godavarman 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and order of the Hon’ble Supreme Court dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
4. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.
5. Establishment of new major thermal and hydro-electric projects Prohibited (except as otherwise provided) as per applicable laws.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
7. Use of plastic bags Prohibited (except as otherwise provided) as per applicable laws.
8. Undertaking activities related to tourism like over-flying the national park area by aircraft, hot-air balloons. Prohibited (except as otherwise provided) as per applicable laws.
9. Discharge of untreated effluents and solid waste in natural water bodies or land area Prohibited (except as otherwise provided) as per applicable laws. Regulated Activities
10. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities. However, beyond one kilometer and upto the extent of the Eco-sensitive Zone all new tourism activities or expansion of existing activities would be in conformity with the Tourism Master Plan
11. Construction activities. a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the Protected Area:
Provided that local people shall be permitted to undertake construction in land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
(b) the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum with the prior permission from the Competent Authority as per applicable rules and regulations, if any.
(c) Beyond one kilometer upto the extent of Eco-Sensitive Zone construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per Zonal Master Plan.
12. Trenching ground. Establishing of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws.
13. Discharge of treated effluents and solid waste in natural water bodies or land area. Recycling of treated effluents shall be encouraged and for disposal of sludge or solid wastes, the existing regulation shall be followed.
14. Air and Vehicular Pollution. Regulated under applicable laws.
15. Noise pollution. Regulated under applicable laws.
16. Extraction of ground water. Regulated under applicable laws.
17. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government;
(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts ¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 17
5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:- a) Deputy Commissioner, Kangra - Chairman b) An expert in the field of ecology and environment - Member to be nominated by the Government of Himachal Pradesh for a term of one year in each case. and the rules made thereunder.
(c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed.
18. Migratory graziers. Regulated under applicable laws and as per Zonal Master Plan.
19. Existing establishments. Regulated under applicable laws
20. Insulation of electric lines. Promote underground cabling. All existing electric lines passing through the Eco-sensitive Zone shall be adequately insulated in the time frame prescribed under the Zonal Master Plan.
21. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
22. Fencing of existing premises of hotels and lodges. Regulated under applicable laws. In order to allow free movement of wildlife, hotels or other commercial establishments within the Eco-sensitive Zone shall not fence their properties with barbed wire and no fence shall be higher than 1 meter. Any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan.
23. Public Rights. Regulated under applicable laws.
24. Collection of small fodder. Regulated under applicable laws.
25. All the ways and existing roads. Regulated under applicable laws.
26. Drastic change of Agriculture system. Regulated under applicable laws.
27. Commercial use of natural water resource including ground water Harvesting. Regulated under applicable laws.
28. Movement of vehicular traffic at night. Regulated under applicable laws.
29. Introduction of exotic species. Regulated under applicable laws.
30. Commercial sign boards and hoardings. Regulated under applicable laws.
31. Protection of hill slopes and river banks. No construction activity unless otherwise permitted by under the Zonal Master Plan shall be undertaken on the hill with slopes more than 1 to 10 and also upto 100 meters from the banks of any river, and natural nallah. Promoted Activities
32. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Shall be actively promoted
33. Organic farming. Shall be actively promoted.
34. Adoption of green technology for all activities. Shall be actively promoted.
35. Cottage industries including village artisans. Shall be actively promoted.
36. Rain water harvesting. Shall be actively promoted.
37. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Eco-sensitive Zone which do not cause any adverse impact on environment, shall be permitted.
38. Use of renewable energy sources. (2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector or the concerned park incharge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wildlife Warden of the State as per proforma given in Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
