PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2377] ubZ fnYyh] 'kqØokj] flrEcj 30] 2016@vkf'ou 8] 1938 No. 2377] NEW DELHI, FRIDAY, SEPTEMBER 30, 2016/ASVINA 8, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 28 िसत᭥ बर, 2016 का.आ. 3100(अ).—भारत सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का. आ. 1512 (अ) तारीख 9 जून, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उसस ेᮧभािवत होन ेकᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितया,ं िजसमᱶ यह अिधसचूना अंतᳶव᳥ ह,ै उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सᭃुाव आमिंᮢत करते ᱟए एक ᮧाᱨप अिधसूचना ᮧकािशत कᳱ गई थᱭ ; और, उᲦ ᮧाᱨप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ स ेᮧा᳙ आᭃेपᲂ और सुᭃावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक ᱨप स ेिवचार ᳰकया गया; ᳲभडवास व᭠ यजीव अभयार᭛य हᳯरयाणा रा᭔ य के रेवाड़ी िजल े कᳱ सीमा पर (पि᳟म ᳰद᭨ली स े लगभग 80 ᳰकलोमीटर) लगभग 412 हे टेयर मᱶ अवि᭭थत ह ैतथा जो शीत ऋतु के मासᲂ मᱶ बड़ी संया मᱶ और 250 जाितयᲂ स े संबंिधत लगभग 35,000 अᮧवासी पिᭃयᲂ को आकृ᳥ करता ह ैतथा राज᭭थान के भरतपुर रा᳦ीय उ᳒ान कᳱ जल सम᭭याᲐ को, यह अभयार᭛य अᮧवासी जल िचिड़यᲂ को अनुक᭨पी शीत ऋतु का ᳯठकाना दतेा ह,ै इसिलए यह उसके मह᭜व को बढ़ाता ह;ै और, ᳲभडवास व᭠यजीव अभयार᭛य पिᭃयᲂ-जंतु समूह अथाᭅत ्ओᳯरय᭛टल मधमुखी, काली चील, लाल िसर िग, िशकारा, िचᱫीदार बड़ा बाज, बूटेड फुदकᳱ, कलगी (भात पᭃी), ᮕेलेग बᱫख, सुखᭅ बᱫख, ᭭पाट-िविबलीड बᱫख, िवशालकाय फोरीजीनस बᱫख, बड़ा बगुलर, पीला िबटन, लाल-वाटेलीड छोटा कुᱫा, िचᱫीदार सारस, उलली गदᭅन वाला चमरचᱶच, पᱶटेड ᭭टॉकᭅ , वू᭨ली नेड ᭭टॉकᭅ , ᮕे ᮩे᭭टेड िᮧिनया, ला᳴फग बᱫख, पीले परै वाला हरा कबूतर, लाल गदᭅन वाला बाज, छोटा ᮧᱶटीकोल, पील ेपाद वाला गुल, सफेद वागटेल, नीला थोरोट, िचतकबरा बुशेट, ᳲसह गौरैया, काला ᱶᮨ कोिलन, लाल ज᭠तमु मुदा बुलबुल, काले पंख वाला ि᭭ट᭨ट, Ჽनूिलन, ᳡ेत उ᭨लू, ओᳯरय᭛टल ᭪हाइट आई के िलए मह᭜वपूणᭅ ह ैऔर ᭄ात ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, ᳲभडवास व᭠यजीव अभयार᭛य अपने वन᭭पित अथाᭅत ् – एᮓोस कैलमस, एिलयन सीपा, कैरम कॉपᳯटकम, नीरम ओडरम, रीयो वोि᭨फया सपᲃटाइन, अमरफोफोलस कै᭥पानु᭨टस, इिल᭡टा अ᭨बा, ओरेसजाइलम इंडीकम, कैि᳖बास सेटिवया, डायᱧᮧास िमलानोजाइलम, कैिसफ ᳰफ᭭टुला, डालबᳶजया िससको, मᱶथा ᭭पसेाटा, ᭭टाइकोनास मसवोिनवा, माटᱮनीया एनुआ, ᳰफकस लोमीराटा, िपनस खसवगᱮ, साइबोयोगान माटᱮनक, साइᮝस मिेडका, एलो बाखेडिेनज, ᳲजजर आफᳱिनकल, ᮝबुलस टीरेि᭭ᮝस आᳰद के िलए मह᭜वपूणᭅ ह;ै और, ᳲभडवास व᭠ यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसचूना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सरुिᭃत और सरंिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ का ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह ै; अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) के साथ पᳯठत और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत े ᱟए, हᳯरयाणा रा᭔ य मᱶ ᳲभडवास व᭠ यजीव अभयार᭛य कᳱ सीमा से 100 मीटर तक िव᭭ तृत ᭃेᮢ को ᳲभडवास व᭠ यजीव अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसिूचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:--
1. पाᳯरि᭭थितक सवेंदी जोन का िव᭭तार और उसकᳱ सीमाए-ं-(1) पाᳯरि᭭थितक संवेदी जोन 119 हे टेयर के ᭃेᮢ मᱶ समािव᭬ ट, ᳲभडवास व᭠ यजीव अभयार᭛य के सरंिᭃत ᭃेᮢ कᳱ सीमा से 100 मीटर तक िव᭭ तृत होगा ।
(2) पाᳯरि᭭थितक संवेदी जोन पूवᭅ (उपाबंध I मानिचᮢ के िब᭠ द ुसं. 11) कᳱ ओर 280 31'35.471'' उᱫर अᭃांश और 760 34'0.906'' पूवᭅ दशेा᭠तर ; पि᳟म (उपाबंध I मानिचᮢ के िब᭠ द ुसं. 1) कᳱ ओर 28032'35.294'' उ᭜ तर अᭃाशं तथा 760 31'54.658'' पूवᭅ दशेा᭠तर ; उᱫर (उपाबंध I मानिचᮢ के िब᭠ द ुस.ं 17) कᳱ ओर 280 32'45.969'' उᱫर अᭃांश और 76032'54.878'' पूवᭅ दशेा᭠तर और दिᭃण (उपाबंध I मानिचᮢ के िब᭠ द ुसं. 9) कᳱ ओर 28031'12.445'' उᱫर अᭃाशं तथा 76033'42.089'' पूवᭅ देशा᭠तर स ेिघरा ᱟआ ह ै।
(3) अᭃांश और दशेा᭠तर के साथ पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का मानिचᮢ मᱶ उपाबधं I के ᱨप मᱶ उपाब है ।
(4) पाᳯरि᭭थितक संवेदी जोन का िनदᱷशाकं उनके अᭃांश और दशेातंर सिहत उपाबधं II के ᱨप मᱶ उपाब ह ै।
(5) पाᳯरि᭭थितक संवेदी जोन के भीतर आने वाले साजापुर, कनवा, िनवादा, रेडुआप, चांदवन, िवलोचपुरा, कोयलपरु और सरुखपुर ᮕामᲂ के ᭃेᮢ या भाग हᱹ ।
2. पाᳯरि᭭थितक सवंदेी जोन के िलए आचंिलक महायोजना –(1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख स ेदो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ स,े इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य स ेआंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित स े रा᭔ य सरकार तथा ससुंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश का िसांत, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना, इसमᱶ पयाᭅवरणीय और पाᳯरि᭭ थितक िवचारᲂ को समᳰेकत करने के िलए संब रा᭔ य सरकार के िवभागᲂ के िन᭥ निलिखत सभी परामशᭅ स ेतैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पयᭅटन ;

(vi) राज᭭ व ;
(vii) कृिष ; और
(viii) हᳯरयाणा रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ।
(5) आंचिलक महायोजना अनमुोᳰदत िव᳒मान भ-ूउपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार स े िविन᳸द᭬ ट न हो और आचंिलक महायोजना मᱶ सभी अवसंरचना के िवकास तथा ᳰᮓयाकलापᲂ को और अिधक दᭃ और पाᳯरि᭭ थितक अनुकूल ᱨप मᱶ ᮓमगिणत हᲂगे ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-सभंरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मदृा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐस ेअ᭠य पहलᲐू, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान उपासना ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलो᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(8) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान े वाल े उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन े के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा : परंत ुपाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भिूम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनमुोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन ेके िलए और पैरा 4 कᳱ सारणी के ᭭तंभ
(2) के अधीन मद स.ं 27, स.ं 37, और स.ं 42 के सामन ेसूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत ्:-
(i) ᮧदषूण उ᭜प᳖ न करन ेवाल ेलघु उ᳒ोग;
(ii) वषाᭅ जल संचय; और
(iii) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग भी ह ᱹ: परंत ुयह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसिूचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा : परंत ुयह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भ-ूअिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करन ेके प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामल ेमᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय को सूचना दनेी होगी : परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भ-ूउपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा : परंत ुयह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएंगे । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(2) ᮧाकृितक जल ᮲ोत -- आचिंलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके सरंᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करन ेके िलए ऐसी रीित स ेमागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो पयᭅटन महायोजना का भाग ᱨप मᱶ िन᳜िलिखत हᲂगे । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, हᳯरयाणा सरकार ᳇ारा राज᭭ व और वन िवभाग, हᳯरयाणा सरकार के परामशᭅ स े तैयार होगी । (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤ सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसातंᲂ के ᳇ारा तथा रा᭬ ᮝीय व् याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनसुार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और सैरगाहᲂ के नए सिंनमाᭅण अनु᭄ात नहᱭ हᲂगे ।
(iii) आंचिलक महायोजना का अनमुोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाए,ं जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख स ेछह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनसुरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनसुरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, जल (ᮧदषूण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनसुार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय सघंटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम स े पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।
(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना िज.एस. आर 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधया ंआवास के अनकूुल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होन ेऔर रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनमुोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनसुार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
4. पाᳯरि᭭थितक सवेंदी जोन मᱶ ᮧितिष और िविनयिमत ᳰकए जान ेवाल ेᳰᮓयाकलापᲂ कᳱ सचूी - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत ्:-- सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
(1) वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़न ेकᳱ इकाइया ं। (क) सभी ᮧकार के खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइया ं वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेल ूआव᭫यकताᲐ के िसवाय ᮧितिष हᲂगी ; (ख) माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गोᳲवदरामन िथᱧमूलपाद बनाम भारत सरकार के मामल े मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामल ेमᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के कठोर अनसुरण का ᮧचालन होगा ।
(2) आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अन᭄ुात नहᱭ होगा ।
(3) जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करन े वाल े उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदषूण काᳯरत करने वाले का िव᭭ तार अन᭄ुात नहᱭ होगा ।
(4) ᳰकसी पᳯरसकंटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(5) जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(6) होटल और सैरगाह का वािणि᭔यक ᭭थापन । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(7) ᭡ लाि᭭ टक के थैलᲂ का उपयोग । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(8) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(9) म᭟ यम धन᭜ व के फाइबर बोडᭅ, पा᳷टकल बोडᭅ, इकाईया ं और संयंᮢ कᳱ ᭭ थापना । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(10) ट भᲵᲂ कᳱ ᭭ थापना । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(11) वािणि᭔ यक हिैलका᭡ टर सेवा। लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(12) मोबाइल टावरᲂ का सं᭭ थापन। लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । िविनयिमत ᳰᮓयाकलाप
(13) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भिूम पर या वनᲂ मᱶ वृᭃᲂ कᳱ कोई कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
(14) पयᭅटन स े संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा अभयार᭛य ᭃेᮢ के ऊपर स ेउड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(15) होटलᲂ और ᳯरसोटᲄ कᳱ वािणि᭔यक ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी ᳞वसाय के िलए आवास के संबंध मᱶ संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर या पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक, जो भी िनकट हो, के भीतर ही नए वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को अनु᭄ात ᳰकया जाएगा अ᭠यथा नहᱭ : पर᭠त ुव᭠यजीव अभयार᭛य कᳱ सीमा स ेएक ᳰकलोमीटर से परे और पाᳯरि᭭थितक सवेंदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनᱨुप होगा ।
(16) संिनमाᭅण ᳰᮓयाकलाप A (क) सरंिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो कᳱ सीमा स ेएक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक सिंनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा: परंत ु ᭭ थानीय लोगᲂ को पैरा 3 के उप-पैरा (1) मᱶ सचूीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भिूम मᱶ संिनमाᭅण करने कᳱ अनमुित दी जाएगी : पर᭠तु यह और ᳰक ऐस ेलघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते हᱹ, स े संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनसुार सᭃम ᮧािधकारी कᳱ पूवᭅ अनमुित स ेही ᭠ यूनतम पर ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 रखे जाएंगे । (ख) इसके अितᳯरᲦ पाᳯरि᭭थितक संवेदी जोन से परे, सदभािवक ᭭ थानीय आव᭫ यकताᲐ के िलए सिंनमाᭅण कᳱ अनु᭄ा दी जाएगी और अ᭠ य वािणि᭔ यक संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे।
(17) कृिष ᮧणािलयᲂ मᱶ आमूल पᳯरवतᭅन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(18) वािणि᭔यक जल संसाधन िजसके अंतगᭅत भ-ूजल संचयन भी ह ै। (क) भिूम के अिधभोगी के वा᭭तिवक कृिष और घरेल ूखपत के िलए जल का िन᭬कषᭅण (सतही और भिूमगत जल) अनु᭄ात होगा । (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भिूमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपिेᭃत होगी िजसके अंतगᭅत ᳰकतन ेपᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह ै। (ग) सतही या भजूल का िवᮓय अनु᭄ात नहᱭ होगा । (घ) ᳰकसी ᮲ोत जल, िजसके अतंगᭅत कृिष भी ह,ै के संदषूण या ᮧदषूण को रोकन ेके िलए सभी उपाय ᳰकए जाएंगे ।
(19) िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण । भिूमगत केबलᲂ को ᮧो᭜ साहन दनेा ।
(20) होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(21) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण । उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लागू अनसुार हᲂगे ।
(22) रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
(23) िवदशेी ᮧजाितयᲂ को लाना लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(24) वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(25) वायु और यािनक ᮧदषूण लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(26) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(27) ᮧदषूण उ᭜प᳖ न करन े वाल े लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन स ेगैर ᮧदषूण, गैर पᳯरसकंटमय, लघु और सेवा उ᳒ोग, कृिष, पु᭬ प कृिष, कृिष उ᳒ान या कृिष आधाᳯरत उ᳒ोग, जो दशेीय माल स े औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन करते ह ᱹऔर जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालत ेह,ᱹ को अन᭄ुात ᳰकया जाएगा ।
(28) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
(29) वन उ᭜पादᲂ और गैर का᳧ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(30) सुरᭃा बलᲂ के कᱹप। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(31) नदी तलᲂ से प᭜ थरᲂ, बजरी, और बाल ूकᳱ िनकासी । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(32) 33 ᳰकलोवाट स े ऊपर के संचरण लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और िवतरण ᮧणाली को िबछाना ।
(33) नए का᭬ ठ आधाᳯरत उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना अनु᭄ात नहᱭ होगी : परंत ुपाᳯरि᭭ थितकᳱय संवेदी जोन मᱶ 100 ᮧितशत आयाितत का᭬ ठ ᭭ टाक उपभोग करने वाल ेनए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना कᳱ जा सकेगी ।
(34) पाᳯरि᭭थितक-पयᭅटन ᳰᮓयाकलाप । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(35) ठोस अपिश᳥ ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । सवंᳶधत ᳰᮓयाकलाप
(36) ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(37) वषाᭅ जल संचयन । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाए ।
(38) जैिवक खेती । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाए ।
(39) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाए ।
(40) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(41) वान᭭ पितक बाड़ । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(42) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह।ᱹ सᳰᮓ य ᱨप स ेबढावा ᳰदया जाए ।
(43) कृिष वािनकᳱ, कृिष संचालन िजसके अंतगᭅत बागवानी, उ᳒ान कृिष और फलᲂ उ᳒ान भी ह ᱹ। लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(44) समुदाय ᮧकृित भंडार। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(45) पयाᭅवरणीय जागᱨकता । सᳰᮓ य ᱨप स ेबढावा ᳰदया जाएगा ।
5. पाᳯरि᭭थितक सवंदेी जोन मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत स ेिमलकर बनेगी, अथाᭅत ्:- (क) उपायु त, झ᭔झर - अ᭟यᭃ ; (ख) अितᳯर त उपायु त, झ᭔झर – सद᭭ य ; (ग) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करन ेवाल ेगैर सरकारी संगठनᲂ (िजसके अतंगᭅत िवरासत सरंᭃण भी ह)ै का तीन वषᭅ कᳱ अविध के िलए हᳯरयाणा रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध - सद᭭य ; (घ) हᳯरयाणा सरकार ᳇ारा रा᭔य के ᳰकसी ᮧिति᳧त सं᭭था या िव᳡िव᳒ालय का नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ का तीन वषᭅ कᳱ अविध के िलए िवशेष᭄ - सद᭭य ; (ङ) ᮧादिेशक अिधकारी, हᳯरयाणा रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ - सद᭭य ; (च) िजला नगर िनयोजक, झ᭔झर - सद᭭य ; (छ) हᳯरयाणा सरकार ᳇ारा नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ का एक िवशेष᭄ - सद᭭य ; (ज) ᮧभागीय व᭠ यजीव अिधकारी, रोहतक - सद᭭य ; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 (झ) रा᭔य जैव-िविवधता बोडᭅ का सद᭭य -सद᭭य; (ञ) उप व᭠ य संरᭃक (ᭃेᮢीय), झ᭔झर – सद᭭य-सिचव । िनदᱷश - िनबधंन :
(2) मानीटरी सिमित का कायᭅकाल तीन (3) वषᭅ का होगा।
(3) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(4) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनसुूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आन े वाल े ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(5) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयाकं का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐस े ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंत ु पाᳯरि᭭थितक संवेदी जोन मᱶ आत े ह,ᱹ ऐस े ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(6) मानीटरी सिमित का सद᭭य-सिचव या संब उपायु त, ऐस े᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन े के िलए सᭃम होगा ।
(7) मानीटरी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहत े ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमिंᮢत कर सकेगी ।
(8) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय जीव वाडᭅन उपाबधं III मᱶ उपबंिधत ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।
(9) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपन े कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदशे दे सकेगा, जो वह ठीक समझ े।
6. इस अिधसूचना के उपबंधᲂ को ᮧभाव दनेे के िलए कᱶ ᮤीय सरकार और रा᭔ य सरकार अितᳯर त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकᱶ गे ।

8. कोई अ᭠ य मह᭜ वपणूᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 28 th September, 2016 S.O. 3100(E).—Whereas, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 1512(E), dated the 9th June, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; And whereas, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government; WHEREAS, the Bhindawas Wildlife Sanctuary is situated in the state of Haryana which is about412 hectares, (approximate 80 kilometers from West of Delhi) attracts a large number and variety of migratory birds, around 35,000 belonging to over 250 species in winter months and with water problem at Bharatpur National Park of Rajasthan, this sanctuary provides an alternate wintering site to the migratory water fowls; hence it’s enhanced importance; AND WHEREAS, BhindawasWildlife Sanctuary is important and known for its Avi-fauna i.e. Oriental honey buzzard, Black kite, Red headed vulture, Shikra, Greater spotted eagle, Booted warbler, crested lark, Graylag goose, Ruddy Shelduck, Spot-wbilled Duck, Ferruginous Pochard, Great ergret, yellow bitten, Red-wattled lapwing, Painted stork, Woolly necked stork, Grey breasted Prinia, Laughing dove, Yello-footed green pigeon, Red-necked falcon, Small pratincole, Yellow legged gull, White wagtail, Blue throat, Pied buschat, Sind sparrow, Black Francolin, Red vented bulbul, Black winged stilt, Dunlin, Barn owl, Oriental white eye; And whereas, Bhindawas Wildlife Sanctuary is important for its flora i.e. Acorus calamus, Allium cepa,Carum copticum, Nerium odorum, Reauwolfia serpentine, Amarphophallus Campanulatus, Eclipta alba, Oroxylum indicum, Cannabis sativa, Diospyros melanoxylon, Cassia fistula, Dalbergia sissoo, Mentha spicata, Strychnos muxvomica, Martynia annua, Ficus glomerata, Pinus roxburghii, Cymbopogon martini, Citrus medica, Aloe barbadensis, Ginger officinale, Tribulus terrestris etc.; AND WHEREAS, it is necessary to conserve and protect the area,the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of the Bhindawas Wildlife Sanctuary as Eco- 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; Now therefore, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub- section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies upto 100 meters all around the BhindawasWildlife Sanctuary in the State of Haryana as the Bhindawas Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.-(1)The Eco-sensitive Zone is upto 100 meters all around the boundary of the protected area of Bhindawas Wildlife Sanctuary comprising an area of119 hectares approximately.
(2) The Eco-sensitive Zone is bounded by 28º31’35.471"N latitude and 76º34’0.906"E longitude towards east (point No.11 of Annexure I map); 28º32’35.294"N latitude and 76º31’54.658"E longitude towards west (point No.1 of Annexure I map); 28º32’45.969"N latitude and 76º32’54.878"E longitude towards north (point No.17 of Annexure I map) and 28º31’12.445"N latitude and 76º33’42.089"E longitude towards south (point No.9 of Annexure I map).
(3) The map of Eco-sensitive Zone boundary together with its latitude and longitude is appended as Annexure I.
(4) The coordinates of Eco-sensitive Zone and Wildlife Sanctuary with its latitude and longitude is appended as Annexure II .
(5) The villages whose area or parts thereof falling within the Eco-sensitive Zone are, Shahjapur, Kanwa, Niwada, Reduwas, Chadwana, Bilochpura, Koyalpur and Surakhpur.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared in consultation with by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments for integrating environmental and ecological considerations into it, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture; and
(viii) Haryana State Pollution Control Board, for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.-Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 27, 37 and 42 in column (2) of the Table in paragraph 4, namely:-
(i) Small scale industries not causing pollution;
(ii) Rainwater harvesting; and
(iii) Cottage industries including village artisans:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act,2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3)Tourism.- (a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Haryana in consultation with Department of Revenue and Forests, Government of Haryana.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of Environment , Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) New construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural Heritage.-All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(6) Noise pollution.-The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981)and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981)and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974)and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Ministry of Environment, Forest and Climate Change, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Act and the rules and regulations made thereunder.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.-All activities in the Ecosensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986)and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:- TABLE Sl. (a) All new and existing mining (minor and major minerals), stone quarrying and crushing units are prohibited except for the domestic needs of bona fide local residents.
(b) The mining operations shall strictly be in accordance with the orders of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting up of saw mills. No new and expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted.
4. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of new major hydroelectric projects. Prohibited (except as otherwise provided) as per applicable laws.

8. Discharge of untreated effluents and solid waste in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.
9. Setting-up of Medium Density Fiber/ Particle Board Units/ Plants. Prohibited (except as otherwise provided) as per applicable laws.
10. Setting-up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
11. Commercial helicopter services. Prohibited (except as otherwise provided) as per applicable laws.
12. Erection of mobile Tower. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities:
13. Felling of trees. (a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the relevant Central or State Act and the rules made there under.
14. Undertaking activities related to tourism like over-flying the sanctuary area by hot-air balloons, etc. Regulated under applicable laws.
15. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond one kilometer or up to the extent of the Ecosensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Tourism Master Plan.
16. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any.
(b) Beyond one kilometer upto the extent of Eco-sensitive Zone, construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per the Zonal Master Plan.
17. Drastic change of agriculture system. Regulated under applicable laws.
18. Commercial water resources including ground water harvesting.
(a)The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.
(b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority.
(c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
19. Erection of electrical cables and telecommunication towers. Promote underground cabling.
20. Fencing of existing premises of hotels and lodges. Regulated under applicable laws. 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
21. Widening and strengthening of existing roads and construction of new roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable
22. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
23. Introduction of exotic species. Regulated under applicable laws.
24. Commercial Sign boards and hoardings. Regulated under applicable laws.
25. Air and vehicular pollution. Regulated under applicable laws.
26. Protection of hill slopes and river banks. Regulated under applicable laws.
27. Small scale industries not causing pollution. Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco-sensitive Zone which do not cause any adverse impact on environment shall be permitted.
28. Discharge of treated effluents in natural water bodies or land area. Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
29. Collection of Forest produce or Non- Timber Forest Produce (NTFP). Regulated under applicable laws.
30. Security Forces Camp. Regulated under applicable laws.
31. Collection of boulders, gravel and sand from the river beds. Regulated under applicable laws.
32. Laying of transmission and distribution system above 33KV. Regulated under applicable laws.
33. New wood based industry. No establishment of new wood based industry shall be permitted within the units of Eco-sensitive Zone:
Provided that new wood based industry may be set up in the Ecosensitive Zone using 100% imported wood stock.
34. Eco-tourism. Regulated under applicable laws.
35. Solid Waste Management. Regulated under applicable laws.
36. Community Nature Reserve. Regulated under applicable laws. C. Promoted Activities:
37. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming and fisheries. Promoted under applicable laws.
38. Rain water harvesting. Shall be actively promoted.
39. Organic farming. Shall be actively promoted.
40. Adoption of green technology for all activities. Shall be actively promoted.
41. Use of renewable energy sources. Promoted under applicable laws.
42. Vegetative fencing. Promoted under applicable laws.
43. Cottage industries including village artisans, etc. Shall be actively promoted.
44. Agro Forestry, Agriculture operations including plantation, horticulture and orchards. Promoted under applicable laws.
45. Environmental Awareness. Shall be actively promoted.
5. Eco-sensitive Zone Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19
(a) Deputy Commissioner, Jhajjar - Chairman;
(b) Additional Deputy Commissioner, Jhajjar-Member;
(c) a representative of Non-governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Haryana for a term of three year – Member;
(d) one expert in the area of ecology and environment from any reputed Institution or University of the State to be nominated for a term of three year by the Government of Haryana -Member;
(e) Regional Officer, Haryana State Pollution Control Board-Member;
(f) District Town Planner, Jhajjar -Member;
(g) one expert in the area of ecology and environment to be nominated by the Government of Haryana - Member;
(h) Divisional Wildlife Officer, Rohtak – Member;
(i) Representative of State Bio Diversity Board–Member;
(j) Deputy Conservator of Forests (Territorial) Jahajjar –Member Secretary. Terms of Reference:
(2) The tenure of the Monitoring Committee is for three years.
(3) The Monitoring Committee shall monitor the compliance of the provisions of Notification.
(4) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(5) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(6) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s)shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(7) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(8) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State per pro forma appended at Annexure III .
(9) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F.
