S.0. 3104(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, published in the Gazette of India, Extraordinary, part II, section 3, sub section (ii) number S.0. 1533(E), dated the 14th September, 2006, the Central Government hereby makes the following amendment in the notification of the Government of India in the Ministry of Environment, Forest and Climate Change published in the Gazette of India, Extraordinary Part II, Section 3, Sub-section (ii), vide number S.0. 107(E), dated the 11" January, 2021, namely:- In the said notification, in paragraph 5, for serial number 1.and the entries relating thereto, the following shall be substituted, namely:- “(1.) Dr. Rakesh Kumar Flat 14, Vinod Villa CHS Ltd.

F-11013/30/2007-3TET.11 (1)) T FHIE AT, G afa (o [—=ve 3(ii)] STRA T ST 2 ST S MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 11th January, 2021 S.0. 107(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.0. 1533(E), dated the 14™ September, 2006 (hereinafter referred to as the said Gazette notification), and in supersession of the notification number S.0. 850(E) dated the 17" March, 2017 of the Government of India in the Ministry of Environment, Forest and Climate Change except as respects things done or omitted to be done before such supersession, the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Maharashtra (hereinafter referred to as the Authority, Maharashtra) comprising of following Members, namely:—

1. Shri Vijay Shantilal Nahata, IAS (Retired), Chairman;

2. The Chairman and Members of the Authority, Maharashtra shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.

3. The Authority, Maharashtra shall exercise such powers and follow such procedures as enumerated in the said Gazette notification.

4. The Authority, Maharashtra shall take its decision on the recommendations of the State level Expert Appraisal Committees (SEACs) constituted for the State of Maharashtra by this notification.

5. To assist the Authority, Maharashtra, the Central Government in consultation with the State Government of Maharashtra, hereby constitutes the First State Expert Appraisal Committee for all the projects related to Industries, Mining and Irrigation in the State of Maharashtra (hereinafter in this notification referred to as the first SEAC, Maharashtra) comprising of the following members, namely:— i Dr. Vijay Kulkarni, Chairman;

To assist the Authority, Maharashtra, the Central Government in consultation with the State Government of Maharashtra, hereby constitutes the Second State Expert Appraisal Committee for Mumbai Metropolitan Region and Konkan Region in the State of Maharashtra (hereinafter in this notification referred to as second SEAC, Maharashtra) comprising of the following Members, namely: —

8. The Chairman and Members of the first SEAC, second SEAC and third SEAC, Maharashtra shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.

9. In order to avoid any conflict of interest,—

(a) the Chairman and Members of the Authority, Maharashtra and first SEAC, second SEAC and third SEAC, Maharashtra shall declare to which consulting organisation they have been associated with and also the project proponents;

(b) they shall not undertake any consultation or associate with preparation of Environment Impact Assessment (EIA) and Environment Management Plan for a project, which is to be appraised by the Authority, Goa and SEAC, Goa during their tenure; and [T I—Evs 3(ii)] T BT TS : STETETOT 7.

(c) ifin the past five years, the Chairman or any of the Members of the Authority, Maharashtra and first SEAC, second SEAC and third SEAC, Maharashtra have provided consultancy services or conducted EIA studies for any project proponent, in that event they shall recuse themselves from the meetings of the Authority, Goa and SEAC, Goa in the process of appraisal of any project being proposed by such proponents.

10. The first SEAC, second SEAC and third SEAC, Maharashtra shall exercise such powers and follow such procedures as enumerated in the said Gazette notification.

11. The first SEAC, second SEAC and third SEAC, Maharashtra shall function on the principle of collective responsibility and the Chairman shall endeavor to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.

12. The State Government of Maharashtra shall notify an agency to act as Secretariat for the Authority, Maharashtra and the first SEAC, second SEAC and third SEAC, Maharashtra. The Secretariat shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all its statutory functions.

13. The sitting fees, travelling allowances and dearness allowances to the Chairman and Member of the Authority, Maharashtra and the Chairman and Members of the first SEAC, second SEAC and third SEAC, Maharashtra shall be paid in accordance with the existing rules of the State Government of Maharashtra.
