PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 14 मई, 2025 का.आ. 2136 (अ).— प्रारुप अजधसूचना भारत के रािपत्र, असाधारण में संखर्ांक का.आ. 4761(अ), तारीख 30 अक्टूबर, 2024, द्वारा प्रकाजित की गई थी, जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थ;े और, उि रािपत्र अजधसूचना की प्रजतर्ां िनता को तारीख 30 अक्टूबर, 2024 को उपलब्ध करा िी गई थी;
और, उि प्रारुप अजधसूचना की बाबत व्यजिर्ों और पणधाररर्ों से प्राप्त आक्षेपों और सुझावों पर कें द्रीर् सरकार द्वारा जवचार दकर्ा गर्ा था;
और, पजिमी बंगाल के 24-परगना जिल ेमें 5.95 वगा दकलोमीटर के्षत्र के हलैीड ेद्वीप वन्र्िीव अभर्ारण्र् को पजिमी बंगाल राज्र् सरकार द्वारा तारीख 24.06.1976 की अजधसूचना सं. 5388 द्वारा अजधसूजचत दकर्ा गर्ा था। स.ं 2089] नई दिल्ली, बुधवार, मई 14, 2025/विैाख 24, 1947 No. 2089] NEW DELHI, WEDNESDAY, MAY 14, 2025/VAISAKHA 24, 1947 सी.जी.-डी.एल.-अ.-15052025-263112 CG-DL-E-15052025-263112 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, हलैीड ेवन्र्िीव अभर्ारण्र् मतला निी और बंगाल की खाडी के संगम पर जस्ट्थत ह ैिो वनस्ट्पजतर्ों और िीवों की एक अनूठी जवजवधता को अनुकूल वातावरण ितेे हुए संक्रमण के्षत्र बनाता ह ैऔर र्ह के्षत्र 5.95 वगा दकलोमीटर के इस सबसे छोटे संुिरबन द्वीप के भीतर मैंग्रोव वनों और तटीर् र्ा तट से ऊपर जस्ट्थत तटीर् वन वनस्ट्पजतर्ों-िीवों के संर्ोिन को उपर्ुक्त पररवेि िेता ह।ै और, र्ह अभर्ारण्र् गंगा डॉजल्िन (प्लैरटजनस्ट्टा गैंगेरटका), एस्ट्टुरीन मगरमच्छ (क्रोकोजडलस पोरोसस), दिशिगं कैट (िेजलस जववररना बेनेट), एस्ट्टुरीन ओटर (लुरा लुरा), जसर्ार (कॉइन्स ऑररर्स), चीतल (एजक्सस एजक्सस), िंगली सूअर (सुस स्ट्क्रोिा) आदि सजहत अनेक संवेिनिील प्रिाजतर्ों का आश्रर् स्ट्थल ह।ै और, इस अभर्ारण्र् में अजभजलजखत की गई पक्षी-िातीर् प्रिाजतर्ों में कॉटन जपग्मी गूि (नेट्टापस कोरोमेंडेजलर्नस), कॉमन टील (अनस के्रका), शपंटेल (अनास एक्र्ूटा), गैडवाल (अनस स्ट्रेपेरा), र्ूरोपीर् हरेरंग गल (लारस अिेंटाटस), कैजस्ट्पर्न टना (हाइड्रोप्रोग्न ेकैजस्ट्पर्ा), ग्रेटर एडिुटेंट (लेप्टोजप्टलोस डजबर्स गमेजलन), जहहम्ब्रेल (नुमेजनर्स दिर्ोपस), पैजसदिक गोल्डन प्लोवर (प्लुजवर्जलस िुलवा), के्रस्ट्टेड सपेंट ईगल (जस्ट्पलोर्नास चीला), परेेग्रीन िाल्कन (िाल्को पेरेग्रीन), लॉन्ग-टेल्ड नाइटिार (कैजप्रमलु्गस क्लाइमाकुरस) आदि िाजमल हैं;
और, इस के्षत्र में पाई िाने वाली मछली की प्रिाजतर्ों में गगंा िाका (जग्लदिस गैंगेरटकस), हमैर हडे िाका (जस्ट्िरना ब्लोची), जगटार दिि (राइनोबेटोस अन्नाडेली), हैंगर (डाजसर्ारटस सेिोसा), बटर दिि (स्ट्रोमेटस साइनेंजसस), जसल्वर पॉम्ब्रेट (पैम्ब्पस जचरेंजसस), बंगाल टंग दिि (जसनोग्लोसस जसनोग्लोसस), गगंेरटक हरे्रदिन एंकोवी (सेरटजपन्ना िासा हजैमल्टन), मोटल्ड ईल (एंगुइला बेंगालेंजसस), ब्लैकदिन सी कैट दिि (एररर्स िेला), आदि िाजमल हैं;
और, इस के्षत्र में अजभजलजखत की गई वनस्ट्पजत प्रिाजतर्ों में हरगुजा (एकें थस इजलजसिोजलर्स एल), अमूर (एग्ली कुकुलाटा (रॉक्सब) पलेेजग्रन), लता संुिरी (बी. परजवफ्लोरा), बंिाई (क्लेरोडेंड्रम इनम े(एल) गीटान), मैथ गोरान (सी. टैगल (प्रोटेट) सी.एस. रॉजबन्सन), दक्रप (लुजित्जेरा रेसमोसा वाइल्ड), िजुधलता (दिनलेसोजनर्ा ओबोवाटा एल), गोलपाटा (न्र्पा रूरटकन्स वुम्ब्बा), केर्ा (पांडनस टेक्टोररर्स सोलैंड), ओरा (एस. जग्रदिजथ कुजा) आदि िाजमल हैं;
और, पैरा 1 में जनर्िाष्ट हलैीडे द्वीप वन्र्िीव अभर्ारण्र् के आस-पास के के्षत्र का पाररजस्ट्थजतकीर्, पर्ाावरणीर् और िैव- जवजवधता के िजृष्टगत पाररजस्ट्थजतकी संवेिी जोन के रूप में संरक्षण और सुरक्षा करना तथा उि पाररजस्ट्थजतकी संवेिी जोन में उद्योगों र्ा उद्योगों की श्रणेी और उनके प्रचालन और प्रदक्रर्ाओं को प्रजतजिद्ध करना आवश्र्क ह;ै अतः, अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना में इसके पिात ्पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उप-धारा (1) और उप-धारा (2) के खंड (v) और खंड (xiv) तथा उप-धारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, पजिमी बंगाल राज्र् के िजक्षण 24 परगना जिल ेमें हलैीड ेद्वीप वन्र्िीव अभर्ारण्र् की सीमा से लग े2 दकलोमीटर तक के के्षत्र को पाररजस्ट्थजतकी संवेिी िोन (जिसे इस अजधसूचना में इसके पश्चात ्पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करन ेका आिर् रखती ह,ै जिसका जववरण जनिानुसार ह,ै अथाात ्:- [भाग II—खण्ड 3(ii)] भारत का रािपत्र : असाधारण 3
1. पाररजस्ट्थजतकी सवंिेी जोन का जवस्ट्तार और सीमाएं - (1) पाररजस्ट्थजतकी संवेिी िोन, हलैीड े द्वीप वन्र्िीव अभर्ारण्र् की सीमा से एक समान 2.0 दकलोमीटर के जवस्ट्तार के्षत्र तक होगा और पाररजस्ट्थजतकी संवेिी िोन का के्षत्र लगभग
26.81 वगा दकलोमीटर ह।ै
(2) हलैीडे द्वीप वन्र्िीव अभर्ारण्र् के आस-पास पाररजस्ट्थजतकी संवेिी जोन की सीमा का जववरण उपाबधं-I में दिर्ा गर्ा ह।ै
(3) पाररजस्ट्थजतकी संवेिी के्षत्र का स्ट्थलाकृजतक मानजचत्र और गगूल इमेिरी मानजचत्र उपाबधं-II-क और उपाबधं-II-ख में दिर्ा गर्ा ह।ै
(4) हलैीड ेद्वीप वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी जोन की सीमा पर भू-जनिेिांक उपाबधं-III के सारणी क और सारणी ख में दिए गए हैं।
(5) कोई भी रािस्ट्व गांव, पाररजस्ट्थजतकी संवेिी जोन के भीतर अवजस्ट्थत नहीं ह।ै
2. पाररजस्ट्थजतकी सवंिेी जोन के जलए आचंजलक महार्ोिना – (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्र् सरकार के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी।
(2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना, ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष्ट की गई ह,ै के अनुसार तथा सुसंगत कें द्रीर् और राज्र् जवजधर्ों तथा कें द्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों, र्दि कोई हों, के अनरुुप तैर्ार की िाएगी।
(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकीर् और पर्ाावरणीर् तथ्र्ों को समाकजलत करन ेके जलए राज्र् सरकार के जनिजलजखत जवभागों के परामिा से तैर्ार की िाएगी :-
(i) वन;
(ii) पर्ाावरण;
(iii) कृजि;
(iv) मत्स्ट्र्-पालन:
(v) पर्ाटन;
(vi) शसंचाई और िलमागा;
(vii) आपिा प्रबंधन और नागररक सुरक्षा;
(viii) अंतिेिीर् िलमागा जवभाग, पजिम बंगाल सरकार;
(ix) पंचार्ती और ग्रामीण जवकास; और
(x) संुिरवन संबंधी मामले।
(4) आंचजलक महार्ोिना के अधीन अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं दकर्ा िाएगा िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो और आचंजलक महार्ोिना, सभी अवसंरचना और दक्रर्ाकलापों में, िो अजधक िक्ष और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी।
(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल स्रोतो के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलुओं, जिन पर ध्र्ान िेना आवश्र्क ह,ै के जलए उपबंध होंगे। पजिमी संुिरवन वन्र्िीव अभर्ारण्र् से गुिरने वाली नदिर्ों के 10 दकलोमीटर तक के अधोप्रवाह में कोई भी 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] दक्रर्ाकलाप, जिसके कारण तट कटाव, बाढ़, िल प्रििूण, पाररजस्ट्थजतकीर् और प्राकृजतक प्रवाह के रुकन ेकी संभावना बढ़ सकती ह,ै के जलए पजिम संुिरवन वन्र्िीव अभर्ारण्र् के प्राजधकरण से पूवा स्ट्वीकृजत प्राप्त करना अपेजक्षत ह।ै
(6) आंचजलक महार्ोिना में जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेिताओं के ब्र्ौरों से अनसुमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट्थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट्मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, हररत के्षत्र िैसे उद्यान और उसी प्रकार के स्ट्थान, उद्यान कृजि के्षत्र, िलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्कंन दकर्ा िाएगा।
(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और पैरा 4 में सारणी में सूचीबद्ध प्रजतजिद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट्थानीर् समुिार्ों की िीजवका को सुरजक्षत करन े के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित और उसकी अजभवृजद्ध भी करेगी।
(8) आंचजलक महार्ोिना, प्रािेजिक जवकास र्ोिना की सह-जवस्ट्तारी होगी।
(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कार्ों को करने के जलए जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी।
(10) आंचजलक महार्ोिना की तैर्ारी और अनुमोिन लंजबत रहने के िौरान, कोई भी नई जवकासात्मक दक्रर्ाकलाप उप- पैरा (1) और (2) के परैाग्राि 6 में जवजनर्िाष्ट उपबंधों द्वारा िाजसत होगी।
3. राज्र् सरकार द्वारा दकए िान ेवाल ेउपार् - राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनिजलजखत उपार् करेगी, अथाात :-
(1) भ-ूउपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुले स्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दक्रर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा:
परंत ुपाररजस्ट्थजतकी संवेिी िोन के भीतर उपर्ुाि भाग (क) में जवजनर्िाष्ट प्रर्ोिनों से जभन्नों प्रर्ोिनों के जलए कृजि और अन्र् भूजम का संपररवतान, जनगरानी सजमजत की जसिाररि पर और र्था लागू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्द्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनिजलजखत आवासीर् आवश्र्कताओं को परूा करन ेके जलए अनजु्ञात दकर्ा िाएगा, िैसे:-
(i) तट जस्ट्थरीकरण र्ा संरक्षण संरचना और उपार्;
(ii) मौिूिा सडकों र्ा िेट्टी को चौडा और सुिढृ़ करना तथा पुलों, पजुलर्ा आदि सजहत नई सडकों, िेट्टी का जनमााण करना;
(iii) निी तलकिाण और िलमागों का तलकिाण;
(iv) सामाजिक रूप से वांछनीर् सावािजनक अवसंरचना, जबिली, पेर्िल, शसंचाई और अन्र् बुजनर्ािी नागररक सुजवधाओं का जनमााण और नवीकरण;
(v) लोगों को प्राकृजतक आपिा अथाात चक्रवात, तूिान आदि से बचाने के जलए आपिा आश्रर् का जनमााण एवं नवीनीकरण और संबंजधत कार्ा;
(vi) ग्रामीण कारीगरों, आदि सजहत कुटीर उद्योगों;
(vii) गृह वास सजहत पारर-पर्ाटन को बढ़ावा िेने वाली स्ट्थानीर् सुजवधाएं;

(viii) सुरक्षा बलों के जिजवरों र्ा गश्त जिजवरों का जनमााण और नवीनीकरण; और
(ix) पैरा 4 के अधीन दिए गए संवर्धात दक्रर्ाकलाप:
(ख) अप्रर्ुि भूजम, अनुत्पािक कृजि भूजम और कच्छ वनस्ट्पजत प्रिाजतर्ों वाल ेनिी तटों पर पुनवावनीकरण करन े के प्रर्ास दकए िाएंगे। परंतु क्षेत्रीर् नगर जनर्ोिन अजधजनर्म तथा राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना और भारत के संजवधान के अनुच्छेि 244 र्ा वतामान में लाग ूदकसी जवजध जिसमें अनुसूजचत िनिाजत और अन्र् पारंपररक वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै के उपबंधों के अनुपालन के जबना वाजणजज्र्क और औद्योजगक जवकास गजतजवजधर्ों के जलए िनिातीर् भूजम के उपर्ोग की अनुमजत नहीं िी िाएगी;
परंत ुर्ह और दक र्दि पाररजस्ट्थजतकी संवेिी िोन के भू-िस्ट्तावेि में कोई तु्ररट दिखाई ितेी ह ैतो उसे संबंजधत संघ राज्र् के्षत्र र्ा प्रिासन जनगरानी सजमजत की रार् लेकर ठीक, प्रत्र्ेक मामल ेमें केवल एक बार कर सकता ह ैऔर ऐसे िुजद्धकरण के बारे में कें द्रीर् सरकार अथाात् मंत्रालर् को अवगत कराना होगा;
परंत ुर्ह भी दक उक्त तु्ररट सुधार के िार्रे में इस उप-पैराग्राि के अधीन दिए गए उपबंध को छोडकर अन्र् दकसी भी मामले में भूजम-उपर्ोग में दकर्ा िाने वाला परजवतान नहीं आएगा;
(2) प्राकृजतक िल जनकार्- सभी प्राकृजतक झरनों के िलग्रहण क्षेत्रों को अजभज्ञात दकर्ा िाएगा और उनके संरक्षण तथा पुनरुद्धार की र्ोिनाओं को आचंजलक महार्ोिना में सजम्ब्मजलत दकर्ा िाएगा और राज्र् सरकार द्वारा मागाििाक जसद्धांत इस तरह से तैर्ार दकए िाएंगे दक इन क्षेत्रों में र्ा इनके जनकट ऐसी जनमााण दक्रर्ाकलापों पर रोक लगाई िा सके िो ऐसे क्षेत्रों के जलए हाजनकारक हो।
(3) पर्ाटन र्ा पारर-पर्ाटन- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पारर-पर्ाटन, दक्रर्ाकलापों र्ा मौिूिा पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन के जलए पर्ाटन महार्ोिना के अनुसार होगा;
(ख) पर्ाटन महार्ोिना को राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा से राज्र् पर्ाटन जवभाग द्वारा तैर्ार दकर्ा िाएगा;
(ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का ही एक घटक होगा;
(घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार दकर्ा िाएगा (ड.) पारर-पर्ाटन की गजतजवजध का जवजनर्मन जनिानुसार दकर्ा िाएगा, र्था: -
(i) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें से िो भी नििीक हो, नए होटलों और ररसॉर्टसा के दकसी भी संजनमााण की अनुमजत नहीं िी िाएगी। परंतु संरजक्षत के्षत्र की सीमा से एक दकलोमीटर की िरूी से िरू पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, नए होटलों और ररसॉर्टसा की स्ट्थापना की अनुमजत केवल पर्ाटन महार्ोिना के अनुसार पारर-पर्ाटन सुजवधाओं के जलए पूवा-जनधााररत और में ही दकर् ेिाने के जलए की िाएगी;
(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नई पर्ाटन दक्रर्ाकलापों र्ा मौिूिा पर्ाटन दक्रर्ाकलापों का जवस्ट्तार कें द्रीर् सरकार और पारर-पर्ाटन द्वारा िारी मागा ििाक जसद्धांतों और राष्ट्रीर् बाघ संरक्षण प्राजधकरण द्वारा िारी पारर-पर्ाटन मागा ििाक जसद्धांतों (समर्-समर् पर संिोजधत) के अनुसार होगा, जिसमें पारर-पर्ाटन, पारर-जिक्षा और पारर-जवकास पर िोर दिर्ा िाएगा;
(iii) िब तक आंचजलक महार्ोिना को अनुमोदित नहीं कर दिर्ा िाता ह,ै तब तक पर्ाटन के जलए जवकास और मौिूिा पर्ाटन दक्रर्ाकलापों के जवस्ट्तार की कोई अनुमजत संबंजधत जनर्ामक प्राजधकरणों द्वारा तथा वास्ट्तजवक स्ट्थल- जवजिष्ट िांच और जनगरानी सजमजत की जसिाररि के आधार पर िी िाएगी और पाररजस्ट्थजतकी संवेिी िोन में दकसी भी प्रकार के नए होटल, ररसॉटा र्ा व्यावसाजर्क प्रजतष्ठान के जनमााण की अनुमजत नहीं िी िाएगी। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(4) प्राकृजतक जवरासत- पाररजस्ट्थजतकी संवेिी िोन में बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थल, िैसे िीन पलू ररिवा के्षत्र, चट्टान संरचनाएं, झरने, स्रोत, घारटर्ां, उपवन, गुिाए,ं शबंि,ु पैिल मागा, सैरगाह, चट्टानें आदि को अजभज्ञात दकर्ा िार्ेगा और आंचजलक महार्ोिना के रूप में उनके संरक्षण के जलए जवरासत संरक्षण र्ोिना तैर्ार की िाएगी।
(5) मानव जनर्मात जवरासत स्ट्थल- पाररजस्ट्थजतकी संवेिी िोन में ऐजतहाजसक, स्ट्थापत्र्, सौंिर्ा और सांस्ट्कृजतक महत्व के भवनों, संरचनाओं, कलाकृजतर्ों, क्षेत्रों और पररसरों की पहचान की िाएगी और आंचजलक महार्ोिना के भाग के रूप में उनके संरक्षण के जलए जवरासत संरक्षण की र्ोिना तैर्ार की िाएगी।
(6) ध्वजन प्रििूण- पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििूण की रोकथाम और जनर्ंत्रण ध्वजन प्रििूण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 और उसके संिोधनों के प्रावधानों के अनुसार दकर्ा िाएगा।
(7) वार् ुप्रििूण- पाररजस्ट्थजतकी संवेिी िोन में वार् ुप्रििूण की रोकथाम और जनर्ंत्रण वार् ु (प्रििूण जनवारण एवं जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और पर्ाावरण (संरक्षण) अजधजनर्म, 1986 तथा इन अजधजनर्मों के अधीन बनाए गए जनर्मों के उपबंधों के अधीन होगा।
(8) अपजिष्टों का जनवाहन- पाररजस्ट्थजतकी संवेिी िोन में िोजधत अपजिष्टों का जनवाहन, िल (प्रििूण जनवारण एवं जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) तथा पर्ाावरण (संरक्षण) अजधजनर्म, 1986 तथा इन अजधजनर्मों के अधीन बनाए गए जनर्मों के उपबंधों के अधीन होगा।
(9) ठोस अपजिष्ट- ठोस अपजिष्टों का जनपटान और प्रबंधन जनिानसुार होगा: - (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट जनपटान और प्रबंधन ठोस अपजिष्ट प्रबंधन जनर्म, 2016 और पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर्, भारत सरकार द्वारा दिनांक 08 अप्रलै, 2016 को प्रकाजित अजधसूचना सं. का. आ. 1357(अ) तथा समर्-समर् पर र्था संिोजधत के अनुसार दकर्ा िाएगा। अकाबाजनक सामग्री को पाररजस्ट्थजतकी संवेिी िोन के बाहर अजभज्ञात दकए गए स्ट्थल पर पर्ाावरण स्ट्वीकार्ा तरीके से जनपटार्ा िा सकता ह।ै (ख) स्ट्थानीर् अजधकारी ठोस अपजिष्ट को िैवजनम्ब्नीकरण और अिैवजनम्ब्नीकरण घटकों में अलग करने की र्ोिना तैर्ार करेंगे। (ग) िैवजनम्ब्नीकरण सामग्री को प्रमुखत: खाि र्ा कृजम के माध्र्म से पुनाचदक्रत दकर्ा िाएगा। (घ) अकाबाजनक सामग्री को पाररजस्ट्थजतकी संवेिी िोन के बाहर अजभज्ञात दकए गए स्ट्थलों पर पर्ाावरण की िजृष्ट से स्ट्वीकार्ा तरीके से जनपटार्ा िा सकता ह ैऔर पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट को िलाने र्ा भस्ट्म करन े की अनुमजत नहीं िी िाएगी।
(10) िवै-जचदकत्सा अपजिष्ट- िैव जचदकत्सा अपजिष्ट प्रबंधन जनिानुसार होगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव-जचदकत्सा अपजिष्ट जनपटान पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर्, भारत सरकार की दिनांक 28 माचा, 2016 की अजधसूचना संखर्ा सा.का.आ. 343(अ), द्वारा प्रकाजित िैव-जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन के भीतर अजभज्ञात की गई प्रौद्योजगदकर्ों का उपर्ोग करके मौिूिा जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्टों का सुरजक्षत और पर्ाावरण की िजृष्ट से सुप्रबंधन (ईएसएम) की अनुमजत िी िा सकती ह।ै
(11) प्लाजस्ट्टक अपजिष्ट प्रबधंन- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट प्रबंधन पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर्, भारत सरकार की दिनांक 18 माचा, 2016 की अजधसूचना संखर्ा सा.का.आ. 340(अ), समर्- समर् पर र्था संिोजधत, द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के प्रावधानों के अनुसार दकर्ा िाएगा।
(12) जनमााण एव ंजवध्वसं अपजिष्ट प्रबधंन- पाररजस्ट्थजतकी संवेिी िोन में जनमााण एवं जवध्वंस अपजिष्ट प्रबंधन पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर्, भारत सरकार की दिनांक 29 माचा, 2016 की अजधसूचना संखर्ा सा.का.आ.
317(अ), समर्-समर् पर र्था संिोजधत, द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के प्रावधानों के अनुसार दकर्ा िाएगा। [भाग II—खण्ड 3(ii)] भारत का रािपत्र : असाधारण 7
(13) ई-अपजिष्ट- पाररजस्ट्थजतकी संवेिी िोन में ई-अपजिष्ट प्रबंधन पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् भारत सरकार के द्वारा प्रकाजित ई-अपजिष्ट प्रबंधन जनर्म, 2016 के प्रावधानों के अनुसार तथा समर्-समर् पर र्था संिोजधत अनुसार दकर्ा िाएगा।
(14) वाहनीर् र्ातार्ात- वाहनों के आवागमन को पर्ाावास अनुकूल रीजत से जवजनर्जमत दकर्ा िाएगा और इस संबंध में जवजिष्ट उपाबंध आंचजलक महार्ोिना में िाजमल दकए िाएंग ेऔर िब तक आंचजलक महार्ोिना को तैर्ार नहीं कर जलर्ा िाता ह ैऔर इसे राज्र् सरकार में सक्षम प्राजधकारी द्वारा अनुमोदित कर दिर्ा िाता ह,ै तब तक जनगरानी सजमजत संबंजधत अजधजनर्मों और उनके अधीन बनाए गए जनर्मों और जवजनर्मों के अधीन वाहनों के आवागमन के अनुपालन की जनगरानी करेगी।
(15) वाहन प्रििूण- वाहन प्रििूण की रोकथाम और जनर्ंत्रण स्ट्वच्छ ईंधन के उपर्ोग के जलए लागू जवजधर्ों और प्रर्ासों के अनुसार दकर्ा िाएगा।
(16) औद्योजगक इकाइर्ा.ं- (क) इस अजधसूचना के रािपत्र में प्रकािन के पिात्, पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई भी नर्ा प्रििूणकारी उद्योग स्ट्थाजपत करने की अनुमजत नहीं िी िाएगी;
(ख) िब तक दक इस अजधसूचना में जवजनर्िाष्ट न दकर्ा गर्ा हो िरवरी 2016 में, समर्-समर् पर र्था संिोजधत, कें द्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा िारी मागाििाक जसद्धांतों में दिर् े गर् े उद्योगों के वगीकरण के अनुसार पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रििूणकारी उद्योगों को ही अनुमजत िी िाएगी। इसके अलावा, गरै- प्रििूणकारी कुटीर उद्योगों को भी बढ़ावा दिर्ा िाएगा।
(17) पहाडी ढलानों का सरंक्षण- पहाडी ढलानों का संरक्षण जनिानुसार होगा:
(क) आंचजलक महार्ोिना में पहाडी ढलानों पर ऐसे क्षेत्रों को इंजगत दकर्ा िाएगा िहां दकसी भी जनमााण की अनुमजत नहीं होगी। (ख) जवद्यमान खडी पहाडी ढलानों र्ा अत्र्जधक कटाव वाली ढलानों पर जनमााण की अनुमजत नहीं होगी।
4. पाररजस्ट्थजतकी सवंिेी िोन के भीतर जनजिद्ध र्ा जवजनर्जमत की िान ेवाली दक्रर्ाकलाओं की सचूी- पाररजस्ट्थजतकी-संवेिी जोन में सभी दक्रर्ाकलाप पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) अजधजनर्म के उपबंधों, उसके अधीन बनाए गए जनर्मों और कें द्रीर् सरकार की अन्र् अजधसूचनाओं, जवजधर्ों और अजधजनर्मों, तत्कालीन पर्ाावरण और वन मंत्रालर् में पर्ाावरण, वन और वन्र्िीव से संबंजधत अजधसूचना, संखर्ांक 1533(अ), तारीख 14 जसतंबर, 2006 और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में तत्समर् प्रवृत्त जवजधर्ों द्वारा िाजसत होंगे, अथाात:् - ताजलका क्र. स.ं दक्रर्ाकलाप रटप्पजणर्ााँ

2. प्रििूण उत्पन्न करन ेवाले उद्योगों की स्ट्थापना (िल, वार्,ु मृिा, ध्वजन, आदि)। पाररजस्ट्थजतकी संवेिी िोन में प्रििूण िैलाने वाल ेदकसी भी नए उद्योग र्ा जवस्ट्तार की अनुमजत नहीं िी िाएगी। मौिूिा उद्योगों द्वारा प्रििूण रोकथाम तकनीक और िोर अवरोधक स्ट्थाजपत दकए िान ेचाजहए।
3. प्रमुख िलजवदु्यत पररर्ोिनाओं की स्ट्थापना । प्रजतजिद्ध।
4. दकसी भी खतरनाक पिाथा का उपर्ोग, उत्पािन र्ा प्रसंस्ट्करण । प्रजतजिद्ध।
5. प्राकृजतक िल जनकार्ों र्ा भूजम के्षत्र में अिोजधत अपजिष्टों का जनवाहन। प्रजतजिद्ध।
6. नई आरा जमलों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी भी नई आरा जमल को लगान ेर्ा मौिूिा आरा जमल के जवस्ट्तार की अनुमजत नहीं िी िाएगी।
7. ईंट भट्टों की स्ट्थापना। प्रजतजिद्ध।
8. पॉजलथीन बैग का प्रर्ोग। प्रजतजिद्ध।
9. िलाऊ लकडी का व्यावसाजर्क उपर्ोग। प्रजतजिद्ध।
10. प्राकृजतक िल जनकार्ों र्ा भूजम के्षत्र में उपचाररत अपजिष्ट िल/अपजिष्टों का जनवाहन। प्रजतजिद्ध।
11. सतही एवं भूिल का व्यावसाजर्क जनष्किाण। प्रजतजिद्ध।
12. ठोस/प्लाजस्ट्टक/ई-अपजिष्ट और िैव-जचदकत्सा अपजिष्ट प्रबंधन सुजवधा की स्ट्थापना। प्रजतजिद्ध।
13. जविेिी प्रिाजतर्ों का समावेिन। प्रजतजिद्ध। ख. जवजनर्जमत दक्रर्ाकलाप
14. होटलों और ररसॉटों की व्यावसाजर्क स्ट्थापना। संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के िार्रे में र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकटतर हो, पाररजस्ट्थजतकी-पर्ाटन संबंधी दक्रर्ाकलापों के जलए छोटे अस्ट्थार्ी ढांचों के जसवार् दकसी भी नए वाजणजज्र्क होटल और ररसॉटा की अनुमजत नहीं िी िाएगी:
परंत,ु संरजक्षत के्षत्र की सीमा से एक दकलोमीटर से बाहर तक र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकटतर हो, सभी नई पर्ाटन दक्रर्ाकलाप र्ा वतामान दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना और प्रर्ोज्र् मागाििाक जसद्धांतों के अनुरूप होने चाजहए।
15. जनमााण संबंधी कार्ाकलाप। (क) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर िार्रे में र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकटतम हो, दकसी भी प्रकार के नए वाजणजज्र्क जनमााण की अनुमजत नहीं िी िाएगी:

परंत ुर्ह और दक प्रििूण न िैलाने वाल ेलघ ुउद्योगों से संबंजधत जनमााण संबंधी दक्रर्ाकलापों को प्रर्ोज्र् जनर्मों और जवजनर्मों, र्दि कोई हो, के अनुसार तथा सक्षम प्राजधकारी से पूवा अनुमजत लेकर जवजनर्जमत दकर्ा िाएगा और न्र्नूतम ही रखा िाएगा। (ख) एक दकलोमीटर के िार्रे से आग े इसे आंचजलक महार्ोिना के अनुसार जवजनर्जमत दकर्ा िाएगा।
16. लघु पैमान ेके प्रििूण न िैलान े वाले उद्योग। िरवरी, 2016 में केन्द्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों के वगीकरण, समर्-समर् पर र्था संिोजधत के अनुसार प्रििूण न िैलान ेवाल े उद्योग, तथा पाररजस्ट्थजतकी संवेिी िोन से स्ट्विेिी सामजग्रर्ों से उत्पाि बनाने वाल ेिोजखम रजहत, लघ ुएवं सेवा उद्योग, कृजि, पुष्प-कृजि, बागवानी र्ा कृजि-आधाररत उद्योगों को अनुमजत िी िाएगी।
17. वृक्षों की कटाई। (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन, सरकारी, रािस्ट्व र्ा जनिी भूजम पर से वृक्षों की कटाई की अनुज्ञा नहीं होगी। (ख) वृक्षों की कटाई को संबंजधत केन्द्रीर् र्ा राज्र् अजधजनर्म तथा उसके अंतगात बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत दकर्ा िाएगा।
18. वन उत्पाि र्ा काष्ठतेर वन उत्पाि का संग्रहण। लाग ूजवजधर्ों के अधीन जवजनर्जमत।
19. जवदु्यत एवं संचार टावरों का जनमााण तथा केबल जबछाना एवं अन्र् अवसंरचनाएं। लाग ूजवजधर्ों के अधीन जवजनर्जमत भूजमगत केबशलंग को बढ़ावा दिर्ा िा सकता ह।ै
20. नागररक सुजवधाओं सजहत अवसंरचना। लागू जवजधर्ों, जनर्मों और जवजनर्मों तथा उपलब्ध मागाििाक जसद्धांतों के अनुसार िमन के उपार् करना।
21. मौिूिा सडकों का चौडीकरण एवं सुिढृ़ीकरण तथा नई सडकों का जनमााण। लागू जवजधर्ों, जनर्मों और जवजनर्मों तथा उपलब्ध मागाििाक जसद्धांतों के अनुसार उजचत पर्ाावरण समाघात जनधाारण उपिमन के उपार् करना।
22. पर्ाटन से संबंजधत अन्र् कार्ाकलाप िैसे पाररजस्ट्थजतकी संवेिी िोन के ऊपर हॉटर बलून, हलेीकॉप्टर, ड्रोन, माइक्रोलाइर्टस, आदि का उडान भरना। लाग ूजवजधर्ों के अनुसार जवजनर्जमत।
23. पहाडी ढलानों और निी तटों का संरक्षण। लाग ूजवजधर्ों के अनुसार जवजनर्जमत।
24. रात के समर् वाहनों का आवागमन। लाग ूजवजधर्ों के अधीन हर्ावसाजर्क उद्देश्र् के जलए जवजनर्जमत।
25. स्ट्थानीर् समुिार्ों द्वारा डेर्री, डेर्री िार्मंग, िलीर् कृजि स्ट्थानीर् लोगों के उपर्ोग के उद्देश्र् से लाग ूजवजधर्ों के अधीन अनुमजत िी गई ह।ै 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और मत्स्ट्र् पालन के साथ-साथ की िा रही कृजि और बागवानी कार्ा प्रथाएाँ।
26. िमों, कॉपोरेटों और कंपजनर्ों द्वारा बडे पैमाने पर हर्ावसाजर्क पिुधन और मुगीपालन की स्ट्थापना। स्ट्थानीर् आवश्र्कताओं को परूा करन े के अलावा लाग ू जवजधर्ों के अधीन जवजनर्जमत।
27. कृजि र्ा अन्र् उपर्ोग के खुला कुआाँ, बोरवेल आदि। जवजनर्जमत तथा र्था उजचत प्राजधकारी द्वारा इस कार्ाकलाप की जनगरानी की िानी चाजहए।
28. पाररजस्ट्थजतकी पर्ाटन। लाग ूजवजधर्ों के अधीन जवजनर्जमत।
29. हर्ावसाजर्क साइन बोडा और होर्डंग्स। लाग ूजवजधर्ों के अधीन जवजनर्जमत।
30. लकडी लाना ल ेिाना। पजिम बंगाल पारगमन जनर्म, 2019 के अधीन जवजनर्जमत दकर्ा िाएगा।
31. मछली पालन। वन के्षत्र के अंिर इसकी अनुमजत नहीं ह।ै अन्र् क्षेत्रों में, पाररजस्ट्थजतकी संवेिी िोन के निी िल स्रोतों में प्रिाजतर्ों का पालन दकर्ा िाएगा और पालन िसल के रीजत को जवजनर्जमत दकर्ा िाएगा। ग. सवंर्धात दक्रर्ाकलाप
32. िल संग्रहण । सदक्रर् रूप से बढ़ावा दिर्ा िाएगा।
33. िैजवक खेती। सदक्रर् रूप से बढ़ावा दिर्ा िाएगा।
34. सभी कार्ाकलापों के जलए हररत प्रौद्योजगकी को अपनाना। सदक्रर् रूप से बढ़ावा दिर्ा िाएगा।
35. कुटीर उद्योग जिसमें ग्रामीण कारीगर आदि िाजमल हैं। सदक्रर् रूप से बढ़ावा दिर्ा िाएगा।
36. नवीकरणीर् ऊिाा एवं ईंधन का उपर्ोग। बार्ो-गैस, सौर प्रकाि आदि को सदक्रर् रूप से बढ़ावा दिर्ा िाएगा।
37. कृजि वाजनकी। सदक्रर् रूप से बढ़ावा दिर्ा िाएगा।
38. बागवानी और औिधीर् पौधों का रोपण। सदक्रर् रूप से बढ़ावा दिर्ा िाएगा।
39. पर्ाावरण अनुकूल पररवहन का उपर्ोग। सदक्रर् रूप से बढ़ावा दिर्ा िाएगा।
40. कौिल जवकास। सदक्रर् रूप से बढ़ावा दिर्ा िाएगा।
41. अवक्रजमत भूजम/वन/पर्ाावास की बहाली। सदक्रर् रूप से बढ़ावा दिर्ा िाएगा।

5. पाररजस्ट्थजतकी सवंिेी िोन अजधसचूना की जनगरानी के जलए जनगरानी सजमजत.- केन्द्रीर् सरकार द्वारा एक जनगरानी सजमजत का गठन दकर्ा िाएगा, जिसमें जनिजलजखत सिस्ट्र् िाजमल होगें, अथाात्:- क्र.स.ं जनगरानी सजमजत की सरंचना पि का नाम

6. जनगरानी सजमजत के कार्ा. –(1) जनगरानी सजमजत, वास्ट्तजवक स्ट्थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर, उन दक्रर्ाकलापों की संवीक्षा करेगी िो दक भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ा का.आ.1533 (अ), तारीख 14 जसतम्ब्बर, 2006 की अनुसूची में िी गई हैं और पाररजस्ट्थजतकी संवेिी िोन में की िा रही हैं, इसके पैरा 4 की सारणी में जवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों को छोडकर और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरणीर् अनापजत्त के जलए, िैसा भी मामला हो, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् र्ा राज्र् पर्ाावरण समाघात जनधाारण प्राजधकरण को संिर्भात की िा रही हो।
(2) िो दक्रर्ाकलाप भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ा का.आ.1533 (अ), तारीख 14 जसतम्ब्बर, 2006 की अनुसूची में न आती हों और पाररजस्ट्थजतकी संवेिी िोन में की िा रही हों, इसके पैरा 4 के अधीन ताजलका में जवजनर्िाष्ट प्रजतजसद्ध दक्रर्ाकलापों को छोडकर, की संवीक्षा जनगरानी सजमजत द्वारा वास्ट्तजवक स्ट्थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर की िाएंगी और उससे संबंजधत जनर्ामक प्राजधकरणों को संिर्भात दकर्ा िाएगा।
(3) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबंजधत कलेक्टर र्ा संबंजधत उप वन संरक्षक, इस अजधसूचना के उपबंधों का उल्लघंन करने वाले दकसी भी व्यजि के जवरुद्ध पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन जिकार्त ििा करन ेके जलए सक्षम होगा।
(4) जनगरानी सजमजत मामले िर मामल ेके आधार पर आवश्र्कतानुसार जवचार-जवमिा में सहार्ता के जलए संबंजधत जवभाग के प्रजतजनजध र्ा जविेिज्ञ, उद्योग संघों र्ा संबंजधत पणधाररर्ों के प्रजतजनजध को आमंजत्रत कर सकती ह।ै

AND WHEREAS copies of the Gazette containing the said draft notification were made available to the public on 30th October, 2024;
AND WHEREAS no objections, comments and suggestions were received from persons and stakeholders in respect of the said draft notification;
AND WHEREAS the Halliday Island Wildlife Sanctuary located in 24-Parganas district of West Bengal with an area of 5.95 square kilometres, was notified by the State Government of West Bengal vide notification No. 5388 dated the 24th June, 1976.
AND WHEREAS the Halliday Wildlife Sanctuary is situated at the confluence of the Matla river and the Bay of Bengal and forms a transitional ecotone which supports a unique diversity of flora and fauna and it is popular for its scenic beauty such as forest landscape with its riverine ecosystem and the area supports Mangrove forests and littoral or supra littoral forest flora-faunal assemblage within this smallest Sundarbans island of 5.95 square kilometers;

AND WHEREAS the avifaunal species recorded from the Sanctuary includes Cotton pygmy goose (Nettapus Coromandelianus), Common Teal (Anas crecca), Pintail (Anas acuta), Gadwall (Anas strepera), European Herring Gull (Larus argentatus), Caspian Tern (Hydroprogne caspia), Greater Adjutant (Leptoptilos dubius (Gmelin), Whimbrel (Numenius phaeopus), Pacific Golden Plover (Pluvialis fulva), Crested Serpent Eagle (Spilornis cheela ), Peregrine Falcon (Falco peregrines), Long-tailed Nightjar (Caprimulgus climacurus) etc.;
AND WHEREAS the fish species found in the area includes Ganges Shark (Glyphis gangeticus), Hammer head Shark (Sphyrna blochi), Guitar fish (Rhinobatos annandalei), Hangar (Dasyatis sephors), Butter Fish (Stromateus sinensis), Silver Pomfret (Pampus chirensis), Bengal Tongue Fish (Cynoglossus cynoglossus), Gangetic Hairfin Anchovy (Setipinna phasa (Hamilton), Mottled Eel (Anguilla bengalensis), Blackfin Sea Cat Fish (Arius jella) etc.;
AND WHEREAS the floral species recorded from the area includes Harguza (Acanthus ilicifolius L), amur (Aglaie cuculata (Roxb) Pellegrin), Lata Sundari (B. parviflora), Banjai (Clerodendrum inerme (L) Geartn.), Math Goran (C. Tagal (Prrottet) C.S. Robinson), Kripe (Lumnitzera racemosa Wild), Dudhilata (Finlaysonia obovata L), Golpata (Nypa fruiticans Wurmb.), Keya (Pandanus tectorius Soland), Ora (S.
griffithii kurz) etc.;
AND WHEREAS it is necessary to conserve and protect the area, surrounding the boundaries of Halliday Island Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and
(xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby intends to notify an area with an extent up to 2 kilometres from the boundary of Halliday Island Wildlife Sanctuary, in South 24 Parganas District in the State of West Bengal as the Eco-sensitive Zone (hereafter in this notification referred to as the Halliday Island Wildlife Sanctuary Eco-Sensitive Zone) details of which are as under, namely: -
1. Extent and boundaries of the Eco-Sensitive Zone.- (1) The Eco-Sensitive Zone shall be to an extent of uniform 2.0 kilometres from the boundary of Halliday Island Wildlife Sanctuary and the area of the Ecosensitive Zone is approximately 26.81 Square kilometres.
(2) The boundary description of Eco-Sensitive Zone around Halliday Island Wildlife Sanctuary is appended as Annexure-I.
(3) The topographical map and Google Imagery map of Eco-Sensitive Zone is appended as Annexure- II-A and Annexure- II-B.
(4) Geo Coordinates of the boundary of Halliday Island Wildlife Sanctuary and its Eco sensitive zone are appended as Annexure -III-A and Annexure-III- B.
(5) No revenue villages are located within the Eco-sensitive Zone.
2. Zonal Master Plan for Eco-Sensitive Zone.- (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan: -
(i) Forest;
(ii) Environment;
(iii) Agriculture;
(iv) Fisheries;
(v) Tourism;
(vi) Irrigation and Waterways;
(vii) Disaster Management and Civil defence;
(viii) Inland Waterways Department, Government of West Bengal;
(ix) Panchayati Raj and Rural Development;
(x) Sundarbans Affairs.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendlier.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. Any activity upstream up to 10 kilometers over the rivers passing through the West Sundarbans Wildlife Sanctuary, which may increase the likelihood of bank erosion, flooding, water pollution, stoppage of ecological and natural flow which require a prior clearance from the Authority of the West Sundarbans Wildlife Sanctuary.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
(10) Pending preparation and approval of the Zonal Master Plan, any new developmental activities shall be governed by provisions specified at paragraph 6 of sub-para (1) and (2).
3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely: -
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation [भाग II—खण्ड 3(ii)] भारत का रािपत्र : असाधारण 19 of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or the State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as :-
(i) Bank stabilisation or protection structure and measures.
(ii) widening and strengthening of existing roads or jetty and construction of new road, jetty including bridges, culverts etc.;
(iii) river dredging and dredging of waterways as per the applicable rules and guidelines;
(iv) construction and renovation of socially desirable public infrastructure, electricity, drinking water, irrigation and other basic civic amenities;
(v) Construction and renovation of disaster shelter and related works to protect people from natural disaster viz. cyclone, storm, etc.;
(vi) cottage industries including village artisans, etc.;
(vii) local amenities supporting eco-tourism including home stay;
(viii) Construction and renovation of security forces camp or patrolling camps, and
(ix) promoted activities given in paragraph 4:
(b) Effort shall be made to reforest or afforest the unused land, unproductive agricultural lands and river banks with mangrove species;
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007);
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change;
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph;
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or Eco-tourism. - (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone;
(b) the Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests;
(c) the Tourism Master Plan shall form a component of the Zonal Master Plan;
(d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Ecosensitive Zone;
(e) the activities of eco-tourism shall be regulated as under, namely: - 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer;
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and ecodevelopment.
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Ecosensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and as amended from time to time.
(7) Air pollution. - Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and Environment (Protection) Act, 1986 and the rules made there under these Acts.
(8) Discharge of effluents. - The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and Environment (Protection) Act, 1986 and the rules made there under these Acts.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under: -
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(c) the biodegradable material shall be recycled preferably through composting or vermiculture;
(d) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall he permitted in the Eco-sensitive Zone.

(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016;
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
(11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management. - The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste. - The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone;
(b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco- Sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under and other notifications, laws and Acts of the Government of India pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time to time specified in the Table below, namely TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Ecosensitive Zone;
(b) The mining operations shall be carried out in accordance with the order(s) of the Hon’ble Supreme Court, dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995; dated the 21st April, 2014 in the matter of Goa Foundation Vs.
UOI in W.P.(C) No.435 of 2012; and IA No. 1000 of 2003 dated the 03rd June, 2022 and subsequent IA No.
131377 of 2022 judgment dated the 26th April, 2023 and the 28th April, 2023.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted. Pollution prevention technologies and noise barriers should be installed by existing industries.
3. Establishment of major hydroelectric project.
Prohibited.
4. Use or production or processing of any hazardous substance.
Prohibited.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited.
6. Setting up of saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited.
8. Use of polythene bags. Prohibited.
9. Commercial use of firewood. Prohibited.
10. Discharge of treated waste water/effluents in natural water bodies or land area.
Prohibited.
11. Commercial extraction of surface and ground water.
Prohibited.
12. Establishment of Solid/Plastic/E-Waste and Bio- Medical waste Management facility.
Prohibited.
13. Introduction of Exotic species. Prohibited.
B. Regulated Activities
14. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or [भाग II—खण्ड 3(ii)] भारत का रािपत्र : असाधारण 23 upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities;
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
15. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometre from the boundary of the Protected Area or upto for extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
16. Small-scale non-polluting industries.
Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted.
17. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.
18. Collection of Forest Produce or Non-Timber Forest Produce.
Regulated under applicable laws.
19. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws of underground cabling may be promoted.

20. Infrastructure including civic amenities.
Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.
21. Widening and strengthening of existing roads and construction of new roads.
Taking measures of mitigation with proper Environment Impact Assessment, as per applicable laws, rules and regulation and available guidelines.
22. Undertaking other activities related to tourism like over flying over the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.
Regulated as per the applicable laws.
23. Protection of Hill Slopes and riverbanks.
Regulated as per the applicable laws.
24. Movement of vehicular traffic at night.
Regulated for commercial purpose under applicable laws.
25. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted as per the applicable laws for use of locals.
26. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies.
Regulated as per applicable laws except for meeting local needs.
27. Open Well, Bore Well, etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
28. Eco-tourism. Regulated as per the applicable laws.
29. Commercial Sign boards and hoardings.
Regulated as per the applicable laws.
30. Movement of Timber Shall be regulated as per the West Bengal Transit Rules,2019.
31. Pisciculture Not permitted inside the forest area. In other areas, species cultivated and method of cultivation will be regulated in the River Waters of Eco-sensitive Zone .
C. Promoted Activities
32. Rain water harvesting. Shall be actively promoted.
33. Organic farming. Shall be actively promoted.
34. Adoption of green technology for all activities.
Shall be actively promoted.
35. Cottage industries including village artisans, etc.
Shall be actively promoted.
36. Use of renewable energy and fuels.
Bio-gas, solar light etc. shall be actively promoted.
37. Agro-Forestry. Shall be actively promoted.

5. Monitoring Committee for Monitoring the Eco-Sensitive Zone Notification.- There shall be a committee to be known as Monitoring Committee constituted by the Central Government which shall comprise of the following persons specified in the Table below, namely: - S.No. Constituent of the Monitoring Committee Designation

6. Functions of the Monitoring Committee.– (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification.
(2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under
38. Plantation of Horticulture and Herbals.
Shall be actively promoted.
39. Use of eco-friendly transport. Shall be actively promoted.
40. Skill Development. Shall be actively promoted.
41. Restoration of Degraded Land or Forests or Habitat.
Shall be actively promoted.
42. Environmental Awareness. Shall be actively promoted.
26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis.
(5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-IV, appended to this notification.
(6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional Measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Supreme Court, etc. orders.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
