करण1 क� ; थापना और उनका िव; तार करने पर िनब=धन अिधरोिपत �कए थे; और, र?ा संगठन1 स ेकितपय ?े�1 जो सामAरक अपे?ा और राB Cीय मह� व के हD म सुिवधाF क� अवि; थित के िलए तटीय िविनयम जोन अिधसूचना 2011 के अधीन समथ�कारी उपबंध बनाने के िलए :ितवेदन :ाG त Hए हD; और, पणधाAरय1 के अितAर8 त् िविभJ न तटीय राK य1 और संघ राK य ?े�1 से समु�ीय और तटीय पाAरि; थितक :णाली के :बंधन और संर?ण, तटीय ?े�1 म पाAरि; थितक पय�टन, जीवन यापन िवक� प1 के िवकास और तटीय समदुाय1 के धारणीय िवकास आ�द के संबंध म तटीय िविनयम जोन अिधसूचना 2011 के कितपय उपबंध1 के संबंध म भी :ितवेदन :ाG त Hए हD ; और, िविभJ न राK य सरकार1 और संघ राK य ?े�1 तथा पणधाAरय1 ने पया�वरण वन और जलवायु पAरवत�न मं�ालय से तटीय पया�वरण स ेसंबंिधत मामले और तटीय िविनयम जोन अिधसूचना 2011 के संबंध म धारणीय िवकास को संबोिधत करने का अनुरोध �कया ह;ै और, पया�वरण, वन और जलवायु पAरवत�न मं�ालय ने तटीय िविनयम जोन अिधसचूना 2011 के संबंध म तटीय राK य1 और संघ राK य ?े�1 तथा िविभJ न पणधाAरय1 के िविभJ न मुदद1 और मामल1 क� परी?ा करने और उ8 त अिधसूचना म समुिचत पAरवत�न करने क� िसफाAरश करने के िलए डा. शैलेश नायक क� अQ य?ता म सिमित गAठत क� थी; और, डा. शलेैश नायक सिमित -ारा :; तुत क� गई Aरपोट� क� मं�ालय ने परी?ा क� है और इस संबंध म िविभJ न पणधाAरय1 से परामश� �कया गया ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, क �ीय सरकार क� पया�वरण (संर?ण) िनयम, 1986 के िनयम 5 के उपिनयम (4) के उपबंध1 को Q यान म रखते Hए यह राय ह ै�क तटीय िविनयम जोन अिधसूचना 2011 का संशोधन करने के िलए उ8 त िनयम1 के िनयम 5 के उपिनयम (3) के खंड (क) के अधीन सूचना क� अपे?ा से अिभमुि8 त :दान करना लोकिहत म ह;ै अब, क �ीय सरकार, पया�वरण (संर?ण) िनयम, 1986 के िनयम 5 के उपिनयम (4) के खंड (घ) के साथ पAठत पया�वरण (संर?ण) अिधिनयम, 1986 (1986 का 29) क� धारा 3 क� उपधारा (1) और उपधारा (2) के खंड (v) -ारा :द� त शि8 तय1 का :योग करते Hए तटीय िविनयम जोन अिधसचूना, 2011 का िनW निलिखत और संशोधन करती ह:ै- (क) आरंिभक पैरा म उपपैरा (iii) को हटाया जाएगा और उप पैरा (iv) और (v) को (iii) और (iv) के 3प म पुन: सं$ यां�कत �कया जाएगा । (ख) पैरा 5 के उपपैरा (iii) (iv) और (v) के ; थान पर िनW निलिखत उपपैरा रखे जाएंगे, अथा�त् :- ‘’(iii) पAरसंकटमय रेखा’’ जल ; तर घटत-बढ़त के कारण भिूम ?े� पर बाढ़ के िव; तार, समु� तल म वृि\ और समय के साथ समु� तट रेखा म घAटत पAरवत�न (अपरदन या वृि\) को िहसाब म लेते Hए सीमां�कत क� जाएगी और तटीय राK य1 और संघ राK य?े�1 के साथ धारणीय तटीय :बंधन के िलए राB Cीय क �, चेJ नई के माQ यम से साझा क� जाएगी ; (iv) पAरसकंटमय रेखा तटीय पया�वरण िजसके अंतग�त अनुकूल और अ� पीकरण करने वाले उपाय1 क� योजना भी ह ैके िलए आपदा :बंधन योजना के औजार के 3प म :यु8 त क� जाएगी (v) तटीय समुदाय1 क� संवेदनशीलता को कम करने और धारणीय जीवनयापन को सुिनि( चत करने क� दिृB ट से तटीय जोन :बंधन योजना (सीजैडएमपी) बनाते समय पAरसंकटमय रेखा और एचटीएल के मQ य?े� के िलए भिूम उपयोग क� योजना को जलवायु पAरवत�न और समु� तट रेखा पAरवत�न के ऐसे :भाव1 को िहसाब म िलया जाएगा । (ग) पैरा 8 म शीष�क ‘’I. सीआरजैड–I. के खंड (i) म उपखंड (च) के प( चात् िनW निलिखत खंड अतं:; 13. का.आ. 2444,,,, तारीख 31 जुलाई,,,, 2017;;;; 14. का.आ. 1227,,,, तारीख 6 अ8 तबूर,,,, 2017;;;; 15. का.आ. 1002,,,, तारीख 6 माच�,,,, 2018 । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 2nd July, 2018 S.O. 3197(E).—Whereas by notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O.19 (E), dated the 6th January, 2011 (hereinafter referred to as the Coastal Regulation Zone Notification, 2011), the Central Government declared certain coastal stretches as Coastal Regulation Zone and restrictions were imposed on the setting up and expansion of industries, operations and processes in the said Zone;
And whereas, representations have been received from the Defence organisations for providing an enabling provision under the Coastal Regulation Zone Notification, 2011 for location of facilities in certain areas which are of strategic requirement and has national importance;
And whereas, representations have also been received from various coastal States and Union territories, besides other stakeholders, regarding certain provisions in the Coastal Regulation Zone Notification, 2011 related to management and conservation of marine and coastal ecosystems, development in coastal areas, eco-tourism, livelihood options and sustainable development of coastal communities, etc;
And whereas, various State Governments and Union territories and stakeholders have requested the Ministry of Environment, Forest and Climate Change to address the concerns related to Coastal Environment and sustainable development with respect to the Coastal Regulation Zone Notification, 2011;
And whereas, the Ministry of Environment, Forest and Climate Change had constituted a committee under the chairmanship of Dr. Shailesh Nayak to examine various issues and concerns of coastal States and Union territories and various stakeholders, relating to the Coastal Regulation Zone Notification 2011 and to recommend appropriate changes in the said notification;
And whereas, the report submitted by Dr Shailesh Nayak Committee has been examined in the Ministry and consultations have been held with various stakeholders in this regard;
And whereas, the Central Government, having regard to the provision of sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, is of the opinion that it is in public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rules for amending the Coastal Regulation Zone Notification, 2011.
Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section
(2) of section 3 of the Environment (Protection) Act, (29 of 1986) read with clause (d) of sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the Coastal Regulation Zone Notification, 2011, namely: —
(a) in the opening paragraph, sub-paragraph (iii) shall be deleted and sub-paragraphs (iv) and (v) shall be renumbered as (iii) and (iv).
(b) in paragraph 5, for sub-paragraphs (iii), (iv) and (v), the following sub-paragraphs shall be substituted, namely:- “(iii) A ‘Hazard line’ shall be demarcated by the Survey of India, taking into account the extent of the flooding on the land area due to water level fluctuations, sea level rise and shoreline changes (erosion/accretion) occurring over a period of time, and shared with the coastal States and Union Territories through the National Centre for Sustainable Coastal Management, Chennai;
(iv) The Hazard line shall be used as a tool for disaster management plan for the coastal environment, including planning of adaptive and mitigation measures;
(v) With a view to reduce the vulnerability of the coastal communities and ensuring sustainable livelihood, while drawing the Coastal Zone Management Plans (CZMPs), the land use planning for the area between the Hazard line and HTL shall take into account such impacts of climate change and shoreline changes;”;
(c) in paragraph 8. Under the heading “I. CRZ-I”, in clause (i), after sub-clause (f), the following clause shall be inserted, namely:- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] “(g) projects relating to Defence organisations which are of strategic requirement and national importance and cannot be located elsewhere, subject to strict environmental safeguards.”.
