10. g wowr, wits, fAEr v vagust, fer F fm aftmmes F =7 § w0 577 F oo Gl aftr #r aftrgfa 0 6w ag ot af G @ gae o S st amarw, af=TgT dw T eft AT FeAt i arad T e giFe of € guersy wrom 11, wrfarreor, e e gaeuey, e F gury dw wEe i dow F o fi, amr a1 de g ST fRrgT e AT R 3 a1 g [%. . 3-11013/36/2008-4TT.11(1)] . o o o T, POITT FHIT ATSIAT, HIH A=A MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 12th August, 2021 S.0. 3271(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.0.1533(E), dated the 14™ September, 2006 (hereinafter referred to as the said notification), and in supersession of the notification of the Govemnment of India in the Ministry of Environment, Forest and Climate Change, number S.O. 1514(E), dated the 5% April, 2018, except as respects things done or omitted to be done before such supersession, the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Bihar (hereinafter referred to as the Authority, Bihar) comprising of the following Members, namely: -

1. Shri Atul Aditya Pandey Chairman; Professor and Head Department of Geology Patna university, Patna

2. Shri Arun Prakash, IAS Member; Retired Special Secretary-cum-Director, Mines and Geology Department, Government of Bihar 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

3. Conservator of Forest-cum-Additional secretary, Member Secretary. Department of Environment, Forest and Climate Change, Government of Bihar

2. The Chairman and Members of the Authority, Bihar shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.

3. The Authority, Bihar shall exercise such powers and follow such procedures as specified in the said notification.

4. The Authority, Bihar shall take its decision on the recommendations of the State Level Expert Appraisal Committee constituted under paragraph 5 for the State of Bihar.

5. For the purpose of assisting the Authority, Bihar, the Central Government in consultation with the State Government of Bihar, hereby constitutes the State Level Expert Appraisal Committee (SEAC) (hereinafter referred to as SEAC, Bihar) comprising of the following Members, namely: -

1. Dr. Gopal Sharma Chairman; Scientist ‘E’ and officer-in-charge, Zoological Survey of India, Gangetic Plains Regional center, Patna

2. Dr. Ramakar Jha Member; Professor, Civil Engineering, NIT, Patna

3. Shri Ranjan Kumar Member; Manager, Project Management Group, TATA Projects Ltd., Patna

4. Dr. Anshumali Member; Associate Professor Environmental Science and Engineering Department, IIM (ISM), Dhanbad

5. Shri Ajit Kumar Samaiyar Member:; Former Senior Adviser, Bihar Disaster Management Authority

6. Dr. Bibha Kumari Member; Department of Zoology, Maghad Mahila College, Patna University, Patna 7 Shri Mokhtarul Haque Member; B.F.S. Adviser, Environment, Forest and Climate Change Department, Government of Bihar, Patna

8. | Dr. Aditya Mohanty Member:; Associate Professor Central University, South Bihar

6. The Chairman and Members of SEAC, Bihar shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.

7. The SEAC, Bihar shall exercise such powers and follow such procedures as specified in the said notification. [STT II—a7E 3(ii)] AT T T - STATETTT 5

8. The SEAC, Bihar shall function on the principle of collective responsibility and the Chairman shall endeavor to reach consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.

9. In order to avoid any conflict of interest -

(a) the Chairman and Members of the Authority, Bihar and SEAC, Bihar shall declare as to which consulting organisation they have been associated with and also the project proponents;

(b) the Chairman and Members of the Authority, Bihar and SEAC, Bihar shall not undertake any consultation or associate with preparation of Environmental Impact Assessment (EIA) Environment Management Plan for a project, which is to be appraised by the Authority, Bihar and SEAC, Bihar during their tenure; and

(c) if in the past five years, the Chairman or any of the Members of the Authority, Bihar and SEAC, Bihar have provided consultancy services or conducted EIA studies for any project proponent, in that event they shall recuse themselves from the meeting of the Authority, Bihar and SEAC, Bihar in the process of appraisal of any project being proposed by such proponents.

10. The Government of Bihar shall notify an agency to act as Secretariat for the Authority, Bihar and SEAC, Bihar and the Secretariat shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all their statutory functions.

11. The sitting fee, travelling allowance and deamess allowance to the Chairman and Members of the Authority, Bihar and SEAC, Bihar shall be paid as per the rules of the State Government of Bihar.
