PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2562] ubZ fnYyh] cq/okj] vDrwcj 26] 2016@dk£rd 4] 1938 No. 2562] NEW DELHI, WEDNESDAY, OCTOBER 26, 2016/KARTIKA 4, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 20 अ तूबर, 2016 का.आ. 3309(अ).—भारत सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢ ालय कᳱ अिधसचूना सं. का.आ. 2599(अ) तारीख 22 िसतंबर, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उसस ेᮧभािवत होने कᳱ सभंावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितया,ं िजसमᱶ यह अिधसचूना अंतᳶव᳥ ह,ै उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमंिᮢत करत ेᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;
और, उᲦ ᮧाᱧप अिधसचूना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सझुावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक ᱧप स ेिवचार ᳰकया गया;
रा᭔य सरकार, मिणपुर के अिधसूचना संया 60/2/95, ᳰदनाकं 24 अᮧलै, 1997 ᳇ारा यह अिधसिूचत ᳰकया गया ह ै ᳰक मिणपुर के टामᱶगलᲂग के िजलाद व᭠यजीव अभयार᭛य मᱶ 21.00 वगᭅ ᳰकलोमीटर ᭃेᮢ सि᭥मिलत है िजसमᱶ सात सरोवर, ᮧिस सात बराक जलᮧपात िनजᱮव पहाड़ी वन का अि᳇तीय पाᳯरि᭭थितक तंᮢ है और िविवध वन᭭पतीय तथा िभ᳖-िभ᳖ जीव-ज᭠तु सिहत तᱶदआु, तᱶदआु िब᭨ली, छोटा भारतीय मु᭫किबलाव, आम लंगूर, ᱟलोक लंगूर, बड़ा भारतीय धनेश, काकड़, सूरज भगत, लजीला वानर, सनुहरी िब᭨ली, सा᭥भर, िसयार, बनैला सूअर, बाघ और हािथयᲂ आᳰद का मौसमी ᮧवजन के जंगली पशु सि᭥मिलत ह ᱹ। और, यह आव᭫यक ह ैᳰक िजलाद व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को पाᳯरि᭭थितक और पयाᭅवरणीय दिृ᭬ ट से पाᳯरि᭭ थितक संवेदी जोन के ᱨप मᱶ संरिᭃत ᳰकया जाए। िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᭬ ट ह ैतथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ के ᮧचालन या ᮧसं᭭करण या उ᳒ोगᲂ के वगᲄ का ᮧचालन और ᮧसं᭭करण करन ेको ᮧितिष करना आव᭫यक है ;
अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) के साथ पᳯठत और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, िजलाद व᭠यजीव अभयार᭛य पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ (िजस ेइसमᱶ इसके 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] प᳟ात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै मिणपुर रा᭔य के िजलाद व᭠यजीव अभयार᭛य कᳱ सीमा स े3.5 ᳰकलोमीटर स े
13.0 ᳰकलोमीटर सीमा ᭃेᮢ को अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानसुार ह,ै अथाᭅत ्:--
1. पाᳯरि᭭थितक सवंदेी जोन का िव᭭तार और उसकᳱ सीमाएं.—(1) पाᳯरि᭭थितक संवेदी जोन िजलाद व᭠यजीव अभयार᭛य कᳱ सीमा से 3.5 ᳰकलोमीटर स े13.0 ᳰकलोमीटर के म᭟य िव᭭ताᳯरत होगी । पाᳯरि᭭थितक संवेदी जोन का ᭃेᮢ 235 वगᭅ ᳰकलोमीटर ह ै।
(2) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का वणᭅन, व᭠यजीव अभयार᭛य और पाᳯरि᭭थितक संवेदी जोन के िनदᱷशांक उपाबधं I के ᱨप मᱶ उपाब ह ै।
(3) अᭃाशं और दशेा᭠तर के साथ-साथ पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का मानिचᮢ उपाबंध II के ᱨप मᱶ उपाब ह ै।
(4) पाᳯरि᭭थितक संवेदी जोन के भीतर आन ेवाल ेᮕामᲂ कᳱ सचूी ᮧमुख िब᭠दᲐु के िनदᱷशाकं के साथ उपाबधं III के ᱨप मᱶ उपाब ह ै।
2. पाᳯरि᭭थितक सवंदेी जोन के िलए आचंिलक महायोजना.—(1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अिंतम ᮧकाशन कᳱ तारीख स ेदो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ स,े इस अिधसूचना मᱶ सलं न अनबुधंᲂ के सामजं᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) पाᳯरि᭭ थितक संवेदी जोन के िलए आचिंलक महायोजना रा᭔ य सरकार ᳇ारा ऐसी रीित मᱶ तैयार कᳱ जाए जो इस अिधसूचना मᱶ िविन᳸द᭬ ट ह ैऔर कᱶ ᮤीय सरकार और रा᭔ य सरकार कᳱ िविधयᲂ तथा ᮓे᭠ᮤीय सरकार ᳇ारा जारी मागᭅदशᱮ िसातं के भी अनᱧुप ह ᱹ।
(4) आंचिलक महायोजना, इसमᱶ पयाᭅवरणीय और पाᳯरि᭭ थितक िवचारᲂ को समाकिलत करने के िलए िन᭥ निलिखत सभी संब रा᭔ य सरकार के िवभागᲂ के परामशᭅ स ेतैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पयᭅटन ;
(v) नगरपािलक ;
(vi) राज᭭ व ;
(vii) कृिष ; और
(viii) मिणपरु रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ, हᲂगे ।
(5) आंचिलक महायोजना अनमुोᳰदत िव᳒मान भ-ूउपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हᲂ और आचंिलक महायोजना मᱶ सभी अवसंरचना ᳰᮓयाकलापᲂ मᱶ दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-सभंरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मदृा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐस ेअ᭠य पहलᲐू, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भिूम, हᳯरत ᭃेᮢ जैस ेउ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(8) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान े वाल े उपाय.—रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन े के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग.—पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंत ुपाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, पैरा 5 के अधीन मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनमुोदन स,े ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद स.ं 26, स.ं 30, स.ं 34, और सं. 39 के सामन ेसूचीब ᳰᮓयाकलापᲂ को पूरा करन ेके िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) ᮧदषूण उ᭜प᳖ न करन ेवाल ेलघु उ᳒ोग;
(ii) पाᳯरि᭭ थितक अनकूुल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैस ेटᱶट, लकड़ी के मकान आᳰद ;
(iii) वषाᭅ जल संचय; और
(iv) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग भी ह ᱹ:
परंत ु यह और ᳰक रा᭔य सरकार के पूवᭅ अनमुोदन तथा सिंवधान के अन᭒ुछेद 244 और त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसिूचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंत ुयह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भ-ूअिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट मानीटरी सिमित के िवचार ᮧा᳙ करन ेके प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामल ेमᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय को सूचना दनेी होगी । परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भ-ूउपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंत ुयह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैस ेवन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत.—आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐस ेᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करन ेके िलए ऐसी रीित स ेमागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन.—(क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो पयᭅटन महायोजना के अनुसार हᲂगे, आंचिलक महायोजना का भाग ᱨप मᱶ िन᳜िलिखत ᱨप मᱶ हᲂगे । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, मिणपुर सरकार ᳇ारा राज᭭ व और वन िवभाग, मिणपुर सरकार के परामशᭅ से तयैार होगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤ सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा राष् ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा सशंोिधत) मागᭅदशᭅक िसांतᲂ के अनसुार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और ᳯरसोटᭅ के नए संिनमाᭅण अनु᭄ात नहᱭ हᲂगे ।
(iii) आंचिलक महायोजना का अनमुोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगक िवरासत.—पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाए,ं जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थलᲂ.—पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख स ेछह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण.—पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनसुरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(7) वाय ुᮧदषूण.—पाᳯरि᭭थितक संवेदी जोन मᱶ, वाय ुᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनसुरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण.—पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण जल (ᮧदषूण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥.—ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय सघंटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम स े पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट.—पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासशंोिधत अिधसूचना िज.एस.आर. 343(अ) तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय पᳯरवहन.—पᳯरवहन कᳱ यानीय गितिविधया ंआवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध िनगिमत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होन ेऔर पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के अनुमोᳰदत होने तक, मानीटरी सिमित सुसंगत अिधिनयमᲂ और ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
4. पाᳯरि᭭थितक सवेंदी जोन मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सचूी.—पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और इसके अ᭟यधीन बनाए गए िनयमᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत ्:-- सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
(1) वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़न ेकᳱ इकाइया ं। (क) सभी ᮧकार के खनन (लघ ुऔर वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़न ेकᳱ इकाइया ं वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िसवाय नहᱭ हᲂगी ;
(ख) खनन संᳰᮓयाए,ं माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) स.ं 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमलूपाद बनाम भारत सरकार के मामल ेमᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) स.ं 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामल ेमᱶ तारीख 21 अᮧैल, 2014 के अतंᳯरम आदशे के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
(2) आरा मीलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(3) जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदषूण काᳯरत करने वाल ेउ᳒ोगᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(4) जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(5) नए बृहत जल िव᳒ुत पᳯरयोजना का ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(6) ᭡ लाि᭭ टक के थैलᲂ का उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(7) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(8) भिूम के उपयोग के पैटनᭅ मᱶ ᮧबल बदलाव । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(9) तेल, ᮧाकृितक गैस, जिैवक धन के पᳯरवहन के िलए भिूमगत पाइपलाइन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(10) खतरनाक पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) । िविनयिमत ᳰᮓयाकलाप
(11) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुिमित के िबना वन, सरकारी या राज᭭व या िनजी भिूम पर या वनᲂ मᱶ ᳰक᭠ही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत के᭠ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनसुार िविनयिमत होगी ।
(12) होटलᲂ और ᳯरसोटᲄ कᳱ वािणि᭔यक ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप स े संबंिधत पयᭅटकᲂ के अ᭭थायी ᳞वसाय के िलए आवास के सबंंध मᱶ संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर या पाᳯरि᭭थितक सवेंदी जोन कᳱ सीमा तक, जो भी िनकट हो, के भीतर ही नए वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को अनु᭄ात ᳰकया जाएगा अ᭠यथा नहᱭ :
परंतु 1 ᳰकलोमीटर से परे या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱧप होगा ।
(13) पयᭅटन स े संबंिधत रᲯुमागᲄ के भािंत ᳰᮓयाकलाप जैस ेगमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा अभयार᭛य ᭃेᮢ के ऊपर स ेउड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(14) संिनमाᭅण ᳰᮓयाकलाप A (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक सवंेदी जोन जो भी िनकट हो कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय लोगᲂ को परैा 3 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भिूम मᱶ संिनमाᭅण करन ेकᳱ अनमुित दी जाएगी । पर᭠त ुयह और ᳰक ऐस ेलघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते हᱹ, से संबंिधत सिंनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनमुित स ेही ᭠ यूनतम पर रखे जाएंगे । (ख) इसके अितᳯरᲦ पाᳯरि᭭थितक संवेदी जोन से परे, सदभािवक ᭭ थानीय आव᭫ यकताᲐ के िलए संिनमाᭅण कᳱ अनु᭄ा दी जाएगी और अ᭠ य वािणि᭔ यक संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे।
(15) वािणि᭔यक जल ससंाधन िजसके अंतगᭅत भ-ूजल संचयन भी ह ै। (क) भिूम के अिधभोगी के वा᭭तिवक कृिष और घरेल ूखपत के िलए जल का िन᭬कषᭅण (सतही और भिूमगत जल) अनु᭄ात होगा । (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भिूमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतन ेपᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह ै। (ग) सतही या भजूल का िवᮓय अनु᭄ात नहᱭ होगा । (घ) जल के संदषूण या ᮧदषूण, िजसके अंतगᭅत कृिष भी ह,ै को रोकने के िलए सभी उपाय ᳰकए जाएंगे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
(16) कृिष ᮧणाली मᱶ ᮧबल बदलाव । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(17) िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण । भिूमगत केबलᲂ को ᮧो᭜ साहन दनेा ।
(18) होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(19) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ, रेल पटरी का संिनमाᭅण । उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लागू अनुसार हᲂगे ।
(20) रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
(21) िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(22) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(23) वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(24) वायु (िजसमᱶ ᭟विन भी सि᭥मिलत ह)ै और यािनक ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(25) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᮓण को ᮧो᭜सािहत करना और अबमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
(26) ᮧदषूण उ᭜प᳖ न करने वाल ेलघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन स े गैर ᮧदषूण, गैर पᳯरसकंटमय, लघु और सेवा उ᳒ोग, कृिष, पु᭬ प कृिष, कृिष उ᳒ान या कृिष आधाᳯरत उ᳒ोग, जो दशेीय माल स े औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन करते ह ᱹऔर जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालत ेहᱹ, को अनु᭄ात ᳰकया जाएगा ।
(27) वन उ᭜पादᲂ और गैर का᳧ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(28) सुरᭃा बलᲂ के कᱹप । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(29) नए का᭬ ठ आधाᳯरत उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन कᳱ सीमाᲐ के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰकया जाएगा :
परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ नए का᭬ ठ आधाᳯरत उ᳒ोग ᭭थािपत ᳰकए जाएंगे िजसमᱶ 100 ᮧितशत आयाितत का᳧ का उपयोग होगा ।
(30) पाᳯरि᭭थितक अनकूुल पयᭅटक ᳰᮓयाकलापᲂ के िलए, पयᭅटकᲂ के अ᭭थायी आवासन के िलए पाᳯरि᭭ थितक अनकूुल कुटीर, जैस े तंबू, लकड़ी के घर आᳰद । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(31) पाᳯरि᭭थितक-पयᭅटन ᳰᮓयाकलाप । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(32) ठोस अपिश᳥ ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । सवंᳶधत ᳰᮓयाकलाप
(33) ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ दुधशाला डयेरी उ᳒ोग और मछली पालन । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(34) वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।

(36) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
(37) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(38) वान᭭ पितक बाड़ । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
(39) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह।ᱹ सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
(40) कृिष वािनकᳱ। सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
(41) कौशल िवकास। सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
(42) पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
5. पाᳯरि᭭थितक सवंदेी जोन मानीटरी सिमित.—(1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत स ेिमलकर बनेगी, अथाᭅत ्:- (क) संबंिधत उपायᲦु - अ᭟यᭃ ;
(ख) ᭃेᮢ का ᭔ये᳧ योजनाकार – सद᭭ य ;
(ग) ᭔ये᳧ पयाᭅवरण इंजीिनयर, मिणपुर रा᭔य, ᮧदषूण िनयंᮢण बोडᭅ, इ᭥फाल – सद᭭ य ;
(घ) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करन ेवाल ेगैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए मिणपुर रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध - सद᭭य ;
(ङ) मिणपरु सरकार ᳇ारा नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए एक िवशेष᭄ - सद᭭य ; और (च) रा᭔य जैव-िविवधता बोडᭅ का सद᭭य -सद᭭य;
(च) उपवन सरंᭃक – सद᭭य सिचव । िनदᱷश िनबंधन
(2) मानीटरी सिमित का कायᭅकाल तीन (3) वषᭅ का होगा।
(3) मािनटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी।
(4) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ.
1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनसुूची मᱶ सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आन ेवाल ेऐस ेᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी।
(5) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयाकं का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐस े ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंत ु पाᳯरि᭭थितक संवेदी जोन मᱶ आत े ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9
(6) मानीटरी सिमित का सद᭭य-सिचव या संबिधत उप सरंᭃक वन/उ᳒ान और अभयार᭛य, कोई ᳞िᲦ जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै उसके िवᱧ पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा ।
(7) मानीटरी सिमित मुᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहत ेᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिध ᮧित मुे कᳱ अपेᭃाᲐ के अनुसार िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(8) मानीटरी सिमित ᮧ᭜यके वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय व᭠यजीव वाडᭅन को उपाबधं IV पर उपाब ᮧाᱨप पर 30 जून तक ᮧ᭭तुत करेगी ।
(9) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपन े कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदशे दे सकेगा, जो वह ठीक समझ े।
6. इस अिधसूचना के उपबंधᲂ को ᮧभाव दनेे के िलए कᱶ ᮤीय सरकार और रा᭔ य सरकार अितᳯर त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकᱶ गे ।

8. कोई अ᭠ य मह᭜ वपणूᭅ िवषय । [फा. सं. 25/27/2015-ईएसजेड-आरई] डॉ. टी. चांदनी, वै᭄ािनक ‘जी’ MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, 20th October, 2016 S.O. 3309(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 2599 (E), dated the 22nd September, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13 AND WHEREAS, no objections and suggestions received from persons and stakeholders in response to the draft notification;
AND WHEREAS, the Zeilad Wildlife Sanctuary in Tamenglong District of Manipur notified vide State Government of Manipur notification number 60/2/95, dated the 24th April, 1997, covering over an area of 21.00 square kilometres, has got unique ecosystem of seven lakes, famous seven step Barak Waterfall and Semi Evergreen and Wet Hill Forests hosting varied floral and faunal diversity including Leopard, Leopard cat, small Indian civet, Common Langur, Hoolock gibbon, Great Indian Hornbill, barking deer, flying squirrel, Slow Loris, Golden cat, Sambar, Jackal, Pangolin, Wild boars, seasonal migration of tiger and elephants etc.;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of the Zeilad Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1), clause (v) and clause
(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 3.5 to 13.0 kilometres from the boundary of the Zeilad Wildlife Sanctuary in the State of Manipur as the Zeilad Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1)The extent of Eco-sensitive Zone is varies from
3.5 to13 kilometres from the boundary of the Zeilad Wildlife Sanctuary and the area of Eco- sensitive Zone is 235 square kilometres.
(2) The boundary description of the Eco-sensitive Zone, Co-ordinates of Wildlife Sanctuary and Ecosensitive Zone are appended as Annexure I.
(3) The map of Eco-sensitive Zone boundary together with its latitude and longitude is appended as Annexure II .
(4) The list of the villages falling within Eco-sensitive Zone along with coordinates of the prominent points is appended as Annexure III.
2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- i. Environment;
ii. Forest;
iii. Urban Development;
iv. Tourism;
v. Municipal;
vi. Revenue;
vii. Agriculture; and viii. Manipur State Pollution Control Board, for integrating environmental and ecological considerations into it.

(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone so as to ensure ecofriendly development and livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zonemay be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 26, 30, 32 and 37 in column (2) of the Table in paragraph 4, namely:-
(i) Small scale industries not causing pollution;
(ii) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Ecofriendly tourism activities;
(iii) Rainwater harvesting; and
(iv) Cottage industries including village artisans:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.-(i)The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Manipur in consultation with Department of Revenue and Forests, Government of Manipur.
(c) The activity of tourism shall be regulated as under, namely.- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of Environment, Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the ZonalMaster Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981)and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981)and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974)and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government and the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.-All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:- TABLE Sl. (a) All new and existing mining (minor and major minerals), stone quarrying and crushing units are prohibited except for the domestic needs of bona fide local residents.

Union of India in Writ Petition (Civil) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
5. Establishment of new major hydroelectric projects.
Prohibited (except as otherwise provided) as per applicable laws.
6. Uses of plastic carry bags. Prohibited (except as otherwise provided) as per applicable laws.
7. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
8. Drastic change of land use pattern. Prohibited (except as otherwise provided) as per applicable laws.
9. Underground pipelines for transport of oil, natural gases, bio-fuel .
Prohibited (except as otherwise provided) as per applicable laws.
10. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
B. RegulatedActivities:
11. Felling of trees. (a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.

12. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond one kilometer or up to the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Tourism Master Plan.
13. Undertaking activities related to tourism like rope ways, over-flying the sanctuary area by hot-air balloons, etc.
Regulated under applicable laws.
14. Construction activities. (a) No new commercial construction of any kind shall be permitted within one km from the boundary of Zeilad Wildlife Sanctuary or Eco-Sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre upto the extent of Eco sensitive Zone construction for bona fide local needs shall be permitted and other construction activities shall be regulated as per Zonal Master Plan.
15. Commercial water resources including ground water harvesting.
(a)The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.
(b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned regulatory authority.
(c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
16. Drastic change of agriculture system. Regulated under applicable laws.
17. Erection of electrical cables and telecommunication towers.
Promote underground cabling.
18. Fencing of existing premises of hotels and lodges.

Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
26. Small scale industries not causing pollution.
Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Eco-sensitive Zone which do not cause any adverse impact on environment shall be permitted.
27. Collection of Forest produce or Non- Timber Forest Produce (NTFP).

28. Security Forces Camp. Regulated under applicable laws.
29. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone:
Provided that new wood based industry may be set up in the Eco-sensitive using 100% imported wood stock.
30. Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities.

5. Eco-sensitive Zone Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(a) The Concerned Deputy Commissioner – Chairman;
(b) Senior Town Planner of the area - Member;
(c) Senior Environment Engineer, Manipur State Pollution Control Board, Imphal-Member;
(d) A representative of Non-governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Manipur for a term of three year in each cash – Member;
(e) One expert in the area of ecology and environment to be nominated by the Government of Manipur for a term of three year in each cash - Member;
(f) Member Biodiversity Board - Member; and
(g) Deputy Conservator of Forests - Member Secretary.

(2) The tenure of the Committee shall be three years.
(3) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(4) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(5) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(6) The Member-Secretary of the Monitoring Committee or the concerned Deputy Conservator of Forests / Park and Sanctuaryshall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(7) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(8) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State per proforma appended at Annexure IV .
(9) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed or to be passed by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
Annexure I Limits and boundaries of the Eco-sensitive Zone of Zeilad Wildlife Sanctuary.
North: Station No. 8 to Station No.12 of Jiri-Makru Wildlife Sanctuary is the northern boundary of the Zeilad Wildlife Sanctuary. Starting from Station No.8 of Jiri Makru Eco-sensitive zone where the Doudong- Pang stream meets the Barak River, the line runs towards westerly direction along the hill ridge upto Station No.9 (Saramba village), then following the Inter Village Road (IVR) to Mandu village passing though Station No. 10 where the IVR crosses Alum stream, then following the IVR, the line passes through Station No.11 and then Station No.12 on Makru River where Singiu stream meets Makru River, East: Starting from Station No.8 of Jiri Makru Eco-sensitive zone where the Doudong-Pang stream meets the Barak River, the line runs along southerly direction along the Barak River upto Vanchenphai village (Station No.1), then it follows along the Duiza ThokLokupto Station No.4 (confluence of two small loks), then along the eastern tributary of DuizaThok / LokuptoTabanglong village (Station No.5), then along the IVR crossing Sanlungpang village (Station No.6), Semapng village (Station No.7) uptoKaiko (Namkaolong) village (Station No.8).
South: From Kaiko (Namkalong) village (Station No.8), the line runs westerly direction along the IVR from Namkaolong village upto Barak River (Station No.9), then continues along the IVR crossing through Lungjamvillage (Station No.10), Chingkholong village (Station No.11), Sibilong village boundary (Station No.12) upto Station No.13 (Hill top).
