6. नगरपािलका आयुM त, Oेटर मुQ बई नगर िनगम या एमसीजीएम ारा पदािभिहत/नामिनSदA ट उपसिचव क� पंिM त से अ� यनू अिधकारी सदLय पदने; 7. वन संर�क, मैनOोव सेल, मुQ बई या मैनOोव सेल ारा नामिनSदA ट उप मु2 य वन संर�क क� पंिM त से अ� यून अिधकारी। सदLय पदने; 8. िनदशेक, के�Tय सामु��क म) L यपालन अनुसंधान का मुQ बई अनुसंधान क� �, वरसोवा, अंधेरी, मुQ बई सदLय पदने; 9. डा. ए.के. चौबे, िनदशेक !ादिेशक आ�फस, एनआईओ, अंधेरी मुंबई । सदLय; 10. िम. कुडले, पूव� अपर िनदशेक, स�Bल वाटर एंड पावर Wरसच� L टेशन, पुणे सदLय; 11. डा. महशे Xशिडकर, !ोफेसर, कालेज ऑफ इंजीिनयZरग, पूणे सदLय; 12. डा. खोट महादवे सत[ पा, !धानाचाय�, छ+. शQ भाजी राजे, सैिनक L कूल खेड, रतनिगWर सदLय; 13 िनदशेक, पया�वरण िवभाग, महाराA B सरकार सदLय सिचव पदने। 2. !ािधकरण का मु2 यालय मुंबई म� होगा । 3. !ािधकरण क� बैठक क� गणपू_त, उसके कुल सदL य$ क� एक ितहाई सदL य होगी । 4. पदने सदL य से िभ� न सदL य को, क� �ीय सरकार ारा िनयत मानक$ के अनुसार भ) ते दये ह$गे । 5. !ािधकरण, महाराA B राa य म� तटीय पया�वरण क� M वािलटी को संरि�त करने और सुधारने तथा तटीय िविनमय जोन �े+$ म� पया�वरणीय !दषूण के िनवारण, उपशमन और िनयं+ण के उbेc य$ के िलए िनQ निलिखत उपाय करेगा, अथा�त्:- (i) !ािधकरण, पWरयोजना !L ताव के अनुमोदन के िलए आवेदन !ाि[ त के पc चात्, य�द वह अनुमो�दत तटीय जोन !बंध योजना के अनुसरण म� हe और भारत सरकार के पया�वरण और वन मं+ालय ारा जारी क� गई तटीय िविनमय जोन अिधसूचना सं2 याकं का.आ. 19(अ), तारीख 6 जनवरी, 2011 (िजसे इसम� इसके पc चात् उM त अिधसूचना कहा गया ह)ै क� अपे�ाf के भीतर है तो उसका परी�ण करेगा और संबg !ािधकरण ऐसी पWरयोजना के अनुमोदन के िलए, जैसा �क उM त अिधसूचना म� िविनSदA ट ह,ै ऐसे आवेदन क� !ाि[ त क� तारीख से साठ �दन के भीतर िसफाWरश करेगा; (ii) !ािधकरण, उM त अिधसूचना म� िविनSदA ट �कए गए के अनुसार तटीय िविनमय जोन म� सभी िवकासा) मक �=याकलाप$ को िविनयिमत करेगा; (iii) !ािधकरण, उM त अिधसूचना के उपबंध$ का !वत�न और मानीटरी के िलए उ) तरदायी होगा; (iv) !ािधकरण, तटीय िविनमय जोन �े+$ और तटीय जोन !बंध योजना के वगiकरण म� पWरवत�न या उपांतरण$ के िलए राa य सरकार से !ा[ त !L ताव$ क� परी�ा करेगा और राA Bीय तटीय जोन !बंध !ािधकरण को उस पर िविनSदA ट िसफाWरश दगेा; (v) !ािधकरण, उM त अिधिनयम या उसके अधीन बनाए गए िनयम$ के उपबंध$ के अिभकिथत अित=मण के मामल$ म� जांच करेगा और उM त अिधिनयम तथा उसके अधीन बनाए गए िनयम$ के उपबंध$ के अित=मण या उ� लंघन को अंतव�िलत करने वाले मामल$ का पुन_वलोकन करेगा;
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 (vi) !ािधकरण, उM त अिधसूचना के अित=मण या उ� लंघन के मामल$ म� L व!ेरणा से या �कसी k यिA ट या िनकाय या संगठन ारा �कए गए पWरवाद के आधार पर जांच या पुन_वलोकन करेगा; (vii) !ािधकरण, उM त अिधिनयम क� धारा 19 के अधीन पWरवाद फाइल करने के िलए !ािधकृत ह;ै (viii) !ािधकरण, उसके सम� तn य$ को स) यािपत करने के िलए जैसा अपेि�त ह,ै उM त अिधिनयम क� धारा 10 के अधीन कार�वाई करेगा । 6. !ािधकरण, अपने कृ) य$ म� पारद_शता बनाए रखने के उbेc य के िलए एक सम_पत वेबसाइट तैयार करेगा और इसके कृ) य, िजसके अंतग�त बैठक$ म� काय�सूची, बैठक$ का काय�वृ) त, !) यके बैठक$ म� �कए गए िविनc चय, उM त अिधसूचना के अित=मण तथा उ� लंघन के मामल$ म� िसफाWरश� और ऐसे अित=मण तथा उ� लंघन पर क� गई कार�वाई और � यायालय मामले िजसके अंतग�त � यायालय$ के आदशे हe और राa य सरकार क� अनुमो�दत तटीय जोन !बंध योजना से संबंिधत सूचना डालेगा । 7. !ािधकरण छह माह म� कम से कम एक बार अपने �=याकलाप$ क� Wरपोट� राA Bीय तटीय जोन !बंध !ािधकरण को भेजेगा । [फा. सं. 12-5/2005-आईए.III(भाग)] Wरतेश कुमार Xसह, संयुM त सिचव MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE ORDER New Delhi, the 6th July, 2018 S.O. 3312(E).—In exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereinafter referred to as the said Act) and in supersession of the notification of the Government of India, Ministry of Environment, Forest and Climate Change number S.O.1054(E), dated 13 th April, 2015 except in respect of things done or omitted to be done before such suppression, the Central Government hereby constitutes an authority to be known as the Maharashtra Coastal Zone Management Authority (hereinafter referred to as the Authority) consisting of the following persons, for a period of three years, with effect from the date of publication of this notification in the Official Gazette, namely:— S.N. (i) Additional Chief Secretary or Principal Secretary or Secretary, Environment Department, Government of Maharashtra Chairperson, ex-officio;
(ii) Additional Chief Secretary or Principal Secretary or Secretary, Revenue Department, Government of Maharashtra Member, ex-officio;
(iii) Additional Chief Secretary or Principal Secretary or Secretary Urban Development Department-1, Government of Maharashtra Member, ex-officio;
(iv) Commissioner or Joint Commissioner of Fisheries (Marine) or Asstt.
Commissioner of Fisheries (Marine), Fisheries Department, Government of Maharashtra Member, ex-officio;
(v) Additional Chief Secretary or Principal Secretary or Secretary, Industries Department, Government of Maharashtra Member, ex-officio;
(vi) Municipal Commissioner, Municipal Corporation of Greater Mumbai or Officer not below the rank of Deputy Secretary designated/nominated by Municipal Corporation of Greater Mumbai Member, ex-officio;
(vii) Conservator of Forest, Mangrove Cell, Mumbai or not below the rank of Deputy Chief Conservator of Forest nominated by Mangrove Cell Member, ex-officio;
(viii) Director, Mumbai Research Centre of Central Marine Fisheries Research, Versova, Andheri, Mumbai Member, ex-officio;
(ix) Dr. A.K.Chubey, Director, Regional Office, National Institute of Oceanography (NIO), Andheri, Mumbai Member;
(x) Mr. Kudale, Ex-Additional Director, Central Water and Power Research Station, Pune Member;

2. The Authority shall have its headquarters at Mumbai.
3. The quorum for the meeting of the Authority shall be one-third of the total number of its Members.
4. A Member, other than an ex-officio Member, shall be paid allowances as per the norms fixed by the Central Government.
5. The Authority shall, for the purposes of protecting and improving the quality of the costal environment and preventing, abating and controlling environmental pollution in the Coastal Regulation Zone areas in the State of Maharashtra, take the following measures, namely:—
(i) the Authority shall, after receiving the application for approval of project proposal, examine the same if it is in accordance with the approved Coastal Zone Management Plan and within the requirements of the Coastal Regulation Zone notification issued by the Government of India in the Ministry of Environment and Forests vide number S.O.19(E), dated the 6th January, 2011 (hereinafter referred to as the said notification), and make recommendations for approval of such project to the concerned authority, as specified in the said notification, within a period of sixty days from the date of receipt of such application;
(ii) the Authority shall regulate all developmental activities in the Coastal Regulation Zone areas as specified in the said notification;
(iii) the Authority shall be responsible for enforcing and monitoring the provisions of the said notification;
(iv) the Authority shall examine the proposals received from the State Government for changes or modifications in the classification of Coastal Regulation Zone areas and in the Coastal Zone Management Plan and make specific recommendations thereon, to the National Coastal Zone Management Authority;
(v) the Authority shall inquire into cases of alleged violation of the provisions of the said Act or the rules made thereunder; and review the cases involving violations or contraventions of the provisions of the said Act and the rules made thereunder;
(vi) the Authority shall inquire or review cases of violations or contraventions of the said notification suomoto, or on the basis of a complaint made by any individual or body or organisation;
(vii) the Authority is authorised to file complaints under section 19 of the said Act;
(viii) the Authority shall take such action as may be required under section 10 of the said Act, to verify the facts of the cases before it.
6. The Authority shall, for the purpose of maintaining transparency in its functioning, create a dedicated website and post the information relating to its functions, including the agenda in its meetings, minutes of the meetings, decisions taken in each meetings, recommendations for matters on violations and contravention of the said notification and actions taken on such violations and contraventions, court matters including the orders of the Courts and the approved Coastal Zone Management Plan of the State Government.
7. The Authority shall furnish reports of its activities at least once in six months to the National Coastal Zone Management Authority.
