1. पयररधथथधतकी सवंदेी जोन कय धवथतयर और ईसकी सीमयए-ं-(1) पयररधथथधतकी संवेदी जोन ओरछय वन्यजीव ऄभययरण्य की सीमय 2 दकलोमीटर क धवथतयररत ह , ओरछय िहर के अवयसीय क्षेत्र (100 मीटर पररधध) और II (ii) 3 ईत्तर प्रदिे के क्षेत्र को छोडकर और पयररधथथधतकी संवदेी जोन कय क्षेत्रफ 24.84 वगा दकलोमीटर ह।ै पयररधथथधतकी की सीमय कय वणान ईपयबधं-I में ददयय गयय ह।ै
(2) ओरछय और पयररधथथधतकी क सयमंजथय ईपयबधं-II औ ईपयबधं-III में ददए गए हैं।
(3) पयररधथथधतकी संवेदी जोन के ऄधीन अने वयल े17 ग्रयमों की सूची और ईनके धनदिेयंक ईपयबधं- IV के रूप में ह।ै
(4) के ब्यौरे और ऄक्षयिं और दिेयन्तर के सयथ पयररधथथधतकी संवेदी जोन कय मयनधच त्र ईपयबधं-V के रूप में संलग्न ह ै।
2. पयररधथथधतकी सवंेदी जोन के धलए अचंधलक महययोजनय – (1) रयज्य सरकयर, पयररधथथधतकी संवेदी जोन प्रयोजन के धलए रयजपत्र में आस ऄधधसूचनय के प्रकयिन की तयरीख से दो विा की ऄवधध के भीतर, थथयनीय व्यधियों के परयमिा से और आस ऄधधसूचनय में संलग् न ऄनुबंधों के सयमंजथ य से अंचधलक महययोजनय तैययर करेगी ।
(2) रयज्य सरकयर द्वयरय पयररधथथधतकी संवेदी जोन के धलए अचंधलक महययोजनय आस तरह, आस ऄधधसूचनय में धवधनर्ददष् ट रीधतयय तथय सुसगंत कें रीय और रयज् य धवधधयों के सयमंजथ य और कें रीय सरकयर द्वयरय जयरी मयगाधनदिेों, यदद कोइ हों, द्वयरय तैययर होगी ।
(3) अंचधलक महययोजनय, पययावरणीय और पयररधथथधतकी धवचयरों को समयकधलत करने के धलए रयज् य सरकयर के सभी संबद्ध धवभयगों के परयमिा से तैययर होगी, ऄथयात:्--
(i) पययावरण;
(ii) वन और वन्यजीव;
(iii) कृधि ;
(iv) रयजथ व;
(v) िहरी धवकयस;
(vi) पयाटन;
(vii) ग्रयमीण धवकयस;
(viii) चसचयइ और बयढ़ धनयंत्रण;
(ix) नगरपयधलकय;
(x) पंचययती रयज;
(xi) लोक धन मयाण धव भयग ।
(4) अंचधलक महययोजनय ऄनुमोददत धवद्यमयन भू-ईपयोग, ऄवसंरचनय और दरययकलयपों पर कोइ धनबंधन ऄधधरोधपत नहीं करेगी जब तक दक आस ऄधधसूचनय में धवधनर्ददष् ट न हो और ईि योजनय सभी ऄवसरंचनय और दरययकलयपों में और ऄधधक दक्षतय और पयररधथथधतकी ऄनुकूलतय कय संवधान करेगी ।
(5) अंचधलक महययोजनय में ऄनयच्छयददत क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकययों के संरक्षण, अवयह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदय और नमी संरक्षण, थथयनीय समुदययों की अवश्यकतयओं तथय पयररधथथधतकी और पययावरण स ेसंबंधधत ऐसे ऄन्य पहलुओं, धजन पर ध्ययन दनेय अवश्यक ह,ै के धलए ईपबंध होंग े।
(6) अंचधलक महययोजनय सभी धवद्यमयन पूजय थ थलों, ग्रयमों और नगरीय बंदोबथतों, वनों के प्रकयर और दकथ मों, कृधि क्षेत्रों, उपजयउ भूधम, हररत क्षेत्र जसैे पयकों और ईसी प्रकयर के थ थयन, ईद्ययन कृधि क्षेत्र, फलोद्ययनों, झीलों 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और ऄन्य जलयियों कय मयनधचत्र की मदद से ऄभ्यकंन करेगी और योजनय कय मयनधचत्र द्वयरय धवद्यमयन और प्रथतयधवत भूधम के ईपयोग कय ब्यौरय दतेे हुए समथान दकयय जयएगय ।
(7) अंचधलक महययोजनय पयररधथथधतकी संवेदी जोन में धवकयस को, थ थयनीय समुदययों की जीधवकय सुरक्षय के धलए पयररधथथधतकी ऄनकूुल धवकयस को सधुनधश् चत करते हुए धवधनयधमत करेगी ।
(8) अंचधलक महययोजनय आस ऄधधसूचनय के ऄधीन ऄपने धनगरयनी कययों को करने के धलए धनगरयनी सधमधत के धलए एक संदभा दथतयवेज तैययर करेगी ।
3. रयज्य सरकयर द्वयरय दकए जयन ेवयल ेईपयय-- रयज्य सरकयर आस ऄधधसूचनय के ईपबंधों को प्रभयवी करन ेके धलए धनम्नधलधखत ईपयय करेगी, ऄथयात:्--
(1) भ-ूईपयोग – पयररधथथधतकी संवेदी जोन में वनों, ईद्ययन-कृधि क्षेत्रों, कृधि क्षेत्रों, अमोद-प्रमोद के प्रयोजन के धलए धचधन्हत दकए गए पयकों और खुल े थथयनों कय वयधणधज्यक और औद्योधगक दरययकलयपों के धलए ईपयोग यय संपररवतान नहीं होगय और के सयथ क ह में थपष्ट रूप से क्षेत्रों को धनधयाररत दकयय जयएगय: परंतु पयररधथथधतकी संवेदी जोन के भीतर कृधि भूधम ऐसे और ऄन्य भूधम कय संपररवतान धनगरयनी सधमधत की धसफयररि पर और रयज्य सरकयर के पूवा ऄनुमोदन स,े जो थथयनीय धनवयधसयों की अवयसीय जरूरतों को पूरय करन े के धलए ह,ै ऄनुज्ञयत दकयय जयएगय जैस:े-
(i) धवद्यमयन सडकों को चौडय करनय और ईन्हें सुदढृ करनय तथय नइ सडकों कय संधनमयाण;
(ii) बुधनययदी ढयंचों और नयगररक सुख सुधवधयओं कय संधनमयाण और नवीकरण;
(iii) प्रदिूण ईत्पन्न न करन ेवयले लघु ईद्योग;
(iv) कुटीर ईद्योगों धजसके ऄंतगात ग्रयमीण ईद्योग; सुधवधयजनक भण्डयर और थथयनीय सुधवधयओं कय समथान करन े वयले वयसगृह सधहत पयररधथथधतकी पयाटन भी ह;ै और
(v) पैरय 4 में यथय सूचीबद्ध संवर्वधत दरययकलयप: परंतु यह दक रयज्य सरकयर के पूवा ऄनुमोदन तथय संधवधयन के ऄनचु्छेद 244 और तत्समय प्रवृत्त धवधध के ईपबंधों के ऄनुपयलन के धबनय, धजसके ऄंतगात ऄनुसूधचत जनजयधत और ऄन्य परंपरयगत वन धनवयसी (वन ऄधधकयरों की मयन्यतय) ऄधधधनयम, 2006 (2007 कय 2) भी ह,ै वयधणधज्यक यय ईद्योग धवकयस दरययकलयपों के धलए जनजयतीय भूधम कय ईपयोग ऄनुज्ञयत नहीं होगय: परंतु यह और दक पयररधथथधतकी संवेदी जोन के भीतर भू-ऄधभलेखों में ईपसंजयत कोइ त्रुरट, धनगरयनी सधमधत के धवचयर प्रयप्त करन ेके पश्चयत् रयज्य सरकयर द्वयरय प्रत्येक मयमल ेमें एक बयर संिोधधत होगी और ईि त्रुरट के संिोधन की सूचनय कें रीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को दनेी होगी । परंतु यह और दक ईपयुाि त्रुरट कय संिोधन में आस ईप पैरय के ऄधीन यथय ईपबंधधत के धसवयय दकसी भी दिय में भ-ू ईपयोग कय पररवतान सधममधलत नहीं होगय । परंतु यह और भी दक धजससे हररत क्षेत्र में जैस ेवन क्षेत्र, कृधि क्षेत्र अदद में कोइ पयररणयधमक कटौती नहीं होगी और ऄनप्रयुक् त यय ऄनुत् पयदक कृधि क्षेत्रों में वनरोपण और अवयस पुनद्द्धयर दरययकलयपों के सयथ पुन: वनीकरण करन े के प्रययस दकए जयएगें । II (ii) 5
(2) प्रयकृधतक जल स्रोत -- अचंधलक महययोजनय में सभी प्रयकृधतक जल स्रोतों की पहचयन की जयएगी और ईनके संरक्षण और पुनद्द्भूतकरण के धलए योजनय सधम मधलत होगी और रयज् य सरकयर द्वयरय ऐसे क्षेत्रों पर यय ईनके धनकट धवकयस दरययकलयप प्रधतधिद्ध करने के धलए ऐसी रीधत से मयगादिाक धसद्धयन्त तैययर दकए जयएगें ।
(3) पयाटन – (क) पयररधथथधतकी संवेदी जोन के भीतर नये पयाटन पयररधथथधतकी सवंेदी जोन के धलए दरययकलयप यय धवद्यमयन पयाटन दरययकलयपों कय धवथतयर पयाटन महययोजनय के ऄनुसयर होंगे । (ख) पयाटन महययोजनय पयाटन धवभयग, द्वयरय पययावरण और वन धवभयग, रयज्य सरकयर के परयमिा से तैययर होगी । (ग) पयाटन महययोजनय अंचधलक महययोजनय के एक घटक के रूप में जयनय जयएगय । (घ) पयाटन संबंधी दरययकलयप धनम नधलधखत के ऄधीन धवधनयधमत होंगे, ऄथयात् :-
(i) ओरछय वन्यजीव ऄभययरण्य की सीमय से 1 दकलोमीटर तक यय पयररधथथधतकी संवेदी जोन के धवथतयर तक आनमें जो भी धनकट ह,ै नये वयधणधज्यक होटल और ररसोटा ऄनुज्ञयत नहीं होंगे : परन्तु वन्यजीव ऄभययरण्य की सीमय से 1 दकलोमीटर की दरूी से अगे नये होटल और ररसोटा कय थथयपनय पयाटन महययोजनय के ऄनुसयर पयररधथथधतकी पयाटन सुधवधयओं के धलए पूवा पररभयधित और पदयधभधहत वगों के धलए ऄनुज्ञयत दकयय जयएगय;
(ii) पयररधथथधतकी संवेदी जोन के भीतर सभी नए पयाटन दरययकलयपों यय धवद्यमयन पयाटन दरययकलयपों कय धवथतयर कें रीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय के मयगादिाक धसद्धयंतों के द्वयरय तथय रयष् रीय ा ययघ्र स सरंक्षण प्रयधधकरण, द्वयरय जयरी पयररधथथधतकी पयाटन (समय-समय पर यथय संिोधधत) मयगादिाक धसद्धयंतों के ऄनुसयर, पयररधथथधतकी पयाटन, को महत्व दतेे होगय;
(iii) अंचधलक महययोजनय कय ऄनुमोदन दकए जयने तक, पयाटन के धलए धवकयस और धवद्यमयन पयाटन दरययकलयपों के धवथतयर को वयथतधवक थथल धवधनर्ददष्ट संवीक्षय तथय धनगरयनी सधमधत की धसफयररि पर अधयररत संबंधधत धवधनययमक प्रयधधकरणों द्वयरय ऄनुज्ञयत दकयय होगय ।
(4) नसैर्वगक धवरयसत -- पयररधथथधतकी संवेदी जोन में महत्वपूणा नैसर्वगक धवरयसत के सभी थथलों जैसे सभी जीन कोि अरधक्षत क्षेत्र, िैल धवरचनयए,ं जल प्रपयतों, झरनों, घयटी मयगों, ईपवनों, गुफयए,ं थथलों, भ्रमण, ऄश्वरोहण, प्रपयतों अदद की पहचयन की जयएगी और ईन्हें संरधक्षत दकयय जयएगय तथय ईनकी सरुक्षय और संरक्षय के धलए आस ऄधधसूचनय के ऄंधतम प्रकयिन की तयरीख से छह मयस के भीतर, ईपयुि योजनय बनयएगी और ऐसी योजनय अंचधलक महययोजनय कय भयग होगय ।
(5) मयनव धनर्वमत धवरयसत थ थल - पयररधथथधतकी संवेदी जोन में भवनों, संरचनयओं, धिल्प-तथ्य, ऐधतहयधसक, कलयत्मक और सयंथकृधतक महत्व के क्षेत्रों की पहचयन करनी होगी और आस ऄधधसूचनय के ऄंधतम प्रकयिन की तयरीख से छह मयह के भीतर ईनके संरक्षण की योजनयए ंतैययर करनी होगी तथय अंचधलक महययोजनय में सधममधलत की जयएगी ।
(6) ध् वधन प्रदिूण -- पयररधथथधतकी संवेदी जोन में ध् वधन प्रदिूण के धनयंत्रण के धलए रयज् य सरकयर कय पययावरण धवभयग यय रयज् य प्रदिूण धनयंत्रण बोडा, वययु (प्रदिूण धनवयरण और धनयंत्रण) ऄधधधनयम, 1981 (1981 कय 14) के ईपबंधों और ईसके ऄधीन बनयए गए धनयमों के ऄनुसरण में मयगादिाक धसद्धयतं और धनयम तैययर करेगय ।
(7) वयय ुप्रदिूण -- पयररधथथधतकी संवेदी जोन में, वयय ुप्रदिूण के धनयंत्रण के धलए मध्य प्रदिे कय पययावरण धवभयग यय रयज् य प्रदिूण धनयंत्रण बोडा वययु (प्रदिूण धनवयरण और धनयंत्रण) ऄधधधनयम, 1981 (1981 कय 14) और ईसके ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसयर में मयगादिाक धसद्धयंत और धनयम तैययर करेगय । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(8) बधहस्रयव कय धनथसयरण -- पयररधथथधतकी संवेदी जोन में ईपचयररत बधहस्रयव कय धनथसयरण जल (प्रदिूण धनवयरण तथय धनयंत्रण) ऄधधधनयम, 1974 (1974 कय 6) और ईसके ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसयर होगय ।
(9) ठोस ऄपधिष्ट -- ठोस ऄपधिष्टों कय धनपटयन धनम्नधलधखत रूप में होगय-- (क) पयररधथथधतकी संवेदी जोन में ठोस ऄपधिष्ट कय धनपटयन समय-समय पर संिोधधत ठोस ऄपधिष् ट प्रबंधन धनयम, 2016, जो भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय सं. कय.अ. 1357(ऄ) तयरीख 8 ऄपै्रल, 2016, द्वयरय प्रकयधित दकए गए थे, के ईपबंधों के ऄनुसयर दकयय जयएगय; (ख) थथयनीय प्रयधधकरण जैव धनम्नीकरणीय और ऄजैव धनम्नीकरणीय संघटकों में ठोस ऄपधिष्टों के संपृथक्कन के धलए योजनयए ंतैययर करेंगे; (ग) जैव धनम्नीकरणीय सयमग्री को ऄधधमयनतः खयद बनयकर यय कृधम खेती के मयध्यम से पुनःचदरत दकयय जयएगय; (घ) ऄकयबाधनक सयमग्री कय धनपटयन पयररधथथधतकी संवेदी जोन के बयहर पहचयन दकए गए थ थल पर दकसी पययावरणीय थवीकृत रीधत में होगय औ पयररधथथधतकी संवेदी जोन में ठोस ऄपधिष् टों को जलयनय यय भथमीकरण ऄनुज्ञयत नहीं होगय।
(10) जवै धचदकत् सीय ऄपधिष् ट- पयररधथथधतकी संवेदी जोन में जैव धचदकत्सीय ऄपधिष्टों कय धनपटयन भयरत सरकयर के पययावरण, वन और पररवतान मंत्रयलय की समय-समय पर यथयसंिोधधत ऄधधसूचनय सं.कय.धन 343 (ऄ) ख 28 2016 द्वयरय प्रकयधित जैव धचदकत्सीय ऄपधिष्ट प्रबंध धनयम, 2016, के ईपबंधों के ऄनुसयर दकयय जयएगय ।
(11) ययनीय पररवहन - पररवहन की ययनीय गधतधवधधययं अवयस के ऄनुकूल धवधनयधमत होंगी और आस संबंध में अंचधलक महययोजनय में धविेि ईपबंध ऄधधकधथत दकए जयएगें और अंचधलक महययोजनय के तैययर होन ेऔर रयज् य सरकयर के सक्षम प्रयधधकयरी के द्वयरय ऄनुमोददत होन ेतक, धनगरयनी सधमधत प्रवृत्त धनयमों और धवधनयमों के ऄनुसयर ययनीय गधतधवधधयों के ऄनुपयलन को धनगरयनी करेगी ।

2. प्रदिूण (जल, वययु, मृदय, ध् वधन) कयररत करने वयले ईद्योगों की थ थयपनय । (क) पयररधथथधतकी संवेदी जोन नए यय प्रदिूण फैलयने वयल े ईद्योगों के धवथतयर की ऄनुज्ञय नहीं दी जयएगी । (ख) केन्रीय प्रदिूण धनयंत्रण बोडा वगीकरण हररत यय श्वेत के रूप में वगीकृत ईद्योगों कृधि अधयररत लघु ईद्योगों सधहत को लयग ूधवधनयमों के ऄनुसयर धवधनयधमत दकयय जयएगय।
3. बृहत जल धवद्युत पररयोजनय की थ थयपनय । लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे ।
4. दकसी पररसंकटमय पदयथों कय ईपयोग यय ईत्पयदन । लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) ।
5. प्रयकृधतक जल धनकययों यय सतही क्षेत्र में ऄनुपचयररत बधहस्रयाव कय धनथसयरण । लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे ।

7. होटल और ररसोटा कय वयधणधज्यक थथयपन । पयररधथथधतकी पयाटन दरययकलयप के ऄथथययी संरचनयओं के धसवयय संरधक्षत क्षेत्र की सीमय से एक दकलोमीटर तक यय पयररधथथधतकी संवेदी जोन के धवथतयर तक आनमें जो भी धनकट ह,ै नये वयधणधज्यक होटल और ररसोटा ऄनुज्ञयत नहीं होंगे: परंतु, संरधक्षत क्षेत्र की सीमय से एक दकलोमीटर से परे और पयररधथथधतकी संवेदी जोन के धवथतयर तक आनमें से जो भी धनकट हो सभी नए पयाटक दरययकलयप यय धवद्यमयन दरययकलयप कय धवथतयर पयाटन महययोजनय और यथय लयगू मयगादिाक धसद्धयंतों कय ऄनुपयलन होगय। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
8. फमों, कंपधनयों, अदद द्वयरय बड े पैमयने पर वयधणधज्यक पिुओं और कुक्कुट पयलन की थथयपनय । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
9. संधनमयाण दरययकलयप । (क) संरधक्षत क्षेत्र यय पयररधथथधतकी संवेदी जोन जो भी धनकट हो की सीमय स ेएक दकलोमीटर के भीतर दकसी भी प्रकयर कय नयय वयधणधज्यक संधनमयाण ऄनुज्ञयत नहीं दकयय जयएगय: परंतु थथयनीय व्यधियों को ईनके ईपयोग के धलए ईनकी भूधम में संधनमयाण धजसके ऄंतगात पैरय 3 के ईपपैरय (1) में सचूीबद्ध दरययकलयप भी हैं, को करन ेके धलए ऄनुज्ञयत दकयय जयएगय । लघु ईद्योगों जो प्रदिूण ईत् पन् न नहीं करत े हैं, से संबंधधत संधनमयाण दरययकलयप धवधनयधमत दकए जयएगें और लयग ूधनयमों और धवधनयमों, यदद कोइ हों, के ऄनुसयर सक्षम प्रयधधकयरी की पूवा ऄनुज्ञय से ही न् यूनतम पर रखे जयएगें । (ख) एक दकलोमीटर से ग अंचधलक महययोजनय की ऄनुसयर धवधनयधमत होंगे ।
10. प्रदिूण ईत्पन्न न करन े वयल े लघु ईद्योग । पयररधथथधतकी संवेदी जोन में दिेीय सयमग्री से ईत्पयदों कय ईत्पयदन करन े वयले गैर प्रदिूण, गैर पररसंकटमय, लघु और सेवय ईद्योग, कृधि, कृधि ईद्ययन यय कृधि अधयररत ईत्पयदों कय ईत्पयदन करन ेवयले ईद्योग सक्षम प्रयधधकयरी द्वयरय ऄनुज्ञयत दकए जयएगें ।
11. ईंट भट्टों की थ थयपनय। लयगू धवधधयों के ऄनुसयर (ऄन् यथय ईपबंधधत के धसवयय) होंगे ।
12. वृक्षों की कटयइ । (क) रयज्य सरकयर में सक्षम प्रयधधकयरी की पूवा ऄनुज्ञय के धबनय वन, सरकयरी यय रयजथव यय धनजी भूधम पर यय वनों में ककही वृक्षों की कटयइ नहीं होगी । (ख) वृक्षों की कटयइ, संबंधधत कें रीय यय रयज्य ऄधधधनयम यय ईसके ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसयर धवधनयधमत होगी ।
13. वन ईत्पयदों और गैर कयष्ठ वन ईत्पयदों कय संग्रहण (एनटीएफपी) । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
14. धवद्युत और दरूसंचयर टयवरों कय पररधनमयाण और केबल धबछयनय और ऄन्य बुधनययदी ढयंचे । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे (भूधमगत केबल क एग )।
15. नयगररक सुख-सुधवधयओं सधहत बुधनययदी ढयंचे। लयग ू धवधधयों, धनयमों और धवधनयमन और ईपलब्ध मयगादिाक धसद्धयंतों के ऄनसुयर न्यूनीकरण की ईपययों के सयथ धवधनयधमत होंगे। II (ii) 9
16. धवद्यमयन सडकों को चौडय करनय और ईन्हें सुदढृ करनय तथय नइ सडकों कय संधनमयाण । लयग ू धवधधयों, धनयमों और धवधनयमन और ईपलब्ध मयगादिाक धसद्धयंतों के ऄनसुयर न्यूनीकरण की ईपययों के सयथ धवधनयधमत होंगे।
17. पयाटन से संबंधधत दरययकलयप जैस े गमा वययु गुब्बयरों, हलेीकयप्टर, ड्रोन, मयआरोलयआटस् अदद द्वयरय पयररधथथधतकी संवेदी जोन क्षेत्र के उपर से ईडनय जैसे दरययकलयप करनय। लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
18. पहयडी ढयलों और नदी तटों कय संरक्षण । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
19. रयधत्र में ययधनक पररवहन कय संचलन । लयगू धवधधयों के ऄधीन वयधणधज्यक प्रयोजन के धलए धवधनयधमत होंग े।
20. थथयनीय समुदययों द्वयरय चल रही कृधि और बयगवयनी प्रथयओं के सयथ पिुपयलन, पिुपयलन कृधि, जल कृधि और मछली पयलन । थथयनीय ईपयोग के धलए लयगू धवधधयों के ऄधीन ऄनुज्ञयत होंगे ।
21. प्रयकृधतक जल धनकययों यय सतही क्षेत्र में ईपचयररत बधहस्रयाव और ठोस ऄपधिष्टों कय धनथसयरण । गू के तहत बधहस्रयव कय धनथसयरण ह ग ।
22. सतह और भूधमगत जल की वयधणधज्यक धनकयसी । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
23. खुले कुअ, बोर कुअ, अदद के धलए कृधि और ऄन्य ईपयोग । लयगू धवधनयधमत के ऄधीन धवधनयधमत होंगे और संबद्ध प्रयधधकयरी द्वयरय दरययकलयपों की सख्ती से धनगरयनी की जयएगी।
24. ठोस ऄपधिष्ट प्रबंधन । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
25. धवदिेी प्रजयधतयों को लयनय। लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
26. पयररधथथधतकी । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
27. प् लयधथ टक थैलों कय ईपयोग। लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।

5. धनगरयनी सधमधत- (1) कें रीय सरकयर, पयररधथथधतकी संवेदी जोन के प्रभयवी धनगरयनी के धलए एक धनगरयनी सधमधत कय गठन करती ह ैजो धनम्नधलधखत से धमलकर बनेगी, ऄथयात ्:-
(i) प्र ग , सयगर -ऄध् यक्ष;
(ii) पययावरण के क्षेत्र में कयया करन े वयले गैर सरकयरी संगठनों (धजसके ऄंतगात धवरयसत सरंक्षण भी ह)ै कय रयज्य सरकयर द्वयरय नयमधनर्ददष्ट एक प्रधतधनधध -सदथय;
(iii) सरकयर द्वयरय नयमधनर्ददष् ट पयररधथथधतकी और पययावरण क्षेत्र कय एक धविेिज्ञ -सदथय;
(iv) मध्य प्रदिे प्रदिूण धनयंत्रण बोडा कय प्रधतधनधध -सदथय;
(v) मुख्य वन संरक्षक, छतरपुर -सदथय;
(vi) धजलय कलक्टर, टीकमगढ़ -सदथय;
(vii) अयुि, नगर धनगम, सयग - ;
(viii) ऄधीक्षण आंजीधनयर, लोक थवयथथ्य धवभयग, टीकमगढ़ -सदथय;
(ix) मुख्य कययाकयरी ऄधधकयरी, , टीकमगढ़ -सदथय;
(x) ह और ग्रयम योजनय धवभयग के धजलय ऄधधकयरी - ;
(xi) रयज्य सरकयर द्वयरय नयधमत जैवधवधवधतय कय धविेिज्ञ -सदथय; और
(xii) वन्यजीव वयडान, ओरछय वन्यजीव ऄभययरण्य - ।
6. धनदिे धनबधंन
(1) धनगरयनी सधमधत आस ऄधधसूचनय के ईपबंधों के ऄनुपयलन की धनगरयनी करेगी ।
(2) धनगरयनी सधमधत कय कययाकयल तीन विा तक यय रयज्य सरकयर द्वयरय नइ सधमधत के पुन: गठन के धलए होगय, और बयद में धनगरयनी सधमधत रयज्य सरकयर द्वयरय गरठत की जयएगी।
(3) पयररधथथधतकी संवेदी जोन में भयरत सरकयर के तत् कयलीन पययावरण और वन मंत्रयलय की ऄधधसूचनय सं. कय.अ. 1533(ऄ) तयरीख 14 धसतंबर, 2006 की ऄनुसूची में के ऄधीन सधममधलत दरययकलयपों और आस ऄधधसूचनय के पैरय 4 के ऄधीन प्रधतधिद्ध गधतधवधधयों के धसवयय अने वयल ेऐसे दरययकलयपों की दिय में वयथतधवक धवधनर्ददष्ट थथलीय दियओं पर अधयररत धनगरयनी सधमधत द्वयरय संवीक्षय की जयएगी और ईि ऄधधसूचनय के ईपबंधों II (ii) 11 के ऄधीन पूवा पययावरण धनकयसी के धलए केन्रीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को धनर्ददष्ट की जयएगी ।
(4) आस ऄधधसूचनय के पैरय 4 के ऄधीन यथय धवधनर्ददष्ट प्रधतधिद्ध दरययकलयपों के धसवयय, भयरत सरकयर के तत् कयलीन पययावरण और वन मंत्रयलय की ऄधधसूचनय संख्ययंक कय.अ. 1533(ऄ) तयरीख 14 धसतंबर, 2006 की ऄधधसूचनय के ऄनुसूची के ऄधीन ऐस ेदरययकलयपों, धजन्हें सधममधलत नहीं दकयय गयय ह,ै परंत ुपयररधथथधतकी संवेदी जोन में अत ेहैं, ऐसे दरययकलयपों की वयथतधवक धवधनर्ददष्ट थथलीय दियओं पर अधयररत धनगरयनी सधमधत द्वयरय संवीक्षय की जयएगी और ईस ेसंबद्ध धवधनययमक प्रयधधकरणों को धनर्ददष्ट दकयय जयएगय ।
(5) धनगरयनी सधमधत कय सदथय-सधचव यय संबद्ध कलक्टर यय संरधक्षत क्षेत्र कय प्रभयरी ऐसे व्यधि के धवद्द्ध, जो आस ऄधधसूचनय के दकसी ईपबंध कय ईल्लंघन करतय ह,ै पययावरण (संरक्षण) ऄधधधनयम, 1986 की धयरय 19 के ऄधीन पररवयद फयआल करन ेके धलए सक्षम होगय।
(6) धनगरयनी सधमधत मुद्दों के अधयर पर ऄपेक्षयओं पर धनभार रहत ेहुए संबद्ध धवभयगों के प्रधतधनधधयों यय धविेिज्ञों, औद्योधगक संगमों यय संबद्ध पणधयररयों के प्रधतधनधधयों को ऄपने धवचयर-धवमिा में सहययतय के धलए अमंधत्रत कर सकेगी ।
(7) धनगरयनी सधमधत प्रत्येक विा की 31 मयचा तक की ऄपनी वयर्विक कयरावयइ ररपोटा रयज्य के मुख्य वन्यजीव वयडान को ईपयबधं VI में ईपबंधधत रूप धवधयन के ऄनुसयर ईक् त विा के 30 जून तक प्रथतुत करेगी ।
(8) केन्रीय सरकयर कय पययावरण, वन और जलवययु पररवतान मंत्रयलय धनगरयनी सधमधत को ऄपने कृत्यों के प्रभयवी धनवाहन के धलए समय-समय पर ऐसे धनदिे द ेसकेगय, जो वह ठीक समझे ।
7. ईच्चतम न्ययययलय अदिे, अदद.- आस ऄधधसूचनय के ईपबंधों को प्रभयव दनेे के धलए कें रीय सरकयर और रयज् य सरकयर ऄधतररक् त ईपयय, यदद कोइ हों, धवधनर्ददष् ट कर सकें गी ।

8. कोइ ऄन् य महत् वपूणा धविय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 2nd January, 2018 S.O. 35(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O.1700(E), dated the 26 th May, 2017, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the draft notification were made available to the public on the 26 th May, 2017; AND WHEREAS, no objections and suggestions were received from the persons and stakeholders in response to the draft notification; AND WHEREAS, the Orchha Wildlife Sanctuary spreads over an area of 45.36 square kilometers is located in Tikamgarh district in the State of Madhya Pradesh and is connected with Orchha territorial range and babina range in Uttar Pradesh; AND WHEREAS, the Orchha Wildlife Sanctuary is extremely rich in flora and fauna and the said Sanctuary is also rich in biodiversity; AND WHEREAS, the Orchha Wildlife Sanctuary contains 4 tortoises species, 16 fish species, 97 bird species and 4 vulture species in Orchha Wildlife Sanctuary and the flora and fauna details are as follows: Flora: Mango (Mangifera Indica), Arjun (Terminalia arjuna), Achar (Buehanania Ianjan), Amla (Eblica officinale), Amaltas (Casia fistula), Bel (Eagle marmelus), Ber (Zizyphus jujube), Bargad (Ficus bengalensis), Bahera (Terminilia bellarica), Bija (Pterocarpus marsupium), Bans (Dendrocalamus strictus), Babul (Aeacia Arabica), Chirol (Holopteelea integrifolia), Dhobin (Dalbergia paniculata), Dudhi (Wrighitia tinctoria), Dab (Dasmostachya bipinnata), Gular (Ficus Glomeratg), Ghont (Zizyphus eylopyra), Haldu (Adina cardifolia), Khair (Acacia catechy), Kardhai (Anogesus penduls), Kachannar (Bauhania variegate), Kasai (Bridelia retusa), Kumbhi (Carea arbore), Kari (Miliusa tomentosa), Kaim 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (Mitragyna pariflora), Kullu (Sterculia urens), Mahua (Madhuca latifolia), Gunja (Kannea gradis), Munj (Saccharum munja), Neem (Azadirachta indica), Palas (Buteomonosperma), Pakar ( Ficus infectoria), Papal (Ficus rdigiosa), Pliuli (Allaterpsis), Rohan (Soymida febrifuga), Reunjha (Acacia levcophloea), Shisham (Dalbergia sissoo), Safed siriss (Albizia procera), Siris (Albizia leabeek), Salai (Bosweleia sarreta), Semal (Bombox ceiba), Sajha (Lagerstroemia parviflora), imli (Tamarindus indicus), Sagon (Tectona grandis), Tendu (Diospyros melenoxylon), Tinsa (Ougenia dalbergioides) and Umar (Ficus glomerata); Fauna: Cheetal (Axis), Blue Bull (Boselaphus tragocamelus), Jackal (Canis aureus), Barking Deer (Muntiacus muntijak), Indian Fox (Vulpes benglensis), Wild boar (Sus scrofa), Hyena (Hyaena hyaena), Indian hare (Leupus nigricollis), Porcupine (Hystrix indica), Black faced monkey (Presbytis entellus), Red faced monkey (Macaca mulata), Bat (Cynopterus sphinx pteropus ginganteus) Mangoose (Herpestes edwardsi), Indian field mouse (Rettus refescena), Chinkara (Gazell gazelle), Five striped palm squirrel (Funambulus pennanti), Jungle cat (Felis chaus) and Bigoos (Melivora capensis); AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Orchha Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent two kilometers periphery of Orchha Wildlife Sanctuary, except at residential area of Orchha town (100 meters periphery) and excluding the area of Uttar Pradesh as Orchha Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), in the State of Madhya Pradesh details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The extent of Eco-sensitive Zone is two kilometres periphery of Orchha Wildlife Sanctuary, except at residential area of Orchha town (100 meters periphery) and excluding area of Uttar Pradesh and the area of Eco sensitive Zone is 24.84 square kilometers, and the boundary description of Eco- Sensitive Zone is given at Annexure-I.
(2) The co-ordinates of Orchha Wildlife Sanctuary and Eco-sensitive Zone are given in Annexure-II and Annexure-III respectively.
(3) The list of 17 villages and their co-ordinates falling under the Eco-sensitive Zone is annexed as Annexure-IV.
(4) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-V.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department, for integrating environmental and ecological considerations into it. II (ii) 19
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions of monitoring under the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial activities and such areas shall be clearly defined in the Zonal Master Plan along with maps:
Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of the local residents and for activities such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such areas.
(3) Tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be permitted within 1 kilometer from the boundary of the Orchha Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer: 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Provided that beyond the distance of 1 kilometer from the boundary of the Orchha Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc., shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or the Madhya Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government or the Madhya Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(a) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016 as amended from time to time;
(b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(c) the biodegradable material shall be recycled preferably through composting or vermiculture; and
(d) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28 th March, 2016, as amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units.- (a) No establishment of new wood based industries within the Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the Eco-sensitive Zone shall be permitted. II (ii) 21
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining
(a) New (minor and major minerals), stone quarrying and crushing units shall prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of new industries causing pollution (Water, Air, Soil, Noise, etc.).
(a) No new or expansion of existing polluting industries in the Ecosensitive zone shall be permitted.
(b) Industries categorised as Green or White in the Central Pollution Control Board classification including agro-based small scale industries, shall be regulated as per applicable regulations.
3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws
6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. B. Regulated Activities
7. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
8. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc. Regulated under applicable laws.
9. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
10. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority.
11. Setting up of brick kilns. Regulated (except as otherwise provided) as per applicable laws.
12. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the relevant Central or State Acts and the rules made thereunder.
13. Collection of Forest Produce or Non- Timber Forest Produce (NTFP). Regulated under applicable laws.
14. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws (underground cabling may be promoted).
15. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulations and available guidelines.
16. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulations and available guidelines.
17. Under taking other activities related to tourism like over flying the Ecosensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated under applicable laws.
18. Protection of hill slopes and river banks. Regulated under applicable laws.
19. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals.
21. Discharge of treated effluents in natural water bodies or land area. The discharge of treated effluent shall be regulated as per applicable laws.
22. Commercial extraction of surface and ground water. Regulated under applicable laws.
23. Open well, bore well, etc. for agriculture or other usage. Regulated under applicable laws and the activity shall be monitored by the concerned authority.
24. Solid waste management. Regulated under applicable laws.
25. Introduction of exotic species. Regulated under applicable laws. II (ii) 23
5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-
(i) Divisional Commissioner, Sagar -Chairman;
(ii) One representative of Non-Governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Madhya Pradesh -Member;
(iii) An expert in the area of ecology and environment to be -Member; nominated by the Government of Madhya Pradesh
(iv) Representative of Madhya Pradesh Pollution Control -Member; Board
(v) Chief Conservator of Forests, Chhatarpur -Member;
(vi) District Collector, Tikamgarh - Member;
(vii) Commissioner, Nagar Nigam, Sagar -Member;
(viii) Superintending Engineer, Public Health Dept. Tikamgarh - Member;
(ix) Chief Executive Officer of Zilla Panchayat, Tikamgarh -Member;
(x) District Officer of Town and Country Planning Department -Member;
(xi) Expert in Biodiversity nominated by State Goverment -Member; and
(xii) Wildlife Warden of Orchha Wildlife Sanctuary -Member-Secretary.
26. Eco-tourism. Regulated under applicable laws.
27. Use of polythene bags. Regulated under applicable laws.
28. Commercial sign boards and hoardings. Regulated under applicable laws. C. Promoted Activities
29. Rain water harvesting. Shall be actively promoted.
30. Organic farming. Shall be actively promoted.
31. Adoption of green technology for all activities. Shall be actively promoted.
32. Cottage industries including village artisans, etc. Shall be actively promoted.
33. Use of renewable energy. Bio gas, solar light, etc. to be actively promoted.
34. Agro-forestry. Shall be actively promoted.
35. Skill development. Shall be actively promoted.
36. Restoration of degraded land/ forests/habitat. Shall be actively promoted.

6. Terms of reference:- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring Committee shall be for three years or till the re-constitution of the new Committee by the State Government, and subsequently the Monitoring Committee shall be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-VI.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Supreme Court, etc. Orders.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Additional Measurs.-The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or High Court or National Green Tribunal. No. 25/63/2015-ESZ] LALIT KAPUR, Scientist ‘G’ Annexure-I Boundary description Orchha Eco-Sensitive Zone Eco-Sensitive Zone is in the 2 kilometer periphery of Orchha Wildlife Sanctuary, except at residential area of Orchha town (100 meters periphery) and excluding area of Uttar Pradesh Total area of Eco-sensitive Zone is 24.84 square kilometers. There are 17 villages that fall in the periphery of Eco-sensitive Zone. The northern boundary of Ecosensitive Zone touches boundary of Uttar Pradesh., Eastern boundary of Eco-sensitive Zone covers 8 villages including Lidhora, Baghpura, Sevari, Madori, Gulenda, Sarsora, Koti and Nata. Southern boundary of Eco-sensitive Zone touches boundary of Uttar Pradesh. The western boundary of Eco-sensitive Zone includes 9 villages namely Majra, Mador, Ladpura, Futera, Gundrai, Ganj, Orchha, Nakta and Aazadpura.
