PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 316] ubZ fnYyh] lkseokj] iQjojh 6] 2017@ek?k 17] 1938 No. 316] NEW DELHI, MONDAY, FEBRUARY 6, 2017/MAGHA 17, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 6 फरवरी, 2017 का.आ. 350(अ).—भारत सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 2384 (अ) तारीख 31 अग᭭त, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होन ेकᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसूचना अंतᳶव᳥ ह,ै उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत करत ेᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;
और, उᲦ राजपᮢ, िजसमᱶ उᲦ अिधसूचना अंतᳶव᳥ है, कᳱ ᮧितयां जनता को 21 िसत᭥बर, 2015 को उपल᭣ध करा दी गई थी;
और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुᭃावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक ᱧप से िवचार ᳰकया गया;
और, बीर मेहास व᭠यजीव अभयार᭛य पंजाब रा᭔य के नाभा-मलेरकोटला रोड पर अवि᭭थत ह ै िजसका ᭃेᮢफल
123.43 हेटेयर ह ैजो ᭭थलाकृित के संबंध मᱶ समान ᱨप से समतल ह।ै पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ अᭃांश और देशा᭠तर सिहत उपाबधं I के ᱨप मᱶ उपाब ह;ै और, चᱹिपयन और सेठ के वन वगᱮकरण के अनुसार, इस संरिᭃत ᭃेᮢ मᱶ वन ह,ᱹ जो उᱫरी शु᭬क िमि᮰त पतझड़ी वन ᮧकार के उप समूह 5(6) के अधीन आत ेह,ᱹ और मुय पेड़ ᮧजाितयां जैसे यूकेिल᭡टस, मलवरी, शीशम, कᳱकर, खैर, ढाक, बेरी, जांड, िस᭥बल, जामुन, नीम, टूट, अजुᭅन, करीर, काही, नारा, अ᭥ब, खजूर, करᲂड़ा और बांस ह;ᱹ और, यह ᭃेᮢ िविभ᳖ ᮧकार के पशुᲐ और पिᭃयᲂ के संरᭃण के िलए जाना जाता ह ैजैसे साही, बनैला सूअर, बल ूबुल, िसयार, जंगली िब᭨ली, ᳯरहसस बंदर, पी फाउल, काला और धूसर तीतर, पैराकᳱट और फाखता ह;ᱹ 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, बीर मेहास व᭠ यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के परैा 1 मᱶ िविन᳸द᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करन ेको ᮧितिष करना आव᭫यक ह;ै अतः, इसिलए, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (3) और उपधारा (2) के खंड (v) और खंड
(xiv) और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत ेᱟए, पंजाब रा᭔ य मᱶ बीर मेहास व᭠ यजीव अभयार᭛य कᳱ सीमा से 100 मीटर तक के िव᭭ तार तक के ᭃेᮢ को बीर मेहास व᭠ यजीव अभयार᭛य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:--
1. पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन का िव᭭तार सीमा के चारᲂ ओर 0 से 100 मीटर तक पᳯरवतᭅनशील िव᭭तार के साथ 48.0 हेटेयर ᭃेᮢफल मᱶ फैला ᱟआ ह ैऔर पाᳯरि᭭थितक संवेदी जोन पूवᭅ कᳱ ओर 30°22’3.498” उ. अᭃांश और 76°10’34.831” प.ू देशांतर (मानिचᮢ का संदभᭅ िब᭠द ुसं. ख); पि᳟म कᳱ ओर 30°22’0.945”उ अᭃांश तथा 76º9’38.125"पू. देशांतर (मानिचᮢ का संदभᭅ िब᭠द ु सं. ङ); उᱫर कᳱ ओर 30º22’22.728"उ अᭃांश और 76º10’1.539"पू देशांतर (मानिचᮢ का संदभᭅ िब᭠द ु सं. क)और दिᭃण कᳱ ओर 30º21’25.33"उ अᭃांश और 76º10’4.826" प ूदेशांतर(मानिचᮢ का संदभᭅ िब᭠द ुसं.घ) से िघरा ᱟआ ह।ै
(2) पाᳯरि᭭थितक संवेदी जोन के भीतर नाभा शहर नाम से केवल एक ही ᮕाम ह।ै
(3) बीर मेहास व᭠यजीव अभयार᭛य के िनदᱷशांक उपाबधं II के ᱨप मᱶ उपाब ह|ै
2. पाᳯरि᭭थितक सवंदेी जोन के िलए आचंिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करन ेके िलए रा᭔ य सरकार के सभी संब िवभागᲂ के परामशᭅ से तयैार होगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पयᭅटन ;
(v) नगरपािलका ;
(vi) राज᭭ व ;
(vii) कृिष ;
(viii) पंजाब रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ;
(ix) ᳲसचाई; और
(x) लोक िनमाᭅण िवभाग।
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलᲐू, िजन पर ᭟यान देना आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।
(8) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान े वाल े उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा:
परंत ु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन ेके िलए और पैरा 4 कᳱ सारणी के ᭭तंभ
(2) के अधीन मद सं0 24, 28, 30 और 35 के सामने सूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत ्:-
(i) ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग;
(ii) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद ;
(iii) वषाᭅ जल संचय; और
(iv) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण द᭭तकार ह ᱹ| परंत ुयह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अनु᭄ात नहᱭ होगा :
परंत ुयह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात ्रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को देनी होगी । परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंत ुयह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करन ेके ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोतᲂ - आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करन ेके िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂग ेजो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, पंजाब सरकार ᳇ारा राज᭭ व और वन िवभाग के परामशᭅ से तैयार होगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂग,े अथाᭅत ्:-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देत े ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर नए होटल और सैरगाहᲂ के नए संिनमाᭅण अनु᭄ात नहᱭ हᲂगे ।
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण – पयाᭅवरण (संरᭃण) अिधिनयम 1986 के अधीन ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 मᱶ िनयत उपबंधᲂ के अनुसरण मᱶ पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟विन ᮧदषूण के िनयंᮢण के िलए िविनयमᲂ को कायाᭅि᭠वत करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, रा᭔य सरकार के पयाᭅवरण िवभाग वायु (ᮧदषूण िनवारण एवं िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के ᮧावधानᲂ के अनुसार वायु ᮧदषूण के िनयंᮢण के िलए मागᭅदशᭅक िसांत और िविनयम लाग ूहᲂग े। यᳰद आव᭫यक हो, पयाᭅवरण कᳱ सरंᭃण के िलए मागᭅदशᭅक िसांत ओर अिधक स᭲त बनाये जा सकत ेह।ᱹ
(8) बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मागᭅदशᭅक िसांतᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकारी जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶग े;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अजैव सामᮕी ᭭वीकायᭅ रीित से पयाᭅवरणीय मᱶ ᳞यत् ᳰकया जाएगा ।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविध ᮧाणीयᲂ के अनुकूल रीित से िविनयिमत कᳱ जाएगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध सि᭥मिलत ᳰकए जाएंगे और जब तक ऐसी आंचिलक महायोजना रा᭔य ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 सरकार के सᭃम ᮧािधकारी ᳇ारा तैयार और अनुमोᳰदत नहᱭ ᳰकया जाता ह ै| मानीटरी सिमित संुसगत अिधिनयमᲂ और उसके अधीन बनाए गए िनयमᲂ िनयमᲂ और िविनयमᲂ के अधीन यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
4. पाᳯरि᭭थितक सवंदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂग ेऔर नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत ्:- सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
1. वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइयां । (क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़न ेकᳱ इकाइयां ᮧितिष हᲂगी । तथािप, वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइ᭨स या टᲂ का िनमाᭅण करना िव᳒मान िविनयमᲂ के अनुसार अनु᭄ात हᲂगे । (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के अनुसरण मᱶ सवᭅदा ᮧचालन होगा।
2. आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा।
3. जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदषूण काᳯरत करने वाले का िव᭭ तार अनु᭄ात नहᱭ होगा ।
4. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠यथा उपबंिधत के िसवाय) ।
5. जलावन लकड़ी का वािणि᭔यक उपयोग। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
6. नए बृहत जल िव᳒ुत पᳯरयोजना का ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
7. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा अभयार᭛य ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
8. सि᳖माᭅण ᳰᮓयाकलाप । ᭭थानीय िनवािसयᲂ घरेलू आव᭫यकताᲐ के िसवाय पाᳯरि᭭थितक संवेदी जोन मᱶ ᳰकसी ᮧकार का कोई नवीन सि᳖माᭅण अनु᭄ात नहᱭ ᳰकया जाएगा िजसके अंतगᭅत पैरा 3 के उपपैरा (1) मᱶ सूचीब ᳰᮓयाकलाप ह।ै ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोगᲂ से संबंिधत िनमाᭅण ᳰᮓयाकलपᲂ कᳱ दशा मᱶ िविनयिमत ᳰकए जाएंगे। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] िविनयिमत ᳰᮓयाकलाप
9. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
10. वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू-जल संचयन भी ह ै। (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का िन᭬कषᭅण (सतही और भूिमगत जल) अनु᭄ात होगा । (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह।ै (ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा। (घ) ᳰकसी ᮲ोत जल, िजसके अंतगᭅत कृिष भी है, के संदषूण या ᮧदषूण को रोकने के िलए सभी उपाय ᳰकए जाएंगे ।
11. िव᳒ुत केबलᲂ, और दरूसंचार टावरᲂ का संिनमाᭅण। भूिमगत केबलᲂ को बढ़ावा ᳰदया जाएगा।
12. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
13. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण। उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लागू अनुसार हᲂगे ।
14. ᭡लाि᭭टक थैलᲂ का उपयोग। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
15. रािᮢ मᱶ यािनक यातायात का संचलन। लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
16. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
17. होटल और िव᮰ाम ᭭थलᲂ का वािणि᭔यक ᭭थापन । पाᳯरि᭭थितक संवेदी जोन के भीतर होटलᲂ और िव᮰ाम᭭थलᲂ जैसे िव᳒मान वािणि᭔यक ᭭थापनᲂ के ᳰकसी नवीकरण या िव᭭तार कᳱ अनु᭄ा नहᱭ दी जाएगी ।
18. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
19. वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
20. वायु (᭟ विन सिहत)और यानीय ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
21. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अबमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा।
22. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग। पाᳯरि᭭ थितक संवेदी जोन मᱶ दशेीय माल से उ᭜पादᲂ का उ᭜पादन करने वाले गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत दशेीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात ᳰकए जाएंगे। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
23. वन उ᭜पादᲂ और गैर का᳧ वन उ᭜पादᲂ का संᮕहण। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
24. सुरᭃा बलᲂ के कᱹप । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. नए का᭬ ठ आधाᳯरत उ᳒ोग। पाᳯरि᭭ थितक संवेदी जोन के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना अनु᭄ात नहᱭ होगी :
परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ 100% आयाितत का᭬ ठ ᭭ टाक उपभोग करने वाले नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना कᳱ जा सकेगी ।
26. पाᳯरि᭭ थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के िलए, पयᭅटकᲂ के अ᭭थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल कुटीर, जैसे तंबू, लकड़ी के घर आᳰद। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
27. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा अभयार᭛य ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । सवंᳶधत ᳰᮓयाकलाप
28. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष और मछली पालन । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
29. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
30. जैिवक खेती । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
31. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
32. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
33. वान᭭पितक घेराब᭠दी। लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
34. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह।ᱹ सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
35. पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
36. कौशल िवकास । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
5. पाᳯरि᭭थितक संवदेी जोन मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत ् (क) मुय वन संरᭃक (व᭠यजीव), पंजाब सरकार - अ᭟यᭃ;

(ग) ᮧादेिशक अिधकारी, पंजाब रा᭔य ᮧदषूण िनयंᮢण बोडᭅ - सद᭭य;
(घ) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै का तीन वषᭅ कᳱ अविध के िलए पंजाब रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध - सद᭭य;
(ङ) पंजाब सरकार ᳇ारा तीन वषᭅ कᳱ अविध के िलए नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ का एक िवशेष᭄ - सद᭭य ;
(च) नगर िवकास िवभाग, पंजाब सरकार का ᮧितिनिध - सद᭭य;
(छ) कृिष िवभाग, पंजाब सरकार का ᮧितिनिध - सद᭭य;
(ज) िजला कलेटर, पᳯटयाला का ᮧितिनिध – सद᭭य;
(झ) ᮧभागीय वन अिधकारी (संरिᭃत ᭃेᮢ का ᮧभारी) – सद᭭य सिचव ।
6. िनदᱷश िनबधंन
(2) सिमित का कायᭅकाल अिधसूचना जारी होन ेकᳱ ितिथ से तीन वषᭅ कᳱ अविध के िलए ᳰकया जाएगा।
(3) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(4) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ.
1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आन े वाल ेऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(5) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंत ुपाᳯरि᭭थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(6) मानीटरी सिमित का सद᭭य-सिचव या संब उपायु त, ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लघंन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन े के िलए सᭃम होगा ।
(7) मानीटरी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहत े ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपन ेिवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(8) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ रा᭔ य के मु य व᭠ यजीव वाडᭅन को अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ उपाबधं III पर उपाब ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।

The map of Eco-sensitive Zone along with latitude and longitude is appended as Annexure-I.
AND WHEREAS, the protected area has forests of Northern Dry Mixed Deciduous type falling under subgroup 5 (6) of the forest classification of Champion and Seth, which have such main tree species as Eucalyptus, Mulberry, Shisham, Kikkar, Khair, Dhak, Beri, Jand, Simbal, Jamun, Neem, Toot, Arjun, Kareer, Kahi, Nara, Amb, Khajoor, Karonda and Bamboo;
AND WHEREAS, the area has known varieties of animals and birds like Porcupine, Wild Boar, Blue Bull, Jackal, Jungle Cat, Rhesus Monkey, Peafowl, Black and Grey Partridges, Parakeets and Doves;
AND WHEREAS, it is necessary to conserve and protect the area (the extent and boundaries of which is specified in paragraph 1 of this notification) around the protected area of the Bir Mehas Wildlife Sanctuary as Ecosensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with subrule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies upto100 metres from the boundary of the Bir Mehas Wildlife Sanctuary in the State of Punjab as the Bir Mehas Wildlife Sanctuary Ecosensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1)The extent of Eco-sensitive Zone is spread over an area of
48.0 hectares with an extent varying from 0 to 100 metres all around the boundary and the Eco-sensitive Zone is bounded by 30º22’3.498"N latitude and 76º10’34.831"E longitude towards East (Reference point No.B of map); 30º22’0.945"N latitude and 76º9’38.125"E longitude towards west (Reference point No.E of map); 30º22’22.728"N latitude and 76º10’1.539"E longitude towards north (Reference point No.A of map) and 30º21’25.33"N latitude and 76º10’4.826"E longitude towards south(Reference point No.D of map).
(2) There is only one village by name Nabha City falling within the Eco-sensitive Zone.
(3) The co-ordinates of Bir Mehas Wildlife Sanctuary is appended as Annexure II .
2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Ecosensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The said Plan shall be approved by the competent authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Punjab State Pollution Control Board;
(ix) Irrigation; and
(x) Public Work Department, for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities;
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 24, 28, 30 and 35 in column (2) of the Table in paragraph 4, namely:-
(i) Small scale industries not causing pollution;
(ii) Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, etc. for eco-friendly tourism activities;
(iii) Rainwater harvesting; and
(iv) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that the State Government shall correct any error appearing in the land records within the Ecosensitive Zone after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be in accordance with the Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Punjab in consultation with Department of Revenue and Forests, Government of Punjab.
(c) The activity of tourism shall be regulated as under, namely.-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of Environment, Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and ecodevelopment and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs and other natural heritage shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder. If required, standards may be made more stringent for protection of environment.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein.
(9) Disposal of Solid wastes. - (i) the solid waste in Eco-sensitive Zone shall be disposed of in a accordance with the provisions of the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016, as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into bio-degradable and non-biodegradable components;
(iii) the bio-degradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Disposal of bio-medical waste.- The bio-medical waste in the Eco-sensitive Zone shall be disposed of in a accordance the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Ministry of Environment, Forests and Climate Change, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and rules and regulations made thereunder.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.-All activities in the Ecosensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under and shall be regulated in the manner specified in the Table below, namely:- Table Sl. 1. Commercial mining, stone quarrying and crushing units.
(a) New mining (minor and major minerals), stone quarrying and crushing units shall be prohibited except for the domestic needs of bona fide local residents with reference to digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption.
(b) The mining operations shall strictly be in accordance to the orders of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N.GodavarmanThirumulpad Vs. Union of India in Writ Petition (Civil) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012.
2. Setting up of saw mills. No new and expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of existing polluting industries shall be permitted within the Eco-sensitive Zone.
4. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of new major hydroelectric projects.
Prohibited (except as otherwise provided) as per applicable laws.
7. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
8. Construction activities. No new construction of any kind shall be permitted within the Eco-sensitive Zone, except for the domestic needs of local residents including the activities listed in sub-paragraph (1) of paragraph 3 and in case of the construction activity related to small scale industries not causing pollution, the same shall be regulated and kept at the minimum.
B.Regulated Activities:
9. Felling of trees. (a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
10. Commercial water resources including ground water harvesting.
(a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land;
(b) extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned regulatory authority;
(c) no sale of surface water or ground water shall be permitted;
(d) steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
11. Erection of electrical cables and telecommunication towers.
Promote underground cabling.
12. Fencing of existing premises of hotels and lodges.
Regulated under applicable laws.

13. Widening and strengthening of existing roads and construction of new roads.
Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
14. Use of plastic carry bags. Regulated under applicable laws.
15. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws.
16. Introduction of exotic species. Regulated under applicable laws.
17. Establishment of hotels and resorts. No new or commercial establishments such as hotels and resorts shall be permitted within the Eco-sensitive Zone.
18. Protection of hill slopes and river banks. Regulated under applicable laws.
19. Commercial sign boards and hoardings. Regulated under applicable laws.
20. Air (including noise) and vehicular pollution. Regulated under applicable laws.
21. Discharge of treated effluents in natural water bodies or land area.
Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
22. Small scale industries not causing pollution. Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Eco-sensitive Zone which do not cause any adverse impact on environment shall be permitted.
23. Collection of Forest produce or Non-Timber Forest Produce.
Regulated under applicable laws.
24. Security Forces Camp. Regulated under applicable laws.
25. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone:
Provided that new wood based industry may be set up in the Eco-sensitive using 100% imported wood stock.
26. Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses and other cottages for eco-friendly tourism activities.

27. Undertaking activities related to tourism like over-flying the sanctuary area by hot-air balloons and other activities.

C. Promoted Activities:
28. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming and fisheries.

29. Rain water harvesting. Shall be actively promoted.
30. Organic farming. Shall be actively promoted.
31. Adoption of green technology for all activities. Shall be actively promoted.
32. Use of renewable energy sources. Permitted under applicable laws.
33. Vegetative fencing. Permitted under applicable laws.
34. Cottage industries including village artisans. Shall be actively promoted.
35. Environmental Awareness. Shall be actively promoted.
36. Skill Develompment. Shall be actively promoted.
5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-

(b) Representative of Department of Rural Department, Government of Punjab- Member;
(c) The Regional Officer, Punjab State Pollution Control Board-Member;
(d) One representative of Non-Governmental Organisations working in the field of environment to be nominated by the Government of Punjab for a term of three year in each case– Member;
(e) One expert in the area of ecology and environment to be nominated by the Government of Punjab for a term of three year in each case– Member;
(f) Representative of Urban Department, Government of Punjab – Member;
(g) Representative of Department of Agricultural, Government of Punjab – Member;
(h) Representative of District Collector, Patiala- Member;
(i) Member of the Punjab State Biodiversity Board – Member;
(j) Divisional Forest Officer (In-charge of Protected Area) – Member Secretary.
Terms of Reference:
(2) The tenure of the Committee shall be for a period of three years from the date of issue of the notification.
(3) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(4) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(5) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(6) The Member Secretary of the Monitoring Committee or the concerned Chief Conservator of Forests (Wildlife)shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(7) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(8) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State per proforma appended at Annexure III .
(9) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
